The Council briefly discussed the staff-reco�endation that the
Cullen Avenue assessment roll be approved as roposed.
Councilman �9ah1 moved the adoption of Resolut on No. 76-60,

IMPROVEMENTS (IMPROVEMENT NO. 75, PROJECT NO. 5)."
Mayor Huber seconded the motion.
BACHELOR AVENUE Mr. E�iilio Fedeli was present regarding his s orm sewer assessmei

I am herewith responding to several letters which were submitted subseq�
to the assessment hearing for the above project in which property ot�rners
questioned the assessments and requested deferment or adjustments io thE
assessments.' After staff discussion, it was de�ermined to make the foli
recommendations to the Council: �
1. That an area assessment be levied on all �roperty which can

One,
Parcel 02700-010-09 is large with the westerly portion on a h llside as
indica-�^� by Mr. Phillips. In that a dwelling is located on the high ( asterly)
portioi� f�� the parcel, we selected an arbitrary cut-off line as bc ng th land
compatiui� �•�ith the residence and assessed it accordingly. The balance of the
parcel was considered to be beyond the limits of the sewer system and w s
omitted fre,r� assessment at this time.

Mr. Phillips suggests that an area about 63 feet wide totaling 30,712
square feet which we assessed and is below elevation 900 be eliminated f om
assessment. This is shown on an attached drawing marked Exhibit "A". I auess
this is a judgement decision. We feel that the amount assessed is fair nd
recommend no change in this assessment. .
Regarding the so-called double frontage assessment, Mr. PhilliE
a separate buildable lot adjacent to Hunter Lane, parcel 18200-010-00, ►�f
received a sewer service connection. t�Je assessed it accordingly. Mr. Pf
residence is on parcel 02700-010-09 and has a separate connection to the
sewer sys�em so we assessed frontage to ii also. We recommend no change
the assessments as calculated.
2. Larr_v Culliqan - Parcel 02700-050-10
As shown on attached Exhibit "B", Mr. Culiigan has a parcel th<
slope considerably to the west. An existing dwelling is situaied in the
east corner and is well above an anticipated sewer elevation. As Staff
discussed the matter, it was felt that the entire easterly portion of thE
would abut a future sewer extension and be.served by the system even thoi
southerly portion was low. A lift pump can very easily make this portior
buildable site. We recommend that the entire parcel be assessed but that
one half be deferred at this time. - I
3. Dr. Leo Culligan - Parcels 02700-020-10 and 02700-030-10
It has come to our aitention that Dr. Culligan is in the proce
preparing a preliminary plat for the above parcels. As indicated on att
Exhibit "C", we assessed only a portion of the parcels as being able to
served by the existing sanitary sewer system. The proposed plat will en
all of the parcles all the way to Highway 13 by utilizing a lift station
view of this fact, Staff has choosen to reconsider the original assessme
to include the 379,875 square feet tKat was considered to be outside of
drainage district. It seems that Dr. Culligan is proving to us that som
the apparent low property can be made buildable at this time. We are he
revising the assessment roll and recommending that the property owner be
notified of the change.

4. Theo. C. Van - Parcels 02700-030-08, 02700-030-09 and 18200-08d-00
Mr. ti'an requests that parcel 02700-030-08 be deferred. This i
buildable property, can be served by the sewer system and in view of the Staff
recommendation earlier in this report, we recommend against deferment.

served by the sewer in Hunter Lane, if access or easements are available�

On parcel 18200-080-00, Mr. Uan indicates an error in computa
and claims to be assessed too much for services. We have revie�aed �he

Dr. Olin requests deferment on all or most of this parcel. B

PLANNING CONSIDERATIONS:

Place
The applicant owns a parcel of land with 200 feet of frontage n
Orchard Road with a depth of 214.5 feet. The existing residen e
is placed on the westerly side of the property in anticipation
of the ultimate division of the land into two parcels with
100 feet of frontage and a depth of 184.5 feet (taking off 30 eet
for dedication of roadwa,y).
2. The results of the proposed division of the land into two equa
parcels would be two lots with 100 feet of frontage each and a
square footage of 18,450 square feet. The ordinance requires, as
you know, 100 feet of frontage and 15,000 square feet of area.
It would thus appear that the proposed division is a reasonabl
one conforming with all minimum requirements of the subdivisio
regulations.
3. The action on the part of the Planning Commission could includ �
a recommendation for waiver of other requirements of the subdi ision
regulations and approval of the proposed lot division as propo ed.

