Pursuant to due call and notice thereof, the regular meeting of
City of Mendota Heights was held at 7:30 o'clock P.M. at City H
Plaza Drive, Mendota Heights, Minnesota.
Mayor Lockwood called the meeting to order at 7:30 o'clock P,M.

rebuild an existing 69 KV Electric Transmis ion Line from the
Rogers Lake Subs�ation to Blue Gentian Ftoad Mr. Dries
explained the application, stating that NSP proposed to rebuil
approximately 5� miles of existing line, ap roximately l� mile
which is located in Mendota Heights. The p rpose of the
rebuilding is to provide for the upgrading f the capacity of
the line. It is proposed that 11 laminated wood structures
approximately 60 to 65 feet in height, repl ce the 8 existing
strucutres. NSP does not plan to acquire y additional
right-of-way through the residential area, owever they plan t
acquire 25 additional feet of right-of-way idth outside of
the residential area. It is also proposed hat the structnres
be constructed on the property lines to red ce their visual
impact. Mr. George Warner, of NSP, explain d the routing and
structure locations. He explained that NSP proposes to
increase the number of structures because t ey will be install

Insurance Services Office, advising the Coun il that effective
September 1, 1977, the City's fire rating wa reduced frnm
Class 7 to Class 6.
CONR�Ii7NICATIONS The Council acknowledged receipt of a letter from
Mr. David Bongiorno, President of "Mama Rosa Inc.",
indicating that he would like to locate a M a Rosa
Restaurant at 1944 Dodd Road and that he wou d like to be
on the November 15 Council agenda to request approval of
wine and beer (on-sale) licenses for the res aurant.

Mayor Lockwood questioned whether the City c n issue licenses
such as those requested, without violating p ovisions o£ the
municipal liquor ordinance. Attorney Winthr p stated that
there are actually two questions involved: t e liquor sale
question and whether the property is properi zoned to
accommodate such a facility.
Several members of the audience objected to e possibility
of liquor license issuance and to the propos d use since the
location is so close to a residential area. The audience
members asked several questions, including t e possibility
of rezoning the subject property ("down-zoni g°), whether or
not the business will include "take-out" ser ice, and whether
a neighborhood petition against the proposal would result in
negative Council action.

In response to the request of the city of Mendota Heights for a rev ew of
the special levy status of emergency expenditures to repair damage �aused
by flooding, the Levy Limitations Review Board conducted a hearing n
October 25, 1977 to�:consider the city's request for the granting of a
special levy for these emergency expenditures.
It is the finding of the Levy Limitations Review Board that:
(1) The city of Mendota Heights spent �35,000 for emergency r pairs
in calendar year 1977 as the result of excessive rainfall on
August 30, 1977. Damages included plugged storm sewers, ashed
out storm sewers, major drainage way problems, washed out dams,
exposed utility lines and erosion caused by excessive sur ace
run-off. The repair measures undertaken by the city coul be
classified as "repairing the effects of a natural disaste ."
(2) The special levy for "exnenses reasonably and necessarily
incurred in preventing, geparing for or repairing the eff
of natural disaster!'including the effects of flooding, h
been eliminated as a special levy for levy year 1977 and
subsequent years by Laws 1977, Chapter 423, Article V, Se
cts
ion 'i.
(3) 'I'he special levy allokied to pay the costs of principal an
interest on certificates of indebtedness specifically exc udes
from special levy status any certificates of indebtedness issued
to fund extraordinary expenditures resulting from a publi�
emer�ency.
(4) The city's emergency expenditures do not qualify under an;
category of special levy listed in Laws 1977, Chapter 423,
Article V, Section 1.

There was a total of 92 hours devoted to training durin
Officers Arndt, Plath, Olmstead, Blackfelner, Bridger,
Sgt. Wicks, attended a 4 hour Felony-in-Progress Course
by the Dakota County Police Training Coordinator. Sgt.
attended a 40 hour course on the Fundamentals of Crimina
conducted by the Bureau of Cri minal Apprehension. Capta
attended an 8 hour course on Check Fraud Investigations,
Chief Thul attended a 16 hour Executive Development Semi
of which were conducted by the Dakota County Police Trai
dinator. '
On October 31 Officer Larry Bridger began his duties as
Prevention Officer. He will be performing crime preven
full time until the middle of March,.1978 including sec
spections of homes and businesses on request, crime pre
speaking engagements, administer the operation I.D. pro
perform other crime prevention duties as needed.

in Valley Park to replace bridges dama.ged�ar destroyed during the
August 30 starm. These bridges are a vital. part of the cross-co t
ski. trail system in Valley Park, and as such quali�y as a project
vn@er ihe Ski To�ring Trail Assis�ance Program. Based an estimat s
by Harvey and Rudy, we antica.pate construc�ion material costs at
$l, 544. %i.onel Greenberg has in�.i.cated fhat he can provide us wi. h

RESOLUTION APPROVING CITY PARTICIPATION IN
MINNESOTA SKI TOURING ASSISTANCE PROGRAM
WHEREAS, the Minnesota Department of Natural Resources has pro olgated
the Minnesota Ski Zbaring Assistance Program whereby ski toaring or anization's,
acting through a county board, may be reimbursed for 65� of the cos s of
dev�eloping a ski touring trail; and
WHEREAS, the City wishes to participate in the Program in the e of ,
City Park property including trails already marked in Valley Park d
Friendly Hills Park for ski touring;
NOT9 TI�REFORE, IT IS HEREBY RESOLVED by the City Council of
City of Mendota Heights, Minnesota, as follows:
1) That City park property be authorized for use as ski
touring trails under the Program on the trails to be
designated in the Application submitted to the Departm nt
of Natural Resources.
2) That the Mayor is authorized to execute on behalf of
City the Application to the Depar�ment of Natural Re
under the Ski Touring Trail Assistance Program for a
grant-in-aid.
3) That upon approval of the Application by the Depar
of Natural Resources the Mayor is authorized to ex

SUBJECT: Escrow Deposits for Petitioned Feasibility Studies
Recently you requested that some criteria be established as
gv.idance in determining the amount of deposit or escrow required'
to commencing an engineering feasibility study. Presumably, thi:

what is the escrow or deposit to protect against? In other word , what
adverse effect, or what loss is to be prevented? I am not aware of any
situations wherein the City has sustained financial loss on prem ture
studies or where land o�aners have taken advantage of governmenta
services -- all with respect to land developers. However, despi e this
rather nebulous starting point, I will proceed to expand on the ubject
matter,
Development History
The following several situations will aid in reviewing the
hand. Consider these several situations:
1.) T.H. 55 Sewer and Water Improver�ents -- Several ye
ago, a number of people in the Kendon, Lakeview an
Furlong area petitioned for sewer and water, howev
it was not a 35$ ownership petition. Since it was
not a lawful petition, the Council in effect initi
the study. �he study was completed and hearings h
and the improvement failed to materialize. The co

notices, mailings, and all labor is still pending.

At the present time, we do have a number of fee schedules adi

3.) Subdivision. The subdivision ordinance requires a
minimum $100 application fee plus an estimated 2 ho

engineering time at $40 per hour, resulting in a
minimum filing fee of $230. In addition, on the
larger plats we have been estimating additional
planning and engineering hours so that in the case f

The following criteria is based on past engineering costs. There is no
magic formula, it is based on some rather simple formulas applie to past
engineering costs.
In the past year, costs of public improvements have exceede $6,000
per lot. The Kopp-Gearman assessment, as you recall, was in exc ss of
$6,200. Ed tells me that the Ivy Falls project for Riley wil.l b approximately
$7,000 per lot. Based on this amount o£ i.mprovement costs, the ngineering
costs amount to approximately $1,000 per lot or can be considere as $1,000
per dwelling vnit. This figure of $1,000 is arrived at by apply ng 15$ which
is the total engineering service when one considers the feasibil ty services,
the design services, the drawings, the many, many hours of field work, the
assessment preparation costs and some amount of City staff costs Therefore,
the percentage rate of 15� is a very acceptable figure and based on current
and near future development costs, $1,000 per unit of engineerin services
is quite realistic. Assuming the feasibility cost is one and on half percent
of the improvement cost or more properly known as 1/10 of the to al engineering
costs, then feasibility costs should be looked at as approximate y$100 per
lot or per unit. This of course is based on past costs involvin developments
of 30, 40, and 50 lot subdivisions. Obviously, it would not be s applicable
in the southeast quadrant o£ the community. In cases such as th t, special

In view of the foregoing, I would suggest that if an escrow 's to be
reguired for feasibility studies, that it be based at $100 per lo plus the�
normal 150$ factor. Th�s would result in a deposit of $150 per I t.
In the case of the partial engineering services required, su h as at
Eagle Ridge, I would suggest that some partial service amount be utually
agreed upon between the developer and the City in order to arrive at a
deposit amount. In other words, if the developer is providing 50 of the
total engineering costs, then we should insist on receiving an es row
amovnting to only 50� of the expected engineering costs.
Once the deposit is received and applied, what shouI.d the en result
be? Do we go the accounting process of adding or subtracting the exact
�easibility costs and then refund or charge the land owner for th
difference? Or should the whole feasibility study cost be applie to the
project when it develops and the escrow be refunded? I believe t at such
ri�erating details also have to be spelled out so that there is no
misunderstanding between the land owner, the City Council and the staff.

whole-heartedly, and would add my supgort to your efforts.
Having been deeply involved in freeway planning in Diendota He gh
and northern Dakota County for many years, I am deeply concerned w th
the implementation of I-35E as originally planned. The added load of
I-35E traffic to the future traffic on Lafayette Freeway would hav a
very adverse effect on both northern Dakota County and the west si e
area.
If the leaders in St. Paul force this kind of additional traf ic
on your area, to the benefit of the Hill district, the adverse imp ct
will be as great on biendota Heights and northern Dakota County as n
the west side. I would be happy to use my influence on�Mendota He ghts
officials to bring legislative.pressure to bear on this matter, si ce
we both have mutual concerns.

All of this concern is brought about because of the failure t implement
previously accepted freeway plans. I would urge you to contact yo r Metro
Council representative, whose very existence has been brought abou to see
that the metro area plans are coordinated and implemented. If the Metro
Council fails to use their power and influence in implementing the freeway
plans, such failure can only be interpreted as a failure of the Co cil to
perform coordinating duties assigned to them by the legislature.

part of the project to be filled with silt and debris as well as ca sing
damage to recently constructed "Gabion" structures. As part of the above
project, the Contractor is hereby directed to clean the basins and o cor-
rect damage to the "Gabions" on a time and expense basin at an esti ated
co�t of $2,435.00. .
3. Because of the August 30th rain storm, the east side ditch alon
Avenue north of Emerson Avenue was extensively damaged by silt and
