of a public hearing on an application frorr the Northland
Land Corrq�any for a conditional use permit for the filling
of Block 3, Mendota Heights Industrial Park.

graphics. He explained that the request is for a conditio�
al use permit and wetlands permit for an area bounded
by Mendota Heights Road, Northland Drie, Pilot,Knob Road
and Transport Drive. N�. Burkhards advised that Northland
�is,contemplating developing the property into an office/
. �office-warehouse parlc with a mix of one story structures
along Mendota Heights Road and one to three story structurt
in the balance of the block. He advised that Block 3
does not lend itself to single story structures because

and that the proposed new fixtures will throw the light
down, not broadcast it as is the current situation.
It was the concensus of the Council that the remodeling
as shown in the drawings submitted with the permit request
would not affect the original conditional use pennit
as long as it is not the intent of the owners to provide
for a future convenience store, which would be a violation
of the conditional use, and which would not be allowed
by the Council.
After discussion, Counci]man Losleben moved approval
of the issuance of �a building permit for the Surfco
station�with the understanding that the conditional use
permit is not affected since the structure is still
retained in its origi.nal ownership and since there is
no change in the conditions of that permit, and also
approval of tlie lighting as presented in graphics and
photographs presented to the Council, all based on the
understanding that the owners' only intent in requesting
the permit is to change from a full-service to a self-
service operation.
Councilwoman Witt seconded the motion.
Administrator Johnson advised the Council that bids were
received at 10:00 A.M. this morning for the acquisition
of a truck cab and chassis to be modified into a tanker
truck for the Fire Department. He advised that only
one bid, that of'Boyer Ford for a 1977 LN800 was received
in response to the advertisement for bids. Me�ers of
the Fire Department truck committee were present and
recomr�nded awarding the bid to Boyer.

After a brief discussion, Counci]man Losleben moved to
award to the bid for a truck cab and chassis to Boyer
-��� '-, Ford for their bid of $12,900 for a 1977 LN800 cab and

by equipment certificate revenues.

FIRE STATION The Council acknowledged receipt of preli minary pro-
posals from several architects relative to construction
of a new fire station, along with rating sheets preparec
by the City Administrator. It was the concensus of the
Council that after each Council m�mber corr�letes and
submits a rating sheet the three firnis receiving the
best ratings should be invited to submit more specific
proposals and be interviewed by the Council.

� RESIDENTIAL The Council acknowledged receipt of a memo from the

, It was the concensus of the Council that a letter should
be sent to all property owners on the inventory, pointing
out the activity which has been observed and giving them
the opportunity to correct the situation before any furthe�

MISCELLANEOUS The Council acknowledged receipt of a letter from the
Association of Metropolitan Municipalities acknowledging
receipt of the City's annual dues.
MARIE AVENUE BIKEWAY The Council acknowledged receipt of a letter and resolutioi
adopted by the County Board approving funding for'the
bike path along Marie Avenue from Lexington to Victoria.
It was acknowledged that the maximun $14,000 in funding
will be based on City participation in a joint maintenance
agreement. Staff was directed to pursue such agreement.
911 Administrator Johnson advised the Council that a presen-
� tation on the "911" system is available to the City.
The Council asked that the slide presentation be made
at the July 20th Council meeting.
CABLE COMMISSION The Council acknowledged receipt of the minutes of the
June NDC4 meetings and the agenda for July 7th.

IVY FALLS FIRST The Council acknowledged receipt of a letter from Sanders and
ADDITION Associutes on behalf of Mr. Ellis Abrahamson, 714 Maple Park Court
relative to drainage problems affecti.ng his property. Mr. Larry
Wacker, from Sanders and Associates, Nh�. Abrahamson, and N�.
Lloyd 9nith, 716 Maple Park Court, who had also submitted a lette�
regarding the drainage problems, were present for the discussi�.
Mr. Wacker stated that he has seen the feasibility study on pro-
posed street and drainage improvements prepared in 1979. He
acknowledged that he is aware of the history and project rejection
but advised the Council that the Abrahamsons are suffering hard-
ship due to the lack of drainage controls, and gave the Council
several exam�les of those problems. He stated that Mr. Abraham-
son would like the City to construct a total in�rove�nt project
in the Ivy Falls First Addition, including curb and gutters on
the cul-de-sac. Mr. Smith indicated to the Council that he would
only support a complete project and felt that there should be
some Council discussion which would result in a solution to the
problems suffered both by the Abrahamsons and himself.
Mr. Abrahamson advised the Council that whenever there is a heavy
rain, water comes down the cul-de-sac and heads directly towards
his front door and he must sweep the water away to avoid damage
to the first floor of his house. He asked the Council to take
some action to resolve the drainage problems.
Counci]man Losleben pointed out that not only is drainage, but
the streets are also in very poor condition. He suggested that
the Council direct preparation of a new feasibility study.
Mayor Locicwood moved the adoption of Resolution No. 82-`.� ,
"RESOLUTION AUTI-IORIZING AND DIRECTING PREPARATION OF FEASIBILITY
STUDY F1�R IVY FALLS FIRST ADDITION DRAINAGE AND STRF��'I'
IMP�VII"IENTS," directing that the City Engineer collect and study
data prepared in 1979 and make a recorm�ndation to the Council
at the August 3rd meeting.

