Held Tuesday, July 19, 1983
Pursuant to due call and notice thereof, the regular meeting of the
City of Mendota Fieights, was held at 7:30 o'clock P.M. at the City
Plaza Drive, Mendota Heights, Minnesota. �

Acting Mayor Mertensotto called the meeting to order at 7:30 o'clock P.M. The
following members were present: Acting Mayor Mertensotto, Councilma Hartmann
and Councilwoman Witt. Mayor Lockwood and Councilman Losleben had n tified the

MISCELLANEOUS Acting M ayor Mertensatto informed the Council, Chat as part of
the Grand Opening celebratian for the Coast to Coast stare in
the Mendota Plaza, he was presented with a United SCates flag
as a gift to the City.

HEARING, CASE 83-01 Acting Mayar Mertensotto ppened the meeting for the purpose of

Culligan for critical area and subdivision appraval for the proposed
Va1ley View Oaic No. 2 Addition.
Mr. Cu2ligan reviewed the histary of discussions an his appli.cation
including discussion at the hearing conducted on May 3rd. Mr.
Culligan noted that at the May 3rd ineeting, the hearing had been
cantinued so that contact coul.d be made with Mn/DOT relative to
the status of the Mendota Interchange project and with the Mendota
Ci�y officials regarding potential sanitary sewer hoakup to the
Mendota sewer system when it is completed. Mr. Cu113.gan asked t
the hearing be cantinued to late September ar eariy pctober so that
more definitive information will be available from Mn/DOT and to
allow further contact with Mendota regarding the utility connection.
Mr. Culligan stated that he is requesting the delay because ii the
Mendata Znterchange project, which raould inc2ude storm sewer
construction affecting his site, is intended for construction, he
will wait until the project is completed before requesting approval
of the plat.
Mendota Mayor Rayal Bakke, present in Che audience, informed the
Council that bids for the Mendata sewer project had been recieved
on July ISth and would be considered by the City Council at the
second meeting in September. He stated that he had received a copy
af Engineer Kishel's repart to the Council, alang with a letter
from Administrator Jahnson. He briefly reviewed the memo from Mr.
Kishel and expressed concerns over possible surface water damage
to properties in Mendota.
In response to questions �rom Mayor Bakke, Engineer Kishel stated
that it is anticipated that Mn/D4T constructian in the Interchange
would begin sometime in 1986 and take until 1989 to complete. He
stated that Mn/DOT staff is pushing to get the project into the
planning stages. The project would inelude a large starm sewer
project which would pick up water from the hi.ghway, from the
ariginal Va21ey View Oak plat, and also from the groposed plat an�
other areas. He stat�d that if Mr. Culligan can get assurances
from the Gity af Mendota �hat seven lots in the subdivision cauld

Heights Road east of TH 149, along with an eight foot wide
bituminous trail, all via MSA funding and constructed by Mn/DOT
He also recommended that the Council authorize preparation of pldns
for an extension of the City's watermain from Lake Drive along
TH 149 and east and west of TH 149 on Mendota Heights Road con-

that the watermain extension was addressed as a part of the
watermain looping in the water tower and water system project and
should be financed via the Water Revenue Fund.
Councilwoman Witt moved to authorize staff to proceed with Phase 2
of Mendota Heights Road construction as an MSA project.
Councilman Eartmann seconded the motion.
Councilman Hartmann moved to direct the Public Works Director
to proceed with the bituminous trail proposed utilizing MSA
funding.
Councilwoman Witt seconded the motion.
Councilman Hartmann moved to authorize staff to proceed with plans
for construction of the watermain extension as proposed, financing
to be via the Water Revenue Fund.
Councilwoman Witt seconded the motion.
Public Works Director Danielson also informed the Council that
Mn/DOT will need wetlands permits in conjunction with I-494
construction east of TH 149. He advised that Mn/DOT will soon
submit plans to the Council for approval and will probably request
wetlands permit hearing waivers at that time.
There being no further business to come before the Council,
Councilman Hartmann moved that the meeting be adjourned.
Councilwoman Witt seconded the motion.

