Pursuant to due call and notice thereof, the r�gular meetin�; of th City Council,
City of Mendota HeiQhts, was held at 7:30 o'clock P.M, at the Cit Hall, 750
South Plaza Drive, Mendota Heigllts, Minnesota.

Councilman Hartmann seconded the motion.
The Council acknowledged and briefly discussed a letter from
the St. Paul [Jater Department advising the City of an increase
in water rates to commence January lst. The Council also

for approval of an addition to the Cray Rese rch facility
in the industrial parlc. Public Works Directo Danielson
advised the Council that all the requirements stipulated in
the Code Enforcement Officer's memo, which ar repair of the
lift station road, storm sewer easement, and etails on manhole
construction proposed on the west side of the Cray Research
property, have all been met. He further advi ed the Council
that the architectural design of the new addi ion will be the
same as the desi�n of the existing structures

After a brief discussion Councilman Mertensot o moved approval
of the application for construction of a seco d addition to
the Cray Research facility, subject to compli nce with all
conditions set forth in the Code Enforcement fficer's memo
dated December 29, 1981.
Councilman Losleben seconded the motion.
COMMISSION Mayor I,ockwood noted that one of th� terms du to expire on

Mr. Bayless was present in the audience, and dvised Mayor
Lockwood that lie would be willing to serve an additional term
on the Commission.

Councilman Mertertsotto asked what would happen in the future if

will begin in 1983, will necessitate Mendota H ights Road and

property when it will be necessary to extend t e system along

Councilman Mertensotto pointed out that if Mr. Laukka is intencl
ing to develop his property in the next two to three years, ;
would be wise to a�nrove the large alternative at this time,
since it would save a good deal of money to do the project no�a
rather than to delay a portion of the project to the future.
He suggested that perhaps the Laukka assessment payment could
be deferred for three years, with the first payment to be due
in the fourth year.
' City Administrator Johnson advised the Council that the large
project would, as proposed in the feasibility study, include
the construction of botlt Huber Drive and Mendota Heights Roacj
to MSA standards, with concrete curb and gutter, and that the
associated costs are included in the $1.5 million estimate.
Councilman I�osleben asked that a staff study also be made on
extending the utilities south through the residential propertic•
so that there be no future problems in providing services�.
As the result of the discussion, t}te Council directed the Citv
Fngineer to prepare specific cost estimates on the clifEerences
,., between the c�sts of the basic Plan and the alLernate pl.an,
incorporating staged, rather lhan fu11 construction of the hIS�\
streets.

PARK AND RECRI,ATION rir. Bc�b DoFfing, a member of the Park and Recreation Commissic>n
MATT�RS updated the Council on details on rink maintenance and on the
County Park Trails system proposed agreement. Mr. Doffing
advised the Council that the proposed Trails agreement with
Dakota County would require, among other things, that t}ie City
sweep the trails three times a year, alon� with a cc�nsiderable
amount of maintenance. He stated that the Commission believes
the City should maintain trails in the same manner as it
maintains the streets. He indicated that the agreement, as it
is proposed by Dakota County, is not acceptable to the Commissic
As the result of the discussion, staff was directed to advise
Dalcota County that the City will not approve the agreement as
proposed, in that the Council has a number of questions and
believes more discussion and details are required.
PARK COMMISSION Mr. D�ffing �3dvised the Council that the Park and Recreation
MEETINGS Commission, at its last meeting, recommended to the Council
that the regular monthly commission meeting be changed to the
second Tuesday of each month, rather than the fourth Tuesday
of. each mcmth.

Councilman Mertensotto moved that the Park an Recreation
Commission be authorized to change its meetin date from the
fourth Tuesday to the second Tuesday of each onth, commencing
with the month of February, 1982.
Councilman Hartmann seconded the motion.
Administrator Johnson advised the Council of MAC meeting to
be held at 7:30 P.M., on January 13th, in the Mendota Heights
Council Chambers. . ,

MONTHLY FIRE RUNS: The department answered anly three runs during Dec-
em �r. The first one was a small kitchen fire in Sunfish Lake. The
counter top cooking unit sharted out causing a greese fir�. Damage was
limited ta the unit with no additional damage to �he kitchen. The second "
run was an alarm malfunctian and the call was cancelled. On December 27
we were called at 7;42 pm �o a major dwelling fire at 536 Fremont. The
owners, Mr & Mr�. Reyes Zapata, had been aut of the city �or several days
and upon returning to the hause found smoke caming from the windaws. The
fire started in an interiar wall between the dining and living raoms. 01.d
outdated wiring may have been the cause of the fire.� Damage �o the house
was estimated a�, $20,000 and'i�s contents at $15,000.
MONTHLY TRATNING: The regular �wo haur monthly training was diva.ded into
�hree forth minutes cla�ses. The �ubjects covered were the changes in CPR,
self-contained breathing equipment, and Lukas rescue equipmen�..

