There being'no further discussion, Mayor Lockwood
thanked Chief Delmont for his appearance and budget
request.
FIRE DEPARTMENT Mayor Lockwood noted the presence of Fire Chief Noack,
BUDGET Assistant Chief Peterson, and Fire Marshal Lange.
After a short general discussion, the Council and firemen
discussed the need for a new furnace. A number of
suggestions evolved, including the feasibility of a
used furnace and other cost cutting measures. The
issue was not resolved. The line item of driveway
snowplowing was discussed to some length. Chief Noack
indicated that response time would be badly hampered
if the snowplowing service is eliminated. A suggestion
was made that possibly it should be reduced considerably,
with tfie Chief establishing the reduction criteria.
Discussion also revolved around rates for the volunteer
firemen and salaries for the part-time Chief and Assistant
Chief. It was suggested that possibly there be no salary
increases for 1983. Fire Marshal Lange reviewed the capital
expenditures, noting several additional items, which had
not been listed in the former CIP budget. He reviewed
the request for updating of two fire engines and the need
for a remote 'transmitter for the pager reception. It
was noted that the priority should be as follows:

Councilman Mertensotto noted that the various capital
expenditure items should be listed under the annual
operating cost budget. He indicated that it was necessary
to include capital expenditure items on the budget sheets
in order to reflect the full and true cost of operating
the department. There being no further discussion, Mayor
Lockwood thanked the volunteer firemen for their dedication
and interest.
Administrator Johnson noted the Code Enforcement budget
request and there were no questions or comments.
ENGINEERING DEPARTMENT Public Works Director Jim Danielson explained the several
BUDGET pages of handouts involving the engineering enterprise
fund. He noted that during the first six months of 1982,
there was some $7,000 of earnings. He noted that despite
reduced work activities, he expects the engineering depart-
ment to be self-supporting.

There were a number of other miscellaneous uestions concern-
ing start-up costs and anticipated work loa s. It was
noted that the establishment of the enginee ing department
was a needed and proper action, however th current
economic conditions will be testing the fin ncial feasibility
in the near future.

that if the Council so desires to clean out the pond, that it
be performed after such time as all of Rolling Green is devel-
oped, to eliminate any more silt from washing into the pond.
Councilman Mertensotto noted that about 60 cubic yards of fill
were removed without prior Council knowledge and that Mr. Burow
should have notified the Council of his intentions. Mr. Burow
noted that this summer had been the driest summer•in several
years, and that is why he decided to drain it when he did. He
did note that he is completely finished, that there is no odor
in the pond area and that there was some water standing in it
from the slight rainfall from the ni�ht before. It was the con-
census of the Council that no further pumping or dredging would
be allowed by individuals in the future.
SIGN PERMITS The Council acknowledged a report from the Code Enforcement Officer
FOR 2012 relative to a request from Greg Lyons and Mike Leibman for sign
SOUTH LEXINGTON permits to place business identification signs on the building
located at 2012 South Lexington Avenue. As noted in the memo,
both signs are wall signs and do not exceed the allowable sign
area for the building. However the Council was concerned about
approving the permits when they did not know the size of the
signs, the height of the signs or the location of the signs.

sufficient information.

Councilman Hartmann seconded the motion.
Mayor Lockwood opened the meeting for the purpose of a public
hearing on the proposed assessment roll for the Roger's Lake
Substation, N.S.P. public improvements.
Public Works Director Danielson explained how the project came
about, noting that the substation is east of Roger's Lake, north
of Wagon Wheel Trail and west of TH 149. He noted that NSP had
petitioned for the improvements and that the entire cost of the
project will be borne by NSP. Mr. Danielson noted that NSP would
like to be assessed over a period of years, rather than pay the
assessment in a lump sum. Treasurer Shaughnessy noted that the
project would be assessed over a period of 10 years at 11��
interest. The total cost of the project is $16,078.61.
There being no questions or comments from the audience, Council-
man Mertensotto moved that the hearing be closed at 8:08 P.M.

ment of the $2,400 check and authorized preparation of the
feasibility study subject only to the provisions of the
applicable City Ordinances. If this is not acceptable to Mr.

