COMMISSION Mayor Lockwood advised the Council members that he has had
APPOINTMENTS no contact with the Planning Commission members whose terms
will expire on January 31, that he would recommend Dorothy
McMonigal to be reappointed to the Park Commission, and
that Park Commission member Gary Gustafson has indicated that
he would not be interested in reappointment to the Park.
Commission. Mayor Lockwood asked members of the Council to
submit names for appointment to the two commissions.
FIRE EQUIPMENT The Council acknowledged and discussed a memo from Fire
Marshall Gene I.ange requesting authorization for the rebuildin�
of fire pumper No. 2286 (Squrt). It was noted that the
estimated $2500 rebuilding cost would include the removal of
two booster line reels&replacement of those reels with pre-
connected hose lays, along with incidental remodeling in the
body of the pumper ta accommodate rhe changes.
After a brieF discussion, Councilman Mertensotto moved to

authorize the Fire Department to expend $2500 for repair and
remodeling of pumper No. 2286, the expenditur should be made
through the Equipment Certificate fund.

LEGISLATIVE CONFERENCE City Administrator Johnson recommended that t e Council appoint
a voting delegate to the LMC�Legislative meet ng to be held
on January 26, l
Councilman Mertensotto moved that Councilwoma Witt be desig-
nated as the City's voting delegate to the Le gue of Minnesota
Cities Legislative Conference, and that City lerk Swanson be
appointed as alternate delegate.

HEARING-LINVILL Mayor Lockwood called the meeting to order fo the purpose of
ASSOCIATES INDUSTRIAL a public hearing on a proposal bq Linvill Ass ciates for a
REVENUE FINANCING commercial facility development project.
Mr. Ralph Linvill, representing Linvill Assoc ates, advised
the Council that he proposes to construct an ffice/warehouse
structure on a site located on the west side f Pilot Knob
Road, south of Mendota Heights Road, and nort easterly of the
Cray Research facility. He gave the Council ackground infor-
mation on his firm and showed pictures of var ous facilities
which he had constructed for a similar use. r. Linvill
advised that most of the renters of his other facilities are
small, technology oriented firms. He estimat d that:approx-
imately 220 people would be employed in the f cility. Mr.
Linvill showed the Council a"footprint" of t e build.ing, and
indicated that soil borings and a topographic survey had been
completed and that the structure is now in ar hitecture. He
stated that the proposed structure will front on Pilot Knob
Road and will be finished on all sides,-perha s with break-off
block or break-off block and stucco or decora or block. The
project is proposed to consist of 40% office pace and 60%
warehouse space. He advised thatthere will b no retail sales
out of the structure and that he and his firm and clients, will
not ask for any variances to allow retail at ny time in the
future.
C Mr. Linvill responded that at this point he i not sure what
the total project cost will be but he indicat d th� the last
structure his firm constructed was $500,000 o er estimate.
He advised that he is asking for the 2,75 mil ion dollars so
that he does not need to come back at a futur date and request
an amendment for additional financing.
In response to a question from Councilman Mer ensotto, Treasurer
Shaughnessy advised that the application is f r mortgage type
note financing, that it meets all the City's uidelines, and

that with the use of mortgage note financing, the lender wili
protect both itself and the City. He indi.cated that he had
encouraged the applicant to request an amount high enough so
that a second issue would not be necessary in the future.

Public Works Director Danielson gave the Council and audience
a brief history.of the pxoposed pra,ject. He stated that the
praject wauld include extension of pubZic utili�ies to serve
the Mn/DOT Garage in �he westerly gart of the City, off af
Filot Knab Road below Acacia Park CemeCery,.and the MAC
praperty. He advised that the project was p�titioned by Mn/DOT.
He described the area which wauld receive the publi.c i.mprave-
ments, along w.ith a description af the raute that the sanitary
sewer main lznes would foll.ow, He further advised that the
LeMay Avenue right-of-way shown an the feasibility study
drawings will be dedicated b�y Mn/DOT and wi�l be paved, with
concrete curb and gutter, as part of the improvement project.
He further advised that the streets and the storm sewer system
would be constructed on].y to serve the Mn/DOT facility. He
stated that the assessments which will accrue to the MnfDOT
property will be recammended Co be assessed, but that staff
would recommend that the section of utila.ty impravements from

foot rates assessed over the past three years, of $I8.00 per

that the balance af the project cost be borne by the Water
Revenue Fund.
Mr, Danielson sta�ed that .if the Wagon Wtteel Trai1 graject is

a 19 year period at 10% interest on the unpaid balance. He

been distributed at the last CiCy Cauncil meeting, and further

Mr. Dick Bebel, 1011 Wagon Wheel Trail, asked why the entire
Mendota Heights Road praject is proposed to be borne by the
Water Revenue Fund when only a partion af the Wagon Wheel
Trail project is to be �reated in this manner. He also asked
why the watermairi was nat complete.Iyconstructed alang Wagon
Whee1 Trail at the time por�ions of �he system were constructed.
He felt that he would be receiving no benefit fram the system
since he has a well, and does not feel that he shauld have to
pay approximately $4,40Q in assessments f ar the wa�ermain.
He suggested that if the City wants the �atermain extension,
a larger share of the cost should be borne by the City arid
that the affected praperty owners should nat be assessed so high.
Tn response ta a questian from Mr. Bebel, Public Works Director
Danielson stated that the watar services would be installed
by the St. Paul Water Department as requested; and are
anticipated to cost approx�ma.tely $2,OQ0 each, in addition to
the propased assessment.
Mrs. Donna Andersan, 994 Wagon Wheel TraiZ, stated.that at the
time they purchased their hame, the prior owner advised them
that the water line was installed at the same time the sewar
was connected. She ask�d whether the cost for ins�alling the
service would be less than $2,OOQ cansidering the iact that
the pipe had already been laid.
City Engineer Kishel rerninded the Council and audience that the

Mr. Carmen Tuminelly was present to request a proval of the
final plat for Tuminelly's Hunter Lane Addit3 n. Mayor Lockwood
pointed out that the plat indicates only a 25 foot right-of-way
for Tuminelly's Hunter Court, rather than the 30 feet shown on
the preli.minary plat and discussed whan the p eliminary plat
was approved. -

The Council pointed out that the proposed street name is too
lengthy for a street sign, and Mr. Tuminelly advised that�
the plat is in error and will be corrected to read "Hunter
Court".
After discussion, Councilman Losleben moved the adoption of
Resolution No. 83-08, "RESOLUTION APPROVING FINAL PLAT FOR
TUMINELLY'S HUNTER LANE",ADDITION," conditioned upon a plat
correction on the street name and the conditions stated in
the developer's agreement.

COMMUNICATIONS The Council acknowledged receipt of a letter from 5tate Repres-
entatives McKasy and Seaberg inviting Council suggestions for
potential legislation along with a listing of Legislative
, Committee Assignments for the House of Representatives. The
Council also acknowledged receipt of a LMC Legislative
Conference agenda. .
CABLE COMMISSION Councilwoman Witt reported on NDC4 activities. Attorney Tom-
Hart reported on a recent.meeting of city attorneys represent-

MISCELLANEOUS Councilma.n..Losleben asked whether anything could be done-to
discourage snowmobiling on the School District property and
advised the Council of a letter he had received from Mr. Paul
Rhein relative to a lost owner's duplicate certificate of title.

I/I STUDY The Council acknowledged and discussed a memo from the Public
Works Director regarding final payment to SEH for the Infil-
tration/Inflow Study costs and the status of federal and state
matching grant payments. In response to the memo, the Counci
directed staff to advise SEH to advise the Council and to rec�._.a
Council approval before proceeding with any work in response
to requests from the MPCA, MWCC or other agencies relative
to the I/I study.

Zemke then indicated that the procedure for RFP consideration and approval would
be on a section by section basis. A short discussion was followed by a consensus
decision to proceed on a section by section basis.

Lanegran moved to amend the Introduction, seconded by Witt, to add from the
Joint Powers Agreement, 9-Section II, motion carried unanimously.