AIRPORP LAND USE Planner John Shardlow was present to review and update the
COMPATIBILITY PLANNING Council on the airport land use compatibility planning process.
Mr. Shardlow advised the Council that Mendota Heights cannot
live with what is currently being proposed by the Metropolitan
Council staff and that he will represent the City at the July 27th
Transportation Subcomnittee meeting.
Councilman Losleben suggested that the City try to initiate a
meeting of the Joint Airport Zoni.ng Board.
CONIMISSION Mayor Lockwood advised the Council that Planning Commission

PROPOSED IiSE HEARING
WHEREAS, the City of Mendota Heigh�s receives Federal Revenue hari,ng
monies under the provisions of the State and Laca1 Assistance Act o 1972
(PI, 92-512} ; and
W�iEREAS, PL 94-4$8, Fiscal Assistance Amendment of I976 amends the
ori.ginal Act by including, among other items, additional public hea ing
requirements; and
WI3EREAS, it is the intent af the City afficials both to meet a 1
federal requ3.rements and to solicit citizen input on use of en�itle ent monies;
NOW THEREFdRE IT IS HEREBY RESOLVED by the City Council. of the City of
Mendota Heights, that a public hearing be established for discussio of proposed
use of Federal Revenue Sharing manzes; and
BE IT FURTIiER RESOLVED, that said hearing shall be conducted a 7.30

CASE ��'$2-13, FEDERAL Mr. Vern Colon, from Federal Land, was present to request a

the neighbors to satisfy their concerns and he presented a

Mr. Charles Bartholdi, attorney far Federal Land, was present
and noted that there are two issues which he would address. ,

50 feet in the rear and 20 feet in the front, so that the unit
will not be directly in line with Mr. Shaughn ssy's hozne.

Mr. Terry Raddatz, from Trail Road, wondered where the costs
would be assessed, and he wanted to go on record to show that
Wachtler and Trail should never connect.
After a brief discussion, Stefani moved, seconded by Frank, to ,
set a public hearing for August 24th, the next regular Planning.
Commission meeting. Voting: all ayes. '
CASE ��82-15, GETTY OIL, Mr. Phil Larsori, from Suburban Lighting, was present to request,
SIGN VARIANCE a sign variance for Getty Oil, at 1906 Dodd Road. Surfco �
Self-service gas station would like to install the new sign '
on the existing sign base in the same location. The variance �
would be to allow a greater sign area than is presently in ,
place. There was some discussion as to the size and location o3
the price signs on the pylon and Mr. Larson stated that it .
was his belief that Surfco would prefer to place the price sign:
on the building, rather than delay action at this time.

SUBDIVISION &
VARIANCE
After further discussion, Frank moved, seconded by Morson,
to recommend approval of a variance to allow a 46 square foot
new sign and new standard without the price signs on a 15
foot pole. Voting: all ayes. -
TUMINELLY, Mr. Tuminelly was present to request a subdivision to create
three lots out of two existing lots at 1903 Hunter Lane, Lots
1 and 2, Culligan Knoll. He stated that he had had no previous
discussion with Mr. Ted Van the abutting northerly property.
Mr. Tuminelly noted that two of the lots will be 23,000 squar�
feet and the third lot, with the existing home on, is 42,000
square feet. He also stated that a Homeowner's Association
would provide plowing and maintenance for a 20 foot wide private
drive in the site.
Frank moved, seconed by Stefani, to set a public hearing for
August 24th, for preliminary plat approval of the subdivision.
Voting: all ayes.
CASE #82-17, MINN. Mr..Thomas Balyk, was present to request permission
FSL, SUBDIVISION to reduce f ive lots to 4 lots in Delaware Crossing. The
lots are lots 19, 20, 21, 22 and 23, Block 3, and Lots 1, 2, 3,
4, and 5, Block 2, Delaware Crossing. The lots were each
platted in groups of five at approximately 10,000 square foot
per lot. The applicant now proposes to enlarge the lots by
talcing two groups of f ive lots and replatting them into four
larger lots, to accommodate larger residential structures.

AIRPORT NOISE Chairperson Kruse advised the members that he had attended
the July ZOth City Council meeting relative t Airport Noise
and proposed uses for land south of TH 110, e noted that
land use was very restricted in this area and that the members
should keep advised of any new developments o this matter.

from the Northern Dakota County Cable Communi ations Commission
(NDC4), asking if there would be any desire f r service for
the Planning Commission from a Cable Company. He noted that
cable presentations would be presented at the August 4 and