The Stacker residence is located at the intersection of Maple ark Drive
and Falls View Court. It is a large substantial house to whic
Mr. Berczyk has been hired to add a swimming pool to the prope ty.
Examination of the land would indicate that the most appropria e
place to place the pool would be on the west side of,the struc ure
along the frontage of the cul-de-sac. The property is of cour e,
a corner lot and the legal frontage is on Maple Park Drive. T e
southerly portion of the property drops off to a steep ravine aking
that area impractical for purposes of locating the pool.
2. As you know, the Ordinance makes provisions for uncovered porc es,
patios, terraces, and'other extensions of the house below the loor
line to be allowed within required yards. Such "low-level" de elop-
ment is restricted by the Ordinance to be not less than two fe t
from side or rear yard lines.
3.
Mr. Stacker proposes to place the pool as shown in the attache
drawing, six feet from the property line along Falls View Cour which
places it approximately 20 feet from the curb of the cul-de-sa .
In as much as the swimming pool is constructed substantially b low
the floor level of the home, it would appear that the location on this
side of the house near the cul-de-sac right-of-way would not i pair
circulation of air, light, or visually obstruct the openness o the
area. It would be well if inembers of the Planning Commission nd
Council vrere able to view the property prior to the hearings t
ascertain the site conditions.

' The Farrars have purchased the old Himmel house in the Spring
this year. The home is a very substantial stone and stucco ho
located north of Sibley Highway, northwest of Ivy Falls, over
the river. Though the home is a beautiful structure, the gara
access condition on the east side of the house is very tight.
The Farrars propose to correct the condition by putting an add
on the garage and reorienting the access toward the highway,
thereby eliminating a turning movement into the east side of t
, old garage.
�. The Farrars are applying for a variance to the required 10 fo
side yard setback to a reduction of six feet. The congituous
owner, Mrs. Allan T. Sullivan has indicated her approval to a
as small as five feet as verified in the attached letter. Th
have prepared a site plan drawing indicating the proposed dim
of �he structure and its relaiionship to the contiguous prope

Basketball - Letters were received requesting basketball cour s at Ivy
Falls Park. The Commission will await results of the survey nd then
set priorities accordingly.
Park and Recreation Survey will be presented to the Council a their
September 7 meeting. The survey has been prepared as a joint effort
between the District 197 Community Education Services and Men ota
Heights Park and Recreation Commission.
The 1976 Park-A-Rama came out in the black. (Financial sta

The Community Education Advisory Council requested representa ion on
the council from the Park and Recreation Commission. Witt wa selected.
The 1977 Budget - The City's proposed budget and Park Commis
were reviewed. It was decided that the Recreation Program s
more money to hire more recreational personnel...
Capital improvements - the park bond fund was $9,934 in the re
completion of the'tennis courts. That money was subtracted fz
$45,600 in the Park Development Fund leaving a balance of $36,
City Attorney says that this money can be used for improvement

would be $205 minimum. Printing costs would be $45 for insty-print or $107
for typeset for 3,000 copies.

We woul� like[to make a final report on Park-A-Rama events held this su er.
We are Ileased to report that we came out in the "black" by about $115.0 .( A copy
of our financial report is enclosed) We will use this money to begin pl ning for
next year. Although we were able to raise the money needed to pay all t e expenses
for this year, it continues to be a difficult task. We are hoping that he Council
will en�ertain the possiblity of including an amount in their budget for the next
year to`help defray the costs involved in holding this Community event.
We strolgly feel that a festival such as we have had is an asset to the oIIununity.
Althoug� not everyone in the area took part in the activities, there was something
for eve�y age group for those who wanted to participate. -
If the Council could see their way clear to helping with the expenses, a some of
the other communities do, it would make our job much easier, and hopeful y
encourage others to continue with the celebration in future years.
Our thalks to you for your support this year, including the waiving n� f'rework
permit fees.
We woul� welcome any suggestions you may have for improvement for future events.

across the Northeasterly twenty (20) feet of said Lot

SUBJECT: Petition for Street and Utility Improvements on
Mayfield Heights Lane.
In considering the above request there are several factors tha
should be looked at. The improvements being requested will be hig
in cost than usual because of several reasons. Some of these incl
the grades involved, drainage problems to be handled and the fact
the assessable footage will be restricted to the iots on the cul-d
hat
-sac.
At the present time, the sewer has been extended 100 feet into Diayfield
Heights Lane. A new project would include extending the sewer app oximatel;
200 feet, water main approximately 350 feet; and a 30 foot street 'ncluding
curb and gutter with a cul-de-sac at the easterly end.
Another consideration is Mayfield Heights Road. It has been g nerally
state@ that when Mayfield Heights Lane was constructed that would e the
proper time to upgrade Mayfielc� Heights Lane to a permanent street I
agree with that thinking although construction of Mayfield Heights Road
will be difficult as well for some of the same reasons as Mayfield E�eights
Lane . -
Another consideration is the fact that the petition represents�only
25� of the parcels that will bear the cost of the proposed improve ents.
To be better inforr.led as to estimated costs, more detail on dr inage,
and properties to be effected, a standard feasibility by our Engin er
would be required.
