Held Tuesday, January 19, 1982
Pursuant to due call and notice thereof, the regular meeting of th
City of Mendota Heights, was held at 7:30 o'clock P.M, at the City
South Plaza Drive, Mendota Heights, Minnesota.
Mayor Lockwood cllled the meeting to order at 7:37 o'clock P.M. T

There was some discussion concerning how far Men ota Heights Road
would extend in both the basic plan and the alte nate plan. After
considerable discussion among the Council member , Councilman
Mertensotto stated that he would prefer to see th alternate plan
proceed, but that this plan is just not economic lly feasible at
this time.

�Mr. Tom Malachway, 515 Blue Gentian Road, questio ed how an assess-
�ment of $3,241 would benefit his property. Mr. M chael Kennedy,
!2567 Delaware, also wondered what his benefit wou d be from the
;project. He noted that his home is about 30 to 4 feet above
the water flow.

Dr. Owens addressed the Council and audience on the flow of the �
various ponds in the area, as he has observed them over a period
of 30 years. He felt that there would not be any forseeable
problem, except possibly behind the David Place residence.
Mr. Malachway then noted that his home may or may not be purchased
by the State for construction of future I-494. Dr. Owens asked
how the City Council would feel if the assessment is taken off fror
the four property owners. Councilman Mertensotto replied that he
still could not justify the anticipated debt service. �
Mr. Beck indicated that if Mendota Heights Road is constructed
from Delaware, he and his partner, Mr. Laukka, would dedicate
the right-of-way for the balance of Mendota Heights Road to
where Mn/DOT would connect at a cul-de-sac, just east of the
Glewwe property. Mr. Beck also stated that the right-of-way for
Huber Drive would also have to be available.
Administrator Johnson elaborated on the Huber Drive right-of-way,
noting that it is more of a City initiated action than a project
action. He noted that the entire right-of-way is on the King
property and that MSA funds can be used to acquire the Huber Drive
right-of-way. Mr. King stated that he has no objection to
negotiate on Huber Drive right-of-way.
Councilman Mertensotto suggested continuing the hearing to a
future date. Mr. Jim McNulty was advised to work with staff and
property owners to show a proposed funding plan and he noted that
he would welcome the opportunity for the extra time, noting that
he would need a minimum of two weeks.
There being no further questions or comments from the audience,
Councilman Hartmann moved that the hearing be continued to
February 2nd, at 8:30 P,M.

There was cansiderable discussion regarding a municipal franchise
versus joining with other communities and the pros and cons of
each. It was noted that 5% of the cable revenue would go back
to the commission
Mr. Otta Gutzmer, a member of the Mendota Heights Cable Advisory
Commission was present and sta�ed that Mendota Heights is too
sma11 a community to be able ta obtain a franchise by itself.
After further discussion, Counca.lman Losleben moved the adaption
of Resalution No. 82-05, "RESOLUTION JOINING THE NORTHERN DAKOTA
COUNTY CABL� COMMUNICATIONS COMMITTLE AND APPOINTING DIRECTORS",

FIRE DEPARTMENT Several Mendota H�igh�s volunteer f iremen appeared befare the
City Council to request money iar a down. payment on a used tanker
truck for the degartment. Mr. BiII Lerbs, spokesman, rroted that
the pres�nt tanker is a 1948 model and is unsafe. It was noted tha
there is $20,Q00 budg,eted Ear capital improvEments, There was
some question on whether the City would need to advertise for bids
for the truck or not. �
Mayor Lockwoad suggested that the fire department come back. with a
wri�ten praposal �or Councai.i consideration and then perhaps a
favarable action can be taken by the Council on their request.
FEDERAL I,AND Mr. Carmen Tuminelly and Charles Bartholdi were present to request
the presence of Ci.ty Planner Howard Dahlgren at one of the neighbor-
hood meetings that Mr. Tuminelly is formulating ta explain the
Federal Land project on TH 13 far townhouse development. Mr.
Tumineily stated that �here were rumars araur►d that there
"� would be a lawsuit filed if this development were denied. �
He stated that there is na truth to the rumors and that no
Iawsuit will be f iled if the proposal is turned down. The
developers wi].l go with the next best scheme, which would probably
be single-family residential development. He also noted that he
is part ownex of the project.
The Council noted that there are persona7.ity probl.ems amon� the
persons i.nvolved and they felt that it wauld nat be in the best
interest of the City to have the City Planning Consultant present
the project to the neighbors. It was the concensus of the CounGil

