he caas advised o£ the variance requast and acicnowledged
that the plat convenant on setbacks does not prohibit the ,
Council from granting a variance. Mr. Prokop distributed a
copy af a Ietter signed by the awners of all residences
within Crown Poin.t an.d Mr. Strub, as a partner in the Men- �
dota Company, appraving the granting of an eleven faot
frant yard setback variance.

ANNUAZ REPORT Department Annual Repart, particularly those sec�ions

In response �o the discussion on fire facilities, the Counci
directed staff to begin a study an facility siting, including
contacting Mr. Herb Warnelce and Perkegwin. Investment Company.
Public Works Director Danielson updated the Council on the
status af the Opticom System installatian.
Police Chief Thul reviewed the 1981 Police Department Annual
Report and responded �o Cauncil questions on degartment
activities.
The Council acknawledged a Ietter from the Dakota County
Plannin� Department r�garding potential Coun�y involvement
in the Metropalitan Regianal Railroad Authority.
PARK AND 12ECREATION Fark Cammission Chairman Bayless advised the Cauncil on
COMMISSION let�ers to Dakota County on trails and Police Chief Thul
on patralling of parks which were a�tached to the February
9th Commissian min,utes. �

FINANCING Financial Advisor Shaughnessy advised the Cauncil that :
recent State legislation gives cities short term borrowing
power to finance general fund deficits creat�d by delayed
and reduced Local Govexnment Azds and Homestead Credits. He
a. advised the Gouncil that he is currently studyin� arbitrage
�� regulatians based on a cash flaw analysis and anticipates a
potential $300,000 to $400,000 borrowing limit. Mr.
Shaughnessy stated that he would pursue the matter if the
Cou�cil so directs, and would contact variaus financing
agencies to negotiate a favorable interest rate. ,r��
The Council directed Mr. Shaughnessy to proceed and ta
report back at a March meetin�.
MN/DOT RIGHT-O�- City At�orney Wittthrop advised that the City has been joined
WAY ACQUTSITION in several suits an land acquisitian by Mn�DOT for I-35E
invalvin.g assessments and easements, right-af-way acquisition
•which would involve Mn/DOT relacation of City utility lines ,
and the acquisitian af twa parcels of land in the Curley Add-
itian area which had been transferred ta City ownership throug:
the tax f.orfeiture process. Mr. Winthrop advised the Council
that the City has received an apprais�l price of $36,000
on one of th� tax farfeited parcels while the offer from Mn/D�
is nnly $19,250. The second parcel has not been appraised,
but the Mn/DOT offer is anly $20Q. He recommended that the
City reftzse both offers and attempt to n�gotiate more
"appropriate acquisition prices for both parcels.

For the C/I permits issued in 1981 the figures show that 17 permits were
issued in 1981 and 21 permits were issued in 1980. This shows a decrease of
4 permits while the valuation difference was $2,533,975 or a 77� increase. The �'
total fees collected were $12,181 which is approximately 76� increase. Our average
C/I permit for 81 was $192,695 in valuation and $931 fee collected. The 1980
figures show $35,325 for average valuation and $177 fee per permit. The 81
valuation was 81� over 1980 and the average fee collected was 80� over 1980. °

Miscellaneous permits equaled 189 issued in 1981 compared with 158 issued in �
1980 which shows an increase of 16�. 1981 valuation was $1,156,171 while 1980
valuation was $718,259 which also shows an increase which was 38�.
The fees collected in 81 were $20,196 and $6,369 for 1980 which increased by ,
approximately 68�. The average 81 permit valuation was $6,117 while 1980's '
average valuation was $4,546 which has an increase of $1,571 or 250. The difference
between fees collected in 81 v/s 80 was $13,827 which would be approximately

The trade permits which include plumbing, water, sewer, heating/air
conditioning, and gas piping permits equaled $6;282 of fees collected for 255
permits in I981. I have issued 273 trade permits for a total of $7,308 for 1980.