MISCELLANEOUS Public Works Director Danielson reported on the new speed limit
reduction to 35 miles per hour on Victoria from TH 13 to
Lexington. He also noted that construction of the Mendota Heights
Road bridge is behind schedule and should be done by mid-September.
He also noted that construction of the Wagon Wheel Trail bridge
will probably start in the spring of 1983.

Staff was directed to check on the time limit for the Peter
Schwartz residence, whose house was moved from TH 13 to an
empty lot on Fremont Street.
City Administrator Johnson noted that he had not heard from
Bill Sheehy in regard to improvements to Mendota Plaza
Shopping Center and MGM Liquor.
Discussion on the street assessment policy was deferred to a
meeting when the full Council could be in attendance.
City.�ldmini"strator Johnson noted the proposed Planning Dept.
budget for 1983. There were no comments from the Council.
Councilman Mertensotto advised the Council of a recent meeting
he had regarding the Fire Relief Association Pension Plan.
MISCELLANEOUS • City Administrator Johnson asked if any Council members would be
interested in attending a Regional Meeting of the League of
Minnesota Cities in Maplewood on September 16th. Councilwoman
Witt expressed interest in attending if her schedule allowed it.
TH 110/149 City Administrator Johnson noted a Handout from Planner Dahlgren
relative to the intersection of TH 110/149. The Council is
to study the memo and respond at a later date.

The Council received a handout letter from the D kota County
HRA representing the City of Mendota on a HUD ap lication for
sanitary and storm sewer. _� -
Councilman Mertensotto moved receipt and acknowl dgement of the
letter from the Dakota County HRA dated August 1, and directed
the City Administrator to write an affirmative r ply to the
Metropolitan Council, supporting Mendota in its pplication
for funds to construct sanitary and storm sewer.

Held Tuesday, August 24, 1982
In accordance with action taken at the regular meeting of August 17
adjourned meeting was held at 7:00 o'clock P.M. in the Conference R
214, 750 South Plaza Drive, Mendota Heights, Minnesota. �
Mayor Lockwood called the meeting to order at 7:00 o'clock P.M. The
members were present: Mayor Lockwood, Councilmembers Hartmann, Losl
and Witt.

SENIOR CITIZEN Mayor Lockwood noted that Mr. Jack Klepp, from .H. Wilder,
HOUSING, A.H. Inc., was present to reque'st further considerati n concerning
WILDER the development of a senior citizen housing stru ture. City
Administrator Johnson explained that Mr. Klepp, embers of
Dakota County HRA, and representatives of Miller Schroeder
had met on four occasions to discuss the feasibi ity of
financing and constructing the senior citizen ho sing. He
suggested that the Council consider a special me ting at
which time the foregoing people would give a sta us report
to the City Council members. Such status report was necessary
to allow further consideration�_by.. Cout�il�: membe to-•determine
further action. After a short discussion, Counc'lman
Losleben moved that a special meeting be establi hed for
Tuesday, August 31, at 7:30 o'clock P.M. to rece've a report
and discuss a number of policy issues and�the fe sibility of
the senior citizen housing development. The Pla ning
Commission members are to be invited to such spe ial meeting.

PUBLIC WORKS Dick Ploumen, Public Works Supervisor, was prese t to explain
BUDGET REQUESTS the several 1983 budget requests for Streets, Pa ks, and
DISCUSSION Utilities. Mayor Lockwood noted that the severa budget
requests appeared to be minimal and only maintai ed the
status quo.
Councilman Mertensotto asked about the fea�sibili

