M& K DE VELOPM�NT The Council acknowledged a memo from City Planner Dahlgren
regarding the exterior materials for the M& K development
structure proposed to be located at the southwest corner of
Pilot Knob Road and I-494. In his memo, Mr. Dahlgren recommended
that the roof color be Riviera Sand and that the exterior siding
� be either a dark earth tone brown or Riviera Rouge Red color,
r with siding to be kept narrow, not exceeding four inches to the
� weather.
After a brief discussion, Councilman Hartmann moved that the color
scheme for the proposed M& K structure be Riviera Sand roof and
dark earth tone, narro�v siding, not to exceed four inches to the
weather, in accordance with Planner Dahlgren`s recommendation.

TARGET STORES The Council acknowledged a letter from Target Stores and a memo
from the Code Enforcement Officer relative to the temporary (nine
month) installation of a 7=� foot b_y 8 foot metal guard house on
the R.L. Johnson �varehouse property located at 2360 Pilot Knob Roac
Several members of the Council indicated that they had seen the
guard house and had no objection to it on a temporary basis, until
such time as the applicant can construct a�uard house using t��
materials comparable in quality and appearance to those mater
used in the original construction of the main building.
After discussion, Mayor Lockwood moved to grant Target Stores
request for a temporary, nine month, variance to allow the
installation of a 7z foot by 8 foot metal guard house on the R.L.
Johnson property.
Councilman Losleben seconded the motion.

MENDOTA HEIGHTS The Council acknowledged receipt of a request from United Propertie
BUSINESS CENTER for approval of foundation and grading permits for Phase II of the
Mendota Heights Business Center, along with a memo from the Code
Enforcement Officer relating to the proposed project.
After a brief discussion, Councilman Losleben moved approval of the
issuance of foundation and grading permits for Phase II of the
, Mendota Heights Business Center, conditioned upon adherence to
� all licensing and permit requirements.
Councilman Hartmann seconded the motion.

MN/DOT SIGN The Council acknowledged receipt of a memo from Councilman Hart-
mann relative to the October 4th Council discussion regarding
proposed Mn/DOT Maintenance facility sign and his subsequent m. -
ings with Mn/DOT representatives regarding the sign. In his memo,
Councilman Hartmann recommended that one of two courses of action
be taken: approval of a 20 foot variance from the front yard set-

back requirement to allow the four by eight fo t sign mounted
on steel breakaway posts (already installed on the site), for
approval of the installation of a similar sign mounted at ground
level on top of a maximum four foot tall berm, 26 feet from the
property line.
After discussion, Councilman Losleben moved to grant a 20 foot
variance from the front yard setback requireme t to allow place-
ment of a four by eight foot sign on seven foo breakaway posts
at the Mn/DOT facility site on Pilot Knob Road
The motion died for lack of a second.
Councilman Mertensotto moved to approve a 14 f ot variance to
allow the placement of the proposed Mn/DOT fac'lity sig,n on a
maximum four foot high berm, 26 feet from the ight-of-way line
for Pilot Knob Road.
Councilman Hartmann seconded the motion.

I-35E/I-494 The Council acknowledged receipt of a letter f om Kermit McRae,
Mn/DOT District Engineer, requesting approval f construction
plans and special provisions for I-494 and 35- in M endota Height
specifically for construction of I-35E through Mendota Neights an
I-494, from TH 55 to one-half mile west of TH 49.
Councilman Mertensotto reminded the Council of past discussions
between Mn/DOT and the residents on the west s'de of proposed I-3
at which time the Council approved the sound b rrier and tierming
for the westerlv side but reserved approvals o the easterly side
because there was a conditional use permit app ication pending
from Johnson Brothers for removal of a conside able amount of
��-dirt on the easterly side of 35-E, and one of he recommendations
by Johnson's planner was that a sound barrier all also be
installed on the easterly side. He pointed ou serious concern
over a problem which exists on the easterly si e of the freeway,
that problem being that the fourth �reen at Me dakota Country
Club lies parallel with the highway and the ca t path is only
about 15 feet from the right-of-way line. He xpressed serious
concern that the proximity of the green to the proposed freeway
might create considerable safety hazards for m torists, and felt
very strongly that a safety wall should be ins alled as part of t
freeway project along several hundred feet of endakota property,
approximately 10 to 12 feet in height. The Co ncil members also
expressed serious concern that no resolution o the issue of the
direct connection in St. Paul has yet been mad , and Mayor Lockwo
felt that ,some decision over freeway design, i.e., freeway or par
way, through the City of St. Paul, must be mad prior to Mendota
Heights approval of the plans.