The last portion of my report deals with contractor's licenses which includes
Masonry, General Contractor, Plaster/Stucco, Heating/Air Conditioning, Gas Piping,
Roofing, Sign, Excavator, Fencing, Landscaping, Pool, Siding, and Paving
Contractors. For the year 1981 Council has approved 251 contractor's licenses
and a fee of $6,275 was collected. In 1981, 234 licenses were issued at a fee
of $5,788. Both the number of licenses issued and fees collected have increased
as follows: 17 more licenses were issued in 1981 which equals approximately
7� and the fees collected show an increase of $487 or 8$.

To recap the 1981 totals,�the City of Mendota Heights and the building
inspe�tion department has issued a total of 760 permits and licens s for a
valuation of $8,391,776 and the 81 fees collected totaled $80,522. The 1980
figures show 727 permits issued for a valuation of $4,928,421 and ees collected
equaled $38,828.
The'increase in the number of permits totaled 33 or' 4�. The
equaled a$3,463,355 increase of 41�. The fee collected figures
increase which is approximately a 52� increase.

In addition to plan review and field inspection for permits i sued, I have
attended during the year of 1981 to maintain my state certificate chools and
seminars to stay current with the f�st changing world of construct on methods
and new techniques. I have attended consulting meetings with City Planner Howard
Dahlgren and staff to review variances, etc., in order to be able o write reports
to the Planning Commission and Council as part of the decision-mak ng process
during their review.
I'm looking forward to a successful and fullfilling year in 1 82 hopefully
equally as productive as the year of 1981 for the City of Mendota eights. 1982

Attached is a copy of a topography (1"=200') of this area of the ity

identified in the Wetlands Map. `
2. You will note that the proposed facility intrudes into trie Wetlan s
Drainage Course as indicated on the attached topographical map.
3. Your Engineering Department has reviewed the drainage propolsal in
cooperation with the Mn/DOT Design Engineers, and conclude that t e
proposed filling of the land and alteration of drainage course is a
workable solution. Mr. Jim Danielson will be at the mceting to e plain
the details of the drainage alterations as proposed.
4. You will note that there is an attached reduced copy of rhe propo ed
facility site plan indicating existing and proposed contours. In
general, the drainage swale is reconstructed on the northerly sid of the
property, with the bulk of the land being regraded for storage ya d
purposes in conjunction with the Mn/DOT structure.
5. More complete plans of the Mn/DOT facility will be available at t e
meeting, including floor plans and exterior elevations. The stru ture is
proposed to be built of brick, and contains 42,000 square feet. The
total site is 15 + acres.

The access to the site will be via a��ublic street which will be edicated
in accordance with previously prepared site plans f.or the MAC Ind strial
Park Development of which this project is the first user. As you know,
the City has been encouraging the M�tropolitan Airports Commissio to
develop the land for light industrial uses as was originally pro}� sed by
the MAC staff over six years ago. The development of this struct re and
the public roadway serving this site will facilitate, in our o�i ion, the
re-use of this land for indu:�trial purposes.

1982
h�in/DOT D�istrict 9 has worked with City officials to 1ocate a new main-
tenance garage in the Northwest corner of the P1.A.C. Property. T e remaining
property is now being prepared by M.A.C. for resale to a develope . M.A.C.
has been working closely with the City in that process. ,
The site that M.A.C. is selling to Mn/DOT for the maintenanc building
has a gully running along its North boundary that is adjacent to he Acacia
Cemetery. That gully appears in the City's Wetlands ordinance as a drainage
way and therefore n�eds a wetlands permit. �
In my opinion, that drainage c�ully has not carried any larqe volume of
water since Pilot Knob Road was constructed. Mn/DOT has designed a drainage
way along their North property line adequate to handle the existing runoff
volumes.
We, the City Staff, feel this wet1ands matter is of a minor c nsequence
to the City's system and recommend the Planning Commission waive the require-
ments for a public hearing. 6�1e feel that su�ject to Mn/DOT granti g the re-
quired Right of Way for future City str�et purpos.es, the permi:t be granted.

regional off-sale liquor establishment. They desire to lease a proxi-
mately 12,000 square feet of space in the center. To accommoda e their
desired occupancy will entail a change in the liquor ordinance rom a
public to private enterprise.
At the council meeting we will have in attendance MGM Liquor Wa ehouse
Inc. personnel and a presentation of contemplated Shopping Cent r
improvements including renderings and anticipated improvement c sts.

