In order to keep our program under control, we will h to jump on th problem right away. 1de still have 7 residents diseased wood to be removed, and we have one resident which ha some carked trees still standing from last year. These proble are being taken care of. We do have several areas which are n showing signs of inection, and we will go in there shortly to mark them for removal. ith ie are going to make an attempt at reating some rark trees th's year with Lignasan BLP. We are presently in the process of pr'cin the chEuical'nd all of the equipment which goes with it. bJe will picx te trees which we will inject and then continue wit the injection process in late r:ay aTter the trees are fully le fed out. A Forestry related CETA student has been requestzd for to assi t me in the field his sucuner. He or She will also be a great a set i.n the oifice when we get into he paper work involved in keeg'ng records and in issuing subsidy. At this time we are awaiting a response on our request for sub idy from the Dept. o Agriculture. fter talking with them, they ave corfirtned receiving our application, and now ihey await action taken on this by the legislature. nopeully we will hear from them n the next few weeks. Also at this time, we are waiting renewel of our open burning ite permit . This permii ran out his Nast month and now we are t ing to persuade the PCA to give us another one. They are tighteni g up onopen burning, and want to eliminate as many burning sites as possible. 'hey have advised me that they have received the ap lication and that it is being sent before their review board. We shoul also be hearing from them in he next couple of weeks. lve are prepared ior the upcoming season and await the battle. An aztempt has been made to have Castle Chemical Co. provide our residents with Lignasan BLP at a wholesale cost. After alking with Mr. Jewitt of Castle Chemical, He advised me thai they had tried this previously, and that here was so much cor. with paperwork and money that they would no longer provide thi service to the public. Castle Chemical deals strictly wih Mu ties and with Nurseries which aould use a great quantity of tY. They said they would definitely not supply this chemical to an other than their Present accounts, municipaliiies, or nurseryr 0 fusion s nicipali- is chemical. yone en. Mr. Smith, the owner, was not able to attend that meeting and has since requested that the proposal be put on the agenda for the April meeting of the Commission. • At the last occassion when Mr. Smith met with the Commission, h intended to work with Mr. Pabst (a contiguous owner to the west on the possibility of making allowances f or the future extensio of the street indicated on the attached skeich and discussed in th December report. A recent brief conversation with Mr. Smith indicated that he had not been able to make any progress with r spect to the revisions for this street right-of-way. The question i not really one of the 50 foot lot line division which is proos d. The real question is one of whether or not we should attempt to make some provision for the extension of this street pattern throug the area at his time. You are aware that the development of this street as an extension to the industrial park to the east and t e south completes a loop road system that is very important to th overall circulation pattern in the hlendota Heights industrial a ea. The Commission may wish to consider approval o the 50 foot lot line change on the condition that he dedicate that nortion of the st eet extending east-westerly through his property off Pilot Knob Roa (County Road 31). , _ . . '. V''. , 4 / ,t/'. / ji , 'j ' i . , ' \\\ . . +u ' - y;r _ ; \, •, •`++ , ;i 1 ,. '.. T e proposed road is indicated in dotted lines, tying into exisii street intersections both to the south and to the east on Pil t Knob Road. 2. In our opinion, this would create a very desirable situation oening up the raw land for future development in a manner so as to c mplete that portion of the raad system which would intersect with th proposed road. 3. Perron Road has been eliminated as an access point to flighalay 13. Thus, the proposed alignment would effectively replace Perron Road as an east-west segment of this portion of the industrial loop road system. 4. In a short discussion tivith Mr. Pabst after the last Planning Commission meetina, we understand he is not particularly inte in dedicating a roadway through his land at this time. The a;licant, however, has stated his interest in working out so sort of solution. At this time the applicant is requesting t addition of a 50 foot strip _of land to the tvro lots to the ea as you have previously reviewed. The addition of this 50 foo - nf land does not, of course, preclude the ultimate platting a eivel opment of the roaday as proposed. The property in question is zoned "B-1". The pylon or free-sta signs are not permitted within this zoning district. The appli however, is requesting that a four by four foot name plate (identification sign) be constructed in one of two locations on either Plaza Drive or podd Road. 2. A primary reason for this request is that the building situated on the property has a rather well-designed exterior and placeme of a wall sign would detract from the originally intended build aesthetics. The basis for this cornent is the fact that the exterior of the building consists of dark finishes and textures also a mansard roof exists on the building. A wall sign on a building with these exterior and roof designs would result in a undesirable aesthetic condition. 3. In this regard, the remaining alternative location for a name p sign is on either Plaza Drive or podd °oad. You will note that the attached sketch Number 2, the ovner has identified two alte locations for the placement of the sign. Location Number 1 is approximately eight feet west of the parking lot entrance drive the second location is at the intersection of the north and wes property lines. A site inspection of t{ie alternative sign loca has been conducted and it is recommended that sign location alternative Number 1 is the most preferential. The basis for t recomendation is made on the fact hat this type of sign is for purposes of name plate identification and not advertising. Sig location Number 2 is higher in elevation than Number 1, is in m better view to Dodd Road and is a more optimal location for adv rather than name place or identification. Furthermore, placing sign at this location would appear to be less consistent with building character, driveway orientation, and general site aest n consideration of the fact that the oUner/applicant has provi i:wo alternate locations and Location Nurber 1 would result in 1 change from existing conditions and have least probable impact site lines, it is recommended as the preferential location. 