The March 23rd Board meeting was held in the F. M. Grass Auditorium before an audience of
approximately 250 people. In his opening remarks Superintendent Russell D. Anderson com-
mended the legislators for keeping the district informed during this acti e legislative
session. An announcement was made by Student Representative, Ann Marvy th t the Henry
Sibley play,"West Side Story" would be performed on March 26, 27, April 2 nd 3 at 7:30
p.m. in the Henry Sibley Auditorium a t a cost of $4.00 for adults and $2.0 for students.

In an attempt to consolidate the F. P1. Grass building use, the School Boarc

Minutes of the Regular Meeting
Held Tuesday, March 2, 1982
Pursuant to due call and notice thereof, the regular meeting of the ity Council,
City of Mendota Heights, was held at 7:30 o'clock P.M. at the City H 11, 750 South
Plaza Drive, Mendota Heights, Minnesota.
Mayor Lockwood called the meeting to order at 7:30 o'clock P,M. The
members were present: Mayor Lockwood, Council Members Hartmann, Mert
Councilman Losleben had notified the Council that he would be out of

MN/DOT FACILITY Mr. Don Engsten, Mn/DOT Landscape Architect, reviewed the
landscaping plan for the proposed Mn/DOT facility site. He
explained that the plan will involve the informal grouping of
shade trees and evergreens throughout the site along with
specimin half-trees around the building. He stated that the
site will be surrounded with chain link security fencing
covered with river bank grape vine. Mr. Wayne Murphy, from
Mn/DOT, pointed out that the plantings will be a mix of nursery
stock and transplants. In response to concerns expressed by the
Council about the chance that some of the transplants might not
take, Mr. Murphy advised that Mn/DOT fully intends to take care
of the plantings and replant those which do not survive.
As part of the discussion, the Council directed that the City
Administrator determine whether a developers agreement to
insure the replacement of transplants and other requirements is
necessary as part of the building permit approval process.
Public Works Director Danielson reviewed his memo addressing
the site plan. He pointed out that one item in the report
relates to the signing, and suggested that it would be prudent
for Mn/DOT to be prepared to address both the sign location
and design at the time building permit approval is requested.
After discussion, Councilwoman Witt moved to approve the issuance
of a foundation permit for the proposed Mn/DOT maintenance
facility.

HEARING -- Mayor Lockwood opened the meeting for the continuation of the
AMESBURY EAST public hearing on proposed public improvements to serve the
IMPROVEMENTS Amesbury �ast P.U.D. and adjacent areas.
Administrator Johnson reviewed the February 2nd Council discussion
noting that the general concensus was that the underground
utilities should stop short of the four developed parcels south of
Amesbury East and that Amesbury East should assume the storm sewer
costs originally proposed to be assessed against those parcels.
He also reminded the Council and audience that a 24 foot surface
for Mendota Heights Road was also agreed upon in order to reduce
the project costs. The country-style construction will extend
800 feet west from Delaware Avenue. Mr. Johnson advised that
staff has met with the Kings and that they have agreed to pay all
annual interest on their proposed $133,000 share of the utility
construction costs, while their property remains under the Green
Acre status. He further advised that Mr. and Mrs. King have
submitted a letter to the City Attorney relative to assumption of
the interest.
Financial Advisor Shaughnessy advised that on the basis that the
King's will submit the annual interest on their assessments along
with annual principal and interest by McNulty Construction for
each unsold lot and full assessment payment on each unit when
it is sold, the project can be financed. He noted that when

the King property changes from Green Acres to assessible status,
the principal assessment due to date will be pa able but all
accrued interest will have been paid. Mr. Shaug nessy also
pointed out that the one arcre on which the King ome is located
is assessible and not eligible for Green Acres a d the King s

Mr. Jim McNulty, of McNulty Construction Company, stated that
because of current economic conditions, his firm is not ready
to quickly move ahead with the Amesbury developm nt. He further
stated that he is optimistic and has good faith 'ntent to proceed.

Public Works Director Danielson advised the Council that staff
recommends a minimum basement floor elevation of 858 m.s.l.
and on that basis Lots 9, 10, 11 and 12 will require filling tc

permits in accordance with the Public Works Director's memo dated
February 26, 1982, and based upon the following conditions:

"RESOLUTION ORDERING IMPROVEMENTS FOR AMESBURY EAST SUBDIVISION
AND ADJACENT AREAS", subject to receipt of a definitive agreement
with the King's setting forth conditions relative to payment of
annual accrued interest on assessments which will accrue to their
property as the result of the improvement project.

