V= P'ERCEtTAGE OF T TAL ASSESSED VALUATIQN CITY OF MENDOTA HEIGHTS MEMO TO: City Council FROM: Orvil J. Johnson City Administrator November l, 1977 SUBJECT: Escrow Deposits for Petitioned Feasibility Studies Recently you requested that some criteria be established as gv.idance in determining the amount of deposit or escrow required' to commencing an engineering feasibility study. Presumably, thi: to the typical developer in the process of platting and developi prior applies ig currently undeveloped land. Of oaurse, one of the first questio s is: what is the escrow or deposit to protect against? In other word , what adverse effect, or what loss is to be prevented? I am not aware of any situations wherein the City has sustained financial loss on prem ture studies or where land oaners have taken advantage of governmenta services -- all with respect to land developers. However, despi e this rather nebulous starting point, I will proceed to expand on the ubject matter, Development History The following several situations will aid in reviewing the hand. Consider these several situations: 1.) T.H. 55 Sewer and Water Improverents -- Several ye ago, a number of people in the Kendon, Lakeview an Furlong area petitioned for sewer and water, howev it was not a 35$ ownership petition. Since it was not a lawful petition, the Council in effect initi the study. he study was completed and hearings h and the improvement failed to materialize. The co this feasibility study and the associated hearing notices, mailings, and all labor is still pending. It is in fact set aside and identified, so that in future, the cost of such knowledge, such basic stu and all previous investigations will be incorporat into the cost of any future improvements. This of course repreSents some lost motion concerning a neighborhood iinprovement -- not an individual deve requesting improvements. 2.) Northeast Area Storm Sew-r -- Previous studies, he costs and other information from 1968 and 1969 wer incorporated into the recent improvements project. fact, even some "public" costs of pipe were incorp into the recent project. Hence, in this case, no losses resulted from earlier uncompleted or aborte actions. tter at s ld t of the ing In rated 9 Escrow Deposits -2- November 14, 177 3.) I am not aware of any privately petitioned improvements of this nature that have needed to be continued to a second hearing or absorbed by fihe government because of the process being aborted. Current Fee Schedule Review At the present time, we do have a number of fee schedules adi the matter of professional fees required for certain governmental Although this is not directly connected with the process of public it does never-the-less respond to requests and actions by land owi toward development of new land. Consider the following: l.) Zoning. There is a zoning fee schedule addressing itself to costs for various zoning matters. Please refer to page (401) 38 wherein you will note that the fee for either rezoning applications or conditional use permit applications is $250. Applications for variances -- land development -- vary from $25.00 in residential areas to $100 in industrial and commercial districts. 2.) Wetlands Ordinance. This new ordinance does have a basic fee of $50.00 for all applicants, for the necessary permit. In a related action, you will rec that we added on a$150 surcharge to building permii when they are in the Critical Corridor Area. This was done on September 6, 1977. ressing activities. improvements, ers, all all 3.) Subdivision. The subdivision ordinance requires a minimum $100 application fee plus an estimated 2 ho of planning time at $45 per hour and one hour of engineering time at $40 per hour, resulting in a minimum filing fee of $230. In addition, on the larger plats we have been estimating additional planning and engineering hours so that in the case f Strub and Crown Point development, a filing fee o£ $530 was levied for that particular preliminary pla . This of course is to cover the anticipated cost of very preliminary engineering and planning during the process of discussing the plat before the Plann n Commission and City Council. Therefore, it is evident that fees and deposits are curren to cover the anticipated professional services required in the development of property. Petition for Public Improvements Normally, the City of Mendota Keights does not initiate the of public improvements. There is usually some over-riding force, case at hand, we are talking about development of private land, h initiating force coming from the land owner. In the case of Augu Construction Company, I originally suggested that August svbmit a required rly onstruction and in the nce the deposit Escrow Deposits -3- November 14, 1977 because they were not the owners of the property. (I believe tha have been the origin_al impetus for deposits for feasibility studi when a land owner (more commonly described as a developer) petiti public inpmvements, we have a tendency to question the £uture of development and wonder how much public monies should be invested. that the investment of municipal consultants' time is much more in the long range planning than the unguided design provided by d and other consultants. This is to say that when ovr own planner are doing the designing, it is quite obvious that all Iong-range system improvement recorunendations reflect their current ]-.nowledg community. This compares to the raw design that may be furnished developer's consultant. Should investment of our engineering and be paid for immediately or can we taY.e the chance of having it be to the cost of public improvements? As long as the land owner improvements, and we believe that he is sincere in his develornne the original professional costs can and are added to the final c Recently we have had a different approach to public improve the installation of utilities by developer in private properties Eagle Ridge area. As you recall, we have asked Carmen inelly engineering escrow (not for feasibility study) to cover the cost engineering consultant, as he does the inspecting and makes the accounting for the utilities. As we already discussed with Harv a similar situation is developing with