Councilman Losleben pointed out that the Coun il has determined
that the project is feasible and necessary an stated that he
does not feel that the s�orm sewer assessment estimate is
excessive. It was his impression tha� the re idents see the
need for the project, and object only to the ost.

� Mayor Lockwooc� noted that although it was an ounced at the

tonight, none of the residents who objected o the project
are in attendance. He noted that apparently the residents
have considered the project, talked with the Council members
since the hearing, and realize that the prop sed project is
a good one. 'I'he Council also concurred that if the project is '
approced, the storm sewer assessment rate sh uld be the sa*ae ,
for the entire district. Mrs. Rhoda Mains, 071 Overlook Road,l
s�ated that she does not object to the propo ed project, but
asked if some consideration would be given t the fact that
Overlook Road property owners had paid a$0. 2 square foot I
storm sewer assessment in the past. The Co cil a�vised i

MENDOTA WATER The Council acknowledged receipt of a letter rom the Mendota
C�MPANY �9ater Company requesting an increase in water rates.
Attorney Winthrop advised the Council that a ublic hearing is
required before any action can be taken on th request. The

City Planner Dahlgren was present to discuss iting for the
proposed public works garage. Mr. �ahlgren r sponded �o
several items contained in a repor� prepared y Councilman 47ah1 ':
relative to location of the facility on Freew y Road. He I
stated that although there is an industrial u e currently on t
site, this was existing at the time the origi al zoning '
ordinance was adopted and was thus "grandfath red" in. He
not feel that it would be appropriate for the City to locate
an industrial type use in an area zoned resid ntial. He also
noted that when the TH 49 overpass over TH 11 is constructed,
the site in question will be highly visible. The public works
garage and associated outside storage would n t be particularly ,
pleasing, visually, �ro:n the bridge. He felt that location of
the iacility on this particular site would be adverse to good
land use and planning principles and concepts He recommended
that the City officials consider acquiring pr perty north of .
Mendota Heights Road, on the west side of Lex'ngton Avenue.
He noted that the property is already properi zoned for such
a use, it is in proximity to the geographical center of the
City, and Civic Center site, and it would be ossible to locate
an elevated water tank on the site. He recom ended that the City
acquire approximately 5 acres of property for the public works
garage and water tank site.

PLANNER AIDE Administrator Johnson advised the Council tha it would be
possible for the City to employ a Planner Aid to assist in
preparation of the comprehensive plan updatin via CETA funds.
The position would be for a one-year maximum uration. He
also noted that a candidate had been referred by CETA, has
been interviewed, and appears to be qualified to assist the
Planner.

Pearson reccmmending acqLisition of an easemen over the
Ione Swanda property in connection with Ivy Fa ls West Second

for $1,500. The Council concurred with the re ommendation.

In response to your letter dated February 18, 1977, you
stated, "Discussion on your variance application was con-
tinued to March 1 in order to allow response from you
prior to a decision on the variance." However, extra
time and money was required to procure legal advice and
to decide rejection or submission.
Your letter further states, "It is the opinion of our Cit,
At�torney that a residual assessment of $787.71 is legally
chargeable to this lot as a condition of variance approva:
It is the concensus of the Council that variance approval
wot�Id be feasible based on the collection of the assess-
ment figure." I will have to agree to place this assess-
ment back on-the assessment rolls for payment over the
balance oi�the original assessment period (through 1981),
if variance is approved.
I ask co��sideration, and request a final decision at the
next council meeting so I may develop this lot; thus,
retuxn-i_n� this lot to a taxable state.

Last fall, the City of Mendota Heights extended Spring Street to Par
Road (unopened) which adjoins our property. In so doing, all of the
trees, brush, weeds, etc. were removed up to our property line and t

1. Children from the Spring Street neighborhood now have easy acc ss either
on foot or bicycle and come onto our property', usually at nigh . There
have been repeated acts of vandalism such as throwing stones a and
breaki.ng outside porch ligh�s and sidewalk post lights; litter ng our Zawn
with pop and beer cans and bottles, etc; and minor theft. Als joggers
or those out for a�oalk find it convenient to come down Spring Street,
across our lawn and continue on up Ivy Hill Drive.
2. When it rains, dirt and sand from the regr.aded but unsodded ar
Partition Road runs down onto our lawn causing serious damage.
We respectfully request that the City take prompt remedial action to
these two serious problems and repair the damage to our lawn before :
worse. Please let us know what action you will take.