Further discussion on the matter was postponed until at least
the November lst meeting, and the Public Works Director was
directed to request that Mn/DOT representative be present for
the next discussion on freeway plans. Staff w s also directed to
invite representatives of the Mendakota Countr Club to be •
present when M n/DOT appears at the Council to esolve the issue o

PARK AND RECREATION Park Commission member Mary Jeanne Schneeman was present. Mr
Schneeman indicated her desire as an individual, for the insta__-
ation of tennis court backboards, drinking fountains, and
basketba].1 hoops at various City parks.
CITY OFFICE SPACE The Council acknowledged a memo from Administrator Johnson
relative to renewal of the lease for City Administration, Engin-
eering and Police department of.fice space. There were several
r" questions from the Council regarding the length of term of the
original lease, proposed term for the new lease, and the need
for a study to determine how long term of a lease the City should
enter into.
As a result of the discussion, Council directed the Administrator
to meet with representatives of the DCR Corporation to get some
idea of potential contract terms and conditions.
PERSONNEL The Council acknowledged and briefly discussed a proposed
resolution which would allow Kevin Frazell to be excluded from
the Public rmployees Retirement Association.
After a brie£ discussion, Mayor Lockwood moved the adoption of
Resolution No. 8'3-91, "RESOLUTION APPROVING THE ELECTION OF K�VIN
D. FRA ZELL TO BE EXCLUDED FROi�1 THE PUBLIC EMPLOYEE'S RETIREMENT
ASSOCIATION".
Councilman Hartmann seconded the motion.

MISCELLANEOUS Councilman Hartmann asked whether the City staff has made any
effort to find out costs of emergency services provided by
agencies other than Divine Redeemer, Smith-?vlartin ambulance and
others. He asked that staff find out what is available and
expressed his dissatisfaction with continued subsidization of
the Divine Redeemer service. He felt that the City should become
aware of the costs of competition and have knowledge of whether
or not the City is getting its moneys worth.
Administrator Johnson indicated that he would contact several
ambulance services in the area and other communities regarding
their ambulance servicing. He was also requested by Councilman
I.osleben to obtain a copy of the Health Department report on
the Smith�fartin ambulance system.
r MISCELLANEOUS M ayor Lockwood advised the Council of a letter he had received
` relative to a citizen's commission to review MWCC charges.
Administrator Johnson was directed to respond to the letter.
LEGAL MATTERS Assistant City Attorney Tom Hart gave the Council an update on
the Freischel assessment appeal and the Krajniak legal matter.
He indicated, with ref_erence to the Krajniaks that his office
will pursue default judgement.
Mr. Hart reviewed various potential terms of an agreement with
Mr. Herb Warnke relative to a Life Estate as part of the fire

station site aequisition process.
The Council concurred with Mr. Hart's recommen ations relative
to tenant payment of real estate taxes on the ortion of property
set aside for residential use, amon�; other mat ers.
Mr. Hart was directed to determine whether the City had been
reimbursed for the costs of the recess in the anLandschoot
litigation matter.
tBID AWARD City Engineer Kishel reviewed bids received fo construction of.
the Kingsley Estates improvement project and r eommended that a
bid be awarded to the low bidder, M& M Sewer nd Water, Inc.
After a brief discussion, Councilman Hartmann oved the adoption
of Resol.ution No. 83-93,"RESOLUTION ACCEPTING IDS AND AWARDING
CONTRACT FOR CONSTRUCTION OF SANITARY SEW�RS, ATERMAINS, AND
STORM SEWER Z^�IPROVf:�tENTS TO SERVE KINGSLEY EST TES PLANNED UNIT
DEVELOP^1ENT (IMPROVEMENT N0. 83, PROJECT N0. S", awarding the
bid to M& M Sewer and Water, Inc., for their ow bid of $80,5].9.�

MENDOTA HEIGHTS ROAD Public Works Director Danielson reviewed his p oposed Resolution
recommending that the Council adopt a resoluti n to request a
variance from the State Aid standard 46 foot w dth for M endota
Heights Road, to reduce the width to 44 feet.
Mayor Lockwood moved the adoption of Resolutio No. 83-92,
"RESOLUTION REQUESTING A UARIANCE TO THE MSA S ANDARDS FOR MEND
HEIGHTS ROAD (DODD ROAD TO DELAWARE A VENUE)".
Councilwoman Witt seconded the motion.

SIGNAL UPGRADING Public Works Director Danielson advised the Co ncil that current
signal upgrading construction at Highway 110 a d TH 149 is being
funded entirely by Mn/DOT, however, the upgrad ng of signals at
TH 110 and Delaware and TH 110 and Lexington m st be financed
in part by the City and County. He indicated hat MSA plans have
been prepared for the signal up�rading project and that the City
would then be reimbursed via MSA funding for a 1 costs involved.
He recommended that the Council authorize the ayor to execute
t necessary documents for the project funding.
After a brief discussion, Councilman Losleben oved to authorize
the Mayor to execute any necessary documents or MSA reimbursemer
for the signal upgrading at TH 110 and Lexingt n Avenue and TH 11(
and Delaware Avenue.

Accounting Clerk. Councilman Mertensotto stated that he
believed the action taken on October 4th was unLair because it

receive retroactivity to July lst, after salary determinations
as a result of the position classification plan.
Councilman Hartmann stated that the position classification plan
and salary study should be prepared as soon as possible so that
the salaries can be implemented on January lst. No action
was taken on the matter.
AIRPORT NOISE Councilman Losleben indicated that his time schedule does not
COMMITTEE allow his attendance at most of the airport noise committee
meetings and asked that he be replaced on the committee. It was
the concensus of the Council. that Councilm�n Losleben's resignatioi
be accepted and that Councilwoman Witt be named as his replacement
ADJOURN There being no further business to come before the Council,

MINUTES
October 11, 1983
The regular meeting of the Mendota Heights Park and Recreation C mmission was
called to order at 7:30 P.M., By Chairperson Bayless. Members present were: Bayless,
McMonigal, Schneeman, Stein and Williams. Absent were: Knittig and offing. Also
present was Terry Blum, Park Maintenance Supervisor.
Minutes of the September 13, 1983 meeting were approved as read.
MAINTENANCE REPORT - Terry Blum reported that the maintenance crew w's fertilizing
thisfall versus doing it in the spring. That should give the grass good start
this fall and thus healthier in the spring. Someone asked about weed killer, but
Terry pointed out that such a costly expense was not in the budget.
The trail through Va11ey Park and around Friendly Hills will be owed this
fall to facilitate cross-country skiing. In addition, tree and bush trimminQ will
be undertaken along the Marie Park ped�oay. .
Commissioner Stein asked that the sand in the play equipment ar�as be replenished
and raked.
TOT PLAY EQUIPMENT - This issue was tabled due to the absence of Com�issioner poffing.
BENCHES FOR PLAY AREAS - The Friendly Hil1s Civic Association reques ed that we consid
puttin� benches near the play equipment area in Friendly Hills Park or mothers watchi
their children. The commission decided to table this issue until.ne t spring.
HOCKEY RINK FLOODING - Commissioner Bayless reported a request from he Mend-Eagan
Hockey Association to allow their people to flood the rinks. After onsultation with
Dick Ploumen, it was determined that, due to a lack of equipment (ho es, gate valves,
etc.) and the potential liability involved, we could not honor their request. The
maintenance crew will flood on a shift of 4:00 A.M, to 12:00 o'clock noon.
TRAILS COMMZTTEE REPORT - Commissioner Stein reported that the Trail Committee sees a
network of trails along existing streets.providing access to the St aul,� inneapolis a
Fort Snelling trails; to the new Lilydale park and to the 7�0. Thei first action is
to pursue a trail through Valley Park linking Marie Avenue Co the Li ydale Park.
COUNCIL M EETING REPRESENTATIVE - Commissioners Schneeman and/or M��o�igal will attend
the October 18, 1983 City Council meeting.

