Helci Tuesday, January,4, 1977
Pursuant to due call and notice thereof, the regular meeting of
City of Mendota Heights, was held at 8:00 o'clock P.M. at the C

Clerk-Treasurer Radabaugh administered the Oath of Office to

Mayor Lockwood called the meeting to order at 8:05 o'clock P.M. The following
members were present: Mayor Lockwood, Councilmen Losleben, Merte sotto, Schaberg
and Wahl.

COMMISSION It was noted by the Council that the terms f three Planning

on January 31. Mayor Lockwood recommended hat the Council
members consider the matter and be prepared for action on
January 18. The matter was tabled to the J uary 18 meeting.
CIVIL DEFENSE The CoUncil discussed a memo prepared by thf
AUXILIARY (Civil Defense Coordinator) and submitted t�

Administrator JohnsQn briefly outlined the ewer Service
Study distributed to the Council on Decembe 7.
After a brief discussion, Councilman Losleb n moved that a
special meeting be held on January 11 at 7: 0 for the purpose
of discussing the Sewer Service Charge Stud .
Mayor Lockwood seconded the motion.
PLANNING COMMISSION The Council acknowledged receipt of the min�tes of the
December 28 Planning Commission meeting.
CI�SE NO. 76-24, Dr. Leo Culligan was present to request app oval of the
CULLIGAN preliminary plat for the Valley View Oaks A dition.
Mr. Lawrence Culligan explained the plat, d stated that the
proposed plat consists of 21 lots, all of w ich meet the
lot size requirement, Lot 10 consisting of 6,000 square feet.
Mr. Wayne Tauer, of Suburban Engineering, e lained the •
sanitary sewer, water and drainage details. He also noted
that at the present time there are no plans for Outlot A, and
that Outlot B will be deeded to Lawrence Cu ligan. He further
explained that Dr. Culligan and Mr. Ted Van have agreed to a
utility easement between Lots 4 and 5 to br'ng utilities into
the Van property.

WALLNER,/JOYCE explained the preliminary plat for the Wall er/Joyce Estates,
explaining that two lots would have frontag on Wentworth
Avenue, and one lot would front on Delaware Avenue.
After a brief discussion, Councilman Losleb n moved approval
of the preliminary plat of the Wallner/Joyc Estates. �

The Council acknowledged receipt of a memo f om the City
Administrator outlining several matters of m icipal concern.
Mayor Lockwood briefly outlined the memo for the audience.
The Council acknowledged receipt of a memo f om the City
Planner regarding the proposed frontage road along TH 110
from Lexington Avenue to Hunter Lane. Counc lman Losleben
outlined a recent meeting with Department of Transportation
personnel regarding the frontage road. Coun ilman Losleben
stated that_the D.O.T. personnel indicated t at if the
Council could reach agreement on the propose location of the
frontage road, they would attend the next Co cil meeting
with plans for location and layout. He furt er noted that
the D.O.T. indicated that the City would be llowed to
conplete the engineering and construction an that the State
would reimburse the City for the costs invol ed. The Council
discussed the matter and concurred with the lanner's
recommendation that Plan 3 of the report was the best location.

Pursuant to due call and notice thereof, the special meeting of
City of Nendota Heights, was held at 7:30 o'clock P.M. at the Ci

Mayor Lockwood called the meeting to order at 7:30 o'clock P.M. The following �
members were present: Mayor Lockwood, Councilmen Losleben, Merte sotto and Schaberg.

SEWER SERVICE Mayor Lockwood noted that the purpose of the special meeting was
CHARGE STUDY for the discussion of the Sewer Service Char e Study distributed
on December 7. Administrator Johnson review d and outlined the
original study as well as the supplement dis ributed at the
beginning of the meeting.

