petitioned the City, to construct Executive Drive between Mendota He5
Road and Northland Drive, with watermain connections, storm sewer tc
the right-of-way and adjacent properties, street lights and the stre
which will provide access to the developing lots.
DISCUSSION:
This project is fairly straight forward as the two east-west
the perimeter of the site are already fully constructed. Constru
Executive Drive will allow the vacant sites to access a street ot'.

to the new Solvay building and two vacant sites will be provided fr m this

A new main will be constructed to flow to the existing pipe in Mendota
Heights Road. This new pipeline will in turn connect to the intern 1 sys-
tems of the developing sites, which will be required to temporarily hold

system. Estimated costs of storm sewers, engineering, overhead and contin-

Since the proposed street grades closely match the existing to ography,
a minimum of site work will be needed. A full width street, comple e with
lights, identical to Northland Drive will be constructed, with acce s to up
to four sites provided. Estimated cost of street construction, eng neering,
overhead and contingencies is $60,000.
COST AND ASSESSMENT SUMMARY
The following is a table of total costs and assessments spread as
requested by United Properties. They have requested that the AART ite pay
only for half (1/2) of the storm sewer costs, as they will be recei.ing
sanitary sewer and water service from Northland Drive. The rest of the
costs will be assessed on an area basis to the three remaining parc ls.

WHEREAS, the City Engineer has submitted his report to the City Co ncil
with respect to the proposed construction of the f ollowing improve ents
to serve Lots 3, 4, 5, 6 and 7, Block 4, and Lots 1 and 2, Block 5
Mendota. Heights Industrial Park, to-wit:'
The construction of an extension to the City's ��ater distribu ion

One of the tentative recommendations coming out o£ the
Citizens Park Review Committee is that the ballfield ne
City HaZl should be upgraded to a full size softbal2 st
and useable for yauth baseball. The preliminary needs
analysis indicates that this faci•lity will be required,
if the Cit� adds a substantial athletic�camplex elsewhe
the commun�ty. There also seems to be a concensus on t
Parks Review Cammittee that the City proceed to develop

Chuck Mastel o� Mend-Eagan Athletic Association appeared
be�ore the Parks Cammissian at its meeting of February 1.
Mr. Mastel and the Commission discussed a potential layo t
for the park. The Engineering Department had estimated
improvement costs at around $35r000 -$40,Q40. The
improvements include fencing the entire facility, reseed ng
or sodding the outfield, regrading of the infield, and
assorted other site imprQvements.
The Parks Cammission voted unanimausl� to praceed with t e
development of the field at an approximate cost of $40,0 0.
They reque�ted staff �a come back with a more definitive
development plan and cost estimate for their Mareh 14
meeting. .
Although no farmal Councii action is required at this ti e,
the purpose of this memo is ta alert Gouncil to the fact that

programs without a reareation director. At its meeting
February 14, the Parks and Rec Commission reviewed these
pragrams, and made the foilowing observations and
recammenda�ion� far 1989:

Chuck Mastel from Mend-Eagan Athletic Associatiort indicat�ed
that the Assoca.ation would like ta continue ta run progr m�
during 1989. Tn 1988, the City provided a$15.04 per
rega.strant subsidy, leaving the parents ta pay anly $10. 0.
At the end of 1988, Mend-Eagan billed the City far 201
registratians or�x; $3,015.00.
Mr. Ma�tel zndicated to the Cammission that he anticipat s
costs�might be up about $3.00 for each participant for 19 9.
It was the Commission"s feeling that the City should not
increase its subsidyr but should continue the $15,00 per
registrant. Any increase, if in fact necessary, would b
bore by the participants, It is assumed that the total ost
to the City wouid then be about the same as for 1988.
AR -IN-THE-PARK
The Communa.ty Education Department of School District 19"
operated our Art-in-the-Park Pragram for y988. The prog:
was offered at Ivy Hills, Marie and Friendly Hills Parks
Tha pragram seemed to ga well, and the Community Educati;
Department is willing to run it for us during 1989.
Communi.ty Education Director Sally Waring has indicated 1
that it was almost a"break even" program so that tha Ci�
subsidy will continue to be little or nothinc�. The Parke
Rec Commissian recammends that we have Distr�.ct 197 aper<

Last year we retained our warming house leadman, Grant
Englemann, to also run the men's summer softball program.
However, in preparing for 1989, it did not appear that tl�
was really that much of a role for a coordinator. In otk�
words, the teams can run the program themselves, with onl
minor clerical and coordinating functions being performed
a city employee. I
Engineering Secretary Diane Ward is herself a softball p
and has voluntarily taken on the task of keeping up the
rosters, keeping track of standings, ordering su�plies,

Our staff has reviewed the applications, work history, evaluations
results of the oral interview (which you attended). Of the four
candidates, Roger Plath, Larry Bridger, Mario Reyes and Jeff Piotr
have decided that Officer Larry Bridger best meets the requirement
assignment and the needs of the Department. That decision was mad
this week and Larry will assume his new duties when the new office
appointed in March.