MINUTES
SPECIAL MEETING, AUGUST 9, 1983
The special meeting of the Mendota Heights Planning Commission was ca led to
order by Vice-Chairperson Blesener at 8:02 o'clock P.M. The followin members
were present: Blesner, Burke, Frank, Morson• Kruse, Butler and Stef ni were
excused. � �
CASE N0. 83-26, Mr. Gregory Nelson, 1061 Delaware was present to request a
NELSON, VARIANCE 3� foot sideyard variance to allow construction of a 20' x 18'
bedroom addition onto the rear of the existing hom . Since
the home is setback 3� feet on the north side, the house is a
legal non�conforming use. Mr. Nelson had written pproval for
his proposed addition from his neighbor to the nor h.

Frank moved, seconded by Morson, to recommend ap r val of a
3� foot side ard variance on the north side of 106 Delaware,
as requested. Voting: 4 ayes, 0 nays.
CASE N0. 83-28,
NEUMAN, UARIANCE Mr. Richard Neuman, 1822 Faro Lane, was present to request a
14� foot rear yard variance to allow construction f a swimmingt
pool in the rear yard. Mr. Neuman noted that he p ans to
install a five foot high chain link fence around t e back yard.
He also noted that he had written approval f�rom hi two contig-
uous neighbors, approving of his proposed pool pla .
Vice-Chairperson Blesener noted that she had�no pr blem with
this proposal, as noted by Planner Dahlgren in his report that
the setback was well within the 10 foot minimum di tance that
he has felt was reasonable as a general standard.

Burke moved, seconded by Frank, to recommend'appr

The City Administrator has asked us to co�nent on the propriety, easibility,
and impact of Jim Riley's proposed multi-family housing project 1 cated
between Lexington Avenue and Interstate 35E, northerly of Mendota Heights
Road, for City Council review. �i
Several months ago Jim Riley's architect reviewed the preliminary
for this project with Jim Danielson, Paul Berg, and myself. We o
numerous suggestions which we felt would enhance the appearance,
and appropriateness of the proposed development. We suggested pu
parking under the building, moving the structures on the site, an�
in parking lot location and access from Lexington Avenue. Subseq�
meeting, Mr. Riley's architect presented revised plans which we n�
(with some minor modifications) will be well suited to the site, �
in a development appropriate to the City. �
PROJECT DESCRIPTION

The site has 19 acres to be occupied by three buildings with 63 u
structure. The structures will be three stories high with underg
parking in a pre-cast concrete structure forming the foundation o
structure above. There will be a total of 189 units with 200 und
parking stalls, with additional exterior parking equal to 2.�5 spa

We are informed by the Northland Mortgage Company that the unit m and rental

The financing program will be down under HUD Program 221-D-4. Th program
for this project will be conducted through the issuance of a$9 M'llion
mortgage revenue bond, which of course, must be approved by the C'ty Council
of P4endota Heights. This program is currently the most popular p ogram for
the construction of market-rate rental units in the Twin Cities a ea today,
and is used by perhaps 99 percent of all projects currently�plann d or under
way in the Twin Cities. The rental range in this case is near th "high end"
and is comparable to building being built in Edina and Downtown 1 cations
in Minneapolis. It would be appropriate for the Council to�reque t of Mr.
Riley at the meeting, his breakdown of the project costs. Such a breakdown
will give the Council an indication of the level of equity in rel tionship to
the project mortgage. I
In the recent past, it was possible to use the 221-D-4 Program wit
revenue bond, and convert to condominium sales before the closing
mortgage. The regulations have now been changed to that the rent�
must remain on the market as rental units for a minimum of ten yea

on the market conditions at that time. Unless things change drast

In the matter of providing a water extension to serve the

At the A�gust 2, 19$3 Council Meeting the Kingsley fina plat and
street vacatian was considered. Mr. Mikelsons, ;the n ighhor to
south objected, saying he needed access provided'to th rear of
his long narrow lot. Cauncil tabled final plat appro al until
this meeting pending the developer working out an arrang ment with
Mr. Mikelsons. !
Since that time the Develaper has worked with Mr.jC Mikel ons and
he naw states that he wants the 400 foot 1ang,l 30 f ot wide
easement dedicated. This is the salutian that was ar ived at
originally at the Planning Commission meeting. j
The Developer submitted the attached letter stating he w 11 grant
that easement to the City. He is having his surveyor and attorney
prepare that document to be recorded by.the Citq. I

