The regular meeting of the Mendota Heights Park & Recreation Commission as called
to order by Chairman Bayless at 7;30 P.M. The following members were pr sent:
Bayless, Schneeman, Liturski, Gustafson, McMonigal, Williams; excused:
Selander, Stein.
The Minutes of the previous meeting were approved as submitted.
Wood Duck Houses:
Dorothy McMonigal said that Wood Duck Houses are available through
Mr. Harris of the Minnesota DN R. Dorothy will call them in January
to place our order at $4.00 to 5.00 each. Rudy said that the city
has some metal fence posts to mount them on.

Rudy says that the rental for dragging equipment to drag the ball p
infields was rented for $50.00 i
Park Report: li
Gustafson: Ivy Falls Ball Park benches are leaning and need painti
The Trail is washing out.
Doffing: Valley Park - 1 picnic table is in bad shape and the Pavi
needs painting.
Schneeman: Wentworth Park - New sand is needed under the playgroun
equipment and the bridge needs work.
Bayless: Friendly Hills - The playground needs sand.

Recreation Report: Dewey Selander reported to Tom Bayless that the park� and
recreation registration is going fine.
Clean Up Day: Next year the city council wouTd like us to investigate alcity-
wide clean up with tree plantings.
Lawcon Grant: The Metro Gouncil has advised that Federal Funds cannot b used for
purchasing of public property.
A discussion followed regarding the transferring the application to the
Wachtler property. A motion was made by Gary Gustafson that we tra sfer the
application to the purchase of the Wachtler property. This was sec nded by
Dorothy McMonigal and unanimously approved.
A motion was made by Tom Bayless and seconded by Doffing to write a lett�r of
welcome to the new police chief.
City Clean Ups: Mary Jean Schneeman will call the Village Manager in Hopl�ins to
find out the cost of the clean up. I

FIRE RUNS FOR THE MONTH: The department made 14 runs during July. There were no
structure fire loss calls during the month. We responded to four vehicle fires
with a total loss of $2,500.
TRAINING: The regular monthly drill was used to train with the Lukas equipment and
othe� resCliQ toOls. Two vehicles donated by Fischer's Tow were used for this train-
ing. The newer members of the department received first hand instruction from the
older members on the use of the Lukas, air wrench cutter tool, and the K 12 power
saw.
On Saturday July 24th ten members of the department attended a 4 hours special
training session with the Metro Airport Fire Department. Much concern has been
expressed in the past by the Fire Command at the airport abbut our equipment and
training regarding air crashes. We have had meeting with them and talked about
the problems we could face if a large craft were to come down in our area. This
training session was one step in preparing for such an emergency. The men used
plain water, protein foam and Light-Water to attack jet fuel fires set in a pool
about 100 ft square. An in-house training film will be developed from the pic-
tures and slides taken by members of the department.

II. Duncan Baird made a Motion to accept the Agenda. Paul Tatone second�d. Motion
carries unanimously.
III. Bob Bruestle mentioned that Secretary, Ken Hanson's name was not at the end
of the July 21, 1982 Minutes.
Under section VIII of the July 21, 1982 Minutes a motion was made b Lanegran
that a letter be sent to U.S. Senators, Boshwitz, Durenberger, and oldwater,
stating that the bill #52172 be defeated in it's entirety. Dave Zem e and
Adrian Herbst office will draft this letter.
Paul Tatone moved to accept the minutes of July 21, 1982. Secondec� by
Henderson. Motion carries unanimously. �
IV. Letters were sent out July 29, 1982 to Senators David Durenberger, u
Boschwitz, and Barry Goldwater, requesting that S.2172 be defeated n
its entirety.

V. Nelsene Karns introduced Ron Abrams , who gave a presentation on
addressability features of Cabi:e TV, interactive and market evalut'on,
equipment and bidirectional communication, and selective time slot
per channel lockout by subcriber.
VI. In review of the Systems Committee minutes of July 28, 1982 a corr ction
was made by Lanegran that the meeting began at 6:00 P.M. not�at 6: 0 P.M.
Seconded by Paul Tatone. Motion carried unanimously. ,
Motion by Lanegran . Seconded by Tatone , that Ken Henderson was p�esent
at the meeting of July 28, 1982. Motion carried unanimously.
Anita Benda led a discussion on Cable Policy Issues from the Sys
Committee meeting.