CABLE TELEVISION Cable TV Commission Chairman Dave Zemke was present to review a
revised Cable TV Joint and Cooperative Agreement. Mr. Zemke
pointed out the changes between the original agreement and the
revisions incorporated into the agreement by the City of South
St. Paul. Mr. Zemke responded to several questions and comments
from the Council. In response to a concern expressed by
Councilman Mertensotto, Mr. Zemke advised that he will get
further clarification on Section 4 relative to public hearing
requirements.
Mayor Lockwood moved that the amended Cable Television Joint and
Cooperative Agreement dated February 23rd, as amended be
approved.

AIRPORT NOISE Planner John Shardlow was present to review his memo on the status
of the airport land use compatability study process. Mr. Shardlow
� gave the Council a brief overview of the current status and
advised that the City has received a$12,000 grant from the Met-
ropolitan Council to help defray the cost of past and a small
amount of future City costs incurred during the airport planning
process. He advised the Council that a series of delays, primaril�
at the Metropolitan Council level have occurred since the
adoption of the Northern Dakota County join t position statement anc
that a good deal of work remains to be done.

low to review future Metropolitan Council repor s as they

and TH 55 at the Mendota Bridge. Mr. VanBer en advised the
Council that the project was scheduled for c nstruction in
19$5, but because it is not current].y funded, a construction
schedule is naw uncertain.

DUPONT ADDITION Mr. Mike DuPont was present to request that the Council
IMPROVEMENTS order public improvements to serve the Michael DuPont First
� Addition. Mayor Loekwood reminded the Council that at the
February 2nd public hearing on the matter, several problems
were left to be resolved by the staff and Mr. DuPont and
private property owners abutting �he project.
Public Works Director Danielson advised the Council that
staff has met with the four adjacent pxoperty owners, and ,
that the owners af the two praper�ies east af the project
� agree that it wauld be wise ta serve their properties with
public utilities as part af this project. Mr. Danielson
advised the Council �hat the Evans property and Dakota's �
Adults properti.es would bath be a��ected by the proposed
improvements because storm and sanitary sewer lines must
cross Che two properties in arder �o serve the DuPont
Addition. He stated tha� staff has met with bo�h parties
and has reached a tentative agreement on easement acquisition:
He further advised that Mr. DuPont has been a party �o those
negotiations and agrees that the costs of the easement
acquisition waul.d be paid for by the project. Mayor
Lackwoad asked for questions and comments from the audience.
Mr. Lynch, owner of one of the properties east of the DuPant
Addition, stated that he is in support of the grojec� and
asked questions relative to the cost of street improvements.

Raad ta TH 55 southbound.

POLICE CHIEF City Administratar Johnson advised the Council that 47
RECRUITMENT applicatians for the Police Chief pasition had been received
and reviewed and that 35 af those applicatians meet both
the experience and supervisory qualifications. He advised
the Council that he and Galden Valley Public Safety Director
Jim Crawford, are currently in the process of grading
responses to an IZ qu�stion questiannaire sent to the 35
applicants. He further advised the Council �hat the
selection process would take at least one mare manth.
MATTERS OF CONCERN The Gouncil ack.nowledged a memo fram City Adininistrator Jah�.
which compiled the items remaining from J?rojects and Polica.es
lists compiled over the past five years. The Council
reviewed each af the items included in the memo. As gart of
the discussian the Counci]. concensus was that the spring
fie2d trip shauld not be canducted this year or such trip
shauld b� postponed at least until fall. Other items dis-
cussed by the Council are as follows:
Staff was directed to investigate and research the possibility
of using special taxing districts;
Staff was dzrected to maintain records of street maintenance
costs by streets on a regular basis;
Councilman Losleben will pursu� senior citizen hi.-rise sit3.ng
at the Shopping Center;
Staff was directed to research the possibility of a"permanent
improvement revolving fund".
As part af the discussian, sta�f was directed to take a close
loak at the costs and needs for plowing of firemen's driveways.
LIQUOR The Council received and discussed a mema fram the City Clerk
relative to liquor dispensing considerations. In answer to
several questions posed in the memo, it was �he concensus af
the Council that stafi should prepare a draft orda.nance to

RE:• JOINT USE RENTAL AGREEMENT FOR 1982
Dear Mr. Johnson:
In accordance with Section 4 of the Joint Use Rental Agre ment
No. 155 between the City of Mendota Heights and the Metro olitan
Waste Control Commission, such contract can be renewed by consent
of both parties.
We wish to renew for another year the Joint Use Rental Ag eement
No. 155 under the same terms and conditions contained in he
agreement which is presently in force between the City of Mendota
Heights and the h1etropolitan Waste Control Commission.
The Renewal Agreement is enclosed in triplicate for your ndorsement.

