Ayes : 4 Nays : 0 ABATEMENTS County Assessor Bill Peterson was present to request Council approval of an abatement for 765 Willow Lane. He advised the Council that the property has been recently reviewed by the Assessor's office as the result of a request from the new property owner. It was determined that the original valuation C was incorrect. After discussion, Councilman Losleben moved that an abatement be granted to Mr. Allan Anderson for 765 Willow Lane, Parcel No. 27-71050-060-00, reducing the assessed value from $50,452 to $41,049. Councilman Hartmann seconded the motion. Ayes: 4 Nays : 0 CASE N0. 83-09, LARSON Mr. Robert Shields, representing Kathryn Larson, was present to request approval of the division of Lot 33, Willow Springs Addition, 623 Callahan Place The Council noted the Planning Commission concerns over maintenance of the existing drainage, and was advised that M s. Larson has agreed to grant the City a drainage easement which is currently being prepared by her surveyor. Councilman Losleben moved approval of the division of Lot 33, Willow Springs Addition, as proposed, subject to receipt of a storm water drainage easement, receipt of the $600 park con- tribution required as part of the division process, and clar- if ication that the property has been fully assessed for public improvements. Councilwoman Witt seconded the motion. Ayes : 4 Nays : 0 CASE N0. 83-15, SMEDSTAD Public Works Director Danielson explained the application from Bruce Smedstad for the division of Lot l, Block 1, Eide Estates Addition, along with an application for wetlands permit to construct an addition on the rear of the structure located at 901 Wagon Wheel Trail. Mr. Danielson stated that Mr. Smedstad recently purchased 901 Wagon Wheel Trail with the understanding that the land within the fenced area was included within his � property. He had learned subsequently that the existing fence was located approximately 18 feet onto the Eide lot. Mr. Danielson explained that 901 Wagon Wheel Trail does not meet the required lot size and that the addition of the 18 feet proposed to be divided from the Eide lot would bring the property into conformance with the ordinance. He stated that Mr. Smedstad had negotiated the purchase of the 18 feet from the Eide's and recommended that the lot division be approved. Mr Danielson explained that the addition Mr. Smedstad proposes t add to the rear of his home would be approximately 45 feet from Rogers Lake. Mrs. Rheta Oster, Mendota Councilmember, exp essed the Mendota Council's concerns over drainage. She state that several representatives of Mendota walked around the Valley View Oak Addition area and viewed the ponding area fo that subdivision and do not believe that it is functioning as it should. She stated that the Mendota officials believe properties in their City are being damaged because of the drainage from Valley View Oak and the City intends to stop the problem. Mendota Planning Commission member Sharon Bruestle also commented on the drainage problems. City Administrator Johnson suggested that a connection to the Mendota utility-system should be explored, and Acting Mayor Mertensotto stated that the City's engineering staff should keep in contact with the Mendota engineering consultants relative to the Mendota utility studies. Councilman Hartmann moved that the hearing be continued to July 19th and that the City Engineer be directed to work with the developer, the City of Mendota and Mn/DOT to determine the extent of the Mendota project and the TH 110 drainage project to determine to what extent the Mendota Heights partic- ipation should be. Councilwoman Witt seconded the motion. Acting Mayor Mertensotto opened the meeting for the purpose of a public hearing on an application from William Strub for a conditional use permit for a planned unit development. Mr. Strub reviewed the proposed site plan for a four building condominium office park planned unit development to be located on TH 13 between Wachtler and I-35E. Mr. Strub reviewed minor changes in the site plan, including the removal of three parking spaces which intruded on the Critical Area 40 percent slope requirement, and a change in parking stall width from 10 feet to 9 feet. He acknowledged the necessity for parking space width variance and a five foot sideyard setback variance for the parking area from the east property line. He stated that a completed landscaping plan and all other plans have been submitted and reviewed by City staff. Architect Robert Ackermann responded to a question on the use of an open ditch for drainage. Mr. Strub responded to a question on lighting. Acting Mayor Mertensotto asked for questions and comments from the audience. There being no questions or comments, Councilman Hartmann moved that the hearing be closed. Mr. Stehr stated that the structure, which has been completed without prior City approval, will be used to house pigeons which he raises for