HEARING ON PROPOSED Mayor Lockwood opened the meeting for the purpose of a public
HOUSING BOND hearing on a proposed housing bond program. He turned the
PROGRAM meeting over to City Administrator Johnson for an introduction
and explanation.
City Administrator Johnson stated that this evening's hearing
was established on November 16 and was called to discuss a
proposed housing bond program, which is merely a blueprint for
the implementation of a housing program which was distributed
along with the agenda. He advised that this would establish a
program for first-time home buyers and eventually a housing
program in Mendota Heights. Mr. Johnson stated that the program,
if approved, would involve not only Mendota Heights, but also the
cities of Eagan and West St. Paul in a senior citizen housing
proposal. Mr. Johnson stated that this evening's hearing is just
one of the beginning stages in the discussion of elderly housing/
housing bond program, that it is a financial scheme which will
have many hoops to go through, including competition for state
bonding. Mr. Johnson introduced representatives of the Dakota
County HRA, the A.H. Wilder Foundation, Miller Schroeder Investment,
and a Holmes and Graven legal firm.
Mr. Jack Klepp, representing the A.H. Wilder Foundation, summarized
responses to a survey of residents from Mendota Heights, Eagan
and West St. Paul, relative to elderly housing. Mr. Klepp advised
that approximately 1600 surveys were sent out to the Darts mailing
list and summarized the 53 responses received out of the approx' e
150 surveys sent to Mendota Heights residents.
The questions for which responses were summarized by Mr. Klepp
were: what type of existing structure the s.enior citizen resides
in, whether the resident was satisfied with his existing housing,
what type of housing the respondent would prefer, type (condo-
minium or townhouse) and height of structure preferred, preferred
size of condominium or apartment, price range, respondents age and
household income, and price range of existing residence.
Mr. Paul Eckholm from Miller Schroeder, stated that the bonds
would ultimately be issued by Dakota County HRA, but the require-
ments of the program would be subject to any rules required by
the Cities of Mendota Heights, Eagan and West St. Paul. Mr.
Eckholm advised that if the Council were to adopt the program this
evening, it would be sent to the Minnesota Housing Finance Agency
for review. If the bonds were then approved by the HFA, they would
be issued by the Dakota County HRA. Mr. Eckholm explained various
aspects of the proposed bond program and answered questions for
the Council. He advised the Council that in response to a request
from a Councilmember during the week, he has had his staff prepare
information on sales of homes in Mendota Heights during the period
of July, 1980 through November, 1982. He advised that of the 119
housing units sold in Mendota Heights during that period of time,
26 were sold for less than $75,600, which is the purchase price
limit under the interest subsidy portion of the program. He al:.

City and the Council must now decide what its objectives are.
Mayor Lockwood stated that until tonight he had been in favor of
the program, and he has always been willing to go along with
providing lower cost housing to seniors from Eagan and West St.
Paul according to population, but after seeing the statistics
presented by Mr. Klepp and Mr. Eckholm, he feels that the Mendota
Heights residents would be in the minority in the project. He
pointed out that the restrictions imposed under the program are
too restrictive for most Mendota Heights residents.
Mr. John Shardlow, from Howard Dahlgren's office, who was present
for the discussion, stated that the City would perhaps have other
alternatives in providing an elderly housing project, and suggested
that the City could use tax increment financing revenues for such
purposes as buying land, clearing it, installing utilities, and
other similar activities which reduce the construction costs.
There being no further questions or comments from the audience,
Councilman Losleben moved that the hearing be closed at 9:17 P.M.

Councilman Losleben moved to decline the offer of the Dakota
County Housing Redevelopment Authority for a proposed housing
bond program for Mendota Heights.

Mayor Lockwood thanked the representatives of the A.H. Wilder
Foundation, the HRA, Mr. Eckholm and Mr. Kehl. He suggested
that the City Council is still interested in trying to find a
method of providing alternative housing for senior citizens in
Mendota Heights even though the housing bond program that had
been discussed has been declined. �

PROSECUTIONS Police.Chief Delmont was present to discuss prop sed 1983 pro-
secution services and charges. City Attorney Wi throp explained
that the cost for prosecution services for past ears were much
more expensive than are proposed for 1983 becaus of the amount
of preliminary services which were provided. He and Chief Delmont
indicated that more of the preliminary work woul be completed by
the police officers rather than by paralegals. hief Delmont
recommended that the Council approve the $12,000 fixed fee charge
for prosecution services for 1983.

located at Lexington and T.H. 110 and Delaware and T.H. 110.