Checking the records, we find that the developer's agreement or
Delaware Crossing, approved on January 9, 1979, indicates that Outlots'
"6" and "C" were to have been deeded to the City at that time. Ap arently
this was never done 6ecause the County Auditor's records still sho the
parcels in the name of Minnesota FSL Corporation. For your inform tion, we
are enclosing a copy of that developer's agreement.
As far as we know, Minnesota FSL should have taken care of th transfer
of title, and should have paid all charges. The fact that this wa not done
leaves Minnesota FSL obligated for all taxes until such transfer t kes place.
The County Auditor will not accept cancellation of taxes after the are once
posted.
The City needs both parcels for surface wa�er drainage purpos s and
expects that titles will be transferred immediately. ;

Minnesota FSL has a re lattin of some lots in Delaware�Crossin coming
up for Council approval at the next meeting. Staff is goinq to re ommen

current years tax statements on Outlots "B" and "C". It is our
understanding the two outlots (B and C) should have been dedicated
to the City of Mendota Heights. Minnesota FSL Corporation does
not intend to pay taxes on Outlot "C" (ponding area) but will con-
sider retaining Outlot "B" to split into two buildable lots.
If these two outlots are deeded to the City of Mendota Heights,
what consideration is there for the current years taxes and prior

SUBJECT: Burow Pond - Rolling Green - Continued
Early Friday morning, August 6th, Mrs. Roszak called to repor
Mr. Burow was removing material from the bottom of the pond.
Orvil was made aware of this fact and suggested that we close�y
monitor the operation, which we did.
During the course of the day we made four visits to the site.

Mr. Burow owns an army surplus self contained scraper, with a capacity
of app�roximately 12 cubic yards, which he was using to move pond b ttom
material. I
On the surface, the pond sedimentation was dry enough but the weight of
the equipment and the digging o.perations found the equipment unabl to suc-
cessfully function without help.
Mr. Burow then obtained help in the form of a farm tractor which was
used to pull the scraper until it was loaded. Hauling and unloadi g was
routine.
When excavating, Mr. Burow removed material no more than 3 to 4 inches
deep and placed it in a like manner at the dump site. The removal was
orderly and accomplished carefully. Mr. Burow ceased work prior t 4 P.M.
that day.
On Tuesday, August lOth, P4r. Burow was observed to be hauling again and
when Jim and I visited the site he indicated that only a few more oads would

In evaluating the dump site, we determined that Mr. Burow had excavated
approximately 60 cubic yards, the amount he was authorized to remo e in
March 1980. �
Prior to starting any of the excavation, Mr. Burow dug a test hole in
about the center of the pond. He found that the sediment was abou 4 feet
thick and there was black dirt below that point. After a period o time,
it was determined that a water table was located at about 3 feet b low the
surface of the bottom of the pond.
Another matter, relative to maintaining water in the pond, wa brought
up by Mrs. Roszak in her Friday morning phone call. She suggested that maybe
she and some of the neighbors might be interested in paying for re lenishing
water in the pond, if the� knew how much it would cost. Later, we computed
the amount of water it would take to fill the pond to an estimated level
=prior to pumping. Ass.uming that the ground in the pond bottom area was not
too dehydrated, we estimated a need for about 500,000 gallons. At the rate
St. Paul Water Utility charges for water, the estimated cost is $500.00 to
$600.00.

come up at the meeting, Council members will be able to discuss the matter
freely.

Greg Lyons and Mike Leibman have applied for sign permits to lace
business identif ication signs on their building located at 2012 So th
Lexington Avenue. The building is south of Highway 110 and east o
Lexington. Both signs are wall signs and do not exceed the allowa le
sign area for the building.
As Council may recall, there has been some.previous sign apprc
action on this property. In 1981, Clarence Mattson was granted a;
height variance. This action did not mention any restrictions on f
ther sign permit applications.
Therefore, I would recommend Council approval of the two sign
permits applied for.

