Pursuant to due call and notice thereof, the regular meeting of the C
City of Mendota Heights, was held at 7:30 o'clock P.M, at the City Ha

Mayor Lockwood called the meeting to order at 7:30 o'clock P.M. The ollowing
members were present: Mayor Lockwood, Councilmembers Hartmann, Losle en, Mertensotto

Councilman Mertensotto stated �hat it was apparent that th�
developer has not met the concerns of the neighbors and that
it would nat be feasible to pu�, a planned unit development on
less than ten acres, as requa.red by Ordinance and that in his
judgement the application shou7.d be denied.

Councilwoman Witt apologized for her comments regarding the
October 5th hearing regarding comments of neighbors outside the
adjacen� property relative to the proposed praject.
Cauncilman Mertensotto moved tha� the variance that was previously
granted on Augus� 3, 1982, to �he developer, be rescinded.
Councilwoman Witt seconded the motion.
Mr. Char7.es Bartholdi, attorney �ar Federal Land Company, asked
Mayor Lockwood ta read Ghe resolution denying the application
for Federal Land, whieh Mayor Lockwood did.
REMOTE FIRE PAGER The Council ackns�wledged a memo fram Gene Lange, Fire Marshall,
TRANSMITTER relative �o the proposed purchase af a single channel, transmitter
only, radio and antenna system, in the amount of $2,394.50.
This would be installed a� Somerset School. After some discus:, ,
Mayor Lockwood moved that staff be directed to have the transmitter
installed and �hat the cost of the antenna, etc. be workecl out
on a equitable basis wi�h the City af Was� St. Paul.
After further discussion on whether West St. Paul would be
agreeab].e to this, Mayor Lockwood withdrew his motion.

be $46,415, assessed equally among the five property owners.

Mayor Lockwood asked for questions from the Co cil. Councilman
Mertensotto wondered how long the street improv ment was in terms
of lineal feet. City Engineer Kishel advised hat it would be
approximately 300 lineal feet in length, with six inch gravel
base and two inches of bituminous surface, 30 f et wide. Mr.
Kishel explained the problems with the easement between Mr.
Abrahamson's home on Lot 7 and Mr. Smith's home on Lot 6, noting
that there is existing vegetation and trees/shr bbery which
would have to be removed and replaced. He also noted that
the streets in this area were installed in th early 1960's and
that the normal street life is 10 to 15 years.

Mr. Ralph Menning, 706 Maple Park Court, (Lot 8 B1 6,) spoke
against the project, noting that the City has n t maintained
the drainage easement and that he is satisfied ith the streets
the way they are and that the City should take esponsibility
for fixing the area.

Mr. Richard Herzog, 703 Maple Park Court, (Lot 4, Block 6),
presented a notice of his objection�to the propo ed project, asking
that his copy be signed on the bottom indicating receipt of his
objection. He also noted that three of the five affected property
owners object to the plan. He also presented th Council with
a petition of about 40 other neighbors who objec ed to the
proposed improvements. He felt that the message was clear that
the residents were not interested in any unneces ary construction
of streets, curbs and gutters or storm sewers.
Mr. Ellis Abrahamson „ 714 Maple Park Court, (Lo 7, B1 6), stated
that he receives water literally like a river be ween his home
and Mr. Smith's home and that he is in favor of he proposed
project.
Mr. Robert Leffert, 669 Maple Park Court, stated that he felt that
the City deserves decent streets but that he is ot in favor of
the project. He stated that there has been no st eet maintenance
in the area since 1981 and noted that the reside ts feel that
they are being ignored. They want their streets maintained but
not in such an expensive manner. He acknowledge that some
work should be done, but did not want an elabora e project.
Mayor Lockwood noted that he would continue the earing until
9:00 P.M. even though another hearing was schedu ed for 8:45 P.M.

Mrs. Gail Foreman, 688 Woodridge Drive, noted that she has
lived in her home nearly 20 years and has seen almost no
street maintenance. She asked for evidence of work records
for maintenance work done in the area.

