Pursuant to due call and notice thereof, the regular meeting of
City of Mendota Heights, was held at 8:00 o'clock P.M, at the Ci
Plaza Drive, Mendota Heights, Minnesota.

Administrator Johnson stated that the propos d project was not �
initiated by petition from most of the resid nts involved, but
some of the City's past lack of action on dr inage facilities in
the area has made it necessary to hold a he ing to explain

He noted that hearing notices had been publi hed in the Sun
Newspaper and that copies of the notice had een mailed to all
affected property owners. The project was a tually initiated
as a result of a petition for improvements b owners of
property located on Mayfield Heights Lane, h wever, a good
share of the surface water drains into the a ea from the
Highland Heights area. He noted that there ould be no use in
allowing development on Mayfield Heights�Lan until there is an
outlet for surface water. The Engineer prop ses that the '
surface water that flows in a northerly dire tion be picked up �
in an underground pipe at Douglas and James ith an auxiliary
pick-up east of the intersection, pipe the w ter into a pondingl
area, control the volume of water flowing ou of the pond, use a
pipe line down Mayfield Heights Road and do to TH 13 into a�
natur�l drainage area. It is proposed to st re the runoff in the
ponding area and meter the water out under c ntrolled conditions,
so that the water flow will be somewhat like it was before any

development occurred in Highland Heights. e proposed
improvements are as follow: Mayfield Heights Lane - sanitary
sewer, water, storm sewer, street and curb a d gutter. the
§treet is proposed to be 30 feet wide. A 24 foot bituminous
surface is proposed for Mayfield Heights Roa , along with �
concrete curb and gutter and drainage impro ments. The Highlanc
Heights area would only receive storm sewer provements. The �
estimated costs are as follow: sanitary sewe ,$7,700 or an
estimated cost of $9.00 per front foot; wate ins, $5,400 or an
estimated $6.25 per front foot; street $29,0 0 or an estimated �
$35.00 per front:foot on Mayfield Heights L e and an estimated
$22 to $23 per front foot. The estimated co t of storm sewer
construction is $65,000, or approximately 6� to 74 per square
foot. It was noted that the Council is awar that some of the
properties abutting Overlook Road were asses ed 2� per square
foot for a partially completed storm sewer s stem in 1969.
Following the verbal presentation, the City dministrator
gave a slide presentation of the present dra nage characteristics
of the area involved in the hearing. �
City Engineer Kishel explained some of the p eliminary �
engineering details, including the fact that since the area
is on the edge of the Mississippi River Corr dor Critical Area,y
the Metropolitan Council will most probably nsist that somet�iing
be done in the future, and that the costs wi 1 probably be �
very excessive at that time.
Acting Mayor Mertensotto asked for questionsland comments from
the audience.
Mr. Stanley Karon, 1764 Douglas Court, sugge ted that the �

water as at present, going to the same place as at present, 1.

Mrs. Marian Clemens, 1040 Sibley Memorial Hi hway, stated that
she is the former owner of the Mayfield Heig ts Lane property,
that the property has never been developable because of the
drainage conditions, and that she objects to the proposed
improvements because of the assessment costs

fundamental reason for the project seems to e to bring the
Mayfield Heights Lane property up to a level of developability.
He also stated that he did not feel that the people were given

Acting Mayor Mertensotto pointed out that th Council must

future and must plan ahead. There is no con rolled drainage
system at present, and the Council must take into consideration
the fact that some time in the future the Me ropolitan Council
may impose drainage control requirements.
Acting Mayor Mertensotto thanked the propert owners for
attending the hearing and commenting on the roposed project.
He again requested that the property owners o wish to make
written comments submit those comments to the City Clerk prior
to the March 15 meeting.

As the result of considerable discussion regarding storm sewers a�nd storm
sewer assessments at the Public Hearing on March 1, we are taking int consideration
some of the pertenant points brought out and, as directed, are submit ing another.
supplement to the original feasibility report dated 7 January 1977 fo proposed
public improvements in the Mayfield Heights and Tilsen's Highland Hei hts areas.
In retrospect, it appears that one of the major differences of o inion at '
the hearing deal.t with the method and amount of contemplated storm se er assessments
proposed for the various sections of drainage district. Another poin of concern
was the need to extend an underground line on Douglas Court to interc pt drainage.

how and where surface water piped in Mayfield Heights Road would be disposed of
at or across Highway 13.
Taking the last item first, it is our intention to spill the wat r into a
culvert under Highway 13 and let it flow as has been done for many years.

