instituted ta avoid problems similar to the P olcop setback
problem. There �aere several, suggestions made by members of
the Council, includin� the process af inspect ng s�aking prior
to excavation and footings, and requiring gre ter responsibility
of the excavator.
City Administrator Johnson•assured the Counci that staff will
attempt to talce some corrective measures to e iminate simil�.r
problems in tl�e ft�ture.

Mr. Danielsqn stated Chat Mr. DuPont, in his negotiatians cvith'
the ScY�oo2 District, has agreed ta construct a sidewalk frorn
Victaria to the Niendota School property, and it is praposed t�.G
the sidecaalk be constructed under the im�rovement project and ,
assessed to �he properties within the DuPont Addition plat. .
It is alsa proposed ta extend sanitary sewer and watermains to
the school property under the project in accordance with the '
terms of Mr. DuPont's agreement with the School District. �'
Publ.ic Works Director Dani�lson advised that the estimated �
project cost is $149,000, whicI� would invalve an assessmen�
of approximately $11,000 a�ainst eacll of the �latted l.ots. �
He advised that the project could be campleted either late fal�
of 19$2, or in the spring o� 1983, which would involve assessiri
in 1984. T�ie str�et assessment would be levied for a period
of 10 years and al.l underground utilities for I9 years, at an
interest rate to be determined at the time of assessment.

Mayor Locicwood asked far questions and camments f�amthe audienc

Councilman Martensotto painted out that a large gas line
crosses the Evans �roperty and that the property miglit theref�
never be able to be developed. rir, DuPont stated that if the
property' can be developed in the fuCure, assessments under this
project sl7ould be levied against the property. He advised ha�ae-
that if �he Cauncil determines the property cannot be �levelaped
he wauld agree to assuming �he assessment obligatipn against th�
area within the pl.at.
Mr. Marty Evans, a�aner af 2010 Victoria Road, gave the Council
a history of assessmen�s levied against his proper�y. He state�
that when the pla� c,ras originally prppos�d, Mr, DuPant stated
that there would be no assessments from the projec� against
any of the private property' ot,m�rs. He ppinted ou� that a higli
power gas lin� crosses his'property and it is therefore
ques�ionable whether the property can ever be developed. He ,
aslced why it i.s groposeci to assess his praperty and not the
Dakota's Adul�s praperty. Iie stated that the project is '
being graposed to benefit the DuPant Addition and wauld only
be to his f inancia]. de�riment . �
Councilman. Mertensatto poin�ed aut that easements will be
required at the back oE Mr. Evans �roperty to accammodate the
extensian af sanitary s�wer and storm sew�r, and asked whether
Mr. Evans woulcl be willing to grant the City the n�cessary
easements far those utilities, Mr. Fvans stated that he is
willing ta worlc with the City as long as the project does not
become a finaz�cial burden to him.

the Dakota's Adults Board has not yet conside ed �he question
of whether they would gran� an easemen� far c nstruction. He
stated that Dakota's Adults had to extend the sanitary sewer
from Lexington Avenue when its facility was c nstructed and
was assessed $18,000 far the extension. He p�-�ted out that
Dakota's Adults is providin.g one-third of the entire s�wer line
to serve tl�e praperty east of it and feels th t the City should
allocate � portion of the $18,000 Dakota's Ad 1ts assessment to
the DuPont development. .

Hennepin County Cooperative Purchasing Group for Ford Fairmor
at $7,979 each and for Ford LTD vehicles at $9,403 each. No
bids were submitted in response to a subsequent City bidding �
procedure. He indicated that the Fairmont is not an acceptable
vehicle for police use from a size or safety standpoint and
that an additional $700 per vehicle would be required to replae
rollbar/prisoner cages which are presently mounted in the
existing squads. The existing cages could be mounted in the
LTD's. He therefore r�cbmmei�ded that the Council authorize �
the acquisition of two 1982 Ford I.TD's.
Councilman Losleben moved to authorize Chief Thul �to purchase
two 1982 LTD squad cars through the Hennepi.n County Cooperative
Purchasing Group for a unit price of $9,403.00 each.