Mr. Jerry Masters, 671 Arcadia Drive, noted that he had assessed
the area and does not feel curbs and gutters are necessary. He
felt that perhaps the streets should be overlayed, not rebuilt.
Mr. Arthur Freeman, 1127 Sylvandale, stated that people are not
interested in curbs and gutters, and also felt that perhaps
some spots need rebuilding.
Mr. Amos Martin, 700 Woodridge, questioned if the five parcels
would be exempt from any future creek improvements. Mayor
Lockwood stated that they "probably" would not be exempt.
It was the concensus of the majority of the audience that they
would be satisfied with a one to two inch overlay of the
streets.
Mr. Larry Walker, landscape architect for Mr. Abrahamson, urged
the Council to explore other less expensive ways to solve the
drainage problems.
Mr. Robert Leffert asked that City Engineer Kishel prepare a
lesser project.
There being no further questions or comments from the audience,
Councilwoman Witt moved that the hearing be closed at 9:14 P.M.

The Council directed staff to prepare a feasibility report, on
a lesser scale, that would give permanent streets and

Mayor Lockwood called the meeting to order for the purpose of a
public hearing pursuant to the requirements of Minnesota Statutes,
Section 462C.01, as it relates to adoption of a General Housing
Plan. He then turned the meeting over to Larry Shaughnessy,
Treasurer, for a brief presentation.
Mr. Shaughnessy gave a brief history of the housing plan and
noted that Carol Schultz and Mark Ulfers, both from the Dakota
County HRA were present for discussion. He then turned the
meeting over to Carol Schultz.
Ms Schultz advised the Council that the 25 page document
that was prepared by the HRA was, for the most part, taken
from the Land Use Plan of the City's Comprehensive Plan updated.
She noted that Eagan and West St. Paul have also acted on the
housing plan in September and that they will go through identical
plans as Mendota Heights, in November.

Mayor Lockwood noted errors and typographical e rors in the
document that should be corrected. Ms. Schult went on to
explain the document and Mr. Stan Kehl and Mr. aul Ekholm,
from Miller Schrmeder, spoke on bonding and int rest rates,
as well as the implementation program.
Mr. Carmen Tuminelly, a member of the audience, questioned
the land costs in Mendota Heights, as compared o the costs
in West St.Paul and Eagan. Mr. Kehl responde that the figures
( are the same for the 7 County Metro area.

Zemke discussed the timetable set up by the Executive Committee.
November 3, 1982 will be the review meeting regarding RFP policies.
November 10, 1982 is the date for a public meeting and hearing
on policy decisions in the West St. Paul Council Chambers.
November 24, 1982 is a tentative date set to meet with the City Attorneys
regarding RFP and Preliminary Ordinance.
Tatone made a motion to accept the report of the Executive Committee.
Seconded by Hanson. Motion carried unanimously.
VI. Ownership Committee Report.
Tatone made a motion to accept the Ownership Committee minutes of October
6, 1982 and October 14, 1982. Seconded by Witt.
Tatone moved to amend the minutes of Oc•tober 14, 1982. The meeting was
moved to adjourn by Witt at 8:33p.m., seconded by Hanson.Motion carried unanimously.
Hanson made a motion to receive the amended minutes, seconded by Baird.
Motion carried unanimously.
Tatone discussed the October 14, 1982 Ownership Committee minutes.
Baird moved that the Commission approve..recommendation .#l.On going
administration of the operation be handled by a commission.

of or. going administration be funded to the extent possible out of
cable revenues.

pay its employees no less than minimum wages as specified by applicable
state or federal law.

The meeting was called to order at 6:30 p.m. by Chairman Dave Zemke.
Directors present were Duncan Baird, Paul Tatone and Ken Hanson.
Also present was John Gibbs, legal consultant.
A discussion followed regarding the date, time and place for the public
hearing on the policy decisions. Due to a scheduling conflict arrangemen s
will be made to use West St. Paul's Council Chambers on November lOth at :30 p.m.
A news release providing the date, time and place for the public hearing ill
be placed in the Voice, St. Paul Dispatch, South-West Review and Sun News ape
Paul Tatone made a motion to send a notice of the public hearing to those on .
the mailing list and then a mailing of the•proposals as soon as possible fter the
November 3rd meeting. '

Dave Zemke talked about the F.ranchise Ordinance. Paul Tatone made a moti n that
the Chairman be authorized to send a letter to all cities requesting perm'ssion
to�have Adrian°Herbst meet with all City Attorneys to review the proposed Preliminary
Franchise Ordinance.
A copy of this letter will be sent to each respective City Attorney.