up a few loose ends, but that at this early date it would not be

RESOLUTION REQUESTING TRANSFER OF TAX FORFETTED PROPERTY
WHEREAS, on December l, 1981, the City Council received and d'scussed
a request fram the Dakota County Auditor for the reclassification f certain
tax forfeited land described as Parcel No. 27-73100-231-03, Lot 23, Blc�ck
3, Summerset Place, except the EasC 253 f.eet and exce�t that part aken for
highway purt�nses; and
WHEREAS, it was the determination of the Council thaC the pub ic interest
would best be served by the conveyance of the tax farfeited Iand t municipal
ownership in order to provide acce�s fc�r the maintenance of public utilities
crossin� the said pareel.
NOW TEEREFORE BE IT RESOLVED by the City Council. nf the City of Mendota
Heights that the Mayor and City AdminisCratar are authorized and direcCed

December 22, 1981
l. The regular meeting of the Mendota �eights Park and Recrea�ion ommission
was called ta order by Chairman Baqless at 7:45 P.M. The follawing members
were present: Bayless, McMonigal, Doffing, Schneeman. Stein was e cused
and Williams was absent. Visitar was Dewey Selander.
2. The minutes af the Octaber 27th meeting were approved.
3. Bayless and Brian Birch, An agreement was drafted to a�low Men ota Heights
use of Mr. $irch's property on Hwy. 110 and Dodd Road. Bayles� wil meet with
Birch abaut the agreement. Hopefully then bids will be let for a p an,

5. Report on Amesbury East. A park donation of $750 per uniC and o land was
agreed upan. Also, the Council has giv�n passive approval to attem t ta acquire

7. Bike Trails - Bayless will draft a letter to the County planner complimenting

by Gustafson. Motion carried.

HEARING, Chairperson Kruse reopened the hearing for Federal Land Company
CASE 81-43, at 8:17 o'clock. Mr. Murnane requested that the hearing be

that Federal Land had tried to arrange several neighborhood
meetings with the neighbors but that for various reasons, they
were unable to meet with them. He noted that it is their
intention to notify the Planning Commission members, as they
requested, of any meetings and that they are welcome to attend.
Chairperson Kruse asked for questions or comments from the audienc�
Mr. Jim Flanagan, who lives behind the subject property, spoke
noting that this was really becoming a long drawn out affair,
and that the neighbors had tried to be accomodating but that
they were tired of this one or that one being out of town on
trips, while they postponed their own trips to be available.
Mr. Julian Bilski, 605 Winston Court added that the neighbors are
not really interested in any possible changes that are being
contemplated. Their only concern is that the property remain a
single family residential zoned parcel. He didn't feel that
there is any interest on the part of the neighbors for any
� change. He preferred to see action taken on this matter now,
with no more postponements.
Martin Colon, brother of Vern Colon, spoke saying that the
postponements were to allow time for Planner Dalilgr.en to be prese-
the meetings and that they just found out last week that the
City Council would not allow Howard Dahlgren's presence at
the early meetings. Mr. Colon stated that there was no
possibility of asking for another continuation, thhat they would
be committed to the March meeting. '
Commission member Stefani expressed concern that there be
adequate notices, adequate representation and adequate presentation
at these neighborhood meetings. Several of the neighbors present
in the audience noted that they had just received their notices
of the continuation request the day before the Planning Commission
meeting and one gentlemen stated that he just received his
notice earlier in the day.
Mr. Colon stated that he would make available to the Commission
the names of the property owners who were notified fox the
neighborhood meetings, if the Commission so desired.
Frank moved, seconded by Burke, to continue the public hearing
until March 23. .
Mr. Jerry Shaughnessy, 572 Miriam Street, noted that this project
has been going on for nearly two years now and this is the same
process that they went through in the original 'proposal in 1980.
Mr. Lyal Hefflefinger, 569 Miriam St, noted that in November, thr
property was bulldozed and there are mounds of dirt 12 - 15 feet
high in front of the property. There is also another mound of
dirt 3- 4 feet high which is not going to allow for drainage in
the spring. He wondered why this was done when the pl.an hasn't