Public Works Director Danielson advised the ommission that
more work and study needs to be done regardi g an amendment
for sign setback requirements and that furth r information
be forthcoming at a later date.
HEARING, CASE 4�83-33, Chairperson Kruse opened the meeting for the purpose of a
RILEY, CUP FOR PUD public hearing on an application from Mr. Ja es Riley, for
a conditional use permit for a planned unit evelopment to

allow construction of an apartment complex on the east side
of Lexington, south of Wagon Wheel Trail.
Planner Dahlgren noted an error in his planning report dated
October 25th, in paragraph 413, where he noted that 225 units
could have been constructed prior to the Mn/DOT taking. He
stated that he should have stated that 262 units could have
been constructed and that the 225 units proposed is approx-
imately half of the number between the original 189 units
and the 262 units that could have been allowed.
Mr. Riley was present and displayed drawings of the 189 unit
proposal and a drawing depicting 225 units.
No one was present in the audience for discussion at the
hearing.
Mr. Riley stated that he was asking for planned unit develop-
ment approval and that his proposal meets all the requirements
of the zoning ordinance. His project will contain two tennis
courts, a swimming pool and a holding pond. The exterior will
be brick with a mansard hip roof. A gable roof will be over
the balconies, very similar to Eagle Point. He asked for
consideration of a 225 unit apartment complex on his 18.2 acre
site, noting that the average number of units per acre would
be 12.4 for 225 units or 10.4 for 189 units.
Chairperson Kruse asked for questions or comments from the
Commission members.
Butler expressed concern over an accessory structure in the
swimming pool area and whether there were to be bathrooms, chang-
ing rooms, etc, in the structure. Mr. Riley stated that there
would be a structure housing the pool equipment and that there
would probably be bathrooms and possibly a changing room located
there also. He also noted that there will be one elevator in
each bui]_ding.
Member Morson felt that a six foot by six foot elevator is not of
sufficient size for a handicapped person with an attendant.
Other concerns were relative to fencing and where it would be
located, what type of signing would be used and whether or
not the concerns of the Fire Marshall could be met.
Mr. Riley stated that only the pool area would be fenced and
that a monument type sign would be installed. He also noted
that he would be able to accommodate the Fire Marshall's concern
over the turning radii. Mr. Riley also noted that the balconies
wou]_d have open wrought iron railings and that each unit would
have a wall air conditioning unit. He also noted that the gradin,
plan is basically a concept plan until a final plan is decidPa

Notice is hereby given that the City Council of the City of Mendota
Heights will meet at 7:45 o'clock P.M. on Tuesday, November 1, 1983, in the

The proposal seems to meet the requirements for a Planned Unit De elopment
in Mendota Heights at this density. Riley has also submitted an lternate
plan for City consideration that shows three 75 unit apartments. The
impact on the public facilities of adding the additional units se ms to
be minimal, however, a variance to density would need to be grant d or a
rezoning.
Sanitary Sewer - Trunk sewers are available to the site alonq I-3�E for
the southerly buildings and in Lexington Avenue for the northerly buildings.
Watermains - a 12 inch watermain is available along Lexington Av
Storm Sewer - no public utilities are presently available. A nor ion of
the site drains to I-35E the rest needs to cross Lexinqton Avenue onto
Resurrection Cemetery. This poses some techriical questions that eed to
be addressed before fi.nal approvals. A detention pond has been s�hown but
the design capabilities are unknown at this time. Also maintenanlce of
the pond is a question.
Driveways - Lexington Avenue is a County Road and driveway permi s will
nee� to be obtained from the County. All driveways need to inte sect
Lexington Avenue perpendicular.
Park Contribution - It is recommended that a cash contribution b� arrived
at using the standard formula for multiple dwellings.
All of the above stated concerns need to be addressed:together with other
normal development requirements in a developer's agreement prepa ed and
executed before final plat approval.