HEARING, CASE Chairperson Kruse called the meeting to order for the purpose of

Public Works Director Danielson reviewed the hist ry of the
proposed subdivision, noting that apparently the ajority of
the contiguous propertyowners were not opposed to the subdivision,
but that they had expressed concern with road acc ss to the site.
Chairperson Kruse asked for questions or comments

Mr. Emil Slowinski, 806 Bachelor Avenue, noted th t he is;against
the Wachtler Road extension. He pointed out that the neighbors
are afraid of an excessive amount of traffic thro gh the neighbor-

hood. He stated that he does not want to.pay for any road
construction as this would not benefit him at all. He noted
that he thought the road construction could be in excess of
one million dollars and stated that since the development is
Mr. Gryc's, that Mr. Gryc should pay for the whole thing. Mr.
Slowinski also suggested that Mr. Gryc postpone his project
for a few more years or until the economy is more favorable.
Mr. Terry Raddatz, 1759 Trail Road, noted that residents�=of�TraiT
Road Would not be in favor of the Wachtler extension, but that
if it should go through, that Evergreen Knoll should be installed
in one phase, all the way from the western boundary of the site
to Dodd Road, and not to leave it as a cul-de-sac, to be finished
in several stages.
There being no further questions or comments from the audience.
Blesener moved to close the public hearing at 8:32 o'clock P.M.
Morson seconded the motion. Vote: all ayes.
Chairperson Kruse asked for discussion by the commission members.
Stefani expressed concern over the future of the Par 3 Golf Course
property. He was also concerned that the roads would be put in
this project and then no de�-elopment would take place.
Chairperson Kruse also expressed his concern over the possible
slowness of plat development while having traffic opened up
from the north and south. He also felt it was,important that
�"Wachtler_ • be installed in a winding, curving fashion, to
discourage heavy traf�ic through the area.
Mr. James Gryc advised the commission that Par 3 had approached
him some time ago about the possibility of developing their land
as well as him developing his land. Both parties were agreeable
to this, but Par 3's plan fell through and Mr. Gryc went ahead
with his plan..
After further discussion Butler moved to recommend denial of�,the -
preliminary plat. Stefani seconded the motion. Butler noted
that she recommended denial of the preliminary plat because she
didn't believe the road or access problem would be solved and also
because she would like to see the phasing and what is involved
with it.
Stefani noted that the plan doesn't adequately address what will
happen to Par 3 and that there is no provision for contact with
the contiguous property owners to the south.
Kruse noted that the alignment of Wachtler meets:the City's re-
quirements but tha't he is opposed to'the straight through�align-
ment of Wachtler Rbad.
Frank, Blesener and Burke noted that they would vote against the
motion, as they felt it was basically a good plat.
Voting: 3 ayes, Kruse, Butler, Stefani.

As there was no agreement among the commission members, it
was decided that, due to the length of time this item had been
before the Planning Commission, to pass it along to the City
Council, with a suggestion by Butler that extra copies of the
Planning Commission minutes be available at the next City
Council meeting on November 4th, when this case will come up.
HEARING, CASE Chairperson Kruse opened the meeting at 9:38 P.M. for the purpose
82-22, ST. THOMAS of a public hearing on an application from St..Thomas Academy
ACADEMY, CONDIT- for a conditional use permit to allow construction of an accessory
IONAL USE PERMIT structure on the school property, located at 949 Mendota Heights
Road.
Mr. Pat Casey, representing St. Thomas, was present to explain•his
request. He noted that the 22' x 32.' garage-like structure would
be used to house the school's athletic equipment and that volunteer
members had started to construct the facility without knowledge
that a building permit and public hearing would be required.
Since it was already started, a request was made to the City
Council on October 5th to close in the structure before the '
weather turned bad. The City Council granted this request
conditioned that the applicant �roceed with the normal requiremenfi-