We received 55 applications'from MPRS. Fifteen were rejected base
minimum qualifications and the remaining candidates were given unt
February 13 to let us know whether or not they were interested in

The eight "finalists" are now completing a very extensive personal history
inventory and they will appear before an oral interview panel on W dnesday,
March lst. The panel will be made up of inembers of our Department. .���This
method of interview was very effective in hiring Officers Piotrasc ke and

interviewed by me. When we identify our top candidate, we will in erview

DISCUSSION:
At the time the feasibility report for Val's Addition was pre-
sented to Council not all the affected landowners had signed a petit
and waiver of the public hearing so a hearing date was set by Counc�
for this meeting. Now a petition for the improvements and waiver of
public hearing document has been signed by all the affected parties
(see attached). There are 1�0 lots affected by this improvement and
costs will be divided equally among �hem (see attached map). Estim�
cost per lot is $20,221.
RECOMMENDATION:
Staff recommends that Council conduct the public hearing as c�
f or and if there is no input to the contrary, no other action is
required by Council because as the plans and specifications were or
dered previously.

The City Council recently approved a preliminary plat as presen

Sanitarv Sewer
Sanitary sewer will be extended from the existing s wer line
under T.H. 13. The cost to extend the sanitary sewer to serve the
ten lots will be $25,200, including engineering, overhea , and
contingencies. The attached drawing shows the proposed ayout of
the sanitary sewer.
Watermain
Watermain can also be extended from T.H. 13 to serv
development. The cost to do so will be $34,200. In add
this construction, the existing watermains that dead end
Hiawatha and at Miriam can be looped together as a part
project. Although looping of these mains is not necessa
serving the new lots in this development, doing so would
firefighting capacity, reduce stagnant water problems, a

The attached Ivy Falls Creek Addition project is a project that
been around a long time, the preliminary plat was first presented by
Carl Anderson as Hillaide Creek in 1986. Now Mr. Keith Heaver, a loc
developer, has taken it over. The feasibility report was presented t
Council and approved in November 1987 with two alternates:
1. Brookside Lane was to be bid to connect through to Laura St eet
with the City retaining the flexibility to deduct the porti n
lying east of the new development depending on final costs. The
affected reaidents are in favor of the project if the costs do not
come in too high.
2. A trail with a bridge over Ivy Creek was to be installed co -
necting this neighborhood to Somerset Elementa.ry School. T is
construction would be paid for out of Park funds. This ite is
also being bid as an item that can be deducted depending or� costs
(Estimated Cost = $30,000). I
RECOMMENDATION:

The Centre Pointe Medical Clinic recently submitted a request
City for a sign permit. The permit request conf ormed with the City
ordinance requirements however Council delayed granting the permit
to the development of a uniform signage policy by Yorkton. Yorkton
agreed with Council on the need for a uniform sign policy and has s
the attached policy for Council review.

1. SIGN LOCATIONS
The location of each building sign shall be shown
on a site plan and shall comply with setbacks es-
tablished by the city.
2. SIZE OF SIGN
The size of each building sign shall comply with
criteria set forth in this guideline and with city� ...,.
codes. The overall size may be dictated by the siz
of the effected building. Also, a certain length/
width ratio must be adhered to.
3. SHAPE OF SIGN

As you will recall Dale Glowa was before the City Council las meeting
to update you on the problems that he was having with Dakota Count in
obtaining entrance permits for his Big Wheel Auto site. The Bid'W eel Auto
site is to be located along Pilot Knob Road which is a County Road and
therefore requires a county permit before a driveway can be constr cted.
Dale asked for City Council's assistance in obtaining the permits nd the
Council directed City staff to contact the Dakota County Administr tor, Mr.
Lyle Wray to see what could be done to work out a solution. Kevin Frazell
did contact Mr. Wray and attended a Dakota County Plat Commission eeting
and they have worked out an arrangement whereby the County will ag ee to
grant the accesses if the City agrees to accept back Pilot Knob Ro d north
of future Trunk Highway 13 after the State finishes constructing T unk
Highway 13 in 199�•
BUILDING PERMIT
Dale needs to have Big Wheel's new building completed and rea
occupancy by December 1, 1989 so he has submitted the attached pla

