acquisitian and installatian of six Citi-Com Plus mobile radios

The Council acknowledqed a memo from Fire Marshall Gene Lange
recammending the acquisitian of three Scott Azr-Pacs and two
extra air tanks from Mid Central Fire for a purchase price af
$2,464.

COMMUNICATIONS The Council acknowledged and discussed a letter from the Leagun of
Minnesota Cities regarding �he Local Gavernment Aid distribution
formula and r�commending coaperation amongst all lacal governments
to support th� unifi�d position on LGA allocations.

League of Minnesota Cities 1983 City Policies. A inistrator

Councils prioritize the policies and submit their five most
important policies in each category to the League.

MISCELLANEOUS The Council reviewed and briefly discussed a letter from the
(" Metropolitan Area Management Association relative to the labor
` relations subsc'riber service. Administrator Johnson reviewed the
memo and noted that the City's current labor negotiator� St. Paul
Employers Association, is paid the $300 annual retainer plus costs
relating to labor negotiations. It was the concensus of the Council
that there is no reason to make a change in the present negotiation
arrangements.
MENDOTA SEWER Administrator Johnson advised the Council of several calls he has
received from Edie Lancaster of the Dakota County HRA regarding the
City of Mendota. sewer application to HUD. He advised that HUD will
grant $1,000,000 to Mendota for the sewer construction project but
that the grant is, contingent upon the Waste Control Commission
receiving favorable action on its CIP. He advised that the
Metropolitan Council will conduct a hearing on January 6th at 2:00
P.M. to consider an amendment to the Water Resources Development
Guide to accommodate construction of the sewer system along with
acquisition of part of the Mendota Heights trunk system. He
advised that Ms Lancaster has requested that an elected Mendota
Heights official be present at the meeting to support favorable
action by the Metropolitan Council.
Mayor Lockwood advised that he will contact the Mayor of Mendota to
see if he feels Mendota Heights support at the hearing would be
desireable or necessary.
CABLE COMM� �Administrator Johnson advised the Council that NDC4 Chairman Dave
UNICATION Zemke has submitted a memo to the mayors of all communities involved
in NDC4, asking that the respective City Councils authorize
their City Attorneys to review the Commission's Preliminary
Franchise Ordinance and attend a meeting to discuss the Ordinance.
In response, Councilwoman Witt briefly updated the Council on the
Commission activities and advised that any City costs incurred
because of the request approval would be reimbursable after
franchise award.
Mayor Lockwood moved to direct the City Attorney to thoroughly
review the Preliminary Franchise Ordinance and attend the meeting
to be held on January 14th.

subcontract to Reed Carpenter, in place of Ralph Camp�aell, the work of
the initial Service Territory maps.

V. Fina�ize Policy Decisions.

Anita Benda Stech distributed and discussed a memo on franchise fee use
with information regarding the need for collecting a franchise fee of 3-S�
of the franchisee's gross revenues. ( memo attached)
Baird moved from the Herbst memo of December 15, 1982 the approval of the re-
drafted item 52.Seconded by Witt. Item 52: The Grantee shall pay 5% of all
gross revenues as a franchise fee to be collected by the Commission. Until the
system is fully operative in the Initial Service Area, the Franchisee shall
annually pay to the Commission an amount equal to the actual costs of the ad-
ministration of the franchise as determined by the Commission. The amounts so
paid shall be charged against the annual franchise fee of 5� of gross annual
revenues in equal installments over -a six year period beginning with the year
beginning with the sixth anniversary of the franchise award.
Motion carried unanimously.

The commission has determined the most important elements of proposals for
a cable communications system to serve the Northern Dakota County area and
will give priority to the applicants proposal which best responds in the
following areas and priorities:
l. a system design that most easily accommodates the expansion of downstream
channel capacity to residential subscribers in the future, a line exten'sion
policy that provides service to the greatest number of people at the lowest
cost, the lowest rates for basic monthly service and installation and the
widest variety of basic and pay entertainment programming services.
2. a system with high quality of signals delivered, the shortest timetable
for constructing the initial service area and line extension area reasonable
revenue projections supported by market studies and industry experience
in similar markets, and the most extensive plans for local origination
and access programming.
3. showing that other systems owned by applicant have been upgraded in
construction, design and services, showing a capital budget that shows

At the request of your chairman,• following is inform
regarding need for collecting a franchise fee of 3-Sy �of
franchisee's gross revenues.
A conservative estimate is that a franchise fee collected in
5(five years from certification by the Minnesota Cable Comui
tions Board) would be $83,000 (3X) and $138,000 (5�C).
Attached is a list of post-franchise tasks and� responsibil
for the cities and/or Commission (distributed ,originall
System Committee in August 26, 1982 memo). In order to pe
these tasks, the Commission will likely need to employ at
one cable officer to assist the Commission and cities with
listed tasks; to serve as a liason between the Commis
councils, franchisee, cities' staffs, any non-profit corpor
that develops and the public; to provide research for
information to the councils and Commission; to 'serve
Commission staff; to monitor the franchi�see'sperformance
operations, alerting councils and Commission to problems
informing them of progress; to develop procedures as outlin
the ordinance; to promote and develop the use of the avai
access channels and other resources; to handle complaints.