requirements, and noting that they would have to comply with any
requirements deemed necessary by the Planning Commission.
Mr. Casey noted that there would be no driveway to the garage, but
that there would be overhead doors on both ends. There would be
no windows and there is presently no screening around the structure,
although the building is below the site line. The cement floor will
be six inches thick except around the edges, which will be 12 inches
thick.
There was no one present in the audience for the hearing.
Butler moved to close the public hearing at 9:42 P.M, and recommended
that the.conditional use permit be approved as requested.
Stefani seconded the motion. Voting: all ayes.
MISCELLANEOUS The commission members suggested that homeowners be advised o�
the required building permits in the next issue of the City
newsletter.
It was also suggested that a new home on Marie and Rolling Green
be checked to see if it is too close to the newly constructed
pedway.
MANUFACTURED The Commission members had a general discussion concerning
HOUSING manufactured housing and amendments to the City's Zoning
Ordinance and the creation of a new zoning district "R-4",
manufactured home park district.

dents o�aposed that plan. The plan we revised again and now only i cludes
residents who desired to be included. �9r. Nill has also prepared plan
that demonstrates how the remaining wentworth lots could be develo ed at :
some future time. We wi11 have that plan available Tuesday evenin .
This Plat is a canventional single family subdivision with all the lots
exceeding the r�inimum 1ot size and meet9ng ihe 100 faot frontage a ihe `
front setback line. '
Our greatest concern is surface water run-off. Jim Nill`s�pla calls
for almost a�71 water off of Evergreen Knoll ta go into a pond on th golf
caurse. We do noi have an easement for the pond, ar iines ta the p nd. Our
only control is an easement for a contra1led level outlet from the ond.
The praposed layaut shows surface water on Evergreen Knoll fro Ever- �
green Court to Wachtler, and an Wachtler to Bachelar being carried n the '
surface, This is too long a distance without starm sewers. This s'tuation
will have to be reviewed i�' and'when a public utilities are request d. .
The street section shown on Sheet 4 wil1 have to conform to Ci
Standards.
Wachtler Avenue should be extet�ded up from Bachelor to Evergre n Knoii;
(at the time this plat develops) ta provide traffic circulation thr ugh the
site. ,
The extention of Wach�tler from Bachelor to Evergreen Knol1 is ecessary
to provide easement far sewer and-water installation. This means e sement s
acquisition from several property owners.
There are no wetlands on the site however the rear of lots 5, , 7, 8„
and 9, �lock 7 are within 100 feet of the Wetlands on the galf cour e.

there is no construction in their backyards.
The City has adequately sized sewer and watermains in the area to serve

1. The property in question consists of areas of land now owned by $our land
owners as indicated on the first sheet of the attached drawings.l
The principal area of land is owned by James Gryc, the area to he north
owned by P. Gryc, an area to the northwest owned by Mr. Lowe, an an area
to the north by the Lewises. The total acreage involved is 24.1 acres,
all of which is zoned Single Family, R-1. The applicants initia ly intended
to work with all of the landowners to the north (those with fron age south
of Wentworth, and prepared prelimianry plans indicating how the ear areas
of those lots could be developed as part of this plat. Apparent y most of
those neighbors decided not to involve their properties, except or the
Lewises who have previously split off a portion of their propert into �
a single lot as approved by the Planning Commission and Council. That ,
subdivision envisaged the further development of the Lewis prope ty into•
four lots, provided for in this submission. `
2. The plan for the extension of the roadways and development of lo s within
the properties proposed appears to work well. Each of the 1 ts meets
the minimum standards of 100 feet of frontage at the building li e, and an
area greater than 15,000 square feet. The total number of lots quals 43,
which produces a gross density of 1.78 dwelling units per acre. The .
average lot size is 19,855 square feet with the smallest being 1,500
square feet.
`r31 The principal problem with respect to the proposal may be as the road �
�J system affects other contiguous properties. One such concern is the
dedication of the half-street that would be requir,ed on the sout 30 feet
of the Kladis property (fronting on Dodd Road). The dedication f that .
30 feet would be essential to the development of the plat as pro osed.
It would appear that the platting with respect to that property s '
shown would allow for the future division of the rear portion of that
lot, and may well be acceptable to that owner. ;
4.
Another issue might well be the proposed future extension of the roadway
to the north which was run through the Ziemer property. This is the .
very narrow lot, virtually all of which would be required for ri ht-of-way