This is regarding your request for a,revised Joint Use Rental
,�Igreer�nt to cover costs incurred by the City of f�lendota Heights
for services to Sunfish Lake Corporate Limits. It is suggested
by the Metropolitan Waste Control Commission that no increase be
offered in the Rental Agreement as requested by the City of Mendota
Heights for the trunk sewer line providing intercommunity service
to the five homes in the City of Sunfish Lake. The communities
have entered into a joint powers agreement which establishes an
equitable capital cost sharing in the trunk sewer together with
user charge consideration. The enacted agreement states the
rights and responsibilities of the parties to joinily use the
inter community trunk sewer.
Until such time as some change may be made in our long-range
position on rental agreements, The Metr000litan Waste Control
Commission offers the original agreement sent to you on November
13, 1981 for approval for the year ending December 31, 1982.
Your cooperation in following the original renewal procedure is
greatly appreciated.

be in order, fror� a technical point of view.
Since State Statutes require C1ty appraval priar to the opening af
bids, P�n/DOT is requesting a resolution to that effect to be in their
possession prior to April 12, 1982.
With the abave propased construction, another facet becomes apparent.
The City has long cantemplated the installation of water mains on
Wagon t+lheel Trai1 and on Mendota Neights Road where they cross Nighway 35E.
With the potential af having the Highway Qepartment do the grading
at these two locatians, it is advisable that the City take steps to establish
projects to at least inst�ll watermain crassings through the Highway Right
af Way befare pavement is installed.
We anticipate being ir�vited ta the pre-canstruction conference and will
attempt to determine when grading will be accomplished sa the crossings can
be installed at minimun cost.
A preliminary directive is requested although final authorization is not
needed until more information on nighway construction scheduling is available.

the State of Minnesota f.rom the federal interstate trust fund to complete
the rema.inder of the I-3$E corridor in Dakota. County on a sc edule that
is eonsistent with the Mir,nesota Department of Transportation.
' It is our understanding that approximately thirteen billian do lars exists
' in the fedez•aI interstate trust fund which is earmar�ed for c mpletion of
� inter.state miles throughout the country. The Gity of Eagan has maintained
ihe corridor alignment far I-35E through its eommunity for a praximately
twenty-seven (27) years. Business and industry have located i this cam-
muniiy and this part of the metropalitan area wiih an undersi- nding and
� commitment by both the State of Minnesota and federal gove nment that
�-35E wauld be completed to provide the transportaiion netw rk that is
desirable for their product and service.

Due to the new federalism and decentralization af programs at the federal
1eve1 of government, the City of Eagan is concerned that this link of the
interstate system be constructed as soon as possible ta assu e that the
funding cammitment is fulfilled by the federal government.

the next highest percent. The rate tivill be calculated by the 20th of each
month for the next month and published in the state register.' The maximum
rate v�rill be the greater of a) the rate in the month that Bond sale is
authorized, b) the rate in the month that Bonds are sold, or c) ten percent
(10%) per annum payable half yearly. Interest rates charged for special
assessments may be one percent greater than the maximum interest rate per-
mitted on the bond sale. As of January 1, 1986, the maximum interest rates
for bonds returns to 9 percent per annum unless changed prior to that date
by the legislature. Negotiated bond sale limit was increased from $200,000
to $300,000.
/�. IDR Bonds and Interest. Interest rates for IDR Bond sales �ill remain
unlimited until January l, 1986, at which time the maximum rate Zvill be
9 percent unless changed prior to that date by the legislature. No new
limitations on usage of IDR Bonds vrere imposed by the 19g1 or 1982
legislature. IDR Bond usage rvas extended for 'tourism' grojects (including
hotels and motels) to the entire T1letropolitan Area.
5. Coefficient of Dispersion Penalty. Imposition of a penalty (municipal aid
reduction for a less than excellent coefficient of dispersion assessment
rating was delayed until 19g4.
6. Interest Rate for Delinquent Property Taxes. Interest rate charged for
delinquent property taxes and assessments :rill be based on the secondary
market yield of one year United States Treasury bills calculated on a
bank discount basis rounded to the nearest percent. It �vill be calculated
in December for the folloti��ing year and is currently 11 percent.
7. Gravel Tax. A tax passed in 1980.of 10 cents per cubic yeard or 7 cents per
ton collected by the county and�distributed 60% to the county, 30% to to�ms,
and 10% for abandoned pit restoration v��as significantly modified. The dis-
tribution now includes cities where pits are located. The definition of
gravel was�extended to include almost everything except dimension material.
With the exception of a few counties with very little gravel extraction,
the tax is mandatory. Finally, the requirement to use the proceeds only on
gravel haul roads was removed.
8. Metropolitar� Mosquito Control District. The control district levy authority
was increased to six-tenths of one mill (approximately 2.5 times the current
levy) and eastern Carver County was added. The commission governing board
is still composed of county commissioners including one from Carver; two from
Dakota, Scot�, and Washington; and three from Anoka, Hennepin, and Ramsey.
9. Manufactured Housing. State statutes governing zoning requirem.ents for cities
and counties were modified so that manufactured housing (corn*nonly referred to
as mobile homes) built after 1976, according to HUD standards, cannot be
totally prohibited through local zoning ordinances. bVidth and type of founda-
tior v��ere added as items that can be regulated in zoning ordinances. This
does�not mean that someone can put a manufactured house any-�r'nere. The city
and county may designate a zoning class, a particular area, and/or certain

