Councilmember Blesener and I met this morning to discus
committee work further, and agreed that these plans are
premature at this time, and may not be needed at all.
Therefore, we are not recommending approval of this aar
this evening.
We do, however, feel that Barry Warner's general assist
and "memory" may be needed at time to facilitate the wo
the committee, and to prepare cost estimates for new
proposals (i.e. the Centex Plan C park). We request Co
authorization to spend up to $2,500 with Barton-Aschman

Attached is the letter of resignation of Michael Sokol as our
citizen representative to the Northern Dakota County Cable
Consortium Commission (NDC4). Council has previously
indicated it's intent to appoint Mr. Ron Rogoshesk, 2333
Rogers Avenue, to this position.
Council was previously informed of the pending expiratic
terms for the following advisory commission members:

Bill Burke Bill Owens
All except Bill Burke have indicated their interest in
reappointment. Bill is also the only one who has sery
than one term.

Dear Mayor Mertensotto:
It is with some regret that I am writing to tender my resignation
effective January 1, 1989, as the public member for the City of
Mendota Heights on the Northern Dakota County Cable
Communications Commission.
I have served as the public member on the Commission with council
member Elizabeth Witt since March 1987 by appointment, his has
been an extremely rewarding position to me since I have teen able
to combine an area of personal interest with public service. I
know from this experience, and am able now to share with you,
that the City's interests with regard to cable communications are
well represented. Furthermore, the Commission itself en-'oys a
highly regarded reputation and has processed its business in a
fair and firm manner.
The reason for my resignation comes upon my selection to serve as
the attorney for the Northern Dakota County Cable Commun-cations
Commission effective January 1, 1989. While I am extrem(ly happy
with this career development, I will obviously miss my
involvement as a Commission member representing Mendota Heights.
I would like to thank you and the City Council for selec ing me
to serve as a Commission member and wish you all continued
success in the New Year.

An Inescapable Fact of Life!
As Council is aware, the new council chamber was pla
with cable television in mind. Most of the cable equipme
has now been installed, so we are ready to begin the proc
of becoming television stars!
Vicky Long, our NDC4 Administrator, will be at the
meeting of January 3 to tape the proceedings. This tapin
will not be broadcast over the cable system, but will mer
be a "practice run" to get us used to the cameras and
thinking about the issues involved with cable television
coverage. Vicky will make copies of the taping available
each member of the Council, so that you can view them at
at your own leisure, to evaluate how you appear to the
camera.
As the last item on the agenda, I have scheduled a
discussion between Vicky and the Council regarding policy
issues surrounding the taping and broadcast of Council
meetings. Attached are some materials Vicky has provided
with regard to the types of policy decisions that need to
considered by the Council, and also a memo from Inver Gro,i
Heights City Attorney Tim Kuntz regarding the obligation

Section 1. Background. The City Council is consid(

Section 2. Retention of Government Records.
Statute 138.163 states that disposal and preservation
records is controlled exclusively by Chapter 138
Minnesota Statutes. Minnesota Statute 138.17 defines
"government records" as follows:

The City of Inver Grove Heights, in furtherance of Cha ter 138
of the Minnesota Statutes, has adopted the records retention
schedule for Inver Grove Heights. To my knowledge, the records
retention schedule as adopted by the Records Disposition Panel
and the City retention schedule as adopted by Inver Grove
Heights are the same.
That retention schedule provides that tapes may be r used or
destroyed one year following the date that the City Council
adopted the official minutes for the meeting.
That policy further indicates that tapes are not the Oermanent
official record of the City's activities, but rather the City
Council minutes are.
Section 3. Comments. The proposed cable policy appears to
be in conformance with the City's retention schedule policy.
Both policies state that the City Council minutes are the
official records of the City, and not the tapes of the meetings.
One change, however, has to be made. In Section 3I of the
proposed policy, subdivision A should read as follows:
Subdivision A. Meetings shall be broadcast live. One tape
shall be made and shall be delivered to the City. The tape
is the property of the City. The tape shall be retained by
the City for a period of one year following the ate when
the City Council approved the official minutes of the
meeting.

Section 4. Comments From The Government Records Division. I
reviewed Sections 1, 2, and 3 of the proposed cable to a policy
with Charles Rodgers, a government records analyst as igned to
the Records Disposition Panel. His comments were as follows:
1. He complimented the City on adopting a pol�cy with
respect to tapes.
2. He believes that the above -noted sections are in
conformance with the records retention schedule,
subject to the one change being made which I discuss
above.