United Propert'ies Development Company requests the appro al of
the City of Mendota Heights for a buildiny permit subjec to
staff's approval of final plans and specifications for t e Biy
Wheel Auto Stores Building. As requested, we have inclu ed 15
reduced copies of the site plan, building elevation, and the
preliminary landscape plan for the referenced project. lso
included is our application for building permit.
The subject project will be located on approximately 6.1 acres on
the east side of Pilot Knob Road as part of the Acacia p o�erty.
The architectural design of this building will incorpora e
painted tilt-up concrete panels around the wareho use bui ding
with a concrete material and glass around the exterior o the
attached two story office portion of the building. The uilding
will consist of approximately 65,000 square feet of buil ing
ar ea . `
Big Wheel Auto Stores is currently located on riendota He
Road in our Mendota Heights Business Park. They have ou
the building that we built for them approximately nine y
and are very excited about this new corporate headquarte
facility, which is approximately double the size of thei
existiny building. As you know, the site plan is consis
the preliminary plat that we have previously submitted o
Acacia property for your approval. We assume that said
preliminary plat will now be approved since the County h
to certain curb cut variances as requested on December 1
by the City of Mendota Heights, with the expectation of
taking back this portion of Pilot Knob Road when the imp
to Highway 13 and Pilot Knob Road are completed in appro
two years.

WHEREAS, Developer praposes a plat for a business ark
" development i.n Mendota Heights to be known as Mendota H ights
Business Park Addition {Acacia Park), cansisting of �we ve lots
, on approximately 49.53 acres lacated on the Metrapolita Airparts
Commissian (MA.Cj site in Mendota Heights; and
WHEREAS,, public servi.ces are needed by the Develop�r from
Mendota Heiglits in order to praceed with said developme�t;
NOW, THEREFORE it �.s hereby agreed by and between
parties as follows:
1. In the event that the City initiates litigatia
ta enforce performance of Developer's
obligations hereunder and prevails in any such
action, the City shall be entitled to
reimbursement af a1I costs and reasonable
attarneys' fees incurred in cannection
therewith, whether incurred priar to or after
entry of judgment.
2, Developar will petition the City for needed
public impravements (sani.tary sewer, storm
sewer, watermains and streets).
3. Developar will pravide at na cost to the City
a11 needed temparary construction easements to
install said improvements and those permanent,
right af way and easements necessary �or said
public impravements.
4. Developer will proceed immediately ta
cammission a registered land surveyor to place
and maintain enaugh lot corners so that street
center].ines and all utilities can be located by
Czty staff.

5. Developer agrees to grade site accarding to t'
grading plan appraved by the City and to
protect the environment by the use of good
erosion control methods. Minimum erosion
control requirements will consist of tap
dressing, seeding and mulching of disturbed
areas within 30 days af site work completion,
as well��as the use oE a sump area follawed by
double row of silt fences where cancentrated
surface water runoff takes place (per gradi.ng
plat) . `
6. Developer acknowledges that there will be park
contribution due to the City as per Ordinance
301, Section 6 as amended by Resalutian 80-16.
That cantribut3.an is to be the sum of $33,570.
The $33,670 shall be payable pro rata as
buiZding permits are obtained for tiie platted
lots within the subdivision. The payment shal
be pro rated based on the land area cantained
in the platted lot far which a building permit
is being;issued as compared to the tatal land
area contained within the platted lots of 44.5
acres. Any unpaid balance sha31 be due in ful
no later�than January 1, 3999. Attached is a
capy of the proposed plat setting forth the
areas of the 1ats. If a different plat is
finally approved, then a new calculation of th
area within the platted lots shall be prepared
and used in lieu of the attached for the
purpose oi computing the above payment.
7. As part oi the grading aperations, the
Develaper shall stackpile 2,400 cubic yards af
topsoil east af Pi.3at Knob Road and 250 cubic
yards of topsail west af Pilot Knob Road for
use by the City in boulevard restaratian.
8. The Developer wi11 be responsible for repairing
damage to public utilities incurred as a result
af building canstruction ar private utility
installa�ion.
9. If and when there is an excessive buildup of
mud ar dirt an existing City streets as a
result af grading or building operations, the
Developer shall have the aifectad streets swept
by mechanical means at the directian of the
City.
1Q. Developer acknowladges this praperty falls
within an airport noise zone and that it will
have to comply with the City's naisa ordinance
requirements.