I am writing on behalf of �he Church Council of P,oyat Redeemer L theran Church
of Mendota Heights. Our concern is in reaard to the application for a ondittonal
Use Permit by the Sons of Jacob Congregation to construct a synagogue a the corner
of Highway li0 �frontage road) and Hunter Lane.
As the formal petition of those opposed to the const•ruction of t e synagogue
indicates, our parish does have property available and had been in conv rsation with
the Sons of Jacob Conqregation and had made them an offer whereby we wo ��d sell them
half of our remaining property and share with them a comnon parking lot,

that they needed more space and now have found the location they desire

above. l�►e ►tiottid have been very happy to iave had them as our neighbors and still
would for t"� �,:matter. However, being that they have found property mo e to their
liking, our Church Council strongly feels that they shoutd be permitted to locate at
the spot and to construct their building. `�

A favorable judgement has been rendered in favor of Richar Sheehy
concerning the suit with Snyder Brothers. Please be aware that
Snyder Brothers has a thirty (30) day period in which to ap eal their
case to the Supreme Court. Of course, we have no way of knowing if
they intend to appeal their case or not and, therefore, we are not
able to start construction until this matter is completely esolved.
With the information I have received in regard to the final replatting
from both Mr. Sheehy and Milner W. Carley and Associates wh are
doing the replatting work, all�drawings are nearing':their f'nal
stages and should be ready for submitting to the City for i s �
approval in the near future.

One majar fire call was received during the month of�D cember,
Early on the morn�.ng of Decernber 28, 19'76 {0455 hours} we w re called
to 531 Fremont Ave, �or a house fire. The temperture was -- and the
wind chill was -35. Bath occupants were asleep at the time the fire
s�.arted in the kitchen area of �.he residence. Francis Haf� ly awake
and smelled smoke, he got his mother up and they ca2led our depar�ment.
When Officer Olmstead arrived he found the �wo occupants by the front
doar. The house was filled with smoke, Mrs. Ha�fley did na want to
leave the warmth of the house da ta her heart problems. Be ause the
smake was so bad she did go out to the squad and wait �or t e ambul-
ance that had been called. The first fireman an the scene were un-
able �o enter the house because af the smoke, they went to he rear

SUBJECT: Sewer Rate Study, Second Supplement
The following is submitted in response to requested informat on resulting
from the January llth discussion. At that meeting, I believe tha it was agreed:
(1) additional receipts are necessary; (2) the existing minimum r sidential rate
should be changed in a minimum way; (3) the sewer rental receipts need not
necessarily equal total sewer service costs; and (4) due to I/I, ome portion ,
of the total sewer costs should be tax supported. Since�the earl er rate
proposal of $8.00 minim�m would result in different receipts than a$9.35
minimum, it was agreed that a new projection should be•made, that some future
projections should be made and further consultation with the Metr politan
Z�Jaste Control Commission was necessary. In the interim, these ma ters have
been reviewed.
The 32� per 100 C.F, rate with a$9.35 minimum was calcula
results of that are as follows: .

PrQjections
Part of the discussion involved the projection of total financ
sewer service in future years. The =ollowing chart is hesitantly �
it is a very rough assembly of figures that may have some relevancE
operations. For flow projections and cost projections, I have lool
earlier figures and merely tried to project similar increases. ThE
total costs are set forth in a very "seat of the pants" manner. TI
represent a 6� annual increase. Z`his may or may not materialize, 1
seems to be a reasonable ex_planation -- without any future rate mai

In response to the Metropolitan Waste Control Commission cri eria, I had
a long talk with a Mr. Don Madore. He indicated that a consisten 32� per
100 C.F, rate is "certifiable." He indicated that as long as all users paid
32� per 100 C.F, that such a rate would be looked on with favor. The fact of
a minimum in the $9.35 per quarter range seemed entirely reasonab e to him.
He noted that the metro sewer billing amounts to approximately 35 per 1,000
gallons and that our rate, which is higher, would also be expecte . In other
words, I got the unqualified impression that the proposal under c nsideration
would be entirely acceptable to both the Metropolitan Waste Contr 1 Commission
and the E.P.A.

associated drawings is submitted for your information. The Count
is again asking for our concurrence in placing several tax-forfei ed
parcels on the auction block. I recommend that we classify the
Somerset Hills parcel as non-conservation, however, I recommend t at the
non-platted parcel in Section 23 be retained under public o�mersh p.
I would especially call your attention to Ed ICishel's feasib lity
report for the Mayfield Heights improvements. It is uncanny that the -- � _
Covnty would advise us of tax forfeit property and at the same ti e
we receive a report from Ed indicating a ponding area on the subj ct
parcel. I assume further discussion is necessary, but I would ur e your
consideration in peiitioning the County for public ownership of t e
unplatied parcel identified as 27-02300-040-52.