4. As you will note on the attached sketch of the proposed sign, t di ng ;ant, t ng and very ate in native and ions is ch rtising the etics. ed ast CASE NUh1BER: 77-9 April 26, 1977 Page T o - applicant suggests that the upright posts and sign letters will be in a dark brown with panel background being painted white. The sign will measure four feet in height and four foot in width a d will be constructed and painted by prafessional sign builders. Based on this information, the sign appears to be quite handsom and the variance is reasonable. 0 r L,+-"' . i • ' • ' , , . ; ; , ; F e , CASE NUMSER: 77-9 APPLIGANi: Coniemporary Co siructian Corp. The Adams household includes children interested in basketball and a hoop has been construct d on the garage. Hoitiever, the owner is concerned about the baske ball rolling into the neighbors yard which is at a lower elevation han the applicant's driveway. To mitigate the concern of having th ball and the children entering the neighbors property, the appl cant would like to construct a redtivood fence. The pr000sed fence is intended to be 40 feet in length and vary in height from three eet nearest the street to five foot in height before it meets the g rage. (refer to aitached sketch). 2. You will note on the attached sketch, however, that the 40 foot length of fence rould result in approximately 22 feet of he fe ce being extended into the right-of-way of Chipoewa Avenue. The applicant should be advised that the maximum length of the fenc should be 37 feet rather than 40 feet. 3. Tie p:•pose for the varying heights (from three foot to five fo t) wouid appear to be an effort on the part of the applicant to not cate a barrier of continuous height which would be abrupt y ended ht rather to taper the height to the lower height at its point of termination. This is a good design consideration and reasonable request. 0 ' _ uno7 4a'__ _ - - • rkt"-- _ __ _ h %'- ". --_-_ / ' r3'kr `' 1 }.}a a S'E. .._ __ ' tv / u.;- • TzJc.u.n..'----_— A Z?, '.-= -- -- 0 CASE NUNiBER. Mr. Garwood has a 75 foot lot with a garage projecting forward rom the house with the required 30 foot setback from the street and ten foot setback from the side lot line. He proposes to build an addition behind the garage extending the home within 62 feet of the lot line (whereas ten foot is required). He has received appro al in writing, which he has submitted to the Planning Commission f om his contiguous neighbor who would be affected by this varianc . 2. You will note from the attached drawing that the addition (122 eet in width) is tucked in a recess behind the garage contiguous to the side of the home. It would appear to be an appropriate location for an addition to this home under these circumstances 3. The proposed variance would have minimal affect aesthetically because of its location behind the garage. In view of the neig bor's approval for this 3z foot variance, it would appear to be one t at would merit a positive consideration. . .1 T , s : fi 4 y a. ■ . - .rr.Y...Y+-s. .—:>;.., --.s...t k " + . ,. `r ' i . a . r S 0 : : , ..*« ..._.wa.,.:av:.>,7.x......,. --.r is•=.rc:x. =z»srx-:=-, 'r`: µ: .4 +7cII- 41:/S= _ . ,N-: -a+v{' ■ ' , ° i' ' i S a u s. `ir , '' 3. , M NC.M#C ,,•, S til..M t w„.+•a<.. .. k `.4.Mfl4:xfifark.r. „ j . - _ 'aM_"e4'rFi'+3'r.J.{1z.MWs.enc>:µ-.F+-M1H:',r^.a14}{ . _ 't''' z';. } .M i. . Y , .' i.. rp ., \ { Rl " ar1. _ ,. X 'w " + \T _ Nw.' cxu.vra4. k. . a ' .r` . :#,. Proceedinq under the to The isions of Ordinance N. 701. Under the provisions of Ordinance No. 701, ihe Cou by resolution may determine which "unsound trees" are t removed €rom either the public right of way or private perty. Before commencing such work, a hearing must be with a prior published notice. The published notice, a other things, must state the particular project propose the estimated cost either in total or as a proposed ass rate. On or before September 1 of each year, the Counc may levy the assessments for such costs in accordance w Section 429.101 of the Minnesota Statutes. Under the p sions of Section 429.101, published and mailed notice i required and, in all respects, the regular special asse procedures are required with the exception that the ass may be payable in a single installment or up to ten equ annual assessments as the Council may provide. cil be ro- eld ong and ssment 1 then th ovi- s sment ssment il r Y Mr. Orvil Johnson Page Two May 2, 1977 2. Proceedin Statutes. under Section 18.023 of the Minnesc Under Minnesota Statutes Section 18.023, the Comm of Agriculture must adopt rules and regulations relati shade tree control in the metropolitan area which by d tion includes Dakota County. All cities must comply w state regulations or adopt regulations found by the Co of Agriculture to be more stringent. Under this statu municipality may direct the property owner to remove o diseased trees. If the property owner does not do so specified period of time, the municipality may do the then charge the property owner for the cost of such wo statute specifically provides, however, that in the ca the expense of removing or treating diseased shade tre located on streets, terraces or boulevards, not more t. 50 per cent of such expense may be assessed against th properties. Any such charges not paid by the property may be assessed against the affected property. Such a: becomes a lien collectible with annual real estate tax a ssioner g to fini- th the missioner e, the treat fter a ork and k. The e of s an abutting owner ount s. The legislation also allows the Commissioner to m ke "grants in aid" to municipalities with approved shade ree disease control programs to be used for the partial fu ding of municipal subsidy programs for the removal of disea ed trees. It would not appear that the state statutes are necess rily in conflict with the provisions of Ordinance 701. Our an lysis would lead to the conclusion that the City may proceed under either Ordinance 701 or the state statute or under bot alter- natives.