if this street were to be extended. The feelings of the landowners from
this area would be important with respect to whether or not this stub
extension is part of the plat under consideration.
5. The extension of the cul-de-sac to serve the rear portion of the Lewis
property appears to work well. If the land is to be platted this way,
however, the potential for further development of the land to the east
and west of the Lewis property will be limited. This means that the
decision to develop or not develop the properties contiguous to the Lewises
will be made now. If these owners desire to consider ultimate development
of the rear portion of their land, the plat could be revised so as to
accomplish their purpose.
6. Perhaps the most difficult area of concern is with respect to the extension
of Wachtler Avenue proposed to be platted north-south between Wentworth
Avenue and Bachelor Road. It has always been the intent of the City to
connect these two, but not to be considered as a part of the major
thoroughfare system. Trail Road as you know now extends from Marie to
Bachelor Road, and is platted as a residential standard street. For
purposes of reasonable, safe, and convenient circulation, it would appear
that the connection of Bachelor and Wentworth is essential at the��west
end of the plat. The extension of this roadway, of course, opens up
the three parcels to the west of this alignment, consisting of the Young/
Shaughnessy property and the Hanson land. The opinions of these land-
owners with respect to the proposed plat would be helpful in analyzing this
decision.
7. No provision in the plat is made for the extension of a stub street to
connect to the land presently occupied by the golf course. If this property
is contemplated to be developed for single family purposes, the extension
of the cul-de-sac (Evergreen Lane) should be considered.
8. The staff has reviewed previous alternative plans with the applicant and
his consultants. Assuming no other land owners wish to develop po�-tions
of their land as a part of this plat, it appears that the proposal as
presented develops the land for single family purposes in a reasonable way,
and provides for very attractive building sites.

side of the alignment of Wachtler Avenue as extended. It appea s from the
applicants location maps that the property awned by Young and S ugn�ssy
may be landlocked. This is the trapezoidal shaped piece of proFer�y at tlie
northwest corner af the site. The tapography here is extremely ifficult,
but care should be taken sa as to provide somc� future mEans of cess ta
this property to prevent a landlocked condition.

Gentlemen:
For the past several months, there has been considerable discu sion on
your part regarding the proposed plat by Mr. Jim Gryc extending fro Dodd
Road to the West to what should be Wachtler Avenue extended.
During this time I have been in close contact with the City En ineering
Oepartment as to how the proposed plat will provide access to the 1 nd which
I own West of what would be Wachtler extended.
At the time this land was purchased some 15 years ago, the ext nsion of
Wachtler from Wentworth to Bachelor was on every City planning map, and
was the basis on which our property was purchased. Any proposed ch nge in
this alignment would be detremental to my property and should, I bel eve, be
given no consideration by the Planning Commission.
I do not believe that it is necessary at this time to construc the
entire length, however provision for right of way and evential cons ruction
should be made.
In discussions with the Engineering Department I have indicate my
willingness to petition for the extension of Wachtler Avenue based n the
original City plans and the current comprehensive plan of the City.

I have reviewed the plans for "Evergreen Knolls", as requested at the Sep
1982 meeting of the Mendota Heights Planning Commission, with the followi
considerations in mind:
l. The efficient and speedy delivery of emergency services to
the 150 (approximately) citizens eventually living in the
area.
2. The ability to effectively provide routine preventative
patrol in the area.
3. The susceptability of the area to crimes of opportunity.
4. Traffic patterns.
A"secluded" residential area with limited access and egress is difficult
and observe. Officers have a tendency to avoid such areas as they remove
officer from main thoroughfares that provide quick routes to major type c�
Access from all four directions is generally accepted as ideal, although r
always possible. Emergency aid, that is restricted in access, can be del�

Traffic accident experience is generally proportionate to the amount of tr ffic
carried. The more routes available to carry traffic in and out of an are , the
less traffic on each route. Carefully planned controls and the capabilit of
effective patrol can further reduce accident exposure.
It is my opinion that the most advantageous plan, from the standpoint of
safety, would be as indicated below:
1. Wachtler Rd. be continued south from Wentworth to the present
Trail Rd.
2. Trail Rd, a logical extension of Wachtler Rd. be renamed
Wachtler Rd.
3. Evergreen Knoll Rd. be completed from Wachtler to Dodd Rd.
as soon as possible to avoid a long and difficult "dead end"
situation.

Per the request of the city staff I have reviewed�the plans for thel
Knolls from the fire department's standpoint.
We have two primary considerations when reviewing proposed addit
city:
1. We are allowed access to the area from two
directions.
2. On dead end and cul-de-sac streets be limited
to S00 ft. in length.
It is my understanding that the main street, Evergreen Knoll, will

Ave. easterly toward Dodd Rd. In light of this development we woul

naming of Trail Rd. If any portion of Wachtler is developed either north of
B�acfielor Rd. or soutli of Wentworth it will connect directly with Tr il Rd.
It should be noted that when Trail Rd. reaches Marie Ave. it also 'nes up
with another section of Wachtler.

was continued for the second time. One of the Planning Commission'

out with the K1!adis`s: and the road remain as shown.
The Planning Commission should make a recommendation on the Gr

2. Each of these persons makes meaningful and what we believe to be important
points in favor of extension of Wachtler Avenue alignment along e west
side of the Gryc platting proposal. The extension of Wachtler A enue along
this alignment as a major thoroughfare was a part of the origina
Comprehensive Plan prepared for•the City in 1960.
When Trail Road was platted along the west side of the subdivisi
Bachelor Avenue, we decided at that time that a street would ext
Wachtler Avenue alignment but would not be a major thoroughfare.
Trail Road was platted as a typical 60 foot street. When the ne�
Comprehensive Plan was prepared the extension of Wachtler Avenue
included as a major thoroughfare for this reason. It was discus
time, however, that it would be important to have a roadway in t'
but not to design it as a major carrier of traffic.
You will note that in the Shaughnessy letter that they offered t
the right-of-way necessary, and petition for the construction of
Avenue. It would, of course, not.be necessary to extend the ent
at this time, but merely plat it to the southwest corner of the
property.
3. The only otlier significant problem we see with the plat is that
out an arrangement with the Kladis property. If the alignment
proposed (between Kladis and the Gryc property), this would all
development of at least four and possibly five lots from the K1
property. At one time, Mr. Kladis proposed this, but now seems
opposed to it.

The City has purchased a 1977 Ford LN 8000 truck chassis for the price of
$12,900.Q0. The radiator had to be replaced for an estimated cost of $500.00.
The tires will have to be changed,from o7.d tanker ta new chassis for a cost of
$48.00 (plus tubes if needed).
We have requested hids or price quates from I2 di�ferent companies and �ave only
received twa price qnotes back. {See attachments). These were from:
Arrow Tank Company with a price af $1Q,576.00
0'Day Equa.pment with the price of $7,930.00
The Commi.ttee recommends that yau accept the praposal fram 0'Day Equipm.nt
because it best represents what the Committee set for guidelines, for t e
least cost.
There will be future e�penditures for warning la.ghts, radio and siren. jWe do
not have exact cost for-these additions at this time. (
We wauld hope that the purchase of the tank could be made at this time
put the truck in service as soon as possible.