Mr. Nelson has a 73 foot wide lot on the west side of Delaware A enue.
The home is set back in line with others on the street, 47.6 inches f om the
curb line. We presume this to be within the 30 foot setback requirem nt.
The setback to the north side is 3 feet 6 inches, whereas 10 feet is equired.
therefore this house is a legal non-conforming structure.
Under these conditions this home requires a variance to th�e nort side
setback to allow for the construction of an addition 20 feet deep and 18 feet
wide in the northwest corner of the house. This addition will be 3 f et,
6 inches from the north property line.
It appears that the development of this addition any further to he south
will impair the view in the living room windows, which overlook the w sterly
rear yard. The addition will have a hallway connecting it to the mai part of
the house, bypassing the existing bedrooms. It appears that the addi ion, as
proposed, appears to be a reasonable one. �i

considerably more work and attention in the future. The size or
magnitude of the band-aid may be debatable, the need for it , and
f utu�e attenti�on to a comprehensive plan isn't. '
Past non-union salary discussions have-not been given suffi-
cient consideration in my opinion. The amount of data and various
reasons for adjustments, as prepared in this office, have probably
been to skimpy. Although I usually spend quite a bit of ' time
preparing the recommendations, my research and documentation is
considerably less thorough than that prepared by a professional
full-time personnel person. (Resulting in less good data and
persuasion in front of you). As a result, I have not been as
persuasive or convincing in my arguments. �
� Our two bargaining units have the benefit of two profession-
al negotiators. All pertinent facts, figures, and comparisons are
brought out on the table and argued out. Whether settlement�is by
mutual consent, or by arbitration, the result is, by and large, a
metro settlement. Our unionized;employees are receiving compensa-
tion and benefits comparable to other similar positions in the
metro area. The foregoing scenario is not applicable to the non-
union employees. � , I

�- 1. My preparation for the 15 different positions (compared
to 4 in the bargaining units) is-not as complete or thorough:

2. There is no "professional" negotiation for the non-,union
employees:

a. Their case has been poorly presented by myself.
. b. Arriving at 15 different and equitable salaries is
much,- much more difficult than arriving at a metro or parity rate
for 9 patrolmen or 3 maintenance men or 3 leadmen or 1 mechanic.
��'�- `� c. "Settlement" has consisted of a percentage mandate
to. be divided up amongst 15 positions of varying importance and
value. It should be obvious that small increases couldn't be
divided• satisfactorily between two persons, let alone 15!
3. The final settlement for union employees is generally
an "industry-wide" or metro rate - a parity rate equal or very
comparable to everyone else. This is not true of the other peo-
ple. As the annual information has shown, and as the attached
"Worksheet" shows, our rates are all below the Group 5 mean. (See
"% of Mean" Column, 3rd from Right). In fact the 1983 rates are
anywhere from 97.9% of the Mean, to as low as 79.9% of the Mean.
-� For the higher salaries, such as Adminstrator, Public Works
Director, and Police Chief, it is understandable that we would not
necessarily expect the mean. At the other end of the scale,' the
lower salaries should compare favorably to the mean. As you note
in the "%" column, they don't, hence the complaint.
In summary I suggest that:
�' 1. Serious consideration be given to the attached Salary
Adjustment Data. The "Increase" Column reflects increases that
will compensate our people in a manner comparable to similar metro
positions. There are seven below-average salaries that should be
adjusted. I have used 97� of the Mean because there are three
other positions that are prsently at about that level. (Public
Works Supervisor, Police Sargent, and Accounting Clerk) I submit
that the adjustments can and should be made as the first step.
1983 Budget allocations were prepared originally to handle sala-
ries comparable to these, hence these adjustments will have no
deleterious affect on the '83 budget.
2. Sometime in the near future, an in-depth compensation
plan study should be made. The short-commings and inadequacies of
_past practices are apparently showing up. Our organization is
getting .bigger. (Engineering added four). It doesn`t take much
analysis or thinking to realize that these 15 positions have been
quite summarily assigned job numbers and compared to short job
�'descriptions as listed in the Stanton Survey. In general, I
believe they are quite valid. However there are at least two
positions that are currently being questioned. In other words, a
more complete job analysis is one of the first things that needs
to be addressed.
_ I have avoided step rates, and more formal merit-type eval-
uations, but maybe the time has come to consider the merits of
more sophisticated and "justifiable" plan. Additional thought and