DISCUSSION•
Dakota County recently turned down United Propertie
Mendota Heights Business Park Plat because of driveway
spacing. The City then requested that the County grant
variances to allow the driveways (see attached letter). The
County Plat Commission still feels that the driveways ar
inappropriate and did not grant the variance request, bu
did state that they will allow the accesses if the road s to
be turned back to the City. (see attached county letterl.
OPTIONS•
1. Request that the segment of county road in question
be turned back to the City. The City would the
have jurisdiction over the drivewaysand could grant
the permits.
2. Appeal the Plat Commission's decision to the Comy
Board.
RECOMMENDATION•
Staff feels that the driveways are appropriate for he
volume of traffic expected at this location and that the City
agree to accept that part of Pilot Knob Road north of fu ure
T.H. 13 back as a city street. The driveway accesses wi 1
then be under the jurisdiction of the City.
ACTION REQUIRED:
Review the attached information and if Council desires
to implement the staff recommendation, they should pass
motion requesting the County Engineer to turn back C.S.A.H.

The Dakota County Plat Commission met on December 19, 1988, 'to cons der the
City appeal of the previous review and request for variance -of the plat of
MEND07'A HEIGHTS BUSINESS PARK. Said plat is adjacent to C.S;A.H. NO 31 and
is;• therefore, subject to the Dakota Comty Contiguous Plat ordinance.
The. -Plat Commission reviewed the requests for variances -to the unty's
spacing guidelines made by the City of Mendota Heights per lett(r dated
December 13, 1988. The Plat Commission's previous review and re ndation
did include variances from the County's guidelines. The Plat Conmissi n feels
the additional driveway requests are not appropriate for any County Road and
not based on sound engineering or safety concerns.. -The many land locesses
..-Proposed by the City oppose any normal design of an arteria]:,highway o even a
collector street by allowing indiscriminate spacing of driveways. It he City
is in favor of the several driveways, the Plat Commission recommends :he City
request the position of C.S.A.H. N0. 31 north of proposed T.H 13 be
eliminated' from the County System and thus turned over to th City's
jurisdiction. This request would be made to the County Highway Engi er. If
the road is to remain part of the County system, then 'the Plat 'ssion
feels the recommendation made in its November 15, 1988, letter s uld be
followed. The City may appeal. -the' decision of the Plat Conudssion to the
County Board.

The City of Mendota Heights recently received notice from you that the
Dakota County Plat Commission had rejected United Propertiear Mend to
Heights Business Park Addition plat as proposed. In the letter it stated
that the rejection was based on the location of a street intersect on and
the location of several driveway accesses along Pilot Knob Road (C AH 31).
The letter also stated that no individual driveway entrances would be al-
lowed along Pilot Knob Road. United Properties is an experienced tnd well
respected developer within Mendota Heights and they have appealed o the
City for assistance in convincing the plat commission to reconside its
decision and grant variances to allow for some of the driveways.
Pilot Knob Road extends the entire length of the Mendota Heig is Busi-
ness Park and there are many other driveway accesses that have bee allowed.
South of proposed S.T.H. 13 the traffic levels will be higher the they will
be north of proposed T.H. 13, and that is where existing business s now have
driveways that violate the County Spacing Guidelines; to my knowl dge there
have been no problems associated with these existing driveways.
The City requests that the County grant variances to their aLoad

1. LeMay Avenue at its first intersection with Pilot Knobnorth
of proposed S.T.H. 13. .

lots, and to determine locations of the driveways at the time the

The City feels that this could be a feasibile alternative with the
County retaining control through access permit review.
Lot 11 Block 3
Lot 1, Block 3, is the largest lot of the development an it only
has frontage on Pilot Knob Road and State Trunk Highway 3.
United Properties has found a user for this site, an exiting
business within Mendota Heights, for which they have dev loped
site plan (see attached). According to the site plan, t is site
needs access at three points, the two.to the north for a tomobile
access to the employees and visitors parking lot and one nearer
T.H. 13 for truck access. These access points are needel due to
the complicated grades along Pilot Knob Road and across his 6
acre site. Pilot Knob Road is at an approximate grade o 5.5%.
The proposed plan adequately accommodates a level footpr nt for
the building, and reasonable grades throughout the'parki g lot and
driveway entrances. Because of, the grades on the site, ruck
docks are best accommodated on the south with a driveway near T.H.
13. Truck access at this point should pose little proble for the
traffic on Pilot Knob Road because on the average there re only 6
trucks per day using the facility.
Mendota Heights and the developer would very much like o retain
this business within Mendota Heights and without the dr veways as
proposed the site is unacceptable to the business, and hey will
need to look elsewhere.

