Held Tuesday, March 16, 1976
Pursuant to due call and notice thereof, the regular meeting of t e City Council,
City of Mendota Heights was held at 8:00 o'clock P.M. at the City Hall,
750 South Plaza Drive, Mendota Heights, Minnesota.
Acting biayor Lockwood called the meeting to order at 8:00 o'clock P.M. Z'he
following members were present: Acting Mayor Lockwood, Councilmen Gutzmer,
Losleber. and Wahl. Mayor Huber had notified the Council that he ould be late.

Acting Mayor Lockwood moved approval of the inutes of the
March 2 meeting. �
Councilman Losleben seconded the motion.
The Council acknowledged receipt of a resolu ion from Inver
Grove Heights in opposition to Dakota County Board resolution
number 10 regarding special assessments. Th Council
discussed the matter briefly.
Councilman Wahl moved the adoption of Resolu 'on No. 76-14,
"RESOLUTION IN OPPOSITION TO DAKOTA COUNTY B

Mr. Johnson pointed out that the estimated street construction

o'clock P.M.
The Council briefly discussed the proposed t ail system. .
Mayor Huber cautioned that the development o a trails system
would necessitate a bond issue referendum an that the Task
Force Committee recommendations could also p ssibly necessitate
a bond referendum. He further cautioned tha the probability
for citizen approval of two concurrent bond ssues would be
extremely slight. Councilman Losleben reco ended that the �
City apply for federal funding for trails an that the trail .
committee be reactivated to compile addition 1 information
and formulate plans for a trail sys tem with the understanding
that there can be no referendum at this time The matter was
tabled to April 6.
The Council briefly discussed the Divine Red emer Ambulance
service subsidy proposal and tabled the matt r pending a
decision by South St. Paul and West St. Paul on the subsidy.
MISCEI�i.?:����OUS Administrator Johnson noted that Richard Bjo klund has been
the City's building inspector for twenty-thr e years. The
Council directed that a letter of appreciati n be sent to
Mr. Bjorklund.
Administrator Johnson stated that Labor Rela ions Associates
had submitted a bill for $750 as a retainer ee for services
in connection with labor contracts for the p riod from
March 5, 1976 through March 15, 1977. It wa the Council
concensus that the fee be approved and that t be placed on
the April 6 list of claims.
Councilman Losleben briefly discussed his si negotiations
with Country Club Markets. It was the conce sus of opinion
that Councilman Losleben continue the negoti tions and report
back to the Council.

been underway with a'76 spirit for 10 years!
But for anyane wha sees the cover ,
of Minnesota Highways and has the � �
slightly spacy feeling of being caught `
in the Zadiac — or even in the �
cross-section of a post " holiday . � #
gastro-intestinal tract, there's a bit �.
more I would like to share with you ��+► � �
about this 1976 Calendar. It's the �� �� �
continuing management £unction we �`
have for a complex planning, pro-
gramming, canstruction and main- �
tenance operation.
I have selected Fiscal Year (fy)
1975 as a way of loolcing at the principal variable aperating
activities which we administer as a result of legislative and
executive direction. Our catendar is simplified to cover only
one year, omittittg the 7 to 10 year planning and
engineering functions required to develop adequaCe road
transportation and mability in Minnesota.
Starting in the center, expenditures are cumulative and
radiate toward the perimeter. They are nat intended to be
comparative between functions but rather ta indicate the
distribution and level o£ activity by rnonths according to
the three seasons we seem to have at MHD. Based upon the
cash flow of variable costs, we can see that from November
through June we are glanning and preparing the bu2k of our
specifications for Iettings of raad improvement prajects.
This is the Pre-Letting period. Coincidentally, during most
of this season we are also clearing tons af snow and ice to
maintain safe roadways. Our second season is £or Construc-
tion and begins sometimes as early as April and continues
for the balance of the warm weather, aften running to De-
cember. The Close Down af the construction season comes
in September, when we will again repeat this cycle — with-
out interruption or loss of momentum.
At the hub of this calendar yau see that less than 2
percent of our manies go toward administering personnel,
fi��ances, processing payments ta contractors, purchasing
supplies, legal services.
Right of Way operations, a second major variable cast in
fy a5, represented about 5 percent of total expenditures.
Road, Maintenance in Minnesota remains a great ur2pre-
dictable because oi weather conditions and the need to
meet the �day-to-day travel demands of our �citiaens for
access to their employment and ather institurions, even to
having fire and police protection. In fy 75, maintenance
accounCed for approximately 23 percent af total annual
variable costs.
Construction Operatians represent expenditures for
planning, engineering, speciiying and constructing roadways
which are supervised by L7epartment employees. This work
far major apgrading and recanstruction accounted for
nearly 16 percent oi the total.
Highway Develapment accaunts iar approximately
one-half of the totat annual cash flow thraugh the
Department. This is money paid Co private contractors, as
directed by our legislature, and a practice which has been
effectively used since the establish.ment of MHD.
Approximately l0,OQ0 (11,400 in September '74) tax-
paying jobs are developed for each year. This partnership
between MHD employees and private contractars functions
smoothly because o£ the exactness in our planning and in
the decails af our specifications. Nearly 600 contractors
compete for highway work by offering the lowest possible
bid price according to our standards. Note that about
two-thirds of this work, mostly Financed by maCching
federal and state funds, takes place between July and
November.
Clearly, Minnesota's uncertain climate does create
difficulties for those managing, maintaining, and construct-
ing raadways. To indicate this distortion from an ideal
operatian, a perfect circle has been drawn between the hub
and the outer perimeter. If all 12 months and all functions
were conducted in Ftorida biandness, then that is probabiy
the way our cash flow would take place. The shaded area
(December to June) inside this circle indicates that the cash
flaw is less tban the manthly average and will require catch-
up activity later in the year.
Our job here at MHD is to try to round the distartion by
flattening the highest paints and raising the low spots.
Although it's a tough egg to work with, it is possible when
everyone understands and fulfills his work assignment and
our plans and prograrns get an assist from the weather.
While most of us may feel remote at a ribban-cutting, I'll
remind each of yon that ail work at MHD is important and
rnust be finished on time. fJur '76 calendar may look like a
zodiac, but we take directians from the stars we know as
friends and neighbors.