him. In these cases, it proper that the developer be able to utilize his own consultants own expertise, however, it behooves us to use our own people (co: and staff) to see that the end result is fitting and proper. In following cost estimates and applicability, please bear in mind proposals are being structured to cover the foregoing sitnations these partial engineering projects are covered also. In my opin pose more of a problem than the conventional public improvement_: Escrow Criteria and Applicability : action may :s.) Therefore, ns for such a I suggest neficial velopers nd engineer lanning and of the by a . planning time later applied itions for process, cost. ents. Consider all in the for an of our inal y Bream, and his sultants the hat the so that on, they etitions. The following criteria is based on past engineering costs. There is no magic formula, it is based on some rather simple formulas applie to past engineering costs. In the past year, costs of public improvements have exceede $6,000 per lot. The Kopp-Gearman assessment, as you recall, was in exc ss of $6,200. Ed tells me that the Ivy Falls project for Riley wil.l b approximately $7,000 per lot. Based on this amount o£ i.mprovement costs, the ngineering costs amount to approximately $1,000 per lot or can be considere as $1,000 per dwelling vnit. This figure of $1,000 is arrived at by apply ng 15$ which is the total engineering service when one considers the feasibil ty services, the design services, the drawings, the many, many hours of field work, the assessment preparation costs and some amount of City staff costs Therefore, the percentage rate of 15 is a very acceptable figure and based on current and near future development costs, $1,000 per unit of engineerin services is quite realistic. Assuming the feasibility cost is one and on half percent of the improvement cost or more properly known as 1/10 of the to al engineering costs, then feasibility costs should be looked at as approximate y$100 per lot or per unit. This of course is based on past costs involvin developments of 30, 40, and 50 lot subdivisions. Obviously, it would not be s applicable in the southeast quadrant o£ the community. In cases such as th t, special considerations would have to be applied, ," Escrow Deposits -4- November 14, 1977 In view of the foregoing, I would suggest that if an escrow 's to be reguired for feasibility studies, that it be based at $100 per lo plus the normal 150$ factor. Ths would result in a deposit of $150 per I t. In the case of the partial engineering services required, su h as at Eagle Ridge, I would suggest that some partial service amount be utually agreed upon between the developer and the City in order to arrive at a deposit amount. In other words, if the developer is providing 50 of the total engineering costs, then we should insist on receiving an es row amovnting to only 50 of the expected engineering costs. Once the deposit is received and applied, what shouI.d the en result be? Do we go the accounting process of adding or subtracting the exact easibility costs and then refund or charge the land owner for th difference? Or should the whole feasibility study cost be applie to the project when it develops and the escrow be refunded? I believe t at such rierating details also have to be spelled out so that there is no misunderstanding between the land owner, the City Council and the staff. c arii i p . zr n [n rom e innin or , Citizens invatvement often takes the farm of an effort ta block something that has aiready been planned {an expressway ar a nuclear power plant, for instance). The most constructive results will be achieved when citizens, planners, elected officials, and members of relevant area agencies share their experience, knawledge, and goats and jointly crsate a plan acceptable to atl. . Constructive citizen participation is happening, Connar says, when: — Planners tisten to residents concerning their attitudes, goals, fsars, and suggestions. . — Citizens find early and convenient r oes t1'► opportunities to make pasitive contributions. — Citizens acquire a broader and deeper understanding of their enviranment, its poten#iai, and its fragility. — [ndividuals, interes# graups, and agencies identify their awn positions, recognize thoss of others> and work towards a win-win solutian cooperatively rather than became lacked inta a des#ructive win-lose or lose-lose pattern. — Relationships between pianners, politicians, and other people are strengthened so that communication barriers are bTeached and mutua4 trust increases. Winona St. Paul, Minnesota 55107 Dear Mr. DeTomaso: I noted with interest the news story on I-35E and your quota in the November 4th issue of the "Voice." I agree with your conc whole-heartedly, and would add my supgort to your efforts. Having been deeply involved in freeway planning in Diendota He gh and northern Dakota County for many years, I am deeply concerned w th the implementation of I-35E as originally planned. The added load of I-35E traffic to the future traffic on Lafayette Freeway would hav a very adverse effect on both northern Dakota County and the west si e area. If the leaders in St. Paul force this kind of additional traf ic on your area, to the benefit of the Hill district, the adverse imp ct will be as great on biendota Heights and northern Dakota County as n the west side. I would be happy to use my influence onMendota He ghts officials to bring legislative.pressure to bear on this matter, si ce we both have mutual concerns. : All of this concern is brought about because of the failure t implement previously accepted freeway plans. I would urge you to contact yo r Metro Council representative, whose very existence has been brought abou to see that the metro area plans are coordinated and implemented. If the Metro Council fails to use their power and influence in implementing the freeway plans, such failure can only be interpreted as a failure of the Co cil to perform coordinating duties assigned to them by the legislature. I regret that I will be out of the City on the evening of the meeting, but will be happy to meet with you and discuss mutual concerns dur ng the folloraing week. Se Donald L.