sensitive and that funds are availab2e to tak

feasibility study pursuant to Ordinance Na.
1508, the Developer shall pravide a cash escro
deposit or letter of credit in favar of Mendot
iieights in the sum of $2,500. Such surety
shall remain with the City until the plat is
completely rough graded and erosion control
required in paragraph 5 above has been
completed and construction af the impravements
in paragraph 2 hereo�' commenced as provided fo
in Ordinance 1508. Until such time, Mendata
Heights may take remedial or corrective
measures with respect to the erosion control,
if needed, paying for such from the surety.
The am�aunt of returned surety will be
de�ermined by the amaunt of remedial ar
corrective work done and as provided in
C?rdinance 1.508.

On October 18, 1988 City Council approved a resoluti

The City of Mendota Heights will use the grant monies f om Dakota
� County to fund its Curbside Recycling Program. The Cit will use
its Rubbish Hauling Ordinance, and the licensing rovisions
� within it, to require the licensed haulers in Mendota eights to
provide the curbside recycling services.
The first purpose of this memo is to summarize th Curbside
Recycling Program and our approach to it. The second urpose is
to explain the new Rubbish Hauling Ordinance that wi 1 rescind
and replace the old ordinance. ,
CURBSIDE RECYCLING
One of the benefits of starting a recycling program ater than
many of the other metro area cities is that we can earn from
their mistakes and copy their successes. One them that is
fairly constant is that success is based upon making e program
as simple, convenient and reasonable as possible. Th following

are starting with a voluntary sign-up because we want o involve

Our approach is to supply containers to those who want them

PROPOSED NEW RUBBISH ORDINANCE
As stated above, the City is requiring haulers o provide
curbside recycling collection through our licensing p wers. It
is necessary to add provisions to our existing Rubbi h,Hauling
Ordinance that ordain the new recycling requirements. �
Staff feels that the old Ordinance is quite outdated,
requesting that Council rescind the old Ordinance and
proposed Rubbish Hauling Ordinance to replace it. At

Yard waste, such as grass clippings and leaves,
must be bagged separately from other refuse.
Residents are encouraged to reduce bagging and
disposing of yazd waste by mowing or mulching
your lawn often and composting at home. This
will benefit yards and gardens while saving space
at the landfill. County compost sites aze available

ORDINANCE N0. 1004
AN ORDINANCE REGULATING THE DISPOSAL OF GARBAGE AND RUBBI
FOR THE COLLECTION THEREOF, AND LICENSING THE BUSINESS OF
RUBBISH COLLECTION.
SECTION l. LICENSES REQUIRED
Hereinafter it shall be unlawful for any person to collec
or buy any garbage from or to any place within the corpor

For the purpose of this ordinance, garbage shall be defin d to include al:
waste matter or material of every kind, and shall be clas ified as either!
wet garbage or dry garbage. Wet garbage shall include ev ey waste acc- '
umulation of animal, fruit, or vegetable matter that atte ds the prepara-'
tion, use, cooking, keeping, storing, buying, selling or ransporting of
meats, fish, fowl, birds, fruits, vegetables, and other p ovisions, to-
gether with table refuse of any kind. Dry garbage shall 'nclude all re-
fuse which is not wet garbage, including but not limited o such articles
as dust, ashes, cans, broken glass, paper, and sweepings.
As used in this ordinance, the term "person" shall mean a d include a
natural person of either sex, persons, co-partnerships, c rporation, or
associations of persons and shall include the agent or ma ager of any of
the aforesaid. The singular shall include the plural and the masculine
pronoun shall include the feminine and neuter. �
SECTION 3. APPLICATION
Application for such licenses shall be filed with the Cit� Clerk on forms
furnished by the City.
SECTION 4. FEE
The fee for each such license shall be $25.00 annually. hen a license
is issued, the City shall furnish to the licensee f or a c arge of $15.00
a metal license plate for each vehicle to be used by such licensee within
the City of Mendota Heights, which license plate shall be affixed to each
such vehicle in a conspicuous place. �
SECTION 5. ISSUANCE OF LICENSE
All licenses shall be issued by the City Clerk.