August 1$ Cauncil meetings. No action was taicen.
SWTMMZNG POOL Mrs. Richard Gehrz, 1047 Marie Aver�ue, had been seated in the
EMERGENCY audience since the start of the meeta.ng. She attended the
(VARIANCE) meeting in the hope of receiving help fram the Commissi.on �
members regarding a swimming pooZ that was just under •
construction at her home. She noted that when the Code �
Enforcement 0£ficer made his inspection, he nated that the
excavating was six feet too close to the rear property line ,
and he pl.aced a"Stap Work" order an the cantractor, thus
allowing no further work ta be dane before a variance cauld
be applisd for and eonsidered. Duri.ng the course af the �
afternoon (July 27, the date the inspecti.an was made and work '�
was stapped), a partion of the retaining wall collapsed.
She admitted that the pool was not p].aced in �he correct
place in the yard and should have been correc�ly place� accordir
ta the site p2.an that was being follawed. However she believed
that heavy equipment on Marie Avenue had caused vibrations
which was causi.ng the sand ta shift and sift around and may
have alsa played a part in �he retaining wall callapsing. '
Before the wall collapaed, she had called the City offices �o
set up an appointment with Planner Dahlgren to app�.y for a
variance, but with the emergency nature of the situatian, she �
hoped to get help from the Planning Commission members withaut �
having to wait to be an the August 24th agenda. `
It was noted that her neighbors ta the rear, living an Overlaak�
could not see a.nto the Gehrz backyard, and the Gehrz's could
not see into the Applebaum yard due ta an apgroximately 25 faa�
high hill which was between the two �.ots.
After further discussian Blesener moved, seconded by Burke, to
recommend approval of a si.x foot rearyard vari.ance to a11ow
continued canstruc�ian of a swimming paol. This action was
taken due to the emergency nature of the matter and was based

1. Mr. Baskfield has purchased this residence recently from Minneso
who have taken over the residential properties developed by Augu
Construction Company in the Delaware Crossings project. He prop
construct a wrought iron fence, five feet in height, with one-ha
square iron pickets placed six inches on center. The detail of
fence is illustrated on the site plan submitted by Mr. Baskfield

conditions, Section 4.8(2)c, the Ordinance states that a fence a ong this
rear line may be only 30 inches high on that part of the fence 1'ne
within thirty feet of the public right-of-way ( Ocala Lane), H intends
to build the fence five feet high along this rear property line nd extend
it southerly along the public right-of-way (east property line) o a point
in line with the front of his house.(fronting on Decorah Lane). The fence
would •then extend from this point westerly to the southeast corn r of his
house. This proposed fence location is indicated on the site pl n.
2. Section 4.8 (2)a, requires that any fence within thirty feet of side
street may be a maximum of 30 inches high. Relief from this req irement
requires a Special Use Permit.
3. Attached is a letter from Mr. Baskfield dated 11 June 1982 addr ssed to
the Mendota Heights Planning Commission indicating the reasons f r his
request.
Obviously, Mr. Baskfield is concerned with the close proximity o
that was misplaced in construction that is contiguous to his rea
trespassing, and possible damage to his property, and the locati
future swimming pool. The problems of tr�spassing may have been
influenced by the fact that Mr. Baskfield, as you may have heard
news accounts, is the spokesman for. Northwest Airlines. He indi
during the recent strike he has had a greater than usual problem
malicious damage, That risk, of course, may well not be permane
least due to those circumstances.

4. The existance of the nearness of the contiguous home, plus the utilities
and drainage arrangements in his rear yard, obviously create some unusual
conditions, particularly with respect to the location of a swimming pool.
The Public Works Director will comment regarding these engineering
considerations.
5. Part of the problem with respect to the replacement of the pool is that
the Ordinance requires that a pool to be constructed at least ten feet
from the house. This is to prevent possible drainage problems with respect
to pool leakage, and is a restriction normally adhered to.
6. One of the reasons for requiring the lower fence height on a corner lot
is so as to maintain traffic visibility at the intersection. Section 4.7
of the Ordinance deails with traffic visibility and requires that no
structure or planting exceed 36 inches high that would adversely affect
such visibility on the corner. This distance is normally construed to be
a triangle drawn at a 45 degree angle to the streets at a point 30 feet
perpendicular distance from either street. Thus, if a structure is placed
30 feet from each street, such a triangle will not be infringed upon by
the structure. Such a triangle drawn on this site would appear to require
that the fence along Pontiac Place be moved approximately 18 feet to the
north. This would have the effect of moving the pool 18 feet north
which would appear to be possible without conflicting with the drainage or
easements in the rear yard. We feel that this is an important consideration
inasmuch as it deals directly with the public safety. Though the applicant
proposes to build a fence that can be seen through, if the pool is placed
only four feet from the side property line, it is likely that such a fence
will ultimately be screened to provide privacy either with shrubbery or other
material.
7. Mr. Baskfield proposes a�ive foot high fence because it is the minimum
requirement required for enclosing a pool in a yard. Another adjustment
that might be considered is that of reducing the height of the fence at the
northeast corner of the property, but enclosing the pool at a point further
south with the required five foot fence. You will notice that in Mr.
Baskfield's drawing, that there is such a fence running east and west from
the northeast corner of his house. The fence may be built five feet high
in all locations exc�pt 30 feet from Pontiac Street. Thus, if a lower
fence is proposed within that 30 feet (for which the variance is being
requested) this would alleviate the condition of a high fence next to the
front yard on the property to the narth.
8. It would appear t.hat the case for locating a pool on the property has merit
in being partially in the side yard inasmuch as the rear yard is
encumbered with engineering concerns. It would appear from the.drawing,
however, that the pool could be moved further to the north, thereby
occupying less of the side yard contiguous to the house, and providing for
the traffic visiblity, which is one of the principal reasons f.or the
reduced fence height in the 30 foot area contiguous to the street right-
of-way.