show. Mr. Stehr gave various reasons why the structure was completed without conditional use permit and advised that he had received a building permit for a 12' x 12' structure. � Acting Mayor Mertensotto asked for questions and comments from the audience. After considerable discussion, Councilwoman Witt moved approval of the minor conditional use permit as presented. Councilman Hartmann seconded the motion. CASE 4�83-17, SMOLIK Mr. David Smolik was present to request Council approval of his application for the division of an unplatted parcel of property located at the southeast corner of M allard Road and Hunter Lane, known as 1916 Hunter Lane. He indicated that the application would allow creation of a new lot of 100 by 153.5 feet north the existing 1916 Hunter Lane. He also requested approval of a 2.3 foot sideyard setback variance for the existing garage at the northerly line of the existing lot. Public Works Director Danielson addressed the matter of drainage and the need for culvert extension. After discussion, Councilman Losleben moved approval of the lot division and sideyard setback variance as requested subject to receipt of the park contribution and appropriate culvert plans and verification that the property has been fully assessed for public improvements. He recommended that the Council authorize execution of a pipeline easement between the City and NSP so that staff may proceed to acquire a quit claim deed from Mn/DOT for the area needed far street right-af-way. The following members were resent: Kruse, Morson, Stefani, Frank, Burke and Blesener. I APPROVAL OF MINUTES HEARING, CASE 83-16, DODD CONSTRUCTION, CUP FOR PUD, WETLANDS PERMIT AND CRITICAL AREA SITE PLAN APPRO VAL Minutes of the April 26th meeting had been su mitted previously. Blesener moved, seconded by Fran , to approve the minutes as submitted. Voting: alliayes. 1 Chairperson Kruse called the meeting to�order for the purpose of a public hearing on an application from Do d Construction for a conditional use permit for a planned un t development, a wetlands permit and critical area site plan approval. Mr. M ike Lyner, architect, explained the proposed project, noting that some setback requirements and garages ha been changed since the last meeting. The proposal consist of 12 double townhouse units, consisting of 2,000 square f et on the first floor and an additional 1,000 square feet abo e in a loft area. The project is proposed for an 8.99 acre site located west of Lexington, across from Overlook Road. The pr perty owner will own 20 feet in front of the unit, and 10 feet on either side and the rear of the unit. Prairie grass will be sed as a natural landscaping. The siding material will be rou h cedar, with an asphalt shingle roof. Mr. Lyner noted thatth re will be no typical floor plan, that each unit will be cu tomized. Dodd Construction will petition the City for,publi utilities. Commission member Blesener expressed concern ith access for emergency vehicles at the western end of the ite. Planner Dahlgren noted that a 20 foot wide lo being proposed. He suggested that perhaps a would be better to eliminate the one way dire street. Voting: 6 ayes, 0 nays. Mr. Richard Einck, developer, noted that he would prefer an opinion from the Fire Marshall regarding the radius of the turn around at the end of the cul-de-sac. He noted that he would prefer to install a hammerhead at the end of the cul-de-sac, but that if a 50 foot radius were needed, he would see that it would be accomplished. There was some discussion among the members regarding an easement on the property south of the proposed site. Mr. Lyner noted that the construction will be staged over a two year time period with the far west section constructed during the first year. Utilities will be installed this year, if approved. After a further brief discussion, Blesener moved to recommend approval of the preliminary development plan subject to staff review and auproval of: 1. A landscape plan; . 2. The provision for future access to the southern property; 3. Resolution of the cul-de-sac turn around; 4. Approval of the drainage plan; S. Approval of a staging plan. Burke seconded the motion. HEARING, CASE 83-18, Chairperson Kruse called the meeting to order for the purpose of RILEY, CUP FOR FILL a public hearing on an application from Mr. James Riley, for a conditional use permit to place fill on an 18 acre site located east of Lexington and north of Mendota Heights Road and south of Wagon Wheel Trail. Mr. Riley was present and noted that the land requires about 8,000 to 10,000 cubic yards of f ill in order for future development to take place. He proposes to stock- pile the fill in a low area on the site and to place hay bales on several portions of the fill to control erosion. He noted that the height of the fill will be 5-6 feet tall with 4-5 feet being the average height. He also noted that he is proposing to construct 3 story apartment buildings