owners in accordance with a list provided by NSP and in
aecordance with City Ordinances.
After a lengthy discussion, it was the Counc 1 concensus that
a neighborhood committee should be appointed to establish a
meeting between NSP representatives and all ffected property
owners so that the residents can get answers to any questions
they may have.

Winthrop in response to Council direction on November lst.
Mr. Winthrop summarized his letter,.stating hat the prime
issue is whether the City has the authority o issue on-sale
- wine licenses as,well as on-sale beer licens s. He stated
that it is his opinion that the City has thi authority if
the restaurant to which the license is issue serves more than
25 people. Issuance of beer licenses is str ctly a local
matter, however, issuance of a wine license ould require
ap�roval of the State Liquor Cor.unissioner, e stated that
the affect that wine license issuance would ave on future
� municipal liquor is not clear in �he statute and recommended
that the Council request an Attorney-General s opinion on
the matter. He noted that the Council �ust ecide whether or
not it endorses municipal liquor. '

Department of Revenues denying the City's re uest for approval
of a special levy for emergency funding for epair of damages
caused by the August 30th storm.
After a brief discussion, Councilman Mertens tto moved that the

relative to emergency financing. -

The Council acknowledged receipt of a letter from the Metropolit
Waste Control Commission regarding the possi ility of the
Environmental Protection Agency's future sew r and building ban.
BURN SITE The Council acknowledged receipt of a letter from Mayor Leibel
of Mendota requesting permission for Mendota to use the
City's burn site. Public Works Supervisor H rvey Franzmeier
advised the Council on the expense involved n operating the ,
burn site, including the cost of policing th site and renting
the necessary equipment. After a brief disc ssion, the Council
directed Administrator and Public Works�Supe visor to prepare �
a report on the potential impact of Mendota' use of the site
an�. information on cost sharing and other po sible effects of
the use of the site by the City of Mendota.

4. NSP representatives at that time indicated the existing towers varied �
from 70 to 80 feet in height and that the proposed structures woul be

5. We note from the meeting notice prepared by Mr. Thaemlitz that the
proposed structures are to be 55 feet in hei�ght. This, of course, should
be verified with the NSP representatives at the meeting. �

Reference was made in the meeting notice to the Environmental Quality
Council. This is a state agency (recently renamed the Environmen 1 Quality
Board) which consists of the various heads of other state agencies and
sorne appointed "public members". Public members are,appointed by he
Governor, and the heads of the other agencies are those which are urrently
appointed. The agencies include the Department of Natural Resoure s, •
the Department of Transportation, Pollution Control Agency, and ot ers.

PLANNING CONSIDERATIONS:
1. NSP proposes to replace the existing steel towers that carry a 69K
transmission line from the transmission station east of Roger's Lake
to the south line of the City. The line will extend southerly;in o Eagan _
along -the existing right-of-way for a total distance of 5.06 miles of
which 1.06 miles is within the City of P�endota Heights.
2. The line will be built on an existing 50 foot easement and additidnal
right-of-way will not be necessary to the residential area. We un�derstand,
however, that it would be prdposed to make the right-of-way 75 fee�t south
of the residential area in Mendota Heights. I
3. In as much as the proposal consists of inerely replacing the exist
structures, there is some question as to whether or not a special
permit is actually required. In consultation with the City attor
however, we feel that it should be processed as a special use per�
that people in the area will be aware of the change proposed.

5. The structures will occur at'approximately seven structures per mile, and that

In sumnary, we feel that the proposed change is an improvement ae thetically
and allows NSP to more efficiently serve this part of the camnuni y. The
existing towers, by the way, are 70 to 80 feet in height. The pr posed

