Mayor Lockwood opened the meeting for the purpose of a public
hearing on the Proposed Use af i9$3/$4 Federal Revenue a7.locations.

HEARING, TARGET, Mayor Lockwood opened the meeting for the purpose of a public

lot at 2360 Pilot Knob Road.

Mr. John Duffy, from R.L. Johnson Construction Company, was
present to explain his request. He advised the Council that
Target was l.easing 275,000 square feet of Johnson's warehouse
and that they had an option for the remaining 125,000 square
feet. Essentially, Target will rent the whole building. Mr.
Duffy noted that the request for the 8 foot chain link fence was
to provide security for the warehouse. He also noted that
Target wished to construct a small accessory building to be
used as a guard house. The guard house will be 6� feet by 8 feet
and will be painted to match the warehouse building.
Councilman Losleben noted the poor quality of the guard house and
expressed reservations about allowing the installation of the
house as proposed. He suggested dressing up the guard house so
that itwould be architectually, as well as aesthetically pleasing.
Further discussion ensued over the fact that no outdoor storage
is to be allowed under a conditional use permit.
After further discussion, Mayor Lockwood moved the adoption of
Resolution No. 83-73, "RESOLUTION GRANTING CONDITIONAL USE PERMIT'
FOR FENCE'', conditioned on:
1. The provision of a more architecturally and aesthetically
pleasing guard house;

trailers to be par g deliberately in the parking lot,
rather than being unloaded� to augment storage in the
warehouse.
Councilman Hartmann seconded the motion.
It was pointed out that the Conditional Use Permit should be
granted to R.L. Johnson, the owner of the building and that
the owner of the fence and guard house is Target Stores.
CASE N0. 83-31, Mr. Charles Mendes was present to request a five foot rear yard
, MENDES, VARIANCE variance to allow construction of a single family home 25 feet
� from Knollwood Lane. The lot is Lot 15, Block 1, Ivy Falls West
� 2nd Addition, or 745 Knollwood Court. Since the lot is a corner
lot, technically his side yard functions as a rear yard on the
east end of the house, and encroaches on the minimum 30 foot
rearyard setback by five feet.
Mr. Mendes advised the Council that he had written approval from
two of his neighbors for his proposed plans. The owner of Lot
Block 1, did not give his written approval.

M ISCELLANEOUS Mr. Ralph Linvill and Mr. Boyd Stofer were present to request
the City Council to consider amending Section 4.17(1) of the
Zoning Ordinance. Mr. Linvill noted that by seeking Council
approval for interior partitioning in the Business and/or
Industrial district, many unnecessary time delays take place.
He suggested that the building permits could be issued directly
by the Code Enforcement Officer.
Councilman Losleben suggested that Mr. Linvill and Mr. Stofer be
exempted from this requirement, but Mr. Stofer preferred to see
the Ordinance amended.
After further discussion, staff was directed to consider the
matter and to bring a proposed amendment to the Council for
review and approval.
In the meantime, there will be no need for Mr. Linvill or Mr.
Stofer to return to the Council for building permits for interior
remodeling as the Council will ratify the permit after the fact,
until the proposed amendment is completed and adopted.
FIRE STATION Fire Chief Noack and several other members of the Fire Department
DISCUSSION were present for discussion on the status of the proposed fire
station site on TH 149. City Administrator Johnson noted the
appraisals on the Herb Warnke property and noted that Mr. Warnke's
property is not large enough by itself for a fire station.
Chief Noack stated that Mr. Warnke does not want to move and
recommended that the City not condemn his property.
City Attorney Winthrop commented that a fire station is not the
most amenable use for residential land.
After further discussion, the Council directed City Administrator
Johnson and Fire Chief Noack to meet with Mr. Warnke, advising
him that the City has more information than it had two weeks ago.

WATER NIANAGIIr1ENT The Council discussed a proposed resolution regarding intentions
ORGANI7ATION to negotiate a Joint Powers Watershed Management Organization.
Councilman Mertensotto noted that he and several others had
attended a meeting on this topic on September lst and he felt
�. that all eight municipalities involved in the watershed matter
should adopt a Joint Powers Water Management Agreement, rather
than a state sponsored Watershed District.
After a brief discussion, Councilman Mertenso.tto moved the
adoption of Resolution No. 83-74, "RESOLUTION EXPRESSING INTENT
TO NEGOTIATE JOINT POWERS WATERSHED MANAGEMENT ORGANIZATION IN
RESPONSE TO MINNESOTA STATE STATUTE, CHAPTER 509, 1982 SURFACE
WATER MANAGEMENT LAW'.

was a member of the Volunteer Fire Department.