VIx. OFFIGERS
Section 1. Number/Election. The o�ficers of the Commissxon
shall cansist of a Chairman, a Vice Chairman, a Secretary and a
Treasurer, all of whom sha�l be elected at the firs� meeting o�
the Commission, and thereafter, at the annual meeting af the Cam-
mission held in January of each year. New afficers shali take
affice at the adjaurnment of the annual meeting of the Commission
at which they are elected. Only directars of the Comm�ssion are
eligible to serve as afficers.
Section 2. Chairman/Vice Chairman. The Chairman may preside
at a�l meetings of the•Board and Executive Cammittee and shall ner-
form all duties incident to the o�fice o� Chairman, and such other
duties as may be delegated by the Commission. The Vice Chairman

member municipala,ties for their adoption. The recornmended
franchise ordinance, if adopted, shall be executed and publi.shed
according to the requirements a� each member municipali-ty.
X. FINANC�AL MATTERS
Section l. F%scal Year, The �iscal y�ar of the Commission
is the calendar yeax.
Section 2. Contributians. Contributions for 19$1 and
subseauent years shall nat e:{ce�d the budget amaunt for that
given yeax. A member municipality sha1.1 be assessed a share
o� the budge� equivalent to the total number a� votes that
munica.pal5.ty has, as it corresponds to the formula set farth
in Appendix B at�ached to this Agr�ement. A member shall be

to exist after dissolution for such periad, no 3.anger than six

considerable mount of past history and describes our $12,000 grant. He has
not elaborated much on future problems and the need to stay involved however

I had not mentioned the $12,000 grant application in the past be ause I was
not sure of its outcome. Obviously I am happy to report this grant - it will pay
for past airport planning costs, and supply a minimal amount for fut re planning
activities.

BACKGROUND
As the City is well aware, the Metropolitan Council's efforts to amend a,
the Metropolitan Development Framework to address aircraft noise and .
safety planning issues has involved a very complicated and cumbersome '
process. Although this subject has not proceeded further through the u
Metropolitan Council Committee process, since we last met to discuss
these issues, there have been some significant developments.
It is also expected that things will happen very rapidly when this
current logjam begins to move. Therefore, we felt that this would be
an appropriate time to review the status of this matter. This
memorandum begins with a brief review of the process to date, explains ,
where it is currently bogged down, and concludes with a brief discussion
of the significance of the planning grant which was just approved for `
the City.
HISTORICAL OVERVIEW
1. MC/MAC Meetings, June 1979. Because of several inadequacies which
were found in its review of the Metropolitan Airports Commission's
Master Plan for Wold Chamberlin, the Metropolitan Council initiated
the formation of the MC/MAC Committee. Two of the issues to be .
considered by the Committee were aircraft noise compatibility and .
safety planning. We attended these meetings to explain the City`s
concerns and to react to draft revisions before they became
adopted policies. .,
2. First Mendota Heights/Eagan Joint Position Resolution, 24 June 1980.
As the MC/MAC Committee continued to meet, two things became
increasingly apparent. Th�se two things were far from unrelated.

First, it was quite obvious that very clear political lines w
formed long before we became involved, which separated the de

3. MC�MAC Committee Adopts Final Report, 5 March 1981. The effe

proposal was presented by Minneapolis Alderman Walter Rockenst
on �ehalf of the developed communities, which favored much str
standards and a disproportionate burden for land use compatibi
planning on undeveloped communities. The Final Report was to

several concessions in an effort to achieve a concensus position. .
Throughout much of the summer, the whole issue lay dormant, due �
largely to the fact that Mark Ryan, the head Metroplitan Council
Transportation Planner assigned to this project, was hospitalized
with pneumonia. After several months, members of the Dsetropolitan ,
Council grew impatient, contacted their staffs, and asked them to
get the ball rolling again. The working group met again and a
joint position paper was prepared in late June of 1981. `