Culligan Plat

The Culligan Plat, as you will recall, was approved in January, 1 77 by the
Council. Since that time, the applicant's legal counsel has been reviewing
the plat with the staff of the Metropolitan Council and the Envir nmental
Quality Board (EQB) pending formal review of these bodies in acco dance
with the interim regulations of the "Critical Areas" development ontrol
measures. Prior to submitting the plat f or formal review, the ap�licant
has chosen to do additional work to thoroughly analyze and substaltiate the
design and development features of the plat.
2. We have been in touch and conferred with the applicant and his le al counsel
and engineering consultants on numerous occassions this past year All of
the material recently submitted to the City Council with respect o this
re-analysis and review of the plan have been reviewed by us in th se past
months. Our comments and suggestions with respect to changes hav been
passed on to the applicant's legal counsel and have been incorpor ted in
all cases io the text and drawings. •
3. In the case of the Culligan property, we have made a diligent eff rt to
work closely with the applicant at its early stages and in the pr cess of
the platting itself. As a part of our planning office hours servi ces to the
citizens of Mendota Heights, we frequently go into the field with the
applicant prior to the development of plans in cases where we fee there
may be need for a sensitive approach to a problem. In the case o the
Culligan plat, over a year ago, we walked the land with Doctor Cu ligan and
his son on two occassions. Our suggestions included these salian points:
a. Do not try to develop all of the property, but emphasize
quality of site rather than number of lots.
b. Retain a large undeveloped area at the toe of the slope
the north side of the property as a screen to the view
from the river valley.
c. Retain undeveloped areas along the westerly side of the
property (contiguous to Mendata) to retain the natural
slope and tree cover in this area as well.

d. Place a single roadway in the strategic position whereas
the slope and tree cover wi11 be retained to the maximum
extent feasible.
e. Orient the opening of the cul-de-sac toward the south and
east (away from the river valley and Highway 13).

Commission and Council.

of the lots in the more critical areas of the plat. We feel thes plans
represent a reasonable and approp'riate way in which to handle the individual
homesites on these properties.
6. 4Je have also looked carefully at the proposed systems for mitigat'ng problems
of run-off during the development. You may wish to refer all of hese
engineering details to your City Engineer, with whom we have disc ssed some
of the elements of this proposal during this interim period.
7. The drawing submitted by the applicant indicating the impact on
cover is of critical importance. The dark shaded areas on this
indicate the existing tree cover to remain. You will note that
development is heavily screened from the river valley and from t
the slope to the west. This map best illustrates the validity of

Dept. of Agriculture. It is an accurate collection of all activitie and
accom�lishments done i.n our city this past year. All costs shown ar accurate
except that of the average cost of replanting / tree. The figure sh wn on the
report reflects the cost using a equipment allowance chart furnished by the State.
This chart only allows 1/3 the actual cost of running a piece of equ pment.
Using our figures on equipment allownaces we find that the actual co t of
planting a tree this fall came to $'77.23.

3. Babe Ruth Baseball Fields. Discussion was had regQrding the problem of n t having

include leasing land and revamping of the ballfields at Mendofia School. Liz Witt
will do some further checking into this and report back at the next meetin .
4. Park Survey. Mills being absent, he did not make a report on the park su�fvey but will
do so at the next meeting. I
5. Recreational Volleyball. Dewey reported through Liz Witt that the men's volleyball
program is going reasonably well and that the women's program is excelle t. There
was little or no interest in the couple's volleybpll program and it has been dropped.
6. Park Landscaping. Rudy reported that the Friendly Hills Park Landscaping is completed
and work is being done on ivy Falls and Wentworth Park. The City has obtained ap-
proximately 140 three-inch trees, twenty-five of which wi II be placed in various parks.
7. County Trails Plan. Liz has received a letter from Dakota County regardi g the county
trails which would interconnect with our trail system. The infient of the I tter was to
say to keep working on our own trails which will eventually link up to a ounty and
statewide trail system.
8. Comprehensive Plan. Liz reported that the City Council has agreed to prc�ceed with a
new comprehensive plan and our input will be required during this process�.

9. Trail Applications. Liz reported that three LAWCON grant applicati
been submitted by the City for trail improvement, trail construction, and
improvements.