MOIVTHLY FIRE RtiN5: The department made ten runs during the month of Dacem?aer.
The tcstal number af runs for the year was 127 compared ta 122 runs in 1981.
We made five s�ructure runs cluring the month, one commercial run to LCS Co.
resul�ed in an estimated damage of $200 to a grincling machine, fans were used to
pull �he smoke from the building. One of the three residencial runs resulted in
about $100 damage to a dish washer at the Fred Arend residence - 668 Woodridge.
The o�.her two residencial runs were lightning strikes. The first on at 4;00 am
an Christmas marning at the Rudy Li�erski home. Ligh�ning struck. a tree and
jumped to a small garage causing structual damage ta �he building. The force af
the strike moved the building fram its foundation and blaw the double daors on
the front open. The strike followed an underground electric cable into the
hause blowir�g.several fusses. The underground cable was blown out of the ground
leaving a small trench. There was no fire damage. The secand strike was on
December 28th at 2:31 am, the location was 2071 Patricia. There was structual
damage to a woaden deck, but na fire damage. This call came during the heavy
snow storm, city plows were used to get the pwmpers to the scene. Several fire-
fighters were unable to respond because the snaw was toa cleep.
On Christmas day at 8:46 am we received a call af a car fire in iront of 1460
Sibley Memarial Iiighway, the fire was out upon arrival of the department. A pass-
inq matorist had extinguished the �ire wi�h a hand extinguisher. The uni�.s re-
�urned to the station, at 9:08 am while s�ill at the station cleaning the pumpers
a second call was received. The ca1l was to llil Sibley Memorial Hiway for a
heart attack. Our lone policeman was on anather call and unabl,e ta r�spond. The
dispatcher requested the fire department �.o respancl. tide sent the Rescue Truck
and one pumper staffed wi�.h five firefighters_ Upon arrival they founcl the victim,
whcs is abaut ?5 yars old, in full arres�. The firefiqhters used their CPR traininq
to revive the victim ancl keep him alive until the D R paramedics could arrive and
take over treatment. Several firefighter assisted the paramedics in transport�
ing the victim to D R hospital. At last report thc; victim was doing very well and
recovering.

addition �o this training faur members of the department attended a special struct-
ural session at the Newpart Fi.re De,partment.

Planning and Development, State of Minnesota, for approval of the pro
together with all attachments and exhibits thereto, is available for
inspection beginning January 11, 1983, from 8:00 o'clock a.m. to 4:30
p.m., Monday through Friday, at the City Hall.

Statutes Section 429.081 by serving notice of the appeal upon the Mayor
or Clerk of the City within 30 days after the adoption of the assessment

upon the Mayor or Clerk; however, no appeal may be taken as to the amount

easements to install said mains.

Any trees needing to be removed wi11 be coordinated throug the

on the platted right af way at the north praperty line and will have
the characteristics of a k�lacktopped private driveway. Th's access

The 1983 Capital Improvement Program for the fire department indludes
two iteias for rebuilding pumper 2286 and pumper 2287. �
We would like to proceed with the rebuilding of 2286 at an esti ated
cost of $2,500. The project calls for removing the two booste line
reels and replacing them with preconnected hose lays. We will eceive
credit from General Safety for the two reels. The re�ls are ne er used
because of their low water volume. Their removal will also red ce the
overall weight of the truck by about 800_�bs.
I have contacted General Safety about scheduling this improvemer�t, I
was advised that they could do the work in the very near future.�
The requested remodeling will require some changes in the body
pumper and some plumbing from the pump to the location of the

SUBJECT: Proposed Zoning Ordinance Amendments
On December 21st the Council conducted a public hearing to consic
Section 4.18 of the Zoning Ordinance and adding a new Section to pro`
new, Manufactured Housing Park district. The hearing was closed and
directed to prepare final drafts.
Tom Hart has prepared the attached draft Ordinance amending Sect
of the Zoning Ordinance. These proposed revisions to the minimum re
are housekeeping in nature and should perhaps have been incorporated
re-codification which was completed in 1981. As the result of a mee
between Tom and staff, the requirement on width of siding material h
deleted, and conditions on driveway curb-cuts have been added in the
draft. Deletion of the siding width provision should drastically re

total Ordinance reflects the same requirements as Section 4.18.
The intent of the proposed R-4 requirements was to create the po

as follows:
"18.1(3)d. Sufacing - Subject to the provisions of
Section 4.18(5) of this Ordinance, all of the area
intended to be utilized for parking space and driveways,
shall be surfaced with a material to control dust and
drainage and subject to the approval of the City Council
except for parking areas of less than three (3) vehicles."
C. Section 18.1(4)a shall be amended to read in its entirety
as follows:
"18.1(4)a. All Residential Dwellings - At least two (2)
parking spaces per dwelling unit."
Section 2. This Ordinance shall be in full force and effect ,
from and after its publication according to law.

Attached is a letter from Short-Elliot-Hendricksen, Inc. transmitting
their final bill. The toal consulting costs spent to date by the City
on this study are (including this 6i11) $61,338.69. The contract amount
was estimated at $77,368.00. These consulting costs together with City
costs have been bil•led to the P�etropolitan Waste Control Commission for
partial payment of grant r�oney. We have been receiving only the Federal
75 percent share. The State will pay 50 percent of their 15 percent
share upon receipt of all of tfie Infiltration/Inflow reports (they only
have received 30 of the 50+ reports to date).. They will then pay the
final 50 percent upon review and acceptance of the reports by the
hiinnesota Pollution Control Agency.
Minnesota Pollution Control Agency officials state that their review
of our report will entai�l a minor amount of future work by our consultant
that will still be billed to us and will be grant eligible.
It is recommended that Council approve payment of this final bill with
the understanding that there may be future billings for minor work as
requested by the Minnesota Pollution Control Agency.