9. Our Engineering Department has checked out the nature of the uti:
that run through the back yard and report that it is an undergrot
electrical service and underground telephon service. Unless ser�
Baskfield residence only, these utilities should�have been placec
easement along the north property line. The drainage swale, Mr.
Danielson reports, does exist running through the back yard, whe�
too should have been constructed within the drainage easement alc
north property line. It would, however, be difficult to change t
drainage condition at this time inasmuch as drainage from the cor
property to the east also runs through this swale. Thus, regrad�
at least two lots would be necessary to reroute the drainage alor
north property line. This is also complicated by the fact that t
residence on the contiguous lot to the north was misplaced, and i

A letter has been received from Wayne Murphy, District Maintenance Engineer
Mn/Dot distxict �%9. Wayne is requesting to be scheduled on the August 3, 1982
councii agenda ta request appraval of a building permit for the maintenance
facility at 2229 Pilot Knob road, (note: the street number is temporary until
such times as the remainder of the M.A.C. property is platted},
MnlDot was before Gauncil on March 2, 1982��or approval of a wetland permit,.
foundatian permit, site plan review, and landscaping plari review. S�aff had
prepared a memo to council addresszng specific requirements some of which I

I have listed above, In addition the planning commission expressed concern ::
directed towards a requirement for dense plantings as a screen along the South
boundary adjacent to the equipment storage lot. pther poin�.s were brought out
cancerning the area are as fallows:
a. The Mn%Dot site abuts a residential zane. A f ence not Iess than 54;per-cent
opaque and not less than 6 feet in height be cons�ructed along the common lo�
line. There is a fence designated on the''�Nofth property line, hawever, ather
than the Iocation details af the praposed fence have not been submitted.
b. Public sewer and water are not avaai.lable for thzs building site at this
time. Mn/Dot has petitioned the city for tho�e facilities last f all, but because
the building is nat schedul.ed for co�zt�letian or occupancy befor� 1982 plans far '
their installatian were delayed. M.A.C. intends ta sell the remaining land to a
developer. staff feels that delaying an improvemant project unta.l after tl�at
sale may be prudent, however, Mn/Dot and Council should be aware that before a
certif icate of occupaney could be issued to MnjDot the required sani.tation facilities
need to be instalZed and functional.
c. The buildings access raad follaws �he proposed alignment far a future city
street and it is felt that the right of way should be dedicated to Che city at
this time.
I have reviewed the plans and specs and f ind them to substan�ially comply with
Iocal codes and ordinances and would recammend that Cauncil grant the building
permit subject to con.tractor licen.sing and carnplience with staff recommertdatzons
listed herein.

1. Dr. Ballard was in last month to discuss a proposal to add a sig indicating
the presence of his dental office in the Mendota Heights Financi 1 Center.
You will recall that he proposed to add a panel under the existi g sign
indicating the location of the Mendota Heights City Hall and the bank.
Based upon advice from the Planning Commission, staff, and consu tation
with others in the building, Dr. Ballard now proposes to constru t a
separate sign easterly o�f the access drive to the general parkin area
as shown on the attached plan, t4embers of the staff and Dr. Bal ard
inspected the site area, and suggestcd that if a sign of the typ proposed
is to $e mounted in the area in question, that the location as n w proposed
would be the most appropriate one.

This places the sign 33 feet east of the driveway, and six (6) f�et from
the right-of-way line of South Plaza Drive.
Another consideration might well be the length of time that the ign is
allowe� to remain. The Commission had discussed the possibility of
setting a termination date of from one to two years. Dr. Ballar has
expressed his concern regarding the establishment of his practic (it
being a new practice), and was willing to consider the possibili y of
the removal at some point in the future when the practice is est blished.
Dr. Ballard reports that at as of this time, no one else in the uilding
desires to have their name on the sign. If that is the case, re oval
as some point, say two year.s, might be aF>propriate for. considera ion.

Thomas Nonnemacher has applied for a Critical Area Ordinance eview
for Lot 4 of the Mayfield Heights Addition. The site plan as subm'tted
has been reviewed by staff in addition staff has made an on site i spection.
The lot slopes to the north and is heavily wooded. The new h me has
been designed to fit the existing grades as closely as possible so only
two trees need to be removed. Very little of the existing vegetat'on on the

SUBJECT: Federal Land Company - P.U.D. Variance Request �
Vern Colon has comissioned different architects, engineers and land- ;
scape designers to develop a new 16 unit P.l1.D. proposal for his 5.6 acre
site on Highway 13. This new plan is not substantially different from the +
townhouse plan submitted in 1981. He has now proposed to eliminate the pool
and tennis court facilities. �
The variance requested deals with a section of the P.U.D. Ordiarice t
requiring a minimum of 10 or more acres of contiguous land.
When this issue was before you in 1980-81 in was learned from the public �
heari�gs that a number of the residents contiguous to the property were opposed
to the P.U.D, concept. In 1980 both the Planning Commission and the City �
Council unanimously voted to deny the P.U.D. Mr. Colon has not demonstrated
to staff that this plan will meet with any greater neighborhood support than ;
it has in the past.
If this variance is approved tonight�a Public Hearing to consider the
P.U.D. should be set for August. If the variance is denied perhaps Mr. Colon '
could be convinced to withdraw his P.U.D. Application.