10. Soccer Program. Howe moved to commend Rudy for his quick and good wo k in
setting up the soccer fields for the Mend-Egan Soccer Program being run this fall.
Goals were constructed and fields I ined and over 270 kids came out for soc er this
year. Motion seconded and possed. I also reported that contrary to expec ations, '
the football program did not suffer as a result of the soccer program.
11 . Playground Equipment. Gustafson reported that the playground equipment
Park was nearly completed as a result of two Saturdays' of work by the Me
Jaycees. Rudy indicQted that they may have to put in some tile to drain t
ground area as when they drove the holes for the equipment it was faund tl

PLANNING CONSIDERATIONS
1. The applicants are constructing a"Schwinn Cycle Center" on a 15 wide lot,
immediately east of the Swenson Carriage House Furniture Store. e have
reviewed the site plan�extensively with the applicant prior to i s approval
� by the Council and the issuing of the building permit. The prop sed
development conforms in all respects to, City Ordinances.
2. The applicant is applying for a variance to the location of the ylon sign
to conform with the location of the pylon sign already construct d for the
Swenson Carriage House. The Ordinance requires that this sign b set back
thirty (30) feet. In the case of the Swenson Carriage House, a ariance
was issued allowing them to place the sign on the property line nasmuch as
there is a 45 foot distance between the service road and the pro erty line.
PJormally, this distance is approximately 15 feet on a typical r aduiay.
3. The applicant proposes to build a sign 8 feet by 12 feet (approx mately the
same size as the Swenson Carriage House sign). The Ordinance al ows a sign
100 square feet in area. The desiqn of the sign is indicated by a sketch
� attached to this report. It will add similar "colonial" charact r to that
of the Carriage House sign.
4. The property to the east of the property is zoned residential an therefore,
the extension of additional businesses to the east are unlikely. Thus,
the allowance of this sign variance will not produce a precedenc involving
additional businesses.

We feel that this'request is reasonable, inasmuch as it conforms�with the
previously approved sign of the Swenson Carriage House and will ot adversely
affect the image in the area in view of the excessive distance b tween
the property line and the service road constructed to serve thes property
frontages.

the attached sketch, we have indicated the location of the lots a they
relate to other lots in the area and existing homes.
2. UJe suggest that the diversion of these three lots into two 90 foo lots
is in keeping with the City's intent to promote lots nearer the 1 0 foot
standard, even in areas where the lots haJe previously been platt d at

the Zoning Ordinance are within 70% of the 100 foot, 15,000 squar foot
lot area requirements, they are deemed a buildable lot. If they a e less

is required prior to issuance of building permits.
2. The lots in this area of the City were platted at 60 feet and a c nsiderable
number of the lots have been developed at that frontage. On the ttached
sketch we have indicated the location of existing houses in the a ea as they
appear on the City's topographical and aerial photo maps.
3. Recently, the City constructed sewer and water in John Street fror�ting on
the lots in question. The sewer connection was constructed and as essed to
each of the lots in question. This would indicate the City's int nt to
allow construction on each of the lots as a buildable lot.
4. The applicant is now requesting such-approval. It would appear tF

The Planning Commission will review and recommend a draft of the ques ionnaire to
•the City Council at its December 27th meeting. The next regular meet'ng of the
City Council will be January 3, 1978 and the questionnaire will be an agenda item.
It is hoped that the City Council will be able to review and approve final copy
of the questionnaire at the January 3rd meeting.

questionnaire, it would be appreciated that they make their concerns

I would like to have the opportunity to meet with the City
Council of Mendota Heights on Tuesday, December 6, 1977,
regarding a new housing program which I believe of,fers a
community such as Mendota Heights a good approach to meeting
the housing needs of low and moderate income families, in a
manner consisterit with the Metro Council Allocation Plan
without developing project housing. Under this program,
the HRA would acquire single family homes on scattered sites
throughout Dakota County, make any improvements ihat are
necessary to put the units into good condition and lease
them to eligible families.
The Dakota County Commissioners have endorsed this program
and the Department of Housing and Urban Development has
provided a grant to purchase 70 units to Dakota County, suffici
to permit a small number in Mendota Heights, if the City Counci
elects to participate in the program.
Enclosed is a Fact Sheet of the Scattered Site Acquisition.
Program and an overview of the present status of low and modera
income housing in Mendota Heights. This information shows the
three year goals through September, 1979, that were estab-
lished by the Metro Council Housing Allocation Plan; and the
Dakota County Housing Assistance Plan as relates to the City of
Mendota Heights, which shows a breakdown between the Section 8
Existing Housing Program, the Section 8 New Construction
Program and the Scattered Site Acquisition Program. This break
down represents what the HRA considers a practical approach to
meeting the Metro Council Allocation Plan Goal. The projected