on the site. Planner Dahlgren noted that berming the site is a good idea since I-35E is relatively close to the area, but that Mr. Riley should plan to cover and seed the fill pile. Public Works Director Danielson noted that items such as erosion control, park contribution, utilities, etc. will all be addressed in a Developer's Agreement. Only one structure call resulted in property damage. On May 20th. at 1:24am we were called to the old school house in lower Lilydale. Someone had set the building on fire, we were able to save only the exterior walls. The remaining parts of the structure were removed by Ramsey County Park. On May 2nd at about 1:16pm we responded to Hiways 13 and 55 were two sedans were struck from the rear by a semi and pushed into the rear of a second semi. Three occupants of one car were injuried and taken to a hospital. The lone occupant of the second sedan was pinned in his vehicle for over a hour before we could safely remove him. We had to wait 30 minutes for two heavey duty wreckers to pull the rear semi off-of his car. The front wheel of the semi tractor was about two feet from the dash of the victims car. The tailgate of the front semi trailer was through the windshield of the victims car. A third wrecker was used to hold the vehicle of the three injuried parties in place as it sat across the endgate of the front semiiand roof area of the victims vehcile. The victim received a cut spinal chord and will be confined to a wheel chair for the rest of his life. SYNOPIS OF MONTHLY TRAINING The regualr two training session was spent at the old quonset type house on Hiway 55. The structure was filled with smoke and each firefighter took his turn entezing�,the structure and locating Capt. Connolly the "victim".�� The firefighter then used the limp waterless hose to find his way back to the entry door. The drill was set up to train in locating victims and to practise exiting a structure should the hose line go soft or break during a real fire surpression. The structure was filled with junk and made a good obstructed course in the thick smoke. On May 21st the quonset was burned during a drop tank drilling session. Their proposal is to develop a series of two un on the land immediately south of the townhouses that were const Lilydale immediately to the north by Bream Associates in the pa The density per unit would be 15,000 square feet as required in �family zone, thus the development could occur in this form unde Unit Development section of the Ordinance without rezoning the 2. We have two suggestions that we would offer for the applicant's consideration. One would be the possibility of bringing in a d roadway near the center of the property rather than grading the access drive condition as proposed. This would likely result i street and less impact on contiguous properties inasmuch as the yards for the townhouses woul.d be contiguous to properties both north and south rather than the access drives th�nselves. This in less grading costs as well. The loop is likely proposed as providing two accesses to the center of the property from which would be constructed. This would appear to be done as a soluti eliminate a long cul-de-sac which provides some problems in ter safety. However, if a divided roadway is constructed near the though each may be one-way, if one were blocked, the other woul be available for emergency purposes. Page 2 4. This land has previously been platted as a single family plat. It would appear then that an imaginative plan utilizing the PUD principles might well produce a better development. As proposed, however, that may not be the case here. 5. The variance requested is for consideration of a PUD under the 10 acre minimum land area. We do not have the exact acreage in the file but is, if I recall, slightly more than nine acres. , 6. The purpose of the Sketch Plan Review is to give the Commission the opportunity to familiarize themselves with the proposed development design prior to the conduct of a public hearing, and to offer comments regarding the proposal at the sketch planning phase of the Preliminary Plan. The Commission may wish to discuss elements of the de�ign as suggested here and/or other consideration offered by the Commission. More information regarding the type, scale, and elements of the units themselves would be helpful. The planning commissioner had a preliminary look at this dev proposal which consists of 24 townhouse units to be construct to a structure in conformance with the 15,000 square foot req 15,000 square foot of land required per dwelling unit. As su the last meeting, the applicant examined the possiblity of or road system toward the interior of the property rather than o and south edge as shown in the plans presented at the last pl commission meeting. The applicant was concerned that this wo the rear of the townhouse units toward the roadway system on to the north and toward the driveway on the property