Held Tuesday, April 11, 1989
Pursuant to due call and notice thereof, the adjourned
meeting of the City Council of the City of Mendota Heights
was held at 6:45 at City Hall, 1101 Victoria Curve, Mendot
Heights, Minnesota.
Mayor Mertensotto called the meeting to order at 6:47 o'cl�
P.M. for the purpose of interviewing Planning Commission
candidates and the annual Board of Review. The following
members were present: Mayor Mertensotto, Councilmembers
Blesener, Cummins, Hartmann and Witt.

indicated that she was a 30 year
resident of Mendota Heights, and had
tatight school in the St. Paul system
for many years. Having managed a
duplex on the west side, she feels t
she is familiar with business matter
Ms. Heidenreich mentioned several
issues that had been a concern in he
neighborhood, including the Colon
development. She indicated that she
would like to help in planning for t
Mendota Heights area.
Christine Roch: Ms. Koch stated tha
she had worked in real estate for th
past 5 years, and that he family had
been in the business for over 40 yea
She indicated that she had seen many
changes in Mendota Heights while liv
here, and wanted to be a part of
helping the community along. She
mentioned her service on the Citizen
Parks Review Committee, and indicate
that trying to keep open space was a
important objective, and one that ha

Brian Marshall: Mr. Marshall reporte
that he grew up in Duluth, and holds
degree from the University of Minneso
in Political Science and Urban Studie
He also has a law degree from William
Mitchell. Marshall said that he work
for the IRS and several other federal
agencies during his career, and was
currently employed by the Post Office
acquiring sites in a four-state area
for new post offices. His
responsibilities are to evaluate and
assist in site selection. Marshall
said he and his family moved here in
early 1987, that they think Mendota
Heights is a wonderful place to live,
and plan to stay a long time. Mr.
Marshall said that he thought he coul
be fair and impartial in his dealings
with the Planning Commission, and he
thought that it would be good to have
someone on the Commission who didn't
have any "special agenda". He added
that he had been following the parks
development issue with great interest
Daniel Tilsen: Mr. Tilsen said that he
grew up in Mendota Heights and atten ed
local schools. He moved away for a ew
years, but then returned to the
community. Tilsen said.that he's
familiar with land use planning thro gh
his career in civil engineering. Hi
specialty is transportation issues. He
felt that the growth of Dakota Count
is going to cause transportation
problems in this area in the future.
In particular, Tilsen said that he w s
very interested in Dakota County's
regional rail authority, and would 1 ke
to represent the City of Mendota
Heights on that body as a Planning
Commissioner. Tilsen s�id that he i a
good listener, and able to assimilat
what people are saying. He describe
himself as "a doer". •

BOARD OF REVIEW At 7:30 P.M., Mayor Mertensotto calle

conducting the annual Board of Review.
Mayor Mertensotto turned the meeting
over to Assistant County Assessor Bil
Peterson.
Mr. Peterson informed the audience th
he would give a brief presentation an
answer general questions, after which
the audience would be invited to meet
individually with representatives of
the County Assessor's Office to revie
their 1989 property valuations. He
also informed the audience of the
processes available for appeal of
valuations. �
Mr. Peterson responded to questions
from those in attendance. He informe
the audience that the Assessor's offi
is targeting 90 to 100� of market
values and that residential propertie
in Mendota Heights were given a 10�
increase in land values only�for 1989
valuation, which should resul,t in an
approximate 2 to 3� increase to the
total property value.