Mendota Heights Standard has an existing plyon sign loczted a
northeast corner of their property. This sign is presently 47 squ
feet. They are proposing to add a changeable copy sign that adver
gas price. This would add 36 additional square feet of signage on
pylon. (There is also a considerable amount of additional signage
,The zoning ordinance allows a maximum of 100 square feet of

l. The Amoco Oil Company through the Leroy Sign Company has equested
permission to place a 5'6" by 6'6" illuminated price sign on the xisting
pylon sign located in the front of their station at the southeas corner
of Trunk Highway 110 and 149. The existing pylon is non-conformi g
because it is less than 30 feet from the front property line as r quired
by the Sign Ordinance.
A variance was issued in 1968 for the pylon to be 40 feet high. he
applicant indicates that the sign on the top of this pylon is 10 eet by
6 feet, oval in shape. The maximum square footage allowed on the pylon
is 100 square feet.
2. Attached is a copy of the original site plan showing the propose
of the sign which appears to be where it has been constructed.

3. The principal problem with the signs on this site is that there re a
number of signs that have been added to the site, all of which a e non-
conforming. The applicant indicates in his letter (copy attache ) that
they propose to remove these non-conforming signs if they are al owed
to construct the price reader board as proposed.
4. It would appear that the removal of the excess signs, one of wh'ch is
actually contiguous to the right-of-way, which substantially wou d
improve the appearance of the station site. Inasmuch as the tot 1 sign
area proposed on the pylon would not exceed 100 square feet as a lowed,
it would appear that the addition of the proposed sign may be re sonable.
We feel, however, that the Planning Commission and Council shou

Tuesday, November 24, 1981, this letter should help to clarify s
of the items we discussed.

Our request is for a Variance to insta 11 the 5'6" by 6'6" Illumi ted
Price sign on the existing "Standard" pole structure. This sign w uld
be installed parallel to Dodd Road, with 10' of clearance below t e
sign. '
We feel the 14' clearance would make it extremely difficult and u-
safe to change the price numerals and because of it's location, t e
sign cannot be hit by trucks.
We do agree to remove the three "Point of Purchase" signs, two ov r
the Pump Islands and one on a perimeter light pole, and the "A moe
Motor Club"_sign.
I have enclosed a copy of a letter received by Stand�•rd Oil indic ting
the Council approval of the installation of the 40' high "Standar "
sign at their meeting of May 21, 1968.

l. Mr. Prokop constructed a house on Lot 26, Block 2(871 Crown Circ e) of
the Crown Point Plat developed about a year and a half ago. Mr. �okop
"staked" the foundation himself and mistook the curb line of the ul-de-sac
as the right-of-way line. Consequently, the nearest point of the house
is 19 feet from the circular line of the right-of-way of the cul- e-sac.
Attached to this report is a copy of the sketch prepared by Mr. P okop
showing the house as it relates to the right-of-way line. The ho se is
set back greater than the 10 feet required on both the north side lot line
and the south side lot line. These dimensions are 22 feet and 12 feet
respectively.
2. Attached also is a copy of a letter from Mr. Prokop. The letter uite
clearly states what happened, and it appears that it is a simple ase
of him having made an error in where the 30 foot required setback is
measured from. We have met with Mr. Prokop, reviewed the situati n and
events, which appear to be substantially as stated in the letter.
The second paragraph of Mr. Prokop's refers to him having submit
site plan to "Dakota County". Actually, the site plan submitted
building permit was reviewed by the Mendota Heights Building Ins:
who approved the building permit based on the site plan indicati
setback of 30 feet from the right-of-way line. Mr. Prokop's let
refers to a 13 foot easement. In fact, this is not an easement :
merely the boulevard area between the curb and the right-of-way �
cul-de-sac.
3. Attached is a copy of the plat of Crown Point indicating the loc
P9r. Prokop's property and the names of property owners who have
constructed homes in the plat as of this time. Mr. Prokop has s
a statement from the land owners indicating their approval of hi
variance.