106 units of assisted housing in Mendota Heights in the Dakota
County Housing Assistance Plan is slightly more than the 91
contained in the Metro Council Allocation Plan due to the fact
that the'Housing Assistance Plan incorporates an additional
program year through September, 1980, and that Metro Council
considers the allocation goal to represent a minimum level of
housing assistance. The overview also shows the currect
status of the Section 8 Existing Pragram in Mendota Heights.
In addition, I have included a model Cooperation Agreement whic
HUD requires communities participating in the Scattered Site
Acquisition Program to enter into jointly with the HRA; which
may be amended in certain areas if necessary. I hope to fully
discuss this information and address the concerns of the Mendot
Heights City Council.

SUBJECT: Proposed 1978 Salary Adjustments
This memo and the attached salary praposal is presented for
cansidera�ion and discussian, t�iith our smali nan-union force, I
not seen �it ta suggest or �ormu].ate a sophisticated pay classif
system. Although �he campensation is based on jab cluties and sp
pasitions, I am a strong believer tha� the compensation should b
adjusted according to the special abilities of the individual.

cansistent with, other similar municipal and governmental positio.
I have used a figure of 7� as a basic increase. Xau will nc
most of the recommended increases are very close to the 7ro tigur�
variations from 7� represent specia.I adjustments because af abila
performance; or other camparable factars. I have used 7� becaus�
a number af precedents establ.ished thraughout �he area. Many of
school settlements have been for 7% ar greater. 5ome public worls
settlements have been at slightly over 7�. Virtually all publi.c
bargaining has ended up at 7�, give ar take a].ittle.
As to our own union negntia�.ions, I have �his to present:
1.. The Palica negotia�ians for the NiAMA group are
sti11 in mediation. The mediator apparen�ly is
c?oing his best to keep the sessians alive in an
attempt ta avaid campulsory arbi�ration.
2. As to the PubZic Works contract, S have made an
affer to �.he Business Agent based on about 6.7�k
increase. I tznderstanH that the offer has been
rejected by the men and I am anticipating a
meeting some time in the near fu�.ure.
Based an �.he above informatian, I have arrived at �he attac7
recommendations. You wa,ll note �.hat it does nat include any pro�
for changes in insurance, mileage ar other similar bena�its. Alt
number of communities axe in the thraes o£ insurance increases (�
there is a dedicated attempt to stabilize heal�.h insurance cantr]
employer. The recammendeci rates can be campletely fundec3 within
set forth in the 1978 Budget propasal. Therefore I would ask yot

supply deficiencies. One way of getting this line in now is to mak it a
part of the proposed elevated storage program.
To do this proposed work will require the instatlation of appr ximately
3,000 feet of 16 inch ductile iron pipe and appurtenances for an estimated
cost of $180,000.00, including fees and contingencies. The abutting pro-
perty on the north side of the street is part of Somerset Country Club.
On the south side are individually owned larger parcels 5 to 10 acr s in
size. It is possible to assess about 5,000 feet of frontage and using a
nominal $12.00 per foot, assessments could bring in about $60,000.00. The
golf course has about 2,800 feet of frontage. Based on previous prlactice,
it is likely that most of any such assessments will be deferred.
It is highly recommended that this segment of the municipal water
system be installed as part of the proposed elevated storage progra . It
is feasible when included with a major water project. The Owners of pro-
perty adjacent to Wentworth Avenue should be made a part of the anticipated
public hearing.

