LANDFILL ABATEMENT Council acknowledged a memo from
Administrative Assistant Batchelder regarding
a proposed amendment to the landfill abatement
agreement with Dakota County. Assistant
Batchelder explained that the proposed
amendment to the 1992 joint agreement
represents changes.that will take place for
1994, including the amount of funding and
increased percentage in the required
residential waste abatement. He summarized
the city's 1994 work plan and informed Council
that while it appears that there will be
funding in 1995, it is likely that the city
will be expected to bear a greater share of
the cost.

Mr. Stary responded that the size proposed is
the maximum size that can be built on the lot
and stated that the exterior of the garage
will match the house.
Councilmember Smith stated that she feels it
is appropriate to grant a one-car garage and
the setback variance because the right-of-way
is so great in the area and there is little
chance of a change in the future.

foot side setback variance to allow
construction of a single car garage at 983

CASE NO. 93-30, EFH Mr. Gene Happe, from EFH Companies, was
present to request approval of a 50 foot front
yard setback variance to allow construction of
a building for the Red Cross on Lots 2 and 3,
Block 2, Northland Plaza Addition, fifty feet
from the right-of-way for T.H. 55, along with
a parking lot setback variance and proof of
parking variance.
Mr. Happe gave a history of the proposed
project, explaining that five contractors
bidding on the project were required to find a
site no more than 10 miles from the airport.
He stated that he looked at several sites in
Eagan, Mendota Heights and Apple Valley, and
that the Red Cross representatives selected
the Northland Plaza site. He informed Council
that he had looked at the lot next to the
Turner's Gymnasium site and also Lot 1 of the
Northland Plaza Addition, but neither site was
large enough.
Mr. Happe explained that a variance is
requested because the city's Zoning Ordinance
requires a 100 foot setback from a major
highway, and the site is adjacent to Highway
55. He informed Council that in order to
build the type of building that the Red Cross
needs, 120 by 205 feet, a 50 foot front yard
setback variance is needed. Mr. Happe stated
that the two lots have been certified to the
state as tax forfeit and can be redeemed by

restaurants. He stated that a hotel had been
originally planned by the developer for the
lot across from the subject property.
Mr. Happe responded that the Red Cross is
under a federal mandate to have a building in
operation by September 1 and there are very
few sites in Eagan and Mendota Heights that
can be built on - he explained that all vacant
lots in Eagan are platted as outlots and the
platting process takes three to .four months.
He informed Council that in order to meet the
mandate, a building shell must be up no later
than March 15. He stated that removal of
about 30 feet of uncontrolled fill on the lots
to the south would be very costly. He felt
that the practical use of the Northland Plaza
lots being considered is not very good and
that the Red Cross use fits the zoning. He
felt that since the lots can be used for
little else, a variance is justifiable.
Mayor Mertensotto responded that Council
should take a comprehensive view of what the
property could be used for. He noted that one
of the Planning Commission�members felt that
approving the application would be much like
rezoning the property. He explained that the
basic reason for the 100 foot setback is to
allow flexibility, and stated that once
properties are stacked close to the right-of-
way, the potential for transportation changes,
such as additional turn lanes, etc. are lost.
He pointed out the access problems at the
Fischer gas station and old fire station
caused by their proximity to the right-of-way.
Mayor Mertensotto stated that while he is
sympathetic to the Red Cross, Council cannot
make a snap judgment when the property has
been planned as a service use for many years.
He further stated that because of the extra
height that Red Cross needs for the building,
it is very much like an industrial building.
Mr. Happe responded that the proposed building
would be 18 feet tall with a four foot high
parapet to screen roof-top units. He stated
that he feels the use fits the zoning.
Mr. Doug Carney, representing the owner of the
land, stated that he understands Council's
concerns over setting a precedent, but
suggested that Council first look at the