INTERCEPTOR The Council acknowledged a letter from the Metropolitan Waste

Agreement No. 130 between the City and the Waste Control Commission

Control Commission will maintain the interceptors rather than
continue City maintenance.
MISCELLANEOUS The Council acknowledged receipt of a handout memo from the Police
Chief relative to traffic speeds on Lexington Avenue.
SAINT PAUL WATER Public Works Director Danielson advised the Council that there is

unacceptable.
Gibbs suggests to eliminate the word local in local investors from the four
provisions.
Henderson comments as long as their investments are legal, it's none of our
business.
Baird comments that he has no objection to people investing.
Witt moved that 16-19 be deleted. Seconded by Lanegran.

At the public hearing it was brought to the commission's attention by Mike
Young to include computer communications for regular and institutional users.
�aird moved the adoption of 25, with the direction to the consultant to
include in the RFP appropriate languaqe for computer communications.
Seconded by Henderson. Motion carried unanimously.
Item 54.
Lanegran moved the words member cities or the ahead of the word commission.
Seconded by Henderson. Motion carried unanimously.
The sentence on item 54 reads: "The Franchise Ordinance shall provide that
the member cities or the commission may inspect Grantee's records and
equipment upon 24 hours notice".
Item 57.
Lanegran moved to insert the words member cities or the ahead of the word
commission. Seconded by Henderson. Motion carried unanimously.
Item 57 reads: "The Franchise Ordinance shall provide that the member cities
or the commission may audit Grantee's records upon three days notice".
Item 58.
Bruestle moved to approve 58 as written. Seconded by Lanegran. Motion carried
unanimously.
Item 132.
Lanegran moved to amend 132 to read; Applicants are required to propose
a System design that provides Inver Hills Community College and all public
and non-public high schools in the CST with a modulator each to transmit
live video programming on either a subscriber or institutional network.

A Nov. 12 opinion from At-
torney General Warren Spannaus
regarding manufactured housing
(mobile homes) placement has
once again muddied the city or-
dinance waters. �
His opinion was in response to a
request from the city of
Moorhead that ttie state clarify
the Aug. 1 law prohibiting cities
from discriminating against
mobile homes in their zoning
' laws. Moorhead officials wanted
to know, specifically, if the city
could restrict the location of
manufactured homes to special
districts. The attornery general
said "no."
Most Dakota County city of-
ficials had not read the opinion so
were unable to respond as to how
the opinion would affect them.
But it could have an effect on
many city ordinances, especially
those in the process of being
amended. �
Inver Grove Heights' or-
dinance, for example, restricts
mobile homes to mobile home
parks. The city has been.in the
process of amending that or-
dinance and �planner Bill Meeker
said the opinion will have an im-
pact on their decision. �
Meeker said the city "has
discussed at great length that
they do not want to prohibit all
kinds of manufactured housing
frorn any part of the city." He

said the opmion will give the city
more guidance in establishing a'
new ordinance.
Some cities responded to.the
nebulous Aug. 1�law by writing
ordinances that required all
single family cesidentlal homes
to ' comply with the Uni�orm
Building Code. Manufactured
housing units are built to comply
to a federal HZJD code, so such a
restriction would effectively keep
mobile homes out of afngle famlly
resideritial areas.
But Duke� Addicks of the
League of Minnesota Cities said
such regulation is not going to
work. "There's not much dif-
ference in the end product (of
homes built up to either code).
There's probably not enotigh to
justify a differentiation. T think
they'll have trouble with them'
(the ordinances) standing up."
Larry Starns,,assistant to the
attorney geiSeral, who wrote the
opinion, agrees with Addicks. He
said the law itself (327.31)
specifies that cities must accept
manufactured • housing that is
built to the HLTD code. "It wrnild
be iIIegal to restrict homes on ihe
basis. bf the Uniform Building,
Code," he said.
He did say, howe.�er, that there
is a wrinkle in the interpretation
of the,law that could cause a lot of
controversy. That is the issue of
the cities' right.to restrict homes•
in certain areas based on such
criteria as width, roof pitch, :
basements and siding material.
"It's a tough`issue as to the extent .
municipalities can go in
regulating such things," he said.
But based on the Aug. l law and
the recent opinion, it looks as if �
that kind of regulation is the most
prudent route cities can take to