Jeff Ruehle
As you know, Jeff completed his six-month probationary peri d
October 18, 1977. In keeping with past practice on all employee ,
I snbmit the following comments regarding Jeff and his work.
During the six-month probationary period, I feel that Jeff a
done a very good job. Because of the nature of the work, it is t
times difficult to measure the productivity, however, recently m
of the projects he has been working on have begun to take shape.
Many of these projects on the comprehensive plan are fairly invol
and complicated. It is apparent to me that Jeff understands his a
well and the end results are very good.
I feel that Jeff is a very competent, dedicated and consc
employee. The on�.y negative comment I have would be that Jeff
been tardy by small amounts of time on several occasions.
In view of the above comments, I would recommend that Jeff's
salary be adjusted as we do with other employees who satisfactori
complete their probationary period. I would recommend that Jeff'
salary be adjusted from the present $800 per month to $824 per mo.
retroactive to October 18th. This represents a 3� increase and y�
the $833 maximum CETA salary participation.

Interceptor Maintenance Agreement No. 130

We have again received a renewal proposal from the Metropoli
Waste Control Commission for the maintenance of the headhouse and
associated equipment. The City forces have been performing this
maintenance since the take-over by the MWWC, and we have been pai
the actual costs for labor, materials, and associated costs.
The only change in the agreement for 1978 is that the estima ed
costs are set at $5,900 compared to $3,732 for 1977. Z'he differe ce
for actual costs will be billed to the Metropolitan Waste CQntrol
Commission on or before February l, 1979. The new estimated cost
figure will be more in line with the actual cost than the previou
figure. �
I recommend that the Mayor and Clerk be authorized to renew i
agreement for 1978.

Municipality may have in such vacated areas; and, in so far as it
is lawfully able to do so without cost or expense to the Local
Authority or to the Municipality, cause to be removed from such
vacated areas, in so far as it may be necessary, all public or
private utility lines and equipment;
(c) In so far as the Municipality may lawfully do so, (i) grant
such deviations from the building code of the Municipality as are
reasonable and necessary to promote economy and efficiency in the
development and administration,of such Project, and at the s�me
i:ime safeguard health and safety, and (ii) make such changes in
any zoning of the site and surrounding territory of such Project
as are reasonable and necessary for the development and protection
of such Project and the surrounding territory;
(d) Accept grants of easements necessary for the development
of such Projects and;
(3) Cooperate with the Local Authority by such other lawful
action or ways as the Municipality and the Local Authority may
find necessary in connection with the development and

thereto (in consideration whereof the Local Authority shall pay
to the Municipality such amount as would be assessed against the
Project site for such work if such site were privagely owned); and
(b) It will provide, or cause to be provided, water mains, and
storm and sanitary sewer mains, leading to such Project and servinc
the bounding streets thereof (in consideration whereof the Local
Authority shall pay to the Municipality such amount as would be
assessed �gainst the Project site for such work if such site were
privately owned). . "

�` 7. No Cooperation Agreement he�retofore entered into between th �
Municipality and the Local Authority shall be construed to apply to this Project
. covered by this Agreement.
8. No member of the governing body of the Municipality or any
public official of the Municipality who exercises any responsibilities
with respect to any Project during his tenure or for one year thereaft
have any interest, direct or indirect, in this Project or any property
or planned to be included in this project, or any contracts in connect
such projects or property. If any such governing body member or such �
public official of the Municipality involuntarily acquires or had acqu
to the beginning of his tenure any such interest, he shall immediately
such interest to the Local Authority. -
9. So long as any contract between the Local Authority and the
for loans (including preliminary loans) or annual contributions, or bot
connection with this Project remains in force and effect, or so long as
bonds issued in connection with this Project or any monies due to the G
in connection with this Project remain unpaid, and so long as this Proj
owned by a public body or governmental agency, including Government, an
for low-rent housing purposes, this Agreement shall not be abrogated; c
or modified without the consent of the Government. If at any time the
title to, or possession of, this Project is held by such other public b
governmental agency, includTng The Government, the provisions hereof sh
to the benefit of and may be enforced by such other public body or gove
agency, including the Government. Otherwise, this Agreement may be ter
by the Municipality at any time.
10. The Municipality hereby gives prior approval of location of �
site that may be selected by the Local Authority under this agreement, :
as no more than one site_is located on.any one square block. The Munic
and the Local Authority agree that this action constitutes the approval
Housing Project within the Municipality's boondaries by the governing bi
of the Municipality, as is required by.Laws of Minnesota, 1971, Chapter
Section 3.