Commission were present to discuss the cable television issue

Public Works Director Danielson reviewed a Mn/DOT letter callit

MINUTES
February 9, 1982
The regular meeting of the Mendota Heights Park and Recreation C mmission
was called to order by Chairman Bayless at 7:35 P.M. The follow ng members
were present: Bayless, Stein, McMonigal, Doffing, Gustafson, Wi liams,
Literski. Schneeman was excused.
2. A quorum was not available for the January 26, 1982 meeting thuslttie agenda
for that meeting was carried over to this meeting.
3. A motion was made and seconded that the minutes of the December $2, 1981 meeting
be approved as read. Motion carried. �
4. Literski reported on the status of rink maintenance. He reporte that there
seems to be little vandalism this winter. Rudy suggested that w might
possibly want to look into a less expensive to operate lighting ystem for
the rinks. He also reports trouble with the breakers with the p esent system.
5. The commission voted to table the update of the Trails Plan pend nu further �
direction from the City Council covering purpose and need.
6. A motion was made and seconded to send the letter drafted by Cha rman Bayless
to the County Plannin� Service. Motion carried. (Copy to Cou ci1).
7. A motion was made and seconded to send the letter drafted by Cha rman Bayless
to the Mendota Heights Police Chief. Motion carried. (Copy to ouncil).
8. Chairman Bayless will attend the February 16th Council meeting. Commissioner
Stein will attend the March 2nd Council meeting.
9. In the election of off icers f or next year, Bayless was elected C airman,
Stein was elected Vice-Chairman and Doffing was elected Secretar .
10. There was considerable discussion concerning the amount of inter
on the Special Park Fund. Chairman Bayless will talk to Mr. Joh
Shaughnessy and seek guidance from the Council if necessary.

At its December 22, ].981 meeting, Che Mendota Heights Parlc and Recreation
Commissa.on, zn a resolution to the City Council, asked that the Pal'ce, at
least once during their evening natrols, drive into the parks where er possible,
stoppin� at the hockey rinks for a few minutes and every ance 3.n a hil.e gazng
into the warming hous�s. The Council, at its next meeting, directe that we
pursue �his directly with the department, hence �his Ietter.
Tha.s resolution was brought abaut because severa�, members of t e commission
have observed vandalism, the suspected smoking o£ marijuana, the us of alcohol
by minors, etc. In additi.an, the rink attendants report bullying a the
younger children, insubardinaCian, vandalism, and the use of alcaha and dru�s.
We don't need any of these things in our parks. a
Therefare, we the members of the Park and Recreation Commissio
that such patrols wauld do much to curb vandalism, th� use of ille�
the use of alcohol by minars and o�her iilicit activities. In adda.
feel such patrol.s would provi.de excellent public relations with th�
peaple and give addiCional conf idence to the parents in the safety
and especially our park system. �I

suburb, but cae feel �hat this aspect of the city's prablem be add

rIRE RUNS: The department made 11 ca].ls during the month, three residenc�.al�.
and one commercial were included. The commercial call was on January 10 th t
Mendota P1aza�for a�rozen sprinkler line in an unaccupied section of ttie '
building. The first residen.cial call was a chinnney �ire on Jan Ilth, the ;
second a frozen sprinkler at Eag1e Ridge Condo on the 16th and the third 'a
smoking firep3.ace on the.30�.h. The las� call was �he result o� the owner `
forgetting ta'open the chimney cap before s�ar�ing �he fire. None of the
s�Gructure ca11s resulted in fire loss. Three rescue ca31s were answered
duri�g'January, the first was a three car'injury accident an the M�ndata �
bridge where the Lukas tools were used �o free one of �he victims. The sec-•
an.d call was on �the 21st to assist the pola.ce department with` an acciden�
west of Lexington on Hiway 110. A cattle truck driver had a heart attack, .
the vehic3.e 1,eftx' the roadway and turned aver, the department assist in re-- •
moving the va.ctims from and vehicle and administered CPR. TYie vic�im, fram
Wzscansin, was dead upan"arrival at DR Hospital. On the 29th we were called-�
Circl� Air Freight, for a man caught in a conveyor, his leg had;been freed
upon arrival, assisted in�laading in ambulatace. ' �

TRAINING: The training session of two hours was divided into 3 classes of
40 minutes each. A CPR refresher class was given, using the equipment t2iat
has been purchased by the firemen. The second class was on the proper use
a� the radio equipment,,both mabile and hand held. The th�rd class was on
defensive driving. State laws dealing with driving emergency vehicles and
tips on their operatian were discussed. ,

There was a total of ten (10) hours d�voted to training during December, 1981.
Sgt. Wicks and Officers Plath, Olmstead, Blackfelner and Reyes each attended a
two hour training session regarding updates in the new laws passed by the most recent
legislature. The training was conducted through the Dakota County Police Training
Coordinator's Office by the Dakota County Attorney.
Michael Hentges completed his internship period with the police department during
December, and as a result received credit towards his law enforcement degree from
Inver Hills Community College. Michael's primary duty while interning with us was
to check the homes of people who have called the police department and asked that
their homes be checked while they are away. He also performed many other duties which
greatly benefited the police department. ,
Due to dissatisfaction with the 1982 police squad car bid awarded by the Hennepin
County Cooperative Purchasing Group, I advertised for bids for 1982 police squad
cars. No bidder responded to the request for bids, and information received from
dealerships indicated that the reason they were not bidding was that there was a bid
guarantee requirement specified. As a result, I advertised a second time for bids
not requiri'rig a bid guarantee. Those bids are due the first part of January, 1982.
When received, they will be compared with the cost and quality of equipment available
through the Hennepin County Cooperative Purchasing Group and if satisfactory, I
will be submitting a request to the City Council for the more appropriate 1982
squad car.

At the February 2nd Council meeting, the Council reviewed an ap lication
for setback variance submitted by Gary Prokop. No action was taken ending
contact with Bil1 Strub with reference to the setback provisions con ained
in the plat covenants. '
I spoke with Bill on February 3rd and was informed that Mr. Pro op had
made similar contact shortly after 8:00 A.M. the same day. Bill adv sed me
that Mr. Prokop must get the approval of every Crown Point lot owner Uefore
the covenant provision can be waived. He informed me that he had pr viously
seen the structure and noted the setback violation. Because of the ocation
of the lot, he did not believe the setback intrusion would create an hardship
for other lot owners. He also advised me that he is in sympathy wit the Prokop's
and would support Mr. Prokop should other lot owners contact him -- ut only
insof ar as it will not jeopardize his position with regard to the co enants
in the future.