corporations have been working with and through the Minnesota Parks
Foundation, a not-fot-profit public corporation, to encourage privat
sector efforts to acquire the steep bluffs and the high ground along
the north-east side of Highway 13, beiween the City of St. Paul and a
point near Diamond Jim's in Lilydale, for addi.tion to Lilydale Region 1
Park.
That acquisition is nearly complete and the Minnesota Parks Foun -
ation is anxious to convey the property so acquired, to Ramsey County for
addition to the Lilydale Park.
The enabling legislation under which Ramsey County may acquire 1 nd
for park and open space purposes, required concurrence by the affecte
munir�;zal and County governing bodies, as a condition precedent to
acq�i�.�ition. The attached Resolution #76-347 of the Board of Ramsey
Co����3iy Commissioners declares their intent io accept the Minnesota Pa ks
Fo�a�;dation gift and to acquire any remaining interests within that ar a,
sui:�;�ect to concurrent approval by the Board of Dakota County Commissi ners,
th�_�ouncil of Lilydale and of Mendota Heights.

affected neighbors are in favor of the proposed construction of the
tennis court. We have suggested to the applicant that these neighbors
either appear at the hearing or submit their approval in wri ing for
consideration of the Planning Commission. .
7. Normally, the construction of a building so near to a side lc
contiguous to a street would be very undesirable. A tennis c
fence, however, would not in our opinion represent a signific
visual block. The presence of tennis court in a single famil
neighborhood we find to be generally a•'factor . improv�ng �
values. A tennis court generally indicates the presence of c

SUBJECT: Classification of Tax Forfeited Lands
The attached letter from the County Auditor and the two prin
indicate land ready for tax sale. 2'he two prints quite clearly
indicate the properties on which taxes and assessments have not b
paid. Z'he parcel north of Mendota Heights Road and northeast of
T.H. 55 is somewhat of a surprise, the Hildebrandt property north
Marie west of Delaware is not a surprise.
I would suggest without reservation that the Perron property
classified as non-conservation and made available for sale. The
Hildebrandt property could possibly be considered for open space
public use, however, I believe there are many reasons to be consi�
otherwise. It would appear that eventual private development of
2.2 acres would be better for the community -- rather than
develop some unplanned public facility in that location.
In summary, I would recommend that both parcels be classified
non-conservation and approved by the City Council.

AN ORDINANCE PROVIDING FOR THE HARDSHIP
DEFERRAL OF SPECIAL ASSESSMENTS AGAINST
THE HOMESTEADS OF SENIOR CITIZENS AND
PRESCRIBING THE RATE OF INTEREST THERE�N
The City Council of the City of Mendota Heights does
as follows: •
Section l. The City Council may defer the payment of a special
assessment against any homestead property of one acre or 1 ss owned
by a person 65 years of age or older when the total=amount of the
assessment exceeds $300.00 and the payment thereof would c nstitute
a hardship.
Section 2. In order to qualify for the hardship defe ral herein
provided, the property for which such deferral is requeste must have
been the homestead of the applicant on the date of the ado tion of the
resolution by the City Council ordering construction of th improvements
for which said special assessments have been levied.
Section 3. A hardship as that term is used hereunder shall be
deemed to prima facie exist when the annual installment (in luding
interest) of the special assessment to be paid exceeds 1 pe cent of
the "adjusted gross income" of the senior citizen as shown n such
senior citizen's then most recently filed Federal income ta return.
Section 4. The deferment of the payment of said spe
ment shall terminate and all amounts accumulated plus acc
at the rate of 7 per cent•per annum shall become due upon
of any of the following events:
(a) The death of the owner, provided that the spouse �s
otherwise not eligible for the benefits hereunder,
(b)
(c)
The sale, transfer or subdivision of the property
any part thereof; �
If the property should for any reason lose its
homestead status;
(d) If, for any reason, the City shall determine that
there would be no hardship to require immediate o:
