The funding of the proposed budget will require a levy of $2,146,550 or a 22 percent increase. Of this increase, $237,409 or 13 percent represents the loss of State Aid which has been shifted to the School District by the State Legislature. Natural growth in new building resulted in an increase of valuation of about 9 percent. Due to changes in the formula computing tax capacity, the net increase in tax capacity is estimated at 4 to 5 percent. The levy as proposed is 6.3 percent lower than the increased advertised, and should result in small increases for lower valued homes, with small decreases for higher priced homes. • ACTION Conduct the Budget hearing and adopt Resolution No. 89- establishing final tax levy for collection in 1990. We own roughly 300 feet of frontage along Wagon Wheel Trail. Theroad in front of our property is already wide enough to meet MSA standards, complete with plent of shoulder for walking and biking. It is also newly built and doesn't require resurfacing. The grade is such that curb and gutter would have little if any ben fit for us. Lastly, but certainly not least is the fa that most of our frontage, if not in fact all of it, i essentially unbuildable. This land is not only at app ima.tely the same level as the lake and prone to stand- ing water, but is so far below the level of the road that any structure built there would be devoid of any view toward the lake and likely have a water filled basement. This fact along with other considerations has prevented our being able to subdivide the property into buildable lots as we would like. We strongly object to the city of Mendota Heights arbitrarily deciding that this frontage constitutes 300 feet of buildable, usable land and assessing it as such. We would be placed in an untenable financial position if assessed in such a manner. The second half of our objection to this project regar the estetic, environmental and safety imp.acts the pro- posed project would have. Widenening the road, addig curb and gutter and a bike path and straightening out s Page 2 the S-curve would change the character of this area of Mendota Heights from a spot with rural charm and woode windy roads, to just another city street. Most of the roadside vegetation, a lovely nesting spot for ducks a birds would be gone from the roadside. The wider stre would be just that much closer to the front doors of r idents bringing with it the noise of traffic in an are already tortured b.y aircraft noise. Another considera tion would be an increase in the speed of the traffic on Wagon Wheel Trail. The new street would have such good visibility and such.a smooth surface that no one would have to drive slowly through this neighborhood full of children. We do not welcome these changes in the character of the neighborhood. Thank you for your consideration of our o cerns. . \ Scott L.. Miller f hyllis Zai aner Mi er cc: Klayton H. Job No. 8816 Improvement 88 Project 7 INTRODUCTION Residents livirig along Wagon Wheel Trail have requested the c:tty install a bituminous trail along that street. Wheel Trail is part af the Muniaipal State Aid Street s but it has never been upgraded ta MSA standards. When ' Wheel Trail is upgraded it has been the intent to inclu additian of an 8 bituminous traii. This repart loaks at the different opions for partial full upgrading of Wagon Wheel. The report will be bro down inta the following sections: Discussian of the construction apians iscussian of the finanaing aptions Discussion of the time tab3e ior campletion Tdentificatian the unresolved guestions List a Recommendations Actian Required nzscusszox to . at gon em, an the If a trai is ta be i.nstalled, it can either be canstru ted as an independent praject ar it can be included as part af an averall upgrade of Wagon Wheel Trail to MSA standards. There are some advantages and disadvantages to each plan. Ea h af the alternatives wi11 be discussed separately. Independent Trai1 Canstruction The chief advantage o canstructing it independently is that it avoids the need of completely reconstructing Wagon W eel when the street is still in fairly decent shape. Then n the future the street wauld be reconstructed as part o the MSA program. Doing just the trail avoids any street assess ents at this time, The disadvantages a canstructing independently are the increasad cost af design, increased constructian cast, . loss of MSA financing. I constructedand designed bef the street is upgraded, the tra3.1 has to be designed to accommodate the future raad so much of,the design of the raadway must be completed early. Similarly, additianal cantruction stepswill have to be taken which wi21 mean higher costs. Alsa some eaanomy of scale will be last. Finally, some other source o'financing wi1.1 have ta be because MSA money wi1.1 probably not be available for an independent trail prcjec. The cost to construct th trail separately, including overhead, contingenaies, and the extra design casts w $134500. Combined Street and Trai]. Froject Existing Wagon Wheel Trail is not up to city design standards. It lacks Curb and Gutter, proper starm drain has an "S' curve whiah i poor design. It wili have ta ; wi.dened fram 24' ta 40'. Wagon Wheel is part of the MSA system so upgrading to M5A standards at some point in ti a certainty, Arnother deficiency in the current design of Wagon Wheel is the interseation with Dadd Road and Decorah. These streets should be realigned to form a four-way i.ntersec ' 'Although this may nat be required by the state, it waul reduce the danger of this hazardaus intersection. .Ther the realignment of this intersection is highly recommen The cost widen and realign the street to MSA standards, realign the intersection o Decorah and Dodd, install c and gutter, construct a bituminous trail, and restore t disturbed yard areas is shawn below: ITEM Street and Bit. If the path is constructed independently MSA funds wi1l. than likely not be available due to the state's funding m and' e is 'rail ree on, be ore n af ath tion criteria. The only other ways that the trail cauld be fnded is via Park funds or assesments. Park funds have been sed in the past for bike trails, sa that option has preceden . The use of assessments ta the adjacent property awners m y be hard ta justify. Really the trail is intended to serve he entire surrounding area so assessing only in the immedi te vicinity would be unfair. If the street and trail are both constructed togeher, savings will result and MSA funds will be available for trail. Sn additian to MSA funds assessments for street canstruction are justiiable. Since Wagon Wheel Trail was a county road up unil a fe years ago, the residents living along it have never pai street or starm sewer lateral assessments. Under these circumstances normally the costs associated with aversi the street are covered by MSA funds and the remainder o costs are assessed. Note that this fits in we31 with t propased palicy on street rehabilitation unding {discu in another mema. any the C1 If the Street Rehabilitation Policy criteria are used t e residents would pay for some af the storm sewer, $10.00 per front foat for street overlay, and ane ha].f af the cast associated with installing the curb & gutter. MSA waul cover a partion of the storm sewer aasts, the rest of t e street overlay costs, all the costs far oversizing of e street, and all the costs for the bituminaus path. Using these criteria the total assessment will amount $24.57 per frant faot for residents that have never pa storm sewer, and $16.50 for those who.have, The table shows the breakdown of the funding assuming the propos Street Rehabilitation Policy is observed. If the realignment of the Decarah-Dodd intersection is any elow out pated included in the project the extra cost of $41,200 could recaptured by using excess MSA funds that will be avail as a result of the Wagan Wheel project. F TABLE Although there has been a:Eair amount of interest in the' idea of a new bituminous trail, there will prabably be substantial oppositian to any assessments. A pub hearing was held on October 17, 1989 to discuss the issu and costs of a street improvement project. There were 12 property owners present at the meet all expressed concerns and dislike for the project, especially concerning the proposed assessments. The h was tabled until the December 5, 1989 Council meeting other potential funding sources could be explored. Si that time, a conflict has arisen, so this public heari be continued on Wednesday. December 6, 1989,at 8:00 P There were a number of comments which were made October 17th hearing regarding the project which I w to address. The following is a response to some of comments. at the 1) "This project is too expensive, the people along Wago Wheel shouldn't be asked to pay for any of the costs" It is true that the proposed assessment of about $2 per foot can turn into a significant amount of money for lot owners along the street. However, you should unders that this is 23 of the total project cost. On a normal street improvement project (one that doesn't qualify for State Aid funding), the lot owners would pay for 100 of cost, which often works out to about $60 per foot of frontage. 2) "This street is already dangerous. By upgrading it will be more traffic and higher speeds, making it e more dangerous.' In my judgement this project would greatly improve safety of the neighborhood. By including the bike trail pedestrians and children could stay out of the street. addition of curbs keeps the cars where they belong. Wid the street improves site distances, provides for safe on street parking, and gives more vehicular maneuvering roo 3) "Upgrading the street will increase the amount of traffic". ; of .ic :s who ing that ,will :he like .00 the the ing This project is the upgrading of an existing street Since it is an existing street, the people who are alrea using it are doing so because it is the most convenient route. The upgrading of the street by itself will only the road slightly more convenient, and therefore traffic volumes are not expected to increase. There just aren't destinations which will compel people to start driving through this residential area. ' 4) "Why spend this money on a project we don't need?" any This street is part of the Municipal State Aid Stre t System (MSA). Because it is an MSA street, at some time it will be upgraded to MSA standards. If our State Aid mon y isn't spent Mendota Heights will eventually lose some of it. By doing the project now a loss of funding and an increa e in reconstruction costs can be avoided. Increased assessme ts would be necessary to cover increased costs in the futur . 5) "There is no need for storm sewer and concrete curbs. Many people wonder why cities always add curb and g tter when streets are reconstructed. There are many advantag s. A street with concrete curb and gutter and storm sewer k eps water from flowing underneath the blacktop. This can gr atly increase the life of a street and reduce maintenance cos s. A longer lasting street means long term savings for the ot owners (reconstruction costs are covered by assessments). Curbs also reduce yard damage caused by snowplows. Additionally, by adding curbs and storm sewer the ditche can be eliminated, which usually improves the appearance and usefulness of a yard. In my judgement as an engineer, there are some advantages to this project, and I wanted to present them to you. You might disagree with some of these points; if y u'd like to discuss some of the issues before the council me tin just give me a call at City Hall. •Whether you're for or against this project, or just interested, I encourage you to attend the December 6, 19 meeting to discuss it. The proposed improvements are to be Iocated .i80 feet narth of this drainageway and are therefore not within the 100-foot setbac area. Furthermore, the land on which the baiting cage and dugauts ar to be located is elevated several feet above Warrior Drive and the rainage way and would nat be affected by storm water runoff. 3. The sketches pravided with the applicaiion are fairiy crude an it is difficult to determine if the required setback from Warrior Dr ve has been respected. I believe the line from which the setback di ensions have been measured on the site plan represents the curb edge af the street. If this is the case, then we must deduct approximately 8 feet f`rom • the ciimensions on the plan in order ta deterrnine the actuat setback from the property line. This would result in a 32-foot setback for the batting cage and a 27-foot setbaek far the dugaut iocat d alang Warrior Drive. Lentner (Mendakota Country Club; 2075 Mendakota Drive (see sketch) Conditional Use f'ermil PUD, Wetlands Permit for 1. Representatives of Mendakota Country Club are proposing to buil two new pump houses on the golf course. One of these is to repla e the existig pump house proposed to be demolished. The locations of these pump houses is indicated on Figures 1 and 2 included wit the application. The letter from Mr. Lentner explains the purpose f the new pump houses and the materials of which they will be construc ed. 2. Section 19.10(2) requires a Conditional Use Permit for changes approved final development plan for a PUD. While I have no reviewed the existing PUD agreement to which this Condition Permit would apply, I believe the nature of these improvements i that they would conflict strongly with anything in the agreement. The proposed pump houses are fioth small ac structures (12 feet by 14 feet) located in large open areas, elirr most of the usual concerns associated with accessory structures o square feet in area. Since both structures are to be located inte the golf Course, as shown o the enclosed site plans, there concerns related to setbacks from public streets. In fact, sin nearest public street is over 1,000 feet away, it is unlikely that of the structures will be visible from any of the surrounding streets or adjacent properties. 3. With respect to the appearance of the buildings, no sketcl - elevations were submitted, therefore, little can be said. Howe Mr. Lentner's letter he states that the new structures will be o frame construction to match the exterior of the new clubhouse. confidant that the Country Club will maintain a high le workmanship in the construction of these buildigs commensurat the overall appearance of their other facilities. 4. Since the request is to replace the existing pump house, which is the 100 foot setback from Rogers Lake, a new wetland per required under Section 6(B) 4 of the Wetland Systems Orc Clearly, the proposed pump house, while substantially larger th existing one, does not create a significant increase in the encroa on the northern portion of Rogers Lake. In looking at the s submitted with the application, it cannot be determined if the in to maintain the same setback as the existing pump house. DISCUSSION Planning Commission to the bluffline, t: plans and replaced At the November Planning Commission meeting it was the spa is smaller and only extends four feet (4') from existing structure, or approximately twenty feet (20) the bluffline. The brick paver patio is not considered structure. There was concern expressed by a neighbor who lives below the Hall's about drainage of the spa. The Plannin Commission conditioned their recommended approval on the spa being linked to the sanitary sewer system. Zone. Mr. Dinger has reviewed hi sign proposal with United Properties. {See attached lette from Dale Glowa). He now is seeking City approval far a setback variance. The sign conforms to a11 ather requirernents of the Ordinance. United Praperties has submitted a comprehensive sign plan for their industr3.a1 park that was approved by the G'ty. Zt shawed their standard signage to be setback twenty fee (20) from the right-o'-way and the City has been approvi g ttese variances as a matter af caurse. Pilat Knob Raad currently exists as a two lane rural section at this site. It is propased to be upgraded and widened in 1991 to a four lane urban section with curb an gutter. When this is dane, the property line will be seventeen feet (17) from the back of the curb and the si will be twenty five feet {25'}. Because of sight distance obstructions created by existing pine trees, the appli.cant has piaced his sign e'ght feet (8j rom the praperty line. The prnposed sign loc tion has been staked for yaur view3.ng convenience. The property is located in the Mendota Business Park, which is managed by United Properties. The F sign woutd be located 8 feet fram the properiy Iine and 16 fee the entry drive as indicated an the site plan included wi application. 5ection 3.$.7{2}a af the C3rdinance prahibits the loca a freestanding sign within any required yard. Since the front ys carner side yard requirements in the industrial district are 40 fe proposed sign woutd require a variance of 32 feet. The building is setback 40 feet from the property line, therefoce, little room for locating a business sign except within the yard ar ndota (see entry -leights oposed t from ;h the wion of rd and L, the sxisting leaving ;a. 2. The dimensins of the propased sign are shown on the drawings ravided by the applicants, and the overall surface area and height are within the requirements of the ordirtance. The appearance of the sign is attractive, simple, and generally in character with other signage in the area. United Properties administers sCandards far sign desi n and construction in order to maintain the high quality appearance af the Business Park. The proposed sign has been reviewed and appr ved by Dale Glawa of United Properties as being consistent with those standards. 3. The propased sign is Co be internally illuminated. While the o does not specificaliy address internal illumination, section prohibits the use of illuminated signs in all districts. The intent requicement is to prevent signs that create irritating distracti passing motarists. This is generally rnore a problem with flashir or those with glaring spot lights or ather beams which m' directed at rrotorists. When staff tirsi met with the appiic indicated that he intended to illuminate to the sign with floodlights. Whe he was informed that floadiights were noC pe he agreed to exclude them from his plans. The graphic design sign is very sirnple and bold and should not present a sic distraction when iit. The City has permitted illuminated signs type in the Mendata Heights Business Park and in other busin industrial districts in the past. Floar Coverirgs, inc., Case No. 89-44 Page 2 r At the present time, there is substantial excess ROW for Pilo Knab Road in this area. However, the County has plans to incre se the width of the roadway, which will significantly reduce the istance between the driving lanes and the proposed sign. The sign w uld be located approximately 47 feet from ihe existing ecige af Pila Knab Road. The new curb will be within 17 feeG of the property line and within 25 feet of the nearest edge o€ the proposed sign. Thi is 22 feet closer than the sign would be in the existing condition. V ciances of up to 20 feet have been approved for other businesses in the Mendota Heights Busiess Park in the past. Assuming an verage distance of 15 ta 20 feet from edge of curb ta the RC1W ine, a setback of 20 #eet wauld result in an effective seiback from the driving lane of approximately 35 ta 40 feet. Based on the site plan included with the application, it app ars as though the sign could be moved another 1Q feet closer to the parking area. Hawever, this may resuit in some obstruction of the sig from the south due to the location of the existing berm. This s tuatian might be impraved by moving the sign c2oser to the entry drive The ordinance allows signs to be located within 5 feet of an entry dive ar parking area. . . ' F A R W t. HISTORY ish a board a :mber cities. The Federal Superfund law was amended in 1986 to include a Title III amendment (Commonly known to as SARA Title III) which states that all communit es must develop plans to protect the public from chemical or hazardous materia s disasters. Among other things it also directed Federal OSHA to develop training r quirements for personnel responding to these incdents. Like usual, there was now a la but no funding was Allocated for training and implementation of the law. With n a few months OSHA had developed training standards and an interim rule 19 0.120 was put into place. At that point, emergency responders across the country beg n to realize that implementation of the standards would be very expensive and in s me cases impossible to implement on an individual basis. DISCUSSION In September of 1988 Fire departments throughout Dakota County were proposal from the St. Paul Fire Department to provide contract hazardo response to the cities. At the same time the County Fire Chiefs formed materials committee and brought this proposal to the city managers at meeting in November of 1988. At that time a county task force was es consisting of City Managers, Fire chiefs and County officials to study lon; range options for Hazardous Materials Response. The Joint Powers agre being presented is a result of the work of that task force and the Fire Cl Materials Committee. Also going on concurrently with all of our efforts, was an effort by the : Fire Chief s Association for the state to establish Regional Response Tean egislature during the 1989 Legislative session This program failed to g egislature leaving cities with still nowhere to turn. 1 sent a s materials hazardous there monthly :ablished ; and short ;ment that is iiefs Hazardous lnesota State at the state approval in Although the Board would be responsible for establishing how best to response to its members the Fire Chiefs committee did extensive work ; preliminary budget forecasts (Also attached). The proposed concept is a: Response team would be made up of firefighters from county fire depar it is not proposed that there be a full time response team on duty waitin incident to occur a 25 member team is proposed. This number came fr that OSHA 1910.120 has requirements of 7-8 people that must be invol addition to a decontamination and support team. Since it is not fulltime more or less volunteer we used the rule of thumb that a 3:1 ratio would meet the minimum requirements. It was also determined that it would individual cities best interest that each fire department responding hav personnel trained to the level one response to produce at least 7 person; to assist the response teams. After the three year implementation period the only costs for maintaini would theoretically be training and administration needs. Where the te; out to an incident all costs for the response would be billed to the carrie organization responsible for the incident. Funding of the team is based capita. Costs to the City of Mendota Heights and our contract areas wou $2895 in 1990, $5473 in 1991, $1708 in 1992. After this point it is es costs to our area would be$2725.20. This compares to a cost for protec City of St. Paul (with no Guaranteed response) of approximately $4700.1 $3820 was budgeted in the 1989 Budgeted for contract services with St. money could be used for our 1990 contribution. RECOMMENDATION Since Implementing a hazardous , material response team would be to c for each city to implement; and since a hazardous material incident is si: natural disaster in the fact that it knows no political boundaries it is im cities to sign. For the best, most cost effective, means of protecting our possible hazardous material situation I strongly urge the participation ir agreement.
