Dear Elected Officials & City Managers:

Just prior to the League of Minnesota Cities official no ification
of "Important Public Hearings: Minnesota Tax Commisssion", Bob Kil-
leen, a member of the Minnesota Tax Commission had sent e a copy
of the hearing schedule. He asked that I notify people who were
in attendance at the breakfast meeting this past summer at Chee's
Restaurant in Rosemount. '�
The City of Eagan is planning to attend the hearing sche�duled for
Monday, November 21, in Room 83, State Office Building, in St. Paul.
Your attendance is important if cities wish to continue th ir effort
to create equity in tax distribution to local units of g vernment.
The two meetings are on Monday, November 21, and Tuesday, November,
22. These are the meetings that affect the metropolitan area and ,
both meetings will be held at the same location.

Mayor Lockwood introduced Mr. Kevin Frazell to the audience,
and informed the audience that Mr. Frazell has been appointed
to serve as City Administrator when Administra or Johnson
retires and will act as an administrator-desig ee in the .

BID OPENINGS Financial Advisor Shaughnessy opened bids received for the
sale of $860,000 General Obligation Improvement Bonds.
Bids received were as follows: Cronin & Marcotte Co., Inc
bid $495,473.75 for 'a net interest rate of 8.355%;
Piper, Jaffray & Hopwood Inc. bid $513,118.33 for a net interest
rate of 8.652%; First National Bank of St. Paul bid $499,890,
for a net interest rate of 8.429%; Norwest Bank bid $524,849.70
for a net interest rate of 8.8�50%.
Financial Advisor Shaughnessy opened bids received for the sale
of $1,000,000 Tax Increment District Bonds. Bids received
were as follows: Piper, Jaffray & Hopwood, Inc. bid
$505,011.50, for a net interest rate of 8.211%; Cronin &
M arcotte Co., Inc. bid $486,818.75 for a net interest rate of
7.915%; Norwest Bank bid $517,446.00, for a net interest rate
of 8.413%; First National Bank of St. Paul bid $485,100.00, for
a net interest rate of 7.887%.
Award of the bids was deferred to later in the meeting to allow
verification of the bid amounts and interest.
HEARING -- CASE M ayor Lockwood opened the meeting for the purpose of a public
N0. 83-33, RILEY hearing on an application from James Riley for Conditional Use
Permit for a Planned Unit Development, along with consideration
of a request for a variance from the density requirement.
Mr. Riley, present for the discussion, reviewed proposed� layout
plans and concept drawings for the Lexington Heights
Apartment Complex proposed to be located on Lexington Avenue
at Wagon Wheel Trail. Mr. Riley reviewed proposed layouts for
both a three building complex consisting of 189 units and
recreational amenities which complies witla the City's density
requirements and a three-building, 225 unit complex which
exceeds density requirements. He stated that the density for
the 225 unit complex is 12.4 units per acre while the density
for the 189 unit proposal is 10.4 units per acre. Mr. Riley
stated that Mn/DOT condemned 7.71 acres of the original site
for freeway purposes last year and that had the condemnation
not occured he could have constructed 262 units on the site.
He pointed out that both plans conform to setback requirement:
but felt that placement of the structures on the higher density
plan is more aesthetically pleasing. Mr. Riley stated that the
structures will be wood frame construction over masonry garages
and also reviewed parking provisions.

P�r. Keith Wehrman, representing Catholic Cemete ies, stated
that he is concerned about changes in run-off c aracteristics
which might result from development of the site He stated
that a detention pond with a metered outlet to ake Au�usta•
currently collects the runoff from the cemetery property. He
was particularly concerned that the rate of run�ff might increase
as the result of the development and sedimentat on in the pond.
He asked that special care be given to sediment�tion control,
especially during construction.
Councilman Mertensotto suggested tha�t any costs for off-site
drainage improvements which may occur as the re ult of the
development be assessed against the Riley prope t,y. Public.
Works Director Danielson suggested that drainag details can
be incorporated into the Developer's Agreement.
In response to a question from Councilman Merte sotto reaard-
ing provisions for handicapped, particularly ad quacy of
elevator size for handicapped persons or emerge�c,y medical
equipment such as stretchers, Mr. Riley stated hat he will
verify adequacy of size and address those conce ns.

R-3 density requirement for the proposed Lexington Heights
Apartment complex to allow construction of 225 apartment units
in three 75 unit buildings.