P.U.D. APPLICATION
1. This project is being designed as a safe, secure, residential
environment. It will feature significant, quality homes in a
park-like setting.
The intended market is of those people, who desire a house wit
individual character within a quiet, shared setting.
. The proposed units will be grouped in clusters to provide as
much park-like open space as possible. These units will be
� located at the top of the site and will terrace down towards
� the highway. By grouping the units in clusters it is possibl
to leave more space open for natural park or landscaping, as
well as the proposed putting green and pond.
2. Should project be approved, financing is arranged with America
National Bank of St. Paul.
3. All of the land within the Proposed Planned Unit Development i
presently owned by Federal Land Company.
4. The expected schedule of development will be to prepare final
design drawings and to prepare construction documents within
60 days of final approval by the City of Mendota Heights. In
response to more specific information relative to construction
scheduling as outlined in Section 19.6 (2) e, the following is
Federal Land Company's intentions. The project will be built
two (2) stages, with 8 units being constructed per stage. Stag
one will commence construction in late fall of 1982, weather
permitting. If the necessary permits and the like cannot be
obtained by this time, then construction shall commence by the
early Spring of 1983. Stage two shall commence construction
within 90 days from the commencement date of construction of
phase one. The development of this project shall be completed
within 9 months from the date of comnencement of construction
of phase one. The total 4 acres of open area shall be complet
phase one. ,
5. The units are set in groupings of 2 residences, giving a total
of 16 over the 5.62 acres. Each resident will have its own

entry-court, landscaped for privacy and rear deck area. To �
accommodate the intended buyers, the homes will be approximately ,
2,000 square feet, selling for between $200,000 and $225,000. ;
6. The cluster site plan allows an open park-like space which � '
separates the housing units from each other. The developed �
area is 16 units X 2,000 square feet equaling 32,000 square
feet. Drives would be equal to or less than the same, leaving
approximately 4 acres of green area.
7. The density per unit is expected to be two people per unit or
32 persons total.
8. The attached units, utilizing a common wall, will conserve on
energy consumption.
9. A tenant's association will be established and as part of the s
duties therewith associated shall be maintenance of the cotnmon ,
grounds. Through past experience, this has proven to be very
successful at preserving a clean and appealing atmosphere. �
10. Based on current data from the Metropolitan Council, the increase
in building permits for townhome developments over the last ten •
years has risen 70� throughout the Metropolitan area, and over
50q throughout Dakota County. This increase substantiates the �
demand for this type of development. The quality construction '
of these units combined with the superior location and the '
internally contro1led landscaping development will make this
development one of the finest in the City of P�endota Heights:

1. Vern Colon (Federal Land Company) has resubmitted the proposal f r a
Planned Unit Development (PUD) for sixteen townhouse units (form rly
submitted as fifteen units) on a 5.6 acre tract of land at the w st end
of Miriam Street, south of Trunk Highway 13.
The PUD Section of the Ordinance requires a minimum of ten (10) cres of
land in order to qualify as a viable submission under the PUD re ulations
as described in the Ordinance. The City's Legal Counsel has adv sed the
variance should be processed prior to consideration of the PUD i self.
If the variance is granted then the PUD plan and other required xhibits
and data can be considered under the Special Use Procedure for a proval of
a Planned Unit Development.
2. The first PUD approved in Mendota Heights in the early 60s was t e Ivy
Falls Townhouse Development. This development utilized the norm 1 single
family residential density in the form of townhouses concentrate on the
easterly end of the property. The westerly end had an extremely high water
table making it difficult to develop. This space was thus pres rved, and
seven acres of it was dedicated to the City for a park. Utiliza ion of
the PUD thus provided a substantial benefit to the community and the
immediate area around the PUD tract. The approximate area of th t PUD was
26 acres. Another early development utilizin� the PUD Principle was that
of Somerset 19, located at the northwest corner of Dodd Road and 6Ventworth
Avenue. In this case, a substantial area of wetlands and draina e capacity
was preserved by concentrating the units in the form of apartmen type
structures containing condominiums rather than the mor.e typical orm of
townhouses.
3. Obviously, as the land ar� involved in a F�articular PUD gets sma11E
potential for achieving the major objective in using the PUD conc
(preserving natur.al open space) rapidly diminishes. If a single
containing two units allowable on a 30,000 square foot tract werE
as a PUD, there would obviously be no potential for any substant:
preservation of any natural amenities. The question then, become
what size parcel encompasses enough land to provide for this poi