believes Council fully understands what the
applicants are trying to do but must make a
judgement based on future development of the
highway corridor. He stated that in his
judgment Council should not give up the
flexibility that the 100 foot setback
provides, but if the applicants could meet the
setback he would have no objection.
Attorney Hart stated that as the City Planner
mentioned in his memo, as a condition to
granting a variance, the city must determine
that this particular site presents a
reasonable hardship for any development. He
further stated that Council must.find that the
hardship is related to the site, and not the
specific development proposed for the site.
Mayor Mertensotto also referenced the planning
report with respect to consistency of
maintaining a 100 foot setback.
Councilmember Smith stated that when she looks
at a change in use, she always tries to look
at the long term. She further stated that
while there have been instances cited where
buildings are currently closer than 100 feet,
perhaps some of those uses are temporary and
in the long-term future will have a different
type of use. She informed the applicants that
Council has designated in its goals for the
year looking at the entire T.H. 55 corridor to
ensure that development takes place with the
needs of the community in mind. She felt that
the timing of the application is very
unfortunate because Council has not yet had a
chance to review the entire corridor. She
asked about the site adjacent to the Turner's
facility and whether the proposed building is
a prototype.
Mr. Happe responded that the lot south of
Turner's is two acres and while he tried
everything he could to get the site to work,
he could not fit the building on it given
setbacks and a gas line easement. He informed
Council that there are currently 52 Red Cross
testing labs across the country which must be
replaced by 11 facilities. He explained that
an injunction issued in July gives the Red
Cross until September to get four labs
operating and the remaining seven must be
built by some time in 1995.

The regular meeting of the Mendota Heights Parks and Rec�
Commission was held on Tuesday, January 11, 1994, in the Cit
Large Conference Room, 1101 Victoria Curve. The meeting was
to order at 6:40 o'clock P.M. The following Commisaion

The November full Com�nission meetirtg was cailed to order by Cha-ir John Lagoo a� 7.00
p.m.
1. ROLL CALL - Members Present: Alvin Boelter, Lucii7e Collins, Ken Henderson, Henry
Navey, John Huber (7:10 p.m.), Jode7le Ista, John l.agoo, Ed M�llarky, Ran
Ragosheske, and George iourviile. Members Absent: John 0'Brien, and Richard
Vitelli. Also Present: Mike Sokol, Legal Counsel; and Joy Curtin and Jodie
Milier, (staff).
2. AGENDA - Motian 12.1.93.1 to adopt the Agenda as presented was made by J. Ista,
seconded by K. Henderson, and unanimously carried.
3. CONSENi AGENDA -
A. Minutes: Mc�tian 12.1.93.2 to apprave the November 3, 1993 NDC4 meetfng minutes
was made by H. Hovey, seconded by L. Collins, and unanimously carried.
B. List of Ciaims: The List of Claims was presented by Treasurer Tourvill� for
review by the Commission. Mation 12.1.93.3 to apprc►ve the List of Claims for the
per�od iiJ4/93 - 12j1/93 was made by G. Tourvilie, seconded by A. Baelter, and
unanimously carried. '
4. REPORT FROM CONTINENTAL -,3. Miller reported that Continentai will carrect a
promotion which is currently being run for "Cable Talk" to state the show will
appear an Channel 43 in the NDC service area.
Customers wanting a second canverter box are wait-7isted for approximately 8- 12
weeks as new customers are being given priority in receiving bor,as. Pre-wiring
is being done for those requesting a secand box so when *t�e box arrives, the
custcmer will not have to wait for ihe wirino co be done.
Continental has arranged for a met�c�rologist fr�om the Weathar Channe'I io give
presentations to schools in the NDC area as part of Cable in the Classroom. A
couple of s::haols in 5auth St. Paul and passibly a few in ISD #199 will
participaie. J. Ista requested staff send a thank-you note to Continental for
making the presentation possible.

6. OFFiCERS' REPORTS - No reports were given.
7. NOCTV UPDATE - J. Ista inquired about the status of receiving payment far the
malfunc�ioning air-conditioner. J. Miller rep3ied ihat the judgement of the
District Caurt was made in favor of NDCTV and collection is being pursued.

