Pursuant to due call and notice thereof,_the regular meeting of th City Council,
City of Mendota Heights, was held at 8:00 o'clock P.M. at the City Hall, 750 South
Plaza Drive, Mendota Heights, Minnesota.
Mayor Lockwood called the meeting to order at 8:00 o'clock P.M. e iollowing

Mr. Carmen Tuminelly, and rL. Bruce Patterson, of Suburban
Engineering, were present to request approval f the preliminary
plat and grading plan for Eagle Ridge East. M. Tuminelly
explained the proposed plat, stating that ther will be a maximum�
of 15 townhouse unii�s constructed on the plat. In connection with
the proposed grading, Mr. Patterson submitted "before and zfter�
drainage characteristics drawing. He indicate that the trade-of�
on drainage would be equalized, the added impe ious surface �
drainage toward I-35E would be more than off-s t by the additional
drainage that was being graded to drain toward Marie Avenue and
�agle Ridge Drive. Mr. Tuminelly stated that e desires to

The Metro�olitan Council has proposed a regional tree �ti�as
plan which recognizes.open burning as a short--term manage
approach and encourages the developrlent of wood resource
systems to meet the long-term need for diseased tree sani
programs. The plan directs each metropolitan.county to c
and dP�rPlop tree waste management sites. Where possible,
facil�ties should serve the disposal needs of more than c
tree ��i_sease control program.
County tree waste management plans developed in response

sites which �neet PCA criteria and also serve adjacent sha

PRESENT SITUATION OF DUTCH ELN: IN THE HEIGiiTS

As a new season ap�roacnes; we find our selves meeting the eve
building demands of our residznts in the area of sanitation an
detection of Ilutch Elm Disease in MendoLa Heights. Public awa
ness in this arza has grown from what it has been in the past.
Our residents are demanding more service in the ar-ea of DED i.n
order to save what trees they have. After losing 700 trees in
1g76, I have projected that this number will double in 197?.
�vith �his in mind, we can see that our work load is going to i
crease. In order to keep our program under control, we will h
to jump on th� problem right away. 1de still have 7 residents
diseased wood to be removed, and we have one resident which ha
some c�arked trees still standing from last year. These proble
are being taken care of. We do have several areas which are n
showing signs of in�ection, and we will go in there shortly to
mark them for removal. �

year with Lignasan BLP. We are presently in the process of pr'cin

A Forestry related CETA student has been requestzd for to assi t

records and in issuing subsidy.
At this time we are awaiting a response on our request for sub idy
from the Dept. o� Agriculture. �fter talking with them, they ave
cor�firtned receiving our application, and now ihey await action taken
on this by the legislature. nope�ully we will hear from them n
the next few weeks.
Also at this time, we are waiting renewel of our open burning ite
permit . This permii ran out �his Nast month and now we are t ing
to persuade the PCA to give us another one. They are tighteni g
up onopen burning, and want to eliminate as many burning sites as
possible. �'hey have advised me that they have received the ap lication
and that it is being sent before their review board. We shoul also
be hearing from them in �he next couple of weeks.

CASE N0. 77-12 Mr. Joseph Dotty was present along with several other

feasibility study by the city engineer. It was noted that the Planning Commission
does not normally discuss engineering feasibility, leaving that to Coun il consideration.
Further discussion on the project feasibility ensued. Howard Dahlgren oted that we
must plan for a future development east and south of the proposed devel pment. It
was noted that the applicant had discussed the matter with City Enginee Kishel as had
Eoward Dahlgren. It was noted also that storm sewer facilities would robably be
necessary for the satisfactory development, along with other necessary tilities.
Mr. Dotty submitted a brochure on the custom-built homes when asked if he homes were
to be pre-fab. After some further discussion, Wheeler moved, seconded y Quehl to
establish a hearing for May 24, 1977 at 8:30 P.M. to hear the �atter of replatting.

Attached is a copy of a report prepared for this proposal for t e
December, 1976 meeting of the Planning Commission. Mr. Smith,
the owner, was not able to attend that meeting and has since
requested that the proposal be put on the agenda for the April
meeting of the Commission. •
At the last occassion when Mr. Smith met with the Commission, h
intended to work with Mr. Pabst (a contiguous owner to the west
on the possibility of making allowances f or the future extensio of
the street indicated on the attached skeich and discussed in th
December report. A recent brief conversation with Mr. Smith
indicated that he had not been able to make any progress with r spect
to the revisions for this street right-of-way. The question i
not really one of the 50 foot lot line division which is pro�os d.
The real question is one of whether or not we should attempt to make
some provision for the extension of this street pattern throug the
area at �his time. You are aware that the development of this
street as an extension to the industrial park to the east and t e
south completes a loop road system that is very important to th
overall circulation pattern in the hlendota Heights industrial a ea.
The Commission may wish to consider approval o� the 50 foot lot line
change on the condition that he dedicate that nortion of the st eet
extending east-westerly through his property off Pilot Knob Roa
(County Road 31).