Dear Mr. Frazell:
Since 1984, Minnesota Depart�nent ot Natural Resources (DNR) and/or US
Fish & Wildlife Service (FGT) representatives have met with your City Counci
to request authority for deer hunts on public lar�ds in yaur city. At many of
these meetings we debate the issues of the safety, effectiveness, ar�d
hwnar�eness of the deer hunt as well as the possible alternatives. We would
lil:e to develop a long-rarge deer mar�agement program for the Fort Snelling
State Park, Minn�esota Valley Nation�al Wildlife Refuge, ar�d adjacent deer
concentration areas. By doing so we could avoid aa� a�nual, tim,e-consuming, a
often enotional debate over the same is�u,es and spend that effort doing the
job.
To arrive at a maryagement plan most lil;�ely to be accepted by the citize
of yaur comm�nities, I am farming a task force to �nine the alternatives a
to attenpt prepare concen,��us recomnenclations to the Co�uncils and the n�atural
resource mariagement agencies. The task force will be representative of 4
grorupe: hunting; anti-hunting (or "animal rights"); "unhiased representative
of the cities of Bloomington, Burns-ville, Eagan, ar�d Mendota Heights; ar�d
natural resources agency field staff. Attached is the final proposal for th
imglementation of a task force.
When I met with the Council last surmner, they were non-comnittal about
participating in th,e task force. Burna�ville, Bloanington, �d Eagaaz have
e�ressed an intent to partici�ate. If you are interested, I now request th
the City select a representative. You may select a citizen-at=large, a staf
menber, or whunever you feel is appropriate. Th�e task force menber should ha
sane interest in deer, but he/she sivould not be strongly opinionated eith�er
against or in favor of the reciuction of deer nurobers by hunting or
sharpshooting. The first meeting will be held frqn 7:00 pn till 9:30 pm on
Weclnesday, April 26, at the Minnesota Valley National Wildlife ftefuge
heac3quarters, 4101 E. 80th Street, Bloomington. Ftzture meetin�gs will be
schcduled by the participaults. I anticipate about faur weekly meetin�gs with
recomnendations finished by mid-May. We may need to proceed beyond that date,
to corrplete long-range recomnendations, but a recomnendation on any hunting
season this year will be made by then.

JUSTIFICATION: 1. The Burnsville City Council has requested that a citizen
taslc force on deer management be instituted by wildlife management
authorities. Before approving DNR deer hunts and/or aharpshooting this yea
the Council has asked DNR to prepare a proposal for the task force and take
stepa to begin implementing it. The Council will not approve further deer
hunts until the task force makes recommendations to the Council. 2. This
task Porce may be instrumental in coordinating deer management programs amo
the many cities in the lower Minnesota River•Valley. To date, wildlife
rsanagement agencies have been unable to encournge the ci�ties with deer
problems crossing city boundaries to work together far comprehensive
solutions. 3. Such a task force could be utilized to address other inter c
wildlife management issues in the Metro Region, such as Canada goose contol
by modifying its membership to suit the issue.

TASK FORCE OBJECTIVES: 1. Identify the problems associated with deer
populations in the Valley. 2. Review past and proposed deer management by
wildlife agencies. 3. Review existing and potential deer population contr 1
methods and recommend methods to be used in the Valley. 4. Recommend
desireable deer population densities. 5. Recommend practical methods for
implementing a comprehensive deer management program in the lower Minnesot
Valley. Recommendations should include: a. agency, person or group in cha ge
of iraplementing the progrnm, b. agencies responsible for financing the
program. c. institutional changes needed to implement such a program. such s
city ordinances or Minnesata statutes. �
TASK FORCE MEMBERSt1IP: The City of �Burnsville has offered to provide a
"facilitator" for the task force. As an alternative, I am considering the
temporary hiring of an experienced facilitator. This person will provide E
structure for analyzing the problem and identifying solutions and will act
a moderator or meeting leader. The facilitator will be subject to approva]
the task force.
The group will have representatives of organizations with interest in
deer populations, citizens from each city involved, and representatives fr�
the natural resource managment agencies involved. Membership will include
representative selected by each of the following cities: Burnsville, Eagan
Mendota Heights, and Bloomington. Natural Resources agency members will
include: US Fish & Wildlife S�u�A�D�J�pg���ij�� @�p��� and Recreation,