discussion on the employment of seasonal help and the SSES
activities by the utilities personnel.
A short discussion ensued on the Park budget request. Park
Commission Chairman Tom Bayless, was present to partake of
the discussion. He noted that the beach activities would �
probably be eliminated in 1983. A brief discussion was
held concerning recreational salaries and also the professional
�ervice•.fees concerning CIP's.
There was no further discussion on the Public Works requests
and Mayor Lockwood noted that the final figures would have
to be adjusted to reflect total estimated 1983 revenues.
ARCHITECTURAL Mayor Lockwood noted that this was the date and time to
•INTERVIEWS consider interviewing of three architectural firms for the
purpose of selecting a firm to perform the professional
services of designing a new fire station. Architectural
Alliance was the first finn to be interviewed.
Architectural Alliance -
Mark Merrill and Carl J. Remick, Jr. were present to describe
their firms capabilities. They noted their experience in
designing structures of a similar nature and also that they
had been commissioned by Cray Research to do the three projects
in Mendota Heiqhts. They noted that they would engage consult-
ing engineers satisfactory to the City of Mendota Heights after
they were commissioned to perform the architectural services.
They indicated that, based on parameters established by the City,
that the proposed building would cost approximately $55.00
per square foot, which would result in an estimated cost of
approximately $500,000. Based upon the estimated cost, they
indicated a service fee of $29,000, which would be the maximum
figure in a service contract. This would provide the normal
architectural services and they would possibly require additional
fees for any unique studies,.which were not expected. They
indicated their willingness to guarantee the above fee as a
maximum, using a monthly billing method for compensation.
After a number of questions from the Council members, the inter-
view was ended at approximately 8:37 o'clock P.M.
Robert Burow Architect -
CMr. Burow was present to explain his firm and its capabilities.
. He sited examples of fire stations that he has been involved
with in the past. He also noted various involvements in Mendota
Heights structures, such as the Dakota County State Bank addition,
the Royal Redeemer church expansion and Dakota's Adults. He
also noted the very complicated and sophisticated'work required
•at-the St. Jude•��urch-.in Little Canada. He noted the several
consulting firms that he uses to supplement the architectural
services. He noted the "task description��process as :explained
in his brochure. He noted the program cost estimate as he
prepared it amounted to $503,360. It was noted that on a task

DISCUSSION The Council members spen � some time discussing t e attributes
of the three firms. A number of the strong poin s of each
firm were noted and reviewed. The lateness of t e hour was
noted and the Council members agreed that a deci ion should
be reached at the next regular Council meeting o September 7,
1982.
A short discussion concerning representation on t�he NDC4 Board
took place, however no action was taken. �

Mark Ulfers noted the need for a tax i.ncrement financi.ng

Jaak Klepp elaborated briefly on the description of a senior
citizen structure and the several sites that they had reva.ew-
ed.

the participants. Jack Klepp noted that this is a REPORT, not
a propasal. He noted that Wilder would be interested in pur-
suing the market survey and other activa,.ties if the Council
e�cpressed interest in the project. A numher af cletails were
discussed such as rezoning necessary for any 1ikely site, the
need to adopt an ordinance authori.zi.ng HRA bond sala and a
number af other matters. Mayor Lockwood noted that the Ci.ty
Council would at�empt to make a@ecision on September ?, at
the regular City Council meeting. AII members of the Piananing
Commission indicated a strang interest �c� pursue the project
with the exception of Sanciy Butler, who e�ressed some reserva-
tions but generally was in favar of the princspal.

time frame allocated.

by Chairperson Kruse at 8:07 o'clock P.M. The following members were p

Chairperson Kruse called the meeting to order for �he purpose
of a public hearing on an application from Vern Co on for
consideration of a conditional use permit for a pl nned unit
development to allow construction of townhouses on property
owned by Federal Land Company on TH 13, north of wning and
westerly of Miri:am Street.
Mr. Charles Bartholdi, attorney from Federal�'Land,
to make the presentation. Mr. Bartholdi noted tha