to the s felt that the grading costs would not be substantially reduce each of the units designed for flat site. This breaks up the unsightly occurence of a pair of double garages dominating the front of the unit. 2. The staff reviewed these considerations with the applicants o Monday May 16th, and have received revised plans today (May 18th) th plans are not in completed form as of this point but, appear to be a co cept that can be well adapted to the site. Attached is a letter from t e landscape architect indicating his intent to prepare a landscape plan w ich may be available for review prior to the planning commission hearing We have suggested that it would be helpful to submit floor pl elevations of the proposed structures for the commissions rev will assist in relating the unit plans to the site plans. You will notice too that the pathway proposed for the common open space will pass within less than 30 feet from the rear of the structures. Some consideration perhaps should be given to increasinq this distance to provide adequate privacy to these patio areas and the areas of window located on this side of the structure. At this point, no plans have been submitted for handling of the surface drainage. A holding pond is proposed at the far west end of the property in the ravine that exists at this location. The method of handling this run-off and ponding required to control this run-off should be carefully examined. Consideration should be given, in our opinion, to making the street access system to the loop a two-way drive rather than a one-way drive. This would reduce the amount of circulation involved eliminating the need for the traffic going to and from the units along the loop making the complete traverse of the loop entering and exiting the site. There may be a problem with respect to the turning of emergency vehicles . in the proposed 60 foot diameter cul-de-sac at the far west end of the property. This should be submitted to the fire department for their con- sideration with respect to the design of that turn-around area. There is adequate space on the site at 15,000 square feet per unit to provide a larger turn-around if that is necessary for the turning of a fire control vehicle. The plans indicate a 12 foot change in grade along the south line of the property near Lexington Avenue. This is proposed to be accomplished in a 30 foot strip which will produce a slope of greater than 3 to 1. But perhaps the units on this side of the loop system should be moved further north to provide greater space for the slope, and the possible widening of the roadway to provide for two-way traffic. The list of requirements for consideration of a preliminary plan for a planned unit development includes a statement regarding the market analysis and staging of the project. We have suggested to the applicant that he prepare such a statement for the planning commission's consideration. The applicant has told us that they have several of the units presold which, of course, speaks well for the market potential. The commission may wish to question the applicant regarding these considerations at the meeting. In general, it would appear that the plan has a potential for being a successful development, subject to the adjustment of some details noted. Having discussed the requirements for consideration of approval of a pre- liminary plan for a planned unit development with the applicant and his . architect, perhaps sufficient detail will be provided as of the time of time of the hearing to a11ow for the commission's consideration of a decision. The key ingredient for the consideration of a Wetlands permit is the solution to the drainage system proposed particularly as it relates to the handling of the ponding area and the run-off into the ravine on the west side of the property. The property in question has been zoned R3, multiple family re� since the initial planning and zoning of the City of Mendota f of 1962. Portions of the land on the east side of the propert� been taken for widening of the right of way for 35E now under c idence district eights program have recently onstruction. The remaining land is proposed to be developed by its owner wi h three structures with living units at three levels and parking,at th basement level. These concept plans have been prepared by the owners a chitect for the purpose of determining the amount of fill that might b needed on the site to enhance its development potential. � Each of you has a copy of a preliminary grading plan prepared y Ron Krueger Associates, Inc. The plans do not indicate the volume of fill to be de- posited on the site. We have not reviewed this concept grading plan with the owner r his consultants. Today we contacted Krueger and Associates and ob ained the following information: a. Without adding the berms as indicated on the grading p an, the grading of the site will balance with a total of approximately 1500 cubic yards of