GENERAL SYNOPSIS OF 1981 FIRE DEPARTMENT OPERATI
:
NO DEATH, NO INJURIES.
We are very happy to start this portion of our report by stating that
we went through the year 1981 without having a fire related death or serious
injury. We can also report that none of the fire fighters received any seri-
ous injuries while answering a total of 122 calls.
We did experience an increase in the total estimated property loss to "
fire from tf�e amount of $78,450 in 1980 to $120,850 in 1981. We fought �
three major house fires in the last 4 months of the year that account for
$86,000 of the total loss.
NUMBER OF CALLS DECREASED.
Total calls received in 1981 were decreased to 122, this is 41 fewer than
the 163 calls answered in 1980. The percentage of contract calls also de-
creased from 22.7% in 1980 to 18� of the total calls in 1981. The City of
Mendota dropped from 10 calls in 1980 to 3 calls in 1981. Sunfish Lake
dropped from 14 calls in 1980 to 8 calls in 1981. Lilydale decreased 2 calls
from 13 in 1980 to .11 in 1981.
TREND.
A review of the "situation found" section of the Fire Calls Statistics
Study reveals several interesting trends. A total structure related calls �
has dropped from 28.8q in 1979 to 12.3% in 1981. This breaks down into 10.8%
in commercial calls in 1979 to 4.1% in 1981, and 18% for residential calls in
1979 to 8.2� in 1981. A second noticeable change is the percentage of false .
fire alarm system calls. In 1979, 10.8% of all the calls received were false
systems calls. In 1980, 14.1% were false systems calls. In 1981, 24.6% of
the 122 calls received were false fire alarm systems. This percentage breaks
down in 1981 to 10.7% of the total calls were commercial false calls and 13.9% �
of the total calls were residential false system calls. One reason for the
increase in the percentage of this type of calls is the added number of alarm
systems being installed in the city. The average out-of-pocket expense for
a false alarm call would be about $180.00, this would break down equal be-
tween wages and truck expenses. The cost of o�perating a fire pumper is esti-
mated at $40.00 per hour.
The third noticeable trend is the increase in the number of,non-fire
responses. This has increased from 48% of the total calls in 1979 to 74% of
the total calls in 1981.
A new statistic starting in 1981 is that of rescue calls. We made a total
of 7 runs during the year. Six of the calls were for vehicle related accidents
and the 7th was a water rescue call to the Lilydale Marina, our services were
not required. The damaged cruiser was able to make it to the harbor on its own.
RESPONSE TIME.
The average response time for the first vehicle on the scene
increased slightly from 5.77 minutes in 1980 to 6.18 minutes in 19
average response time for all Mendota Heights calls was 5.90 minut
to 5.33 minutes in 1980. The response time to the area north of W

We answered 8 calls during February, none of the calls resulted in

different ty.pes and applications of systems along with the proper procedures
used in responding to sprinkler calls was studied.
May, 1981.
There was a total of 9 calls during May. Only one call resulted in pro-
perty damage loss, a$1,000 vehicle fire. The department also assisted at a
fatal vehicle accident, the location was 'Jictoria and Kay Avenues.
Training for the month consisted of a two hour smoke drill on the Glewwe
property. A special four hour drill later in the month provided suppression
and fire control practice.
June, 1981.
' There were 14 runs during the month with no structural loss, one car fire
resulted in a $5,000 loss.
Training for the month of June consisted of smoke drills held at the Charles
Perron house on Highway 55. Crews took turns entering with hoses into the smoke
filled house and retrieved victim designated objects. •
July, 1981.
One structure fire was extinguished during July. The department was called
to Sibley High School for a small fire in the hockey warming house. Damage was
estimated at $450.00.

On December 27th we responed to the third and final major residential fire
for 1981. The call was at 536 Fremont Avenue, Mr. and Mrs. Zapata came home
from a Christmas holi'day to find smoke coming from the windows of their home.
When the first pumper arrived on the scene, flames were coming from the dining
room windows. The fire had burned for sometime before it was discovered.

away:' The entire house received heat and smoke damage. The estimated loss
was $35,000.00. The department was able to keep the flames from spreading to
the second floor and attic. The exterior walls, except for several windows,
and the roof were not damaged by flames.
Training was divided into three 40-minute sessions. CPR, self-contained
breathing apparatus, and Lukas rescue tools were covered.

Personnel
During 1981 the Mendota Heights Police Department had a total strength f 12 licensed

full-time police officers, 4 reserve/part-time police officers and a fu 1-time clerk/
secretary. � Due to the resignation of a full-time officer in late Dece er, 1980,
a vacancy was created and that was filled by the appointment of Mario R yes to the
position of full-time police officer in early January, 1981. There wer no other
personnel changes, or actions, during 1981.
During 1981 the Police Department had three (3) college interns from In er Hi11s
Community College perform an internship with the department. Robert Wi sor, Kenneth
Mikle and Michael Hentges each performed 150 hours of volunteer service while,
interning with us, and as a result received credit towards their Law En

has accepted the position of Chief Deputy with the Dakota County Sheriff's Department,
and will be leaving in late February or early March, 1982.