I am concerned about the radius of the turns in the parking lots. The radii
range from 15 feet to 20 feet. The turning radius of our first responding pumper
is 31.05 feet. The other apparatus's averages about 35 feet turning radius.
The north building has such a turn before access to the main entrance. Also
the tur.ns to the underground garages are too sharp.
The center building is better, except the access to the main entrance from the
north driveway and to the garage are too short. The south building has sharp turns
from both driveways as well as access to the garage.

1. Most of you are familiar with the proposal for a hearing on t e preliminary
plat from the last Planning Commission meeting at which time a pu lic hearing was
set for the October Planning Commission meeting. The proposal in olves az18.2
acre site for which three buildings of 63 units each are proposed to be constructed,
containing a total of 189 units.
2. Attached to this report is a copy of a previous report for the Co ncil and
Planning Commission relating to the financing program. That repo t indicated
proposed rental plans and potential for the future remodeling to ltimate
condominium development. That information will not be repeated i this report.
3. The mixture in the project as proposed will be 30 one bedroom uni
units and 12 two bedroom "end" units per structure, for a total o
63 two bedroom and 36 two bedroom "end" units, giving a total of

4. We have met with Che applicant and his architect on several occasions in the past.,
reviewing and suggesting changes in the plans. All �he changes have been incor-
parated into the plans. Qne of which was rearranging the parking so as ta provide
better aceess far pedestrians ta interim parking contiguous to the curb nearest
the building. This alsa eliminates cars parking facing the building with the
abvious impact of headlights occuring at night. Another change was that af. adding
two driveways ta the two southerly mas� structures, which we feel wi11 be more
efficient for Fire and Police and reduces the chance of the building being blocked
with a single driveway,
5. We have examined the landscape plan and although it is not specific in respect
to every species, the number and Che size, we suggest that the
concept is appropriate. The Planning Commissian and City Council may wish to
consider approval af the I�ndscape plan subject to final staff review as to �he
specific number and size at a later date.
6. Public Works Director Danielsan expresses cancern regarding the adequacy of the
storm drainage facilities. We feeC that a complete analyszs of the system
shauld be made and yau may wish ta question the applicant subject to final
staff review. �
7. In examining the elevation af the structures (the side views of the building}
we are unclear as to the nature of the balconies in terms of material and Che
handling o£ what appears to be end walls on the balcany, The handling of these
balcanies will be an impartant element in terms ofthe aesthetic element of thesF
structures. We assume the buzlding will be built af a brick, although that is �
indicated on the plan. We like the idea of the shed roaf versus the flat roaf,
but as noted earlier, the handling of the balconies will make a considerable
difference and should be verified and cammitted.

The City Administrator has asked us to co�nent on the propriety,
and impact of Jim Riley's proposed multi-family housing project
between Lexington Avenue and Interstate 35E, northerly of Mendot
Road, for City Council review.
Several months ago Jim Riley's architect reviewed the preliminary
for this project with Jim Danielson, Paul Berg, and myself. We o
numerous suggestions which we felt would enhance the appearance,
and appropriateness of the proposed development. We suggested pu
parking under the building, moving the structures on the site, an
in parking lot location and access from Lexington Avenue. Subseq
meeting, Mr. Riley's architect presented revised plans which we n
(with some minor modifications) will be well suited to the site,:

The site has 19 acres to be occupied by three buildings with 63 u

reviewed as a part of the PUD development approval process. Construction is
proposed to start in the Fall of 1983, with completion by the Spring of 1985.
The project is anticipated to be constructed in sequence, and not staged �
over a period of time. �
Y7e are informed that the project's amenities will include: elevators, security
system, meeting.room, laundry and drying facilities, disposal unit, and air
conditioning. The exterior facilities will include tennis court, childrens
play area, parking areas with curb and gutter, and landscaping for the
remainder of the site. Al1 of these eleraents are subject to the Planned Unit
Development review.
FINANCING PROGRAD4
We are informecL by the Northland Mortgage Company that the unit mix and rental
range is proposed as follows:

The above rents include the garage space under the building.
The financing program will be down under HUD Program 221-D-4. The program
for this project will be conducted through the issuance of a$9 Million
mortgage revenue bond, which of course, must be approved by the City Council
of r4endota Heights. This program is currently the mo.st popular program for
the construction of market-rate rental units in the Twin Cities area today,
and is used by perhaps 99 percent of all projects currently planned or under
way in the Twin Cities. The rental range in this case is near the "high end"
and is comparable to building being built in Edina and Downtown locations
in Minneapolis. It would be appropriate for tlie Council to request of Mr.
Riley at the meeting, his breakdown of the project costs. Such a breakdown
will give the Council an.indication of the level of equity in relationship to
the project mortgage.
In the recent past, it was possible to use the 221-D-4 Program with a mortgage
revenue bond, and convert to condominium sales before the closing on the
mortgage. The regulations have now been changed to that the rental units
must remain on the market as rental units for a minimum of ten years. The
project is proposed to be constructed, however, so as to make conversion to
condominiums possible after that date. This decision will depend primarily
on the market conditions at that time. Unless things change drastically
during this period, it would appear to us that such conversion to condominums
in the future in this location in Mendota Heights is highly likely.

I have reviewed the documents submitted and have two minor concerns. It
should be insured that when the storm sewer connection is made in the street on
the northwest corner of the site adjacent to Cray Research's access drive, that Cray
Research will have access to their building. It should also be noted that manhole
#1 have an eccentric cone installed. The west access drive on the site plan shows
a 32 foot width, whereas the Zoning Ordinance allows a maximum width of 25 feet.
I would recommend that the building permit be issued to M& K Properties, subject
to compliance with the above comments, the color scheme addressed by Planner Dahlgren,
and proper licensing of contractors involved with the construction of this project.
A representative will be available at the meeting to answer any Council questions.

Garold (Jerry) Murphy has submitted plans and made application or a
building permit to do some remodeling on Somerset Country Club's equ'pment
garage. The remodeling will consist of enlarging two overhead doors to 10
feet high by 10 feet wide, raising 30 feet of the existing roof to 1'8" and
reroofing of the entire building (see attached site plan). As Counc'1 may
recall, Somerset Country Club is in an R-1 zone under a conditional se permit
and past practice has been that Council reviews and approves permits for
Somerset.

Montreal, �uebec� Canada� which means we will be leaving Mendota eights.
While we likely will not be leaving the city until January or Fe uary,
the�familiarization process and travel associated with preparing or the
new�job preclude further participa.tion in Park and Recreation Co ission
activities. For that reason, I am submitting my resignation from the Park
and Recreation Commission effective immediately. I will transfer all of
my records as Chairman to the Vice Chairman, Jim Stein.
I have very much enjoyed my tenure on the commission and I believ that we
are making progress towaxds an efficiently running pa.rk system. here is
much more that needs to be done and I wish you all the best in th pursuit

Since budget time in 1982, we have proceeded on the assumption t at the sewer
user charge now in effect will be adequate for utility purposes. In the
meantime, we have noticed that most of our neighbors have put 20-25% increases on
their user charges. Because of this, we have made a study of our cu rent and
projected charges by MWCC, to determine if some action should be con idered to
offset�a substantial jump in rates a year or two down the road.
The following table is a brief history of the billings we receiv from MWCC,
along with a projection of increases MWCC anticipates at this time. Their bill
is based on a gallonage estimate, and adjusted two years hence by a R or CR based
on actual flow. For this table, based on our past actual volume, I ave projected
a flat�gallonage base in 1984 and later.

volume becomes actual volume. Then we could be faced with a rate inc ease in the
range of 30% in 1985, growing to 60% in 1987.

We have generally attempted to keep our local user income at abo t the level of
our MWCC billing, before credits or debits or volume use. If we con inue this
theory for 1984, we should consider a modest rate increase. Since r tes were '
unchanged in 1982 and 1983, this would not seem to be out of line. f we delay
an increase, we could be faced with a rather large increase in 1985.
