On October 8, 1976, President Ford signed a law which author

Service expects that acquisition funds will be available at hat time.

2. Idealiy, it would be helpful if a study could be made of the ra
land development patential in the area south of Wentworth (to
P�arie Avenue}, wes� af Delaware {to Dadd Road}. Such a study c
indicate aptianal ways in which to provide future access to thi
fine developable land so that the Flanning Comr�issi�r, and Counc
wauld have a basis for considering this subdivision and others
likely to come along in the future. Such a preliminary study w
done by yaur consultant about 15 years aga for the major land
awners in the area at that time. Perhaps land oarners in the ar
stiil have copies of that study. Hopefuliy, some of the land
awners affected in the area will be at the .public hearing to di

1. The current owner of the property consisting of approximately seven
acres is William G. Smith, who purchased the land from the Bill
Sweeney Estate following Bill Sweeney's demise in the early 60's.
Mr. Smith now proposes to sell the land to Paul Joyce and Rob rt
l�lallner, who propose to divide the land into separate parcels.
2. P•1r. Joyce is purchasing the old Sweeney home witn approximatel
172,630 square feet of land with frontage on Delaware Avenue.
Mr. Joyce has no intention of further dividing the land at
the moment but could do so in the future utilizing the extensi e
frontage on Delaware Avenue.
3, Mr. Wallner is the pu rchaser of the remainder of the land by
which he intends to divide the property into three lots as sho
on Plan 1 in the attached drawing. These lots would be 44,100
square feet, 36,880 square feet, and 51,670 square feet. This
plan proposes a dedication of a half street on the west side
of the property providing access to the interior of the land t
the south and west of the property in question. Provision for
the dedication of this street was a suggestion by your consult
as a means to open up the property for lot frontage for Mr. 4Ja
land and as a means of getting into the interior space to the
south and west in the future.
• 4. Mr. Wallner has an optional plan, whereby he proposes to turn
Lots 1 and 2 with frontage on 4Jentworth Avenue. This arrangem
as shown in Plan 2(attached) would allow for immediate develo
of two lots off Wentworth Avenue reserving Lot 3 for developme
at such time as the street may be constructed. Plan 2 thus, h
.some practical considerations in the event that the north-sout
'street proposed is not constructed for some period of time. W
are not aware of the feelings with respect to the westerly lan
owner, Mr. Mairs. Nor are we aware of the feeling so the rest
of the neighborhood in terms of the desirability of providing
means of access to the interior of the large block of land to

5. It would appear obvious in this case that a public hearing shoul
be held for the preliminary plat in as much as many �roperty own
ta the southwest {and directly south of the property in question
Delaware Avenue} would be materially affected by the extension
af such a street. We do feel, however, that it is important tha
arrangements be made far providing access ai same poini south af
4�entworih Avenue �o provide for future development in this area.
6. A rather sirange line that divideds the Joyce properiy fro� the
4Jal7ner property fallows existing retaining walls and fence lines
that current7y defines the developed ]and as relates to the o7d
Sweeney house.
7. The property is zaned R-lA which requires a 40,000 square foot
minimum lot, and a iot widtFi of 250 feet. Lot 2 in Plan 1 has
slightly less than �0,000 square feet, being 3b,880 square feet
as rneasured by planimeter in our office. The iot width in
Lot 2 under Plan 2 has 144 feet of frontage. In this plan,
hawever, the 7ot width is li�aited by the available frantage on
4lentworth Avenue being a tota] of 294 feet rr�ith 30 feet allawed
for the half street dedication,
8. It wouid appear appropriate for the Planning Commissian to set
a public hearing far ihe proposed plan and offer their camments
to the applicants ai the meeting of November 23rd. The key
ques�ion in our opinian is the pravisian for the north-sauth
street on the west edge of the property. Either af the two
plans, in our opinion, offer a reasonab3e delineatian of the
1and of the development af some fine single family homes in ihis
very desirable portion of the City.

RESOLUTION ADOPTING 1977 BUDGET DOCUMENT
WHEREAS, a proposed budget document for 1977 was presented
Council on September 7, 1976; and

budget was conducted on September 21, 1976; and

Wi�REAS, on October 5, 1976 the City Council adopted Resolut on No. 76-76
establishing the 1976 tax levy collectible in 1977 based on the p oposed budget
amended to include additional funding for the Diseased Tree Contr 1 Program;
and
WF�REAS, the City Council has considered the appropriations isted in the
nroposed budget dociunent and has deternsined that the appropriatio s are proper
and necessary for carrying on the business of the City;
NOW THEREFORE IT IS HEREBY RESOLVED by the City Council of tY
Mendota Heights that the proposed budget document submitted on SeF
and amended on October 5, 1976, is hereby approved and adopted as
Budget for the City of Mendota Heights.

5. Comprehensive Planning -- The recent legislation man

old 1959 plan, and the introduction of other element

be lots of staff and consultant time needed, but the
Mendota Heights Planning Commission and the City Cou

6. Street Lights

street lighting? What should we tell the people who
a light in their immediate area. This is a governmer
service that was not included in our basic levy limit
and any appreciable increase will require unique or
radical financing.
B. Policy Enforcement
1. Wetland Ordinance.
The new Wetlands Ordinance, published in late Decembe
will only be as meaningful as we apply it. Pictures
were taken of the known dump or fill sites before sno
fall. We intend to contact such land owners, advisin
them of the ordinance requirements and begin the
enforcement process. This will require considerable
staff time in the future such as:
a. Noting fill areas and monitoring all building
permit applications -- comparing the applicat
with the official map;

Contacting and working with the applicant;
Receiving and processin g the applications

2. Increase of Sewer Rental G`harges
The recently completed Sewer Service Charge Study
documents the need to increase sewer charges. The Stt
recommends about a 25� increase, but even this amount
may only be a temporary situation. Early action is
needed, so that bills can be computed before March 31.

B. Long Ra.nge
1. Public Works Garage -- When?? The need is increasing
not decreasing.
� 2. Elevated Water Tank -- Northland is actively promotin
the Industrial Park. The reliability and capacity of
water to the Southwest corner is of utmost importance
if we intend to cooperate with the developers.
3. The termination of the Friendly Hills Water System
Franchise in 1981 (1956 plus 25 years) may even be
a part of the elevated water tank discussion.
III. NiISCELLANEOUS
A. Move City Hall offices into new quarters, approximately
- May, 1977. New meeting room (Council Chambers) will need
some special designed appointments and outfitting.
B. Statements (by elected officials) made at the North End
Hearings indicated that we would attempt to get West St.� aul's
contributions to the storm sewer cost. This has not been as
of this date.
C. Park and Recreation activities should be re-assessed now
all Park Bond monies, and nost of the Special Park Fund
monies are used. This is currently being studied by the
Park and Recreation Commission.
