Minutes of the Regular Meeting
Held Tuesday, February 15, 1977
Pursuant to due call and notice thereof, the regular meeting of
City of Mendota Heights, was held at 8:00 o'clock P.M, at City
Plaza Drive, Mendota Heights, Minnesota.
Mayor Lockwood called the meeting to order at 8:00 o'clock P.M.

SQUAD CAR BIDS Administrator Johnson advised the Council tha no bids were
received on the_purchase of two squad cars. e requested
authorization to again request bids on biarc}h for awarding on
March 14.

CASE NO. 77-1', Mayor Lockwood noted that the application for variance to build
KASSAN on an undersized lot, Lot 31, Block 2, J.H. M rrison's
Addition, had been continued from the Februa 1 meeting.
Neither Mr. Kassan nor a representative were resent for the
continued discussion. 7.'he Council acknowledg d and discussed a
memo from the City Administrator regarding s rounding
property ownerships, past policy on similar r quests and
assessment history on the subject property. e Council
concurred that prior to consideration of appr val of the
variance the matter of payment £or residual a sessments should
be resolved. The property was purchased tax orfeit in 1968,
and the County {in 1971) submitted $516.51 to the City for
application on the sewer and water assessment for the property.

the original assessment plus interest, less t e County's
� payment, prior to granting any variance for t e lot.

Rudy Literski, Park-Department Leadman, was p esent to expand on

Pursuant to due call and�notice thereof, the adjourned meeting of

discussion revealed no concensus. 9.) Gas an Electric

indicated a desire for future consideration. 11.) Surface

BE IT RESOLVED by the City Council of the City of b�endota H�eights
as follows: �
t�THEREAS, a hearing was held on the application of Thomas E. Koepke
to construct and operate an animal hospital or veterinary clinic on
the following described property situated in the City of M ndota
Heights in Dakota County, Minnesota, to-wit:
Lot 1 of Einess Addition plus some adjoining property
owned by Brian Birch, said property being in the
Northwest quarter of Section 25 in Township 28, -.

WHEREAS, said property is situated within an area describe as a
B-2 "Neighborhood Business District" under the City's Zoni g
Ordinance, and
WhEREAS, under the provisions of Ordinance No. 123 adopted July 16,
1974 (codified'as Section 13.2(6) of Ordinance No. 401) a onditional
use permit is required to operate an animal hospital or ve erinary
clinic in a B-2 district, and
WHEREAS, a public hearing on said application for a condit'onal use
permit was held before the City Council on October l, 1974 pursuant
to notice duly given as provided in said ordinance, and

SUBJECT: Trapping and Hunting Ordinance
I have checked with the City of Golden Valley, and others,
the ordinance on hunting and trapping. I have the following to

l. The Public Safety Director at Golden Valley advised
me that the ordinance was past in response to people's
complaints on promiscuous trapping. They have not
prosecuted anyone on that basis, however, he indicat d
that it was a good piece of legislation and it has i
effect stopped the previous deleterious actions.

2. I have asked our Chief Thul for his comments. His r sponse
is as follows. "I think the trapping ordinance look real
' good. Paul Drystad (local game warden) thinks it is a
good idea due to the population of the City and the
number of animals in the City that trappers find des reable.
As I told you last week, we had several contacts wit
trappers last year and numerous telephone inquiries
regarding our trapping restrictions."
I would recommend that Sherm Winthrop be directed to prepare
Mendota Hei.ghts ordinance encompassing the same provisions for fut
Council cansideration.

RESOLUTION ESTABLISHING SUBSIDY FORMULA FOR
REMOVAL OF DUTCH ELtd DISEASED TREES
WHEREAS, the Mendota Heights City Council is deeply concerne
about the Dutch Elm Disease problem; and

�h'HEREAS, the Council is desirous of establishing a formula o
svbsidy to financially assist residents in the removal of disease trees;
and
WHEREAS, the 1977 Budget includes $10,000 for diseased tree
subsidy matching;
NOW,TI�REFORE IT IS HEREBY RESOLVED by the City Council of
of D4endota Heights that a subsidy formula be established as fol
1. The City shall reimburse residents at the rate of
$1.50 per diameter inch of tree to be removed, the
diameter measurement to be taken at breast height;
2. The amount of annual subsidy per resident shall be
based on a maximum of 70 diameter inches of trees
removed.
BE IT FURTHER RESOLVED that the following conditions must
before a resident shall be eligible for subsidy:
a. The diseased tree(s) must be located on residential
property: golf courses, cemeteries, school property,
nature centers and other related public properties
shall not be eligible for sUbsidy;
b. Trees must be "functional," trees which shade the
�"living area" around and over the resident's home;
c. Trees must be condemned and marked by the City Tree
Inspector as diseased on or after January 1, 1977;
d. Property owner must abide by the laws and restrictic
set forth by the Department of Agriculture as inter�

Upon Orvil's direction, I wish to submi.t to you the following
information regarding the equipment proposed for the Public �4orks
Compressor -- A new s5 CFP4 unit is proposed. It is to be gaso ine
powered. The estimated cost is approximately $5 700
to $5,800.