Chairperson Kruse expressed his disappointment that the site
would be raised 10± feet above the grade of Le ington Avenue.

placed on the site, thus making for more diffi ulty in
� developing the land, with the possibility that any extra fill
would be placed elsewhere.
Chairperson Kruse noted that he would not be 'n favor of the
proposal and that he would like to see some de elopment plans
from Condor Corporation showing how thay would develop the
land after it is filled.
Mr. Johnson, from Johnson Brothers Corporation noted that the
contours were given to them by Condor Corporat'on with no reason
for them being as they were. He stated that h could speak with
representatives of Condor Corporation and rela that information
back to the Planning Commission at a future me ting.

' On October 13, 1982, I sent a memo to Howard Dahlgren, addressir
number of items proposed to be changed or added to the R-1 Zoning Ord'�
Thesei new requirements are a reaction to the legislation which came ir
effect on August 1, 1982, prbhibiting the exclusion of manufactured hc
by municipalities or counties. The Municipal Planning•Act is amended
permit the regulation of the width and type of foundation of building:
manufactured homes may be located within a community, they must comply
zoning ordinances, promulgated by the community.
The proposed 4.18, "Minimum Requirements for Single Family Resid
deal with:
1. A minimum single family dwelling size;
2. Width to length ratio;
3. Basement or ,cellar requirement;
'4. A two car garage with a minimum of 440 square feet;
•5. Surfaced driveways and offstreet parking space;
6. Screening of certain items;
7. Prohibits flat roofs, with the exception of earth-sheltered

Many of these items, in my opinion, will create unnecessary vari
requests, which will take up the planners, staff, Planning Commission
Council time. In addition, these proposed items will affect all dwell
just manufactured homes installed in the R-1 zone. The items that I
will have the most problems enforcing would be the elimination of flat
structures, the siding restrictions and a minimum width of 22 feet. T
requirements for paving of driveways, off-street parking spaces and th

Attached is a copy of the memo from last month with general comment on
the proposal, and draft copies of the amendment to the single famil
development requirements, and the proposed R-4 Manufactured Homes P rk
Zoning District.
Based on comments from the Planning Commission and review of the pr posed
text, we suggest the following changes:
4.18 Minimum Requirements for Single Family Residential Dist icts
4.18(3) All single family homes shall have a basement or cellar under

Revisions to Zoning Ordinance Relating to Manufactured
The 1981 session of the Minnesota State Legislature enacted new
eliminating the term "mobile home" and substituting a descripti
"manufactured homes". This legislation further prescribes that

Researching other communities, we have found that Brooklyn Park has
approved what we believe to be the first plat for manufactured homes in
the Metropolitan Area. This plat and PUD is on an eight acre site with a
density of 4.5 units per acre, and a lot width of 57 feet. The housing
units are 900 to 1,300 square feet in area, and have 30 foot public streets
in a 60 foot right-of-way. Copies of this proposal and illustrations of
of the proposed manufactured homes will be available at the Planning
Commission meeting for information purposes.

(30) feet. Streets shall be surfaced with poured-in-place

be landscaped with,appropriate grass, shrubbery, and trees around
the entire perimeter of the manufactured home park. This buffer

10A.4(4) The Minnesota Department of Administration Building Code Division
of Rules for Mobile Homes Support and Tie-Down Systems, authorized
by Minnesota Statutes 327.31 and 327.34, are hereby adopted by
reference and made a part of this Ordinance as if fully set forth
herein. All new manufactured homes or those manufactured homes
changing ownership shall be equiped with an anchoring and support
system as defined and approved by said state rules. It shall be
unlawful for anyone to own or occupy a manufactured home in
violation of this Ordinance. Manufactured home parks shall not
allow any'manufactured homes to remain in a manufactured home
park in violation of this Ordinance.'
10A.5 Standards for Manufactured Home Parks

sections, which in the traveling mode is eight body feet or more
in width or 40 body feet or more in length, or when erected on site,
is 320 or more square feet, and which is built on a permanent
chassis and designed to be used-as a dwelling with or without a
permanent foundation when connected to the required utilities,
and includes the plumbing, heating, air conditioning, and electrical
system contained therein; except that the term includes any
structure which meets all the requirements and with respect to
which the manufacturer files a certification required by the
secretary (of the U.S. Departsnent of Housing and Urban Development)
and complies with the standards established under this chapter.
3.2(79) Manufactured Home Park: A tract of land at least ten acres in
area where two or more manufactured homes are located, zoned, and
built in accordance with Section l0A of this Ordinance.