Kinney moved to accept the Application Instructions, seconded by Baird, motion

Information Requested of Applicants
Nelsene Karns indicated that Group W would like to see the 2 year guaranteed
rate requirement removed because of the difficulty in forcas�ing.
Following a short discussion Tatone moved that Information Requested of Applicants
be accepted as written. Seconded by Henderson, motion carried unanimously.
Procedures
On page 11, the technical consultant needs from each of the cities costs incurred
by the cities and anticipated costs for 1983 (mostly attorneys fees). Do not
include money each city contributed to the Commission. Mail to the City of
Mendota Heights for Dave Zemke.

Several commission members expressed their opinions, with
Blesener wanting a general discussion on down-zoning and
mixed use. Morson noted that he did not think this site
should be a commercial site. Chairperson Kruse stated that
staff will come back with a proposed zoning ordinance at the
February meeting and also with some typical ordinances from
other cities. �he Commission could take a look at these
and probably set a public hearing on this application for
the March meeting. There was some question as to whether
this should be done at a work meeting or at the end of the
February agenda.
Chairperson Kruse noted to the applicant that just because
he voted in favor of the motion tonight, that did not
necessarily mean that he would vote in favor of a zoning
ordinance amendment to allow this proposed project.
CASE 83-02, Mr. Lawrence Culligan was present to explain his request, stating
CULLIGAN, that he plans to develop nine lots on 7.3 acres on the north-
SUBDIVISION AND west corner of Glenhill Road and TA 110. These lots are in
CRITICAL AREA the Critical River Area corridor and will also need site plan
SITE PLAN REVIEW approval. Each of the lots exceeds the 15,000 square foot
lot minimum area and conforms to other development requirements
of the City. A sanitary sewer easement is planned to accommodate
Lots 1 and 2.
After further discussion, Butler moved, seconded by Stefani
to set a public hearing for February 22nd to consider
preliminary plat approval and critical areasite plan approval.
Voting: all ayes.
CASE 83-03, Mr. and Mrs Herb Dalglish, 1054 Sibley Memorial Highway, were
DALGLISH, SUB- present to explain their application. Mr. Dalglish noted that

too small for the family. They are proposing to build a
larger home on their present property. He noted that there
are 60 feet between their property line and their neighbor's
property line. The existing lot has some slopes on it that
are unusable as yard space and one of the new lots will need
a variance to area and frontage, as it will•contain only
13,300 square feet This land is also in the Critical River
Area corridor so when a new home is contructed on the proposed
new lot, it would have to undergo critical area approval.
Because this property is metes and bounds, the division of this
should be processed as a preliminary plat, rather than as a
lot division.
After a brief discussion, Butler moved, seconded by Morson, to
set a public hearing for preliminary plat approvll for rebruary
22nd. Voting: all ayes.

As you will recall from our discussion at the beqinning of your 23
1982 Special�Meeting, we continue to be concerned about several as
the airport safety zoning process. At the 4 November meeting of t
Airport Safety Zoning Board, I presented exhibits and testified on
of the City of Mendota Heights. Since that time there have been a
of important;developments and I believe an update is in order.
First of all; the Joint Zoning Board seems to have been convinced t
proposed regulations are too strict to be adopted without placing a
unreasonable�(and I would submit unnecessary) burden on the local 1
owners and cities. Since hearing the concerns which have been expr
by all of the cities abutting the airport, but, particularly Mendot
Heights and Eagan, the Board has considered a number of alternative
make the rules less severe.

Most of the alternatives for reducing the negative impact of the sa
zoning have involved a reduction in the size (length) of the A and

