INTERVIEWS OF PLANNING COMMISSION CANDIDATES Planning Commission appointment candidates Dolores Heidenreich, Christine Koch, Bri�an Marshall and Daniel Tilsen were present, and were invited to give brief presentations i Council in support of their applications for appointment to the Planning Commission vacancy created ] the resignation of Dorothy McMonigal Dolores Heidenreich: Ms. Heidenreic indicated that she was a 30 year resident of Mendota Heights, and had tatight school in the St. Paul system for many years. Having managed a duplex on the west side, she feels t she is familiar with business matter Ms. Heidenreich mentioned several issues that had been a concern in he neighborhood, including the Colon development. She indicated that she would like to help in planning for t Mendota Heights area. Christine Roch: Ms. Koch stated tha she had worked in real estate for th past 5 years, and that he family had been in the business for over 40 yea She indicated that she had seen many changes in Mendota Heights while liv here, and wanted to be a part of helping the community along. She mentioned her service on the Citizen Parks Review Committee, and indicate that trying to keep open space was a important objective, and one that ha to balanced with the pressures for n at � � s _=• development. Ms. Koch that she thoug t `� commercial development was obviously n issue in the city. Brian Marshall: Mr. Marshall reporte that he grew up in Duluth, and holds degree from the University of Minneso in Political Science and Urban Studie He also has a law degree from William Mitchell. Marshall said that he work for the IRS and several other federal agencies during his career, and was currently employed by the Post Office acquiring sites in a four-state area for new post offices. His responsibilities are to evaluate and assist in site selection. Marshall said he and his family moved here in early 1987, that they think Mendota Heights is a wonderful place to live, and plan to stay a long time. Mr. Marshall said that he thought he coul be fair and impartial in his dealings with the Planning Commission, and he thought that it would be good to have someone on the Commission who didn't have any "special agenda". He added that he had been following the parks development issue with great interest Daniel Tilsen: Mr. Tilsen said that he grew up in Mendota Heights and atten ed local schools. He moved away for a ew years, but then returned to the community. Tilsen said.that he's familiar with land use planning thro gh his career in civil engineering. Hi specialty is transportation issues. He felt that the growth of Dakota Count is going to cause transportation problems in this area in the future. In particular, Tilsen said that he w s very interested in Dakota County's regional rail authority, and would 1 ke to represent the City of Mendota Heights on that body as a Planning Commissioner. Tilsen s�id that he i a good listener, and able to assimilat what people are saying. Mayor Mertensotto turned the meeting over to Assistant County Assessor Bil Peterson. Mr. Peterson informed the audience th he would give a brief presentation an answer general questions, after which the audience would be invited to meet individually with representatives of the County Assessor's Office to revie their 1989 property valuations. He also informed the audience of the processes available for appeal of valuations. � Mr. Peterson responded to questions from those in attendance. He informe the audience that the Assessor's offi is targeting 90 to 100� of market values and that residential propertie in Mendota Heights were given a 10� increase in land values only�for 1989 valuation, which should resul,t in an approximate 2 to 3� increase to the total property value. Before approving DNR deer hunts and/or aharpshooting this yea the Council has asked DNR to prepare a proposal for the task force and take stepa to begin implementing it. The Council will not approve further deer hunts until the task force makes recommendations to the Council. 2. This task Porce may be instrumental in coordinating deer management programs amo the many cities in the lower Minnesota River•Valley. To date, wildlife rsanagement agencies have been unable to encournge the ci�ties with deer problems crossing city boundaries to work together far comprehensive solutions. 