I KRAJNIAK WETLANDS Assistant City Attorney Hart reported that the PERMIT a proposed storm sewer easement over a portion owned by Michael and Debbie Krajniak and locate Avenue, had not as yet been resolved. Mr. Hart Krajniak had apparently violated the terms of t originally granted to Mr. Krajniak by the City 1978 in the (i) the filling of his property was greater than that which was authorized pursuant permit, and (ii) Mr. Krajniak had failed to sul mation to the City, required pursuant to the te permit, concerning the extent, nature and handl ' be deposited on his property. ispute concerning the property at 535 Marie oted that Mr. wetlands permit uncil in May of ubstantially o the wetlands t certain infor- s of the wetlands a of the f ill to C. Ayes: 4 Nays: 0 Page No. 1831 May 17, 1983 According to Mr. and Mrs. Noel F. Zaspel, owners of the propertv adjacent to the Krajniak property and located at 1792 Ridgewoc Drive, this excess fill has resulted in a diversion of the watt_ runoff from the Krajniak property onto the rear portion of the Zaspel property. Mr. Hart noted that in October of 1981, the City Council approved the issuance of a second wetlands permit to Mr. Krajniak to include the excess fill, which approval was condi- tioned upon (i) the execution and delivery to the City by the Krajniaks of a storm sewer easement at no cost to the City and (ii) reimbursement of all costs incurred by the City in the pro- cessing of the application. Mr. Hart further noted that, since that time, substantial efforts have been made to negotiate the terms of an appropriate storm sewer easement agreement with Mr. and Mrs. Krajniak, but that the Krajniaks had apparently elected not to grant to the City any such storm sewer easement. The Krajniaks have taken the position that the drainage problems curr- ently being experienced by the Zaspels were not caused by the ex- cess fill, but are instead caused by the discharge of storm water runoff from a nearby culvert which is a part of the City drainage system. The Zaspels disagree, indicating that the level of water runoff onto their property dramatically increased immediately sub- sequent to the performance of the filling work by the Krajniaks. Councilwoman Witt indicated that she was familiar with the area, that the Zaspels were indeed experiencing severe drainage pro- blems, and that she felt such drainage problems were created as a result of the excess fill on the Krajniak property. Mr. Hart reported that, in the event that the City Council elected to take action, several alternatives would be available, including the following: (i) initiating a lawsuit or other action to compel the Krajniaks to remove the excess fill; (ii) condemning a portion of the Krajniak property and performing the required drainage work, with the option of treating the project as a public improvement and assessing the parties benefited by suah improvement for the costs thereof; (iii) citing the Krajniaks for violation of the Mendota Heights Wetland Systems Ordinance (Ordinance No. 402); and (iv) performing certain filling or other remedialwork on the Zaspel property. Mrs. Zaspel confirmed that she and her husband are will- ing to grant an appropriate storm sewer easement to the City. After Councilman Mertensotto's arrival, the matter was once again raised. Mr. Russ Wahl appeared on behalf of Debbie Krajniak. Mr. Wahl indicated that a portion of the Zaspel property has been class ified as wetlands in the past, reiterating the position of the Krajniaks that the fill on the Krajniak property did not cause the problems currently being experienced by the Zaspels. He requested that the Council defer action on the matter until the following • Council meeting set for June 7, 1983, in order to allow the Krajniaks an opportunity to resolve the matter amicably. Councilman Mertensotto moved to continue the matter until the June 7th meeting. Mayor Lockwood seconded the motion. PARK COMMISSION MISCELLANEOUS Page No. 1832 , May 17, 1983 , Park Commission Chairman Bayless reported on Pa k Commission and Trails Committee activities and the recent Park Commission meet- ing. Councilman Mertensotto reported on the status o a proposed chang to a defined contribution method of funding the Fire Relief Assoc• iation. Continued erosion, flooded basements, yards hat are turning into swamps, and decreasing pzoperty values lare e er present fears for many of our citizens. Our plans are to try and handle average wate= run-off und r the current conditions with the development of a'natural' storm sewe system. Holding ponds would collect the water for drainage into t e ziver. This system urill not be in place until fourth quarter of 1983 or possibly second quarter of 1984, depending on forthcoming bids and schedules. Even with this system, continued development 