4. The copy of the thouroughfare plan from the current Comprehensi�
attached and noted as Exhibit 3. This Plan, approved by the Cii
and the Metropolitan Council anticipates the ultimate construct�
relocated Trunk Highway 149 with the extension of old #149 as a
road to the new intersection with Trunk Highway 110. The area ;
grey illustrate this substantial amount of right-of-way that cat
by not constructing a grade separated interchange at this,point,
the substantial decrease and anticipated traffic projections on
Highway 110 (and other reasons) the Plan envisages the continuar
Trunk Highway 110 as a four-lane "minor arterial" with grade crc
at Delaware, Trunk Highway 149, and Lexington Avenue.
5. The City Council, at a meeting in May, 1982 with representative:
requested an agreement with Mn/DOT officials that they prepare �
designs with redevelopment for the construction of relocated Tri
149 without an interchange at Trunk Highway 110. This course w�
with the intention of improving accessibility to Mendota Height:
Commercial Area, and to enhance its potential through the relea:
additional right-of-way for development purposes.
6. In July of 1982, Mn/DOT officials met with the City stafflto re�
preliminary plan prepared by t�ln/DOT indicating the alignment anc
construction for relocated Trunk Highway 149. The plan illustr�

D. SUMMARY
It would appear that the City has an opportunity at this point in t me to
substantially enhance and alter the course of events that could pro uce a
highly desireable, revitalized Central Commercial Area in keeping w th the
prestige level typifying the development of the City over the past wo and
one-half decades. The results of an analysis of the development po ential
under the current circumstances should result in decisions that wil have
crucial impact on the future for the Central Area of Mendota Height . The.
commercial and other central facilities functions are far under dev loped
in relation to the development of the rest of the community. Great oppor-
tunity would appear to be inherent in the planning for the expansio of both
private and community interests of benefit to all. The cooperative effort
between local government, county, state interests, and free-enterpr ze can
achieve far better results over what may likely happen if we simply wait with-
out policy, plans, or direction. ,

The feasibility s�udy will focus on the following improvements:
1. Installation of Watermain - the City of Mendota Heights
designated installation of a 6" watermain, the location
of which is shown on the utility plan, attached hereto
as Exhibit "A." The watermain will connect the existing
watermain along Highway 13,.and in so doing will complete
the looping of the Miriam Street watermain to Highway 13.
2. Installation of Sanitary Sewer - The City of Mendota Heights
has designated installation of an 8" sanitary sewer system,
the location of whi.ch is shown on the utility map, attached
hereto as Exhibit "A." The sanitary sewer will connect to
the existing system on Highway 13.
3. Dedication of Roadway - The City of Mendota Heights
requires the connection of Hiawatha Street and Miriam
Street. A 60' right-of-way to effectuate the connec-
tion will be dedicated to the city. The area to be
dedicated is set forth in Exhibit "B," which is attached
hereto. .
4. Storm Water Drainage and Ponding Area - Storm water
runoff from the project will be created. There will be
16 units of approximately 2,000 square feet in size,
constituting approximately .75 acre. Hard surfaced area
(streets and drive-ways) will cover an addi�tional .75 acres.
Therefore, there will be approximately 1.5 acres of impervious
area and approximately 4.12 acres of green area with ground
absorption capabilities. The run-off factor ("Ifactor") prior
..,::. to development is .2. The run-off factor after development
' will be .4. These figures have been provided by Probe
Engineering, the consulting engineers for the project. Since
these figures are already determined, it should be merely an
arithematic task to determine the size of the ponding area.
A preliminary drainage plan, prepared by Probe Engineering
Company, has alreac�y been submitted to assist you in this area.
Federal Land Company has, at considerable expense, retained Probe Engineering
Company to address the engineering aspects of this pro�ect. Probe Engineering
has followed the City's requirements and instructions in preparing the
necessary engineering plans. Therefore, the majority of the issues to be
covered in the ��f��s;i;bility study have already been presented and resolved.
The cost of the.feasibility study should reflect this fact. Since the
drainage of storm water and ponding area present the most significant issue
to the Federal Land Company property, it is anticipated that the cost of this
aspect of the feasib�ility study will be the largest.

feasibility study relating to the resolution of the storm water dra
problem which exists on the property adjacent to and northeast of t

The following constitutes a fourth feasibility study with reg<
need for storm sewers and upgraded street construction in ivy Fall<.
Addition. Earlier reports were prepared in October 1979 and Octobf
while an informal study Report No. 3 with an anticipated preliminar
ment roll, was prepar.ed in December 1980 for discussion with residE
the subdivision. After several neighborhood meetings, on January �
the Council decided to drop the entire matter for the time being.
Streets in ivy Falls have continued to deterioate and surface
problems have increased. Maintenance money has been limited and S1
the Council have not found justification to do major maintenance ar
the neighborhood as was suggested at some of the open meetings.

