Held Tuesday, June 1, 1982
Pursuant to due call and notice thereof, the regular meeting of the ity Council,
City of Mendota Heights was held at 7:30 o'clock P.M. at City Hall, 50 South Plaza
Drive, Mendota Heights, Minnesota.
Mayor Lockwood called the meeting to order at 7:30 o`clock P.MI. The following
members were present: Mayor Lockwood, Council Members Hartmann; Losl ben, Mertensotto
and Witt.

Mayor Lockwood noted that the Planning Commission �,had recommendec
denial of Dr. Patrick Ballard's application for variance to
allow a 32 by 2 foot sign to be attached to the,Dakota County
State Bank directional sign located at the west parking lot
entrance.� D'r�. Ballarcl, preserit �for the discussion, expressed
his agreement with the Commission determination and stated that
he would rather that the bank install a sign on the front of
the structure. He indicated that Dick Stryker is checking for
tennant interest in�such a sign and that after he receives a
report from Mx. Stryker he will reapply for variance.
Councilman Mertensotto moved to continue the discussion on
Case No. 82-07 to a future meeting to permit the applicant to f'-
an amended variance application when an alternative proposal
has been prepared�. • \

CASE N0. 82-08, Administrator Johnson explained the application for the Council,
MURPHY (PAR 3 advising that a conflict in Mr. Murphy`s schedule does not allow

Danielson�advised th�at th�e pond is currently being used as a
settling pond but could possibly be developed as a detention
pond at such time as the area develops.

' hearing be waived and that the permit be granted conditioned '
`'-�"' '' ' upon submission of a filling plan which meets the Public Works
' � �Director's� approval�and subject to the condition that the City
may require'removal of the fill at some future time should the
pond be needed for storm water�retention.

CASE N0. 82-09, Mr. John Severson was present to request approval of a front

"RESOLUTION REQUESTING COUNTY TRAIL FUNDING," relative to
Dakota County participation in the construction of the Marie
Avenue trail.
Councilman Hartmann seconded the motion.

CIVIL DEFENSE The Council acknowledged and discussed a memo from County.
Civil Defense Director Dale Grimes relative to procedures for
activating the civil defense sirens. It was the concensus of
the Council that the Dakota County Siren Activation Procedures
. be adopted' as presented in the memo and that copies of a flyer
'• describing the�°procedures be distributed to all homeowners via
the newsletter and other appropriate means. .
MISCELLANEOUS

Administrator Johnson advised the Council that Public Works
Department time has been committed to assisting the Mend-Eagan
Athletic Association in the renovation of a ballfield at St.
. � Peter's Church: `��
MISCELLANEOUS Administrator Johnson advised the Council that he has been
contacted by the Dakota County H.R.A. relative to an application
for sanitary and storm sewer facility construction for the City
of Mendota. He advised that the HRA has stated that it would
like to be able to indicate in the application that Mendoa Height.
would consider maintaining a lift station and process sewer
billings for Mendota. The Council expressed its desire to
cooperate in the process, under a negotiated contract similar
to contracts with the City of Lilydale.
JUNK CARS
The Council requested current information on the tagging of
junk cars.
VAN LANDSCHOOT City Attorney Winthrop distributed and discussed a memo
LITIGATION relative to the opinion handed down in the Van Landschoot
case. It was the concensus of the Council that the memo
should be studied and digested and that a determination on
appeal be made some time during the next 60 days.
MISCELLANEOUS The Council acknowledged receipt of the Engineering Status
Report for May.
LIQUOR ORDINANCE The Council acknowledged and discussed a memo from the City
Clerk relative to questions needing resolution before final
preparation of an on-sale liquor ordinance. A concensus was
�� reached on all items except size and seating requiremerits, and
~` the Clerk was directed to research requirements of other
communities .
ELECTRONIC GAMES The City Clerk was directed to research and report on how
surrounding communities address electronic games.

ordinances resulted in two inconsistencies in e s�op and
yield intersection ordinance and recommended a option of a
corrected ordinance.
Council.man Mertensotto moved the adoption of Or inance No. 197,
"AN ORDINANCE AMENDING ORUINANCE NQ. 1113", to eplace the
existing codified ordinance No.. 113.3, "AN ORDIN CE ESTABLISHING
STOP AND YIELD INTERSECTTONS WITHIN THE CITY OF MENDOTA HEIGHTS".

