LEADERSHIP The Council acknowledged a letter from the City Administrator
TRAINING advising of the need to reschedule the leadership training
session which had been scheduled for June 17th. It was the
concensus of the Council that the session should be scheduled
for all day on June 14th.
KRAJNIAK WETLANDS The Krajniak wetlands permits/storm sewer easement matter was
PERMIT 'briefly discussed and tabled for discussion later in the meet-
ing pending the arrival of Councilman Mertensotto.
PERSONNEL The Cour� il acknowledged a memo from Public Works Director
Danielson notifying the Council that Rudy Literski has decided
to retire from the City Park Leadman position on June lst. Mr.
Danielson discussed and received Council approval of the interim
appointment of Terry Blum as acting Park Leadman, the employment
of an additional part-time seasonal employee and a shift in re-
sponsibilities among the Public Works employees until a new lead
person is selected and a new maintenance person is hired.

The Council reviewed final plans and specifications for street
surfacing in the Ivy Falls Addition.
Councilwoman Witt moved the adoption of Resolution No. 83-48,
"RESOLLTTION APPROVING FINAL PLANS AND SPECIFICATIONS AND AUTH-
ORIZING ADVERTISEMENT FOR BIDS FOR THE CONSTRUCTION OF BITUMINOUS
STREETS AND APPURTENANCES TO SERVE IVY FALLS ADDITION AND ADJA-
CENT AREAS (IMPROVEMENT NO. 79, PROJECT NO. 12)", the bids to be
received on June 20th.
Councilman Hartmann seconded the motion.
The Council acknowledged and discussed a memo from Engineer Kishel
and final plans and specifications for the upgrading of Huber
Drive.
Councilman Hartmann moved the adoption of Resolution No. 83-49,

KRAJNIAK WETLANDS Assistant City Attorney Hart reported that the

According to Mr. and Mrs. Noel F. Zaspel, owners of the propertv
adjacent to the Krajniak property and located at 1792 Ridgewoc
Drive, this excess fill has resulted in a diversion of the watt_
runoff from the Krajniak property onto the rear portion of the
Zaspel property. Mr. Hart noted that in October of 1981, the
City Council approved the issuance of a second wetlands permit to
Mr. Krajniak to include the excess fill, which approval was condi-
tioned upon (i) the execution and delivery to the City by the
Krajniaks of a storm sewer easement at no cost to the City and
(ii) reimbursement of all costs incurred by the City in the pro-
cessing of the application. Mr. Hart further noted that, since
that time, substantial efforts have been made to negotiate the
terms of an appropriate storm sewer easement agreement with Mr.
and Mrs. Krajniak, but that the Krajniaks had apparently elected
not to grant to the City any such storm sewer easement. The
Krajniaks have taken the position that the drainage problems curr-
ently being experienced by the Zaspels were not caused by the ex-
cess fill, but are instead caused by the discharge of storm water
runoff from a nearby culvert which is a part of the City drainage
system. The Zaspels disagree, indicating that the level of water
runoff onto their property dramatically increased immediately sub-
sequent to the performance of the filling work by the Krajniaks.
Councilwoman Witt indicated that she was familiar with the area,
that the Zaspels were indeed experiencing severe drainage pro-
blems, and that she felt such drainage problems were created as
a result of the excess fill on the Krajniak property.
Mr. Hart reported that, in the event that the City Council elected
to take action, several alternatives would be available, including
the following: (i) initiating a lawsuit or other action to compel
the Krajniaks to remove the excess fill; (ii) condemning a portion
of the Krajniak property and performing the required drainage work,
with the option of treating the project as a public improvement
and assessing the parties benefited by suah improvement for the
costs thereof; (iii) citing the Krajniaks for violation of the
Mendota Heights Wetland Systems Ordinance (Ordinance No. 402); and
(iv) performing certain filling or other remedialwork on the Zaspel
property. Mrs. Zaspel confirmed that she and her husband are will-
ing to grant an appropriate storm sewer easement to the City.
After Councilman Mertensotto's arrival, the matter was once again
raised. Mr. Russ Wahl appeared on behalf of Debbie Krajniak. Mr.
Wahl indicated that a portion of the Zaspel property has been class
ified as wetlands in the past, reiterating the position of the
Krajniaks that the fill on the Krajniak property did not cause the
problems currently being experienced by the Zaspels. He requested
that the Council defer action on the matter until the following •
Council meeting set for June 7, 1983, in order to allow the
Krajniaks an opportunity to resolve the matter amicably.
Councilman Mertensotto moved to continue the matter until the
June 7th meeting.