excess material. b. The berms as indicated on the grading plan would requi of 9,500 cubic yards. . ' c. Thus, to accomodate the final site grading as indicate plan a total of 8,000 cubic yards could be accomodate 2. Thus it would appear that to grade the property as proposed in plan submitted, a total of 8,000 yards could be accomodated fo of completing the berm plan as drawn. In any case, it would be no�mal to approve the development plan, which would thus verify the location and the extent of the berms proposed. � It is likely that the development of berms on the property particularly along the interstate freeway right-of-way would be helpful in enhancing the ultimate quality of the project. Thus, it is theoretically possible'to deposit the 8,000 cubic yards at an appropriate location with this intention in mind. This should only be done however if appropriate measures are detailed and approved with respect to provisions made to control erosion and protect the surface of the raw earth resulting from the deposit of the fill. Not knowing how long the stockpile of fill material may be in existance prior to development, it would be important in our opinion to provide for ground cover that would contribute to the control of erosion and excessive growth of weeds. What is thus needed then, is a plan showing the location of the stockpiles, and a delineation of the erosion control methods and ground cover proposed. The staff will contact the owner advising him of our concerns. Perhaps he can provide additional inforr,►ation at the hearing that will provide answers to these questions. ' � �Y 9, 1983 Mendota Heights Planning Corrmtssion and City Council Members Dear Sirs: I am applying for a variance because I wish to build a screened-in, roofed deck extending 12 feet from the rear of m�y home. The problem is that rr�y house is 30 feet from the rear lot line and to build an attached structure wr�uld shorten that distance to 18 feet. N�y understanding is that a distance of 30 feet must be maintained fY�om the rear lot line to any structure attached to rr�y home. When you look at the sketch showing rr�y lot and the adjacent lots, you can see that I have another alternative; the front yard. I would not want to build on to the front of rr�y house because of the noise and heavy traffic ftha.t currently exists on Dodd Road, also I ha.ve no existing doorway or entrance fY�om the front, other than a side door facing the south. This would pose�add- itional problems as well as additional costs for rqyself. Fiowever, rr�y main con- cern would be privacy and the amount of road noise. On the other hand, build- ing this structure in �y backyard would definitley be a better approach, as a sliding glass door exists for an entrance and would provide for more privacy not to mention added value to rqy home. � I am convinced tha.t �y plan to build this structure in rr�y backyard would not in anyway har�rn or reduce in value any of �y neighbors property. Attached is a copy of a site plan indicating a location of the house�on their property at 1395 Dodd Road. You will notice th is set back substantially from Dodd Road a distance greater th on either side. llmeier's the home the hoMes The Bollmeiers desire to attach a screened roofed porch to the rear of their house which is set back 30 feet from the rear property 1'ne. The zoning ordinance requires a 30 foot rear yard within which acc ssory structures can be placed, but not the home itself, ; You will notice that due to the location of the garage on the outh side of the house, that there is really no place to add a screen po ch other than in the rear yard. They propose to build a porch 12 feet by 14 feet, which places the back of the porch 18 feet from the rear property line. Thus, they re requesting a variance of 12 feet to provide for this construction. Ordir,arily, a 30 foot rear yard is desirable, and in most case represents no problem on a typical lot. In most cases such a rear yard i opposite an adjacent rear yard. In this case, you will note that there is a sub- stantial distance (60 feet) to the nearest house to the west o the Bollmeier property (Stelter's house). The Stelters have two sheds that re contiguous to the rear lot line of the Bollmeier's property. Under these conditions it would appear that the proposed locat�on for _the porch is reasonable. Berg Public Works Director and Code Enforcement Officer SUBJECT: CAO Case No. 83-02, Shaughnessy, Application for Variance in Critical Area Mr. Gerald Shaughnessy and his contractor Richard Bjorklund, were in to meet with Howard and staff regarding construction of a single family home on _ Lot 12, Block l, Valley View Oak (Dr. Leo Culligan plat). This entire addition is within the Critical River Ordinance review area and all building permits need Critical Area Ordinance reviews. Mr. Shaughnessy.'s lot has the 40% slope area encompassing a majority of his lot and it would be a hardship to construct