Mayor Lockwood called the meeting to arder at 5:00 o'clack P.M. e iollowing

After a brief discussion, Councilman Wahl ma ed that �.he Fury

The Council acknowledged receipt of a supple ental feasibility
study from the City Engineer. Councilman Me tensotto briefly
outlined the March 1 hearing for the Council and audience.
Mayor Lockwood asked the Engineer to review he supplemental
report for the Council and audience.
Engineer Kishel stated that based on Council direction and
suggestions made at the March 1 meeting he h s prepared a
supplemental report. As the result of one o the suggestions,
underground pipe dwon Douglas Court south of James Road has
been included in the proposed construction. He noted that one
of the major differences of opinion at the h aring was the
proportion of proposed storm sewer assessmen s for the various
sections of the drainage district. Based on this consideration
the supplemental report modifies the origina report by dividin�
the originally proposed drainage district in o two separate
districts: one applying to storm sewers serv ng the Mayfield
Heights Lane and Mayfield Heights Road north of Mayfield Height�
Lane, the other applying to storm sewers se ing Highland
Heights South and Tilsen`s Highland Heights. Two possible
assessment methods were considered in the re ort. Method A
indicates that it would be possible to provi e storm_sewers
for Mayfield Heights Lane only, installing t e system on
Mayfield Heights Lane and on the portion of ayfield Heights
Road north of Mayfield Heights Lane to T.H. 3. The estimated
cost is $18,600, or approximately $.0636.per square foot. The
installation of drainage improvements in Hig land Heights would
require a holding pond and overflow pipe on ayfield iieights Ro�
to Mayfield Heights Lane. The estimated cos of such
improvements using Method A is $45,700.00 fo an estimated
assessment rate of $0.6�8 per square foot. M. Ki.shel suggested
that the proposed assessment rate be the sam for both portions
of the district if this method is used.
Mr. Kishel outlined Method B, stating that t is method consider:
the fact that the responsibility for surface water flowing
from the Highland Heights area does not te nate at the
holding pond. He stated that the cost of pi eline construction
on Mayfield Heights Road must be borne by th Highland Heights
drainage district as well as the properties n Mayfield Heights
Road and biayfield Heights RQad. The estimat d costs to be
charged to Mayfield Heights area properties ased on this methoc
would be $14,600, or an esti.mated cost of $0 05 per square foot,

approximately $52,300.00 or approximately $0 071 per square foof
Mayor Lockwood asked for questions or comment�s from the
Mr. Michael Posnansky, 1041 Douglas Road, st ted that he feels �
_ that the project will benefit the Mayfield H ights residents and
objected to having to bear a portion of the ssessments equal to
or greater than the Mayfield Heights residen s.
Mayor Lockwood pointed out that the owners o homes on high
ground have no right to continue to allow r off from their
property to flow onto lower properties witho t ever paying for

control of the water. �
Mr. Stanley Karon, 1764 Douglas Court, state that the Iots on �
Mayfield Heights Lane were recently acquired by people who do not
now live in Nendota Heights, and those peopl had petitioned
for the improvements. He stated that he fee s it is unfair
for Highland Heights residents to be assesse for the drainage
improvements when they would not see any dir ct benefit from �
the project and the Mayfield Heights Lane pe ple would receive �
a definite benefit while paying a similar ra e. He stated
that the lots on Mayfield Heights Lane are 1 w lbts and prcbably,
were very inexpensive and that the project, o be assessed �
against the more expensive Highland Heights ots as well, will
increase the value of the Mayfield Heights L ne properties. �
He felt that the Mayfield Heights Lane prope ty owners should
have to pay all or a considerably larger por ion of the drainage
improvement costs. He stated that he adaman ly opposes the �
proposed project on that basis and would not support the project
if he must bear any portion of �he assessmen . �
Mr. Clifford Bolin, 1680 Mayfield Heights Ro d, stated that the
Aiayfield Heights Lane lots are not marshy ar as, the cul-de-sac
is in a marshy area, but the lots are facing west and are on a
rise. He stated that the majority of the wa er problem is
caused by runoff fxom the Highland Heights a ea.
Mr. Posnansky stated that if a proposed asse sment rate were
more equitable in his opinion, he would not bject to the ,
project.
There being no further questions or comments from the audience,
Councilman Mertensotto moved that the hearin be closed.
Councilman Wahl seconded the motion.
The hearing was closed at 9:05 o'clock P.M.•
Mayor Lockwood advised the audience that'�the Council will
discuss and hopefully make a decision on the matter at the
April 5 meeting.
On behalf of the City Council, Mayor Lockwoo presented a
Certificate of Appreciation to City Administ ator Orvil Johnson
in recognition of his twenty-five years in c'ty management.
Mayor Lockwood called a recess at 9:15 o'clo k P.M.