'n the slopes surzounding Mendota could cause extensive erosion and dra.nage problems. Stein seconded the motion. Passed. ,Bayle s will have the certi.ficate prepared. Tennis Tournament - Williams reported that aain City wide unsanct oned junior tennis tournament could still be planned and held in the City's par system this July or August. It would be conducted as a sanctioned tournament, nder the guidelines of the U.S. Lawn Tennis Association. The commission has several resource people, in addition to Dewey Selander, to set up the tournament. Williams moved that the Park and Recreation Commission take wh.tever action necessar to obtain a U.S. Lawn Tennis Association membershi with he ul.timate intent of having a sanctioned tournament in 1983. Schneeman second d the motion. Passed. Williams estimated such a membership to cost $20-$30. Thus, we will not those suggestions. tion. to development was to sis and d we . repeat Though the level of service is restricted in some areas, we ac ept the apparent decision to center the principal fire fighting facili ies in a single location in the vicinity of the intersection of 149 and 110. The principal criteria here should be safe and efficient acces to both highways so as to serve development to all directions fro this general location. If the proposed bridge location and accessory ramps•and access roadways were in place today, we would strongly suggest the location re ommended in our preliminary land use plan in the northeast quadrant of he interchange. This location would provide imriediate and safe a cess to 149 for travel quickly and efficiently both to the north an the south. Access to the west would be very direct via a freeway oad and the movement of the fire equipment westerly on the access ramp to 110. The northeast quadrant of the City could be served directly by access to 149 and Marie Avenue. The far southeasterly quadrant of th City could be served by access via 149 (south-bound) and turning le t at the future Meridota Heights Road. The area that would be least wel served would be the area just south of Highway 110 and west of Delawa e. Most of this area, however, is occupied by the Dodge Nature Center or which frequent fire fighting services may not be as essential as mor developed areas of the City. Thus, from an efficient access viewpoint, he location of the fire station on the land already owned by the ity, south of Freeway Road would be most appropriate. When we met with representatives of the Fire Department, Polic Department, and City administration several weeks ago, it was that a location north of Highway 110 could be appropriate. It of course, normal and usual for members of the Fire Department is, to ed MEMORANDUM RE: Fire Station Site 17 desire a new fire station to be in close proximity to their re We understand why the members of the Fire Department today are endorsing a location south of Trunk Highway 110. The principal disadvantages to locating a.fire station now in northeast quadrant is the fact that there will likely be subst delay before the bridge can be constructed. As noted by Mn/D0 comments at conferences in consultation with with representati as expressed at the hearing, if Mn/DOT is to fund the project construction date of 1988 may be possible. During the interim of time a station at the site recommended would be less effici an alternate location to the south of 110. ' In any case, given the ultimate land use pattern that may evol "Downtown Mendota Heights", we suggest that no potential comme should be used for the station site. The City is in short sup; commercially zoned property, and the prospects for additional such use in the vicinity of 149 and 110 are likely very slim. station and/or a city hall facility is permitted in the resid zone. We suggest that it is therefore appropriate that such d occur on land that is currently zoned residential rather than that is now zoned for business or may be in..the future. e 1983 Page 4 dences. e tial s s and eriod t than for ial land y of nd for fire tial land VIe suggest also, as indicated in our previous presentations, th t excess right-of-way that may be made available easterly of the new ali nment of Trunk Highway 149 should be used for uses allowed in residen ial zones. A view of the residential development in the northeast uadrant and the existence of the Nature Center in the southeast quadran - adherance to this principle will protect the integrity of those uses. The placement of a fire station, however, in the southeasterly uadrant on land that may be excess right-of-way would be very difficult to achieve in the near future. Also, access to this area of land ill require the construction of the loop road system around the sho ping center prior to development of a fire station site in this area. This land, we feel, would