3. There was a serious watermain break in Friendly Hills on �ecorah
Lane on December 29th.
4. Staff inet with Short, Elliott, Hendrickson to discuss the status of
our Infiltration-Inflow report. A final report should be availabl in February
or P�arch. Delays have been due in part to the fact input needed flom the
Federal authorities has not been available.
5. City Project 79-7 - L.C.S. -� This project �Nas completed he be�inning
of December. Due to the cold weather we deleted the street restor tion. To'be
completed in the spring.
6. City Project 82-1 - Marie Avenue - Surveying Hias complete� for �1arie
Avenue Upgrading. Staff is now working on design.
7. City Project 81-7 - Amesbury East - Staff began taking �i�ld infor-
mation for this project in anticipation of a winter design on this project.

SUBJECT: Renewal of Hame Beauty Shap Approval
Mrs. Elizabeth Mulcahy, 67Q — 2nd Avenue, stogped in today to
request approval to operate her home beauty salon for another year. She
noted that due tp the State emp�.oyees strike last summer, her hame
inspection had been delayed unti.l late in Ju1y, hence theq probably ould
not inspect her hame again this year until mid summer, if even then, due
to all the State cutbacks.

She has been caming in of l�er awn accord to request this appra al since
January, 1979. We have received no complaints abaut her home accup tion
and past Sta�e Cos�neto2ogy Znspection Reparts have shown excel2ent eports.
She only operates this two days a week, an Tuesdays and Fridays.
I recommend that Council approval be granted for renewal for 19j82 of her
home beauty shop. (

the staff inembers. The engineerin� staff has met with virtually al concerned
parties to this project. Hence most of the concerns have been conv yed to and
considered by engineering sta££, Larry Shaughnessy has prepared a rief financial
impact analysis and the su�mary af �hat 3.s included as a second por ian of this
Memo.
Although this Memo is being prepared for City Cauncil conside�
of it are being distributed to the cancerned parties so that everyar
will have the same starting information and, hopefully, discuss the
the same startin� point. As a word of caution to all: this Memo a�
data supercedes any previaus data Chat has been distr3.buted. AlI p�

4. Sanitary Sewer and water cas�s are not being assigned to the 4 residences
or the Owen and King hamesteads. Tn otherwords, the King PTTD and Amesbury praperty
are picking up the total cast of sana.tary sewer and water in the Basic Plan.
5. The Basic Plan does propose a very basic and minimal p1an. It will serve
the Amesbury East praject in a Catally sufficient manner and have minimum impact
on the ad,joining properties. Bear this in mind when reviewing the first shee�
of the Financing Schedule.
6. The Alternate Plan is called "Maximum construction wiCh 24-faot streets.."'
This implies that the trunlc systems af sewer and water are being ins�alled as we'11
as the majar surface water �run3c system. {Na Iocai storm collectar system}, This
plan would envisian driveable stxeets on Mendata Heights Road ta the west to meet
with future MniDOT s�reet and would alsa include iiuber Drive between Delaware Hi11s
and Mendota Heights Road.
With the forc�gaing notes and qualifications, you may want to compare these new
figures with previaus worksheets. A very general statement wauld be; this set of
sheeCs (both Basic and Alternate) provide a compromise situatian tha� basically
places mast af the costs against the Amesbury project and the remaining acreage
owried by the Kings {King PUD}, Of course, �he disadvantage ta this is that the
amaunt assigned to King is against Green Acres property and cannot be col3.ectabie,
more on this in the next discussion. The Czty Council did request af. alternate
sewer and water plan for the 4 properties south of the praject. This current propo
is based on the propasition that i� sewer and watex is desired south c�f tl�e project
it will h�ve to stand on its own merits wheri that time comes. In general, I bel3eve
that these figures represent the best kin d of a compromise and I would recommend
serious consideration of either' one of the schemes. We have been advised by the
develaper and the landawners that this contract must gat aff the ground very shortly
if it is to be a viable praject, I gathered that a decision on 'Tuesday ni�ht would
sid in the resolution of their graposal.
IT.
FINANCING SCHEDULE
Larry Shaughnessy has prepared two financing schedules, one fo.r the Basic
Plan and one for the Alternate P2an. He has listed a number of assumptions for
both cases. These two analyses prabably need some fairly concentrated studying.
Expanding on his assumption No. l, we have assumed that i� wau2d take 7 years to
complete the Amesbury pxoject and after that time, either the King praperty would
develap or nat develop, That is the basis for the alternate aC the bottom of the
first page. In atherwords, as nated on Larry's �irst sheet, the.act of assessing
approximately 29 acres of Green Acres, will necessitate an anrnxa] levv of approximately
$$,000 in order to pay aff the bonds and interest for the first 7 years. If the
Green Acres were not develaped after that time, Che Ievy would have to increase to
approximately $20,fl04 per year. As noted on the last Iine, the principal and interest
has accumulated to $272,Q00 by 1991, Will the land be warth that much?

