Pursuant to due call and notice thereof, the regular meeting of
City of Mendota Heights, was held at 7:30 o'clock P.M. at the Ci

Mayor Lockwood called the meeting to order at 7:30 o'clock P.M.

CASE N0. 77-12, City Planner Howard Dahlgren was present to d scuss several of

the original plat to 96. Mr. Dahlgren explai ed the proposed
street system, proposed park dedication and t e proposal for
development of the area to the east and south of the plat.

EIm. Administrator Johnson elaborated on the portion of the
memo outlining Mr. Neska's concerns over the ximum one-year
assessment period for payment for removal of iseased trees,
noting that if the Council deems it feasible o consider a
five-year assessment period staff would prepa e a study and
proposal. After a brief discussion, staff wa directed to
prepare a proposal for assessment for removal of diseased trees.

The regular meeting of the ASendota Heights Planning Commission was ca

CASE N0. 77-21, Mr. Strub was p'resent to make a presentation o a new platting

lots and that Mr. and Mrs. Siebell would join ith them in

Adr.�inistrator Johnson explained that staff had prepared a steep slope
area and he noted on the map that at least four of the proposed lots �
unbuildable because the slope exceeded the 18% maximum allowed in the
Ordinance.l He advised the Commission members and Mr. Strub that the
RecreationFCommi.ssion desired a cash contribution from this platting
pedestrian�rightro�-way along Interstate Valley. Mr. Strub indicated
unwillingne,ss to provide a cash contribution and pedestrian right-of-�
north to south. Chairperson Ridder noted that the Commission and Men�
were also concerned about the future of the ten to twelve acres and t

MISCELLANEOUS Administrator Johnson advised the Commission m mbers of City
� Council action on previous planni.ng cases.
Howard Dahlgren was asked to discuss the proposed Pfaff apartment c nstruction in
Lilydale� He was asked to advise the Commission and a number of pe ple in the
audience�on the matter. He noted his memo which had been sent to . Frisch
earlier, and reviewed past court action with Lilydale activities. . Frisch
noted an attorrtey's opinion concerning the critical area restrictio s on the
proposed'site, noting that 24 of the 72 units had been withdrawn by Mr. Pfaff.
Mr. Frisch asked that City officials become involved in this matter to protect the
valuation and quality of living along Victoria in the Highland Heig ts area.

and askiig that the matter be placed on the Council agenda.

appropriate solution to the platting of this property for single family

3. The plat consists of 53 lots, all of which meet or exceed the 10 foot
minimum lot frontage and 15,000 s�uare foot lot area requirement . The
total areas of development consists of 29.6 acres with a public ark
area of 2.6 acres contiguous to the south boundary of the plat i a
location where it can be added to when the land to the south is ltimately
developed. We feel that the circulation pattern and lots develo ed with
this plat are most appropriate for the property, recognizinq the terrain
and tree conditions as they exist on the property today.

The present fire protection contracts with Lilydale, Mandota
Sunfish Lake are dated January l, 1974. In late 1973, we negotiai
contracts with the three coIIut►unities. At that time, the amounts �
increased, based on a rather hvrriedly assembled formula: a formu�
took into account population and valuation. The contracts for Li_
and Mendota are in effect until proper notification of amendment �

the year 1978. The original contract dated in 1965 indicates that
contracts "continue thereafter from year to year unless and until

I appreciate that the details are rather miniman in this mem , however,
I feel strongly that we should: (1) initiate a change in contract formula
and (2) a notice should be sent out during budget time to allow t e
af�ected communities an opportunity to incorporate any changes in heir

Therefore, I would recommend that Sherm be given direction to give
the proper notice which should include a"non-legal" explanation of what is
being reco�ended and the invitation to participate in the applic tion of

The goa! established by the city counci! was to formufate
a method whereby a fair and equitabfe charge was made
to each community using the fire department for fire pro-
tection. This gaaf was estab}ished a{ter a study of the fire
department's use and income shawed that more than 50
percent of the fires fought were outside the municipai
limits while approximately �0 percent of the fire depart-
ment income came from the other communities. The
prob}em was then to equate use and potential use of the
fire department with an adequate annuai charge.
One method of determining this charge would be an a per
unit basis. Hawever, this did not take inta consideration
the vaiue of the unit protected and did not allaw for grass
fires which were prevalent on vacant lots during the Spring
and Faf1 dryseasons.