Subsequent to our last appearance in front of the City Council we located
a substantial tenant in the retail hard goods category that was d sire-
ous of opening a facility in Mendota Plaza. Since then we have eyolved
a layout and finalized accepta6.le economic terms to accommodate tN�eir
occupancy. We are currently finalizing the lease which should be complete
by the end of the year. We are anti�cipating commencing the tenan improve-
ments in January with completion in late March and occupancy in A ril of
1983.
We anticipate that we will b�e commencing our shopping center reno ation
plans early next spring as a majority of the work is exterior in ature
and necessitates warm weather.
Sheehy Properties, Inc. will be approaching the City Council when
consumated the hard goods lease to unveil the improvement program
on the on-sale liquor license situation.

Section 27 of the City's Personnel Code stipulates that manda��
retirement from City employment shall occur at age 70. It is prov�
however that the City Council may grant annual extensions to age 7!
such extensions are in the best interest of the City.
After having served as the City's consultant engineer for twe
five years, I was appointed to the City staff effective on Novembe
1981. At the time'of my appointment the Council granted a waiver
age provision, presumably because it was deemed that such action w
be in the City's best interest. The engineering transition appear
have been successful and the department is providing efficient and
fessional in-house engineering. I feel that my service during the
sition and my first year of employment has been beneficial to the

The following pages represent a compensation plan for our 32 f
employees and the 3 part-time positions for 1983. The proposed pla

1. The output and dedication of the staff people.
2. Comparables in other communities.
3. The plight of the State and Local Government Aids.

several items of explanation. Health insurance and mileage comment are
included as needed.

The 1983 salary proposal was prepared after discussing the mat er with the
several department heads or the employees themselves. I have attem ted to keep
a relative balance between the several quite diverse duties and res onsibilities,
yet at the same time equate with private sector compensation, other municipalities,
and our'own labor contract provisions.
You may recall that both the Police and Public Works contracts expire on
December 31, 1982. Gene Tretter, of St. Paul Employers Associata:on and I
have met with both Business Agents, twice on Police negotiations an once
on Public Works negotiations. Although both sets of "demands" were long and
all-inclusive, I am quite optimistic at bringing back proposed sett ements
quite similar to the average percentage increase reflected on the a tached chart,

and health insurance�increases similar to those shown hear. Obviously I am
attempting to keep this proposal as close to expected settlements as possible.
Virtually all discussions with other City Managers, and expected settlements,
center around a 6� salary/wage increase. Inver Grove Heights has approved a 6+�
increase for their non-union employees, and insurance contributions far exceed
our^�. Local school teachers enjoyed a 14.87� increase a year ago, and a 10.48�
increase for the current year. Now that the Legislature has, in effect, mandated
a 2� decrease in public employees compensation for 1983, the attached proposal,
totaling a 6.19� increase is patently defensible. (Total monthly increases add
up to $1959, compared to 1982,monthly salaries of $31,552).
With the exception of the Police Chief, an attempt has been made to keep
increases below 6� for the higher paid positions, giving the lower paid positions