As in the past, the great majority of police training provided to the officers is
provided by the Dakota County Police Training Coordinator. The police training provided
by that office is all approved by a committee of the Dakota County Police Chiefs and
is of extremely high quality. Also, whenever possible the instructors for the Dakota

County Police Training Coordinator are police officers from Dakota Coun�y who are
certified as instructors with the State of Minnesota. Chief Thul, Sgt. Wicks and
Officers, Plath and Mack have all served as instructors at several of t e Police
Training courses. In addition, all training provided by the Dakota Cou ty Police
Training Coordinator has been approved by the Minnesota Peace Officers
and Training Board as approved police training, and it is all credited �owards the
yearly continuing education requirements of full-time peace officers in the State

Crime Prevention
As in 1980 the Mendota Heights Police Department was unable to assign
any significant time regarding crime prevention duties during 1981. Pa
prohibited the reassignment of an officer, even on a temporary basis.

Operations

The pa�.ro2 officers continue �o exercise their choice to bid for shift preference
based on seniori�y as provided in t�heir Iabar agreement, and the policy of officers
working permanen� shifts continues. �`here has been a change, however, in the
indiuidual officers who are warlcing certain s%if�s and at present, and during 198I,
Ofiicers Plath, Olmstead, and Black.felner worked all day shifts; Officers Bridger,
Reyes and Anderson worked the middle shifts; and Officers Arndt, Vaillancourt and
Mack worked all night shifts. In 1982 the shift preference is continuing and the
officers have9elected to bid for shifts only once each year, so they wi1.1 continue
working the same shi�ts for the entire year 1982,
Equipment and Faci2ities
In the spring af 1981 the Police Department toolc del.ivery of three (3} 1981 Chevrole�
Malibu sedans which were immediately put in service as marked patro3. vehicles. These
were the first palice cars purchased through the Hennepin County Cooperative Purchasing
Graup of which the Ci�y oi Mendota Fieights i� now a member. A�ter delivery of the
new vehicles, the two (2) ].980 Chevrolet Malibu sedans whi.ch were previausly being
used as marlsed patrol cars were converted ta unmarked cars for stafE and administrative
purposes.

Also during 1981 the City made use of the auction facilities available o m�mbers
of the Hennepin County Cooperative Purchasing Group, and w� disposed of three (3)
used squad cars through auction. The return on the sale of the three v hicles at
the auctiQn caas considerably more than would have been received had we ttempted to
sell the vehicles on our own. '
One of the vehicles disposed of at the auction was a 1979 Dodge which
provided to the P•lendota Iieights Police Department by the City of Lilyd

marked police patrol vehicle. To replace that vehicle, and as a condi
Police Service Contract with the City of Lilydale, one ot the 1981 Che
�' purchased last year is being paid for entirely by the City of Lilydale
three year period. There was no increase in the total number of polic
purchased by the City of MPndota Heights itself for 1381.

Radar Unit belonging to the Mendota Heights Police Department, a new KR 11 Moving
Fadar Unit was purchased by the Police Department and put in service in 19a1. The
KR-11 Radar Unit is the latest in the state of the art in Moving Radar nits, and
its addition now gives us two KR-11 Moving Radar Units in service in th two primary
squad cars used for patrol duties.