The Council briefly discussed problems created �y a temporary con•
� struction road heing used by the contractors fo the Visitation
Convent construction project. The Council dire ted the Public Wo�
Director to look into the matter.

SUBJECT: United Properties Monument Permit
Mark Cella has suLYnitted a sign permit application, site plan and
an elevation drawing for the proposed Mendota Heights Business Par
Monument. As shown on the site plan, they are proposing to locate the
monument on the northwest corner of their property, near the inter ec-
tion of Mendota Heights Road,and Pilot Knob Road. The site plan s ows
the monument to be set back a distance of 20 feet from the propert
lines adjacent to Pilot Knob'and Mendota Heights Road. The propos d
monument is shown to be 15 feet high overall and 7'6" wide and 7'6'
deep. A representative from United Properties will be present Tue -
day eveing for possible questions and discussion.
I can see no technical reason why this proposed monument shou]
not be installed and would recommend approval of the permit as re-
quested, subject to Council's review. !'

As you may be aware, the Mayor, Council, and citizens of endota
have expzessed great ooncern about the continued and incz asing
water zun-off into the City of Mendota.
We (the Mayor and Council), are requesting that the Mendo a Heights
Planning Commission and the City Council considez the pro lems we face
and the damage caused to homes and property by the increa�ed develop-
ment in the areas bo=dering the City of Mendota, especial�.y the Hwy.
110 areas. Continued erosion, flooded basements, yards �hat are
turning into swamps, and decreasing pzoperty values lare e er present
fears for many of our citizens.
Our plans are to try and handle average wate= run-off und r the current
conditions with the development of a'natural' storm sewe system.
Holding ponds would collect the water for drainage into t e ziver.
This system urill not be in place until fourth quarter of 1983 or
possibly second quarter of 1984, depending on forthcoming bids and
schedules. Even with this system, continued development 'n the slopes
surzounding Mendota could cause extensive erosion and dra�.nage
problems.

Mr. Robert Kilgore is the applicant's architect and has worked clo ely with
Staff to prepare a plan in accordance with the C'ritical River Ordi nce. The
proposed structure is setback in excess of the required 40 feet mi imum from
the bluffline, and needs no other variances.
The home is situated on the embankment of a fill area created by t e developer
for the new stree�tsand utilities. Soil tests were taken and recom endations
made for the foundation of the new home will 6e followed. �
Staff recommends Council authorize a building permit be granted fo
a review of the final plans by the Code Enforcement Officer.

MINUTES
JUNE 14, 1983
The regular meeting of the Mendota Heights Park and Recreation Commission
was called to order at 7:00 P.M, by Chairperson Bayless. Members p esent were
Bayless, Doffing, Knittig, McMonigal, Schneeman, Stein and Williams. Also
present was Terry Blum. ',
M inutes of the previous meeting were corrected to credit Bayle s with the
survey of Friendly Hills park. M inutes were approved.
Maintenance Report - Terry Blum reported that the warming house at vy Falls
Park had been vandalized. Several lights were broken and the walls were damaged.
Maintenance in the parks included: repairing a bench at Ivy Falls ark, hauling

people, in addition to Dewey Selander, to set up the tournament.
Williams moved that the Park and Recreation Commission take wh�.tever action
necessar to obtain a U.S. Lawn Tennis Association membershi with �he ul.timate
intent of having a sanctioned tournament in 1983. Schneeman second d the motion.
Passed. Williams estimated such a membership to cost $20-$30.

have the unsanctioned tournament in 1983. Knittig seconded the mot on. Passed.

The principal criteria here should be safe and efficient acces to
both highways so as to serve development to all directions fro this

If the proposed bridge location and accessory ramps•and access roadways
were in place today, we would strongly suggest the location re ommended
in our preliminary land use plan in the northeast quadrant of he
interchange. This location would provide imriediate and safe a cess
to 149 for travel quickly and efficiently both to the north an the
south. Access to the west would be very direct via a freeway oad and
the movement of the fire equipment westerly on the access ramp to 110.
The northeast quadrant of the City could be served directly by access
to 149 and Marie Avenue. The far southeasterly quadrant of th City
could be served by access via 149 (south-bound) and turning le t at the
future Meridota Heights Road. The area that would be least wel served
would be the area just south of Highway 110 and west of Delawa e. Most
of this area, however, is occupied by the Dodge Nature Center or which
frequent fire fighting services may not be as essential as mor developed
areas of the City. Thus, from an efficient access viewpoint, he

