Minutes of the Regular Meeting
Held Tuesday, September 6, 1977
Pursuant to due call and notice thereof, the regular meeting of e City Council,
City of Mendota Heights, was held at 7:30 o'clock P.M, at the Ci Hall, 750 South
Plaza Drive, Mendota Heights, Minnesota.
Mayor Lockwood called the meeting to order at 7:40 o'clock P.M.

Mr. Jerry Murphy, representing Somerset Coun ry Club, explained

Dr. Leonard Levitan, 699 Sylvandale Court, s ated that his
basement was flooded because of what appeare to be a back-up
of the City's sanitary sewer system. He sta ed that he had
4 inches of mud in his basement and feels th t the City must
take steps to alleviate or prevent recurrenc s of such a
problem from future storms.
Dr. Ronald Lampert, 705 Sylvandale Court, st ted that his
basement was also flooded by what appeared t be a sanitary s
back-up and asked that something be done to revent similar
future problems.
The Council acknowledged receipt of a letter from Mr. & Mrs.
Lawrence Vinaglia, 976 Douglas Road, who sub itted flooding
damages to their home as a result of the sto m.
Public Works Inspector Pearson gave a brief �iunmary of some of
the damages incurred on City property as a r sult of the storm.

Mayor Lockwood suggested that the Council ap int an ad hoc
committee to study the storm damage and repor back to the
Council. City Administrator Johnson recommen ed that staff
be directed to prepare a survey of the damage , estimate of
repair costs and very preliminary suggestions on what interim
or remedial action should be taken.

The Mendota Heights City Council will conduct a public heari g in
the Council Chambers at 7:30 P.M., Tuesday, September 20. The pu ose
of the hearing is to discuss and receive citizen input on the pro osed
1978 Budget. Following is a brief summary of the proposed Genera Fund
expenditures by Department: Administration; $372,400; Police, $24 ,300;
Fire, $44,710; Public Works, including Street, Utilities, arid Par
Departments, $377,890; Planning $33,000 for a proposed General Fun
budget of $1,073,300. Anticipated receipts are as follow: Local axes,
$531,000; State Ai.ds, $180,450; miscellaneous receipts from Count
and local sources, $361,850, for a total of $1,073,300 anticipate .
The Federal Revenue sharing allocation of $34,399 is preposed to e
placed in a Public Works facilities building fund.

solution for the August Construction Company's proposed development in
relationship to the overall development and circulation in he area.
Recommendations includ�' specific consideration for:
1� Provision for traffic circulation and extension of al thorough-
fare from the Friend7y Hi71s area to Delaware Ave.
2� Lot sizes of the August Construction Company propos 1( remaining
lots in the Friendly Hi71s plat) and lot developmen pattern.
3) Park expansion and relationship to future open spac�e to the

4) � Impact on the wetlands ordinance regulations .
5) Consideration of thoroughfare alignment in relation hip to the
remainder of the Rauenhorst properties, the Dodge ature Center,

Thorouqhfares and �Traffic Solution:
Our first step in evolving our recommendations was he conduct
of a careful review with Ed Kishel for the north-so th thorough-

original comprehensive plan and the City's State Ai Street
system p1an included a north-south thoroughfare fro Mendota
Heights road north to highway 110 on the section li e on the

I hereby request a change in the preliminary plat for Eagle
East that was approved in April 1977. In addition to apprc
Units 7, 8 and 9, as shown on our revised plat dated 9/13/'
specific revision being requested at this time is a change
2 in configuration and location. We are requesting to move
forward so as to not encroach on the steep embankment at tt
of the property and to further accommodate a change that w�

After reviewing Carmen Tuminelly's revised plat and pl�
on site inspection of the proposed cha`nge, I find that
quest for Unit #2� is a good change for two reasons. F�

set hacks.

