Mr. Winthrop stated that it is h s opinion that the City does not have the right to investigate e system. With the company's permission, the City could prep re such a study if the company is desirous of turning the system over to the City prior to 1981. He recommended directing the ngineer to prepare a report on what the possible costs of prepar ng a feasibility study would be and that the Engineer also adv se the Council how much lead time it will take to perform a feas bility study. � Mr. McGirl stated that the City has the Water Company's ' permission to perform the study and will have the full , ; cooperation of the company. Planner Dahlgren briefly outlined the hisLory of the original Comp preparation. He advised the C?ty officials and audience of the re mandating that alI communities must prepare a new comprehensive pl Mr. Dahlgren distributed copies of a comprehensive planning progra and officials, and briefly reviewed the contents of the program an preparation costs. Mr. Dahlgren also explained that a portion of within the Mississippi River Corridor Critical Area and consequent Metropolitan Council requires the City to prepare a plan to establ controls for development of this area. You will note on th ske�ch that there is identified the location of a willow tree �vithin the area of the proposed fence construction. Also noted on ihe sketch, is an area identified as a"patio area"_. l�Je have vieveed the property and find that the apparent plan of � landowner is that the patio be construc�ed in the area of the willow �ree off the back door of his home and that a�rivacy fence be constructed to enclose this area spatially as well as a less desi•rable view to the west. The design concept here is quite apparent and realistic. 2. Upon visual inspection of �he proaerty, however, it is noted that the ivi l low tree i s i n fact about four fieet fur�her east than shown in the applicant's drawing. Based on this, we would recommend that the propesed rence be situated four feet further east and in line with the front of the two car garage located at the southern end of the proper�y. ihe advantage of this recommendation is that a visual line from the garage to the fen can be maintain as opposed �o having this�visual line broken by a four foot intrusion made by the proposed fence. This is a subtle design recommendation but one worth considering. It would not appear that moving�the fence an additional rour foot would have negative impac� on the incorporation of the willow t and patio into the back yard design. ihis, however, should be discussed �,rith �he applicant and if determined that �his does c a problem, then construction of the fence as proposed could be a 11 ot�re d . - 3, he creen ast use As �o the actual request Tor a vari�ance in the height of the fe ce, the applicant is requsting a six foot redwood fence be cons�Cruc ed which is 42 inches higher than that which is allowed. Swanson proposes to create a single lot whic is to be sold for the developmznt of a single family house. Tnis ot will �have 120 feet of frontage on Orchard Place and a dep�h o 125 feet. We have reviewed the pr000sal with Mr. Delmar Schti•aan e, surveyor on the project. We have discussed optional vaays in wh ch the remainder of the property can be developed into single fami y lots. It appears that Mrs. Swanson does not care to commit her elf as to ��hich of the optional methods might be utilized ultimaiel . Two of �the plans involve cooperation with contiguous neighbo s to the south and/or the �vest. 2. In reviewing �hese plans wi�h h�r. The property is located within an R-1 District and consists of approximately 11,200 square feet in area with a 70 foot frontage on Valley Lane. Though the lot is less than the 15,000 souare � foot minimum required by Ordinance, it is within 70% of the requirements for R-1 lots. . , 2. The applicant proposes to construct a single family residence measuring 24 feet in depth and 47 feet in length. The home will be situated on the lot as shown in Sketch 1. - 3. As shown on Sketch 2, identified as the Wetland Systems Map, you will note that the property is within a designated wetland area. In this regard and in view of the fact that there is existing development in the area, including homes and roads, a field insp c- tion was conducted and the rollowing comments are made: a. There exists a drainage structure in the soutfiwestern corner of the subject pro.perty. The structure will � ,. provide adequate drainage of run-off from the site. b. I asked Sherm to prepare the amendment after I noticed that th present wording of Section 15 did not allow for compensation of the Civil Defe se Auxiliary•Police Officers, and therefore we could not provide them wit workm�ns compensation