parcel in question on an individual cas� basis. We should thus be asking
ourselves, "Is any substantial portion of the amenity being preserved
through the use of the PUD on the property in question in this case?"
4. As you know, Mr. Colon has applied for a single family plat providing for
12 single family lots on the property. Such a plat was approved
distributing the housing units very similar to that of the proposed PUD,
utili.ing a cul-de-sac off Trunk Highway 13, in almost the identical
location of the proposed cul-de-sac access in the PUD design under
consideration. In short, this means that the proposed development is
similar to that of the single family plat in terms of distribution of homes,
with the major differnce being that the housing units are constructed in
pairs (two units per structure), and that the cul-de-sac is a private street
rather than a public street. Looking at it from a standpoint of distribu-
tion of units only, the PUD serves as a method of rezoning the land from
R-1 to R-2 (duplex units).
5. The purpose of providing a variance provision in any Zoning Ordir�ance is
to allow a means of application for relief from a particular standard in the
Ordinance due to a hardship condition caused by some physical property of
the land. In this case, the hardship would appear to be that there is no
way to expand the acreage from 5.6 acres to the required ten (10) acres,
inasmuch as the property is bounded on all sides, either by existing
single family development or Trunk Highways. That represents a physical
condition appropriate for application for relief, but only if it is perceived
that the intent of the Ordinance is achieved through the provision of open
space achieved by dispersing the density in some manner to achieve that
objective. The PUD as now proposed concentrates a higher number of units
closer to Trunk Highway 13, thereby leaving more open space on the southerly
high ground, and in an areas westerly of the cul-de-sac. The plans
indicate a proposal to construct a putting green in the latter area. Does
this offer substantial amenity to be considered adequate reason for the
variance?
6. One of the problems perceived in reviewing the plan is that the concentra-
tion of units near Trunk Highway 13 results in structures being within
nine (9) feet on the east side of the cul-de-sac pavement area and within
12 feet on the west side. This condition can be corrected, but represents
at the moment a mis-use of the flexibility provisions inherent in a PUD
process.
7. The distance between the two structures throuqh which the entrance to the
cul-de-sac passe:> is approximately 46 feet. If this were a single family
development with a 60 foot dedicated street, the distance between the
structures would be 120 feet.

8. We have suggested to Mr. Colon and his associates that they work closely
with the contiguous property owners, and adjust to their concern . As
you know, some of the neighbors in the past have felt that the b nefits
of the accrued open space that are possible in a PUD process, wer not
handled in a way to mitigate their concern. This speaks to the int of
the size of the parcel, inasmuch as if the site did consist of t e required
ten acre area, the location and scale of the open space accrued y
concentrating the density in certain areas could be more meaning ul.
This is, in fact, why the ten acre minimum was established when he PUD
regulations were initially established by the Planning Commissio and
Council.

The new PUD Plans as submitted indicate a concept of unit design that
appear rather attractive. This is, of course, not the issue wit reference
to the variance to the ten acre minimum site size. With respect to that
question, the factors are very similar to that previously consid red.
The principal question is then, does the five acre parcel as cur ently
conceived for development, provide adequate open space amenity ( ither
public or private) that mitigate the impact oi the higher concen ration of
density in various parts of the site? �

The existing service station at this location is proposed to be emodeled
closing-in the existing service k�ays and other improvements with'n the
interior of the structure. They do not propose to convert this pace to
a convenience store. The existing sign consists of 36 square fe t, and
is located within six feet of the right-of-way of Trunk Highway 10 and
within six feet of Dodd Road.
The proposed sign (see attached sketch) would consist of a 46 sq are foot
sign at the top, with two 20 square foot signs on either side of the pylon
pole, equaling a total of 86 square feet. The Ordinance provide for a
maximum of 100 square feet on a pylon.
Additional signs are proposed on the building, all of which are
Ordinance requirements.
2. One of the reasons for approving the original sign in its locati
close to the rights-of-way as constructed, was that the sign was
relatively small, being basically six foot by six foot. Our pri

their business. Our concern is that the hanging of such signs c uld have a
deleterious affect on the single f.amily residential area on the est side

sites was to identify th� brand, and the ��reser�ce of the servic� One
wonders whether c�r not it would be ac9ec�uate to �rc>vic3e for the p ice signs
on the structure itself in accordance with coc�e requirements.
4. The normal setback rec�uir�d for a sign in this district for this purpose
would be 30 feet. The r�quired setback in the Ordinance for ser ice
stations for the building is 60 f.eet. The bui]ding meets that r.quirement.
5. The applicant also indicates the intent to develop new lighting
where th2 source of the light is shielded. The addition of this
will be an asset t� the sik.e compared to its present condition.

PLANNING CONSIDERATIONS: ,
1. The properties in question were platted by August Construction Co pany as
a part of the replatting of portions of Friendly Hills, known as elaware
Crossing, Second Addition. The lots in question were each platt d in
groups of five at approximately 10,000 square feet each, consist nt with
the original lot sizes in Friendly Hills. The applicants now pr pose to
enlarge the lots by taking two groups of five lots and replattin them
into four larger lots. The attached exhibit prepared by Probe E gineering
indicates the ex�sting and proposed lot lines.
2. The properties in question have now been taken over by Minnesota Federal,
who recognize the market for larger homes in this desirable area of the
eity. They are therefore recognizing this much potential, and p opose to
develop the larger lots to accommodate the larger residential st uctures.
3. The drawings indicate the existing and pro��osed services for pub ic utilities
which appear to represent no problem with respect to this adjus ent. It
appears too that the change represent� an increase in quality an
desirability for the homesite and the future residences. It wou d appear
to be consistent with the City's policies and desire for quality construction
in this area of the City.