a home on the lot in compliance with the required 40 foot setback to the 40% slopes. Staff has reviewed Mr. Shaughnessy's plan and finds his request of a 22 foot variance to the rear setback reasonable. We have examined the plans, and it would appear that the location proposed is the only place in which to attach a g rage to this residence. � The homes in this area are set back from the property line app oximately 59 feet. If the garage is constructed 26 feet in depth (to co pensate for its narrow width) the garage will extend 6 feet beyond the exi ting front of the house. This will require a variance of 6 feet inasmuch as where all the homes are set back a distance greater than the required mi imum 30 feet, this establishes the required setback line in accordance with he zoning ordinance. The garage would thus extend approximately the same distance i to the front yard as the front stoop. It would appear that this minimum in rusion in this very deep front yard would not create an adverse esthetic cond'tion in the neighborhood. We examined the possiblity of pushing the garage further back street, thus avoiding the front yard variance. As it is,the p will cover half of the north side of the screen porch which is the northwest corner of the house. Among the topics cove the meeting was the above noted study and its relationship to the con: a new fire station. The officers and I plan to be present on June 7, part in the public hearing scheduled for the study. I t ink it goes without saying that we are a civic minded organization. If we were no , we would not be serving our community as their f ire department. We are continually planning and training for the future of our department. We support fully any effor the City makes to improve life in our community. I understand that they attended about 15 long meetings over a period of one year. I also understand that four of the five members joined in the majority r port which recommended to the City Council that a new station should be located o Dodd Road, south of TH 110. It is my personal opinion as your Fire Chief, and th opinion of all my officers, that the majority report you received several years a o is correct as to the location of a new station. I therefore recommend to the Cit Council and City Administrator that the subject of the location of the new f ire st tion be removed from the study of developing a commercial district in the TH 1 91110 area. Locating a new station at Freeway Road or on the property owned by the City east of the new TH 149 in Friendly Hills would greatly impair the operation of the depart- ment. When we look at a map of Mendota Heights, it appears as a large right angled triangle. At the north end of the hypotenuse, we f ind the greatest de sity of older homes, which are occupied mostly by older citizens. These homes and c�tizens are more susceptible to emergencies than the newer homes and younger citiz ns located south of this area. At the south end of the hypotenuse, we find the g eatest density of high-value property. The continued construction of large, commerci 1 structures in this area place additional demands on the department for quick and eliable response to alarms. Locating the new station near the site of the present stat on places it Page Two about equal distance from the two areas noted above. More important than mid-point location is the fact that fifteen of the thirty firefighters live within one-half mile of this location. Equally important is the fact that we have a direct access to both north/south and east/west arterial roads. Location of a station on Freeway Road would increase the distance to the station for the f irefighters who usually drive the trucks by about one-half mile. It would also increase the response time to the Industrial area by several minutes. Construction of a station on Freeway Road before the proposed road and bridge is completed would cause a very serious response problem for the firefighters on their way to the station. A study several years ago showed that the signals at TH 110/149 are red on ��149 about 75% of the time. This could cause a delay of one to two minutes in getting to the trucks. I am now in the second year as Chief of the f ire department. I have enjoyed the support of the Council, Administrator, officers and men that serve under me. Through the cooperation of all, we have been able to upgrade our equipment, improve our training program, improve the morale of the men and the over-all operation of the department. The major remaining problem is the outdated and inadequate station. At the present time, 12 members of the department have completed or are about to complete the 72 hour Dakota County Vo-Tech Firef ighter I course. This training was received by attending classes at other Dakota County f ire departments. Due to the inadequate conditions of our station, we could not, nor would not, invite the instructors to hold classes at our