Commission. The sewer line will extend from Me dota Heights`
trunk sewer at Lexington Avenue and TH 13. Pub ic Works Director
Danielson noted that there are five residences n Mendota Heights
that will now have sewer available and the cost for the service
will be $400t. He recommended that this servic cost together
with a calculated amount for frontage should be assessed to those

Clerk Swanson relative to a one-month leave of absence,
beginning September 7th, with an anticipated return date of
October 3rd.
IVY FALLS ADDITION City Engineer Kishel advised the Council that �s. Freischel's

FBI NATIONAL Administrator Johnson distributed a Handout memo from Police Chief
ACADEMY Delmont, requesting permission to attend the FBI National Academy
in Virginia from January 4th to March 23, 1984.

plus a$500 expenditure for aire fare for one trip home during
the 11 week session, per Chief Delmont'S memo dated July 8, 1983.

job decriptions that were prepared by department heads for
• non-union employees. City Administrator Johnson advised the
Council that within the next two weeks or a month at the most,

INTERVIEWS Mayor Lockwood noted that the meeting was bein conducted for
the purpose of interviewing candidates for the osition of
City Administrator. ',
Mr. Mark Lenz, 1740 Mississippi Boulevard, Coon Rapids, was
present for his interview at 7:30. After his i terview, Mayor
Lockwood thanked him for being present. �
Mr. Kevin Frazell, 12270 Eagle Street Northwest Coon Rapids,
was present for his interview at 8:30. Mayor L ckwood thanked
him .for his presence and responses during his i terview.

The special meeting of the Mendota Heights Planning Commission was ca led to order
at 6:30 p.m. by Chairperson Kruse. The following members were presen : Kruse,
Butler, Burke, Frank, Morson and Stefani. Also present was City Admi istrator
Johnson.
CASE 4�83-31, Mr. Charles Mendes was present to request�,a f iv foot variance
MENDES, for the east end of his proposed home to be con tructed on Lot
VARIANCE 15, Block 1, Ivy Falls West 2nd Addition,'�or 74 Knollwood Court.
The proposed home is to be located in such a ma ner that this
end of the house encroaches on the minimum 30 f ot rear yard
setback. I
Mr. Mendes distributed copies of a letter�of approval from two
of his contiguous neighbors, but noted that Mr. ene Hughes' name
was not included in the letter. Mr. Hughes lives at Lot 16,
Block 1, Ivy Falls West 2nd Addition.
Commission member Morson asked about the width o Mr. Hughes'
driveway. Mr. Hughes stated that his driveway i 15 feet wide.
He also asked about the need for a variance, all ging that
Lot 17 will also need a variance. Chairperson K use explained
the front and rear yards and required setbacks f r each. Mr.
Hughes expressed concern that by granting �this r quested variance,
a precedent would be set for Lot 17 to ask for a variance also.

members familiarity with the current conditions of the river bottoms. The department,
under the direction of Chief Noack, is cooperating with the Dakota County Aircraft
Disaster Committee in forming a pre-plan for respondi�}g to an aircraft down call. The
Chief has been attending monthly meetings of the committee and helping them develope
the proper pre-plan.
The Saturday make-up drill was held in the industrial park were the crew worked with
the Squ�t.
The monthly rescue training session was spent at W. St. Paul Fire Department working
with them on mutual problems and getting familiar with each others equipment.

recommendation as stated on Page 5 of inemo dated July 8, 1�83 in
regard to Geographic`Narrow casting. Motion carried unanimously•
A motion by Lanegran, seconded by Witt, to accept the consultant`,s
recommendation as stated on Page 4 and the top paragra�h qf Page
5 in regard to the Institutional Network and add the statement '.:�hat
the basis of your determination of our need be based on the standards
of evaluation ihat is used throughout the periodic evaluations as

During the disc�ssion Mr. Paul Anderson of Schbol District No. 199
and a citizen of Inver Grove Heights, stated that we should not delay
nor cut back on the institutional network. This should be p�ovided
now in its entirety rather than reduce what we are asking.