study should be given to the whole gamut of�fiinge benefits I- and
�� who gets what. The Metro Manag�rs are considering a"Cafeteria"
approach, allowing employees to s'elect pre-tax benefits that more
closely fill each one's special n�eds. (Health insurance benefits
granted to both a working man and working wife - and yet collect
on only one policy is a prime example of poor application.) I
�
Although no special action is necessary at this time, I
would strongly suggest that a comprehensive compensation study be
commenced in the near future. A well-developed, well-understood,
modern compensation plan would ';
a. Provide a valid base line for future adjustments.
b. Encourage better personnel practices amongst all the
employees.
c. Reduce the "whim" or "chance" element feared by many.
d. Result in better morale and work satisfaction.
Developing such a plan will take l�ots of time and effort on almost
everyones part - but I believe its time has come. �

are often required. However, it is not required when visibility s one mile
or less and/or traff ic conditions are determined by the person in charge to

SUBJECT. 1984 Budget Praposal
Th.e praposed 1984 Budget for Administration Department ac ivities
is attached for your review and consideration. The administrat ve budget
sheets, as we].1 as the balance of the departmental budget�s, was prepared
on our I'ffi�1 camputer. Because we no have the ogportunity to sav the
data base fram year ta year, a number of format refinements hav been
made throughout the departments. Two such refinements were mad in the
administrative budget format. The office rental line item, whi h in
the past had consisted of costs for rental of both the police a d admin-
istrative facilities, naw reflect on2y the cost af rent for adm nistration
and the City's share af the owner's increase in real estate tax costs.
The Metropolitan Waste Can�rol Commission's sewar availability harges,
collected along w3.th buildi.ng permit fees, and then submitted t MWCC,
have been reflected in the Util3ty Degartment budget, The corr spanding
revenue item has been deleted fxom the General. Fund and placed n the
Utility Fund. The Adminis�ration budget percentage and do7.lar ncreases
addressed in the memo refZect the el�:mination of SAC eharges an tfie
distribution of office rental casts. For comparison purposes, he 1983
Administration Department Budget , adjus�ed to reflec� these ch nges,
totals $294,320.
The attached budget groposal reflects an overall increase of $20,330
over the 2983 adjusted budget, for a.percentage increase of 6.9°, In
all past years, el.ection expenses have been separaCed from the b dget
for the purpase af camparing both doZlar increases and per.centag� iiicreases.
I have, however, chosen to include the anticipated $6,900�in electian
expenses {ane-third of the tatal dollar 3ncrease prapased�for 19 �} in
the overall percentage and have kept other increases at the min' um in.
conszderation of revenue reductions 3n Loca]. Government Aids. E clusi.ve
of el.ections, I am proposing a 4.9% overall increase. '
I have groposed a significant increase in the Personlel Ser ice
Iine item for full-time salaries. The budgeted amount reflects hat I be-
lieve to be the mast extreme possible impact which could occur a the re-
sulC af initiation of a pasi.tion classificationjcompensation pla at some
time during the year. The capital outlay portion of the budget s reduced
slightly from 1983, but anticigates needs for mice2lan�aus offic equigment
as well as acquisition af additiona�l computer sof�ware., memory b ard ex-
gansian and other tninor system upgrading. � .
The attached budget proposai, in my opinion, is extremely onserva-
tive, particularly given the retentian of a substantial continge cy and the
inclusian of eiection within the over-all percentage increase. t does
however represent an honest attempt to address the need for spen ing con--
strai.nts in view of state cutbacks and yet providas the abil.ity o address
potentially signiiicant cost increases in the largest portion of the budget.
Since I am scheduled to be on vacation most of next week,, I do not
plan an attending the Council meeting un�ess something of an urgent nature
occurs between nnw and Tuesday evening. Larrq Shaughnessy wiil be in at-
tendance for the complete meeting to par�icipate in the several financial
matters included in the agenda. He has valuntaered to present the adminis-
trative budget proposal on my behalf. I have complete confidence that
Larry is as pregared as I would be to answer any quest�ans you might have,
however, I am planning to attend the August 23rd special budget meeting
should you desire further detail on the budget praposal.
As a P.S. to the faregaing, I would be happy to came in early for the
August 23rd meeting to demonstrate the nse of our new camputer ior budgeting.
Zf any of you would be interested in such a demonstration please let me know.