The placement of a fire station, however, in the southeasterly uadrant
on land that may be excess right-of-way would be very difficult to
achieve in the near future. Also, access to this area of land ill
require the construction of the loop road system around the sho ping
center prior to development of a fire station site in this area. This
land, we feel, would be ideal for senior citizens housing, bein close
to.but not within the shopping center site itself.
Under these condition we suggest that the most appropriate site
construct a fire station in the future is i�mediately south of
Mendakota County Club, and west of Highway, 149. The site will
direct access to the south, and will in fact be closer to the f
southwest quadrant where our principal industrial development �
occurring. This location will be accessible to the new intercY
via South Plaza Drive. It would appear to us that of the site;
for dev.elopment at this time south of Highway 110, that this s�
represents the best choice. Ideally, on this'site the structux

In my every day travel, I quite ofter get thinking time to sort out c� fferent
possibilities on projects. I would like to address the downtown Mend ta Heights
Plan from my personal viewpoint, witfi advantages and disadvantages fo Plan A,
which I like to think Qf 'rehabilitating' the Highways 149 and 100 In ers:ection
on present alignment and Plan B being the 'realignment' of 149 betwee the
two Friendly Hills sections.
�he advantages of Plan A, Alignment of 149 on existing right of way:
1) People are accustomed to traffic in that corridor. I
2) It allows the entire SE quadrant of that intersection to be avai
commercial downtown development, including some type of frontage
3) Separate pedestrian cross over due to over pass on existinglalig
less traffic and pedestrians due to on and off ramp connectioris.
4) The new fire hall could be located in the area of the old fire h
successfully.
5) A senior citizens high rise located on the east commercial proge:
have direct access to the shopping center without crossing a maj�
highway.
The disadvantages of Plan A, Realignment of 149: '
1) Extremely tight, if not impossible, fit within existing right of

2? Housing in Friendly HilZs area abutting new alignment are totally opposed
due ta the fac� that they have the r.lost to iose because they now enjoy
the qu�ude in the back yards of their homes from property which they
do not awn.
3� Standard QiI Statian needs ta be purchased anc� relocated.
4? If senior citizen center is located to the east of the commercial property,
senior citizens would have ta crass a main truck highway to get ta the
shopping center.
Although there are many other considexations, the above draws me to �.he following:
A) Bath plans should be studied extensively to come to the most respansible
soluti.on.
B) The first pass appeared ta me to be less castly an Plan A, however,'I
beiieve it may be more costly due to the heavy earth work required with
ramps built on bridges, lowering of 110, etc. Therefore, su�ficient study
shouid be made to evaluate reasonable cost for both plans.
C) Enviranmen�al responsibilities of the City should be addressed under both
p] ans .

Heights. Ace has not worked for the City previously but they have been bid-
ding our work recently. In checkir�g references, we find that they are a 5
or 6 year old company consisting of exemployees of B-Tu-Mix, Inc., a now
defunct company that was very good in its day. Although their bid is about
5 percent over our estimate, we feel that an award should be made o Ace
alacktop, Inc. in the amount of $91,503.00
Attached is a resolution listing ttie bids received. Staff recomme ds that

Mr. John Callahan owns a lot located the the northwest quadrant of
Road and Marie Avenue. He has had several prospective developers
to City Hall trying to design a home to fit the lot. Because of t
fact that there is a water course running through the lot, the hom
on Marie Avenue are set back farther than the 30 foot City standar

setback this lot has been a challenge to try to fit a new home on.

held in accordance with the City's wetlands ordinance. �

PETITION FOR SANITARY AND STORM SEWER AND
WATERMAIN IMPROVEMENTS AND WAIVER OF HEARING
The undersigned, being the owner of the fallowing described
property situated in the City of Mendata Heights, in the County
af Dakota and State af Minnesota, to-wit:
Lots 1 through 11, Block 1., and Lots 1 through
7, Block 2, of Snelling Va.ew Repla�, Sectian
22, Township 28 Nor�h, Range 23 West.
Pursuant to the provisions of M.S.A. 429.031, Subd. 3, the under-
signed hereby petitions �,he City Counca.l of the City of Mendata
Heights to construct and extend said City's Watermain, Sanitary
and Starm Sewer Systems so as to directly serve the above des-
cribed property and to assess the entire cast of said improve-
ments (including the cost of any land or easement acquisition
incurred by reasan �hereof} against said property. The under-
signed hereby further specifically waives the requiremen�. of any
hearing and said improvements and assessments therefare and fur-
ther waives the requirement af publication and mail�d notice of
ar with respect to any such hearing or hearings.
The undersigned further agrees to donate to the City of
Mendota Heights any easements over the above described property
required for said project.

