Pursuant to due call and notice thereof, the regular meeting of t e City Council,

The Council acknowledged receipt of the 1976 Annual Financial �
Statement and associated memo from the City dministrator. Aft�

Avenue and Hunter Lane. Councilman Mertens tt.o expressed

Administrator Johnson stated that the staff ill have to meet
with the D.O.T. representatives, asking them to prepare
preliminary plans for the frontage road and o advise the City
of the right-of-way requirement. It will th n be necessary to
advise the Sons of Jacob of the area of the ight-of-way ded-
ication necessary and to obtain an agreement from them, and
proceed from that point.

as submitted.
Getting back to the application for Mr. Kassan's property, I ubmit the
following information in response to your February 1 direction.
1. Adjacent Property Ownership. Our records indicate t at
Mr. and Mrs. Alfred Johnson own Lots 39 and 30, adja en
to Lot 31 on the south side, fronting on Dodd Road. Th
Johnsons also own Lots 9, 10 and�ll, south and west f
the subject property, each of these lots fronting on
Chippewa. The Johnson's home is located on Lot 10, he
southern edge of the home being located on the north rl'
lot line of Lot 11. Their home faces Dodd Road and as
an address of 1105 Dodd Road.

2. Assessments. On November 12, 1963, the City assesse
Lot 31 $450 for sanitary sewer and $390 for water
(total assessment of $8`40). No payments were made b;
the original owner. In May of 1968, Mr. Michael Kas
purchased this tax forfeit parcel from the County fo
$1,500. On January 15, 1971, the County submitted $

Attorney Winthrop's interpretation of the State Statutes on ssessments
on tax forfeited properties is that we can legally assess the dif erence between
the original assessment plus interest from the date of originatio until the present
ti.me, excluding the County assessment payment. This would mean t at the
original $840 assessment plus 6� interest per year (on what tirould have been the '
annnaJ, balances had the monthly installment been paid) from 1964 hrough the
present would amount to a balance due of $1,304.22. After deduct'ng 'the County
payment of $516.51, we arrive at a figure of $�787.71 which can be assessed
against the lot. According to Sherm, in order to place this parc 1 on the i
assessment rolls we must either formally notify Mr..Kassan of thi assessment
and conduct an assessment hearing, or Mr. Kassan can voluntarily ccept the
assessment figure and sign the necessary papers waiving the heari g. If the
assessment is levied, the Council must then establish an assessme t payment
period and the associated interest schedule.

that would put a moratorium on the taxing of all home impro em
This bill is coauthored and supported by the Chairman of t e
Tax Committee, Chairman of the Housing Commitiee, and
Chairman of the Energy Committee. The only stipulation o
the bill is that the homesteaded structure must be five year old
or older, and the improvement must not increase the squar
footage of the structure itself. As a state we must stop
discouraging the upgrading of residential property, includ'ng
desperately needed energy saving improvements .

trail plan for the proposed Dodd Roa�s. This project meets the criteria as set
down by the Federa� R_id Urban Program. We reco�ranended that Ho ard proceed with

view of public works operations and a brief summary of ass ciated
costs and statistics.
Because this is the second annual report presented, a portion of
this report will be devoted to reviewing tlie goals set for 1976
in the report on year ago and comparing how many of those oals were

sponsored by the 1�7.innesota Asphalt Pavers As ociation

retain original service. �ti'here frost heaves occurred, these areas w
excavated out and refilled with stabilization materials and�then bla
top�,ed to iti's original condition. On sections of streets where set
occurred, partial overlays of bituminous were laid to insure better
condi-cions. Chippewa Ave. should be considered seriously in the fut
by the council for a complete overlay due to the settlement occurrin
It would be less expensive going this route then'to wait for any len
time and have to replace the complete street. Another street; Emer
kve.(t�etween Dodd and Delaware) is also in very bad condition. This
has not been oiled for many years. The street dept. has the option,
either turning it back to a gravel street which could cause a dust p

The �treet Dept. updated all the regulatory signs in 1976 to comply
with Federal standards and ti•�ith the manual on Uniform Traffic Control Devices
for S�ree�s and High��ays. �► total of 27j man hrs. were spent on this
project. I�ian hours, ea�uipment hours, the cost of signs and posts ��er
all submitted to the State of r�inn. which totaled a cost of �$,636.48 .
The State absorbed all but �836.65 oi the total cost.
Snowplowing procedures went very smoo-Ehly t�rith no major problems. Ve
feer complaints came in from our residents. The two trucks and grader are
assigned to their particular areas. Periodically their routes are re ersed
so that the same areas are not Glways last to be plowed. In my opini n I
am proud and very satisfied in the way my snowplowing cre�•� is keeping
our streets r.,aintained in the winter.