CONCLUSION
The only alternatives that are feasible at this po'�nt are a
County wide composting system, transfer stations as a hort term
solution for the Fall leaves and the promotion of backyard
composting through education and technical a sistance.
Discussions are currently underway with Dakota Count planning
staff for provision of better yard waste service fo northern
Dakota County communities.
We have the ability to revise our Recycling budget bef�re July 1

from within the amount we have already been grant�d in our

HISTORY
In the past, the City has used a portion of the Sewer Main�
in West 5t. Paul along Delaware Avenue. The City of
West St. Paul has been reimbursed for this use through the
rates charged by the Metropolitan Waste Control Commission.
Effective in 1989, the MWCC no longer will reimburse
West St. Paul and the City of Mendota Heights will have t
enter into a rental agreement for the continued use of the
connection. The annual cost of this use has been determin
at $646 which is the amount that West St. Paul has been
reimbursed for in recent years.

The regular meeting of the Mandota Heights Planning
Commission was held on Tuesday, March 28, 1989, in the Ci
Hall Council Chambers, 1101 Victoria Curve. Chairman Mor
called the meeting to order at 7.35pm. The following mem
were present: Morson, Anderson, Koll, Duggan, and Dwyer.
Commissianer Krebsbach had informed the Commission that s

light with push button activator by
sidewalk.
Mr. Duffy stated that trash removal
would be handled by a screened dump ter
enclosure built into the bermed slo e.
The neighborhood would like to see
Phil's garage incorporated into the
plan; Mr. Duffy's proposal is for he
service garage to be built as a
separate wing with over-head doors
facing away from the Lexington
entrance, and all parking in the re r.
Aesthetics was a major concern with
residents; Mr. Duffy proposes follo ing
a basic Early American style, but u ing
brick on all sides. Entrance nodes
would be used as a means to break u
the linear appearance of the front
wall. ..
Mr. Duffy stated that Tax Increment
Financing is a good vehicle and wan ed
to consider this as part of a
development proposal. He stated wh re
the road would be installed with hi
proposed B-2 zoned shopping center.
There would be no variances needed; he
has met all the required setbacks. He
stated that parking and the traffic
flow would be maximized with two sm 11
loops on each end of the center. M.
Duffy stated that there are tax iss es
with a'tax exempt statue and zero 1 t
lines.
Mr. Duffy presented the topographic
plan which included a berm proposal to
screen the residential lots. He st ted
that Dundee Nursery has been hired o
prepare the landscaping plan he
presented. Mr. Duffy explained tha
the sign band would be a white bac lit
strip to show up with words and
individual letters.
Commissioner Dwyer asked Mr. Duffy w at

Commissioner Anderson said that bac in

owning the strip. Commissioner
Anderson asked about maintenance on
zero lot lines. Mr. Duffy explaine
that there would be a general
maintenance agreement for the cente .
Commissioner Anderson questioned Mr
Duffy on the desirability of new
residential lots. He's not sure th t
new residents will be thrilled with
this; what is the impact on the
community? Mr. Duffy said B-2 zoni g
is wanted. The neighborhood wants
residential lots berming to appease the
neighborhood, both visually and for
sound. It was explained that Tom
Curley owns this property; a realto
would look at viability of these lo s.
Commissioner Anderson commented on he
viability of the shopping center. e

it, we may have problems. Mr. Duff

Commissioner Anderson asked Mr. Du fy

stated the letters were signed when
Plan A was proposed and that either
development was attracting tenants.

with the exterior appearance of the
structure, it should have a modern look
to it - use same brick as City Hall �o

Commissioner Duggan complimented the
developer on the improved plans. He
had major concerns over the traffic;
will mean a lot of trips for that
corner - he has a concern for the
neighbors. Mr. Duffy would like to :
signalized intersection with button
crossing for pedestrians and bikers.
However, the County doesn't seem
interested to complete modification.
Commissioner Duggan displayed much
concern over the traffic situation.
City Planner Howard Dahlgren concurr�
that the design will work sufficient:

added that traffic on the north side

Commissioner Duggan commented on the
auto garage; he felt it would not be
harmonious to future residents. He
also commented on the garage pit;
recommended that garbage be contain d
in the buildings. Mr. Duffy agreed
that �nside storage of garbage woul be
ideal, however, dumpsters are norma ly
. provided behind the building.
Commissioner Duggan also made a comm
that junky cars are unsightly. He
asked who would be responsible for
maintaining berm and landscaping. M
Duffy said they are responsible and
would be included in the development
agreement. Commissioner Duggan feel
there is a need for more substantial
landscaping, and Mr. Duffy will come
forward with size of trees and adequ
landscaping.