9. Mendota'Heights Resolution in Sup�ort of Working Grou� Report,
July, 1981, On 7 July, the City adopted a re�olution supporting the
working group's report. This report was submitted to the P4etropol-
itan Council staff with a request to meet and discuss it. This
request was either misunderstood or ignored, and the matter was
scheduled for the 15 December meeting of the Transportation
Sub-Committee meeting.
In the meantime, Metropolitan Council staff had prepared their own
report and had made no effort to send it to or discuss it with
anyone. As a result, we found ourselves at the meeting with no
resolution to the problem. Metropolitan Council members were
understandably angry. Once again, the matter was tabled, but,
this time Maurice Dourton, the Director of Physical Planning, was
placed in charge of seeing that things were resolved within thirty
days.
10. Working Group Meeting, 5 February 1982. After the above mentioned
thirty day period had passed, and we had heard nothing, we called
to inquire. Once aqain, Metropolitan Council staff was intending
to revise their own report without discussing it with anyone of
the other affected agencies, and municipalities. After discussing
this matter amongst outselves, each of the affected staff planners
contacted their Metropolitan Council representatives to request a
meeting to review this report prior to returning to the Transporta-
tion Sub-Committee. Mr. Dourton was directed to hold such a meeting
and�`he did on 5 February 1982. Several problems were identified
with the Metropolitan Council staff report and this is essentially
where the matter rests today. Another meeting is to be scheduled
in the near future to review a revised report.

residents and users. Staff representatives and consultants hav
monitoring and attending meetings regarding airports noise and
issues, not covered in the Airports Element af the A.4etropalitan

essential service to this vast area, it creates an unacceptable noise
environment only in those cities which are located in close proximity
to it and along its flight corridors.
4Ve have already expended a great deal of time and money on airports
planning issues which were not covered in the r,ietropolitan Systems
Statements, and consequently, were not provided for in either contracts
with our planning consultants, or planning grants received by the
cities. The Minneapolis-Saint Paul International Airport is operating
in violation of the state noise standard. Judicial decisions at a
federal level continue to identif� the airport operator as the
violator. It is both unreasonable and unfair to expect local
communities to bear the cost of local land use compatibility planning
and subsequently, the cost of irnplementing these plans, without just
compensation.
It is equally unreasonable and�unfair to effectively place a penalty
on local property o�vners and developers, who will have to provide
noise abatement building and site features. The ?��inneapolis-Saint
Paul Airport serves an area which exceeds the State of P:iinnesota.
A11 of those who benefit from its service should share the cost of
the changes necessary to insure its continued operation, within
acceptable environmental parameters.
The following represents a summary of our position on several key
airports related issues:
ISSUE: What methodology is appropriate for determining
aircraft noise and what land use guidelines should
be adopted?
We agree with the MC/MAC Committee that the Noisemap Policy
contour represents the most current information about
potential noise exposure and that the utilization of the one
hour Leq's is �iositive in that it adds the important
consideration of frequency of exposure. The land use
compatibility guidelines which correspond to the policy
contours are more reasonable than the h�[PCA standards.
The Trletropolitan Council should play a lead role in working
out the details of the major discrepencies between the
proposed guidelines and the current state law. This will
definitely require action by the State Legislature.

After careful review and consideration we believe that t e
fairest and most effective place to abate nbise is at it

scheduled airline fleet continue to predict a prepondera ce
of first and second generation aircraft through the pla ing
period. Any agreement on the part of local communities o
amend comprehensive plans and zoning ordinances should b tied
to a firm commitment on the part of the airport operator and
all involved federal and state agencies to reduce noise t
its source.
ISSUE: Airport Operational Procedures
As part of the Minneapolis-Saint Paul International Airp
Master Plan, P,�AC is required to prepare a detailed noise
abatement plan. This plan should include such details a
recommended corridors, altitudes and engine thrust level
departing and arriving aircraft. The Cities of Northern
Dakota County are vitally interested in the content of t
plan and .�,v�.11 �vant to participate in its review and
consideration.
It is also firmly believed that this revised operations