be ideal for senior citizens housing, bein close to.but not within the shopping center site itself. Under these condition we suggest that the most appropriate site construct a fire station in the future is imediately south of Mendakota County Club, and west of Highway, 149. The site will direct access to the south, and will in fact be closer to the f southwest quadrant where our principal industrial development occurring. This location will be accessible to the new intercY via South Plaza Drive. It would appear to us that of the site; for dev.elopment at this time south of Highway 110, that this s represents the best choice. Ideally, on this'site the structux orient to the south, with a driveway access to old 149 opposite Avenue. to :he rovide r inge available :e ; can Creek MEMORAIJDUM RE: Fire Station Site 17 Jure 1983 IPage 5 Should the Council wish to discuss elements of these recommendation with us in the immediate future, we would be happy to do so. I would like to address the downtown Mend ta Heights Plan from my personal viewpoint, witfi advantages and disadvantages fo Plan A, which I like to think Qf 'rehabilitating' the Highways 149 and 100 In ers:ection on present alignment and Plan B being the 'realignment' of 149 betwee the two Friendly Hills sections. he advantages of Plan A, Alignment of 149 on existing right of way: 1) People are accustomed to traffic in that corridor. I 2) It allows the entire SE quadrant of that intersection to be avai commercial downtown development, including some type of frontage 3) Separate pedestrian cross over due to over pass on existinglalig less traffic and pedestrians due to on and off ramp connectioris. 4) The new fire hall could be located in the area of the old fire h successfully. 5) A senior citizens high rise located on the east commercial proge: have direct access to the shopping center without crossing a maj highway. The disadvantages of Plan A, Realignment of 149: ' 1) Extremely tight, if not impossible, fit within existing right of 2) If additional right of way is required, considerable expense may : in additional right of way acquisition. le for ad. nt with L quite , would truck y . : incurred E11iQYvN }rL1;'t Eil Fage 2 ) Cansiderable expense may be incurred in lawering the surface of Highway 110 so that Highway I49 overpass can be lowered sufficiently to provide same type of reasonable access elevation to the shopping cenGer. 4} Standard ii S.ation needs to be purchased and relacated. 5} The Bank iacility location would nat be the most desirab3e unless a frontage raad, (with complete elimination of South Plaza Dri.ve) cauld be ],aid out for access to the businesses alang Sauth Plaza Drive, plus the extension of Sauth Plaza Dra.ve an arontage raad basis so that addita.onal commercial development caulc take place east of the bank, Advantaqes of Plan B, Realignment of Highway 149: 1) liows a more open connectian wih free flow of traffic routing in the intersectian. 2} Unused Iighway 149 right of way conld be eturned to original. owners wha may want ta develop housing with an extended A,pache Street to shopping center. 3) The new fire hall could be lacated in the area of the old fire ha7.I quite successfully. Disadvantages af Plan B: 1) Large loops transec.ing and combining Highways 149 and 110 intersections wi.th rontage roads, 2? Housing in Friendly HilZs area abutting new alignment are totally opposed due ta the fac that they have the r.lost to iose because they now enjoy the quude in the back yards of their homes from property which they do not awn. 3 Standard QiI Statian needs ta be purchased anc relocated. 4? If senior citizen center is located to the east of the commercial property, senior citizens would have ta crass a main truck highway to get ta the shopping center. Although there are many other considexations, the above draws me to .he following: A) Bath plans should be studied extensively to come to the most respansible soluti.on. B) The first pass appeared ta me to be less castly an Plan A, however,'I beiieve it may be more costly due to the heavy earth work required with ramps built on bridges, lowering of 110, etc. Therefore, suficient study shouid be made to evaluate reasonable cost for both plans. C) Enviranmenal responsibilities of the City should be addressed under both p] ans . " . nr,otiN t+Cv[Ri Page 3 Anbather alternate plan could be Plan A with the possiblity of 110 on the bridge and Highway 149 below. Highway Due to the complexity of either option, but also considering the exc'ting opportunities of each option to have a good downtown plan, I would r quest that at the next council meeting, we try to determine our cost to go ahead with a complete study for both plans and give firm directi:on as to w ether we are interested in seeing the project through or not.