ITEM # 1
NORTHLAND RD. AREA ON APPROXIMATELY LOT 5 OF THE INLAND
The earth berm near the storm sewer outlet has been wa
by the storm, there is an area approximately 8-10 feet wide
4 feet deep in which the water was allowed to flow directly
storm sewer outlet. The top of the berm area is approximat
higher than the top of the open grate storm sewer inlet tha
in the low lying area just preceeding the berm. I might me
Tom Knuth from the Bettenburg, Townsend, Stolte and �omb is
on this particular inspection. We are now standing down by
sewer outlet. We have an area that has been washed away ri
to the pipe and the flared end section and I would estimate
feet in length and approximately 10-12 feet in depth. Also
outlet side of the storm sewer, directly straight in front
is a bend in the ditch line and there's been an area which
estimate 10-15 feet of the bank which is 15-20 feet high th
completely wiped out and the trees in that area have fallen
creek bed itself. It appears that there will need to be a
amount of clean up as far as tree removal and that sort of

On the north side of Lake Drive, approximately 100 fee

We have about 2 feet or so of fine silt in the bottom

SOMMERSET SCHOOL AREA JUST TO THE WEST SIDE OF DODD ROAD
(A) It appears that with the amount of wash in this area, w
considerable amount of erosion. It appears that the greates
erosion is approximately 250-300 feet in length and about 50
the maximum width, and to a depth of approximately 10 feet,

line for the Somerset School to be exposed. The water is fl

Ivy Falls 2ND Addition, and it appears that the lower basket

selves. It would appear that these baskets should be filled
little bit larger rock than the previous. Upstream from eac

out, there was a potiver outage from poles being knacked over, and the

creek is now a flowing torrent pf water after tUro inches or more of ainfall.
Somerset Country Club has battled this ever increasing flow of ater from
VTest St. Paul ever since i955. Since 1963 era have spent over $3�,Q0 to slow
dov�n the ilow of the water and, in same casss, vre have callected. the rrater,
bacifing it up over the golf course, and meiering it out at a rate sq al to the
ability ar carryin� capacity of the dawn stream creek. Of course, t e 7� inches
of rainfall vras far beyond our abilities to control.

that was last or flamaged during the storm?tt t�Thatever is done shauld be carefully
p].anned and executed so as not to adversly affect the down stream pr perty as �vell

411e would like to cooperate vrith the City of Mendota Heights in study of
this mutual problem. Somerset is reluctant to rebuild or reconstruc the dam or
any other rela�ed faci.lity until ruch time as a complete, detailed s udy and plan
is developed for the drainage area under cansideratzon. t'�e �nauld as that the
C�ty Council initiate such a detailed study and develop p3ans to man ge the water
within this draznage area.

carport.
I have the door insta.l.led, and moved the storage doors over to build he
outer wall. To finish I have about 1/3 of the ti�all, and a service do r

Directing the water from your blayfield Heights storm sewer o to my
property is causing me unnecessary and unreasonable injury, there ore
I demand that you stop doing so.
During the last part of August 1977, Mendota Heights constru ted a
storm sewer in the Mayfield Heights area, designing it so th�t th v�ater
collected runs through a culvert under Hiway 13 and onto my front lawn.
The first time it rained after the acanpletion of the storm s wer
was on August 30, 1977. The result was water in my front yard to a
depth of approximately 2 feet and water in my�basement to a depth of
approximately 1 foot. Through constarrt R�ork we were able to piunp the
basement out and partially drain the yard by the evenin; of Septe ber
1, 1977. It rained that night and the storm sewer flooded the ya d and
basemerrt a second time. Y�le again pLur►ped and drained this v�rater. It
rained again on September 8, 1977 and again the yerd Kas flooded nd
water entered the basement. Vlater f.rom your storm sewer has run nto
my yard continuously since September 8, 1977.
The directing of your storm sewer onto my l.and is csusing ex ensive
property damage. Monetary damages cannot be tota led now because njuries
are continuing to occur a nd will accumulste until the storm sevrer is redirected.
Nothing in this notice shall preclude or limit my right to
against any individuel or comnany for negligence or other malfea

At approximately 5:00 p.m. on Sunday, September 18, 197
the warning alarm on the Mendota Water Company system s
Investigation of the situation indicated an electrical
problem which prevented the pump from delivering water
the well to our stand pipe. At 7:OO.p.m., the�servicem
from McCarthy Well arrived and determined our problem w
in the wiring to the pump or possibly the pump motor it
This necessitated xemoval of the pump which was accompl
Monday morning.. Upon inspection by McCarthy Well, it w
determined the electrical cable to the pump motor neede
replacing. They also determined that the electrical le
on the pump motor needed replacement. This was estimat
to require 3 weeks to accomplish.
After the service call by McCarthy Well on Sunday night
we determined we were faced with a need to find an alte
method of providing water to�our customers, I called Ma
Lockwood to determine if we could use St. Paul Water Co