The Task Force on Metropolitan Affairs of the Senate`s Government 1
Operations Committee will hold a series of regional hearings in A oust
to get the views of inetropolitan area citizens and public officia s on
two issues related to metropolitan government in the 7-county met o-
politan area.
The Task Force is interested in your views on whether the Metropo itan
Council should become an elected body, and whether the provzsions of the
Administrative Procedures Act should be extended to cover the ,iet o
Council and metropolitan agencies. You may testify on one or bot of the
issues.
The hearing for citizens and public officials living in Metropoli an
Council districts 9, 11, 15 and 16 (Dakota, Scott, Carver and par
of suburban Hennepin County) will be held on Wednesday, August 24 h,
in the Auditorium of Penn Junior High School, 2501 West 84th Stre t
(corner of 84th Street and Penn Avenue), Bloomington, Minnesota a
7:30 p.m..
Those wishing to participate in the hearing should write the Task
on Metropolitan Affairs, Room 205 State Capitol, St. Paul, Minnes
or ca11 296-4175, so that you can be listed on the agenda. While
not necessary to be listed on the agenda in advance, your coopera

by NSP on a temporary basis as provided by Minnesota law.

SUBJECT: Utility Leadman Recommendation
In accordance with Orvil's memo of June 28 regarding Public dTork
Ieadman positions, we have administered a second written test for the
position of utility leadman on July 27. Tom Olund, as you rememb r,
was the only candidate and had passed all of the remaining three
testing procedures. On the second written test Tom has passed wi
a score of 94. In view of that fact, I would recoaunend that Tom lun
be appointed utility leadman at a wage rate of $6.75 per hour, re roa
to July l. .
My reasoning for making the position retroactive to July 1 i:
so that both leadman positions will begin their probationary peric
at the same time.

We, the undersigned residents of Mendota Heights, hereby petitio�

We urge you to adopt the followin� resolutions, to-.wit:

1. Authorizing the Mendota Heights City Attorney, Howar
Dahlgren Associates Planning Consultant, and any and
all other Mendota Heights facilities or agencies to
oppose the proposed apartment development on two (Z)
sites having a total area of 2.75 acres with high de sity
apartments. . understand the proposed apartment d opment
would have a tota of seventy-two (72) units sulti g in a
density of twenty-six 6) units per , We belie e that
the compromise of six (6) its r acre as agreed u on in the
previous litigation inv 'ng dota Heights, Lilydale and
Inland Construc ompany for the evelopment on Lexington
Avenue uglas Road, should be the m'mum density per acre.
2. To commit all reasonable efforts to oppose the propos
, apartment complex at all governmental and quasi-gover
levels, including but not limited to the Metropolitan
Council, Metropolitan Sewer Commission, Dakota County
Minnesota Environmental Ouality Council, and before a

We further believe that the proposed plan is inadequate to provid aesthetically
attractive landscaping. Current plans call for the 75,956 square foot site to
have 48 living units, 48 underground interior parking facilities nd 59 parking
spaces above grade. As a result, this development will have a se ious adverse
impact on adjacent single family homes in the area.
There can be no justification for this high density development e cept for the
s' le reason as expressed by Mr. Pfaff, namely: economics. This of course,
i, is business decision and risk. �
We urge you to demand extensive plans and specifications includin engineering
studies for the nethod of disposing of surface water and its impa t upon adjoin-
ing properties and facilities serving the site.
k'e are proud of our neighborhood which includes existing single f<
and multiple dwelling residences in Alendota Heights and Lilydale �
