Held Tuesday, August 2, 1977
Pursuant to due call and notice thereof, the regular meeting of
City of Mendota Heights, was held at 7:30 o'clock P.M. at City
Plaza Drive, Mendota Heights, Minnesota.

� Mayor Lockwood called the meeting to order at 7:30 o'clock P.M.

HF.ARTNG - CLEMENT/ Mayor Lockwood opened the°meeting for the pu se of a hearing
VANDALL AREA on the proposed assessment roll for Clement/V dall area
II�ROVEMENTS improvements. Mayor Lockwood turned the meet ng over to
City Administrator Johnson for a review of th project.
Administrator Johnson gave a brief history of the project,
stating that the project included several di ferent kinds of
street improvements plus storm sewer improvem nts. He pointed
out that the project also included improvemen s in the
Wentworth Park costing approximately $21,500, and that this
would be paid for by General Obligation taxes The proposed
assessment rates are as follow: 30 foot stre t with curb and
gutter at $21.50 per assessable foot; 30 foot street without
curb and gutter, $16.50 per assessable foot; 8 foot street
without curb and gutter, $10.00 per assessabl foot; storm
sewer at $0.062 per square foot; sewer servic s at $340 each;
water services at $350 each; bituminous drive ays at $0.09 per
square foot. Mr. Johnson advised the residen s that the�
assessments, if approved by the Council, may e paid in full
without interest during the thirty days follo ing adoption of
the assessment roll, or they may be paid over a 10 year period
for street improvements and driveway improve nts, and a 19 ye
period for the balance of the improvements a an interest rate
of 7� on the unpaid balance.
Mayor Lockwood asked for questions and commen�ts from the

Pursuant to due call and notice thereof, the regular meeting of e City Council,
City of Mendota Heights was held at 7:30 o'clock P.M. at City Hal , 750 South
P�aza Drive, Mendota Heights, Minnesota.
Mayor Lockwood called the meeting bo order at 7:30 o'clock P.M. e following

I�ARING -- FEDERAL Administrator Johnson stated that the City h s been receiving
REVENUE SHARING Federal Revenue Sharing funds for the past s veral years, which
PROPOSED USE funds were to be used as determined most nec ssary by the
City Council. In 1977, the legislature amen ed the Federal
Revenue Sharing Act to require �ublication o notices and
conduct hearings on proposed uses of 1978 Fe eral Revenue
Sharing funds. As a result, notices had bee published in
the local newspapers, publicizing this eveni g's hearing.
Mr. Johnson outlined the distribution of the 1977 funds and
proposed the 1978 funds, $34,399, be placed n a fund for
construction of a proposed Public Works faci ity.

When City streets are upgraded with bituminous surfacing, it is th practice
to install sewer and water services to each patential b�iiding.sit so it
will not be necessary to dig up the pavement when the parcel is us d for
that purpose. It is firue that the lots are sub-standard based on oday's
requirements, but this may not always be that way. The parcels in question
face differenfi streets so it was a Staff decision to install sewer and'water
services to each lat. Should bath parcels be used as a single buitding
site, the availability of these connections on either side.of a corner lot
will make it easier to place a building an the site and be less e ensive
than installing new service at that time. . '
2. Lot 12 of Block 3 has a frantage of 94.81 feet on the Miriam Avenu
Averagi�g that with the b0 feet rear lot dimensian results in 77.4
as th� assessable amount.
3. I am at a loss as to the figures you show in your third paragraph.

� am responding to your tetephone request for information on how the ass ssment
was calculated on your property. The records indicate that you own part of
Lotis 1 and 2 of Block 7 in Kirchner's Addition. In determining assessme ts, we
cons��er each parcel separately and in your case have used our normal fo mulas
to comp�te assessments for each parcel.
Attached is a simple drawing indicating the parcels in different colors
assessment purposes.
On pert of Lot 1, we averaged the short s'ides and applied the assessment
the Butler Avenue side, which is your street address. On the part.of Lo
you own, we wimpty applied the frontage that faces Butler because it is �
jority width of that parcel. The above computations were applied agains�
construction with curb and gutter on Butler Avenue. No assessments for �
construction on Spring Street were applied to your properties. The rate
street assessment on Butler Avenue was $17.25 per foot.
Storm sewers were assessed on a square foot basis and we have indicated
feet in each parcel on the drawing. The storm sewer rate was $0.065 per
foot. �

in the North End of Mendota. Heights and that our objections were made knowri to the
City C ounci�just prior to �our unanimous approval of order to carry o t this work, -
which we fe�t was unriecessary and would be �n imprudent expenditure, nii would not
i�esult in any desired improvement,�o our properties. It was evident to us that that
meeting was held to satisfy the legal requirement for such a hearing� but �t was also

Schbol� I was told by Mr. Edward Kishel� that all lot
facing Chippewa �ve . North of Miriam St . and North fa
lots on Simard St. would not be included in the Storm
assessment charges because the natural storm water fl
was Northward from Miriam St. at Chippewa Ave. and Ea
from the corner on Miriam St. and Simard St. I was al
given a"Proposed Storm Sewers" map Exhibit - B� with
showing the normal flow of storm water Northward towa
Annapolis St., on Chippewa Ave.
At The 8-16-77 meeting, I was then informed by Mr. Joh
that I am being charged for Storm Sewer Assessments� a
same rate per square foot as all benifitted parties in
entire project, because the sewer line was put at a lo
elevation at the corner of Miriam St. And Diego I,ane t
receive- storm -water at -thE �lower swale on -the -Block 2
at some future date. This is not now connected to any
basin or drain.
The reasoning that I am using her.e is that the charges
Storm Sewer are being assessed but there is in fact no
to our property, because of no connection to the swale

I feel that when the above mentioned connection is mad

me that some greater efforts should be made to assure that taxpaye s are

As was suggested at the meeting last night, we would apprec aie

Since the storm sewers were put in, whenever it rains, we ave
a puddle in front of our home. We have a unique situation a
the previous owner put in a parking area in place of the boul vard
and therefore our loi is uneven with our neighbor� s and the ater
does not run off into the storm sewer. We brought this to th
aitention of the men doing the road work ]a.st summer bui io 0

We would appreciate anyihing that can be done to alleviate

Also, at the time the street was put in, absolutely no work
done on our driveway as we had a private coniractor redo t]

ORDINANCE NO.,
AN ORDINANCE PROVIDING FOR THE HARDSHIP
DEFERRAL OF SPECIAL ASSESSMENTS AGAINST
THE HOMESTEADS OF SENIOR CITIZENS AND
PRESCRIBING THE RATE OF INTEREST THEREON
The City Council of the City of Mendota Heights does
as follows:
�rdain
Section l. The City Council may defer the payment of a special
assessment against any homestead property of one acre or 1 ss owned
by a person 65 years of age or older when the total amount of the
assessment exceeds $300.00 and the payment thereof would c nstitute
a hardship.
Section 2. In order to qualify for the hardship defe ral herein
�provided, the property for which such deferral is requeste must have
been the homestead of the applicant on the date of the ado tion of the
resolution by the City Council ordering construction of th improvements
for which said special assessments have been levied. '
Section 3.� A hardship as that term is used hereunder shall be
deemed to prima facie exist when the annual installment (i cluding
interest) of the special assessment to be paid exceeds 1 p r cent of
the "adjusted gross income" of the senior citizen as shown on such
senior citizen's then most recently filed Federal income t x.return.
Section 4. The deferment of the payment of said spec'al assess-
ment shall terminate and all amounts accumulated plus accr ed interest
at the rate of 7 per cent per annum shall become due upon he occurrence
of any of the following events:
(a) The death of the owner, provided that the spouse is
otherwise not eligible for the benefits hereunde ;
(b) The sale, transfer or subdivision of the propert� or
any part thereof;
(c) If the property should for any reason lose its
homestead status;

(d) If, for any reason, the City shall determine tha
there would be no hardship to require immediate
partial payment.

Section 5. The City Clerk shall include in the notice of hearing
of all assessments, where senior citizens' homesteads may be assessed,
appropriate information on the provisions of this ordinance.
Section 6. Applications for deferral of the payment of special
assessments as provided for hereunder shall be made on fo ms approved
by the City Council and shall be transmitted for recordin in the
offices of the Dakota County Register of Deeds, Assessor nd Auditor.
Section 7. This ordinance shall be in full force an effect from
and after its publication according to law.

Streets and Curb and Gutter Improvements
This is a suggested street and curb and gutter policy prompte
primarily by several questinns on the Northeast Area improvements.

ASSESSMENT PIDLICY
PERMANENT STREET SURFACING,
INCLUDING CURB & GUTTER
All property within the improvement district which is servedl
abuts the street shall be assessed.
In the case of rectangular shaped lots, the side abutting th�
will be considered as the frontage for assessment purposes.
On corner lots where the street improvement abuts the two si�
lot, the assessment will be made on the basis of the front (or na
plus 25� of the length of the long side. If the street improveme�
only one side of the property, then only that side will be assess
appropriate length. (Front or side.)
Odd-shaped lots will be adjusted to an average frontage that
equivalent to the frontage of a regularly-shaped lot of the same
area.

For the purpose of standardization, an average lot shall be 1 0 feet
wide and shall have an area of 15,000 square feet.
1. Odd Shaped Lots - for odd shaped lots, such as exist on c 1-de-
sacs, triangular intersections, curved streets, etc., the adjusted
front footage is computed by dividing the area of the lot by
15,000 to determine the equivalent number of 100 foot fro tage
units in the parcel. The number of units multiplied by 1 0
feet will give the adjusted front footage. See example.
2. Approxi.mately Rectangular Lots - For a lot which is appro 'mately
rectangular, the adjusted front footage is computed by av raging
the front and rear sides of the lot. If the lot is deepe than
150 feet, the width at the 150 foot depth is used for the rear ,
lot line. This method is used only where the. divergence etweei
front and rear lot lines is five (5) feet or less. Wher �
divergence is greater than five (5) feet, use "odd shape
lot" formula. See example.
3. Rectangular Lot - For the normal rectangular lot, the ad'usted
front footage is the actual front footage of the lot. S e example.
4. Corner Property, Abutting on Two Streets
a. Corner Lot - The adjusted front footage of a regular latted
corner lot is the short side plus 25� of the long si , if the
street abuts on the long side as well as the short si e. See
example.
b. Tracts or Portions of Several Lots - Unplatted parcel and
parcels consisting of portions of two or more platted lots
may receive special consideration in levying special
assessments. Unplatted parcels can only be considere on
a case by case basis. Parcels used as building sites
consisting of portions of platted lots, may be consid re
(for assessing purposes) as conventional platted lots if
the assembled or combined area under one ownership is
15,000 square feet or 1ess. In such cases, the prope ty
will be assessed, using the appropriate policy, as th ugh
it is a single platted lot. Assembled parcels over 1,000
square feet will be assessed on lot by lot basis unle s
the following paragraph conditions apply.

RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS
(IMPROVEMENT NO. 77, PROJECT NO. 5)
WF�REAS, the City Clerk, with the aid of the City Engineer, h s
calculated the proper amount to be specially assessed for Improvem nt
No. 77, Project No. 5(construct�ion of an extension of the City's anitary
sewer system to serve the property known as 2215 Dodd Road, Mendot Heights,
Minnesota) against the assessable property affected thereby upon e basis of
benefits, without regard to cash valuation, in accordance with the provisions
of Chapter 429, Minnesota Statutes Annotated, particularly of Sect'on 429.051
thereof; and �
WI�REAS, the property owners affected by such improvement ha
requirement for public hearing on the proposed assessment;
NOW TE�REFORE BE IT RESOLVED by the City Council of the City
Heights, Minnesota:
l. Such proposed assessment, a copy of which is attached her
made a part hereof, is hereby accepted and shall constitu
special assessment against the lands named therein, and e
tract of land therein included is hereby found to be bene
by the proposed improvement in the amount of the assessme

2. Such� assessment shall be payable in equal annual installm
extending over a period of 19 years, the first of the ins

C'hairman Wheeler reviewed recent Metropolitan Council data comparin R-3 densities
throughout the area. Planner Dahlgren responded by noting that a s udy of R-3
density would be part of the Comprehensive Plan and that such study should continue.
Kruse concurred that such a study should be included in the Compreh nsive Plan
rather than a separate, independent study. The members e�ressed o ncern about the
preparation of a revised Comprehensive Plan. Stefani noted that as an advisory
body, which considers itself as a.cross-section of the community, e body
recommends and strongly advises the implementation of the comprehen ive planning
process because: a.) the Land Planning Ac� requires such planninq e ements to be
done; and'b.) the existing comprehensive plan needs updating after 8 years.

1. The property in question is a 40 foot lot which has never been oc

2. The applicant proposed to construct a new single family home, 40 f et in
depth, with a front width of 26 feet, providing for a four foot se back
on one side and ten feet on the other (to allow driveway to the re r yard).
3. Mr. Hanson is purchasing the lot frorn his father, Leroy Hanson, wh is a
builder in the area and has owned the lot for many years. Steve H nson
has a wife and son and proposes to live in the house himself. The design of
the house will be presented at the Planning Commission meeting, i is a
split level design, which should work reasonably well on the site iven the
fact that the lot is only 40 feet wide.
4. A. typical standard used in determining appropriate setbacks for sm ller lots
is that the total setback equal 20q of the lot width with at least 10% on
each side. For instance, our 100 foot lot width requirement provi es for
a ten foot setback on either side conforming to the standard. For a 40 foot
wide lot, a four foot setback would be considered a reasonable pos ibility.
5. In this case, we suggested that Mr. Hanson discuss this proposal w th his
immediate contiguous neighbor on the west side. That neighbor has a ten
foot six inch setback on this side of his house. The reaction of his
neighbor would be important in determining an appropriate solution
6. In the rear of his lot, Mr. Hanson proposed to construct a double arage
which would be four foot from the rear and four feet from the side lot
line. This will allow space f.or a garage apron and the ability to get in
and out without backing the entire driveway length to the street.
7. In the overall, it appears that the proposal is a reasonable one, �
provide as much house and garaqe as could possibly be built on thi;
property. We suggest it will improve property values in the area �
will constitute a general improvement.

1. Mr. Koppen proposes to build a 22 by 44 foot,two story house on th
remainder of Lots 8 and 9, a portion of which were taken for�the c nstruction
of the service road north of Highway 110 in this part of the City. The
property is triangular in shape and has a frontage of 230.56 feet and a
depth of 132.71 feet on the eastern side. The actual lot area is 1,987
square feet. However, the location of the service road is such th t there
is an extremely wide boul�vard of approximately 40 feet between th north
line of the service road and the property. If we measure the land area
within 15 feet of the curb (which is the normal width of a bouleva d),
the land area would be approximately 20,700 square feet.
2. h1r. Koppen also proposes to move his home within 20 feet of the fr nt
line, rather than the normal 30 feet. This will allow him to have a
substantially larger back yard and a�ould have no ill effect on con iguous
housing in as much as the service road is setback a considerable istance
at this point.
3. This same variance was approved in 1975 for a previous owner of th lot,
who chose not to pay the assessments and ultimately construct a ho e on
the property. Mr. Koppen proposes to pay the assessments that are due on
the property, and will build the new home proposed as soon as perm ssion
is granted.
4. 4Je feel that the proposal is a reasonable one and would allow for �
development of a good single family home on a reasonable lot in vi�
considerable distance from the service road to the front lot line.

Mr. Griesgraber proposes'to build a new home on a 100 foot lot whi h
consists of an existing lot of 70 feet of frontage with 30 feet o vacated
street to the north. This is shown on the attached sketch as Lot "A".
Mr. Griesgr.aber has also purchased a 75 foot lot immediately to th south
which is occupied by the old sheet metal business.' Mr. Griesgrabe has
sold this to a third party who intends to remodel the existing str cture
into a single family home. This 75 foot lot was created by using he
existing frontage of Lot 4 and half of Lot 5. The problem is that the
splitting of Lot 5 was never approved when• Mr. Peters origi ally
sold the property to Mr. Griesgraber. It is this approval that is being
sought at this time.
The property to the south is still owned by Mr. Peters and consist of
a single 125 foot site, consisting of 22 lots. It would appear th t the
125 foot lot was retained at that size because of the location of he existing
home on the site. In any case, all three lots together, include 30 feet or
an average of 100 feet of frontage each. Unaer these conditions, 't would
appear reasonable to approve the division as has been accomplished therefore,
allowing for the construction of the new home for Mr. Griesgraber nd the
remodeling of the existing sheet metal shop into a single family h me. This
shop, as you know, has long been an eyesore in this part of the Ci y. It
would appear helpful to have this remodeled to a single family hom , thereb�,
substantially improving the aesthectic quality of this part of the City.

Our house is a three-bedroom rambler located at 741- Decor Lane,
Mendota Heights. It does not have a family room or a dini g room and
we feel we would like to ha.ve this additional space, as we ha.ve a large
family.
This can be accomplished by converting a portion of our p esent
garage and extending the new portion of the'attached garag 112 ft.

We did explore the possibility of purchasing or building a
house in this general area, and came to the conclusion tha
be our choice to improve our present home.
As you can see from the attached sketches, the addition is

The plan we ha.ve chosen is the one that will ha.ve the leas

Variance to Front Yard Setback
Attached is a copy of a letter submitted by Mr. Eilers relevant t� his
proposal to built an garage addition on the front of his house, a lowing
for the conversion of existing garage to a family room and dining room.
Also attached is a letter indicating the approval of neighbors in the
immediate area.
2. P1r. Eilers proposes to construct a new garage to within 19 feet o� the
front lot line.
3. In the process of discussing this proposal with Mr. Eilers we hav suggested
that it is important to maintain a distance of at least 20 feet i front of
the garage to the street right-of-way. This is to provide adequa e space
for the parking of a car without having it project into the stree right-
of way itself. This is a normally accepted standard in the metro olitan
area, in�as much-as it avoids having vehicles parked so that the umpers-
project out into the street right of way where there may ultimate y be a
sidewalk constructed. �
4. It would appear from the examination of Mr. Eilers'house that his
remodeling proposal is a reasonable one in view of the existing c
and plan-for his home. We do suggest, however, that a 20 foot se

RESOLUTION RELATIVE TO CRITICAL AREA DEVELOPMENT
Wi�REAS, the citizens of Minnesota and the metropolitan area ave
established a Mississippi River Critical Corridors Areaj and
WF�REAS, such area and boundaries as established in Mendota H ights
are shown on the attached drawings; and
WHEREAS, such protection concept has resulted in the formatio , by State
agencies, of interim rules and regulatio�s and other restrictions n
development in such area; and
WE�REAS, the legislation directg that local governments withi the area
be responsible for the enforcement of the interim rules and regula ions; and
WHEREAS, the local governments are also responsi.ble for the d velopment
of their own special development plans within the cri�ical area; d
WHEREAS, as of this date, Mendota Heights does not have such lans,
including any fee schedule for the appropriate handling of the dev lopment
plans; and
WHEREAS,�staff and consultant work is necessary irregardless f the
status of the Mendota Heights planning.
NOW, THEREFORE IT IS I�REBY RESOLVED, by the City Council of he City
of Mendota Heights that the Planning Consultant be directed to con inue
with the planning for the critical area development as per the Sta e mandate;
and
BE IT FURTI�R RESOLVED, that the fee for any building permit ithin
the critical area be increased by $150 to help defray the costs of processing
such permits.

REMOVAL OF DISEASED TREES �
Wi�REAS, the State Legislature has passed legislation author
and encouraging local governments to be active in diseased tree r
and
WHEREAS, the City of Mendota Heights has budgeted monies for
removal on both private property and public property; and
WI�REAS, on May 3, 1977, the City Council unanimously electe�
enforce the provisions of Section 18.023 in the removal and asses
for removal of diseased trees; and '
WF�REAS, it appears that assess�nts of one year duration me:
extend the agonizing period of tree removal payments; and
� WI�REAS, State law authorizes the spreading of such tree rem
costs over a five-year period. ,
NOW, Ti�IEREFORE IT IS I�REBY RESOLVED by the City Council of •
of Mendota Heights that tree removal costs incurred by the City o�
property shall be spread over a five-year period at 7� interest o�
unpaid balance; and

I have reviewed the plan for the Mendota Heights Bicycle Shop �
prepared by Keith Ackermann, cantractor for the proposed owners and
operators of the shop. We have noted on the site plan presented to
today, the addition of a screen fence at the rear of the property wY
was added to screen a contiguous R-1 area to the south as required t
Ordinance. The applicant (as represented by Mr. Ackermann) has agre
addition of the fence which will be constructed in the same manner �
detailed in the plans for the east side of the property.
With respect to landscaping, we have noted that the three exis
in the front yard are to be retained and that the planting indicate
site plan will be constructed as shown. With respect to drainage,
recommend that Chet Perason and Ed Kishel look at the plan to ascer
whether it will work. The plans indicate the parking lot to be gra
north and south following natural drainage. However, no provision
for channelling the run-off other than "sheet" drainage over the ra
the south and thence to the east. With respect to the roof, the pi

RESOLUTION ESTABLISHING ASSESSMENT FORMULA FOR
REMOVAL OF DISEASED TREES
WF�REAS, the State Legislature has passed legislation auth
and encouraging local governments to be active in diseased tree
ana
WHEREAS, the City of Mendota Heights has budgeted monies for
removal on both private property and public property; and
ing
Wf�REAS, on May 3, 1977, the City Council unanimously elected to
enforce the provisions of Section 18.023 in the removal and assess en
%r removal of diseased trees; and
Wi�REAS, it appears that assess�nts of one year duration mer�ly
extend the agonizing period of tree removal payments; and
• WI�REAS, State law authorizes the spreading of such tree
costs over a five-year period.

NOW, THEREFORE IT IS I�REBY RESOLVED by the City Council of t e City
of Mendota Heights that tree removal costs incurred by the City on private
property shall be spread over a five-year period at 7� interest on the
unpaid balance; and '
BE IT FURTI�R RESOLVED that the City F`iscal Agent be directed to work
with the City staff and prepare financing for the expected 1977 tr e
removal program.

As of September 1,1977, the City of Mendota Heights has marked
condemned approximately 2,700 trees within our Control Area. �
trees that were remo�ed totaled over 400.
Our subsidy program has started and our staff is now in the proce�s of
distributing funds amongst the residents which qualify.
We are presently in the process of developing a reforestation pro ram
to be initiated i.nto our city this fall. 'l�e State of Minnesota as
allotted our City �2,400 to use as funds for replanting. This ai ng with
the money budgeted by our City should be a good base for a replan ing
program. We have been pricing trees to be planted and have found a
very large increase in prices since we last planted in 19?5. Aft r
callin$ nurseries such as Park,Bachmans,Baileys, and Southview, w found
that prices vary from �149. to �210. for a 2 to 21/2 inch tree wh'ch would
be planted and guaranteed for one year. We find that we could pl t very
few trees at these prices. After contacting Nicollet �ree in Fa ington,
we found that we could buy their trees for � 42.50 a piece. Thes trees are
2 1/2 inch in diameter, and are of a very healthy stock. Types a ailable
are Summit Ash, Marshall Ash, Lindens, and Maples. We would have to
�
plant these trees our selves. with the aid of a tree spade, I th'nk ws could
possibly plant 140 trees on our boulevards and public properties. 2'he
people at Nicollet Tree advise us that this way of planting is ve good
and that we should have no problems with tree loss if we take som care'
in tree planting.
After reviewing our records from the beginning of our Shade Tree rogram,
we find that we have generaly lost boulevards' trees throughout t e city.
I think that by using our records, we can start in the older part of our
city and replace some of the old larger trees that have been take down earl-
ier. If we do decide to get 140 trees, we can distribute them ar und
enough to satisfy everybody. I do think that we should replace t e trees t�at
were taken down in previous years.
After reviewing our records, we find that there are quite a few r sidents
that are not abiding by our removal program. Basically the reaso s behind
their action is due to not being able to afford the burden of the cost of
removal. Many people have many trees on their property and they ust
cannot pay the bill for removal right on the spot. The number of
residents at this ti.me amount to approximately 20. The dollars ' volved
in removal of their trees could be approximately $50,000. dollars lhis
is based on the possibility of 35 - 40 residents. I reccomend th t
we consider giving the resident five years of which to carry the ost of
tree removal on their taxes. It is possible that we could have m�ny many
more residents that are not abiding with the removal procedures,