Regarding storm sewer assessments, we have given considerats`an ta twa
different ways of assessing and leave the f'snal decision to the Cou,ncil.
In order to add credence to the infarmation submitted i� this repo t, we
have taken steps to accurately determine the amount of area, in sq are feefi, ,
that is being used for estimated assessable costs. The cost figure�s to do
the work are still based on our best judgement o� costs ta do the
catagories of work. As a visual aid, we have taken Exhibit "H" fr

two separate drainage districts, one to apply to storm sewers serving Ma field
Heights Lane and Mayfield Heights Road north of Mayfietd Heights Lane an one
to apply to storm sewer facilities serving Tilsen's Highland Heights and Highland
Heights, South.
Some discussion at the hearing alluded to a separation of surface w ter
responsibility and suggested a division of construction costs north and outh of
the holding pond. After having had a chance to contemplate on this, we o not
agree entirely with this concept and suggest one of two other methods as described
below:
METHOD A
To provide storm sewers for Mayfield Heights Lane only can be accom lished
as was shown on exf�ibit "B" in the initial report. To do this work will cost an
estimated $18,600.00. With 291,801 square feet of assessable area, the nit
assessable cost will be $0.0636 per square foot. �
The construction of storm sewers in Highland Heights will requ.ire a
holding pond and overflow pipe on Mayfield Heights Road to Mayfield Heig ts Lane.
It is suggested that all storm sewer construction costs south of Mayfiel Heights
Lane be assessed to the Highland Heights drainage district. To construc the
sewer lines, holding pond and overflow pipe to Mayfield Heights Lane wil cost
an estimated $45,700.00. With 739,53� square feet of assessable area, t e unit
assessable cost will be $0.0618 per square foot. Using this type of cos
distribution indicates that, realistically, the cost of the entire proje t should
be distributed equally over all assessable property.
METHOD B � �
Another method of cost'sharing considers the fact that responsibility
for surface water flows from the Highland Heights area cannot terminate t the
holding pond. This means that the cost of the pipe line construction on Mayfietd
Mendota Heights - 4 -

Mayfield Heights. The Highland Heights drainage district is more than

Cancerning the proposed storm sewer project which was
at the March l, 1977 hearing, I caffer the following:

It is my opinion �hat it would be grossly unfair to ask the
iandowners of proper�y directly north of the proposed s reet
improvement project in Mayfield Heights to bear more th n a
fair share of the cost o� installing storm sewers to ma e such
a project feasible. Although it is �rue that these sto m sewers
wou2d offer same bene�it to �hese landowners, I'tn certa'n �hat
yau wi11 agree that the mast benefit from this project i11 go
to the developers who have petitioned for the s�ree� im rovements.
Since these developer� apparently have acquired these n w unbuild-
able lats for very minimal. costs (prabably back taxes), and since
they wa.3.I pas� a1Z of the assessments charged them tor 'mprovement�
•' ��on to ��:he purchasers af -these- lo�s, you are asking us, he land- -
��owners f��rth of them, to contribute �o their prafit on he ven�ure.
If we ar� to pay anything fo� this project, it would se m ta me
that the ;,nr.oper amount wauld be anly for that which wou d be

In other words, I am asking for three levels of assess ents
which will most accurately relate benefit to cost. Th
developers of Mayfield Heights who reap the greatest b nefit
from the project should bear all the costs from a port on of
the ponding area north to the river. Thae landowners f Overlook
Road and Douglas Court should bear all the costs of ex ension of
the project from and through their property and togeth r with
the remainder of the other landowners also bear a fair share of
of the costs of the project from.Douglas and James Roa s�to and
including a portion of the ponding area.
If the share of the project was originally to cost the landowners
of Highland Heights and Highland Heights South 7� per quare
foot, I am suggesting that it would now cost the devel pers of
Mayfield perhaps 12�, the landowners of Overlook and D uglas
��� -��Court�-5�, •�a•nd remainder -of the� landowners in the affec ed area
2� per square foot.

of the property assessed. There is no benefit to my prop�

I am writing in regard to the proposed storm seWer and street i�
ment project involving the Mayfield Heights and the west portion of ]
�ieights areas in Mendota Heights which was discussed at the March 1,
ci�.� council meeting. T, like most area residents present at the me�
am 5irongly opposed ta the storm sewer portion oi �he project effect:
th� H��hland Heights area for the following reasons:
l. Being a resident of the Highland Heights area, I fail to se
real direct advantage of the proposed storm sewer system ov
open drainage system currently present wizh �the possible ex
of alleviating the occasional standing water at the Douglas
James Road-Douglas Court intersection. Much of the standin
pr�blem could be alleviated if the road were properly pitch
provide drainage to the open system present. This should h
been properly drained at the time the open culvert was plac
under the road in that area. The estimated cos� of seven c
square foot to be assessed to all properiy owners Capproxim
cost of $1500-2000 per lot) to provide for the storm sewer
seems a ridiculously high price to pay for correction of th
isolated drainage problem at the above-mentioned intersecti

prohibits the filling in of nat�ral swampland in Mendota Hei hts.
Tf this is true, the lots mentioned in point number 3 above houl
not be allowed to be developed since these are swampy and wo ld
require fill for development.
I appreciate the opportunity to make these points known to you a
trust you will g7.ve serious consideration to them in arriving at a fi
decision on the proposed project. If you feel there is justification
the storm sewer po�tion of the project that will involve the Highland
Heights area, T�incerely hope every effort will be made to distribut

BACKGROUND
Attached to �his letter is a drawing of the land in question in the
in�r�3ediate area overlayed on the City's topographical maps at a scai
of 1'" = 200'. The nominal eight acre tract in questian is indicate on
th� drawing west of Warrior Drive, in addition to the 1ot owned by he
Schooi Board fronting on Knob Raad. Contiguaus to the eight acre p rce1
in the north, yau wi71 nate a 20 acre parcel purchased by the Schoo
District s�hor�ly after its acquisition af the high school site. Th's

parcel, known, as the "Schanno Property" was purchased as a potential
elementary schoo3 site shortly after the Board's acq�isition o-F the igh
schoal proper�Gy. As you knaw, the site includes a highly aesthetica ly
desirable ponding area with an area of very fine tree cover on the s uth-
east slope of the pond. Land east af the pond and including most of the
wooded area has heen dedicated as a"school forest" by the Board and it
is iheir intent to permanently retain this area of land irrespective of
the ultimate use af the remainder of the site.
The potential location for the e1ementary school was planned to be a
the west side of the pond. This area of land has na tree cover and c
be adequately graded to accammodate an elementary school site. Acce
to the site, however, wauld of n�cessity be from Warrior Drive via a
access drive an the north side of the pond, or fram future road exte
off Dodd Road to the west. Access from the west, however, wauld be
desirable inasmuch as it would not adversely affect the pond itself,
_�_., encroach upon the tranquility of the single family homes located
:� im�ediately north of the pond {off Callahan P1ace�. '

In �he event that the School 8oard decides to nat seil or to not dev
an eTementary schaol site or if the Board decides not to build an
e7ementary school on the 2Q acre parcel, it is conceivable the Board
may affer the westerly por-tion far sale. At that point in time, the
Board may likely ask the City if they are inierested in that site fa
park area, or ather public purpases. Planned in conjunctian with la
single family parcels to the west (fronting on Dodd Road) this site
could be we11 developed far singie fat�ily purposes. Ai this point i
time, of course, that is not the question at hand and no decisian ha
to be �ade until such time as the Schaol Board �ay wish to consider
dispc�s-itian of this site.
CITY ACQUISITION OF EIGHT ACRE PARCEL
We question the need far an active City recreaiional park in the area
substantial pnrtion of the high school grounds are developed in playi
fields which facilities are considered a part of the overall recreati
sysLem for citizens in the area. The impartant consideration in our
apinian is that the pond and the forested hillside to the southeast b
retained as an important passive recrea�ional area. We suggest that
easterly side of the pond cantaining the farested s1ope is a most
impartant element to be retained adjunct to the ponding area itself.