3. Paul along Delaware Avenue. The City of West St. Paul has been reimbursed for this use through the rates charged by the Metropolitan Waste Control Commission. Effective in 1989, the MWCC no longer will reimburse West St. Paul and the City of Mendota Heights will have t enter into a rental agreement for the continued use of the connection. The annual cost of this use has been determin at $646 which is the amount that West St. Paul has been reimbursed for in recent years. Chairman Mor called the meeting to order at 7.35pm. The following mem were present: Morson, Anderson, Koll, Duggan, and Dwyer. Commissianer Krebsbach had informed the Commission that s would be out o� towr► on the date of the meeting date. Al present were Planner Howard Dahlgren, Public Works� Direct Jim Danielson, Administrative Assistant Kevin Batchelder, Mayor Charles Mertensotto. A bike path is needed, according to residents; Mr. Duffy proposed a bike path running d the right-of-way from Tom Thumb Stre to Hwy. 110 with a signalized stop light with push button activator by sidewalk. Mr. Duffy stated that trash removal would be handled by a screened dump ter enclosure built into the bermed slo e. The neighborhood would like to see Phil's garage incorporated into the plan; Mr. Duffy's proposal is for he service garage to be built as a separate wing with over-head doors facing away from the Lexington entrance, and all parking in the re r. Aesthetics was a major concern with residents; Mr. Duffy proposes follo ing a basic Early American style, but u ing brick on all sides. Entrance nodes would be used as a means to break u the linear appearance of the front wall. .. Mr. Duffy stated that Tax Increment Financing is a good vehicle and wan ed to consider this as part of a development proposal. He stated wh re the road would be installed with hi proposed B-2 zoned shopping center. There would be no variances needed; he has met all the required setbacks. He stated that parking and the traffic flow would be maximized with two sm 11 loops on each end of the center. M. Duffy stated that there are tax iss es with a'tax exempt statue and zero 1 t lines. Mr. Duffy presented the topographic plan which included a berm proposal to screen the residential lots. He st ted that Dundee Nursery has been hired o prepare the landscaping plan he presented. Mr. Duffy explained tha the sign band would be a white bac lit strip to show up with words and individual letters. Commissioner Dwyer asked Mr. Duffy w at the distance is between Mary Adele a d the back of the proposed building. r. Duffy responded by saying approximat ly 200 feet; lots are 130' deep; there is 15' of boulevard between the lots anI Mary Adele pavement. Commissioner Dwyer asked if the bac of the building was brick? 'Mr Duffy s id yes, there is brick on all 4 sides, a canopy in front with a stucco band 'n back. Commissioner Anderson said that bac in February, Plan A did not involve residential lot development; the residential lots would be rezoned f om the existing wall north. He then a ked what happens with the undevelopable land? Mr. Duffy said the city ends up owning the strip. Commissioner Anderson asked about maintenance on zero lot lines. Mr. Duffy explaine that there would be a general maintenance agreement for the cente . Commissioner Anderson questioned Mr Duffy on the desirability of new residential lots. He's not sure th t new residents will be thrilled with this; what is the impact on the community? Mr. Duffy said B-2 zoni g is wanted. The neighborhood wants residential lots berming to appease the neighborhood, both visually and for sound. It was explained that Tom Curley owns this property; a realto would look at viability of these lo s. Commissioner Anderson commented on he viability of the shopping center. e need a decent sized anchor. Withou it, we may have problems. Mr. Duff said that they have anchors and te ant lease mix. They have 3 open spaces with letters of intent for occupan y. Commissioner Anderson asked Mr. Du fy is he could still lease everything if he were proposing Plan A. Mr. Duf y stated the letters were signed when Plan A was proposed and that either development was attracting tenants. Commissioner Anderson was concerned I with the exterior appearance of the structure, it should have a modern look to it - use same brick as City Hall �o tie the corners together. Commissioner Anderson asked Mr. Duff! which proposed center did he feel wa: the best site: Mr. Duffy stated that Plan A was the best use of the land � was based on marketing analyses. Commissioner Duggan complimented the developer on the improved plans. He had major concerns over the traffic; will mean a lot of trips for that corner - he has a concern for the neighbors. Mr. Duffy would like to : signalized intersection with button