4. In this case, fortunately, the setback error is a good deal less �evere
than if it were on a straight street. Because the house is on a ul-de-sac

none of the other houses to be constructed on lots around the cul-de-sac
will line up with the house Mr. Prokop built. Thus, as homes are located
around the end of a cul-de-sac, it is quite difficult to determine their
exact setback inasmuch as none of them line up with another. Fortunately,
the 19 foot setback measures to the nearest point of an open porch which
shelters the front door. The garage itself is setback 21.5 feet from the
right-of-way, thus allowing ample room for the parking of his car without
a portion of it extending into the right-of-way itself.
5. Under the circumstances, it appears that an honest error was commited.
The house is nearly completed. The alternatives are to tear the house
down and set it back the required 30 feet, or approve the variance as

2. Attached also is a copy of a letter from Mr. Prokop. The letter uite
clearly states what happened, and it appears that it is a sim�le ase
of him having made an error in where the 30 foot required setback is
measured from. We have met with Mr. Prokop, reviewed the situati n and
events, which appear to be substantially as stated in the letter.
The second paragraph of Mr. Prokop's refers to him having submitt
site plan to "Dakota County". Actually, the site plan submitted
building permit was reviewed by the Mendota Heights Building Ins�
who approved the building permit based on the site plan indicatir
setback of 30 feet from the right-of-way line. Mr. Prokop's lett
refers to a 13 foot easement. In fact, this is not an easement x
merely the boulevard area between the curb and the right-of-way c
cul-de-sac. �
3. Attached is a copy of the plat of Crown Point indicating the loca

none of the other houses to be constructed on lots around the cul-de-sac
will line up with the house Mr. Prokop built. Thus, as homes are located
around the end of a cul-de-sac, it is quite difficult to determine their
exact setback inasmuch as none of them line up with another. Fortunately,
the 19 foot setback measures to the nearest point of an open porch which
shelters the front door. The garage itself is setback 21.5 feet from the
right-of-way, thus allowing ample room for the parking of his car without
a portion of it extending into the right-of-way itself.
5. Under the circumstances, it appears that an honest error was commited.
The house is nearly completed. The alternatives are to tear the house
down and set it back the required 30 feet, or approve the variance as
proposed.

The Hennepin County Cooperative Purchasing Group, of which we are membe
and received bids for 1982 Police squad cars. After the bids were rece
tabulated, the contract for 1982 squad cars was awarded to Midway Ford
2777 North Snelling Avenue, Roseville. The specifications required tha
submitted for a mid-sized police sedan with a wheel base of not less th
and a full-size police sedan with a wheel base of not less than 114.2 i
Ford's successful bid in the mid-size range was $7,979.00 for a Ford Fa
in the full-size range for an LTD S at a cost of $9,403.00.

Due to the generally bad reputation that the Ford Motor Company has reg rding their
police squad cars, I advertised for bids twice after receiving the info mation that
the Hennepin County Cooperative Purchasing Group had awarded the bids t Ford.
However, no bids were received from auto dealers in response to my adve tisements.
My requests for bids was prompted by the extremely favorable maintenanc record that
we have had with General Motors police squad cars since 1976 and also t e standardiza-
tion of the equipment size that we have in the vehicles presently being used as squad
cars.
I would like to recommend to the City Council that they approve the pur
1982 LTD S police squad cars at a cost of $9,403.00 each. I am not req
approval for the purchase of the mid-size Fairmont squad car at the $7,
for several reasons. Due to the interior dimensions of the mid-size Fa
would have to replace the rollbar/prisoner cage which is presently moun
of our squad cars and which would be needed in the 1982 cars. The repl
costs for two comparable cages would be approximately $700.00. In addi

$8,100.00 each. Assuming we will receive approximately $4,000.00 from
the two 1980 vehicles at the auction, the net cost for the full-size 19