INTRODUCTION
The 1989 Capital Operating Budget includes $2,500 f
the purchase of a computer and network card for the
Administrative Assistant. Kevin Batchelder's appointmen
this position will begin on Wednesday, January 4th. The
purpose of this memo is to request Council authorization
purchase a computer for Kevin's office.
DISCUSSION
I have made price comparisons between the IBM equip
available through the state contract and two "clone" pro
with which I am familiar, the Leading Edge Model D and t
Express PC which is built and marketed by PC Express in
Burnsville. The City currently owns a Leading Edge, whi
being shared by Paul Kaiser and Rita Dolan; the City of
Rosemount uses the PC Express product exclusively. In m
judgment, the quality of the clones is superior to the I
which is roughly $200 more expensive than either of the
clones. Additionally, the delivery time for an IBM syst
purchased from Ameridata through the state contract is 4
weeks. Delivery of either the Leading Edge or Express P
would be 5 to 7 days.
The price of an IBM XT compatible Leading Edge Mode
with dual floppy drives, 640k ram memory, and a color mo
from Intra -Systems, Inc. in Eagan is $1,350. The price
quoted by PC Express for an Express PC with the same fea
as the Leading Edge and a two year maintenance contract
$1,378.
We are in the process of evaluating our computer ne
and available options, and do not recommend purchasing a
network card for the Assistant's computer at this time.

RECOMMENDATION
Don Darling from the City of Rosemount speaks very
highly of the Express PC and the service provided by PC

The Park Bond Referendum Committee Chair, Jan Blesener reque ted that
staff obtain a quote from Barton-Aschman indicating how much they would
charge to prepare.iieighborhood park improvement plans for the exi ting seven
neighborhood parks (see attached quote). Barton-Aschman has alre dy pre-
pared similar information for the three new undeveloped parks, Ha Strom King
Park, Mendakota Park and Victoria Highlands (see attached example). Jan
feels that this data is necessary for the Committee to make infor ed deci-
sions on preparing for a potential bond referendum. We have also asked for
and received a quote from Barton-Aschman on a per hour basis to hive them
attend committee meetings and provide support as requested.
ACTION REQUIRED:
Review the attached quote and determine whether or not to hire Barton-
Aschman to assist the Park Bond Referendum Committee.

Neighborhood park improvements are instrumental to a bond issue's success
and will provide equal quality facilities for the entire coamunit),. This
proposal, requested by the city, would assist in determinin; those
facilities desirable for existing parks. A preliminary cost est'3i ftate for
facility construction and a simple sketch plan illustrating the
bprovements would also be completed.
Similar tasks were completed in the Fall of 1988 for the proposed Me adakotal
Victoria, and Hagstraft neighborhood parks. The prcposed exercise , muld be
directed to Friendly Hills Park, Friendly Marsh Park, Valley Park, Bry Hills
Park, Marie Park, Rogers Lake Park and Wentworth Park.
The following specific tasks will be completed as part of the

RECOMMENDATION: Staff would recommend City Council apprval

will be the sign message.

Minnesota Statute 331A.02 requires that Council ann
designate an official newspaper for the publication of 1
notices. We have received letters from the Minnesota
Suburban Newspapers (Sun Current) and Lillie Suburban
Newspapers (South-West Review) requesting designation as
City's official newspaper for 1989.
Both of the publications qualify to be the City's
official newspaper under MS 331A.02. The legal publicat:

SUBJECT: Approval of Joint Powers Agreement with Dakota
County for Receipt of Recycling Grant Monies
On October 18, Council approved an application to
County for $85,866 of County funds to implement our rec
program in 1989 and subsequent years. The County has n
approved that grant application, and we are required to
a Joint Powers Agreement between the City and County fo
terms and conditions of the payment.
Attached is the Joint Powers Agreement as prepared
the County. The provisions of the Agreement are consis
with the previous information that has been provided to
City on how the program would be operated. Exhibit A,
referred to in the Joint Powers Agreement, is our appli
to the County as previously adopted and approved by the
Council. To reduce copying cost, I have not duplicated
for this agenda packet. However, I will have a copy at
meeting, and if any of you want to review it prior to t
meeting (and have already recycled the copy that you re
with the October 18 agenda), please call our office and
will send one out to you.