SUBJECT: Delaware Crossing Second Addition
Minnesota Federal Savings and Loan requested to replat 10 existing
substandard lots located in Delaware Crossing to 8 lots, 2 of whi h still
contain less than the minimum required square footage. All propo ed lots
appear to be able to provide the 100 feet of frontage required at the
building setback line. As shown on the proposed replat sewer and water
connections will be available to each newly created lot.
Staff contacted Minnesota Federal Savings and Loan in an atte pt to
adjust the lot lines to the remaining substandard lots so that all lots
would now meet minimum lot size. MFSL stated they did not want to do this
because of problems with utility services.
Staff feels that the 2 substandard lots could be increased to meet
the 15,000 square feet requirement and the subdivision could then all
within the exception portion of the Ordinance. A hearing could be waived
and approval of preliminary plat forwarded to City Council.

SUBJECT: Variance to Rear Yard Setback. Case ��82-19
Mrs. Richard Gehrz of 1047 Marie Avenue was before the Planning (
on July 27, 1982 to request a variance of six feet or to be allowed
in twenty-four feet of her rear property line with a swimming pool.

To further explain the request, some background information is n cessary. On
July 19, 1982, I had issued a swimming pool permit to Superior Pool Builders, Inc.
A site plan was submitted along with the permit application showing the pool to
be located twenty feet from the West property line, thirty-two feet from the
East property line and thirty-one feet from the North property line On July 27,
1982 a location inspection was called for by the pool company so To Knuth and I
went out to measure the setbacks to insure that the pool was locate in the spot
where the site plan said it would be. We found that the pool was pl ced six feet
closer to the rear lot line than allowed. I then issued a stop work order and
advised the pool contractor and homeowner that the pool project cou d not continue
until such time as the Planning Commission and City Council had rev ewed a variance
application and was approved by Council.
The Gehrzs' had not met with the Planning Consultant, Howard Dah
regularly scheduled consulting meeting;and went directly to the Pla
meeting on the 27th of July. Planner Dahlgren was in attendence at

PETITION
The undersigned hereby inform the City Council of Mendota Heights hat they
are in general agreement with the development plan (Exhibit A) on he
following described property to wit;
Lot 3, Perry's Addition to St. Paul and Part of Lot 9, Audito�'s
Subdivision No. 4 Lilydale, Dakota County, Minnesota
All that part of Lot 9 in Auditor's Subdivision No. 4, Lilyda
lying South of the South line of Cherokee Park Heights except
therefrom
as presented by Vernon R. Colon of Federal Land Company. The plan
to the undersigned shall consist of (no more than) 16 single story
townhomes in clusters of 2 units each and the townhomes will be ex
landscaped. There will not be a swimming pool or tennis courts in
development, however, there will be a putting green for the use of
residents. It is also understood by the undersigned that each indil

acknowledging that some future rebuilding could occur, resultin�g in a new assessment.
We have now had several areas where initially permanent streets w re installed,
such as Ivy Falls East and Ivy Falls Second, where construction, some 16 years ago, is
still in excellent condition and should provide another 10 to 15 year of service
without rebuilding or overTayment.
For the past several years, the City has been wrestling with the ilema between
assessing 100% for good, permanent streets and the need for good, per anent streets
in areas where street base and street surfacing was less than permane t. In 1980,
the City staff studied and the City Council.spent a eonsiderable amou t of time
discussing improving streets and drainage in the Ivy Falls First Addi ion. The project
was deferred because the residents were not of a mind to "buy" a good permanent street
the associated drainage improvements. This same concept applies to t e Chippewa-
Hiawatha area, acknowledging that City off icials have not had as much face-to-face
dialogue with the residents as occurred in the Ivy Falls First Additi n.
Is it unreasonable to charge or assess older homes for a new stre t and' drainage
system? We levy these improvement costs onto newly developed areas b cause it is
merely a part of the total improvement. It would appear that the reb ilding of
streets in existing residential areas may take more the form of, or c mpare to:
a) a large expenditure to put on a new roof on your house, or
b) a complete residing job in order to bring the investment up t current
standards.
If it is the concensus thatolder homes should have some type of incen ive or
subsidy for repTacement facilities, then the City Council should face up to a
change in policy or at least an amendment to the hard and fast 100%. If the City
is to participate in the rebuilidng of existing streets, then comes t e question:

At what level of participation or subsidy?
It may be that now is the time to consider a change in policy and some assessment
criteria to accompany the change.
Under Chapter 429 of the Improvement Code, we can undertake a project so long as
20% of the cost is assessed. Bonds may be issued for the entire cost or even in
excess under certain conditions. Any bond issue that is only partially assessed
obviously has to be made up through a special debt service levy. It may be that a
"replacement fund" should be established in order to finance future subsidies for
street improvements. This could be accomplished by "over-financing" and possibly
collecting a debt service levy somewhat in excess of that needed. Through these
two measures, we could graduaTly begin to establish a fund for future City participation
for street improvements.
The criteria for participation should include at least the following elements:
a) Permanent (bituminous surfacing only) street reconstruction should have
approximately 50% City participation. City participation should not apply
or be considered in those areas where permanent street construction has not
been assessed. Street restoration costs which were part of the cost of
utility improvements should not be considered as "permanent" street improve-
ments. (If a permanent street, including drainage improvements had been
constructed, it would have been assessed as a permanent improvement).
b) If past drainage improvements have not been assessed, then 100% of the
storm sewer collection system should be assessed. As part of the collection
system, curb and gutters are as integral a part of the collection system as
are the underground pipes and catch basins.
c) If any amount of "trunk line" drainage pipe is needed, then at least 50%
of such trunk line should be considered as a City participation or
general obligation.
Justif ication for benefits, and legal tests, would be much more defensible if local
collection is assessed 100%, and trunk lines are considered and paid for as a
general City obligation.
The attached resolution attempts to put the foregoing thoughts and concept
into a policy statement. It is submitted for your consideration, discussion and
certainly subject to change and "f ine-tuning".

SUBJECT: Burow Pond - Rolling Green
I
In the matter of the Burow Pond, an incident has occurred dur'ng the
past several days which we believe should be brought to the attent'on of
the City Council and others.
It seems that this past week-end, Mr. Burow, the Owner, has p mped all
of the water out of the pond through the overflow pipe into the Ma ie Avenue
pond where it was lifted into Valley Creek.
Starting early Monday morning, Staff received several telepho � calls
with respect to this operation. Most were ecological in nature co cerning
the wild life, possible damage to vegetation, and appearance. It robably
was also fear of the unknown.
After lunch on Monday, July 27th I discussed the matter with hief of
Police, Dennis Delmont, mostly to determine if a citation was in o der.
Because Jim Danielson is on military leave this week, I also conta ted Sherm
Winthrop for legal advise. Sherm suggested that we order him to c ase
pumping or be cited. This was not done pending further investigat on.
We reviewed the wetlands ordinance and the easement agreementlfor
establishing the pond as part of the Rolling Green plat.
The wetlands ordinance permits the removal of not more than 1 0 cubic
yards of materials. It has other limitations but, in our opinion, none
effected Mr. Burow's operation. There is nothing in the ordinance that
covers removal of water, unless one reads between the lines.
Dennis met with Mr. Burow Monday afternoon and learned that i his
(Burow's) intention to remove dried silt in an amount less than 10 cubic
yards, to fill a low spot behind his barn, one that becomes soggy fter each
rainfall. Mr. Burow maintained that he had a letter permitting hi to do
so, but Dennis did not see the letter. Without a date, we looked hrough the
files but found nothing.
Tuesday morning I received a phone call from a Mrs. Roszak, 9 8 Stratford
Court, who asked about the operation, and indicated that by that t me, Mr.
Burow had the pond pumped down to mud. She called it "dry".
With Jim gone, we were not certain whether a verbal approval o move
dirt had been given. We finally got Jim on Tuesday afternoon and iscussed
the situation. Jim recalled that at the time we obtained the drai age ease-
ment in March 1980,there may have been some mention of dirt movemer.�.
Because a lot of what had gone on for two days was heresay, first Dennis
and I agreed, and then Jim and I discussed the matter further Tuesday evening
and agreed, that I should meet with Mr. Burow to obtain first hand informa-
tion because it was rumored that a number of Rolling Green residents might
appear at the next Council meeting.
Wednesday morning, Dennis and I met with Mr. Burow to determine what he
intended to do. We explained conditions of the wetlands ordinance and the
easement he signed for the establishment of the pond. He explained that he
wanted to move about 60 cubic yards of silt from the pond area to a low spot
back of his barn and that he had permission to do so.
He showed us a copy of a letter from Sherm, dated April 2, 1980, to Don
Christenson, Burow's attorney, indicating that the City Engineer concurred
that the movement of 60 cubic yards within the ponding easement was acceptable.
That struck a bell, and further research revealed that as part of the
agreement to sign the pond easement, Mr. Burow was told he could move 60 cubic
yards from the pond to the low spot in question. He maintains that he was
only conforming with that permission even if it was 2 years later.
At this time, it is our judgement that he is conforming with regulations
except for the fact that he did not first notify the City of his intentions.
We are not certain as to how to deal with the pumping the pond dry.
It is possible that representatives of the neighborhood will be at the
next Council meeting and it is possible that Mr. Burow will also be there.
It appears that it may take a week or so, without rain, for the silt
to dry sufficiently for Mr. Burow to remove same by his method of operation.
Should rain come, he will be stalled again.
The removal of the silt from the bottom of the pond will not harm the
City's interest in the pond. In fact, it will help delay the need for the
City to clean the pond.
Some concern has been rendered that excavating might break a seal in the
bottom of the pond thus permitting it to dry up permanently. We are not cer-
tain that there is such a seal, and this is not likely to take place because
there are 2 to 3 feet of silt and Mr. Burow intends to remove only the top
4 to 6 inches.
It appears that the silt moving operation will improve the pond depth
and will improve Mr. Burow's back yard.
Without further comment, we leave the matter for possible discussion
at the next Council meeting.