Dear Mr. Mayor and Council Members:
In the past three or four years we have experienced a problem in �
that has become increasingly worse. The problem is two-fold; the
smoke which billows from chimneys of some woodburning stoves and
and the outdoor storage of wood used to fuel these devices.
Certainly no one would object to the sweet-smelling odor of an occ
wood fire in a fireplace or wood stove. However, at least one re�
our neighborhood has had his furnace modified to burn wood as his
source of heat. The smoke belching from his chimney is definitel�
sweet-smelling and permeates the homes of unfortunate neighbors wt
to be in the path of the prevaiiing breezes.
It is disgustin� to enter your home af�er being away and find it
of acrid smoke or to enter a bedroom to retire and realize you wi
inhaling polluted air all night. Even worse, the fresh-air fiend
us who like to open a window just a crack even in the winter find
this is now impossible. Even further concern centers around the

According to the Minnesota Pollution Control Agency, the Agency a yet has
-no regulations in this area and suggested we contact local author ties. A
call to the Mendota Heights city offices brought the astonishing ews that
there are no ordinances that govern the emissions from these unit nor the
outdoor storage of wood, other than that of Dutch elm diseased tr es.
A call to Bob Mood, building inspector for the City of Bloomingto , was
extremely informative since they have recently updated their ordi ances in
this area. Bloomington requires a permit and woodburners must al o be
inspected when installed. Mr. Mood said this became necessary wh n resi-
dential fires increased alarmingly because of improperly installe wood
stoves and furnaces.
Regarding the outdoor storage of wood, Bloomington has 30 feet se�backs
from both front and rear property lines and 10 feet on each side hat must

be observed, with wood storage not a"permitted encroachment." Also, the
wood must be "stored within a building or fully screened so as not to be
visible from adjoining or adjacent lands." One back yard in our area
contains a woodpile that is roughly 15' x 25' and is 4' to 5' in height!
This eyesore is stacked against the fences of three abutting property
owners who are afraid to think about what type of creatures might be
living within.
We feel that the related problems of smoke-polluted air and unsightly
woodpiles will only continue to worsen as utility rates continue to rise
and more people try to lower their energy bills. Therefore, we hope you
will move quickly to enact an ordinance to address the wood-burning
stove emissions and wood storage in the Mendota Heights area. '
After all, clean air to breath should be a very basic right for all of
us. A copy of the Bloomington ordinances is enclosed for your informa-
tion, and Mr. Mood said he would be happy to be of any assistance. He

efficient perfarmance of its intended functic+n.
(3) 1�'Vhere a rear yard or a side yard in a reszdenciai zoning district abuts a pubtic street, trash burners and garbage
receptacles are prohibited in the setback area of such rear or side yard and, if locatec! ar placed in such rear or side yar�, shali be .��

the Deferred Compensation P�.an tha� was adopted origina�ly in early 19T4.
There is no impact change on CiCy abligations, i.e., City Adm3.nist-r tion
remains identical in both cas�s. The thrust of the changes is to 1' eralize
the payout plan in the future and respond ta several changes in the law
since 1974.

RESOLUTION CLASSIFYING STREET LIGHTING SERVICES AND
ESTABLISHING CHARGES THEREFORE
W�iEREAS, Ordinance 701 provides for the assessment of costs fo� current
services, including street lighting; and
WHEREAS, there are two basic needs for street lights, namely () lighting
the intersections of state, county and MSA thoroughfares, and (2) p oviding
lighting for the benefit of residential, commercial and industrial reas; and
WHEREAS, the cost of installation and operation of residential� commercial
and industrial lighting is optional and based on area desires,
NOW THEREFORE BE IT RESOLVED that there are two classes of st
established:
Class I: Thoroughfare Intersection Lighting
Class II: Area Benefit Lighting; and
t lighting
BE IT FURTHER RESOLVED that the costs of Class I lighting shal be supported
by tax levies, the installation and o�erational costs of Class II 1 ghting
shall be assessed in accordance with Ordinance 701 and applicable s ate
statutes; and
BE IT FURTHER RESOLVED that the Public Works Director establis a preliminary
plan� cost estimates and guide lines for the installation an operational �

lighting, the Public Works Director shal prepare plans and estimat d cost, the
Council will conduct a feasibility earing after proper notice, and the improve

BE IT FURTHER RESOLVED that charges for such current services hall be
added to the quarterly sewer billings for the properties connected o the
sewer collection system, and the charges for undeveloped properties shall be
assessed as set forth in Ordinance 701, Section 5.