PLANNING CONSIDERATIONS:
The property in question is zoned B-2, located on Dodd Road north o
Highway 110 adjacent to the Tom Thumb Superette. The property is
developed as an animal hospital with a single building of approxima ely
2,40� square feet of floor area. The existing development was approv d
by a Conditional Use Permit in October, 1974 subject to approval of
the dr�ainage plan and conformance with the zoning code requirements
The petitioner seeks approval of a'building permit for an addition
approximately 1,000 square feet to the existing building: �
If the original Conditional Use Permit referenced a site plan,any +ame dmE
or addition to the development would require an amendment to the
Conditional Use Permit and the necessary public hearing process.
Fiowever, where the Conditional Use Permit does not reference a specific
;ite plan or developmznt plan, the normal building permit process w uld
be sufficient. It is recommended the City Attorney's opinion be so ght
on this question.
The zoning code allows an animal hospital by Conditional Use Permit
the following conditions:
1. No noise from the operation of the facility shall be
discernible beyond the boundaries of the lot.
2. Odor control shall consist of a ventilation system �
designed so that no odors or organisms will spread
between wards or to the outside air.
3. An approved system shall be provided for storage and
disposal of dead animals off the premises.
4. Large yard facilities for indoor excercise of such
animals shall be provided.

5. No outside pens shall be permitted.
6. When abutting residential districts, an approved screenin
and landscaping plan shall be filed and developed along
the property boundary lines that abut the "R" District.
7. Hours of operation shall be approved by the City Council.
8. Off-street parking facilities shall be provided of at
least the ratio required for professional offices...one
space for each 200 square feet of floor area in the buildi

The new building with tlie addition will total 3,400 square feet of floor
area which will require 17 off-street parking spaces. The submitt d
site plan indicates the provision of the reauired 17 spaces.
The property owner indicates that the addition is an expansion of t
facilities and is not a major change in operation. Basically, the
hospital will continue a similar operation schedule. The building
indicates that odor, sound, and dead animal storage will be contro'
in a similar manner as they are presently.
Architectural building materials are of the same quality and style
the existing structure. The basic landscaping plan will not be ch
from its existing condition.
In summary, the proposed additioh appears to be in conformance witt
zoning code requirements.

In February of 1975, the Mendota V�Iater Company put into effect,
with city approval, a water ra-te structure of the same s that
used by the St. Paul Water Company at that time. This ype of
water rate structure was a compromise to the minimum ra e structure
previously used and was to be given a one year trial. ur audit
for 1976 and 1975 shows losses of $4,045 and $9,220 for each year
respectively with an operating loss carry-f orwaxd of ap roximately
�23,000.
^ In order to curtail our continuing operating losses and
reasonable return on our investment as provided in the �
village ordinance, it is imperative we petition the cour
revision in our rate structure. Based upon our projectE

Requirements
PLANNING CONSIDERATIONS:
1. The subject property is a lot of record zoned R-1, Single Family
Residential, located at the intersection of Kay Avenue and Vic oria'"" `
Road. �
2. The applicant has already moved a house onto the site and he p oposes
to situate the house 20 feet from the front property line (the
Victoria Road right-of-way) instead of the required 30 foot se back.
This lot was created in a triangular shape by the acquisition of
the right-of-way for the movement of Victoria Road to allow ro m
for the construction of Interstate 35E. The lot has an odd sh pe
and although the house could be situated within the 30 foot se back,
the resulting rear yard would be diminished in area.
3. The lot is located on a curve of Victoria Road and therefore t e
20 foot setback would not create an abnormal front yard when v'ewed
in terms of the neighborhinq properties which are developed as
single family residential. '

1. The subject property is a single family lot zoned R-1, Single amily
Residential, located at the corner of Mohican Court and Pueblo Drive
(7441 Mohican Court). The �etitioner is asking a variation��fr m���
the front yard setback requirements in order to construct a do ble
car garage in front of the existing double car garage, with the
intention of converting the existing garage into a family room
The petitioner has obtained statements from adjoining property
owners and others in the neighborhood. There were no objectio s
to the construction of the double car garage among the people who
submitted statements.
2. The subject property is a corner lot and although there is an opportunity
to locate the new garage in the back yard, there exists an enb nkment
which would require extensive excavation in order to develop t e proper
grade and it would diminish the rear yard area that presently xists.
3. The garage would be located 92 feet further forward than it sh uld be
which gives him 212 feet in which to park his car within the f ont_
yard.

Given the situation of a corner lot, the existing grades, and
excavation problem, and the statements of support from the adj ining
neighbors, it would seem that the proposal would be reasonable

1. The applicant purchased this loi measuring 143 feet by 303 fe

to construct a home and two car garage. -
2. The proponent has submitted a site plan identifiying the locat
of the proposed home on the property. The two side yards measu
20 and 49 feet in depth which are far in excess of that which i
required by Ordinance: The reason, however, for the Wetlands F
request is that the proposed front yard is 70 feet in depth res
in a proposed home being constructed 76 feet from the creek whi
fl o�vs through the subject property, thus placing the home within
feet of the drainageway/creek.

It is worth noting that the reason the proposed building is bei g

It was also noted by the applicant that during the past year, 1 nd-
scape improvements on the property have been conducted includin
the clearing of dead trees, anticipating the construction of th's
proposed home.
lr� "The purpose of the Wetlands System Ordinance is to provide for he
protection, preservation, maintenance, and use of Mendota Heigh s
wetlands and water resource related areas to maintain the natu al
drainage system, the minimize the disturbance which may result
from alteration by earth work, loss of vegetation, loss of wild ife
and aquatic organisms as-a result of disturbance of the natural
environment, or from excessive sedimentation; to provide fo'r pr -
tection of potable fresh water supplies and to insure safety fr m
floods."

The Ordinance further requires that such wetland permits shall
processed in accordance with the procedures specified for
conditional use permits and in this regard the following stipul
tions are set forth for your review with regard to your
consideration of this request:
a. Run-off from the property during and follotaing construction
may be directed to the wetland (drainageway/creek) only whe
reasonably free of silt, debris, and pollutants. This is
- required so as to not increase water turbidity or disturb
wetland vegetation as the result of run-off rates in excess
-- •-of that-which'presently-exists under the natural conditions
b. The Ordinance requires that the proposed floor elevation
of the proposed building must be at least three feet
above ihe highest known water level and the proponent
has indicated that the lowest floor of the proposed home
-� -rwill be 3.92 feet above the top of the creek bank. �� �
Actual elevations of the highest known water mark for the
creek should be confirmed with the City engineer.
c. Removal of vegetation within the Wetland District but
outside the wetland itself shall be limited to that
� reasonabl�� required for placement of structures and the
use of the property. It would appear that on a basis
of the extent of landscaping, the owner has already
conducted on the property, that in all probability, the
removal of vegetation would consist only of that which
is required for the placement of the structure.
d. In the event that a drainageway or swale is created for
purposes of directing surface water run-off from the �
proposed home, the rate of run-off should not exceed that
of the natural conditions and any increased run-off should
be detained prior to discharge into the receiving creek/
drainageway. . '
: 5. The proponent has not provided a detailed topographic map with
`� contour intervals,of two foot or data concerning the highest k
' . water level of the creek.

--� " - In view of this fact, it would appear appropriate that prior to ��
issuance of a building permit, the following information be rev'ewed
by the Cit,y Building Inspector regarding its conformance to the
Ordinance.
a. Site topography with contour intervals of two foot noting
the highest known water level of the creek's. �

b. A site plan showing the limits of grading, extent of
vegetation removal and manner in which excavation is going
to be disposed of. -
c. It was indicated on the site plan that there is four foot �
---- of silt excavation to be conducted with back filling of
a controlled compacted fill. Silt is a highly eroidable
soil type and as such, the proponent should provide the
Building Inspector with a plan to control erosion during
construction. This may include�temporary stabilization
of the disturbed soils by the use of anchored straw mulch
in the event that establishment of a permanent ground cove -
is not practical. This may reduce erosion up to 80�. In .
the event that a drain swale is created or one does exist
naturally, the straw bales should be placed along the
swale prior to water discharging into the receiving draina e- .
way/creek.
6. It would appear that the Wetlands Permit request is a reasonab e
one, however, prior to the issuance of the building permit,
review of the above mentioned items should be conducted by the
Building Inspector.

RESOLUTION APPROVING WETLANDS PERMIT AND
ATTACHING CONDITIONS Ti�RETO
WF�REAS, a naturaZ drainageway/creek flows through the southl
of Lot 4, 4�Tillow Springs Addition; and
WE�REAS, said Lot 4, Willow Springs Addition falls within a
District as delineated on the City's P7etlands Map; and
Wi�REAS, Mr. Lawrence Goff has submitted an application for
Permit preparatory to constructing a residence on said property;

CaHEREAS, on March 22, 1977, the Mendota Heights Planning Co 'ssion
considered said Wetlands Permit application and reconanended its prova
subject to conditions outlined by the City Planner; '
NOW THEREFORF IT IS HEREBY RESOLVED by the City Council of
2iendota Heights that the public hearing for said permit appiic
rEquired by the "v7etlands Ordinance, be waived; and
BE IT FURTHER RESOLVED, that a Wetlands Permit be approved
Lot 4, Willow Springs Addition, subject to submission to and a
the following information by the City Administrator:
a. Site topography information with contour intervals
two foot, noting the highest known water level of
creek;
?�, Site plan showing the limits of grading, extent of
vegetation removal and manner in which excavation is
going to be disposed of;
�. Plan to control erosion during construction, possibly
including temporary stabilization of the disturbed so
by use of anchored straw mulch in �he event that
establishment of a permanent ground cover is not prac
in the event that a drain swale is created or exists
naturally, the straw bales should be placed along the
prior to water discharging iato the receiving drainag
creek.

1. The property in question is zoned B-2, Neighborhood Business District .
and it is presently developed as a Tom Thumb Superette. The

levFl at the base of the sign. The drawing submitted does not
�indirate the height of the proposed sign. The Ordinance does r
perm�i°i: the pylon sign to be located closer than 20 feet from a

Wetlands Permit Waiver
1. On March 21, 1977 Mr. Dick Bjorkland, City Building Inspector,
called our offices regarding the appropriateness of the Wetlan
Ordinance requirements with regard to development on the above
referenced lot. Mr. Bjorkland had indicated ihat in his revie
of the property and the proposed development, a Wetlands Permi
was not necessary.
2. On March 22nd, I personally viewed the property to determine i
drainage characteristics in relation to other major drainways
the area. The following comments are made i•n this regard:
a. You wi71 note from the attached Exhibit 2 that the south-
eastern portion of the property is traversed by a drainway
which naturally flows in a southwesterly direction through
the subject property.
b. You will also note on Exhibit 3 that the natural continui
of the drainway shown on Exhibit 2 has been interrupted
due "to topographic modification occurring sometime in the
'past, perhaps when rough grading of the subdivision was
conducted in anticipation of homesite and road constructi
c. Field inspection confirmed this break in drainway continui
and clearly indicates that there is drainageway headwater
on the south side of Maple Park Drive between Lots 17 and
as shown on Exhibit 3. It is also apparent by field
inspection, that surface water run-off drains generally
to the east from the subject's eastern boundary into the
existing City ponding area and flows under Maple Park Driv
via a culvert and then continues south and westerly in
the natural drainway.
3. It was apparent from field inspection that the proposed constri