Chief increase, the $210 is composed of: $30 to bring pay up to previously
established 1982 rate of $2770 monthly, a 5.75� increase of $160 and an arbitrary
amount of $20/month which, even including mileage allowance, does not equal the
1983 pay scale he would be anticipating in Maplewood.
The recommended increase of $1959 per month compares to 1983 Budget
provisions amounting to $2110 per month.
I would urge your ser��ous consideration of the foregoing proposal and would
welcome the opportunity to further discuss it, �should you so desire. I must note
that, in my opinion, there is a balance and a relationship between all the
proposed rates, and any change will upset the overall balance. As on final
comparison, it should be noted that the recently passed Legislative Bill addressing
governmental financial problems impacted-;us on two counts:
1. The final 1982 Local Government Aids to be collected in
December, 1982 will be reduced by about $10,600.
2. The 2� contribution on public employee compensation for 1983
will result in the 32 employees contri.buting approximately
$15,800 to the State General Fund.
The justification for 32 Mendota Heights employees contributing $15,800 and
the City, with over $45,000,000 of assessed valuation, and a budget of approximately
$1,250,000 only being shorted $10,600 is hard to comprehend or understand.
Health Insurance Contribution
Health insurance costs are being increased from 7.3� to a proposal as
high as a 39.8� increase. The average industry wide increase hovers around
18 to 20�. Our Washington National Insurance (LMC sponsored) advised us of
an increase of $24.42 per month (Family Coverage), guranteed for only 6 months.
Our HMO proposals for 1983 have been more modest, asking $11.20 increase for
"Employee plus 2 or more."
The major Public Works union contract in the metro area, as settled,
increased insurance benefits from $105/mo. to $125/mo. Adjacent municipalities
are considering a $20/mo. increase.
In view of the foregoing, I recommend that insurance contributions for the
non-union employees be increased from $110/mo. to $130Jmo.

A feasibility report was prepared on June 9, 1981 and placed o file
by the Council. Now it is time to proceed with the work.
The proposed construction, as shown on the attached drawing, is esti-
mated to cost $63,805.00, including overhead, fees and contingencies.
There are a total 1,140 feet of potential assessable frontages on 5
adjacent properties. Most of the south side of tJagon l�Jheel Trail, in the
construction limits, is public park property.
Because of the Highway Crossing and oversize pipe, it is assu ed that
most or all of the cost will be carried by the Water Revenue Fund.
It. is suggested that a nominal rate of $16.00 per assessable oot be
established for abutting properties but that the Council be prepar d to
defer the making-of assessments in that none of the property owner have
requested water service. With parcel widths of 110 to 310 feet, i dividual
assessments could exceed benefits and be contested, especially whe there
does not appear to be a need for water service at this time.
So as to be prenared to complete the Highway Crossing and ass
work, it is recommended that a feasibility/assessment hearing be s

Portions of the project are assessable while others are not. It is sug-
gested that all storm sewer and street construction in this project b assessed
100 percent, and that water and sewer be assessed $19.00 and $2?..00 p r foot
respectively for those parcels to be assessed. Costs not paid for by assess-
ments will have to be taken care of by Tax Increment Financing. Unti such
time as the M.A.C. properties are satisfactorily disposed of, these o other
assessments should be considered for deferrment.
Based on the above suggested assessment rates, there will be a r sidual of
unaccountable funds in the amount of approximately $135,000.00. This is the kind
of financing that should be considered for Tax Increment Financing.
' So that the matter may be more fully discussed, it is suggested hat a feasi-
bility hearing be set for January 18, 1983. In the meantime it may b advisable to
have a special workshop session to review the various aspects of the roposed project.

bJHEREAS, Delaware Avenue is a County State Aid road, CSAH 63; and
WHEREAS, Delaware Avenue's intersection with Trunk Highway 110 is signalized;
and
WHEREAS, Trunk Highway 110 grades entering this intersection are steep and
present a safety hazard; and
WHEREAS, Minnesota Department of Transporation proposes to upgrade this
signal to include:
1. yellow advance warning flashers to reduce this safety hazard to
Delaware traffic. . .
2. pedestrian walk signals to improve safety to the walking and biking
public and decre�se red time on Trunk Highway 110; and
WHEREAS, Mn/DOT shares such upgrading costs based upon traffic legs in-
volved; and ,
WHEREAS, in this case there are two legs on the State Highway system and
two legs on the County State Aid system; and
WHEREAS, Dakota County has established an arbitrary policy providing for a
cost sharing of 50 percent County and 50 percent municipality; and
IJHEREAS,.this intersection is uniq�e in that six governmental agencies (State,
County, School and three rnunicipalities) are involved; and
WHEREAS, the three municipalities involved are unable to come to an agreed
upon split of their 50 percent funding;
NOW THEREFORE IT IS RESOLVED that the Mendota Heights City Council
hereby request the Dakota County Commissioners to re-assess the cost sharing
policy as it applies to this unique situation; and
BE IT FURTHER RESOLVED, that Mendota Heights requests Dakota County
to support Mn/DOT's signal installation on a County State Aid Road, notwith-
standing the municipal disagreement on local cost sharing, by financing
the County leg portion of the cost.