SECTION 1. TITLE
This ordinance shall be known, cited and referred to a
Mendota Heights Rubbish Ordinance except as referred t

2.8 "RESIDENTIAL UNITS" means, for the purpose of thi:

enterprise of any kind is carried on, and shall i clude
restaurants, clubs, churches, and schools where f od is
prepared or served.
2.11 "SCHEDULED DAY" means that normal customar� and s heduled
day that the HAULER has informed the CUSTOMER or greed with
the�CUSTOMER to collect solid waste from the CUST MER'S
RESIDENTiAL UNIT.
2.12 "YARD WA�TE" means leaves and grass clippings or
materials as may be defined by�Council resolution

4.7 Revocation upon violation: When any person holdi g a
license has been convicted for the second time by a court of
competent jurisdiction for violation of any of th '
provisions of this Ordinance, the Council shall r voke the
license of the person so convicted. Such person ay not
make application for a new license for a period o one year.
SECTION 5. LIABILITY INSURANCE

6.3 Weekly Collection: Al1 licensed haulers shall ake weekly
collection of separated garbage and other refuse, yard waste
and recyclables available to custamers.
6.4 Collection Hours: No collections' of garbage, o her refuse
and/or.recyclable materials shall be made except etween the
hours of seven o'clock (7:00} A.M.�'and six a'c ock (6r00}
P.M. Monday through Friday.
6.5 Collec�.ing Recyclable Materials Required: A11 li ensed

network adapters so that all existing computers can be connected
to the system. Unfortunately, we have experienced sig ificant
difficulty in finding network adapters compatible w3,th the
�ystem. The purpose of this memo is to discuss our op ions and
recommend a course of action.
INFORMATTQN
The City purchased the network and NCS accounting
and utili.ty �oftware in the spring of 198&. The recom

We received 128 applications for the pasition. Ea
applicatians was reviewed for experience, skills, etc.,

the position, Three af those candidates elected not to
the job.
On this past Monday and Tuesday, we administered t�
office aptitude and communication skill testing to ten
candidates. We have reviewed�the test scores and resumE
those individuals and have invited six finala.sts to int�
next week, on Monday artd Tuesday mornings. We expect tt
prepared �o make a recommendation on a candidate for ap�

Re: Fire Department Policies and Procedures
Last week I forwarded ta yc�u a copy of the February, 989
draft of the Fire Department's Policies and Procedure
manual {please bring these with you to the meeting}. At its
general meeting of February 15th, the members of the
Department vated to adopt the document. Prior to th t vote I
requested two changes, and they were incorporated;
1. On page 4-1, Section 7 was changed fram:
"All mambers af the Department are considere City

2. On the last page, 5-18, a new article was ad�ed, ta
read as fallows:

this document and State statute or City or inance,
the statute or ordinance shall prevail.
Two additional changes since Council review of t e first
draft of this document are the removal of any re erence to a
Treasurer (as this is handled in the Relief Asso iation By-
Laws), and deletion of a policy on use of intaxi ants.

SUBJECT: Airport Noise Monitoring�
In the past, MAC has used mobile vans equipped wi�h reco
devices to monitor the noise af aircraft in various
neighbarhoads. During the recent 180 day runway test, a
temporary, permanent system was installed in Highland an
Bloomington to recard test data.

MAC feels that a permanent system will provide them with
be�ter data on a continuaus basis. As a result, they pla to
install a��stem with between 20 and 30 permanent �OGci't'10 s,
each hard wired to a central computer to monitor noise.
A Design Repor� has been completed, with a site selection
study now uncierway. Between three and five monitars will be
located in Mendota Heights. We have encouraged at least wo
locations north of Hwy 110. It is hoped �.he �ystem can b
bid by the fall of 2989 and instal.led by late summer 1990.
The information received will be a va�t improvement aver hat
is naw availab].e.
Until installed, the mabile manitoring will continue as
the past. Once installed, the mobile eguipment use will
to record essential situations and be at a greatly reduc
level.
The new system will �rovide a much better recard for Menc
Heights, with bath t�.me wise in user reliability and the
infarmation presented in a more usefu7. manner.
The effect af the new system will give us a much greater
level af monitoring.