Creighton regarding various NDC4 concerns about the Contract. It

CAA attorneys at Bernick & Lifson have stated that the transfer of ssets does nat
constitute a"taxabie event" which was a concern raised by the �iDC attarney. A
written opinion to that effect will be issued.
It is the opnion of T. Creighton that the purpose of the language equiring NOC4
to adopt chartges in NDGTV pol�cies within 60 days or waiving the�r ight to do so
is to avoid gridiock. It is expected that if NOC4 has a orablem with policies
proposed by NOCTV, it �an express its concerns within the cycle o two meetings
and begin the review process. NOCTV is open to any other iengt of time NDC4
deems reasanable. After brief discussion, there was consensus t at 60 days is
adequate and the language shc�ctid remain as proposed.

accumulated personal leave, extended disability leave, vacation, and compensatory

Discussion took place on whether to convert up to 48 haurs af accumulated sick

J. Nuber, and unanimously carried.
D) Southview Gables: M. Sokal reminded the Commissian that a follow-up needs ta
take place after January 1, 1994 to make certain the apartment complex security
system has been remaved from Regional Channel 6.
STAFF REPORTS -
A) Executive Director: J. Miller distributed a Letter of Engagement from Brian
Grogan, Moss & Barnett, the attorney seiected by NDC4 to represeni ihe
organization. Discussion tocak place on various aspects of the Letter. Motion
12.1.93.fi to approve the Letter of Engagement from Attorney Br�an Grogan with the
following cFtanges: Point #2 - no rate aver �1�00 will be charged unless
au�horized by the Executive Director; Point #5 - request i�emized statements;
Point #9 - the Moss and Sarnatt propasai becames a part of the Letter of
Engagement and will be superseded by the Letter of Engagement should a conflic�
between the two documents arise was made by G. Taurville, seconded by K.
Henderson, and unanimously carried.
,i. Milier highlighted access channel programming activities. Representative
Milbert and Senator Metzen are producing two shows per month far the Gavernment
Access channeis. "A� Issue", a live cai3-in shaw, will take place the evening of
December 2nd and feature experts an community policing. NDCTV will be
coord3nat�ng technica3 aspects +�f the Dakota County Childre� and Families
Conrerence to take piace at several sites around Dakota County on January 13.
Volunteers are needecf to help with the production.
Plans are unde!-way to offer M-SPAN, a state-wide cable service tha* will provide
live coverage of the Minnesota iegislature and related activities while the House
and Senate are in session. When not in session the service may carry local
governmeni access programming, In the Twin C3ties, caverage wiil be carried on
Regional Channel 6. Public access channels pragramming hit a record 51

16 at the NDC7V Studio. Representatives from Continental Cablevis on and DaEcota
Electric will be present to discuss the potential of extending cabl to locations
that do not quaiify to receive cable at this time because of the h using density
requirement. The meeting wi11 be taped for playback and will be bic cled ta those
interested rasidents who cannat attend the meeting. Alternati e methods of
financing the extension are being discussed. A notice regarding th meeting will
be published in the rtewspapers and the Inver Grove Fteights newsle ter.
11. NEW BUSINESS - On behalf of the Cammissian, Chair Lagoa thanked ike Sakal for
his dedication and service to NDC4 over the past few years and wi hed him well.

The department responded to 11 calls during the mor.
of December 1993. The most notable of these calls was �
stubborn vehicle fire on Highway 13 south of the Mendot�

DISCIISSION
The Dakota County Board of Commissioners asked County taff to
examine the possibilities for a Regional Trail corridor th t would
run east-west through the northern section of the County.� he goal
would be to connect the Northwest Regional Trail (Soo Line rail in
western Mendota Heights) to the Riverfront Regional Trail ' South
St. Paul.
The Riverfront Regional Trail is planned to connect Sc
Paul with Hastings, and possibly Red Wing. As Council i�
the Northwest Regional Trail (Soo Line Trail) will connect
Island/Lilydale Regional Park with the Mendota Bridge a
trail connections south into Eagan and Dakota County. ��The
desires to link these two regional trails with the Nort
Trail through Mendota Heights, West St. Paul and.South St.
On December 16, 1993, staff inet with representatives :
various cities, Dakota County staff and Dakota County
consultant to discuss trail concepts. (Pleaae see attached
from this meeting.) Specific designs of routes and coY
points are to be recommended by the County's consultant Z

