Mayor Lockwoo called the � meeting to order at 7:30 o'clock P.M. The following members were present: Mayor Lockwood, Councilmen Hartmann and Mertensotto. Council man Losleben had advised the Council that he would be late. Councilwomen Witt had notified the Council that she would be unable to attend, ADJOURN Ayes: 4 � Nays: 0 Mayor Lockwood turned the meeting over to Assistan County Assessor Bill Peterson. Mr. Peterson advisecl that he and several other assistant assossors were present to review 1 82 estimated market values. He advised that all residential pr perti s nd condominiums in the City were given an across the oard 1 Oa ��� increase in valuation over 1981, that townhouses w re r va ed and there is a 10� increase in market value of co ercial structures. He then asked for general questions f om the audi- ence, advising that the County representatives wou d discuss specific questions relating to individual valuatio with the property owners later in the evening. ! Councilman Losleben arrived at 7;45 P.M. Mr. Peterson explained the factors used in evaluti g properties and advised that the estimated market value is app oximately 85� of the market value of properties. He answered se eral questions from the audience. In response to a question from an owner of an Eagle Ridge condominium, he advised that the Asses or's staff would be willing to meet with the condominium owners and review the valuation procedure to determine whether an adjust ent in the valuation piiilosophy for the structures is necessa y. Mr. Peterson and the representatives from the asse sor's office met individually with all of the members of the au ience. He stated �hat the propased irnprovements wauld include repainta.ng a calor scheme for the entire center; painting the rear of the 1center to�match the fu11 calor scheme; enclosing the raof units and trash areas; cleaning up the rear entrance and redoing the entry vestibule; and repairing some of t ceiling tzles. The carrigated me�al facade needs repairing as i� is full of hales from previous signs being taken down. He noted tht they will do a first class job of bui].ding and repair- �f•ing. �Councilman Mertensotto suggested that a game room area ' should noC be considered in any remaining vacant space. There was some discu�ssian as to allowi.ng window signs and Sheehy notec2 that there was a lack of golicing an thezr part, but that this will be manitored more closely in the future. The Cauncil felt that staff should work wi�h Mr. Sheehy on a developer's agreement and Mr. Sheehy stated that obtaining a performance bond would b� no problem. He n,oted that MGM '.. Liquor would be ready to'open in 60 to 90 days after the remodE ing is complete."' Ayes: 5 Nays: 0 MENDOTA INTERCHANGE The Council acknowledged receipt of a handout notice for a public PROJECT hearing to be conducted by Mn/DOT on June 22 at 7:30 P.M, at St. Peter's Church in Mendota, regarding the proposed Mendota ; Interchange project. No action was taken. MISCELLANEOUS 'The Council acknowledged receipt of a handout letter from � Norbert Berg, commending Chief Delmont for his professionalism in dealing with a recent situation. MISCELLANEOUS City Administrator Johnson read a memo from Chief Delmont relativ to a runaway semi-truck and 82 year old Rollo Ransier, who tried to stop the truck and received minor bruises. Mayor Lockwood noted that any member of the City Council who wished to commend Mr. Ransier for his action should call him, but that no public action should be taken. MISCELLANEOUS The Mayor again noted that Council letters of concern or notes regarding the Sheehy Mendota Plaza property and proposed improvements should be directed to City Administrator Johnson G that they would like to consider a 15 minute tour of the Mendota Plaza at the next Council meeting, possibly meeting at the shopping center at 7:15 P.M. TENNIS COURTS VAN LANDSCHOOT Ayes: 4 Nays: 1 Witt Park and Recreation Commission Chairman Tom Bayless was present in the audience and noted that the tennis courts have been resurfaced and that there were no other matters to discuss. There was some discussion on the Van Landschoot case and City Attorney Winthrop noted that a decision is needed by � September 9th. After further discussion, Councilman Hartmann moved that the City Attorney be directed to appeal the court's decision in the Van Landschoot litigation. Councilman Losleben seconded the motion. ELEVATED WATER The Council acknowledged a memo from City Engineer Kishel STORAGE outlining the proposed repairs to the elevated water tank. Mr. Kishel explained how the repairs would be done. The work will be completed in September, 1982. •� ASSESSMENT Engineer Kishel noted that Northland Drive and the DuPont Addit HEARINGS improvements would be assessed this year and the possiblilty that the Pilot Knob Road improvements may not be ready for assessing until next year. He briefly explained the discussions he has had with Mr. Toomey, the owner of the Stan ard Oil Station on the corner. He also noted that he had set p a meeting with Mn/DOT representatives, Wilder representatives and himself, Administrator Johnson and Planner Dahlgren, fo a discussion on the matter for Monday, June 21st, at 2:30 P.M. He suggested that other interested Council members might wi h to attend. It was the concensus of the Council to hold an adjourned meeting at 2:30 P.M. on June 21st to discuss the inter ection and related matters. Councilman Losleben,noted that he, as a repres ntative of the Cable TV Commission, would be preparing a posi ion paper regarding Cable TV. He wondered whether he should have n endorsement from the City Council. It was decided that he woul send copies of his position paper to the other Council member for their reaction before submitting his paper to the Commission. Berg Code Enforcement Officer SUBJECT: Building permit for Pabst Meat Supply ,., Harrison Developement, Inc. has submitted plans to do some in erior remodeling of Pabst Meat Supply located at 1455 Mendota He�ights R ad. The work will consist of filling in a four•foot recessed loading dock area��with- in the existing building walls with compacted fill, installing ne floor drains, a new concrete slab and to construct masonry walls to for two rooms in