As you recall, there was less than unanimous agreement at the ast meeting
on how to site the new station.
Chief Noack and I discussed the several alternatives with Herb Warnke on
September 8th. We proposed that the City acquire his entire parcel and that
he continue to live in his house. We discussed the feasibility of ocating the
new structure as close as 20 feet to the south of his house, and he agzeed to that.
Large trees and a small storage shed south of the garage would be r moved. The
existing garage would be left as-is, trying to design the parking 1 t around it.
We would carry liability and casualty insurance, he would have his wn personal
property insurance. Taxes were discussed but unresolved. (Tom Har later
advised me that in a life-estate situation, taxes must be paid, eve though a
tax exempt entity owns the fee title).
After all of the discussion, Herb was advised that the City co ld pay the
appraisal price of $56,000 for the property, then jointly occupy it as described
above. ! .
On Monday, September 12th, he advised me that he and his�daught

Earlier this year, NSP initiated a program for conver:

lamps. NSP developed this program to reduce the'numbf
inefficient street lights on its system, in line�with
the national commitment to energy conservation. j
Because of recent reductions in the cost of high pres
fixtures supplied to NSP, we are now able to make the
conversion program even more attractive to you. �This
has occurred due to a nationwide movement toward'the
new, efficient light source, resulting in mass produc
high pressure sodium equipment at lower c�sts.
Correspondingly NSP, on September 8th, is filingiwith

Because of these many advantages of high pressure sodium street
lighting, NSP plans to convert the NSP owned overhead and custom
underground street lights in your city to the nearest equivalent
light ouput high pressure sodium. This will always result in
slightly more light on your streets. Because this will be a
large conversion program (NSP owns more than 70,000 street lights),
and because of the necessity of scheduling this conversion work
to match available crew time and minimize costs, NSP may not be
able to make the conversion when you request it, and will have to
schedule the work over several years. Any mercury street lights
that require maintenance during this waiting period will be con-
verted to high pressure sodium at no charge.
Provided the respective commissions approve NSP's filing, NSP
will begin converting NSP owned mercury, incandescent and
fluorescent street lights to the high pressure sodium at no
charge for the conversion, provided the conversions are made
according to NSP's schedule. If conversion is desired prior to
NSP's schedule, a one-time charge of $20 per light will be as-
- sessed to cover NSP's additional costs.

Section 1. Ordinance No. 401 known and referred to as the '`Mendota
Heights Zoning Ordinance" is hereby amended in the following respect:
The following paragraph is hereby added to Section 4.17 of said
Ordinance:

Districts are applied for, the Code Enforcement Officer

SUBJECT: Sign and Building Permit for 1960 Dodd Road (Getty Statio )
Application has been received for a remodeling permit for the etty Station
at 1960 Dodd Road to remove the facade covering the three bays so t at Getty may
lease the service bay section of the existing station to Mr. Tony S hackman.
Mr. Schaclanan proposes to do minor auto repair within the bay space . The re-
opening and use of the service bays would be in compliance with the motor fuel
station requirements called out in the Zoninq Ordinance. Mr.�Bill ichie will
be the contractor who will be removing the front facade which now c vers the
three bay doors. �
In addition to the remodeling, Mr. Schackman has made applicat'on for a
4' x 8' sign to be mounted on the face of the mansard roof centered over the
bay area of the Getty Station. (See elevation drawing of bay� area. The
elevation plan notes that an 18 square foot Getty sign will be remo ed and only
the new sign will be on the mansard. As can be seen on the sign pe it application,
the sign will be made of of an exterior grade �" x 4' x 8' plywood ainted white
and will have red and black lettering as shown. A representative f om Getty and
Mr. Schaclanan will be in attendance to answer Council questions in egards to the
alteration and sign permit. I

discussing possible increases in 1984 city levy or cutting back on he level
of services. (See his two memos, one dated June 30, 1983, the seco d one
dated July 5, 1983). The general concensus and direction eminating from that
meeting was to keep the same level of service and increase the tax evy to
make up for the State Aid deficit. .

This and other comparisons can be seen in the following�chart

As previously mentioned, the total budget is 5.I% greater than the 19$3 budget.
You wi11 note that the 1983 Estimated expenditures are approximately $31,000
less thaa budgeted, {This is approximately a 2.3f safety factar}. Expendi�ures
for the var3.ous departments are very similar to those of 1983, with the exception
that Personal Services al2aca�i.ons are appraximately 5! higher. Several expenses
have been re-allocated. In the past, Admina.stration rent has included Police
space rent. The proper O�fice and Police rental costs are now placed in apprapriate
departments» The raCher large SAC receipts and associated expenditure submitted to
the MWCC are now recorded in the Sewer Utility BudgeC, rather than Administration.
The figures as proposed herein, are almost identica�. to those presented to you
by the several Department heads during mid-August. They are real.istic and madest,
in my opinion. This financial plan represents a"maintenance onl.y" stance. It
daes not incl.ude any additional service or equipment. I believe that the Fire
Department f igures represent some amount of "catch-up" as concerns maj�ar'maintenan�

but does not address the costs associated with putting a newlbuild�ng into service.
Although you may rebel at the thought of increasing the mill rat approximately
2 or 2.1 mills, consider these thoughts: ,
l. The Legislature reduced State Aids (for some municipaliti s) knowing
and expecting them to make up the difference in increase tax levy.
2. Changes by the Legislature in the taxing formula and valu tion formula
will tend to reduce the property tax for houses with Mark t Values between
$30,000 and $120,000. I
3. If the Legislature continues its trend of aiding the high tax municipalities,
(rewarding the spenders) and likewise reduces our proport'onate share of
state aids (from your sales and income tax contributions) then we must
rely more heavily on user charges and property tax Tevies.
4. Some o.f our sister cities are proposing tax increases ra�ging from
one to three mills. I
Some additional work has to be done on the Sewer Enterprise Bu get and also the
Engineering Budget. These two documents, as well as the Capital I rovements
Program (CIP) sheets will be submitted later. The attached sheets, in my opinion,
support and justify the proposed Levy Resolution. Your favorable c nsideration
on October 4th is requested. �

There has been only one previous assessment of SRA
members, and that assessment was in a very small amount.
Funding of SRA activities to date has come from a fund
originally provided by the Minneapolis Gas Company as a
franchise administration fee. The fee was paid to the SRA
prior to the transfer of the responsibility for
supervision of the company to the Minnesota Public Service
Commission in 1975. That fund has been nearly depleted as
a result of SRA's intervention in rate cases involving
Northern States Power Company, Minnegasco, Northwestern
Bell, and further by the Board's activities related to the
Metropolitan Waste Control Commission.
Attendance at SRA Board meetings has been good; interest
in its activities is keen. Our strength is dependent on
our collective effort to continue the useful work of the
SRA. I will be happy to answer your questions or listen

At its last meeting, the City Council adopted an assessment roll to permit
five (5) property owners in Mendota Heights along State Trunk Highway 13
to connect to an interceptor sewer being constructed by the Metropolitan
Waste Control Commission to serve the City of Mendota.
Part of the arrangement requires the City of Mendota Heights to adopt a
resolution indicating that the City does not object to such connections,
agrees to pay the M.W.C.C. for the connections and to then assess the pro-
perty owners for the connections.
It also requires that the City submit formal requests to the M.W.C.C. for
these connections, which Staff will do.
The attached resolution is to be adopted by the Council and submitted to
the M.W.C.C. along with the individual requests. The M.6�J.C.C. prefers
to deal with the City rather than the individual homeowners.

At the meeting of August 16, 1983, the matter of assessments with respect
to watermain construction to serve Riverwood Place (Bill Strub) w s dis-
cussed in conjunction with awarding a contract to do the work.
Staff has determined that the entire project cost will be approxi
$40,392.00. After much discussion it was agreed that the cost sh
shared on the basis of frontage along Riverwood Place in Mendota
and Thompson Lighting Protection Company and the Lilydale Racquet
in Lilydale. The portion in Lilydale wi11 have to be held in abe
until connections are requested.

BE IT FURTHER RESOLVED, that prior to October 6, 1983, the'owner of any lot

The new 1983 projects are a rather small total amount, and I
suggest that we add these projects to the amount of the issu