Recent surface water problems encountered by a resident on �•1a le Park
Court precipitated a private study which was presented to the Council. This
resulted in an open discussion by the Council and directive to review the
entire Ivy Falls First Addition street and storm sewer matter.
In that a considerable amount of study has_.preceded this writi�g, it
is our intention to utilize that.information and to apply it to pre,sent
conditions in an effor-t to comply with the Council request for an updated��
report.
Existin treets were reconstructed in 1963 when sanitary sewe s and
water mains were installe . t hat time, the reconstruction consi ted of
a nominal 12 inch bituminous surface over a 4 inch gravel base. Pr posed
reconstruction will cbnsist of 6 inches of gravel base and 2 i.nches f
bituminous surface as well as concrete curb and gutter. ;
Before street surfacing, all underground work should be �comple ed.
This includes storm sewers, drain tile and creek improvements.
�
During previous discussions at formal hearings and neigh�borhoo meetings,
many suggestions for varying amounts of work were considered.� Pers nal in-
terests were prevalent and at no time was it possible to obtain a c ear
consensus.
In an effort to remidy a bad situation in the•Plaple Park Courtlarea,
it appears that one of two solutions is in order.

1. The first solution is to install a complete storm sewer and street
construction project as is shown on Sheets 1 and 3 of the drawings included
in the October 30, 1980 report, copies attached.
2. An alternate is to upgrade P�aple Park Court by installing storm
sewers and a 30 foot wide bituminous surfaced street with concrete curb and
gutter from Cascade Lane to the cul-de-sac. This is as shown on Sheet 2 of
the attached drawings. Sheet 2 of the October 30, 1980 report contains
a series of eliminations in an effort to arrive at a compromise in order to
satisfy some of the residents in ivy Falls First Addition. This procedure
and Sheet 2 has bee�;•el.iminated from this report.
STORM SEWERS - GOMPLETE SYSTEM
The proposed complete storm sewer system as shown on Sheet 1 of the
attached drawings does include improvements to Maple Park Court.
Although the 1980 cost estimates are almost 2 years old, the economy
is in such a state that during the past year or so, the construction in-
dustry has been providing very favorable bids for the installation of public
utilities. It is therefore our position that the 1980 cost estimates remain
valid at this time.
Installing the entire storm sewer system, as shown on Sheet 1 of the
attached drawings, will cost an estimated $232,700.00. With approximately
1.,111,600 square feet of assessable property, the unit assessable cost for
the proposed project is estimated to be $0.�209.per square foot.
STREETS - COMPLETE SYSTEM
To do the street eonstruction as shown on Sheet 3 of the attached draw-
ings will cost an estimated $261,000.00, including fees and contingences.
With about 8,827 feet of assessable frontage, the unit assessable cost
comes to $29.57 per foot, an amount not out of line with current construction.
MAPLE PARK COURT ALTERNAT,E
Should the concept of a complete street and storm sewer system be rejected,
to resolve the serious surface water problem on Maple Park Court, it is sug-
gested that consideration be given to the upgrading of this individual street
and that drainage facilities be installed as shown on Sheet 2.
One of the major problems in conjunction with removing surface water
from Maple Park Court will be the corrstruction of an outfall pipe from the
cul-de-sac to a drop structure at the edge of Ivy Falls ravine. It must
cross private property somewhere along the lot line between Lots 6 and 7
of Block 6 in an area that is now heavily vegetated. An existing drainage
easement will have to be increased in width and an agreement will have to be
reached with the property owners to remove or transplant some trees and
shrubbery.