station. I do not think it would be unfair to state that we are operating in the poorest f ire station facility in Dakota County, if not in the Metro area. In order to maintain the present morale and to continue to improve the service of this department, I am asking that the Council begin NOW to select the site for the new fire station. We have been talking about a new station for three or four years with little or not progress toward the goal. Now is the time to show your full support of the department by going forward with the building of the station in the area that,we have requested. Continued lack of any progress for this project can only.have a negative affect on the department. The Mendota Heights Fire Department has served the citizens of this community for well over thirty years. During this period of time, the department has saved the taxpayers millions of dollars by providing low cost fire protection. Mendota Heights enjoys one of the lowest tax rates in the Metro area. One reason the rate is low is the operation of our department on a budget of less than'$75,000. A paid department would cost the taxpayers about $750,000 per year. Several times a year we hear words of praise for the job we are doing in providing the City with fire protection. The words are well received, but they do little to help the operation of a good fire department. What we really need from the Council is a modern, well-designed f ire station on Dodd Road. We need it NOW. Dear Mr. Dahlgren: I have looked again at the newspaper article wh appeared on Wednesday, February 9 regarding "downtown Me Heights." It appears that at some time this spring, the plans to hold hearings on matters related to the highway and 110 intersection. However, it is not entirely clear what this hearing is going to address. In the referenced newspaper article, you ar quoted as saying that the City owns parcels of land east of the shopping center and others east of Dodd Rodd and north of 110. Could you please identify these parcels on some plat or map. 2. The article indicates that you said the par el on the north of 110 would be excellent for a semi-c'rcle approach to the highway of a bridge over 110 at Dod Road. Could you please tell us what kind of bridge that it would be,,i.e. pedestrian, vehicle, etc. 3. You were quoted as saying that you had meet'ng with some of the principal landowners in the area. Could you please identify�which landowners you have conferred with, whether or not you have conferred w'th the owners of any residential properties; and becau e I believe the Dodge Foundation may be the largest landowner adjacent to highways 110 and 149, have yo talked with them. 4. You are quoted as saying that you met with the highway department and "viewed.some of the safe hazards that exist in Mendota Heights due to the gr going east on 110 and going west at Dodd Road." The article also indicated that Mendakota Country Club has indicated interest in using some of the land contiguous to highway 110 for development, and that this land could be replaced by land on the south of the club. Is there some way you could describe what land contiguous to 110 is being referred to and a 1 so what land is being referred to on the south side of the club. We are also interested in learning from you or from the City Council just what source of funds the City has in mind for acquiring any of the 149 right of way or the shopping center site. The normal leave requ rement is three to six months. The agency has however, because of the nature f my job, agreed to reduce the leave requirement to one month. By this memo I am requesting that you grant me a one month leave o absence in accordance with the provisions of the personnel resolution. The agency will call us, tomorrow or a year from tomorrow', to t 11 us that we may pick up our baby the following day. Swanson City Clerk SUBJECT: Unauthorized Property Divisions Legislation adopted in 1982, provides that the municipalities right to restrict the County Auditor from accepting a conveyance f or division of land if the provisionsof the municipal subdivision have not been met. In order to place such restriction on the Audi ice, the City Council must, by resolution, choose to be governed b statute provisions. While incidents involving the recording of unauthorized lot di only occur sporadically, perhaps five or six a year, it never fails least one or two either create significant problems or result in lo do not meet ordinance requirements. Such unauthorized splits have in numerous pieces of correspondence with the past County Recorder staff and the City Attorney. In the past however, the Auditor has impowered to refuse to accept a conveyance. As Norma Marsh, Deputy indicated to me recently, the restriction will probably result in s nasty complaints from property owners each year. I believe that ha such calls would be far less unpleasant than dealing with the probl by unauthorized splits.
