Councilman Wahl seconded the motion EAGLE RIDGE Mr. Carmen Tuminelli appeared before the Counc'1 to request EAST approval of a change in his preliminary plat w'th respect to configuration and location of Unit #2, and the approval of additional units #7, 8, and 9. Ayes: 4 Nays: 0 � MISCELLANEOUS After a short discussion and with the recommen ations of both the Planning Consultant, Howard Dahlgren and t e Building Inspector, Richard Bjorklund, Councilman Wahl oved to approve the changes and additions as requested. Councilman Schaberg seconded the motion. Mrs. Dale Peterson of 871 Cheri Lane addressed the Council with a request to help solve the problem of th setback requirement of a proposed house being built ad acent to their home, which according to the ordinance, allows it to be built 10 to 12 feet ahead of their house setback. S e stated that at the time their home was built, the then exi ting Council requested them to place their ho�e at an 85 fo t setback, which they did. Her request is for the adjacent hom owners to be requested to align their home closer to the ex sting setback. f i Page 880 September 20, 1977 After a short discussion, Councilman Losleben as appointed to investigate this matter and report back to he Council for a recommendation. STORM DAMAGE The Council discussed briefly a report submitt d by the Public Works Inspector, Chet Pearson which he nd the City Engineer , Ed Kishel had prepared after a thor ugh investigation of the overall flood damage sites in the City. STORM DAMAGE CLATMG The City Engineer presented a slide presentati�n showing the storm damage to our utility facilities here in Mendota Heights. A brief discussion followed the slide presenta ion with the Council in full agreement on the need for the plesnentatio of repair work. The City Engineer and the Public Works Inspect r were requested to supply a work study and an approx ate cost report for the continued meeting on Monday nig t. City Administrator, Orvil Johnson gave a short report on the Federal Small Business loan requirements which are being implemented to aid the storm damage residents. Mayor Lockwood requested that Councilman Schab rg, who had previously toured the damage sites, be the Cou cils repre- sentative to follow thru on the progress of th damage repair. Jerry Murphy was on hand to elaborate on a let er submitted by the Somerset Country Club regarding their p operty damage. He stated that Somerset would ask that the Cit initiate a detailed study to develop plans for management of water drainage in the area. He stressed full cooper tion with the City on such a project. After further discussion the Council adjournedlthis matter to the Monday night meeting. The Council acknowledged receipt of storm dama e letters from C.C. Herbert; John T. Benke; and Mr. & Mr . M.F. Welsch; which will be turned over to the Citys insuran e carrier for donsideration. One of the later hang-ups was the involvement with the Mi sissippi River Critical Corridor Area restrictions. The following members were present: Ridder Wheeler, Quehl and Kruse. A.bsent: Clemens, Shipman, and Ste fani. Also present were Planning Consultant Dahlgren and C ty Admini- strator Orvil Johnson. APPROVAL OF Minutes of the August 23 meeting had been MINUTES submitted with the agenda. Krus moved, seconded by Wheeler, that the mi utes be approved as submitted. Voting: All Ayes. Chairperson Ridder noted that Case #77-24, Northern tates Power Company, would be presented first because thei repre- sentatives had to attend another meeting. CASE N0. 77-24, Mr. Nick Dries from Northern Sta Northern States Company explained the proposed G Power Company Use Permit to rebuild 5� miles o Conditional Use of which 1 mile is in Mendota He Permit Quehl questioned if they will pu on property lines. Mr. Dries sa would widen the existing easement to 75 feet in Mend� and that Northe rn States Power Company would purchas� from property owners. Mr. Riley, we understand, has owned the property in question for en or twelve years. The land was zoned R-3 under the Comprehensive Pla . This land use is �recommended because of the relatively isolated nature of the property being bounded by the Cemetery and Lexington Avenue on th west, the commercial district on the south, and alignment of 35E on the east. 2. The applicant proposes to develop the land for multiple purposes s indicated in a sketch plan prepared by the applicant's planning c nsultant a copy of which is attached to this report. The total number of nits would equal 434 on a site area of 25.79 acres. This would create an overall gross density of 17 dwelling units per acre. 3. Though the original zoning ordinance adopted by the City included provisions for such a density district, the ordinance was amended subsequent y to require approximately ten dwelling units per acre for multiple dw lling zones in the City. The applicant is seeking permission to vary f om the density requirement of about 10 units to acre to 17 units per acr . 4. We feel that such a drastic change in density, should not come un'er the provisions for variance. A variance is a procedure wherein an ap licant is allowed to vary from a specific requirement due to hardship co ditions relating to physical conditions on the site, site size, terrain, �ocation of trees, site limitations, etc. We suggest that if the City wis es to consider a density of greater than 10 units per acre, that we be equested to consider appropriate provisions for a new zoning district prov ding for density and other controls that might be slightly higher than tha existing in the current ordinance.(though they may not be as high as that proposed by the applicant). 5. We do feel that there is a case for having more than one multiple in a corrmunity. Many communities have a whole range of densities multiple housing types provided for in their ordinance, providing greater flexibility in application of the various districts to thE parts of the City. As you will n te from the attached drawing of his proposed addition, his existing arage is 20 feet by 22 feet with a stairway in it. Thus, it is not a f 11- size double garage. . 2. Attached is a copy of the letter from Mr. Bystrom's contiguous pr perty owner, Mr. David W. Johnson. The letter indicates his approval o the location of the new garage, the corner of which would be seven fe t from his side lot line versus the required ten feet. Thus, the actual intrusion into the ten foot required side yard is merely a triang lar portion of the building consisting of only nine square feet. You will note that the corner of the existing garage is 11 feet from the proper y line. The proposed intrusion into the side yard is approximately 55 fee from the front of the lot, and thus will not have significant affect n the appearance from the street. The distance between the proposed ad ition and the contiguous house would appear to be approximately 25 feet indicating that the contiguous home is approximately 14 feet from the side lot line. � 3. Rudy Liturski reported that the playground equipment that was purchased for FriE Park was near completion and that they were still planning on installing the pla equipment at Wentworth Park this year. 2. He presented a detailed memo regarding .the eligibility of different types of projects and indicated the deadline for submitting an applica ion was 5 pm on September 16. After a considerable discussion, the Commission agreed to apply for grant monies for the following improvements. a. (mproving trails and construction of necessary bridges b. Trail signs c. Playground equipment for 2 more parks d. Land acquisition and development cost of 2 Babe Ruth parks - e. Sand for improving the swimming beach at Rogers Lake One of the criteria for selection was that an overall plan for the development o system be accomplished prior to application for grants. It was felt that the plar has been done by the Commission and, in particular, the trails plcan completed c years ago might be sufficient. I met with St. Paul Water officials on September 23rd to discuss th matter. They objected to several of the sections in the original ordinance and the attached version now meets with their approval with Sherm's approval. You will note the special provisions appl� to the Mendota Water Company billing procedure. I mentioned that this is a time-consuming process. St. Paul officials tell me that there is approximately a three month lead- ime before they can institute this collection process. They have a n er of inechanical details and programming details that must wend thei way through the process. Direction at this time is necessary in orde to institute this collection process effective January 1. I recommend your favorable consideration of this financing p oce so that the entire matter of water system improvements can procee without any more delay.