On behalf of the City Council of the City of Mendota Heigh s, this
letter is offered in support of the concept of the Nor h Urban
Trail, which Dakota County is exploring as an opportunity to link
two regional trails. While specific routes and connections for the
North Urban Trail are still to be determined, the City of Mendota
Heights supports the concept of an east-west trail corri or that
could link the Soo Line Corridor trail and the South t. Paul
riverfront trail.
An east-west trail corridor linking the regional trails on both
sides of the County would provide better access for our r sidents
�• who desire to use the Northwest Regional Trail (Soo Line C rridor)
and/or the Riverfront Regional.Trai1 (South St. Paul).
The City of Mendota Heights appreciates the opportunity
with Dakota._County in exploring additional recreationa
facilities-to serve the residents of our area. We look fo:
continuing our cooperative efforts in this regard and p:
input as Dakota County begins to determine more specific
for the various routes and connection points.

of Marie, west of Carlough Park. This tcail will not be oa the curbline, but will be back.
We do not lrnow how far the set back will be.
B. Batchelder: Valley Park Trail oomes out on Lilydale Road. There is a connection from .
Park Place residenti.al. area. There may be possible access along Annapolis. The�trail uld go
down H'ighway 13 with st�irways. The trail could go north along Wachtler then south ong
A'ighway 13. The�re is a city trail on the north side of Wentworth to Wachfler from d.
W. Craig: The West St Paul City Council has not yet decided to build the golf co . A
trail would not be feasible to go around unused areas of the fairways because of stray lf
balls. �
R. Nelson: Connections should be made to the Athletic Center, Henry Sibley School,
from South St. Paul to Robert. A connection from Sibley to Rabert is a must.
L. Moratzka: The 5 year CIP does extend a bikeway south of Wentworth, along e to
Marie. In order for the County upgrade existing bikeway to Regional Trail standards, e
cities have to request the•work and the decision �s made by the City and the H'ighway �

R. NeLsoa: Randee gave an overview of the South St. Paul RiverFmnt Trail Plan. A
tunnel under 19th Avenue is a possibility instead of going over the st�reet. The 19th 1�
bridge will not be replaoed in the near future because the cost estimate is .25 million.

The Counry is in. the pracess of seeking grant funds to bwild the regional trail from th

The County will be working with MnDOT in an effort to cooniinate design so that th
Regional Trail will m�rge in with the southbaund County Bike Trail. at the at grade co trolled
intersection of Pi1ot Knob and new Highway 13.

In addition to routine maintenance performed in the Public Works dep ent, we
reported in early on December 6 and 13 for sandi.ng. We salvaged the storm sewer prons and
beehives at the Culligan Land and Glenhill holding pond for future filling. Bridg decks on
Mendota Heights Road and Wagon Wheel Trail were cleaned of snow.
The emergency generator was brought out to the Northland Drive lift station
22nd for a power outage. The cause of the power outage was due to N5P ogera

sign permit application and drawing of the proposed sig . The
unlit sign is proposed to be installed on the east side of he ACT,
Inc. building above and to the north of the main entrance doorway
on the brown building band. The individual 2' high plastic letters
will be mounted approximately 17' above grade. The letters will be
attached to the building on studs with 1/2"�of clearance between
the building face and back of letters to give a 3-D effe t. The
letters will be an opaque white color and span 46'. is will
create a total of 92 square feet of signage. The City' Zoning
Ordinance allows 100 square feet of sign face in the Indust ial "I"
District.