83-95, "RESOLUTION APPROVING CONDITIONAL USE PERMIT FOR LEX-
INGTON HEIGHTS APARTMENT PLANNED UNIT DEVELOPMENT," conditioned
upon resolution of drainage, turn-around radii and other concerns
addressed in staff reports. . •
Mayor Lockwood seconded the motion.
It was the concensus of the Council that staff be authorized to
establish a hearing date and public notice thereof should a �'
new hearing be required on the housing plan amendment and
mortgage revenue financing.
AIRPORT BUSINESS Mr. John Pope, of Pope Associates, and Mr.. Charlie Rattloff, o
PLAZA M& K Properties, were present to request approval of the ,
issuance of a building permit for the proposed Airport Bus-
iness Plaza. The Council noted that in his memo responding
to the permit request, the Code Enforcement Officer expressed
the following concerns:
1. That access to the Cray Research facility is not restricted
during connection of the Airoort Business Plaza site to the
storm sewer.
2. That an eccentric cone be installed on manhole P�o. 1.
3. That the width of the access drive be reduced to a max-
imum of 25 feet to conform to Ordinanc� requirements.
Mr. Pope stated that the developer has agreed to all of the
adjustments suggested by the Code Enforcement Officer.
Public Works Director Danielson responded to a question from
Councilman Mertensotto regarding the sign setback. P�ayor
Lockwood asked Mr. Rattloff to consider changing the name of
the facility.
After discussion, Councilman Losleben moved approval of the

and, in response to a Council question, indicated that all
City employees can participate in the plan, however only

COUNTY ROAD Administrator Johnson informed the Council that he recently
TURNBACKS received information from Dakota County regarding the turnback
of two County roads, Wagon Wheel Trail and Victoria Road, to
the City. He stated that a memo from Countv Hic�hway Engineer
Bob Sandeen to the County Board on October 25th, suggested �hat
the Board adopt a staff recommendation which listed Glagon �Jheel
Trail and Victoria Road, at .09 miles rather than the actual
1.5 miles, for turnback. Using Mr. Sandeen's figures, the
anticipated annual savings to the County is $4,750 per mile,
which would result in an annual City obligation of $11,875, if
the turnbacks are accomplished. He suggested that while the
turnback theory is good, there should be some trade-off between
agencies and not simply a transfer of expenses. He pointed ou+
that three recommendations made by the Dakota County Transport� ,n
Policy Advisory Group have been ignored by the County Board. He
recommended that the Council direct staff to attend the Decem-
ber 6th County Board meeting to advise the Board that the
Council would reluctantly qo along with the turnbacks if the
County agrees to its obligations and adopts the following
recommendations of the Policy Advisory Grouo:
Additional lighting of County road intersections; installation
and maintenance of traffic signals at Countv roads; and storm
sewer provision in a manner typical of the State Aid formula.
Public Works Director Danielson pointed out that one step in
the turnback process is County upgrading, including overlaying, of
the roads before turnback to the City.
Councilman Losleben moved that staff be authorized and directed
to attend the County Board meeting and to voice the Council's
objections to the turnback proposal and to the lack of irrple-
mentation of the Policy Advisory Group's recommendations.

UTILITY FUND City Treasurer Shaughnessy reviewed the proposed 19'84 Utili'ty
BUDGET Fund Budaet along with his memo regarding sewer use charges.
' He expressed concern over the potential for a significant MWC�
billing increase in 1985. As part of the discussion, Mr.
Shaughnessy recommended that the minimum rate be increased b,y
$1.00 per quarter for 1984, with a comparable percentage increase
(approximately 5q) in volume rates to begin to hedge against
a potential need for as much as a 30� increase in 1985.
� � The Council directed staff to prepare a draft resdlution to
� address the recommended rate increase. The Council also
directed staff to determine whether interest can be charged
against delinquent sewer accounts.

SUBJECT: Report on ICMA Annual Convention
At the time we negotiated my compensation package, the Council greed to
reimburse my registration fee and hotel bill for attendance at the In ernational
City Management Convention in Kansas City, October 9-13. I thought it would be
appropriate to give the Council a brief report on what I feel I gaine by attending.
This year's conference was particular].y notable for outstandin
speakers. First was Richard Byrne, management consultant and Profes
ications at the University of Southern California. Professor Byrne
dynamics of introducing new technology into an organization, and str
successful implementation. In particular, he dealt with the introdu
sonal computers, and how the chief administrative officer can establ
ment that will encourage their acceptance by employees, and increase
the organization.
Our second keynote speaker was Thomas Peters, co-author of the
seller, In Search of Excellence. Peters described the work that he
iate had done in examining American industry, to separate the fair t
from the excellent, and made some observations about important diffe
special interest to me was his emphasis on the role the chief admini
of an organization plays in defining the mission of that organizatio
an expectation among the employees for excellent performance.
The third keynote speaker was James Baldwin, noted observer of
rights scene, who offered observations about where our cities are to
with relationships between heterogenous groups, and creating a hospi
environment.