29R zones, since they currently stop at 8,200 feet. However, this
alternative would free up several valuable parcels currently covered by
the 29L B Zone.
The r4n/DOT suggestion for a terminus of the safety zones was the right-of-
way for realigned Trunk Highway 13. This line is shown on the attached
exhibit and the land which it would take out of the B Zone is shaded. In
summary, neither of the two proposed limits significantly improve the future
fortunes of the P�IAC property, but, they both greatly improve the development
potential of the area off the end of 29L in both Mendota Heights and Eagan.
It is interesting to note that the Joint Zoning Board invited a pilot to
discuss safety considerations at their most recent meeting. According to
the pilot, the Mississippi/Minnesota River bluff line is the real line in
this area. Furthermore, he stated that as long as the development met the
height requirements, he was unconcerned about density. It would appear that
the folks from Mn/DOT are leaning on an old zoning practice, that being the
use of a natural or man-made barrier to provide a zoning line. The river
bluff line might be a bit more complicated to define, but it is every bit as
logical. If density does not concern the people who fly the planes, why
shouldn't the MAC property also be developed to a reasonable density? It
seems, like to many previous decisions, that this one is convenient but no
less arbitrary.
I have included a copy of Joint Zoning Board Chairman John Voss's letter to
James Fortman, Direction, AirPort Section of the Mn/DOT Aeronautics
Division. In his letter John recommends that D4n/DOT amend its rules to
establish the 8,000 maximum length. He recommends against a law change.
Although I basically support what John and the Board are trying to
accomplish, I disagree with this decision. 4Jhile I agree that the specific
law he was reacting to was not a good one, I think the option of passing
a law to amend the rules ma_y be the best available option.
There are only two ways to change these proposed rules. The first is for
the Legislature to pass a law amending them. The second would be for
Mn/DOT to change their rules administratively. In either case, the rules
would then serve as the basis for an ordinance which would have to be
adopted and implemented by the Joint Zoning Board. My reason for choosing
the former approach is because the latter (Mn/DOT administrative amendment)
will surely take at least a year. And frankly, given their conspicuous
lack of understanding of land development, planning, and zoning, I am
very concerned about what other sorts of problems might arise through this �
process. `

I feel there has been sufficient factual evidence assembled both t
the Amcon Development vs. the City of Eagan�trial and the Joint 70
Board's process, to clearly show that the current Mn/DOT rules are
on.arbitrary assumptions and even then fail to accomplish their pu
and intent. With the recent opening of I-494, interest in the lan
within this area has been heightened. The level of competition am
throughout the Metropolitan Area for quality commercial and indust
developmentiis steadily increasing. It would be most unfortunate
the future of this area in limbo for a year, if it could be resolv
in the legislative session with some initiative, and a strong well
organized amendment. ,
Before closing I think it is important to recognize one more import
aspect of this complicated matter. That is that although Eagan an�
Heights have cooperated on many important related items in the past
two cities are in vastly different positions on the subject of air�
zoning. Eagan denied Amcon's proposal based on (among other thing:
inconsistenc;ies with these rules, even before they were adopted in
ordinance. �Consequently, Eagan is not in a position to propose th�
solution.
My recommendation based on all of the above, it to contact the sena
represents the Mendota Heights area and urge hi.m to sponsor a bill
the Mn/DOT rules. I am available to answer questions regarding th�

While �ve agree that the recognition of the validity of existing ap roved
� comprehensive plans is a positive step, we feel that setting up th special use
permit procedure only serves to add one more layer of bureaucracy. Such a
layer is unnecessary because the Board of AdJustment and its varia ce procedure
is designed;to accomplish the same purpose. -
We appreciate your effort to modify the negative impacts of the mi imum
standards, however we have d'etermined that'the proposed change wou d not
significantly help us in modifying the development �.mpacts on the
municip�lities surrounding Wold-Chamberlain Field. ,

Rather than�trying to make a law change, we encourage you to amend the rules to
limit the total length of the safety zones to a maximum of 8,000 f et. This
would greatly reduce the development impacts�on the municipalities near
IYold-Chamberlain Field. At the same time, we believe that such a aximum would
provide forjthe margins of safety that need to be maintained.

necessary to cross under the P'lilwaukee Railroad tracks with both H

In early December, we requested permission to cross the right of �
and just recently received two sets of Pipe Line Agreement documer
which are to be endorsed and returned to the railroad for further
action. ;
As a part of entering into the agreement, two stipulations have be
made. One,jthat the City must pay a$150.00 preparation fee. Two
that the City must pay a$1,500.00 consideration fee.
We do not have much choice in the matter. These costs will be ap�
to the total cost of the project and will be assessed.

ST. PAUL AND PACIFIC RAILROAD TRACKS
WHEREAS, the City of Mendota Heights is planning the construction
of water and sewer extensions to serve the Metropolitan Airports Commission
property and adjacent parcels in the vicinity of Acacia Park as part of
Improver�ent 82 Project 2; and
WHEREAS, it is deemed necessary to cross under the_Milwaukee Railroad
tracks with the proposed utilities; and
WHEREAS, the Milwaukee Railroad has submitted to Mendota Heights a
Pipe Line Agreement for endorsement; and
4JHEREAS, it has been determined that the signing of this Agreement
will not adversely effect the residents of P9endota Heights.
NOW THEREFORE IT IS HEREBY RESOLVED by the City Council of the City
of Mendota Heights that said Agreement and necessary costs are hereby
approved as proposed; and
BE IT FURTHER RESOLVED that the Mayor is hereby authorized and dir-
ected to execute said Agreement for a Pipe Line Crossing.

On October 19, 1982, the City Council conducted a feasibility hear
proposed storm sewers and street construction on htaple Park Court �
Falls First Addition. Discussion by affected property owners reve�
that three of the five owners were opposed to the proposed constru�
with the result that the Council took no action on the matter. In
course of discussion a number of Ivy Falls Addition residents, out�
bf the areaiproposed for construction, commented with respect to s�
improvements throughout.the entire subdivision. �
It was their consensus that street surfaces needed some improvemen
that they did not want curbs nor did they want storm'sewers. Afte
discussion it was requested that Staff put together a"Lesser Proj

lesser scale, but one that would give permanent streets and surfac

In the interest of maintaining a minimum type project, it is propo ed
that an average 2 inch bituminous overlay be installed,�and that d ainage
facilities be installed only to the extent necessary. Drainage fa ilities
will include a limited amount of pipe line on an easement off of M ple
Park Court and about 400 feet of pipe line on Maple Park Drive whi h is
needed to alleviate a constant ground water problem. It is also i tended
to install curb and gutter in these same areas to control the surf ce water.

As requested by interested property owners, through a program of ":
Maintenance';, it is proposed to resurface the existing payement wi
disturbing the surface and adjacent facilities except where draina�
structures and curb and gutter will be installed. No surface or si
surface correction will be done and the bituminous overlay will be
on the existing surface. Driveway approaches will be adjusted onl;
extent thatidriving surfaces will be matched.

The cost of the proposed work is estimated to be as follows:
BITUMINOUS STREET MAINTENANCE AND DRAINAGE '
The proposed work is estimated to cost $137,058.00. This includes new
�- construction, overhead items, an appraisal and previous feasibility studies.
It also includes storm sewer construction south of Maple Park Drive which
was completed in 1979 after some serious flooding.
CONCRETE CURB AND GUTTER
Proposed concrete curb and gutter, as shown on the attached drawing, is
estimated to cost $4,214.00
The total project is estimated to cost $141,272.00
It has been determined that a total of 58 parcels (lots) are affected by
the street maintenance work. It is Staff's recommendation that all parcels
be assessed equally for the proposed construction.
Only 5 lots abut the proposed curb and gutter work and in that only they
will be improved by such construction, it is suggested that these 5 lots
be assessed for this work on a front foot basis. In that each lot varies
in width, the assessment for each parcel will also vary. Attached is a
tabulation showing the added cost for each of the 5 lots involved.
So as to establish a fixed assessment for the proposed work it is suggested
that the following maximum rates be established. .
Street Maintenance = $2,385.00 per lot
Concrete Curb and Gutter = $ 8.00 per lineal foot
Assessments can be paid up in full within 30 days after formal notice, other-
wise they will be certified to the County Auditor and the amounts spread on
-• the tax rolls over 10 years with a 10 percent annual interest rate on the
unpaid balance.
It should be clearly understood that the above form of bituminous maintenance
does not conform to our usual Engineering standards. Ex:�.sting cracks and
� alligatoring in portions of the existing surface are likely to reflect through
the new surface and be a source of future maintenance. With financial limita-
tions, it is not possible to provide street surfacing that will compare with
� normal City design. One must anticipate greater than normal future deteriora-
tion if this project is constructed.
Approval of this report and the establishment of a feasibility/assessment
hearing is recommended.