Dear Orvil:
As directed, we submit herewith a feasibility report in conn ction with
the proposed installation of sewers, water and streets for Mayfield Heights
Lane off of Mayfield Heights Road as shown on the attached drawin s,
Exhibits "A" � "B".
The proposed development of Mayfield Heights Lane leads to s veral
connecting problems which should be looked into at this time and esolved.
We refer to the fact that surface waters in the�vicinity must be emoved
satisfactorily and that the existing oiled gravel driving surface on Mayfield
Heights Road is a source of constant maintenance because of a ste p 12q
gr.ade causing erosion due to surface waters. _
Surface waters are generated over a fairly large area including portions
of Highland Heights and Hightand Heights South. The drainage dis rict and
subsequent flow is as shown on the attached drawing, Exhibit "C". The
natural slope of the drainage district concentrates run off to Ma field
Heights Road or the valley east of Mayfield Heights Road over whi h Mayfield

Neights Lane is ta be constructed. This presents a probiem in can action
with anticipated starm sewer construction, one in which properties other
than thase in the Mayfield Heights Subdivision may be required to articipate
as far as cost is cancerned. The uttimate autlet for surface wate in this
part of Mendota Heights is to State Nighway 13 and thraugh a 15 inc cuivert
under State Highway 13 into �ilydaie. This is the natural directio of
flow and no apparent other ways ar means for disposing of these wat rs
are readily availabie. 7his means that the State Nighway Departmen will
be invalved in any final planning as may be the Gity of Lilydale or roperty
owners in Lilydale adjacent to State Nighway 13.
So as to minimize the effect of surface waters from portions of Nightand
Heights and Highland Heights South, we have considered the possibili y af
constructing a halding pond on a parcel af land which is naturatly lo and
has nat been developed as yet. 7he canstruciian of a dike to build a pond
and an autamatic overflow facitity through a storm sewer in Mayfield eights
Road can controt most of the surface waters and permit better develop ent
af the build'abte iots and parcets. This is as shown on Exhibit "D".
Exhibit "E" indicates anather method of picking up surface waters
which flow naturaily to Highway 13. To minimize these flaws thraugh p ivate
praperty, Exhibit "E" suggests natural flows ta Mayfield Heights Lane here
the water can be picked up and conducted through a storm sewer on Mayfi ld
Heights Lane and Mayfield Heights Road to State Highway 13. .
The deveiapment of Mayfietd Neights Lane requires the canstruction of
storm sewers as shawn, as a minimum. In that a partian af Mayfietd Hei hts
Road will be disrupted for proposed storm,tisewer construction and resurfaced,�

sewer system for the entire drainage area and rebuild the street as
the overall project. We approve of this latter method and suggest
favorable consideration.

The construction of sanitary sewers, water mains and streets or� Mayfield
Heights Lane will follow standard practice. Stub sewer and water l�nes off
of Mayfield Heights Road are available. Thirty-foot bituminous str�ets with
concrete curb and gutter are contemplated.
The existing driving surface on Mayfield Heights Road consists�of an
oiled graveled surface varying in width from 16 to 20 feet. It is r}arrow
because of physical obstructions and a limited nominal 50 foot righ of way.
The installation of storm sewers on this street wilt probably requi e the
removal and reinstallation of an existing retaining wall at 1666 Ma field
Heights Road. When reconstructed, the location of the wall can be r�ove
to provide for the construction of a 24 foot roadway. Together witF� an
upgraded bituminous surface, Mayfield Heights Road will be more in onformance
with other City streets in older residential areas.
The following constitutes our estimate for the various construc�tion
possibilities in conjunction with serving proposed Mayfield Heights
public utilities.
SANITARY SEWERS

$5,770.00,including fees and contingencies. Services will add $1,94 .00 for an
estimated financing cost of $7,719.00. With about 640 feet of asses�able front-
age, the estimated unit assessable cost is $g.00 per foot.

$1.2� to $1.50 per foat.