The final keynote presentation was delivered by Gail Sheehy, a thor of the
best selling books, Passages and Pathfinders. Ms. Sheehy's presenta ion dealt with
strategies used by people who have been particularly successful im m �euvering and
weathering life's ups and downs, and how each of us can maintain a p sitive and
energetic approach to life.
In addition to the keynote sessions, I attended several smalle�
presentations dealing with topics such as time management, ethics of
ment profession, and the roles, concerns, and frustrations of today':
officials. One afternoon, I took a field trip of Kansas City neighbc
workshops and

revive decaying areas. �
In addition Co the sessions, I was able to participate in a number o£ bus-�
iness and sacial functions of both the I�"fA, and my city management alumni pragram
from the University of Kansas. I feel very strongly that the professional contacts
one initiates and maintains at these types of functions are a very important part
of conference attendance.
In summary, this was one of the best conferences I have aCtended. In my
apinian, the ittformation gained and the opportunity to continue important pro-
fessianal cantacts was wel� warth the time and money spent, I very much appreeiate
the Council's suppart af my professional develapment.

NOTICE OF HEARING ON APPLICATION FOR EASQ�IENT VACATION
TO WHO:�i IT MAY CONCERN :
Notice is hereby given that the City Council of the City of Mendo a
Heights will meet at 7:30 o'clock P.M., on Tuesday, November 15,1983, n the
City Hall Council Chambers at 750 South Plaza Drive, Mendota Fieights, N, to
consider a request from Dodd Construction Company for the vacation of 75 foot wide
drainage easement.
More particularly, this easement is located along the westerly li e of
the Snelling View Replat, together with a 10 foot wide drainage e sement
centered on the lot line between lots 10 and 11, Snelling View Re lat.
This notice is pursuant to City of Mendota Heights Ordinance No. 02.
Such persons as desire to be heard with reference'to the proposed ease ent vacation
will be heard at this meeting.

RESOLUTION N0. 83-
RESOLUTION AUTHORIZING VACATION OF DRAINAGE
EASEM�NT IN THE SNELLING VIEW REPLAT
WHEREAS, Dodd Construction Company is the current record owner of all of
the property included within the plat of Snelling View Replat, now known as
Kingsley Estates, Dakota County, M innesota; and
WHEREAS, a petition has been duly presented to the City Council of the City
of Mendota Heights by Dodd Construction Company .for the vacation of a 75 foot wide
drainage easement along tY�e west line of Snelling View Replat, together with a
10 foot wide drainage easement centered on the lot line between Lots 10 and 11,
Snelling View Replat; and
WHEREAS, a notice of hearing on said vacation has been duly published and
posted more than two weeks before the date scheduled for the hearing on said
vacation, all in accordance with the applicable Minnesota Statutes; and
WHEREAS, a public hearing was held on said vacation on Tuesday, November 15,
1983, at 7:30 o'clock P.M., at the City Hall of the City of Mendota Heights; and
WHEREAS, the City Council then proceeded to hear all persons interested in said
vacation and all persons were afforded an opportunity to present their views and
objections to the granting of said petition.
NOW THEREFORE, IT IS HEREBY RESOL VED by the City Council of the City of Mendota �
Heights, M innesota, as follows:
l. That the vacation of the drainage easement described above, situated in
the City of Mendota Heights, is in the best interests of the public and the
City, and is not detrimental to the health, safety and welfare of the
community .
2. That the above described utility easement be and the same is hereby
vacated.
3. That the City Clerk be and is hereby authorized and directed to prepare
and present to the proper Dakota County officials a notice of completion
of these vacation proceedings, all in accordance with the applicable
Minnesota Statutes.

Resolution No. 74-35 accepting said petition and feasibility
report and ordering preparation of plans and specificatiojns, and ..
WHEREAS, said petitioners desire that the conditions of p�aragraph
3 of said Resolution No. 74-35 be modified as hereinafter set
forth.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council f the
City of Mendota Heights, Minnesota, as follows:
1) That the petition for said improvements and the
feasibiiity report therefore are hereby accepted.
2) That the City Engineer be and he is hereby authdrized
and directed to prepare plans and specifications for� said
improvements. I
3) That the provisions of paragraph number 3 of sa

shall cease to be used as a permanent residenc�

and III.