2. In our opinion, this would create a very desirable situation oening
up the raw land for future development in a manner so as to c mplete
that portion of the raad system which would intersect with th
proposed road.
3. Perron Road has been eliminated as an access point to flighalay 13.
Thus, the proposed alignment would effectively replace Perron
Road as an east-west segment of this portion of the industrial loop
road system.
4. In a short discussion tivith Mr. Pabst after the last Planning
Commission meetina, we understand he is not particularly inte
in dedicating a roadway through his land at this time. The
a;��licant, however, has stated his interest in working out so
sort of solution. At this time the applicant is requesting t
addition of a 50 foot strip _of land to the tvro lots to the ea
as you have previously reviewed. The addition of this 50 foo
- nf land does not, of course, preclude the ultimate platting a

Sign Variance
1. The property in question is zoned "B-1". The pylon or free-sta
signs are not permitted within this zoning district. The appli
however, is requesting that a four by four foot name plate
(identification sign) be constructed in one of two locations on
either Plaza Drive or podd Road.
2. A primary reason for this request is that the building situated
on the property has a rather well-designed exterior and placeme
of a wall sign would detract from the originally intended build
aesthetics. The basis for this cor�nent is the fact that the
exterior of the building consists of dark finishes and textures
also a mansard roof exists on the building. A wall sign on a
building with these exterior and roof designs would result in a
undesirable aesthetic condition.
3. In this regard, the remaining alternative location for a name p
sign is on either Plaza Drive or podd °oad. You will note that
the attached sketch Number 2, the ov�ner has identified two alte
locations for the placement of the sign. Location Number 1 is
approximately eight feet west of the parking lot entrance drive
the second location is at the intersection of the north and wes
property lines. A site inspection of t{ie alternative sign loca
has been conducted and it is recommended that sign location
alternative Number 1 is the most preferential. The basis for t
recomendation is made on the fact �hat this type of sign is for
purposes of name plate identification and not advertising. Sig
location Number 2 is higher in elevation than Number 1, is in m
better view to Dodd Road and is a more optimal location for adv
rather than name place or identification. Furthermore, placing
sign at this location would appear to be less consistent with
building character, driveway orientation, and general site aest
�n consideration of the fact that the oU�ner/applicant has provi
i:wo alternate locations and Location Nur�ber 1 would result in 1
change from existing conditions and have least probable impact
site lines, it is recommended as the preferential location.

applicant suggests that the upright posts and sign letters will be
in a dark brown with panel background being painted white. The
sign will measure four feet in height and four foot in width a d
will be constructed and painted by prafessional sign builders.
Based on this information, the sign appears to be quite handsom
and the variance is reasonable.

Variance in Height of Fence
The applicant/owner proposes to construct a redvaood fence begin ing
at ihe eastern face of his garage and continuing towards Chippe a
Avenue parallel to his driveway. The Adams household includes
children interested in basketball and a hoop has been construct d
on the garage. Hoiti�ever, the owner is concerned about the baske ball
rolling into the neighbors yard which is at a lower elevation han
the applicant's driveway. To mitigate the concern of having th
ball and the children entering the neighbors property, the appl cant
would like to construct a redtivood fence. The pr000sed fence is
intended to be 40 feet in length and vary in height from three eet
nearest the street to five foot in height before it meets the g rage.
(refer to aitached sketch).
2. You will note on the attached sketch, however, that the 40 foot
length of fence �rould result in approximately 22 feet of �he fe ce
being extended into the right-of-way of Chipoewa Avenue. The
applicant should be advised that the maximum length of the fenc
should be 37 feet rather than 40 feet.

Ti�e p��:•pose for the varying heights (from three foot to five fo t)
wouid appear to be an effort on the part of the applicant to
not c���ate a barrier of continuous height which would be abrupt y
ended h�t rather to taper the height to the lower height at its
point of termination. This is a good design consideration and
reasonable request.

ACTION REQUESTED: Variance to Side Yard Setback
PLANPJING COPdSIDERATIONS:
1. Mr. Garwood has a 75 foot lot with a garage projecting forward rom
the house with the required 30 foot setback from the street and ten
foot setback from the side lot line. He proposes to build an
addition behind the garage extending the home within 62 feet of the
lot line (whereas ten foot is required). He has received appro al
in writing, which he has submitted to the Planning Commission f om
his contiguous neighbor who would be affected by this varianc .
2. You will note from the attached drawing that the addition (122 eet �
in width) is tucked in a recess behind the garage contiguous to
the side of the home. It would appear to be an appropriate
location for an addition to this home under these circumstances
3. The proposed variance would have minimal affect aesthetically
because of its location behind the garage. In view of the neig bor's
approval for this 3z foot variance, it would appear to be one t at
would merit a positive consideration. .

It would not appear that the state statutes are necess rily in
conflict with the provisions of Ordinance 701. Our an lysis
would lead to the conclusion �that the City may proceed under
either Ordinance 701 or the state statute or under bot alter-
natives.
While Ordinance 701 requires hearings both before�comm ncing
the intended work and before levying an assessment the efor,
the procedure prescribed under Section 18.023 would al ow
assessments against affected properties without the ne essity
of a prior hearing.