DEVELOPER'S AGREEMENT CONCERNING SINGLE '
FAMILY DEVELOPMENT ON THE SNELLING VIEW REPLAT ADDITION
SECTION 22, T28N, R23W, MENDOTA HEIGHTS, MINNESOTA

This agreement, made and entered into this /S _ day of
, 1983, by and between the City of Mendota Heigh s,
kota County, Minnesota, (hereinafter called the "City"), a d
odd Construction Company, Inc. at 4917 Rolling Green, Minneapo-
lis, Minnesota, (hereinafter called the Developer). (
W I T N E S S E T H:
WHEREAS, Developer proposes a plat for a Planned Unit Dev 1-
opment in Mendota Heights to be known as Kingsley Estates Ad i-
tion, consisting of 24 Patio Home Townhouses on approximat ly
8.99 acres in the southeast quarter of Section 22, in: Mend ta
Heights, more particularly shown on the plat known as Kings ey
Estates Addition; and '
WHEREAS, public services are needed by the Developer f om
Mendota Heights in order to proceed with said development;
NOW THEREFORE, it is hereby agreed by and between I,the wo
parties as follows:
1. Developer will petition the City for needed pub ic
improvements (Sanitary Sewer, Storm Sewer and Watermains). Dev 1-
oper agrees to pay $3,600.00 excrow to the City as per Ordina ce
1503.
2. Developer will provide at no cost to the City all neeaed
temporary construction easements to install said improvements.I
3. Mendota Heights will proceed as expeditiously as:pos i-
ble with hearings and such additional proceedings as may be
required to cause public improvements to be installed.' It is
recognized that the developer's plat is the only property to be
served by this project so the entire cost is to be 'asses ed
against the twenty-four (24) parcels located in the plat.
4. Developer agrees that no lots will be sold until 11
necessary easements for utility construction are received by
Mendota Heights. �
5. The access road to the homes is to be constructed by he
Developer and will have the characteristics of a blacktop ed
private driveway. This access road will be maintained by he
association that utilizes it. The road will be maintained a a
level and in a timely fashion to allow emergency vehicles acce s.

6. Storm water drainage toward the west boundary of the
property has been pointed out as a concern, design of a holding/
detention pond by the City will be coordinated with the mass
grading of the site by the developer. New construction will
be designed not to increase runoff rate down the ravine to Trunk
Highway 13. Runoff toward Lexington Avenue has also been a
problem and a detention pond may need to be added on the east
side of the development.
7. Developer adds six additional lots in this replat and
agrees to contribute $3,600.00 ($600.00 per lot) for a park
contribution. The first half shall be payable before execution
of the final plat or before a building permit is issued by the
City and the second half due before January 1, 1984.

SUBJECT: Annual Contracts - Metropolitan Waste Control'Commission
Staff has received the Metropolitan Waste Control Commission Renta Agree-
ment No. 155 for the City lines used jointly with Lilydale. This ear
the MWCC has increased the amount offered from $530.00 to $635.00. They
have also made the agreement a five (5) year one. Staff feeJs thi agree-
ment is acceptable and recommends the Council authorize the Mayor nd
Clerk to execute the agreement. '
It should be noted that their other annual agreement, No. 130 is n� longer
applicable because the MWCC is now maintaining the headhouse wi.th heir
own forces. ,

STATEMENT OF AGREEMENT RENEWAL
JOINT USE RENTAL AGREEMENT N0. 155
The Metropolitan Waste Control Commission and the City of
M end ot a Heights agree to renew the Joint Use Rental Agreement No. 155
under the terms and conditions contained in the agreement which is
currently in force between these parties. The renewal period shall
be for f i ve ( 5) years commencing on January 1, 1983 through December
31, 1987.
The Commission hereby agrees to pay the municipality the total
sum of $635.00 for the use, operation and maintenance of the
int er c eptor sewers described in Exhibit "A" of the original agreement
on or before January 31 of each calendar year during the agreement
renewal period. .
On or before November 1, 1987 , the Commission may give the
mu nicipality written notice of its intention to renew this Agreement.
Wit hin thirty (30) days after receipt of such notice the municipality
shall notify the Commission in writing whether it will renew the
Agreement. If the municipality fails to give such notice within such
period, the Agreement shall be renewed for the following calendar
ye ar without modification, except by consent of both parties. If the
Commi s s ion f ails to give the municipality notice of its intention to
renew by November 1, 1987, the Agreement shall be renewed only by
consent of both parties.
That both parties agree to the renewal period and terms is
