Minutes of the Regular Meeting
Held Tuesday, April 20, 1976
Pursuant to due call and notice thereof, the regular meeting of t!e City Council,
City of Mendota Heights, was held at 8:00 O'clock P.M. at the Cit Hall, 750 South
Plaza Drive, Mendota Heights, Minnesota.
Acting Mayor Lockwood called the meeting to order at 8:12 o'clock .M. The
following members were present: Acting Mayor Lockwood, Councilmen utamer and Wahl.

policy of the Council to discourage permanen cul-de-sacs
wherever possible. The Council also noted at the number of
lots in the proposed plat would not be decre sed by providing

area requirements of the zoning ordinance.
The Council also noted that the extension of the street through#

1. The property in question was brought before the November meet ng
of the Planning Commission at which time Mr. Smith requested
division of a lot into two parcels. At that time there was a dispute
between the Department of Natural Resources and Mr. Smith reg rding
the filling of the lake to expand the site. In the November 5, 1975
report to the Planning Commission (copy attached) we suggeste that
any action be tabled pending the settlement of the dispute b tween
the DfVR and Mr. Smith.
2. l�e are informed now that the action against Mr. Smith regardi
filling of the lake has been settled. We have checked with M
Harnack and confirmed this fact. It would appear that now Mr
is in a position to proceed with his request to divide the lo
two parcels. As pointed out in our attached report of Novemb
the property in question measures 218.93 feet in width and 81
in length. The proposed division would leave 84.82 feet of f
on Cheri Lane for the easterly most lot, with 30 feet of fron
the westerly most lot. This 30 feet, of course, is available
the 30 foot of street which currently exists is vacated.
3. We have discussed this with the City Engineer who feels that
important that we maintain our access and easement rights witl
30 foot street that currently is platted. If this 30 feet of
street were converted to an easement and retained for pedestr�
and utility maintenance this frontage could be utilized to at
partially qualify for the frontage requirements for the seconc
(westerly most lot).

The development of lots on a corner such as the case in point here,
normally would not have the minimum 100 feet of frontage at t e street
line itself. The 100 feet of frontage (as is the case on cul de-sacs)
is measured at the building line. It is obvious the two lots in
question have more than adequate area and so it is a question of
establishing a building line with 100 feet of width or mor at that
point. Theoretically there could be a"bulb" developed at.th s corner
to provide additional frontage for the two lots proposed. Th handling

of such a"bulb" in this design shall be demonstrated at the earing.
We question the advisability of the construction of such-a "b lb" in
the sense that it merely requires additional street to be mai tained
by the City in the future.
It should be the intent and objective of the City to create t
valuable and buildable sites without destroying the terrain o
excess street. It would appear that if the City agrees to va
street and convert the entire 30 foot width to pedestrian acc
lake (and utility easements) the platting of the land as prop

With regard ta a proposed subdivision of Lot 3$ �inden Additian �nd compiying
with your April 20th request, I comment as follows:
Sanitary sewers and water mains are available on Swan Drive adja ent to the
property. The sanitary sewer is about ]4 feet deep so there sho ld be no
problem in hooking up except that the westeriy parcel does not d rectiy
front on the sewer line.
Water services are installed by the Saint Paul Water Department. They general-
ly r�quire that a service be installed at right angies to the ma n bui 1 do
nat know haw they will handte this situation for the westerly pa cel.
The attached drawing shows the locatian of existing utility line including
the storm sewer au�let and apen ditch on public right af way whi h the develper
is r�questing vacation.
Regardless of same of the sfiatements made by the Develaper in re uesting the
vacation af that segment of Cheri Lane between Swan Drive and Ro er's Lake,
we cannot recammend such actian. The City needs the 30 foot str p for the
storm sewer outlet and access to the take. The assumption that ome sort of
an easement will suffice is nat valid in that periadic rnaintenan e is required
and the development of the property by the Owner cauTd preclude he use of
mechanical equipment far maintenance including the c]eaning of t e stilling
basin, pipe line and open ditch without restoration costs if the street be-
comes an easement on private property.
Rather than to vacate a portion or all of the 30 faat wide stree so that the
westerly parcel can have access to Swan Qrive,'we suggest the ca struction af
a hard surfaced substandard roadway ta and beyond the stilling b sin which

will allow City equipment to get to the basin and allow the privat property
to have street access. This also can permit the .construction of p blic
utitities to serve the westerly parcel. The above suggested work an be
petitioned for and be assessed against the property. The second a tached
drawing shows such an arrangement.
No matter how the matter is handled, either through the above sugg sted
construction, or through some sort of a variance, we feel very str ngly that
the 30 foot street right-of-way not be vacated.

You will recall that Mr. Magnus brought this case to your at ention
at the Planning Commission meeting of March 23, 1976. Mr. M gnus
sought concept approval during the above mentioned meeting w'th the
following recorr�nended changes; that the cul-de-sac be reduce in
length by 120 feet and that the lots be rearranged according y. This

1. Applicant is the legal counsul for the owner of lots 1+ 2 0
Heights Addition which is a four lot division of land attach
a stub street provided for this purpose in the original plat
Ivy Falls done in the early sixties. The owner of lots 1+
a very substantial home on lot 1(westerly lot of the two) w
end of the driveway on a portion of the contiguous lot (lot
the east side). He now proposes to sell the existing house
and lot 2 to two separate parties. �
2. So as to have all the driveway on lot 1, permission is sough
8'� to lot 1 from the west side of lot 2. The existing east-
of lot 1 is 153 feet, lot 2 is 154 feet. The existing lot a
1 is 36,000 sq. feet with lot 2 being 30,000 sq. feet. The
strip of land to be added to lot 1 contains 1952 sq. feet.
new lot area will be 37,952 for lot 1 and 28,048 for lot 2.