JOINT RESOLUTION FOR THE MINNESOTA METROPOLITAN REGIONAL RAIL AUTHORITY "'
The following resoiution was offered by Camiissioner -
and seconded by Cortmissioner
WHEREAS, under the provisions of Laws 1980, Chapt�r 6i6 (Minn. Stat. Sections
398A.01 to 398.08} the legislature of the state of Minnesata has provided a •

means whereby counties, with state and federal aids as may be available, are .

authorized to organize, by joint resolution, far the purpose of preservin.g � �
t
and improvinq local rail service for agricuiture, industry, and passenger �
traffic when determined to be practical and necessary for the pubiic welfare;
and
WHEREAS, the counties of Anoka, Carver, Dakota, Hennepin, Ramsey, Scott and �
Washington, all bodies politic and corporate under the laws of the state of
Minnesota, have determined that a regional rail authority acting under Laws �
1980, Chapter 616, is practicable and necessary for the acquisition of aban- �
doned railroad rights-of-way within the seven county metropolitan area and that
the preservation of such railroad rights-of-way is in the best interests of the
public welfare; and
NNEREAS, the counties participating herein are desirous of establishing an
organization for the purpose of advancing the objectives and powers of Laws
1980, Chapter 616, and at the same time, maintaining, to the extent feasible
and practicable, the autonomy and authority of the participating counties �
herein; and �
�NHEREAS, notice of public hearings upon the adoption of this organizational
resolution has been published in the official county newspaper of each of the
participating counties and has been mailed to the governing body of each muni-
c5pality within each of the participating counties, all at least 30 days before
the hearings before the governing bodies of each of the counties. as required
by laws 1980, Chapter 616, Section 3;
BE TT RESOLVED:
i. That the I4innesota Metropolitan Regional Rail Authority is
hereby established and organized under the Regional Railroad Authorities ,
Act, Laws 1980, Chapter 616, as a po7itical subdivision and local govern-
tnent unit, to exercise thereunder part of the ���Preian power of +hP
5tate. in conformity with the provisions of this resolution for the

2. That the participatinc counties adopting this organization-

Authority shall apply, and the respansibilities shall be borne equally •
' within the territorial jurisdiction of such authority, as provided in
Laws 1980, Chapter 616. upon a majority vote of all menbers of
The Authority. If authority is exercised to acquire or dispose of
real property by pu"rchase. gift, devise. condennation, conditional sale
lease, lease purchase. or otherwise, to acquire or dispose of personal
property whose value exceeds the sian of $ 25,000, to issue bonds
or other obligations however designated, to accept, contract for, or
receive and disburse federal, state, or other funds or property, public
or private. made available by loan, grant, or lease, or to enter into
any agreenent authorized by Minn. Stat. �398A.04, subd. 9, such
majority vote shall include at least one affirmative vote from each of
the designated service areas. Before a service area can be included
within the taxing district allowable under Laws 1980, Chapter 616, all
Camiissioners serving on The Authority from the service area where the
. levy is to be made shall cast affirmative votes to a11ow the levy.
Nothing herein shall be construed as preventing less than all of the
service areas fran constituting a taxing district under Paragraph 6D
herein. The exercise of any of the above powers under this provision
sfiall be done only after consultation with each County Board represented
by a service area.

Cray Research, Inc. (the "Company") pursuant to a Trust Indenture
dated as of May l, 1978 (the "ariginal Indenture"} between the
Ci�y and Fa,rst Trust Company of Saint Paul (�.he "Trustee") and a
Loan Agreement dated as a� May l, 1978 {the "Original Loan
Agreement") be�.ween the City and the Company. The 5eries 1978
Bonds are secured by a Combination Martgage and �ecurity Agree-
ment dated as of May l; I978 (the "Original MQrtgage"j and a
Guaranty Agreement dated as o� May l, 1978 (the "Original. Guar-
anty") from the Campany ta the Trustee. The City ha� a3.so issued
its $3,500,000 Temporary Iandu�trial Development Revenue Bonds

The bi11 amends ihe municipal p3anning act to prav:de tha� a city may n t prohibit
manufactured homes (until last year, known as "mobile homes"), which ot erwise camply