Final Plat
DISCUSSION:
Fv 1988
The Victoria Highlands Townhomes plat was approved as four platted lots
and 10 platted outlots. This was done so that final plats of the cutlots
could be accomplished as the individual units are sold. Lot line configura-
tion vary based on units selected. The Developer has now submitted his 3rd
final plat for three units to be located on Outlot J (see attached).
RECOMMENDATION:
Staff recommends approval of the Victoria Highlands 4th Addition final
plat as submitted.
ACTION REQUIRED:
If Council desires to 'implement the staff recommendation they need to
pass a motion adopting Resolution No. 89--, RESOLUTION APPROVING �INAL PLAT
FOR VICTORIA HIGHLANDS 4TH ADDITION.

WHEREAS, a final plat for Victoria Highlands 4th Addition has
submitted of the Council; and
WHEREAS, the City Council has reviewed said final plat.
NOW THEREFORE IT IS HEREBY RESOLVED by the City Council of the
Mendota Heights, Minnesota, as follows:
1. That the'final plat of Victoria Highlands 4th Addition su
at this meeting be and the same is hereby approved.
2. That the appropriate City officials be and they are hereb
authorized to execute the final plat on behalf of the Cit
Mendota, Heights.

penditure for the Curley Tot Lot play structure from $4,000 to $6,70 . That

spring. Still remaining to be done is to; ext * end a storm sewer culv rt

SCHOOL REFERENDUM Mrs. Alice Bergquist, a member of the Save
Our Schools Committee, was prese t to
request Council support for the chool

December 20th. Mrs. Bergquist s ated that
Mendota Heights has traditionall had a
very strong school district and hat this
is a major factor in the strength of the
City. She felt that many people have moved
to Mendota Heights because of th strong
school system, and that if the rferendum
fails it could have disastrous ciity.

Mr. Kuross stated that when he su mitted
the preliminary plat for Val's Addition he
assumed that Silk Street had been vacated,
since all City maps show that it had been
vacated in the past. He stated his
abstract company has informed hi that
there is no record at the Countywhich
indicates that the vacation has Iccurred.

approval of a 20 foot sign setback,
consistent with variances approved
throughout the business park, ane a parking
variance to allow four parking s aces per
1,000 square foot of structure a d 816"
wide parking stalls. Mr. Glowa stated that
these variance requests are also consistent
with other variances granted in the park.
Mr. Glowa also informed Council that the
landscaping design will be consistent with
that installed for the first phaa of the

recommendation; that is, should a Council
subcommittee be established to make a
recommendation on standards. He stated
that it is very difficult to visually, from

Director Danielson whether he wo ld prefer
Council to develop guidelines based on the
information Council has already ieceived,
or if he would prefer a subcommittee
approach. He volunteered to serve on a

might be faster if some of the Council
members would be interested in looking at
the lights and choosing a fixture.
Councilmember Blesener stated that Council
needs to talk about how to set u the
process before selecting fixture;.
Councilmember Hartmann felt that one source

the surrounding communities to se what
types of fixtures they use.
Councilmember Cummins suggested hat

prepare alternative recommendati ns and lay

Dear Jim:
The City issued a building permit for my house to be
in 1955• The building was completed in the fall.
It
In 1958 Chippewa and Mariam streets were graded and paved,
however the street grade was raised 1; feet. This higher grade
made my lot lower than the paved street, and also the lowest
finished lot on Block 2. Water drained from the gutter in the
street, down my gravel driveway and on top of my drain field
and into my basement.
In 1963 when the sanitary sewer and water project was completed,
• I installed a cement driveway and raised the street end of the
driveway up to the top of the bituminous curb. This st pped the
water from the street draining onto my lot. During the sanitary
sewer and water project, the Contractor filled-in Simard Street,
thus trapping the water on the Block 2 low area. This action
interrupted the normal drainage pattern in this area. I contacted
Ed Kishel and told him to put in a culvert under Simard or a
catch basin on Block 2 low area. He said there was not ing in the
budget for this, when a storm sewer is installed in the future,
would be the proper time for the installation of a catch basin.
In 1976 a feasibility hearing was held for Northeast area Improve-
ments #75 - Project #8. I talked. to Ed hishel again a.b ut a. catch
Basin and he said nothing was set up in the budget for this. I
reminded him about our conversation of 1963 and he sai he did
not recall.
When we have wet weather the water percolates through he ground
from the low area. on Block 2. I had. a drAin tile systen installed
below the foundation footing on�_he outside of the building in 1969,
connected to my old septic tank system. I pump this when needed.
I have been pumping for a little over 25 years. I feel an outlet
for the wetland would correct a large portion for the need of my
future pumping. I also feel that there should have been some
provision made to drain the water from Block 2 at the time the City
had Simard filled-in.