The total runs for the month of August was four. Two o� the r�uns were for
alarm malfunctions,�one for a gasoline spill, and the forth wa� a lightning
strike during the heavy rain storm August 30th. ,
The Department received a donation during August from the Mend ta Heights
Lions Club. They received a check in the amount of $450.00 to be used to-
wards the purchase of a Resusci Anne. The Department added $5 0.00, from
its Fireman's Dance�Fur�d and took delivery„on a Recording Resu ci Anne.
This equipment will be used to keep the fireme�n,and�police"per onnel sharp
in the use of CPR�at Cardiac calls. Marc Connolly, from the f re department,
has qualified as an instructor in the use of this equipment. t is planned
to train others so that classes can be offered to c.ivic groups �

RESOLUTION EXPRESSING INTENSIONS CONCERNING I-35E CORRIDOR
t�REAS, back in the mid-1950's, Planning Commission Chai
A1 Horning and members of the Planning Commission objected to
criss-crossing Mendota Heights; and
WHEREAS, the community reluctantly accepted the fact that as
township, they had no direct veto power over the location of high
but rather, negotiation; and
WHEREAS, the Comprehensive Plan was then prepared and
around the planned freeway alignments; and
Wi�REAS, the Comprehensive Plan showed the entirety of Mendot Heights
adjacent to I-35E to be park land or residential with the exceptio of the
southerly 16$ adjacent to I-494; and
WHEREAS, additional hearings involving the upgrading of T.H. 10
acknow].edged the residential character of the T.H. 110 corridor; d
WI�REAS, the development has in fact taken place in accordanc with
the Comprehensive Plan, i.e., residential development along T.H. 1 0; and
Wi�REAS, the Courts have twice sustained the residential zoni g in
the face of co�mercial development; and
WE�REAS, in spite of the I-35E corridor, park and residential land in
Mendota Heights has been maintained along 84 percent of the I-35E orridor;
and
WI�REAS,'in case the City of St. Paul should choose to abando the
I-35E freeway concept and substitute a parkway facility on the I-3 E
corridor; '
NOW THEREFORE IT IS I�REBY RESOLVED by the City Council of th City
of Mendota Heights that the City of Mendota Heights hereby express s its
intent to pursue a parkway concept for the Mendota Heights portion f
I-35E north of I-494 consistent with, and similar in nature to, th

The City Council of the City of Mendota Heights, M

Section l. Water Company Defined. Every person, f

Section 2. Water Surcharge Imposed. For the purpo

and street construction. The majority of work will be located within the
subdivision proper however, to complete traffic and utility circ�ulation,
a portion of the west end of Bachelor Avenue is included in the prolposed
project.
At this stage, adequate street right of way on Bachelor Avenue is a
problem with negotiations proceeding to either acquire property fro an
individual property owner on the south side of the street, or to a quire
a portion of the Mendota Heights Par 3 Golf Course in order to go round
the existing dwelling. The drawings, which are a part of this rep rt, ,
indicate acquiring golf course property but a change to some other land
acquisition will not effect the results of the study.
The proposed sanitary sewer on Trail Road is planned to be ex ended
on Wachtler Avenue North of Bachelor Avenue. The water main on Tr il Road

To do the storm sewer construction as shown on Sheet 2 of th at-
tached drawings, will require the installation•of approximately 2,�00 feet
of 12 in�h through 18 inch concrete pipe and appurtenances for an stimated
cost of $52,000. Assuming the entire cost to be 100� assessed, a d with
approximately 857,403 square feet of assessable area, the unit ass�ssabte
cost is es:timated to be $0.06 per square foot.
Assuming that the over flow piping from the ponding area on tf
Course is carried on General Obligation, this will reduce the assesl
costs by $4,000 to $4,500 making the unit assessable cost for the h

As indicated earlier, streets as proposed�will be standard 30
bituminous surface with B-618 concrete curb and gutter. It is ant