In accordance•with suggestions given to Fire Department memb
January 19th, the Truck Committee has met with City staff and pres
specifications for a proposed tank truck. Their memo is attached.
Larry and I met with the Truck Committee a week ago, discuss
specifications, the purchasing process and other safeguards. Thei

recommend approval of the specifications as submitted.
In accordance with our discussion with the committee, they h
recommended that Larry be authorized to issue a check in a maximum
of $500 as a down payment to hold a prospective unit. This check �
issued upon request of the Truck Con¢nittee. The truck would then '
closely inspected by our mechanic (and others if prudent). If the

scheduled meeting. It is, of course, anticipated that any purchas�

Northern States Power Comnany has requested the construction f a storm
sewer extension from the cul-de-sac on Rogers Court in the Eide Es ates Sub-
division to the interior of Roger's Lake Substation where a landsc pe wall
will interfere with natural surface water runoff.
To do the work will require the installation of approximately 370 feet
of 12" and 15" concrete pipe and appurtenances at an estimated cos of
$13,750.00 including fees, administrative costs and contingencies.
Easements will have to be obtained from N.S.P. Company as wel
owners of Lots 23 and 24 in Eide Estates. Northern States Po��er (
has petitioned for the improvements, has agreed to pay all costs a
grant necessar,y easements within N.S.P. properties. THey have wai
requirement for a public hearing.
To construct the landscape wall, it is necessary to install t

The project is needed, is feasible and is recommended for consitruction.
This segment of storm sewer will also be a step toward furnish�ing the
easterly part of Lakeridge P.U.D. with facilities, when it is develbped.

James Illetschko informed us the middle of March that his well had
failed and that he needed to connect to City water. Jim's home does not �
� front on a public street but is very near Lexington Avenue. His driveway . '
' is on an easement across 1875 Lexington. There are several other homes
, that are located around his that also don't front on Lexington but have �•
driveways across easements, (Kelley, Lachenmayer).

In 1965 when City water was installed in Lexington, the City allowed `
Lachenmayer and Kelley to run a private 2" cast iron water main in to serve
them. This main runs on an easement down Jim's dr�veway. Jim is working
out an agreement with those neighbors to allow him to connect to that � '
; private main and he says,that they are charging him-$1,600..00 as a connection
; charge. That amount is equal to or slightly greater than what,a no;rmal�Cit'y .,
assessment for water has been running lately. ' ' ; � � � � �
At the time Lachenmayer and Kelley hooked their private main into�the
. , City's a connection charge of $300.00 each was paid.

' We recommend Illetschko be allowed to connect to that private main
' i:f he pays the $300.00 connection charge and the $200.00 WAC charge to the

Three bids were received for the 1982 Street Sweeping Contract, bids
ranged from $40.00 to $45.50 per hour, and are listed below:
Loomis Transport, Inc. $45.50
Crosstown Sweeping 45.00
Joe Rosse Commercial Sweeping 40.00
Loomis, who has been our contractor for the past two years submitted
, the highest bid. A new company, Joe Rosse Corr�nercial Sweeping, submitted
the low bid of $40.00 per hour.
I have checked several references on the low bidder and recommend
" that the Council accept the low bid awarding the 1982 Street Sweeping
Contract to Joe Rosse Commercial Sweeping.
Rosse has indicated sweeping could start on or about May 3, 1982.
