PAUL WHEREAS, the saga of I-35E construction in Dakota County and in St. F has raged on for nearly 25 years; and WHEREAS, the I-35E corridor bisects the community of Mendota Heights; WHEREAS, certain interests in St. Paul have, in the past, caused the legislature to restrict portions of I-35E in�St. Paul to a parkway, terminating onto City streets, thereby removing it from the category of a freeway; and WHEREAS, the Mendota Heights City Council in 1977, adopted Resolution No. 77-82, expressing its intent to pursue a parkway concept through Mendota Heights consistent with that proposed in St Paul; and • WHEREAS, the current status of I-35E, including present legislative debate, was discussed by the Mendota Heights City Council at its regular meeting on March 2, 1982. Facia boards were installed�by Pittsburgh-Des Moines Steel Company at no cost to the City io camouflage the dents in the tank. We will be going inside the tank this Spring to inspect what damage may have occured to the protective coating be- cause of welding these boards to the tank. 7II-4 FRIENDLY HILLS WATER COMUERSION P1urr Plumbing completed the required changes in May to connect the Mendota Water Company system to the St. Paul system. The well will be abandoned this winter by Keys Well Drillers, and investigation by the Minnesota Department of Health caused the delay. The tower will be dismantled this Spring by P-laster Tank Company. It should be noted that this project completed another im- portant loop in the water system be�tween Dodd Road and Delaware Avenue. 78-6 EAGLE RIDGE STORPI I�JATER PROJECT This was a storm sewer project along Victoria Road from Eagle Ridge Drive to Burrow Pond and from Victoria Town- homes to the Pond. The contract was awarded to Sandmark Construction, Inc. and was completed on schedule. This project handles surface water from the new Victtrria Townhomes project and also solved erosion problems on Victo�ria Road and the Burrow property. 79-8 VALLEY VIEI�J OAKS The public improvements for this project were staged to allow utility work and street construction to be con- structed in 1980 and landscaping and blacktopping in 1981. The Contractor for this project was ACG P�9echanical, Inc. and they completed the work in the time specified. Because this job was located in the Mississippi Critical River slope area, special attention was paid to storm �Nater drainage by the construction to two holding ponds and street width and.berms were narrowed so as to disturb as little as possible. 79-7 L.C.S. Richard Knutson, Inc. is the Contractar on this project and has instalied the undergraund utilities this year with the streets and other remaining work to be comp7eted in 1982. The City has been denied a Railroad track crossing from the Milwaukee Rail- road at Trunk Nighway 55 and is presently gaing throuqh a public hearing to decide the fate of the"crossing. Sarton-Aschman has been commissioned to work with the City Attorney's Office in representing the City at the hearing. With the early �haw, we had problems on Bl Gentian Rd. with mud and ruts. Excess P-rock le�t o fram seal-coating was hauled in to help stabilize th driving surface. This cured �he problem, and left a fairly good driving surface. ! The City of West St. Paul was good enough to loan us their small bull-dozer to allow us to push and shape our land fill site on Freeway Rd. Brian Mueller was hired as Tree Inspector. July brought us more prepreation for seal coat work. A contract for Diseased trees was let and the City crew went around and reestablished the sod and dirt after the tree stumps had been removed. More work was done on the Wentworth Pedway. The Friendly Hills hockey rink rework was started with new boards and paint. August brought about the final sealcoating of some of our areas. John Neska and Tom Olund toured Metropolitan Waste operations in St. Paul. Many hours were spent trying to put together a workable and agreeable budget. In September we had two water service leaks to repair. General patching of streets continued and the sweeping of excess seal coat materials was done. Kamish & Sons hauled in many yards of fill material to the Civic Center site in anticipation of future development. In October we did traffic counts on al1 MSA streets. The fence around Friendly Hills water tower was taken down in order that the tower can be dismantled. Grading of secondary roads for winter travel was performed. Marker posts for hydrants were put in. John Neska, Terry Blum, and George Noack attended a two day seminar for equipment operators. This was due to the sm�ll budget of $3,000 for the year 1981. Our new water tower continued to give us some problem�. We had to operate the altitude valve by hand for some�time during the year. We also had to completly dismantle he altitude valve to clean out sand and sediments which ad accumulated and caused the valve to leak. The well p'�t had to be , pumped twice weekly due to water being exhausted thro gh the altitude valve as it operated. The Utility and Street Depts. did the excavating of a leaking water service on Victoria Rd. We also dug a water service on Wagon Wheel Trail that was thought to be turned off at the corporation on the main. It was found not to be connected from the stop box to the line extending from the home. I'm hoping that with the amount of money we spent on the I&I study that we will continue to try and correct the problem. . The study to my knowledge should have been completed by now. As of this report, I haven't seen a final analysis. It seems that there has been a lack of communication from Short-Elliot . and Hendrickson..in reguards to keeping the Utility Dept.informed � on just what they are doing. This was due to the fact that it was in a poor drainage area. The ground was never quite stable enough to support the walls of the rink and keep them in a straight line. The hockey boards were painted, and all of the overhead lighting was moved to provide proper lighting of both the free skating and the hockey areas. The Friendly Hills Hockey rink was completly refitted with ' new boards or plank to update it with all the other rinks. 