the area. The smaller room will be used to store and wash bone carts. he larger space will be used to receive fresh meat and ship finished products. Although the permit has no effect on the exterior of the stru and may seem insignificant for the Council to review, but the pre zoning ordinance requires that ali permits applied for in the ind zone receive Council approval. I would recommend that Council grant approval for this remode project subject to the general and sub-contractors being properly in Mendota Heights. He did point out the fact that the Friendly Hills Park sign does not meet the City setback ordinance requirements and with land- scaping, makes visibility quite difficult. He questioned that if this was allowed, he should be allowed to install his fence on the corner of his lot, He also noted that Somerset 19, on Dodd Road and Wentworth, had placed several large evergreens on the corner which made for difficult siting on that corner intersection. After a great deal of discussion concerning the misplaced easements, along with the house to the rear being on a portion of the utility easement, Commission member Butler recommended setting a public hearing for the fence for the July 27th meeting, to consider the conditional use permit for the subject property. Frank seconded the motion. Voting: all ayes. It was also the concensus of the commission that staff should check out the matter of the drainage problems and utility easement and address these concerns at the next regular meeting. Another matter that needs correcting is the house to the rear of Mr. Baskf ield's. CASE 82-12, ROTH, Mrs. Margaret Barret, real estate agent, and Mr. Norman Roth, LOT SPLIT part owner of the proposed new lot, were present to explain their request to reduce four 60 foot lots to make three 80 foot lots. Mr. Roth lives at 660 Second Avenue and the other owner, Mr. William Johnson, lives at 666 Second Avenue and the new lot would be between these two addresses. The new lot would consist of one 80 foot lot, which they have a buyer for. This case came to the Commission without benefit of staff or planning reports. The reason for this was because the County apparently had accepted the lot split, without City authorization and the buyer was anxious to buy and build on the lot. The surrounding property owners had submitted a petition authorizing the selling of the lots to make the new one. The new lot will consist of the east 40 feet of Lot 4, and the west 40 feet of Lot 3, T.T. Smith Subdivision No. 3. It was noted that the or,iginal platting was for all 60 foot lots. This proposed new lot would be 80 feet by 125 feet, which does not meet the 70% minimum lot size requirement. After further discussion, Burke moved, seconded by Butler, that thelpublic hearing requirement for the lot split be waived, and recommended approval of the lot split, subject to notification of the propert owners within 350 feet of the subject parcel, that this request would be before the City Council for approval on July 6th. They are planning on building an office complex next year. These development plans require additional fill (-� 40, 00 C.Y.). This required fill is presently available from the I-494 construction pro= ject. Buesing Brothers is the Mn/DOT contractor on this portion o the freeway and would a7so do the work of providing this fill. Because the fill amount is greater than 400 C.Y. it requires Con- ditional Use Permit and because a portion of the block is designat d as a Wetlands area it requires a Wetland Permit. Ed and I have reviewed the proposed fill concept and find no eason not to allow it. The City storm sewer in the area is adequately d signed to accomodate all the surface runoff and no on-site ponding is nec ssary. At the time of pl tting it was noted that this lot and several others in Rolling Green Ad�iiti n would need Wetlands Permits. The plan Mr. Dobie submitted seems to be very appropriate for the site. The home is set at the proper elevation not to be flooded and the olding capacity of the pond will not be encroached upon. Mr. Dobie should be reminded of erosion control and his respo sibility to remove any soil he allows to flow into the pond. The property in question is Lot 10, Block 3 of the Rolling Green� approved by the Planning Commission and Council about two years Plat as igo . Prior to the platting and development of the land, there existed a pond on the site which was incorporated into overall wetlands drainage s stem. . This pond was retained as interim ponding and a part of the drai age system for the future and was incorporated into the Preliminary and Fin 1 Plats accordingly. The City has a drainage easement for depositing wa er in this pond which runs to approximately Elevation 862. 2, When the Preliminary and Final Plats were reviewed, it was appar the development of structures on the residential lots on the nor side of this pond would require Wetlands Permits. The lots, as notice, are 150 feet in depth, a portion of which is in the pon itself. The developers and the City discussed the possibilities blanket variance to the Wetlands requirements for these lots, bu ultimately decided that each lot would be reviewed on its own me individually as actual development proceeded. 3. This, then, is the first lot in this area on the north side of th be developed under these conditions. The site plan as submitted the nearest portion of the house to the ponding area to be 56.4 whereas 100 feet is the normal standard. Thus, they are seeking of 43 feet, 8 inches. It would appear obvious that this reducti setback will not have a deleterious effect on the ponding or dra capabilities inasmuch as the City's easement line which represen maximum level of the ponding function is about 36 feet from the portion of the residence to be constructed. • 4. At that time he received information on costs he would incur and n the procedures to follow. Mr. Roth did not want to spend the time or money involved until he located a buyer for the lot. His realtor was u aware of the need to get,City approval for the split and already receiv d County approval. Staff in an effort to expedite this matter because of the Co error put the matter before the Planning Commission without repor prepared.