crossing for pedestrians and bikers. However, the County doesn't seem interested to complete modification. Commissioner Duggan displayed much concern over the traffic situation. City Planner Howard Dahlgren concurr� that the design will work sufficient: for the amount of trips each day. H� added that traffic on the north side serve shopping area could be better . more parking were added in front. T] service road is workable, but Mr. Dahlgren was concerned with lack of stacking ability at the proposed ban: drive-up - he feels the bank proposa is not adequate at this time. He concluded by saying that the overall traffic scheme is not seen as a problem. When the Frontage Road/ Lexington intersection traffic warra a signal, a light will be installed there. it e d Y to f Commissioner Duggan commented on the auto garage; he felt it would not be harmonious to future residents. He also commented on the garage pit; recommended that garbage be contain d in the buildings. Mr. Duffy agreed that �nside storage of garbage woul be ideal, however, dumpsters are norma ly . provided behind the building. Commissioner Duggan also made a comm that junky cars are unsightly. He asked who would be responsible for maintaining berm and landscaping. M Duffy said they are responsible and would be included in the development agreement. Commissioner Duggan feel there is a need for more substantial landscaping, and Mr. Duffy will come forward with size of trees and adequ landscaping. t te Commissioner Dwyer asked if the crab� apple trees could be saved. Mr. Duf y didn't know if the trees could be sayed or not. � Commissioner Duggan asked how many residential lots are being planned f r development. Mr. Duffy said 9 lots were platted. Commissioner Duggan asked if he would consider eliminati g some lots to increase overall lot sizes.' Mr. Duffy said that is Curley's decision. Commissioner Duggan aske� about pollution concerns with gas station Croix Oil. Mr. Duffy said that Cro Oil has served SOS for the past 11 years, and would like to sell the g to the new station. Commissioner Duggan thanked Mr. Duffy for the pl Commissioner Koll asked about the c of the street and size of the front parking lot. Mr. Duffy said that 2 stalls, 24' drive aisles, and 20' stalls is code; however, parking 1 could be made larger without varian The road curvature was no problem f the amount of traffic in question. Commissioner Koll questioned the au o repair in the back of the building; her concern is the buffer area (jumper cars, etc). She said the desirabil'ty of lots is still satisfactory to he . A colonial type of construction was her choice,� but whatever type is decide upon, the materials used must be of substance and quality. She asked a out the existing evergreens on the propo building area - can they be saved or moved? Mr. Duffy said he would like see as many as possible stay; possib half of the existing trees. City Planner Howard Dahlgren elabora e� on his report, explaining parking concerns, trees and screening, traff'c and parking. He said that the key i channeling traffic at entrance to center; this is not a good situation now. Mr. Dahlgren concluded by sayi g that Plan A is the best alternative f it is adjusted somewhat. It solves h problem of the screen: leave it and enhance it. Commissioner Anderson feels that Pla A has a safer and better traffic patte n. He said this was a valuable piece of commercial property at the western gateway to the City; he asked why minimize the buffer and miniscule th size and potential of the center. Mayor Mertensotto gave an oral presentation expressing his desire t maintain the existing wall'and pine tree screen, explaining the TIF poli y and the City's desire to see a very high quality project if public money is involved. Chairman Morson opened the meeting t the floor. Mr. Harry Wise, 3077 Tim y Street, presented comments from the neighborhood meeting which had been held earlier. There was great reluctance among residents to lose t e screen. They were in agreement with B- 2 zoning, and the 3 non-conforming businesses should be kept. A�"sore- point" issue is the drive-in bank; s�ome feel this is high speed risk traffi . The residents show heavy resistance to the drive-in bank and to fast food restaurants. Mr. Wise then presented his persona opinion. He is upset about selling the lots with berm and trees; he feels hat the rear parking is useless during ush hour. The garage, the biggest sour e of noise, is as close to neighbors � you can get it. He feels that the traffic flow is a problem, the screening is not adequate. He feels is unethical to put in neighbors as � screen. The flow into the filling ! station is inadequate, and the , aesthetics of a convenience store is'. concern to him. Mr. Duffy took the floor with clarifications. He said that every stayed at the meeting to come to a concensus. Zoning and uses allowed been agreed upon. Plan A building 50' from wall and 75' away from property line. .s it a ad Mrs. Judy Werthauser thanked Mayor Mertensotto for his direction. She went on to say that she, and 200 oth r people, were against Plan A. The B- zoning was a concern; she wants a CU and not a change of zoning. She fee s that creativity should be a major factor in screening, and would like o see screening options from the developer. Mrs. Werthauser is unhap y with the amount of pumps proposed at the convenience store; she feels tha the traffic study should have suppor ed the neighborhood better and is still uncomfortable with it. Mr. John Nides, 2094 Patricia Stree explained that he was concerned ove the fact that the project being presented was what was agreed upon; he is hearing something totally different. He is very concerned ov the size of the project. Judy and A1 Werthauser said they do want rezoning or variance on reside lots. They feel they are forced to make a decision whether to have a b mall or a small mall with houses. also would prefer keeping the exist screen in place. Chairman Morson said that he feels t at the people have spoken in favor of P an A, especially with the screen. He added that the Planning Commission d es 0 not have a satisfactory recommendat to make to the City Council, and a decision must be made. Commissioner Anderson said that a decent opportunity to present a viab e project hasn't been given to Mr. Duf y. He feels that at this time, there is no workable detailed plan. We need to e more specific with plans for Mr. Duf y and the neighborhood. Tim Curley, son of the owner of the property, stated that they have been trying to develop the property for f u years. He want on to summarize the activity on this project since Augus , 1988 when they came to the City for direction. Chairman Morson stated that the Commission has not been influenced the Mayor's comments. Many aspects the presented plan are not acceptab He does not want to see trees remov He felt that the first developer sc people with the huge Super America first planned. Chairman Morson add that a decision should not be made under a stressed condition; he recommends taking another look at t situation. f ed Mary Sweeney, 2047 Theresa Street, stated that her front doo� faces th trees. She wants to see the barrie rather than lots; she feels that ne homes there would not be an additio to the neighborhood. She also wants t keep the trees. Harry Wise feels that points in Pla C are valuable and if incorporated in Plan A, it could be much better. Mr. Duffy addressed the commission saying that he has been presenting plans to meet the needs and wants o the neighborhood and the City. He feels the time has come for some positive action; he wants to get th right solution - would like to know what it is that is really wanted. Chairman Morson agreed with Mr. Duf that a decision must be made. Joe Schmitz, owner of the SOS, said that one year ago, they were told to make no improvements with their property. Now improvements are necessary and insurance will be costly if improvements are not made. He doesn't understand the direction bei g given. Mayor Mertensotto feels that Plan A is a viable project economically for t e developer; Plan A should be develop d with the concerns addressed. Commissioner Anderson said the neighborhood has limited influence the problem. Legal issues are involved, along with health, welfar and safety issues. The traffic iss really shouldn't be considered. He added that Mr. Duffy's problem is t he is too nice and has listened to of us; we've jerked him around from month to month. Mayor Mertensotto given us a dose of political realit tonight; now the time has come for clear direction. A neighbor stated that the develope� and the community have bee� misled. Mr. Duffy has presented a co�promisE that was worked out with the neighborhood. Harry Wise added that they have presented their concerns. Commissioner Dwyer asked if the Werthausers and Mr. Wise's comments were a consensus of the neighborhooc The neighbor said they're trying to come to a compromise • Chairman Morson stated that he sees merits in both plans, but cannot ac either as a"whole. We must review reassess. Pat White, 2098 Theresa, expressed concern over the fact