DEVELOPMENT POTENiIA�.

4�le suggest that the eight acre parcel should be offered for privat�
ownership, and that the land shou7d be u�ilized for single family 1�
developed in accordance wi�h ihe existing single fami7y s�andards ui
the R-1 regulations of the 'Zoning Ordinance (25,000 square foot lat:
with lOq feet of frontage). The land is currently zoned ta this
category.
As shown on the attached drawing, we have prepared a preli�inary ske
indicating what we recammend as the most appropriate way to develop
the land far single family purposes. In view of the extrer�e terrai
encountered, and the presence of clumps af trees on the property, vr
recommend the use of �wo cul-de-sacs off of Warrior Drive. This de
soiution avoids street construction thraugh �he steep slopes on the
westerly half of the property, and-does not penetrate wooded areas
-the site. Though the cul-de-sacs are difficuli ta plow, an this pa
site they N�ill result in the creation of some very desirable lats,i
of which wi71 feature "walk-aut base�ent" gossibilities, Done in t
fashion we suggest ihat same very desirable homes wi11 ultimately b
canstructed an the property.

.wooded area is in fact, on the eight acre tract. The high knob on he
�northeast corner is nat waoded and cauld thus be appraoriately grad d ta
provide desirable single family lots in that portion of the land.
Yuu will also note that the north-south dimensions of the property
�{approxir�ately 700 feet) conveniently allow the iand to be develope
with four lot modules from north to south. If the north property 1
is moved to the south, the praperty wauld be far more difficul� to
efficientiy develap. The possibiiities af using a single "L" sha�e
cu7-de-sac were cansidered but this would have necessitated grading
thraugh the high waoded icnab approximately in the middle of the pro
(and slightly to the west). The two cul-de-sac scheme retains this
wooded knob as an aitrac-iive fea�ure of several of the 1ots.

ASSIGNS, TO ERECT A GAS PTANT, AND TO USE THE STREE
ALLEYS, AND PUBLIC GROUNDS OF SAID CITY FOR THE PUR
OF INSTALLING, ENLARGING, OPERATING, REPAIRING, AND
MAINTAINING IN TINE CITY OF MENDOTA HEIGHTS, DAKOTA
COUNTY, MINNESOTA, TEE NECESSARY GAS PIPES, MAINS,
APPURTENANCES FOR THE FURNISHING OF GAS TO SAID CIT
ANI? ITS INHABITANTS, AND OTHERS, AND TRANSMITTING G
INTO AND THROUGH SAID CITY. �
The City Council of the City of Mendota Heights,
Minnesota, ordains as follows:
Section l. That there be and hereby is granted to
States Power Company, a Minnesota corporatiori, its success
assigns, hereinafter referred to as "Company," during the
20 years from the date hereof, the right and privilege of
a ga� plant.and using the streets, alleys, and public grou
City �t rlendota Heights, Dakota County, Minnesota, hereina
to as "*Z;;nicipality" for the purpose of installing, enlarg
repairing, and maintaining, on, over, under and across the
gas pipes, mains and appurtenances, usually, conveniently,
sarily used in connection therewith, for the purpose of fu
gas for public and private use in and to said Municipality
inhabitants thereof, and others, and for the purpose of tr
gas into arid through said D•iunicipality, provided that such
mains, and appurtenances shall be so located as in no way
with tne safety and convenience of ordinary travel along
streets and alleys, and provided that Company, in the ins
enlargeT�nt, operation, repair, maintenance, and removal
pipes, r;iains, and appurtenances, shall be subject to such
regulatinn as may be imposed by the Municipal Council.

Section 2. In erecting, installing, enlarging, rep�
maintaining, moving, removing, or replacing said gas pipes
and appurtenances, Company shall, in all cases, place the

Section 3. Whenever the P4unicipality initiates a F
improvement which requires the removal, relocation, or rea
of Company's facilities located on public streets, alleys,
Company, upon reasonable notice by the A4unicipality, shall
its facilities without charge to the Municipality; provide
foregoing shall not deprive Company of any right it may ha
State law to be reimbursed for any relocation, removal,�or
ment required for the improvement or construction of a Fed
aided high��ay project; and provided further, that in the e
or state grants are made available for financing any of su
improvements requiring relocation of Company's facilities,
shall be reimbursed for such relocation irom the Federal o
funds available. The foregoing shall not be construed so
require the Municipality to reimburse Company out of local