last year, Elmer Huset and others had indicated that we would be rece

This is not necessarily true with the City of Maplewood. The C

disagreement. The Maplewood City Manager, Barry Evans, contends tha
no justificatian for the 2d� surcharge for suburban cansumers. Thi
c3ifferential was agreed to back in 1976; we agreed to it on Septembe

contract, and very little understanding, for many, many years. West

It is our feeling that the City of Maplewood has been more than pa ient
in its dealings with the Water Utility. I wrote you several month
prior to the March 30, 1982 expiration of the contract between St. Paul
and Maplewood.
As a result of that letter and subsequent meetings, you indicated hat
the Utility would hire an engineering firm in an attempt to justify the
20� surcharge to Maplewood residents. �
However, it took you over three moriths to hire such a firm, and we have
heard nothing since. We can only assume from the most recent arti le that
the Water Utility has every intention of proceeding as it has in t e past
by placing an unfair charge on our residents.
Consequently, unless we hear in an affirmative or an acceptable ex lanatory
manner from you by October 31, 1982, I will request authorization rom the
City Council to take whatever legal action will be required to res lve the
matter to the benefit of, Maplewood residents.

This is in reply to your letter of October 6, 1982, regarding cont�act negotia-
tions between the Board of Water Commissioners and the City of Maplewoo ,
You will recall that on March 19, 1982 Thomas D. Mogren, Assistant
Manager, and I met with you and Ken Haider in your offices to discuss p
procedures for developing a revised contract for submission to the Boar
wood City Council for approval. We decided, at that time, to examine i
of the sections in the contract dated March 30, 1962 and the amendment
15, 1976. We arrived at a fairly good meeting of the minds on all item
exception of Section 1 of the amendment pertaining to rates.

Various ways of arriving at some agreement on rates were discussed. It was
decided that we, at the meeting, could not reach agreement on the metho but that
it appeared desirable to have a cost-of-�ervice study to aid in the neg tiations
between the Board and the City. I agreed to ask the Board to approve t e use of a
consulting engineering firm for such a study and to approve the funding of the study.
I know you are familiar with the steps that are necessary to inte iew firms,
receive proposals and prepare documents for approval. This was all acc mplished and
the Board of Water Commissioners by Resolution 3297 dated July 14, 1982 approved a
contract with the consulting engineering firm of Toltz, Ki:ng, Duvall, derson and
Associates to conduct the study at a cost not to exceed $33,000�00. A opy of the
resolution and a copy of a current status of study report dated October 6, 1982, is
enclosed.
The review of the sections of the previous contract and amendment nd the arrange-
ments for the cost-of-service study were all on the assumption that the City of Maple-
wood desired a"full service" type contract like in the past rather tha considering

with the point-of-view of one receiving that type of service and related charges.
It is, of course, necessary for the Board to require a relatively long-terni
contract for either a"full service'� or "wholesale" type contract as capital improve-
ments provided by the Board to adequately serve would differ in many respects.
Because of the long term of the next contract, it is prudent that all aspects including
rates be carefully examined by all parties and this may take more time than you origi-�
nally anticipated. Both the Board and the City of Maplewood need provisions that
assure proper service and fair distribution of costs.
We had discussed the possible need of periodic meetings to keep the staff of
both entities up-to-date on progress of the study and the following negotiations.
Mr. Mogren and I believe such meetings are desirable. Please let me know if arrange-
ments are possible in this regard,

WHEREAS, the City of Mendota Heights has established a policy of c nstructing
permanent streets, including concrete curb & gutter and storm sewer in new
development areas, and assessing the cost of such street improvements OOy
against the benefitting property; and
WHEREAS, street surfacing and drainage improvements in the older a�eas of
the community were constructed to less than permanent standards in yea s past; and
WHEREAS, in a number of cases the street surface was actually cons
"street restoration", a direct result of underground utility construct

On October 3rd you briefly discussed a memo on the status f proposed
amendments to the Zoning Ordinance, to both adopt language to p ovide for
an R-4 Manufactured Housing District and provide for changes in the R-1
Mini.mum Requirements. In the memo, I advised that a public hea ing would
be conducted by the Planning Commission in November.
During the October 3rd discussion, I was apparently remiss
requesting formal Council action on the matter. As you will no
October 26th Planning Commission minutes, the Commission Chairm
"that a public hearing should be set for the November meeting t
an amendment to the R-1 district and that the commission would
ection from the City Council on whether to conduct a public hea
establish an R-4 zone." Given the Commission Chairman's statem
my lack of request for formal direction on October 3rd, I herew
quest that the Council take action in one of the two following
