MEMO
TO: City Council
FROM: Orvil J. Johnson
City Administrator
SUBJECT: Snelling View Replat
September 27, 1977
Mr. Nielsen has been working on the Snelling View Replat for several
years. One of the later hang-ups was the involvement with the Mi sissippi
River Critical Corridor Area restrictions. These problems have b en
resolved with the appropriate state people and now the plat is re dy for
approval. We received a check for $3,600 on April 7, 1977 as one half of
the park contribution. The remaining $3,600 is payable on July 1 198,
with interest. Mr. Nielsen does not plan to develop this inedia ely,
hence there is no petition for utilities or streets at the presen time.
' I recommend approval of the plat and authorization for the
and Clerk to sign the appropriate documents.

Dear Sir:
Enclased is an itemizd accoun of damages incurred during the
severe rainstorm and flaod which took glace August 34, 1977. E
that time water, mud and sewage from the sanitary sewer backed
into my basement and deposited as much as five inches of the mi
sewage water, Considerable damage occuxred w:ith extensive Ias:
of property as itemized $ 7 . This is the second time
tha the sanitary sewer has backed np into my basement in afoi
year period. In ,anuary of 197'3 the basement was flooded with
six inches of waCer from the sanitary sewer. This was caused
by a blackage in the city sanitary sewer line.
It is na coincidence that sewage backed up into my basement tw ce
in a four year period, and I now have na assurance that th.s w 11
not recurr.
in additian o the loss of property incurred, tha value of my
house has depreciated many thousands of dollars since I could
iat in conscience withhold such infarmation from a prospective
buyer.
Please give me an early answer as to your Iiability in ths.s ma
and even more important, action taken ta prevent a recurrence.

Jim Riley
East of Lexington Avenue, Acros
Resurecction Cemetery (see sket
; from

Approval of Variance to Multipl Density
1. Mr. Riley, we understand, has owned the property in question for en or
twelve years. The land was zoned R-3 under the Comprehensive Pla . This
land use is recommended because of the relatively isolated nature of the
property being bounded by the Cemetery and Lexington Avenue on th west,
the commercial district on the south, and alignment of 35E on the east.
2. The applicant proposes to develop the land for multiple purposes s
indicated in a sketch plan prepared by the applicant's planning c nsultant
a copy of which is attached to this report. The total number of nits
would equal 434 on a site area of 25.79 acres. This would create an
overall gross density of 17 dwelling units per acre.
3. Though the original zoning ordinance adopted by the City included provisions
for such a density district, the ordinance was amended subsequent y to
require approximately ten dwelling units per acre for multiple dw lling
zones in the City. The applicant is seeking permission to vary f om the
density requirement of about 10 units to acre to 17 units per acr .
4.
We feel that such a drastic change in density, should not come un'er the
provisions for variance. A variance is a procedure wherein an ap licant
is allowed to vary from a specific requirement due to hardship co ditions
relating to physical conditions on the site, site size, terrain, ocation
of trees, site limitations, etc. We suggest that if the City wis es to
consider a density of greater than 10 units per acre, that we be equested
to consider appropriate provisions for a new zoning district prov ding for
density and other controls that might be slightly higher than tha
existing in the current ordinance.(though they may not be as high as that
proposed by the applicant).
5. We do feel that there is a case for having more than one multiple
in a corrmunity. Many communities have a whole range of densities
multiple housing types provided for in their ordinance, providing
greater flexibility in application of the various districts to thE
parts of the City. Such changes in development policy, of course
a principal subject of study and concern in the development of th
Comprehensive Plan contemplated to begin this year.

Donald W. Bystrom

Approval of Side Yard Variance
its
Mr. Bystrom proposes to add a 19 foot by 12 foot addition to the ear of
his garage for the purpose of accorrrnodating inside storage for ga dening
equipment, woodworking tools, and general storage. As you will n te
from the attached drawing of his proposed addition, his existing arage
is 20 feet by 22 feet with a stairway in it. Thus, it is not a f 11-
size double garage. .
2. Attached is a copy of the letter from Mr. Bystrom's contiguous pr perty
owner, Mr. David W. Johnson. The letter indicates his approval o the
location of the new garage, the corner of which would be seven fe t from
his side lot line versus the required ten feet. Thus, the actual
intrusion into the ten foot required side yard is merely a triang lar
portion of the building consisting of only nine square feet. You will note
that the corner of the existing garage is 11 feet from the proper y line.
The proposed intrusion into the side yard is approximately 55 fee from
the front of the lot, and thus will not have significant affect n the
appearance from the street. The distance between the proposed ad ition
and the contiguous house would appear to be approximately 25 feet
indicating that the contiguous home is approximately 14 feet from the
side lot line.
3. It is significant to note that the addition to garages, commonly
suburban residential homes provides additional storage f or materi
which otherwise might be stored outside. Thus, such additions. frE
add to the quality of the neighborhood, and benefit contiguous pr
It would appear that the proposal as requested is a reasonable onE
the Planning Commission and Council's consideration.

Dick Dwinnell of Howard Dahlgren and Assocs. appeared before the Commissio to discuss
the possibility of applying' for grants from the Federal Land 8 Water Commission Fund Act
and the State Legislative Commission Minnesota Resources grants to acquire and develop
outdoor recreation facilities. He presented a detailed memo regarding .the eligibility of
different types of projects and indicated the deadline for submitting an applica ion was
5 pm on September 16. After a considerable discussion, the Commission agreed to apply
for grant monies for the following improvements.
a. (mproving trails and construction of necessary bridges
b. Trail signs
c. Playground equipment for 2 more parks
d. Land acquisition and development cost of 2 Babe Ruth parks -
e. Sand for improving the swimming beach at Rogers Lake
One of the criteria for selection was that an overall plan for the development o
system be accomplished prior to application for grants. It was felt that the plar
has been done by the Commission and, in particular, the trails plcan completed c
years ago might be sufficient. It was felt that even though our chances are slirr
with little time to prepare the application, that it would be good to do it to gei
back and apply again next year when these funds are available.

SUBJECT: 10 Surcharge on Water Billings
Attached is a considerably revised ordinance establishing an
authorizing the collection of a 10 surcharge on water bills. I
met with St. Paul Water officials on September 23rd to discuss th
matter. They objected to several of the sections in the original
ordinance and the attached version now meets with their approval
with Sherm's approval. You will note the special provisions appl
to the Mendota Water Company billing procedure.
I mentioned that this is a time-consuming process. St. Paul
officials tell me that there is approximately a three month lead- ime
before they can institute this collection process. They have a n er
of inechanical details and programming details that must wend thei way
through the process. Direction at this time is necessary in orde to
institute this collection process effective January 1.
I recommend your favorable consideration of this financing p oce
so that the entire matter of water system improvements can procee
without any more delay. Ed Kishel has been alerted to advise you on
the status and progress o£ the Feasibility Study which was ordere on
June 21, 1977.

Salaries
Except far changes made in the saEaies of the
mayor and cauncilmembers, no method is pres-
cribed for determining salary schedules, but such
action is usually taken by ordinance stating the
name of the employee{s) or the ciass of positions,
the jobs being performed, and the salary rate paid.
Changes in the rates of pay can then be made by
the passage af a similar ardinance. Whenever the
council establishes or changes salaries, it should
first determine whether or not its proposed actian
is in accard with the budget and whether adequate
revenues will be available. (See League memo
"Campensatian of Statutory City Officers and
Emplayees."
Since justices of the peace are compensated on a
fee basis, the counci) cannot pay them a saEary in
lieu of ar in addition to such fees.123
The salary af any official may, by appropriate
action, be changed at any time during his term of
office.
Salary Limitation
No sa[ary af a person empEoyed by a city,
county, town, schaol baard, or ather political
subd ivision may exc, that of the state Com-
missioner of Finance.
Ehat except for initiaE salaries i mediately after
incarporation, a change in salary does not become
effectiv, until after the next egular municipal
election. 'here is na referendu provision. Until
a change is made, salaries remain at current levels.
The salary authorization in t e law is designed
to aliow the cauncil to fix its ompensation for
all its duties. Thus, if the coun il feels that there
shoulci be additional cornpensati n over and above
the "base salary" for special mee ings, the amounts
set by ordinance'shou{d reflect this.
Salary changes should be ma e by ordinance,
but a motion adopted with for a{ities substanti-
ally equivalent to those for enact ent of ordinances
has the leeffect of amendi g a prior salary
ordinance.