local unit of government. The purpose of this action wa.s to avoid addin another
permitting agency or.clearing house to an already confusing regulatory s stem.
In other words, a developer, single family or whatever., should be able t.go to
the local unit of government to get all his development or permit questi ns answered.
If you do not lmow what is said in the Interim Development Regulations, o not tell
the developer to call the Critical.Areas staff. This works against our ' tention
with the regulations. You should, however, either refer to the Interim egulations
to find the answer or personally call the Critical Areas staff.• If anyo e calls
with a question about a development, it should be the'local regulatory o ficial, '
not an individual wondering if he can merely build a single,family home r other �

stood without thoroughly reading them and working with them. You should be
familiarizing yourselves with these regulatiozs and, when presented with a

development is allowed under both your existing regulations and the Inte im
Development Regulations. If it �us,t receive EQC review, as defined in S ction I,
send the EQC a copy of the buildin� permit application and any other sup ortive
infoxmation that may be helpful to our review.. You then hold off�the lo al final
decision on the application till you receive the EQC review (a maximum o 30 days).
I repeat, you (the local unit of government) should be d(eter.nining wheth r the .
applicant is allowed a permit under the Interim Development Regulations, not the

variance. These_cases will be described here. to hapefully avaid anath.er ccurrence.
Bath cases invalve the application of the variance to the subdiv�sion of and.
To clarify �h� situation and set the recard straight, a vari.ance cannot.b used
ta jus�ify the creation o£ nanconformin.g, substandard lots. The variance can only
be applied Lc� indivi.tival development candi.tions which meet the criteria d scussed
in the previous paragraph. Allowing a subdiviszon �o less #:han the regul tion
standards wc�uld be creating unbuildable lots. The lots would be unbuilda le
because anyone buying �d wishing to build an the Iots w�uld have to rece ve a
variance f'rcm the regulations. The varian.ce could not be given because o the
secand var�.�nce provision, that is, Lhe lar�do�.-ners crea�ed �he situation y.

A dimension variance can be granted only if it complies with all •
of the criteria"listed:
(1)
the�strict enforcement.of the setback or height restrictions,
or lot size or line of sight will result in unnece sary hard-
ship. "Hardship" as used in the consideration of dimension
variance means that the property in question canno be pui to
a reasonable use under the dimension provisions of these
Interim Development Regulations;
(2) there are exceptional circumstances unique to the roperty
tnat were not created by a landowner af ter April 2,.1975;
�3) the dimension variance does not allovr any use that is not
a compatible use in Zhe land use district in which the
property is located;
(4) the dimension variance will not�alter the essentia character
of the locality as establ.ished by these Interim De elopment

(5) the dimension variance would not be contrary to th� intent
of the Order. -

NOTE TO COUNCIL:

Several month s ago, when discussing matters of concern, the i sue of
liquor disnensing -- both public and private -- was in question. herm's
attached opinion indicates the present status, and also the necess ry
processes if we are to issue private "on-sale" licenses in the fut re.
As you recall, tdendakota and Somerset have Club licenses now -- an cannot
be issu=d Sunday licenses because of our current status. It would seem
prudent to put the "on-sale" issue on a ballot sometime in the fut re --
anticipating the reguest and desireability of having one or two qu lity
supper clubs or dining establishznents. Any quick vote in response to a
reques� would, in�all probability, generate considerably heat than light,
pmr.lotir.g highly emotional results, rather than a coaunon sense app oach.�

the issuance of "on-sale" private liquor licenses.
�� Under the provisions of Section 340.353 of the Minneso
Statutes, municipalities under 10,000 population may e
� hlish, own, and operate either "or_-sale" or "off-sale"
� liquor stores or both. Since Mendota Neights has a po
tion of under 10,000, these provisions would apply.
The Minnesota Statutes further provide that in any
::?��riiCipality in which a municipal liquor store has bee
e�tablished, the municipality may continue to operate
thP m�lnicipal liquor store regardless of a subsequent

While the provisions of Section 340.353 (Subd.'s 5 a d 6)
are not precise, in our opinion, a fair reading of t e
statute indicates that the issue to be submitted to he
voters is that of the so-called "split" liquor, that is,
a municipal on or off sale liquor store in conjuncti n
with private on-sale licenses granted to hotels and estau-
rants. If the City is operating a municipal liquor tore
at Lhe time it determines to issue private on-sale 1'censes
to hotels and restaurants, the statutes require that the
matter be submitted to a vote. If the City desires o
preserve a split liquor situation but issue on-sale iquor
licenses to hotels or restaurants prior to the estab ish-
ment of a municipal liquor store, in our opinion, Se tion
340.353 would likewise apply and the determination t issue
such private on-sale liquor licenses (while retainin the
right to establish a municipal liquor store) wc�uld h ve to
be submitted to the electorate.