commercial property at the western
gateway to the City; he asked why

Mayor Mertensotto gave an oral
presentation expressing his desire t

tree screen, explaining the TIF poli y
and the City's desire to see a very
high quality project if public money is
involved.
Chairman Morson opened the meeting t
the floor. Mr. Harry Wise, 3077 Tim y
Street, presented comments from the
neighborhood meeting which had been
held earlier. There was great
reluctance among residents to lose t e
screen. They were in agreement with B-
2 zoning, and the 3 non-conforming
businesses should be kept. A�"sore-
point" issue is the drive-in bank; s�ome
feel this is high speed risk traffi .
The residents show heavy resistance to
the drive-in bank and to fast food
restaurants.
Mr. Wise then presented his persona
opinion. He is upset about selling the
lots with berm and trees; he feels hat
the rear parking is useless during ush
hour. The garage, the biggest sour e
of noise, is as close to neighbors �
you can get it. He feels that the
traffic flow is a problem, the
screening is not adequate. He feels
is unethical to put in neighbors as �
screen. The flow into the filling !
station is inadequate, and the ,
aesthetics of a convenience store is'.

Mr. Duffy took the floor with

developer. Mrs. Werthauser is unhap y
with the amount of pumps proposed at

the neighborhood better and is still

explained that he was concerned ove
the fact that the project being
presented was what was agreed upon;
he is hearing something totally
different. He is very concerned ov
the size of the project.

Tim Curley, son of the owner of the
property, stated that they have been
trying to develop the property for f u
years. He want on to summarize the
activity on this project since Augus ,
1988 when they came to the City for
direction.
Chairman Morson stated that the
Commission has not been influenced
the Mayor's comments. Many aspects

Plan A, it could be much better.
Mr. Duffy addressed the commission
saying that he has been presenting
plans to meet the needs and wants o
the neighborhood and the City. He
feels the time has come for some
positive action; he wants to get th
right solution - would like to know
what it is that is really wanted.
Chairman Morson agreed with Mr. Duf
that a decision must be made.
Joe Schmitz, owner of the SOS, said
that one year ago, they were told to
make no improvements with their
property. Now improvements are
necessary and insurance will be costly
if improvements are not made. He
doesn't understand the direction bei g
given.
Mayor Mertensotto feels that Plan A is
a viable project economically for t e
developer; Plan A should be develop d
with the concerns addressed.
Commissioner Anderson said the
neighborhood has limited influence
the problem. Legal issues are
involved, along with health, welfar
and safety issues. The traffic iss
really shouldn't be considered. He
added that Mr. Duffy's problem is t
he is too nice and has listened to
of us; we've jerked him around from
month to month. Mayor Mertensotto
given us a dose of political realit
tonight; now the time has come for
clear direction.

INTRODUCTION:
As part of the Val�s Addition utility project a sanitary sewer #
constructed across property owned by Mike Cornick (1176 Sibley Memor�

Mr. Cornick has requested that the City vacate all of "L" Stree so that he
may use it for additional buildable area. Since the City requires easement

easement agreement. Mr. Cornick has already signed a Notice of Inte t which
states that he will grant an easement if the City vacates "L" Stree and deeds it
to him.
Since there will also be sanitary sewer in the �'L" Street righ -of-way, a 45
f oot drainage and utility easement should be maintained along the v cated street
righ�of-way.
RECOMMENDATION:
Since it is desirable to obtain a utility easement across Mr. ornick's
property within a reasonable time frame, staff recommends Council v cate "L"
Street right-of-way to Mr. Cornick subject to him giving the City a easement
across his property.

