FIRE RUNS
The department made eight runs during the month� None of the calls were for structural
fires. The year total for structual loss remains at a very low $200. On April 16th at
2239 hours the department was called to Hiway 13 between Lexington Ave and Mendota for
a r.escue call. The incident was a head-on crash between a pick up truck and a small.
sedan. The department's rescue equipment was used to extricate the fatal victim. Fire-
fighters also assisted in the care of the injuried St. Paul police officer who was driv-
ing the pick-up truck.
'MONTHLY TRAINING
The regualr two hour session was used to drill on the long ladders. Three pumpers were
taken to the Johnson Warehouse on Pilot Knob Road, the structure was used in the ladder
drill. Firefighters drilled on advancing hoses and equipment up the ladders as well
as working off the ladders. The building is about 26' high.
The department sent men to two special drills during the month. One was a mutual aid
drill at Woodbury and the other was at the Ashland Oil Refinery. The Ashland drill was
working with gasoline fires. Four men completed the Firefighter I at Vo-Tech, the eight
others who started in the second group are continuing with the training.

Please voice your opposition also to the PELRA bill. The house bill
allo�rs for sympati�y atri�Qa, all but eliminates supervisory employees,
includes those employees Who work over 67 days annually as eligible for
collective bargaining and provides for PELRA to override city charters.
The senate veraion is slightly less offensive to the cities but you
should urge the legislature to reject all oP the amendments to the
PELRA billo
There is still time, but only a few d�ys , to contact legislators
on these bills. Keep in mind, ve vron't have another chance to voi�a ou:°
opinions on money bills uatil 1985.

The regular meeting of the Mendota Heights Park and Recreation Comm'ssion was
called to order at 7:00 P.M. by Chairperson Bayless. Members present w re Bayless,
Stein, McM onigal, Knittig, Schneeman and Doffing. Also present was Rud Literski.
Maintenance Report - Rudy Literski announced that he is retiring after 4 years with
the Mendota Heights Public Works department. His duties will be assume by Terry
Blum. Literski suggested that the commission consider the Rogers Lake rea as a
possible site for tree planting if trees are received in the settlement with Mr.
Dalglish. There will be a June lst retirement party for Rudy Literski.
Park Surveys Continued - Schneeman asked that the bridge in Wentworth P rk be
looked at in terms of repair. Doffing said that the Friendly Hills Par needs a
ditch cleaned out and several boards in the rink replaced.
Tot Lot - Bayl.ess reported that the City Atorney has researched the sta�
Friendly Hills Tot Lot and found it to be City property. Stein express�
belief that under the circumstances, the present covenant dictating pre;
of the land could be overturned by the courts. The commission agreed tl

need for change other than avoiding a liability problem with the play e�

Trails Committee - Doffing reported that he presented the proposal for trails
survey by MidContinent Surveys at the May 3 City Council meeting. They rejected
the $5,965.00 proposal, but would f inance a survey by the Commission co ting
$300 - $400.
Council Meeting - Bayless will attend the May 17 City Council meeting.
The next meeting of the Park Commission will be June 14 at 7:00 P.�. It
was moved and seconded that the meeting be adjourned.

was called to order at 8:00 P.M. by Chairperson Daffing. Members pres

Daffing reviewed the progress of the Trails Committee to bring ev eyane
up-to-date. As was told ta the Park and itecreation Commission, the Ci y Council
turned down the request far $5,965.Q0 ta finance a trails survey by Mi ConCinent
Surveys. Doffing felt the Gouncil was receptive to the idea of a surv y, but not
the expense. The Council suggested that the committee conduct its own survey,
costing $340-$40Q.
The Committee discussed the possibiliCy of conducting its own sur ey, con-
cluding that the Council's approval and support was essential if such a project
is undertaken.
Stein moved that three members draft a proposed survey
cammittee and approved by the Cauncil. Seconded and passed.

SUBJECT: Richard Einck, Dodd Construction - Conditional Use Permit
Case No. 83-16
Richard Einck of Dodd Construction, Inc. has made an application for a
variance, Conditional Use Permit for a Planned Unit Development, Wetlands
Permit and River Corridor Critical Area review. The property is located
contiguous to and south of Lilydale's Lexington Court development which
are also townhouses. This piece of land is 8.99 acres which does not
meet the minimun 10 acre requirement for a Planned Unit Development. It
has been determined in the past by the City Attorney that the first action
to take in this type of proposal is to consider the variance to the minimum
10 acre requirement. Staff feels that this land being contiguous to a
similar type of development could be viewed as an extension of that and
therefore we would recommend granting the variance. That would allow the
developer to present his plans at a public hearing to gain input from the
affected contiguous land owners. Subject to favorable Planning Commission
action tonight on the variance a public hearing could be considered for
the May Planning Commission meeting.

COMMISSION BUDGET AND AUTHORIZING TRANSFER OF FUNDS
WHEREAS, the City of Mendota Heights, by its approval and executi n of a
Joint Powers Agreement, became a member of the Northern Dakota County able
Communications Commission (NDC4); and
WHEREAS, as a member of the NDC4, the City recognizes its obligat on under
the agreement to review and approve the annual Commission budget and t contribute
its equivalent assessment to support said budget; and
WHEREAS, the City Counc3.1 of the City of Mendota Heights has rece ved and
reviewed the proposed NDC4 1983 budget totalling $20,5001•

of $2,280 as its proportionate assessment to support the NDC4 budget; nd
BE IT FURTHER RESOL VED that a transfer of $2,280 from the General Fund to the
Cable Television Franchise Fund will be made after notification of fin 1 approval