I feel that Public 4�iorks are versetile enough that the three departm nts
can help each other out when needed. In 1976 the Street department elped
the Par�•:s dept. construct 2 pedways; one at Friendly Hills, and one t
Curley's Valley View addition. They also helped.in the lov�ering and in
the raising of manliole castings �aithin the city. Ihzring the winter
months Vahen there is no snow to be cle�red from the streets, the thr e
departments are busy removing diseased and dead trees along zhe west shore-
line of Rogers Lake. After completion there, they will move into Va ley
Fary i,�here there are also a lot of diseased trees. .
Since the beginning of Public GJorks in 1�iendota�Heights and up till n;
��Je have fulfilled all abligations and services our residents require.
Looking to��Jards the future development of our community, we can forsee
a great dem�nd for more detailed service to our public. The answer t tris
demand of more detailed service lies in the'aco.uirement of much neede
equipment, and a new public �aorks garage to r�aintain and store the e ipment.
Combining the skills of our three de�artments t,�ith good equipment, I eel

The budget proposal contained a total o£ $7,500 (page 29) for publ'c
control an� refarestation. This amount was inciuded within the pr iously
au4horized "excess levies", therefare, �he above propased plan amo ts �o
$24,QOQ greater than ariginally praposed. Since the $15r004 of pub ic
control (day labor, equipment rental and other activities) prapose comes
within �he au�thority of the attached Commissioner's order, this ca be an
additianal "excess I.evy". The $10,000 subsidy can be an excess Ie under
matching grants. This o� course is in the anticipation that the S ate will
make monies availab�:e for such subsidies in the future, and this wa ld seem
to be an understatement. In summary, the additional $24,000 expend'ture
falls within an a].Iowable $25,000 excess levy, therefore falls with'n levy
limitations.

There wzs a to�al of 194 man-hours devoted to training during January, 19 7. Captain
Lange, and Officers Blackfelner and Arndt attended a 40 hour Crash Injury Management
�(Emergency Nedical Technician) course at Inver Hills Community College co ducted by
the Dako�a County Police Training Coordinator. Officer Munson completed is first oi
8 weeks of the Basic Police Science Course at the Arden Hills Training Ce ter .conducted
by the Plinnesota Bureau of Criminal Apprehension. Reserve Officer traine s Murphy,
Piotraschke and Brown attended the Dakota County Reserve Officers Trainin Course for
three hours each S9ednesday night.
Semi-annua;� performance evaluations were prepared and given to each offic r during the
month. The patrolmen were evaluated jointly by Sgt. Wicks, Captain Lange and Chief Thul.

A few months ago I vaiced some concern abou�.the trapping of sznall animals
in Mendota kIeights. Contact has been made with the area game ward n
who is Paul Drys�ad. He indicatacl that trapping Iicenses are req 're8
for peaple 16 years of age and older, no ID or trap numbexs are re uired,
any type af trap is accep�able except bear �raps and it is legal t trap
any place except private property, city or village property unless an
ordinance by the munieipality is in effect.
I still believe trapping should be prohibited in the Gity of Mendo a Heights.
We should be more concerned with pxeserving of wild life than redu ing it
in cur metro area.

model ordinances pertaining to the prohibiting•of trapping and hun ing.
Attached is the ardinance in effec�. in Golden Va].ley and I urge ou adapting
such an ordinance.

SUBJECT: Equipment Needs of Public Works Department
As you all know, the City of Mendota Iieights has taken some
steps in the past few years in street upgrading and development c
of course has made some changes in maintenance of streets. In tt
years, approximately 9.6 miles of permanent bituminous streets ha
constructed. Of this total, approximately 3.1 miles has been con
stree�s added through development. At the end of 1973 we had a t
miles of permanent street. Today, that total is 27.7 miles. '�
Because the type of maintenance changes when we upgrade fro
street to a permanent street, there is also a shift of type and:

In 1976 the total material costs for base materials and asp alt mix was in
exces.s..of $6,800. There were three areas that consumed a fair ount of this
ma�eeri�t'1. They were the area on Lexington near Highway 13 that as washed out
due to a waLer main break, Woodridge Drive in ivy Falls, and C`hi pewa Avenue.
In reality, the more bituminous streets we have, the greater the aeed for
patching and the use of the equipment mentioned.

In the spring Harvey and myself will make a survey of all st eets and make a
report to you on the conditions as we see them. I personally fee that there
will be some streets that will need some rebuilding due�to what a pears to be
poor base. What the time frame will be I couldn't even suggest a of today.
In regards to equipment, there are several pieces that are e
maintenance in the Public Works Departments.' Attached is a copy

The street sweeper is brought to your attention at this time �Eor several
reasons. They are as follows: �

1. Very difficult to hire a contractor to do good work
most have old, worn out equipment that has not been
maintained. �
• 2. Dspendability is terrible among the contractors we
had.
3. The streets are swept only once a year. To do a goo job
of keeping streets and catch basins clean, sweeping houl
be done twice a year.
4. F7ith the increase in mileage of permanent streets, t e
' rental cost of about 2 to 3 years would pay the init al cost
of the machine.
, The pickup truck is needed mainly for the Tree Irispector's us . However,
it is intended to be used in whatever department has the greatest eed on any
given day in Harvey's opinion. At present, the parks department d es have only
one pickup for delivery of mo�.�ers, taxi service for suuimer help, w tering of
trees and new seed and grass areas, as well as hauling materials, tc.