RESOLUTION N0. 82-
RESOLUTION ESTABLISHING ASSESSMENT FORMULA
FOR REMOVAL OF DISEASED TREES
WHEREAS, the State Legislature has passed legislation authorizing and
encouraging local governments to be active in diseased tree removal; and
WI�REAS, on.May 3, 1977, the City Council unanimously elected to
enforce the provisions of Section 18.023 in the remova� and assessment for
removal of diseased trees; and
WHEREAS, it appears that assessments of one year duration merely
extend the agonizing period of tree removal payments; and
WHEREAS, State law authorizes the spreading of such tree r�smoval
costs over a five-year period.
N�W., THE�tEFORE IT IS HEREBY RESOLVED by the City Council of the City
of Mendota Heights that tree removal costs incurred by the City on private
property shall be spread over a five-year period at 11% interest on the
unpaid balance.
Adopted by the City Council of the City of Mendota Heights this 15th day
of June, 1982.

MONTHLY TRAINING The regular scheduled two hour drill was used to pump
water with several, differant set-ups used. Men from the department atterid-
ed "Special Drills" during May. The first,was on May 1, at the As'hland Oil
in St. Paul Park. They went into the "smoke-house", a training building,
which contains smoke and high level of heat. Firemen enter with full�gear
including breathing units, open a window and vent out the smoke and heat.
The second special drill was with Dakota County fire departments in a,mut-
ual aid exercise in Eagan. Over 4,000 feet of big hose was laid and pumpers
were added along the route to raise pressures. �

Dear Mr. Mayor and Council Members: I
Sheehy Properties, Inc. approached the City Council of
Mendota Heights on April 20, 1982 relative to our interes
in the location of a MGM Liquor Warehouse facility in
Mendota Plaza. With the approval of MGM Liquor Warehouse
Inc. as an off-sale liquor applicant, we would proceed wi h
our renovation plans.
Subsequent to our latest correspondence to the City of
May 10, 1982, we have matured our lease agreement with
MGM and have preliminary estimates on our renovation plan
From my most recent conversation with the City staff, I
understand the formation of a private off-sale ordinance
is currently proceeding with formalization expected in th�
not to distant future.

We would like an audience with the Council on Tuesday,
June 15, 1982, to unveil our proposed improvements and
to attain formal guidance from the Council as to the propE
procedures required to realize our desired objectives.

MISGELLANEOUS Mr. William Sheehy, af Sheehy Properties, and Mr. Pat Maglic�
of MGM Liquars, were present to request Council adoption of:
provisions to a11ow the issuance af an off-sale liquor :
license to MGM Liquors ta aperate a facility in t�e Mendota
Plaza Shopping Center. Mr. Sheefiy advised the Council that•
his firm propased major renovation of the shapping center,
inciudxng screening of the roaf tap ventilation system an
trash areas, replacement af ceiling tiles, removal of out� a�
signs, ct�anging the rnetal facade of the fro,.� of the structur�
painting of the structue and paa.nting and patching on the
rear of the facility.
Mr. Sheehy stated tht3C the MGM aperation in the center
wauld pramote interest by new retail clien�s and will
be a catalyst for his firm to make improvements to the
center. He advised that MGM is interested in leasing
12,OQ0 square feet adjacent to Snyders, and that approx-
imately 5,000 square fee� of space will then be available
for other retail enterprises. The Council sugges�ed, and
discussed with Mr. Sheehy, the deaireability for a hard-
ware store in the center. Councilman Mertensatto sugges�ed
that parking spaces be provided at �he rear of the facility
to encourage greater access at the south entrance ta the
building.
Mr. Maglich reviewed the history af the MGM operation for
the Council, advi�ing that they currently operate 18
retail stores and provide higYi quality service and
selection. He asked the Council to enact a private off-
sale liquor Ordinance and to consider MGNf as a license
candidate.
Mayar Lackwood advised Mr. Maglich and Mr. Sheehy that nc
action can be taken immediatel}* by the Council �nd that any

action on the matter caoulcl be at least two to three months
into the future. He also asked Mr. Sheeh� how he wauld
react to a.nterest by the Wi.lder Foundatian in using a
portion of the Sheehy property for a senior citizen fac�lity.
Mr. Sheehy advised that his firm would be very favorable
to an e2derly housing faci,lity on the approximate 3.6
acres of land available sauth of the shopping center.

other representatives have met with representa�ives af St,
Thomas Academy and Visitation Convent and ather awners of
all property within 350 feet of the site ta explain the

existing and proposed contours, site lines and wetlands

Mr. William Richie of William Richie Construction, has request
building permit to do some remodeling at the Surfco Gas Station, lo
at 1960 Dodd Road. �
This station was formerly a Ske1ly.Station and a conditional u
permit was granted to Skelly by the City Council on April 6, 1972,
the following minute excerpt:
Councilman Stringer moved the Council approve the application o
Oil Company for a conditional use permit for the construction of a s
station on the corner of Dodd Road and Highway 110; subject to the h
operation to be 6:30 A.M, to 10:00 P.M. until further order by the C
further limitations: no un-enclosed storage of trash, which include
oil cans, drums, old.tires, etc., nor any storage of junk or wrecked
premises. The approval is to be conditioned upon the site plan, lig
sign plan, and the photograph submitted to the Council as part of th
Motion seconded by Mayor Huber. Vote: Ayes: 5, Nays: 0.
Councilman Stringer moved the issuance of a building permit to
Company to construct the service station in accordance with the plan
to the filing of a landscaping performance bond in the amount of $3,