0 Both Ivy Falls and Friendly Hills were painted on the inside and on the outside of the hockey rinks. Many trees were transplanted this year in the Parks. Due to the overpopulation of trees in some parks; we transplanted many to other more needy areas to help make them more attractive. Rental of the Tree Spade used was at a cost of $750�. Due to the vandalism at the Archery Range; Many of the excelsior bales were replaced. This was also partly due to deterioration of the posts and bales. Cost of the bales: $283.50 Most of the rest of our time was spent doing normal summer and winter grounds maintainance. With the long growing season this past year, many hours were spent mowing the many acres of grass. Combined with the initial discount each city received, saved its 220 participants well over $1 million dollars. As was done for 1980, the dividend payment for individual cities was c according to a formula which takes into account both the size of the c premium and the loss experience of the individual city. Specifically, of the dividend is allocated among participants proportionate to the c mium, and two thirds is allocated based on the loss experience of the city. Based on this formula, individual cities' dividends ranged from of 8.30 of premium in a city whose losses and expenses exceed their pr -' about 1/3 of premium if a city had no losses�•at all. m CIT workers nt. For cities whose loss experience was good, the total savings a e much higher. This marks �rt�e second consecutive year in which the LMCIT workers' com ensation program has returned a 25% dividend to its participants. We feel that the success of this program demonstrates what can be accomplished when cities coop rate to address their insurance needs and we look forward to continued success in the coming years. The first and most appropriate action of the Council once a deter ination has been made that the municipal liquor licensing provisions should not be retained, is to draft and adopt a new ordinance to rescind the existin municipal liquor ordinance. The Council must then choose whether to s' ply ignore the Iiquor issue at this time or to prepare and adopt liquor lic nsing regulations. PRIVATE LIQUOR LICFNSING OPTIONS The first, and most obvious alternative to municipal liquor is to repare and adopt an intoxicating liquor licensing ordinance which would accomm date the licensing of both on and off-sale private liquor establishments. M.S. 340, Subdivision 11, states that "on-sale licenses may be issued for the sal of intoxicating liquors in hotels, clubs, xestaurants and establishments f r the sale of on-sale liquors e�clusively within the number authorized by thi Section". The City may, according to statutory provisions, issue a maximum of six on-sale licenses. In addition, the City may continue to issue the two club lic nses to Mendakota and Somerset should the clubs prefer "club" over "on-sale" li enses. The license fee for a"club liquar license" is $100 per year, and a lic nse ma� be issued on the condition that liquor sales be only to club members an bonafide guests. The state statute does not specify license fee maximums for on sale liquor licenses other than club licenses. The statute simply states th t"on-sale licenses shall be granted and an annual license fee therefore sha11 be ixed by the City Council in advance at a specified sum for the year by the respecti e municipal- ity authorized to issue the licenses". For your information, we have a tached an excerpt from a League of Minnesota Cities bulletin on liquor licensing hich indicates the average Iicense fees charged in 1981. M.S. 340 gives total discretion to the Council on the numberiof of -sale Iicenses to be issued in the community. It sets a maximum Iicense fee f$200 for each off-sale license. The statute provides that such licenses may be issued only to "exclusive liquor stores or drug stores." An exclusive liquor tore is defined as an establishment exclusively for the retail sale of liquor a d under Che control of an individual owner or manager. � � - 3 - The statutes provide that the City may impose restrictions and re on the sale of intoxicating liquors within the City limits more strin€ those established in M.S. 340. The statutes require however, that a referendum on the issuance of Sunday liqu r be conducted. Sunday liquor requires a separate license to be renewed annually. It would appear to be a safe assumption that someone requesting an on-sale 1'iquor license would also have strong interest in the Sunday liquor provision. The mo t appropriate time to conduct a referendum for Sunday on-sale liquor, regardless of whether tha liquor licenses are actually issued in 1982, would be to cond ct a referendum at the November general election. � Issue No. 3- on-sale wine licenses.