Mr. Damon Farber, landscape architect spoke, noting that he
would address site analysis, the housing layout on the site and
landscaping and open space within the site. He noted that
currently the drainage is going on TH 13. Mr. Farber noted
the single entrance from TH 13, and the controlled access that
dead ends in the turnaround. He noted an emergency access off
the Miriam-Hiawatha connection.
Mr. Farber noted that there will be 16 units in the development
and that large plantings and landscaping will be used. They
will not buffer the views but will screen the driving views from
the surrounding streets. Trees will be coniferous and deciduous.
Mr. John Pope, architect�noted several schemes, with square
footage ranging from ],910 square feet to 2,170 square feet,
excluding garages. He noted that some buildings will have hand-
split shake roofs, others will be shingled. Some exteriors
will be masonry, others stone, brick, stucco or wood. Some will
have overhangs, others will not.
Chairperson Kruse then asked for questions or comments from the
commission members. Blesener expressed concern about the size
of the turnaround for emergency vehicles. It was acknowledged
that a fire truck could not make the turn around and would have
to exit the site via the emergency access in the northeast
corner of the site.
Another question regarded a park donation. Public Works
Directbr Danielson noted that this would need to be a cash
donation for the 16 units. A question was raised on whether the
holding pond would handle on site drainage as well as drainage
from the northeast, which�it will be able to handle. Another
concern was that some of the units would be too close to the
internal road.
Planner Dahlgren noted that the Miriam connection is included in
his calculations for density for the site. He also pointed out
that perhaps one unit should be removed from the site, as he felt
they were too crowded on the west side, near TH 13.
It was noted that the proposed street will be 24 feet wide and
that guest parking would have to be in the street. Planner
Dahlgren suggested making the street wider to accommodate
overflow guest parking. It was also suggested making the cul-
de-sac large enough to allow emergency vehicles to turn around
in and to forget the emergency access in the northeast.
Mr. Colon stated that he will pay for the improvements in the
northeast area of the site and that he would be willing to
eliminate two units from the proposal, thus building only
14 units, thereby accommodating the parking needs and relieving
the crowded situation. He did not indicate which two units
would be eliminated.

Mr. James Hill, developer for Mr. Gryc explained th� request,

noting that the average lots are 20,000 square feet. A proposed
street, Evergreen Knoll, would extend through the site from Dodd
westerly to Wachtler, and Wachtler is proposed to be extended
south to Bachelor Avenue. There would be two cul-de-sacs off
Evergreen Knoll. He noted that the natural drainage is to the
southwest and that sanitary sewer comes off Bachelor to service
the area. It would be proposed to develop the westerly portion
of the site, proceeding easterly to Dodd. 43 lots would be platted
on 24 acres, with all lots meeting setback requirements and
minimum lot sizes.
Planner Dahlgren expressed concern about getting from the site
north to Wentworth.
Mrs. Bernice McGown, 768 W. Wentworth, stated that she does not
want a road through her property to Wentworth. Perhaps a cul-
de-sac from the south to her property may be satisfactory, but
definitely not a road through her property.

Chairperson Kruse asked for questions or comments from the
audience and Mr. Shaughnessy and Mr. Young, two contiguous
property owners, stated that the plan is adequate as far as
they are concerned. ,
Mr. Harry Kladis, 1649 Dodd Road, expressed concern over the
placement of the road, noting that the road is in the center of
his land and Mr. Gryc's land, along the boundary between the two
parcels.
Mrs. Lily, 1694 Dodd Road, wondered whether the lots would be
platted, or if a specific development was being planned.
Mr. Ray Fuller, 734 Wentworth, expressed concern over a proposed
Outlot A, which would be given to the City for access for future
use. It would be 50 feet wide and if it was not used by the
City, then it would be split between the two abutting property
owners. Planner Dahlgren noted that there would be a good
possibility of a half street (24 feet wide) along Mr. Kladis'
property and that there is no other solution.

Mr. and Mrs. George Ziemer, 730 Wentworth, also expressed concern
over Outlot A and how it would affect their property.
Planner Dahlgren suggested removing Outlot A from the proposal
and replacinq it to the McGown lot as a deadend now, with the
possibility of it going throug.h in the future.
There was soine question as to why not put the road in through
the Lyle Lewis property, at 760 Wentworth. It was pointed out
that the property is only 210 feet wide, therefore not wide
enough for a road through it.
Mr. Jim Lily, 1694 Dodd Road questioned the green acres law and
wondered if the City was deviating from it. Chairperson Kruse
responded that this plan does meet with the Comprehensive Plan.
Mr. Lily also was concerned with the traffic on Dodd Road and
stated that he does not wish to see a stop sign at the intersection.

