Pursuant to due call and notice thereof, the regular meeting of
City of Mendota Heights, was held at 7:30 o'clock P.M. at the Ci

Mayor Lockwood summarized previous Council d scussions on NSP's
application for con�.itional use permit. May r Lockwood noted
that the area residents and NSP representati es had met on
November 30th to discuss the application and resolve several
problems. He asked Mr. RQbert Lockard and . Ralph Thaamlitz,
co-chairmen of the citizens' group, to repor on the outcome of
the meeting. Mr. Lockard stated that questi ns which were of

report for November and the final report on 977 Dutch Elm
Disease program activities,
The Council acknowledged receipt of proposed notices to
bidders and specifications for a fire truck hassis, fire
truck and related fire equipment. Fire Mars al Gene Lange
gave a brief graphic and verbal report on th City's fire
rating and the effect a new 1250 GPM pumper y have on the
rating. Fire Chief Siebell and Fire Marshal Lange and other
members of the Fire Department explained the need for the
proposed equipment and, in addition, their d sire to remodel
the 1961 Ford fire truck, rebuilding it into a Quick Response
Vehicle. "

The Cauncil acknowledged receipt of the ParklCommission
minutes for October 27, 1977.
The Council acknowledged receipt of a copy o a letter from
Park Commission Chairperson Liz Witt to vari us organizations
advising the organizations of an upcoming Co ission vacancy
and requesting names of suggested candidates for appointment.
The Council acknowledged receipt of the minu�es of the
November_22nd Planning Commission meeti�g.
CASE NO. 77-34, Administrator Johnson explained the applicat`on for sign
PARK SCHWINN location variance for the Park Schwinn Cycle Center, He
noted that the applicant proposed to install the sign on the
same setback as the Carriage House sign. Co cilman Wahl
expressed concern about whether the sign wou d be Iighted and
if so, what the hours of lighting would be. The Council
directed the City Administrator to check wit the owner,
Art Engstrom, to determine the proposed inte sity and hours
of lighting.

Mr. George Ostrand was present to request ap roval of his

that he plans to redeem the property himself.

Developer and then later on to individual lot developers. If a g ading
� plan is approved, it must be adhered to. Once again, how and who �will
police the activities of an individual builder? What constitues "reason-
able development of the property? The concept of haybale dikes has been ,

Proposed Layout for Eagle Ridge Phase II, Outlot "A"
We have conducted a review of the proposed layout for Eagle Ridge Eas�
present the following comments for your consideration in review of th
proposal:
1. Buildings identified by Number 9 through 14 have been situated on
the site in such a manner so as to provide same degree of spatial
sequencing and visual interest. The location of these buildings
appears to be appropriate when considering the configuration of
the property boundary, the location of existing utility easements
and also in consideration of the lay of the land which generally
slopes from Marie Avenue south and easterly. Although Unit 9 is
located within five feet of the southeast property line, it must
be realized that vacant land southeast of this property line is
under common ownership by the Eagle Ridge Homeowners' Association
and no development of this land will occur.under the existing
by-laws and covenants of the Association.
2. It is felt, however, that less asphalt area is required in the
layout. In this regard, please refer to the attached sketch
which identifies the driveway and access changes. You will note
on the sketch that the 24 foot drive which previously existed in
front of Units 7 and 8 has been removed and will be recreated as
a green area. The purpose for moving this is the fact that the
original intent and function of having that 24 foot driveway
running in an east-west manner with a curb cut at either end at
. Marie Avenue, simply is no longer required under the present
concept of situating the buildings,as shown in these layouts.
This enables adding a significant green area in the front of
Units 7 and 8 and will still allow for access from Marie Avenue
to Unit 8 as shown in the drawing. You will also note that the
d'riveway from Marie Avenue to Unit 8 has been narwowed to 16 feet
again reducing the amount of asphalt required while increasing
the amount of green area in the development plan.• You wil•1 also
note that guest parking bays have been provided in the revised
plan in addition to the four spaces per each unit.

These design modifications have been reviewed with Mr. Tuminelly and are
agreeable to him. The significance of these changes is the fact tha
greater areas of green space are created with less area of asphalt.
The proposed development is consistent with the original intent and once
of the area and the recommended design modification, we feel, will add to

AN ORDINANCE ESTABLISHING A WATER AVAILABILITY C
Section 1. Purpose and Intent. For the purpose of p
establishment, obtainment, construction, reconstruction, r
replacement, depreciation, enlargement, maintenance, and i

Unit" Charge;
(b) "Basic Equivalent Unit" for the purpose of this rdinance,
the following classifications of property according to the use made
thereof are hereby established for determining the basic e uivalent
unit charge to be made:
(1) Group One - each detached dwelling single f mily
living unit shall constitute one "Basic Equivale t
Unit"; , _
(2) Group Two - all other living units, includi�g town-
houses, condominiums, apartments and any other " ttached"
living units. Each such living unit shall constitute
80 per cent�of the "Basic Equivalent Unit."

facsimile signature of the Mayor's signature to be used and honor

WHEREAS, under the applicable Minnesota Statutes, the use of
facsimile signature is authorized Drovided that the City obtain
appropriate insurance protecting the City against the loss of any
public funds withdrawn upon unauthorized use of such facsimile
signature; and
�+TF�REAS, federal law requires that federal tax withheld on i divid�aal
payroll checks be submitted within three days of the payroll date, which �
makes conventional Council authorization impractical.
NOG�T THREFORE, BE IT RESOLVED by the City Council of the City
Mendota Heights as follo�vs: •
1. That Resolution No. 431 adonted by'the City Council
on April 18, 1�372 be and is hereby rescinded.
2. That the oa1roll checks o£ the City may hereafter
bear the facsimile sig?iature of the Mayor of this
City ar:c� such payroll checks with such facsimile
signature shall be honored as fully as though they
bore the manually �aritten signature of the Mayor.
3. That the check to the Director of the Internal Rev
Service be prepared and submitted at the same time