The City's 1982 budget document was distributed to the City Council
December. The docinnent includes a budget of anticipated Utility Enterpr
Fund revenues and experiditures forecasted for 1982. This memo is intend
support and explain the forecasting and recommend an increase in the use
needed to support the utility department activities.

The major change in proposed budget expenditures is the anticipated 1982 MWCC
billing of $275,000, which represents a$25,270 (13.4%) increase over 19 1. The
overall utility budget is increased by just about the same percentage. t is
proposed that the antic�ipated expenditure increase be supported by an in rease in
user charges along with�expected modest increases in several of the reve ue
sources detailed in the�revenue portion of the proposed budget.
Residential sewer use charges for 1981 were established at a minimu quarterly
charge of $16.75 for wa�ter useage not exceeding 2900 cubic feet (based o winter
quarter water readings)�. A premium of 60� was charged for each 100 cubi feet of
water used in excess of'the minimum. It is proposed that these rates be increased
to a minimum of $19.00 per quarter (13.4% increase) and a premium of 70� per 100
cubic feet (16.7 % increase) in excess of the minimum.

Commercial, Industrial and lnstitutional users were charged a minim m quarterly
rate of 60G per 100 cf of water used or a minimum charge of anywhere fro $25.00 per quarte;
to $320.00 per quarter, depending upon water meter size. C/I/I customer without
metered water were charged a minimum quarterly rate based on the water m ter service
size whicYi would be required to provide the same service as the gallons f water
per minute produced by their existing private pumps. It is proposed tha those
proposed minimum rates be increased by the same percentages proposed for residential
useage. I I

20� surcharge for outside users would produce approximately $400 of additional revenue.
In order to finance the anticipated expenditures for 1982, we recommend that the

- For budget purposes, 2% might be a more appropriate number. If
the 1982 homestead credit payment is unknown, the following
formula will provide a close estimate. (1981 homestead credit X '
homestead growth ratio X 1.08 = 1982 maximum homestead credit.)
The 'Homestead growth ratio' was provided by the Revenue Department
to each city for calculation and certification of 1982 levy limits.
- No recertification will be allowed,. therefore, ihe 2% of 1982
homestead credit will need to be subtracted from 1982 budgeted �
revenue and budget expenditures adjusted as appropriate.
3. Property Taxes. Cities and counties' will not be allowed to recertify
1982 taxes but school districts have been given the option of a
2 mill increase. It is expected that most school districts v�ill
exercise this option. fdo o'ther property tax increase or credit
decrease was included for property taxpayers for 1932.
4. Shade Tree/State Grants. Shade Tree grant money for 1981 (not yet
paid by state was reduced by one-third to $2.7 million. All Shade
Tree grants money for 1982 has been eliminated. As to other grant
programs administered through state departments, cities involved
should contact the appropriate department to determine if cuts have
been r�ade. , -
B.. I983
1. Levy Limits. The 1982 Levy Limit law has been extended to 1983 and
beyond. Thus, the General Fund levy will be a1loUred to grow each year
by homestead growth and 8% over the previous years Genera7 Fund levy.
Qonded debt and all current special levies are retained as special
levies.
2. Local Government Aid - 1983. The 1983 appropriation was reduced by
�23 million dollars. The new appro�riation is equal to what the 1982
appropriation was prior to the $30 million cut.�
3. Property Taxes. Based on this bill, city and county taxes will increase
by homestead growth plus 8% schools will be allo4red the 2 mill
option, and various current property tax credits remain intact.
- The Transit Mill Rate for general operations of the MTC will increase
from 1.72 mills to 2 mills �vithin the Transit Taxing District.
C. MISCELLANEOUS
Cities and counties, through a bill passed December 31, 1981, have been
guaranteed payment (by February 26, 1982) of all the November/December

' RESOLUTION OPPOSING METROPOLITAN SURFACE WATER MANAGEMENT
PLAN, OPPOSING RELATED LEGISLATION AND RECOMMENDING CHANG
IN SPECIAL ASSESSMENT STATUTES.
WHEREAS, Mendota Heights has experienced damages from uncontr llable
waterways and has expended monies to correct drainage problems cau ed by
surface water runoff from both within and outside the corporate li its; and
WHEREAS, Mendota Heights has lost several special assessment hallenges
because "contribu�tion" to the surface water problem was obvious bu the
"benefit" was not� proven; and
WHEREAS, the Metropolitan Council has produced a voluminous s�udy and
plan addressing drainage problems in the metro area; and
WEIEREAS, the'estimated cost of such plan appears to surpass c
associated with recent comprehensive plans; and
WHEREAS, legislation responding to the Metro Council plan is
considered; i

NOW THEREFORE BE IT RESOLVED that the Mendota Heights City Co
expresses opposition to the Surface Water Management Plan as prese