Heights will meet at 7:30 o'clock P.M., or as soon thereafter as p ssible
on Tuesday, September 7, 1982, to conduct a public hearing on the roposed
use of $26,500 anticipated 1982/83 Federal Revenue Sharing Entitle ents.
Revenue Sharing monies received in previous entitlement periods ha e been

AUTHORITY TO EXERCISE, ON BEHALF OF THE CITY OF ,
THE POWERS CONFERRED BY MINNESOTA STATUTES, SECTION 462C.01 to 462C.08,
RELATING TO PLANNING AND IMPLEMENTATION OF A SINGLE FAMILY MORTGAGE REVENUE
BOND HOUSING PROGRAM
WHEREAS, the Dakota County Housing and Redevelopment Authority (the "HRA") was
created pursuant to Laws of Minnesota 1971, Chapter 333, as amended by Laws of
Minnesota 1973, Chapter 534 (the "Enabling Statute"), and authorized pursuant
thereto to exercise the powers of a housing and redevel�opment authority under
the provisions of the Municipal Housing and Redevelopment Act, Minnesota
Statutes, Sections 462:�411 to 462.711, as amended (the "Municipa—'f HRA Act"),
w�—'t—Fi-in the territorial boundaries of the County; and
WHEREAS, the Legislature has enacted Minnesota Statutes, Chapter 462C (the
"Municipal Housing Finance Act") to regu ate the p anning and implementation of
single f amily housing programs and has provided f or the financing of such
programs pursuant to its'terms only; and -
WHEREAS, pursuant to the Municipal Housing Finance Act, a city is authorized to
make or purchase mortgage loans to finance the acquisition of single f amily
housing and to issue revenue bonds to provide funds therefor, such bonds to be
issued after adoption of a housing plan and pr,ogram and approval thereof; and
WHEREAS, pursuant to the Municipal Housing Finance Act, a city is authorized to
delegate its powers pursuant thereto�to the housing and redevelopment authority
acting within the City; "�
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
Section 1. The HRA is hereby authorized to exercise on behalf of the City of
(the "City"), the powers conferred by Minnesota Statutes,
Sections 462C.0 to 462.08, including the power to issue and sell single f ami y
housing revenue bonds.
Section 2. The HRA shall, upon request of the City Council, make periodic
status reports to the City Council regarding the progress of the housing program
and bond issue undertaken pursuant to the power conferred hereby.
Section 3. The HRA shall submit the Housing Plan and Program for the City
prepared by the HRA to the City Council for its approval, prior to submission
of said Plan and Program to the Metropolitan Council and Minnesota Housing
Finance Agency, respectively.

SUBJECI': Variance and Subdivision request - Lots 1 and 2, Culligan Knoll
Carmen Tuminelly was at a regular scheduled Planning Consultant meeting
to request a subdivision approval to create 31ots out•�of 2 existing lots
located at 1903 Hunter Lane. Proposed Lot #3 has an existing single family
home in place.

Carmen has�expressed a desire to rehabilitate this existing home and
construct two additonal homes to the east of the existing structure. These
new proposed homes would not have the required frontage on a public street.
Staff has suggested that Carmen provide half a street and half a cul-de-sac
so that the land to the north if and when it develops could provide its half.

We feel that a public sewer and water connection should be petitioned
for and installed to serve these lots, however, the street could be installed
and privately maintained until such time �as the lots to the north are developed.
Being that the proposed subdivision will provide lots exceeding the mini-
mum lot size •required by the Zoning Ordinance we feel that the Planning
Commission should favorably consider this request. If this preliminary plat
is approved, a developer's agreement with Mr. Tuminelly should be prepared
outlining City concerns such.as public utilities, park contribution and a11
other normal subdivision requirements. This developer's agreement would need
to be completed before final plat approval.
A Public Hearing should be set up for the August meeting.

The property in question is a 2.2 acre tract with an existing sin le family
house near the west end. The applicant informs us that the house has been
unoccupied for an extended period of time, and is badly in need o repair.
The applicant has purchased the property with the intent of addin to the
existing house and substantially remodeling it to put it on the arket
as a high quality residence and homesite. The applicant proposes to
plat half of the cul-de-sac extending from Hunter Lane and develo ing two
lots with 135 feet of frontage on the cul-de-sac. Each of these ots
would be approximately 22,950 square feet. The remaining lot to he west
(occupied by the existing home) would be approximately 42,000 squ re feet,
minus that area taken up by the cul-de-sac. Thus, the lots�would be of
substantial size, far exceeding the 15,000 square foot minimum an the
100 feet of street frontage. I
The property to the south is platted with lots fronting on Cullig n Lane.
The homesites on these lots are located such that a street could ot be
built along the south line of the property in question. The prop rty north
is owned by Mr. Ted Van and was recently approved for the plattin of a
single lot on the west end of his property with provisions for a 0 foot
strip of land to serve as access to the new westerly lot. It is onceivable
that at some point in the future if that strip of land coulei be d dicated
as public right-of-way that additional lots could be plattecl to t e north
on the Van property. j
3. It would appear that the method proposed here is the only way in �hich to
develop public access to the subject property. �
Under the conditions as they are, it would a�pear that the apgrop iate way
to handle this plat would be to accept the dedication as proposed but
without the acceptance of public maintenance. This would allow f r the
construction of utilities into the land to serve the properties ( ot now
served).
4. Mr. Van has not yet filed his proposed lot, he may be willing to djust his
proposal in view of the current proposal on the part of Mr. Tumin lly.
There is a fine stand of trees along the south line of Mr. Van's roperty,
it may be possiblc� to r.etain these trees in the center of the med an if a

public street were to be constructed on either side of the trees with a
turn-around at the end. Mr. Van may not be willing to litigate at this
time, but a street design for the property in question might envisage
this prospect. In any case, it may be possible to have a private street
constructed on the public right-of-way dedicated as a part of this proposal
with the understanding that at such time as the land to the north is �
wished to be subdivided further, that additional dedication would be
acquired, and a public street constructed at that time.

Design Forum, Inc. was before the Planning Commission on August 2 to
discuss variances to the building height and setback to the liluffline as
required by the Critieal Area Ordinance.
At the Planning Commission meeting, the Hear�in� was waived and the Commission
recommended approval of a variance subject to the bii3lding height con orming to
the Ordinance and that the house be positioned on the �ot such that t e average
setback is 40 feet from the bluffline. Design Forum, Inc. has subseq ently
submitted a revised site plan demonstrating the proposed structure to be set
back an average;of 44 feet from the bluffline, which exceeds the Plan ing
Commission's-recommended 40 feet. •
Design Forum,' Inc. hasn't completed the elevation:�drawings of the structure,
but assure us that their redesign of the building heiight will meet th Ordinance.

Design Form, Inc. has made application to construct a new Sing
Dwelling at 1235 Knollwood Lane for tnr. Alexander Yue, on Lot 11B-1

Approval of Variance to Critic 1 Area
Ordinance �
The property in question is a single family lot on which Mr. Yue proposes to
built a single family residence designed by Design Porum Inc. T ey have
designed a residence for this lot, unaware of the Critical�Area rdinance
requirements. You are all aware that as per an Executive Order f the
Governor in November of 1976, each community in a designated Cri ical Area
along the river corridors in the Twin City Area wer.e required to prepare
specific regulations for the protection of the river corridor en ironment.
This action resulted in the City of Mendota Fieights adopting Ord nance 403
establishing policy, standards, and criteria for the development of
properties�within a designated Critical Area Boundary. The prop rty in
question is within this boundary. ;