Developnent District Number 1 and established Tax Increm nt

ment project pursuant to Minnesota Statutes, Section 273.

and Request for Workshop �
One of my first responsibilities in Mendota Heights is to come u
new compensation plan for the fifteen employees not represented by a
unit. Much of the background has been completed, and I expect to be
with a recommendation for Council consideration by the end of this mo
purpose of this memo is to advise Council of my timeline for the rema
the project, and to request Council to convene a workshop session on
November 29th, to consider the proposal.
Discussion
By Thursday, November lOth,� a job description for each City posi
me. I have completed a comparison of our salaries with those in all
area cities of populations of 5�,000 - 10,000, and also with surroundi
cities. In addition, I have developed a rating system to compare Me
positions with one another. I will be meeting with Orvil and the Cit
heads next week (week of November 14th) to review this approach and s
back.
Following receipt of all job descriptions and the department heac
will finalize a compensation schedule, and recommend the placement of
fifteen positions on a particular step. I am requesting that Council
workshop session on Tuesday, November 29th, to review the recommendat:
the justification thereiore. We can then address and incorporate whal
Council may raise.
A final plan will be submitted for Council adoption on either De�
20th, along with a list of recommended specific salaries for 1984.
Capital Improvement Plan

prepared: plans, special provisions, and specifications for the impro ement of
Trunk Highway No. 390 and 393, renumbered as Trunk Highway No. 35E an 494,
within the corporate limits of the City of Mendota Heighta, on TH 35E from 0.3
mi. So. to 0.6 mi. No. of CSAH 26 and on TH 55 to 0.5 mi. W. of TH 14 ; and
seeks the approval thereof;
NOW, THEN, BE IT RESOLVED that said plans and special provisions for the im-
provement of said Trunk Highway within said corporate limits of the C'ty, be and
hereby are approved including the elevations and grades as shown and onsent ia

SUBJECT: Certification of Delinquent Sewer Rental Accounts
A proposed resolution to certify 32 delinquent sewer useage charg s is
attached for your review and consideration. On October lst, notices of delinquency,
which are required by Ordinance, were submitted to all of the residents included
in the list. All parties were notified that unless payment was remitte by November
lst, the delinquency plus a$25.00 penalty would be certified to the Co nty Auditor.
The number of properties on the list is generally consistent with the p st three
years. Research of three past resolutions indicates that there are 17 ew accounts
delinquent, eight have been delinquent once, six have been delinquent t ice, and
five have been delinquent in each of the past three years.
At the November lst Council meeting, there was a brief discussion and direction
to staff to research an increase in penalty provisions or application o interest.
We have done some basic research in this regard, but are not yet prepa ed for a
report and recommendation. We anticipate completion of research and su mission of•;
a report to you at the December 6th meeting, so that a change in polic,y if one is
approved by the Council, can be implemented in 1984.
We recommend your adoption of the attached resolution.

hereby adopted and confirmed as the proper unpaid sanitary sewer rental
charges due for the above described properties through Nov mber 1, 1983,
for each of said lots, pi:eces and parcels of land respecti ely, and the
current charge against each such parcel of land shall be a lien concurrent
with general taxes upon such parcels and all thereof.
2) That the total amount of said sanitary sewer rental charg s shall be payable
with general taxes for the year 1983 collectible in 1984 ( ow designated by
statue as real estate taxes payable in 1984).
3) That the City Clerk shall prepare and transmit to the Cou ty Auditor a
certified copy of this resolution with the request that e�ch of said
amounts shall be extended upon the proper tax lists of th county to be
thereafter collected in the manner provided by law.
4) That a$25.00 service charge will be added to each delinq ent sewer account

resolution to adjust useage rates. The rates proposed reflect a$1.00 5.3%)
per quarter increase in the minimum residential rate, and approximately the
same percentage increase in all other rates.

RESOLUTION SETTING SEWER RENTAL CHARGES FOR SINGLE FAMILY
DWELLINGS, MULTIPLE DWELLINGS, AMENITY STRUCTURES, SCHOOLS,
CHURCHES, PUBLIC BUILDINGS, COMMERCIAL AND INDUSTRIAL USERS
WHEREAS, Ordinance No. 803 provides that the sewer rental charges for the
use of the City municipal sewer system by any single family residence, duplex,
school, church, public building, multiple family dwelling, commercial r
industrial user shall be determined from time to time'by Resolution of the City
Council; and
WHEREAS, it is desirable that users pay on the basis of sewage ge�erated; and
WHEREAS, a portion of the Mendota Heights real estate tax is levi d to -
supplement the operation of the City's utility system, and this portio of the
tax averages approximately 20% of the sewer service charge,
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the C�ty of �endota
Heights that the following schedule of sewer rates be established:
I. Single Family Residence, including Townhouses with individual

A. Dwellings served by a central water system:
1. Sewer charge shall be based on water useage durin� t
immediately preceding November, December and January bas

sanitary sewer.
IV. Sewer service outside corporate limits of Mendota Heights.
A. Those rates applicable to the uses described above
multiplied by 120%.
BE IT FURTHER RESOL VED, that the foregoing sewer rental charges shall be
effective as of January 1, 1984, or upon the original hookup to the City municipal
sanitary sewer system, whichever last occurs. Said sewer rental charges shall be
payable quarterly for each of the quarterly periods ending March 31, June 30,
September 30, and December 31, of each year. In the case of a connection to the
municipal sewer system occuring during a quarter, the quarterly charge shall be