STREETS
The construction of Mayfield Heights Lane will consist of a 30
bituminous surface with concrete curb and gutter. It will include
foot

borrow material, deep black base and surface and a standard cul-de- ac,
all to serve four lots. The estimated cost for this work is $26,00 .00
including fees and contingencies. Total estimated assessable front ge,
including the side lots along Mayfield. Heights Lane, is 750 feet re ulting
in a unit assessable cost of $35•00 per foot. This is high compare to some
of our recent projects but there is a lot of blacktop for a short s reet
and a limited amount of property being assessed. lt may be possibl to
modify the street design to decrease the original cost but other pr blems
will develop as far as surface water control and storm sewer constr ction is
concerned. Care should be exercised in making quick decisions with regard
to downgrading the proposed street construction.
As indicated earlier in this report, full control of surface w ter in
the Mayfield Heights vicinity should be considered at this time. T do so
will require the establishment of a drainage district, the developm nt of
a holding pond with overflow and the extension of storm sewers on M yfield
Heights Road south of Mayfield Heights Lane as shown on Exhibit "D". The
extension of storm sewers will require the reconstruction of the st eet
surface on the entire tength of Mayfield Heights Road involving ano her
facet of the proposed project.. The parcel of land on which the pon ing area
is suggested, consists of about 1.8 acres of low land which has not been
built on and is wet during extended periods as the collection spot f�or surface
water runoff. To construct the pond and build the storm sewer as sh;own,
will cost between $24,000.00 and $25,000.00 including fees and contiingencies,

but not the pond site. �Assuming an acquisition cost of $7,000.00 t
$8,000.00, the total storm sewer cost could reach $32,000.00 to $33,000.00.
An enlarged drainage district, as shown in Exhibit "F", will encomp ss about
1,000,000 square feet of potential assessable area. Assuming that 11 potential
�assessable area will pay for the complete sotrm sewer construction as shown,
the unit assessable cost is estimated to be between $0.03 and $0.03� per
square foot.

Other methods of cost sharing can be considered, one of which ight
be to assume the Tilsen properties wilt pay for the pond constructio�n
(land and actual construction), while the Mayfield Heights area will pay
for the physical storm sewer construction. On this basis, the pond is
estimated to cost $11,000.00, white the storm sewer will cost $22,00 .00.
With 734,000 square feet of area, the Tilsen portion is estimated to cost
$0.015 per assessable square foot. With 328,000 square feet of asse sable
area, the Mayfield Heights area will cost between $0.06 and $0.07 per
square foot. There may be other combinations,_ but the above appears to be
a reasonable way to finance the proposed storm sewer construction to resolve
drainage problems in the entire district.
The matter of reconstructing Mayfield Heights Road is one that �an be
very controversial. The construction of Mayfield Heights Lane will omehow

Secause af existing conditians, a deciston must be reached as t the
type of street construction to be considered. We refer to a street ith
curbs to contral surface water and traffic, or a curb-less street as is
there now but with an upgraded surface. Again, street construction n
Mayfield Heights Road will be mast difficult because of the steep gr de,
existing private walls, driveways, trees and the inability to change the
grade appreciably because of existing water and sewer installatian. As
indicated earlier, the maximum driving surface width that may be ins a11ed
is 24 feet. A 24 fiaat street wi�h curbs allaws far limited an-sfiree
parking.
Because of pr�vious controversies and limited available assessa le
frontage, we are recommending a maximum 24 foot driving surface with no
curbs, To reconsfiruct Mayfield Neights Road, as discussed, will cos

area by constructing a hqlding pond and additional storm sewers.
5. Because the existing driving surface of Mayfield Heights Road is such
that an unusual amount of maintenance has and is required, the m tter
of resurfacing and upgrading the street with a permanent bitumin us
surface should be considered in conjunction with the proposed co struction
of Mayfield Heights Lane.
The proposed work is needed, is feasible, and is herewith reco ended
for construction. •
Because matters other than the petitioned construction have bee
discussed in this report it is suggested that the Council review thi
document, determine to what extent public improvements should be con idered
for this area and then set a public hearing for discussion with the roperty
owners effected by any proposed construction.

SUBJECT: Destruction of Records �
I would like to request your approval and adoption of the at ached
Resolution. This resolution will allow us to request State appro al to
destroy a large amo`unt of material which is both unnecessary and 'n all
cases outdated. The information which is being considered for
destruction is outlined in the attached form.
Timely approval by the State will allow the destruction of t ese
materials prior to our relocation in our new office space, and wi 1
save us both a considerable amount of space in the new quarters d
a considerable amount of time in transferring our documents and�
£iles and equipment.