that a lando at 11 as 0 must pay taxes on residential lots, then nothing can be done with them. i7 Commissioner Koll said that the proc ss has gone on too long. She is hearin a dichotomy. Commissioner Anderson explained that the Planning Commission is guided by principles and laws that compel acti n. A motion was made by Commissioner Dw to close the public hearing. Commissioner Duggan seconded the motion. City Planner Howard Dahlgre explained that it can be moved to cl the public hearing tonight and conti the hearing next month, or close everything tonight. Commissioner Duggan stated that he wants clarification of the process of_clos or continuing the hearing. He withd seconding of the motion. Commissioner Koll then seconded the motion. AYES: 3 NAYS: 2 Anderson, Duggan Commissioner Dwyer moved that Plann Commission recommends that the City Council approve Plan C with a fine tuning of the dumpster enclosure an berm area, a resolution of Ethan A1 and drive-in bank situation, and th inclusion of a berm with 30 foot sp trees. Commissioner Koll seconded, with emphasis on the berm, its landscaping, its screening and buffering ability. Commissioner Duggan felt the term "finetuning" is inadequate. This mu be specified now. All of Mr. Duffy' plans have been rejected; the neighborhood will never be satisfied Chairman�Morson said we are only hez to approve the plans, but Commissior. Duggan felt that we are also here tc give Mr. Duffy some direction. e t r Commissioner Anderson feels that Pl�n C is unsound and does not make the be t or highest use of this previous commercial property. AYES: 2 NAYS: 3 Anderson, Dwyer, Koll Motion fails. Commissioner Duggan moved to recomme� to the City Council that applicants proposal be denied. The city should not pursue a plan that nobody is hap with; Mr. Duffy should be given a chance to begin again. Commissioner Anderson stated that th s motion has merit; it seems to be the only thing that everyone can agree o. Commissioner Duggan withdrew the mot because of lack of second. Commissioner Anderson moved to recommend that the City Council app the preliminary plat for a modified Plan A, subject to the following conditions: � a. That the center be moved west and north away from existing wall to allow for a landscaped area. b. That the free standing service station be limited, or scaled bac to six pumps. c. That the zoning be retained as B- with amendments to the B-2 zoning allow for the following uses: 1. motor fuel/convenience store 2. drive-in back 3. minor auto repair 4. furniture store 5. locksmith , 6. interior decorator 7. picture framing store 8. health studio 9. radio repair c. Recommend denial of any fast drive-up use. to d. That the center incorporate the more modern exterior facade propo al ., , " of a brick surface with masonry comparable to City Hall. nd e. Recommend that the R-1 zoned area be rezoned to B-2 zoning, and that t e B-2 zoning line be drawn 20' nort of existing wall so the required 0' setback keeps building to the nor h. f. Recommend approval of 4 acre variance to allow a 6 acre PUD. g. Recommend denial of the requested signage variances and that signag be•in accordance with city ordinances. h. Recommend approval of a 30' varia ce to the 60' setback for a service station. i. Recommend that final approval of preliminary plat be contingent on the submittal of a survey that accurately reflects the details o the placement of the north servic road. The first month is over the estimates; however, the heating system was not balanced and electric use was above that � might expect. CUSTODIAL SERVICES at Council will recall that we contracted with Lee's Janito ial for our custodial services. Lee's employees work three evenings per week, five hours each evening. We pay them $750 per month. Our experience to date has not been that satisfactory. e are now on our third custodian since moving in in Novemb r. Also, while the regular cleaning duties are done on a fa rly adequate basis, there are many additional tasks that nee to be done around City Hall (i.e. oiling the wood surfaces, dusting, etc.) that are outside the contract, and for wh ch we would have to pay extra. After reviewing the alternatives, Staff feels that a bet�ex option would be to hire our own part-time custodial pers n. ': r � � We project that for the same amount of money that we are paying Lee's, we could hire our own employee for around hours per week. This assumes an hourly wage of $6.50 (w seems to be the going rate in the newspaper), and includ the cost of other payroll expenses and fringe benefits.