SUBJECT: Proposed Resolution for Final Approval of Linvill Associates
Industrial Revenue Financing
Attached hereto is a resolution for the City Council which gives f nal
approval to the Pilot Knob Associates Industrial Revenue. Similar to t e Mendota Heights
Business Center project, this issue is a conventional bond issue, with ecurity in
the form of a letter of credit from the First Bank Southdale. Juran an Moody is
also the Underwriter on this issue.
The project was approved by the State of Minnesota Department of C�mmerce on
April 18, 1983.
Roger Gordon and myself have reviewed the documents which are bein approved
by this resolution, and find them in proper order and consistent with t e City

"Guaranty"). To further secure payment of the Bonds and up to
285 days' interest thereon, First Southdale National Bank of
- Edina, in Edina, Minnesota (the "Bank") will issue its
Irrevocable Letter of Credit dated as of May l, 1983 (the
. "Letter of Credit") and the Company and the Bank wi.11 enter
into a Letter of Credit Reimbursement Agreement dated as of May
1, 1983 (the "Reimbursement Agreement").

it is hereby found, determined and declared that:
(a) the Project described in the Loan
Agreement and Indenture referred to above
constitutes a Project authorized by the Act;
(b) the purpose of the Project is and
effect thereof will be to promote the puhlic
welfare by the acquisition, construction and
equipping of a facility for use as an
office/service facility;
(c) the Project is to be located within
City limits, at a site which is easily accessi
to employees residing within the City and the
surrounding communities;
(d) the acqu-isition, construction and
installation of the Project, the issuance and
of the Bonds, the execution and delivery by th

the performance of all covenants and agreement

respect to the Project Premises and payable during
the term of the Mortgage, Loan Agreement and
Indenture;
(h) under the provisions of �linnesota
Statutes, Section 474.10, and as provided in the
Loan Agreement and Indenture, the Bonds are not to
be payable from or charged upon any £unds other
than the revenue pledged to the payment thereof;
the City is not subject to any liability thereon;
no holder of any Bonds shall ever have the right
` to commel any exercise by the City of its taxing
powers to pay any of the Bonds or the interest or
premium thereon, or to enforce payment thereof
against any property of the City except the
interests of the City in the Loan Agreement which
have been assigned to the Trustee under the
-..-- Indenture; the Bonds shall not constitute a
charge, lien or encumbrance, legal or equitable
upon any property of the City except the interests
of tne City in the Loan Agreement which have been

Bonds shall recite that the Bonds are issued
without moral obligation on the part of the state
or its political subdivisions, and that the Bonds,

Streets, is termed "off system" funding. In an attached letter f om Elmer
Morris, District 9 State Aid Engineer, he explains that in his opinion "off
system" funding is not to be used to subsidize the State Road Sys em but
rather may be used to provide a part or all of "local share" funding. Such
local share items would include a portion of a signal system, sid wal,.ks,
roadway widening, storm sewers and others, where Mn/DOT and a municipality
are involved in a joint venture project. I
Where state aid funds are used to finance a municipality's portion of
an 'Soff system" project, the amount of funds used will then be ann ally de-
ducted from the municipality's "construction needs" for a period o 10 years.
The annual apportionment of state aid funds is based - 50 per ent on
population needs and 50 percent on construction needs for those stjreets de-
signated as part of the uncompleted state aid street system in thelCity.
The 1982 "needs" report indicated that construction needs for Mendota
Heights amounted to approximately $4,000,000.00. Based on population and
construction needs, Mendota Heights receives an annual alotment of approxi-
mately $175,000.00.
The use of State Aid Funds for an "off system" project penalizes a
municipality reducing future state aid allotments for the following ten (10)
years.
Another facet in the use of State Aid Funds is that they must be used
regularly. Accumulation of funds is discouraged through a regulation which
limits the banking of funds to two (2) years, otherwise future alotments may
be reduced or discontinued.
Delayed upgrading of State Aid Streets often leads to construction pro-
blems where residential development accurs resulting in a lack of uniformity
in setting building elevations, establishing lawn and driveway elevations,
changes in drainage and so forth. Example, Marie Avenue between Lexington
and Victoria. This is an ideal time to complete Huber Drive defore develop-
ment takes place. It is also ideal in preparation for the southerly extension
of Huber Drive to Mendota Heights Road, a portion of which will be constructed
by Mn/DOT in 1984.
Based on discussion with Mn/DOT personnel, any possible construction
of Highway 149 through "Downtown hlendota Heights" is several years away, in
fact the District 9 Engineer stated that if money were "in the bank", 1986
is the earliest it could be constructed and any negative comments from the
Environmental Impact Statement/Environmental Assessment or other approvals
could further add to a delay. Should a cooperative project develope, the use
of State Aid Funds for "off system" improvements can be determined at that time.
Based on the above comments, Staff requests the approval of Huber Drive
plans and specifications and the direction to advertise for Bids at 10:30 A.M.
on June 20, 1983.

Rudy Literski will be retiring on May 31, 1983 after 14 years� with
the City of Mendota Heights. We will be having a lunch in his hon�or on
Wednesday, June 1, 1983 at 12:00 in the City Council Chambers.

RESOLUTION COMMENDING RUDOLPH T. LITERSKI
FOR MUNICIPAL SERVICE
WHEREAS, Rudolph T. Literski was hired by Mendota Heights to
the Street Department on April 15, 1969; and
WHEREAS, Rudy transfered from the Street Department to the P
partment in 1974; and ,
WHEREAS, in 1976 he was appointed as Park Leadman and has se�

NOW THEREFORE BE IT RESOLVED, that the Mendota Heights City ouncil
members commend Rudolph T. Literski for his 14 years of faithful ervice

BE IT FURTHER RESOLVED that the City Council express it sinci
preciation to Rudy for the conscientious manner in which he perfoi