This spring St. Thamas Academy's Environmental Studies class requested variance
fram the City's ()rdinance ta allow them to use a motorized pontaon to callect wa r samples
from Rogers Lake. The City Cauncil granted the variance subject to them sharing the results
of their studies with the City. The studies are now completed and members of tha class will
attend the 7anuary 18th meeting ta pre�ent the results (see attached letter).

My name is Timothy Vetscher and I am writing you concerning the
evaluation that the S� Thamas Academy Environmental Studies class will present
on January 18th, 1994. You have most graciously given us access to various
ponds and lakes in Mendota. Heights and in exchange for that privilege we agreed
to share with yau our results. The presenter.s will be Travis Porcelli, Thamas
Quirk, Matthew Quy, Reggie Rassmussen, and myself. What-we plan on
accomplishing in a half an hour is presenting the data and analysis that we have
gathered from Rogers Lake and the Lilly Ponds at Dodge Nature Center located
in Mendota Heights. Following that, we will open the floor to discussion and

At the November 16th Council meeting, the City Council decided to hold off on the
entire'Friendly �Gills street project and instead focus on just the Frienclly Hills 1st Additi.on.
A feasibility study on the Friendly Hills lst Additi.on has been completed and reviewed by the
Council. The next step is to hold a public he,aring. On 3anuary 1$, 1994, at 1.45 P.M., a
hearing is scheduled to discuss this project. You aze encouraged ta attend.
There are 59 homes in the 1 st Addition and the streetS involved are Creek, Fox,
Hokah and Aztec. The eurrent proposal would involve reconstructing all the streets with
storm . sewer, curb and gutter, and new blacktop.
Storm Sewer wi11 be installed throughout most af the area.. A1so aun underground drai.n
system will be inst.alled in some areas so homes with excessive sump pump discharge will
have the option af hooking up. Froblems caused by runoff from D�odd Road, the fire hall and
ihe bank will be addressed by the new storm sewer system as well. Given the many ground
water problems in the azea, a new storm sewer might help lower the ground water levels and
therefore help in same si�zzations.
This $347,3{?0 pmject would be funded in three ways. The City bnfrasiructure
Reserve Fund would cover many of the costs of canverting to npgraded streets. $135,000 of
Lafrasixucture Funds would be allocaied taward this groject. A1so the cost of the storm sewer
improvements associated with runoff from the bank and fire hall area. would be covered by
the Starm Water Utility Fund.
. The remaining $20b,Q00 in project costs would be split evenly among the 59
properties. Every lot would pay the sam.e assessment, which would amannt ta approximately
$3,500 per household. T`hijs assessment could be paid up front or spread out vn the ta�c rolls
for a 19 year period. The average monthly payment over the 19 year period would be
appro�ci7mately $25.0{}. The early years would be more and the Iater years wauld be %ss.

DISCUSSION•
At it's November 16th meeting the Council directed staff to prepare a feasibility report
for reconstruction of the streets in just the Friendly Hills lst Addition. This report will look at
the design and cost for reconstiucting the lst Addition streets, installing storm sewer, financing
the project, and then will provide recommendations.
Streets
The streets in the lst Addition include Aztec, Creek, Fox and Hokah. There are 59
properties abutting these streets in the pmject area. The streets are 24 years old.
Reconstructing the lst addition streets to the standard 33 foot wide urban stseet should be easier
than maay of those in the 2nd and 3rd additions because most of the homes sit well above the
streets. The estimated cost to reconstruct the streets is $241,300.
Storm Sewer
Storm sewer will be installed to serve the entire neighborhood. It will include some
perforated pipe to help lower the groundwater in the area. The extta cost of the perforated pipe
is estimated to be $5,800. It is assumed that plastic pipe will be used throughout the pmject.
Also some 6" drain pipe will be included to allow for hookups to sump pumps. Some
improvements are also proposed to alleviate the drainage pmblems between the fire hall and the
bank parking lot. The cost of the storm impmvements, includi.ng $6,300 for the �'ire hall/bank
drainage repairs is estimated at $106,000.