5. You will recall that the preparation of the Official Wetland
Systems Map was based on available topographical information,
map data, Dakota County soils survey, and the Surface Water P4a
ment Plan. We feel that the map is very accurate but at the s
time acknowledge that past alterations of the land may have oc
on specific parcels making compliance to the letter of the Ord
inappropriate. This is, of course, why the Ordinance provides
flexibility in the review of Wetland Permit Applications.
6. It would appear that no violation of the Wetlands Ordinance is
involveci and no unusual development requirements would be recor

1. Minutes of the February 24 meeting were approved.
2.
Parkorama. John Larson, Greg Walker and Greg Quehl representing the Pa orama
committee made a request to the Commission for partial funding of the Parko ma.
After considerable discussion, a motion was passed to recommend to the City Council
that $300 be committed to the Parkorama budget for this summer. The commi tee wa's
grateful for the recommendation and also suggested that we mighfi consider this when
preparing budgets for 1978, when that time comes.
3. Archer . John Larson reported thafi the archery range was in good condition and also
volunteered to serve as an instrucfior for a six week archery course for the su mer
recreation program. .
4. Playground Equipment. Greg Quehl, representing fihe Jaycees, indicated t at they
would be willing to work with us on the construction of playground equipmen this
summer. The Jaycees were responsible for the construction of the playgroun equip-
ment at Somersefi School and indicated that they had two engineers thafi desi ned that
playground and they still have the plans for that particular equipment. Considerable
savings could be accomplished with this volunteer labor to construct this equ pment.
Johnson indicated that a grant requesfi to CETA had been made for several po itio�s,
including a carpenfier and if that grant is awarded, this individual could also help with
that construction. A motion was made 4nd passed that fihe City Planning D partment
begin preliminary design work on playground equipment to be constructed at Friendly
Hills and Wentworth Parks this summer. Johnson wil) coordinate fihose plans ith the
Jaycees and it is expected thafi by the next meeting a budget and preliminar design
will be available for the Commission to review.
5. Election of Officers. An unanimous ballot was cast for the Nominating Com ittee's
slafie of officers. The officers for the coming year are Liz Witt, chairman; J rry Finn,
vice chairman; Gary Gustafson, secretary.
b. Spring�Summer Recreation. Ms. Witt reported that Louie Selander has been
very hard on the summer recreation program and that the brochure would be
on May 10. Several new ideas for programs will be forthcoming at that tim

7. Dodd Road Pedway. Johnson reported that no progress has been made since
meeting. Dahlgren is si-ill working on the FAU funds grant and that applicat

8. Valley Park Trail . Mills and Witfi reporfied that they had made an inspectio of the
Trail and find two bridges in need of repair. They also suggested extending he oufier
forks at the end of fihe trail and making that a circle. The center fork at the north end
is also in need of repair and clean-up. Johnson has been in communication ith NSP
and they are willing to permit us fio mark a firQil across fiheir property undzr fi e power
lines �hat would connecfi up with the Cherry Hills public area, fihus permittin access
to the park by trail from the north. Johnson will follow through with thai- p oposal.
9. Toro Parkmaster Lawnmower. A memo was presented from Harvey Franzmeie indicating
that this particular piece of equipment cannot be effecfiively utilized under t e present
program of park maintenance. Since this is a reel fiype mower and we are n t spraying
weeds, it is difficult to keep the parks looking neat whereas a rotary type mo er would
more effectively cut the type of turf we have in our parks. There was consi erable
discussion regarding the merits of selling this piece of equipment and purchas ng a
' replacement rotary fiype equipment. It was agreed that Jerry Murphy would ead up
a committee to meet as soon as possible that would include 2 or 3 Commission members
and someone from the Park Maintenance Department, who would then report ack to the
,Commission in May for a final decision. -
10. Kiwanis Project. Orville reported that heihinks that all the funds the Kiwai
have been allocafied, but Gusfiafson was instructed to contact Richard Buehl
there is still a possibilifiy of obfiaining funds from them for construction of pla
equ i pment.

due principal amounts and then "plug in" into the going assessment. Apparently
at this time, the Vans would prefer to have fu�ure buyers pick up e original
assessment and of course then should expect to pay the going rate f interest

There may be other ways of approaching this, but in response
request, I would reco�unend that the Council assess the $6,052.50 0