WHEREAS, the City of Mendota Heights is the current record owner of
street right-of-way as described as follows;

the City of Mendota Heights) as it is platted in Beaudet�s
Addition, located in Section 27, Range 23 West, Dakota County,
Minnesota,reserving from said vacation the westerly 45.00 feet

SUBJECT: Yorkton Centre Pointe South - Sign Policy
DISCUSSION:
In December of 19$$ the City Council rejected an application from
Centre Pointe Medical Clinic to construct a new building sign. Council
that before any sign permits were approved, the Developer, Yorkton Ltd.
should establish a standard sign policy similar to what United Propert5
has done in their area. Yorkton agreed with the Council�s decision and
submitted a policy for their review at the February 21, 1989 meeting.
Although the policy conformed to the current City ordinances, Council
problems with the proposed height of the pylon sign and with the sign

We have established some guidel.ines on signage
�or exis�.ing and praposed buildings in arder
to obtain uniformity throughout the development
and enhance the building architecture and land-
scaping.

GENERAL GUIDELINES
l, SIGN LOCATIONS
Th� location o� each building sign shall be shown
on a site plan and shall eomply with setbacks es-
tablished by the city.
2. SIZE OF SIGN
The size of each building sign sha11 comply with
criteria set farth in this guideline and with city
codes. The overall size may be dictated by �he size
of the effected building. Also, a certain length/
width ratio must ba adhered to.
3. SHAPE �F SIGN
The building signs shall have a vertical, horizantal,
or square shape as indicated on attached �ke�ch. The
design and shape o£ the ef�ected building may dictate
which style of sign will be used.
�. SIGN MATERSALS
Sign pasts shall have round aluminum pale covers aver
structural tubi,ng. The sign body shall have an a1-
uminum skin with rauted out letters and backed with
whi�e lumasite.
5. SIGN COLORS
Sign posts and body shall be pain�ed with dark burgundy,
and highlighted with a white border and white letters.
6. LETTERTNG STYLE
All lettering shall be souvenir medium or souvenir ba1d;
depending on size and style on sign. Maximum he�ght of
letters shall be as indicated on attached sketch. A11
letters �Jil1 be illuminated from within with fluorescent
lamps.

In the case of mul.ti-tenan�. buildings, indiv-
idual tenant signs (which may appear on the

Custodial Help

HISTORY
At budget time, we estimated that the annual operating
of the City Hall to be about $30,000. This was broken
as follows: �

While it is still early to tell how we will come out, it
appears that gas and electric could be a bit short. The
first month is over the estimates; however, the heating
system was not balanced and electric use was above that �
might expect.
CUSTODIAL SERVICES
at
Council will recall that we contracted with Lee's Janito ial
for our custodial services. Lee's employees work three
evenings per week, five hours each evening. We pay them $750
per month.
Our experience to date has not been that satisfactory. e
are now on our third custodian since moving in in Novemb r.
Also, while the regular cleaning duties are done on a fa rly
adequate basis, there are many additional tasks that nee to
be done around City Hall (i.e. oiling the wood surfaces,
dusting, etc.) that are outside the contract, and for wh ch
we would have to pay extra.
After reviewing the alternatives, Staff feels that a bet�ex
option would be to hire our own part-time custodial pers n.

We project that for the same amount of money that we are
paying Lee's, we could hire our own employee for around
hours per week. This assumes an hourly wage of $6.50 (w
seems to be the going rate in the newspaper), and includ
the cost of other payroll expenses and fringe benefits.
The other expense associated with this option would be
purchase of equipment, i.e. carts, dumpsters, vacuum
cleaners, mops, etc. We estimate that this would be a
$2000, and could be taken from contingency and reserve
Staff would like to have Council's authorization to adve
the position, and to see what type of a response we get.
Depending upon our success, we would then come back with
specific recommendation for rate of pay, hours, etc.