In 1983, the City issued its multifamily housing revenue bonds to finance the acquisiti n and
construction of the above-referenced property. Those bonds were secured by a First B nk Letter
of Credit. In 1991 those bonds were refunded as variable rate demand obligations in o series

converting the existing bonds to long-term, fixed rate obligations which will be secu

Discussion of North Kensington Park
INTRODIICTION

In July 1991, City Council accepted a settlement des'gn for
the Kensington PUD and the Parks and Recreation Commissio began
the process for design and construction of Kensington Park. This
included a 12.9 acre park dedication. This settlement p�an was
based on criteria developed by City Council for an acceptab e plan.

that this park be designed in house by city staff without the use
of a�professional park consultant, based on our experience ' n other
park construction.
Throughout the Fall of 1991, the Parks and Re reation
Commission considered the design and use of both the no th and
south portions of Kensington Park. A consensus on the app opriate
use of the north park area was never achieved and cons ruction
proceeded on the south park soccer complex while it was de ermined

that the north area would be graded and seeded to await I
consideration on deaign and construction.
During the discussion on the appropriate use for t
park area, staff presented two concept designs. (P1
attached drawings of Concept A and Concept B.)
Concept A included a multi-use field, trails and
connections, play structure, backstop, hardcourt, parki.
picnic. Concept B was a more active proposal with tennis c
basketball court, landscaping and berming, horseshoe pits, �
lot and picnic shelter. Concept B was not a proposal to :
all these amenities, but merely an illustration of optior

As stated earlier, there was no consensus on the apprc
use of this park space and many ideas were generated duri

The park site is located south of Mendota Heights Road and is
bordered by townhomes under construction to the west and single
family homes to the east. The multifamily units are all est of
the power line corridor and the single family homes are east of the
powerline corridor.
It is anticipated that residents living east of Dodd R�
west of Delaware Avenue will be the primary users of th�
facility. This area includes the Bridgeview Shorea, Mendota
Putnam/Rottlund Homes, Brentwood Estates and Ken;
developments. The Copperfield and Hampshire neighborhoods �
included as primary users because of existing facilities an�
that• serve those areas, although they will be using
facilities as well.

The northwest corner is low and must remain so to acc�

East of this building a wooded hill ascends in o the
residential area. Only the west side of the slope is wit in the
park. Going south, the topography rises to a high point mid ay and
then descends into the south area of the park. The ma.jorit of the
park area was graded and seeded. It is currently being mo ed and
maintained in this condition.
Visual Impacts
The dominate negative feature in the park is the N rthern
States Power high lines along the western boundary extendi g from
Mendota Heights Road into the corridor and south park area.
Mendota Heights Road is at a higher elevation than the p rk and
will look down into the park area. This park will be bord red by
residential development which will contain a mixture of ew and
mature vegetation.

We have received notice from the Dakota County Assessi
the need to schedule the 1994 Board of Review meeting. ThE
Assessor has suggested that the meeting be conducted at 7:(

DISCUSSION
Assistant Assessor Bill Peterson has informed us that
valuations throughout the city will increase from 4o to 5�
across-the-board increase may result in greater meeting
attendance than has occurred in the past few years. It is
anticipated, however, that many property owners will attenc

While the turn-out may be larger than in the recent
half an hour should provide sufficient time both for the
Assessor's presentation and his response to Council and

Hall for the Assessor's staff to meet individually with

Re-Scheduling of March 1 Council Meeting
DISCQSSION
At our last Council meeting we briefly discussed the ;
reschedule our Council meeting planned for March 1, 1994,
meeting conflicts with Statewide political caucus meetir
according to State Statute, public bodies may not hold m
after 6:00 P.M. that night.
Originally staff has suggested Wednesday, March 2nd
preferred alternative date for the Council meeting. This c
not workable for Councilmember Huber as it conflicted
meeting of the Northern Dakota County Cable Commun�
Commission. Since two Councilmembers were not in attendana