Upon finding this information, I contacted Howard Dahlgren to 'ee if an
amended conditional permit would be necessary before Counci:l reviewe� the
permit application. According to Howard, this action would not be r�quired as
long as there was no enlarging of the present structure or the remod ling was not
being done to create a convenience store/gas station. According.to e plans
submitted, neirher of these conditions will be created.
Mr. Richie's contract and permit will be to remodel the.existin
by: 1. removing all existing shelving; 2. installing a new coun'te
installing new wall paneling; 4. install new vinyl flooring; 5. in
14 foot by 14 foot security curtain wall in half of the north garage
installing a new two compartment above floor safe; 7. installing ro
cedar siding over the existing bay doors; and insulating from the in
the bay doors. '

The Fire Relief Association now requests twa final changes. T ese changes
are noted on the first page and fifth page. The firs� request seem �consistent
with the cancept af aZZawing a form of bene�it�far those w`ho��have s rved at leasr
10 years (as per the schedule an page 5,'Early WiChdrawal). �
The�second change is merely adding a sentence to this dzaft = sentence
that does exist in the old By=].aws. I believe that both.changes ar proper and
acceptable.

Design Public Hearing on Tuesday, June 22, 1�82 at 7:30 P.M�. to d�
the proposed Mendota Interchange project at the junction of Trunk
13, 55 and 110. There will be an informational open house prior ��
hearing from 5:30 P.M. to 7:�30 P.M. The hearing and open house w�
held at St. Peter's Catholic Church near the east end of the Mendc
at the intersection of Trunk Highways 13 and �55. '

This hearing will be held in accordance with the pr�visions �f United
States Code, Title 23, Section 128.
The project, as proposed, would consist of reconstructin4 Tr
Highway 55, adjacent to the present roadway, from the Mendota Bri
Mendota Neights Road and reconstructing Trunk Highv�ay 110 from Tr
Hiqhway 55 to Lexinqton Avenue. It would also include the constr
of a partial interchange at the junction of Trunk High��ays 55 and
well as the construction of a nevr Trunk High�rray 13 connection, on
alignment from near I-494 to Trunk Highway 55. In addition,' ther
be a separate connection from Trunk Highways 55 and 110 to the Ci
Mendota, and several miles of frontage road for local traffic.

� The purpose of the proiect is to correct the traffic congesti�On and
accident problem near the east end of the Mendota Brida,e.. ' �
' One 0.6 acre wetland will be filled by the construction. It
classified as a Type 2 wetland, based on U.S. Fish & t�lildlife Serv
Circular No. 39. It will be replaced by several new wetland areas
will be created as part of the pro,ject. • �

Portions of the Mendota Historic District and Fort Snelling S
Park will be crossed by a storrn sewer from Trunk Hight��ay 13 �to the
Minne.sota River. In addition, there will be some encroachme�nt by
Highway 13 onto St. Peter's Church property which is also in'the M
Historic District. The construction in these areas will involve t
following protective Federal legislation: Section 4(f) of the Dep
of Transportation Act of 1966, Section 106 of the �lational Histori
Preservation Act of 1966, and Section 6(f) of the Land and l+later
Conservation Act of 1965. ;

No date has been established for construction because of pres nt
hiclhway funding difficulties. However, it would be after I-35E an I-494
are substantially completed in Dakota County.
All interested persons, governmental agencies, and nublic int rest

come in on June 1, 1982 to perform the inspection.

During the prior week, the tank was drained down by valve con�trol so that
the inside tank walls were exposed for examination. , I
The Sai.nt Paul Water lJtility provided an employee who togethe with PDM's
man determined that burned spots did exist and that paint repairs ill be
necessary.
Because of pri.or scheduli�ng it was not possible to do any rep iring
immediately with the result that the tank was refilled for normal se.
In a discussion with the Saint Paul Water Utility, they sugge ted that
we do not attempt the repairs now or during the balance of the su er because
of possible drought periods and the Water Utilitys requirement fro N.S.P.
Company to pump�only during off-peak periods.
Today, we received a call from Oean Bach of PDM acknowledging the need
for corrective work and suggesting that, because of scheduling, po sibl,e dry
weather. periods and so forth, that we hold off repai�rs until fall.
After considerable discussion, and learning that the tank wou d be down
for about 2 weeks during repairs, it was agreed that PDM wou:ld hav a crew
here on September 13, 1982 to start the work. j
Saint Paul Water Utility has also agreed to have an inspector
to check the work when it is done. I