STORM SEWERS - MAPLE PARK COURT
Proposed storm sewers on Maple Park Court are as shown on She t 2.
The work includes construction in the street and on easements betw en Lots
6 and 7. To do the proposed work is estimated to cost $20,420.00 including
fees and overhead. Even though some surface water from Cascade La e, Wood-
ridge Drive and Arcadia Drive may ultimately end up in P�laple Park ourt,
we suggest that assessments for the proposed storm sewers be confi ed to
the five lots adjacent to the proposed construction. This means t at the
five lots would then no longer be involved in future street and st rm sewer
assessments for the balance of the subdivision.
With approximately 1.25,100 square feet of assessable property
unit assessable cost is $0.163' per square foot.
STREETS - MAPLE PARK COURT
, the
Proposed street construction for Maple Park Court is as shown on Sheet
No. 2. The work will consist of a 30 foot wide 2 inch bituminous urface
on a 6 inch gravel base with concrete curb and gutter, all conform ng to
City standards. The cost is estimated to be $21,813.00 and includ s
fess, contingencies and overhead. With assessments being made aga nst the
adjacent five lots, having an estimated 839.2 feet of assessable f ontage,
the unit assessable cost comes to $26.00 per foot.
SUMMARY
The directive from the Council to come up with a positive rec¢mmendation,
is as follows: I
A. (1) Ivy Falls First Addition streets should be upgraded t¢ City
standards with B-618 concrete curb and gutter. �
(2) To do this will require the installation of storm sew�rs and
other drainage facilities.
(3) The costs should be assessed against all properties i the
subdivision which contribute to the need for these fa ilities.
B. The matter of surface drainage on P4aple Par.k Court sh uld be
corrected either by the installation of complete faci ities in
the entire subdivision or by doing construction withii the
street itself, as shown on Sheet No. 2.
C. _ Positive action by the Council will require the estab ishment
of another public hearing or hearings. /

for your review. The proposal reflects a 5.77� increase over the 198 budget,
for a$17,750 increase. I will be on vacation next week and therefore will
not be present for the discussion. I would be most willing to answer any
questions after I am back from vacation, and hope that the following arrative
will serve as an acceptable alternative to my presence on Tuesday.
PERSONAL SERVICES
The elected officials remuneration is budgeted at the same level
in the past two years -- simply because no discussion on the matter p
budget preparation. Adjustments in Council salaries can only be prop
in a year during which a municipal election will occur. Since I do n
know the Council's feelings relative to an increase�, I will defer fur
discussion on the matter to a future memo and a meeting at which I wi
be present.
The balance of personal service line items relate to full-time
temporary em,ployees. The proposed adjustment in full-time salaries i

for engineering fees. Basically, this amount is proposed to cover services which
can later be billed out. As an example, prior to the engineering transition,
most assessment splits were totally accomplished by administration. Given our in-
house engineering expertise and increased demands on my time, I have asked Ed to
prepare all assessment splits. After Ed's involvement is completed, we prepare
the data processing forms for submission to the County and bill the property
�owner for all costs incurred in the splitting process.
The 1983 line items proposed for telephone and teleprocessing reflect rate
increases by Northwestern Bell and service increases by LOGIS. The $1,000 increase
in hospitalization insurance anticipates a conversion by one employee from single
to family coverage and would also accommodate an increase in the employer con-
tribution to match that afforded to the bargaining units. The workmen's com-
pensation insurance reduction of $6,000 reflects both the favorable insurance
trust rates and anticipation of a refund which will be credited directly against
the line item rather than being treated as income as was the case in previous
budgets.
COMMODITIES
Each of the line items in "commodities" is proposed to be increased over
1982 by percentages in excess of the 67 guideline. The increase in the office
supply allocation will allow the printing of receipts, forms, etc., which are
purchased in volume every two to three years, along with replenishing various
office supplies.
The equipment repair allocation covers the cost of maintenance agreements
on the typewriters and includes estimated agreement costs for an electronic
typewriter. Postage is proposed to be increased $300 in anticipation of increases
in postal rates.
OTHER CHARGES
There are no significant changes in other charge line items except for SAC
charges. The $25,000 SAC charge allocation is based on our best conservative
guesstimate of residential and commercial development activities for 1983.
This is a pass-through cost, with a corresponding $25,000 recognized in
a General Fund revenue account. ,
PERA and FICA are increased in a ratio proportionate to the proposed over-
all full-time salary increase. It also reflects the variations in employer
contributions for members of both the basic and the coordinated retirement plans.
CAPITAL OUTLAY
We have proposed that $2,500 be set aside for the purchase of an additional
electronic typewriter and magnetic tape unit. We do not feel that our current
or proposed needs justify the purchase of a word processing system. Several
excellent electronic typewriters on the market today are designed to tie in with
mag tape units, mini-computers and CRT's with only minimal modification and cost.
The typewriter/mag-tape system would be used jointly with engineering so that
it will be more cost-effective than if it were to be used solely by either depart-
ment.

The $8,000 contingency budgeted for 1982 is proposed to be
to $13,000 for 1983. Contingency is designed to cover both salary i