Une of the key provisions of this Ordinance is that there be no evelopment
in areas of the bluff slope where the grade exceeds 40�, and tha any
development be set back 40 feet from the bluff line which is def ned as
that point where the grade is 40� or greater. A copy of tlie app icants
site plan is attached which indicates the proposed location of t e residence
in r.elationship to the topography. You will notice that at the esterly
trianqular portion of the lot that the grades are extremely stee . These
grades are approximately 50�, slightly east of the westerly most projectior�
of the proposed dwelling unit. Thus, if the dwelling is to be c nstructed
as proposed, a variance to the setback requirement of approximat ly 40 feet
would be required in this case. �
Ordinarily, approval for a single family dwelling within Y.hc Cri ical Area,
or a minor addition, can be handled without r.eferral to th� Planiing '
Commission or the conduct of a Publ i�� Hearinq. This E�r.oc�c�ure i. covereci

In the event that a plan submitted does not conf.orm with the requirements
(in this case the 40 foot setback requirement), the procedure outlined in
Section 2.4 applies which requires the Planning Commission to establish a
Public Hearing and the forwarding of a recommendation to the City Council
within 60 days. It would appear that i.n t}ii.s case this would be the
appropriate procedure.
4. The criteria for consideration of the variances is listed under Section 5.4
as follows:
5.4 Variance Approval Standards. In cor�sidering applications
for variance under this Ordinance, the Council shall
consider the advice and r.ecommendatioris� of the Planning
Commission and �nay grant variance from the strict
application of the provi.sions of this Cr.itical Area
Overlay District Ordir�ance and impose conditions and
safeguards in the variances so qranted, provided.the
followiny additional criteria shall be considered:
A. The conditions causing the hardship are unique to
that property. .
B. The variance is proved necessary in order to secure
for the applicant the right or rights that are
enjoyed by other owners in the same area of the
district.
C. The granting of the variance will not be contrary
to the public interest or damaging to the rights of
other �ersons or to property values in the neighbor-
hood.
D. The �r.antinq of the variance will not be contrary to
the management policies of the Critical Area.

G. The conditions which result in the need for the
variance were not created by the applicants desi
solution. The applicant shall have the buxden o
proof for showing that no other reasonableidesig
solution exists.
5. The basic problem here is that the home is already designed;to be
as proposed in the site plan submitted. The architect indicates t
reason for establishing the home so close to the bluff lineiis the
of distance needed to climb the hill with the driveway so as to ge
the garage level. Given the present configuration - this conditi
well be true. The question is, of course, whether or not some oth
configuration of the driveway and the location of the garage might
for the home to be set back further than proposed. '

6. A mitigating factor for locating the home as proposed is the fact
steep slope is densely wooded, and therefore the structure may wel
visible from the river itself. It would be helpful if inembers of
Commission and Council could view the site so as to ascertain this
condition. In defense of the design, it would appear also that th
has taken careful measures to preserve existing trees on the site
labeled on the site plan.
7. Perhaps the most helpful process would be one of asking the design
explain the hardships ensued in moving the structure away from the
line. If the Planning Commission and Council are satisfied that s
hardships do in fact exist, and that the structure as located will

Unfortunately, the project is not funded at thi.s time. With the unc rtainties in

The praject has, hawever, progressed to the paint where t�e layout h
mitted for�formal Mn/DQT Staff Approval, the Environmental Assessmen
has been approved by the Federai H9ghway Ac�ninistraiion, and a iocat
Public Hearing has been held. Since there have been no significant
comments fram individua3s or agencies cancerning the project, a"Fin
Significant Impact" by ihe FNWA is anticipated. The project, theref
soon be ready for detai 1 desi gn.

Ryan Construction Company has submitted a plan and a permit ap lication,
requesting a building permit to create an area 20' x 86' within the existing
warehouse section of Sperry Univac's facility, located at 2465 Lexi gton Ave-
nue South. The granting of this permit will allow Sperry Univac to reclaim
precious metals from computer parts in house rather than sending th parts
to a reclamation center. The area will contain a chemical lab and strip
lab as shown on the plan submitted. I have reviewed the plans and lso was
supplied with reports from the Metropolitan Waste Control Commissio for an
Industrial Discharge permit and also a letter from the Minnesota De artment
of Health, Section of Water Supply and General Engineering. �
Ryan Construction is in the process of filling out the require SAC
form and will submit it to the Metropolitan Waste Control Commissio for
a determination as to whether or not addi:tional SAC charges will be appro-
priate. �

INCH MENDOTA HEIGHTS TRUNK SEWER BY THE NIETROPOLITAN
WASTE CONTROL COMMISSION
Wi�REAS, the Mayor and City Council of the City of Mendota Heights find
that the City of Mendota proposes to construct a sanitary sewer col.lection
system to serve at least 90 percent of the City of Mendota; and
WHEREAS, the City of Mendota has requested the Metropolitan Council to
approve the construction of a lift station, forcemain and gravity trunk
interceptor sewer to connect its proposed sanitary sewer collection system�with
an existing 9 inch trunk sewer located in the City of Mendota Heights� and
WHEREAS, the 9 to 18 inch trunk sewer that is owned by the City of Mendota
Heights contains approximately 0.45 million gallons per day of capaci:ty in
excess of the complete development needs of the City of Mendota Heights, based on
the City's approved Comprehensive Sewer Plan; and
Wi�REAS, the City of Mendota can economically u�ilize a po�tion of the excess
capacity in the 9 to 18 inch Mendota Heights trunk sewer as determined by their
engineering consultants as per the report entitled, Feasibility Stud'y for Sanitary
Sewer for the City of Mendota, August 1978.
NOW TF�REFORE BE IT RESOLVED, by the City Council of the City of Mendota
Heights that based on the above facts, the Ci:ty of Mendota Heights requests
that the Metropolitan Council approve '�he request and recommend to the Metro-
politan�Waste Control Commission that it acquire the 9 to 18 inch Mendota Heights
trunk sewer at such time as the sanitary.sewer collection system in the City of
Mendota is constructed.

SUBJECT: Roger's Lake N.S.P. Substation Wall
Last year N.S.P. received a Conditional Use Permit to construc
a 12 foot sound and screening wall around the south boundary of the
Roger's Lake Substation. The material of the wall was not part of
the approval,.however it was always referred to as concrete. N.S.P
took bids this summer and found that a concrete wall was much more
expensive than estimated. N.S.P, now requests the City allow the w
to be of wood. Staff feels that although the Conditional Use Permi
was for wall height this is a significant change to the way the wal
was originally presented and th.e Council should be allowed to make t
decision. �
I talked with Howard Dahlgren and he feels that a wood wall wo ld
be an improvement over the originally proposed concrete. He also f els
that N.S.P. should use green treated timber to construct the wall a d
allow it to weather (do not paint). He recommends they take�the mo ey
that would 6e used for paint to plant vines along the outside of th
wall.

At the regular council meeting held on September l, 1981,
a conditional use permit to allow construction of a twelve
foot high concrete screening and noise wall was granted.
The wall will also be located closer than 100 feet to an
established wetlands, so a wetlands permit was also granted.
Because of escalation of costs for the concrete wall, Northern
States Power Company is asking the Council to approve a
change in the wall material from concrete to wood. We feel
that the change will not detract from the esthetics of the
proj ect .
We ha�e contacted Eide Realty, Inc. of our plans to change
the construction material from concrete to wood. ThEy also
feel that the change will not detract from the project.

is hereby adopted and confirmed as the proper unpaid sanitary sewer
rental charges due for the above described properties through September

and the current charge against each such parcel of land shall be a
lien concurrent with general taxes upon such parcels and all thereof.

The area proposed to be assessed for said improvements is sit ated
within the City of Mendota Heights in Dakota County, Plinnesot , and
is more particularly described as follows:

or City Clerk of the City of Mendota Heights within 20 days after he adoption
of the assessment roll and filing such notice with the District Co rt within
10 days after service upon the Mayor or Clerk. �
You are hereby advised of the provisions of Plinnesota Statutes, Section 435.193,
435.194 and 435.195 which provide for the possibility of a deferral of special
assessments in the case of hardship for senior citizens.
This Council proposes to proceed under and pursuant to the authority granted
to it under the Minnesota Statutes, Section 429.