Section 4. Except where the vacation is for the pri
benefit of the Municipality in the furtherance of a nublic

such gas pipes, mains, and appurtenances until the reasonab

Section 5. Company shall indemnify, keep, and hold
its officers, employees, and agents free and harmless from
all liability on account of injury to persons or damage to
occasioned by the construction, maintenance, repair, remova
operation of Company's property located in, on, over, under
across the streets, alleys, public ways, and public grounds
Municipality, unless such injury or damage is the result of
negligence of Municipality, its employees, officers, or age
results from the performance in a proper manner of acts rea
determined to be hazardous by Company, but such performance
theless ordered or directed by Municipality after notice of
determination by Company. In the event that suit shall be
against�Municipality under circumstances where the above ag
to indemnify applies, Company, at its sole cost and expense

promptly given to Company within a period wherein Company i

given as hereinbefore provided, Company shall have no duty
nor defend. If Company is required to indemnify and defend

Section 6. The rates to be charged by Company far �
in the Municipality shall be sub�ect to the jurisdictian o:

efficient and adequate service to members o� the public wi1
Municipality who apply for such service in accordance with

one time only. The new Com Key 718 is set up for $333 per month f r the first
three years, then $215 per month thereafter. One time installatio is $101.
I have computed this on the basis of seven years in the new

Top Patrolman Pay For Officer Bridger
As a result of several conversations I have had with you regarding
matter, I am submitting this memo as my recommendation that OfficeY
Bridger receive a pay raise, retroactive to February l, 1977, that
place him at the pay level for patrolman with over 3 years service.
Officer Bridger began his employment as patrolman in Mendota Height
August 8, 1975. Prior to that time he had served as a police offic
2 years 8 months in Baldwin Park, California, and 8 months in Uplan
ifornia. He received 409 hours of basic police training at Rio Hon
Junior College, DJhittier, California and was certified as a peace o
by the California Commission on Peace Officers Standards and Traini
After beginning his employment with our police department he underw
passed the Minnesota State Certification Testing Process which mean

In 1973, streets in the Somerset View Addition were reconst�-ucted
:�ith bituminous surfacing. Because of potential assessment prob ems,
F_merson Avenue was not included as part of the project and there ore not
s�srfaced. This relatively short segment of roadway is used cons derably and
havi��3 a graveled surface has required a great deal of maintenan e without
improving the riding qualities.
Because the existing roadway is quite stable, it makes for n adequate
base for a bituminous surface. We are quite confident that by s aping the

existing surface and placing a two inch bituminous surface, it will be possible
to construct a hard surfaced standard city street without curb a d gutter.
Because surface drainage does not appear to be a problem if the xisting
grades and alignment are not disturbed, we are not recommending he installation
of curbs. The existing 24 or 25 foot width should be increased o 30 feet as
a minimum. This will entail some regrading of ditches and shoul�ler placement.

Normal financing of a project af this nature is to assess abut ing
praperty for the wark. In this case the entire sauth side of Emers n abuts
the Somerset Country Club and about one-half af the narth side abut
properties that have double facing lots an Coieshire Lane and were ssessed
in 1973 for the surfacing of Coleshire. We do have precedence for ssessing
double facing lots in that it was dane in T975 when Ashiey Lane was averlayed
and the same properties had been assessed in 1973 for work an Baebe Avenue.

Nir. F�nilio Fedeli was present regarding his storm sewer assessment'
objection. City Engineer Kishel exolained that e lot drains
totally into �he storm sewer system and recomr,i2nd d �hat the
assessment remain as proposed. Administrator Joh son noted that
the correction of possible drainage problems at . Fedeli's
driveway should be considered from a repair stand oint and needs ,
further investigation. It was the Council concen us that the
assessment should remain as proposed and the Admi istrator was '
directed to look into fhe driveway drainage probl m. ,

Mr. John Fahey, a review was made of the proposed assessment on
his property. The study revealed that there had een a property

It is the intent of these specifications to describe a tandem stee wheel
vibratory roller in sufficient detail to secure bids on comparable equipment.