coverage should they be injured while assisting�the Polic Depart- ment. As you will notice, the amended ordinance would allow the volun eers to be considered "special enployees" of the City, and therefore receive a token salary of $1.00 per year. According to our insurance carrier, this to en salary paynent would prov?de for their coverage under our workmens compensati n in- � surance policy. Should the City Council see fit to enact this amended ordinance, I wou d like to take this opportunity to recommend that Garold Murphy, Kenneth Piot aschke, Thomas Brown and James Miller be appointed Civil Defense Auxiliary/Pol ce Re- serve Officers ior the City of Nendota Heights. Candidates Murphy and Piotraschke have served for many years as Civil efense ._r Auxiliary Volunteers in b5endota Heights, and recently completed the 5 onth x�Dakota County Police Reserve Officers Training Course, and 40 hour Cra h In- jury Management Course. Most of these have been just recently marked d are in the Cherry Hills � Addition. Removal has just begun and t this time we have only a few removed. We have just started treating some Elm trees in our parks wi h ; Lignasan. Trees are picked which appear undiseased and of w ich are functionable to our recreation areas. Records will be k pt on all injected trees. Lignasan has been purchased and also a ressurized injection kit which Lignasan is injected, Our burning site has been approved by the PCA for a period o one year. They will review the site and our permit every month d continue to let us utilize this area until they determine ot erwise. , We have yet to receive confirmation on our application to th State for subsidy. Thul, Police Chief � • • Subject:, Traffic Survey of Staples Avenue• -_ ` _� As a result of the City Council's request of May 17, 1977 a traffic sur ey was con- ducted on Staples Avenue on seven consecutive days from May 19 thru May 25, 1977, inclusive. The survey consisted of a total of 4.9 hours�of radar speed monitoring, and observations by officers of traffic flow. Attached to this memoran um is a summary outline showing the day, date and times the monitoring was done the numbers �.;f cars observed, their average speed, the highest speed recorded for e ch day, and the numbers of �vehicles that were clocked over 30 M.P.H. each day. The column li�ting the numbers of veYiicles observed also shows how many drove the ntire length o� Staples between Dodd Rd. and Delaware Avenue. The survey was conduc ed primarily du:�.ng the hours of the day that Mrs. Delmont advised us were the heavi st traffic times. � � _ • I As you will note, a total of 101 vehicles used Staples Avenue during th nearly 5 hours of the survey, and over half, 54�, used it as a thru street betwe n Dodd and Delaware. Of the 101 vehicles, two were clocked at what I consider a v ey high rate of speed for that street, however, the average speed for all vehic es was only 22.9 _M_.P.H., and only 6 of the 101 vehicles were clocked over 30 M.P.H. The results of the survey indicate several things�to me.i Obviously, St ples Avenue is us<tid Uy a significant number of motorists as a thru street between D dd and Dela��: war�,.l:nwever, 94� of them drove under 30.M.P.H., and only two drove ov r 33 M.P.H.. � Ir.�:.s_rsyinion, these results do not warrant a reduction of the speed li it on Staples A:r�nue as they do not demonstrate.a continuous general disregard of the speed -limit •, �� motorists. On the $40,000 homestead, Citizens League says that.taxes Heights would be $597 in 1977 compared to $1,228 on the same valu homesteaded in Minneapolis. Minneapolis is the highest taxed mun we are the lowest. For your information also, Eagan and Inver Gr rank next to us for low tax rates, West St. Paul is number 82 wit $698 on the same house. Why should we rank the lowest?? The following thoughts come mind. Are we low because: 1. Our level of services are the lowest in the metro 2. Our people require less services than anyone else in the metro area? 3. Is it because our existing public facilities are , and require little maintenance? 4. Is it because we have very few public facilities, he: don't levy the tax to support construction of public facilities? 5. Is it because the employees are under-paid? 6. Is it because we don't have enough employees? 7. Is it because the Administrator and staff are not adept enough to provide new and better programs? 8. Is it because we have more of the individual enterprises than most other communities? 9. Is it because we do not welcome a proportionate s disadvantaged? 10. Is it because we don't face up to our �otal munic responsibilities? � 11. Since State Aids to Municipalities are based in part taxing efforts, our proportionate share is reduced.