If the reason behind implementing land use controls is to protect
the health, safety, and general public welfare, blanket variances
or relaxed performance standards should not be considered for de-
veloped communities. Variance criteria should be fairly and onen-
ly developed and representatives of both developed and undeveloped
communities should participate in this process.
ISSUE: Representation on Advisory Commi.ssions �
The Aviation Subcommittee of the Technical Advisory Committee con-
tains among its twelve members, representatives from four local
communities. None of these individuals renresents the cities of
Northern�Dakota County. The D![etropolitan Council should take the
necessary steps to insure that our position is lmown and given
proper consideration on all airports related planning issues.
ISSUE: Property Loss or Damages Due to Airport Safety and Noise Com-
patibility Planning
The cities of Northern Dakota County should not expect to bear the
cost of property loss or damages incurred through the ir.rplementa-
tion of airport safety and noise compatibility planning standards.
The basis for this position statement was established at a joint meeting of
the Northern Dakota County Cities, at the Mendota Heights City Hall, on

Mn/DOT Qistrict 9 has been working with City Staff in the des7gn of
a 42,Q00+ square foot maintenance garage facility to be lacated we t of
Pilot Knob Road on the North 15+ acres of the M.A.C. site.
A wetlands permit is need to construct a building on the site. That
permit applicatian was considered by the Planning Commission at th ir February
meeting and there was a unanimous vate recamsnending to tite Cauncii the granting
of the permit subject to heavy screening being provided for at their equip-
ment and storage lot. �
Because Mn/DOT will be bidding this project in Plarch they would like
assurances from the City Council that 8uilding Permits wiil be gra ted sub-
ject to final code review. �
City Code Enforcement Officer has not yet received a complete
signed pla�s and specifications for this buildin,q; however he has.'
preliminary plans and can make the following observations from the

their concerns being directed toward a ret3uirement for dense r�lanti gs as a
screen along the south boundary adjacent to the equipment storage 1 t.

6. Publie sewer and water are not available for this building at this
` time. Mn/DOT'haa petitioned the City for those facilities last fall but
because the building is not scheduied for completion or occupancy before
1983 plans for their installation were delayed. M.A.C. intends to sell the
remaining land to a developer in the next few months and staff feels that
delaying an improvement project until after that sale would be prudent.
7. 'We feel the building's sign design and location should be discussed.
8. The buildings access road follows the proposed alignment for a
future City Street and w� feel the right of way should be dedicated to the
City at this time.
Upon review of the submitted documents it is recommended the Council
grant a wetlands permit and a foundation permit to allow commencement of
this project in the Spring. A final building permit would be presented to
the Council after receipt and review of all required documents.�

The McNulty Company feels that in order to preserve a number f mature
trees, they need to add several wetlands permits to the ones origi ally con-
sidered. They a1so feel that in order to market these units they eed ap-
provals of the permits along with the P.U.D. approval. It is the 'ntent of
P.U.D.'s to provide a means to allow substantial variances from th ordinances,
provided the variances granted do not constitute a threat to the p operty
values, safety, health and the general welfare of the owners or oc upants
of adjacent or nearby lands.
t�Je have reviewed the 14 requested variances and find that the only
negative impact we are concerned about is that these structures ma'ntain a
minimum basement floor elevation of 85II M.S.L. Cross Sections sub itted
show that it is possible to maintain that basement floor elevation with less
than the required 100 foot wetlands setback. It should be noted t at four
units not requiring a variance appear to fall below that 858 conto r. Those
basement elevations will also be required to be a minimum 858.P1.S. . The
designed pond elevation is to be at 853.5+ and we feel that 4 fee or more
grade separation should be provided above that pond elevation. It should
also be noted that when Tom Knuth was surveying in this area he no iced a
great number of dead trees around the pond. l�e feel those dead tr es should
be removed to lessen the possibility of branches clogging the futu e storm
water inlet pipe.
We feel that these variances are necessary for a reasonable a d prac-
tical physical develop►nent of the site and are not requested solel on the
basis of financial considerations. �
