CASE NO. 93-29, STARY Mr. & Mrs. Frank Stary were present approval of a six foot front yard s variance to allow construction of a one-car garage at 983 Diego Lane. Mayor Mertensotto informed the audien the Starys would like to convert thei existing attached garage into living and add a single car garage. He stat because of the configuration of the 1 the existing setback of the house fro street, the proposed garage would not noticeable. He asked Mr. Stary about nd Sun city's th an South- ht and the tne entire ies are ions in erence in he Sun at the Review request that d that t and the be the Page No. 3882 January 4, 1994 building materials and why he proposes only a single car garage. Mr. Stary responded that the size proposed is the maximum size that can be built on the lot and stated that the exterior of the garage will match the house. Councilmember Smith stated that she feels it is appropriate to grant a one-car garage and the setback variance because the right-of-way is so great in the area and there is little chance of a change in the future. Councilmember Smith moved to approve a six foot side setback variance to allow construction of a single car garage at 983 Diego Lane as proposed. Councilmember Huber seconded the motion. Ayes: 3 Nays: 0 CASE NO. 93-30, EFH Mr. Gene Happe, from EFH Companies, was present to request approval of a 50 foot front yard setback variance to allow construction of a building for the Red Cross on Lots 2 and 3, Block 2, Northland Plaza Addition, fifty feet from the right-of-way for T.H. 55, along with a parking lot setback variance and proof of parking variance. Mr. Happe gave a history of the proposed project, explaining that five contractors bidding on the project were required to find a site no more than 10 miles from the airport. He stated that he looked at several sites in Eagan, Mendota Heights and Apple Valley, and that the Red Cross representatives selected the Northland Plaza site. He informed Council that he had looked at the lot next to the Turner's Gymnasium site and also Lot 1 of the Northland Plaza Addition, but neither site was large enough. Mr. Happe explained that a variance is requested because the city's Zoning Ordinance requires a 100 foot setback from a major highway, and the site is adjacent to Highway 55. He informed Council that in order to build the type of building that the Red Cross needs, 120 by 205 feet, a 50 foot front yard setback variance is needed. Mr. Happe stated that the two lots have been certified to the state as tax forfeit and can be redeemed by 4 Page No. 3 83 January 4, 1994 February - the back taxes and asses total $70,000. Mayor Mertensotto stated that he app the concern that the City would pick years of back taxes and assessments, that since the Red Cross is exempt t be no further real estate tax paid o. if the structure is built. He expre concern over land use for the site, that when the property was zoned B-3 intended use was as a service site f industrial park. He stated that if application is approved, Council wou essentially changing the development for this part of the T.H. 55 corrido would set a precedent for setbacks a corridor. He stated that he would 1 have the Red Cross facility in Mendo but would prefer to help them find a site in the city. Mr. Happe showed aerial photos, and that the subject property and the Ai Motel are the only two sites on the corridor which have a 100 foot setba felt that it makes no sense that onl sites maintain the setback. He also out that on the two lots Red Cross i at, the building design is long and that because of a necessary gas line Lot 3 is unbuildable on its own. Mayor Mertensotto responded that the area on Lot 3 could be blacktopped a for parking. He stated that he beli land was zoned B-3 so that it could : service area and that it bothers him the haste for this project Council m getting involved in granting a varia a service use should go. He did not Council should bind itself to less t: foot setback in the B-3 area because precedent which would be set and tha hopefully, an eating facility, bank station would locate on B-3 zoned pr Assistant Batchelder reviewed drawin existing land uses in the T.H. 55 co the zoning in the corridor. He then platting and rezoning of the site. explained that the property was zone with the idea of providing business for the area, including motor fuel a ciates p f ive ut noted xe would the lots ed plaining its the d be concept and ong the ke to a Heights different tated liner '.H. 55 k and those pointed looking arrow and setback, easement d used ves the e a that in ght be ce where feel that an a 100 of the service erty. s of ridor and gave the to B-3 pport two i Page No. 3884 January 4, 1994 restaurants. He stated that a hotel had been originally planned by the developer for the lot across from the subject property. Mr. Happe responded that the Red Cross is under a federal mandate to have a building in operation by September 1 and there are very few sites in Eagan and Mendota Heights that can be built on - he explained that all vacant lots in Eagan are platted as outlots and the platting process takes three to .four months. He informed Council that in order to meet the mandate, a building shell must be up no later than March 15. He stated that removal of about 30 feet of uncontrolled fill on the lots to the south would be very costly. He felt that the practical use of the Northland Plaza lots being considered is not very good and that the Red Cross use fits the zoning. He felt that since the lots can be used for little else, a variance is justifiable. Mayor Mertensotto responded that Council should take a comprehensive view of what the property could be used for. He noted that one of the Planning Commissionmembers felt that approving the application would be much like rezoning the property. He explained that the basic reason for the 100 foot setback is to allow flexibility, and stated that once properties are stacked close to the right-of- way, the potential for transportation changes, such as additional turn lanes, etc. are lost. He pointed out the access problems at the Fischer gas station and old fire station caused by their proximity to the right-of-way. Mayor Mertensotto stated that while he is sympathetic to the Red Cross, Council cannot make a snap judgment when the property has been planned as a service use for many years. He further stated that because of the extra height that Red Cross needs for the building, it is very much like an industrial building. Mr. Happe responded that the proposed building would be 18 feet tall with a four foot high parapet to screen roof-top units. He stated that he feels the use fits the zoning. Mr. Doug Carney, representing the owner of the land, stated that he understands Council's concerns over setting a precedent, but suggested that Council first look at the Page No. 3 January 4, building as a permitted use and then the setback. He explained that ther elevation difference from the road b limited access from the freeway, whi eliminates the concern over creating problems. He did not think that the fifty foot setback would affect aest stated that there are many cases of setbacks along the highway now which affect the flexibility of changes fo. highway in the future, and felt that makes any change in the future, the : likely would be to move the highway other direction. He felt that the s would be handsome, and an asset to t: corridor. He stated that if Council the ideal service use, it could end much less attractive package than wh being requested. With respect to pr he stated that he agrees with a 100 : setback for the property to the nortl site and will not come back asking f foot setback on that property. He f since the Red Cross site has control: to the highway, a fifty foot setback impact traffic. He also felt that d of the lots by the Red Cross would m other B-3 sites more desirable for s uses. 5 994 ook at is an and safety etics. Mr. Happe responded that the appeara ce of the building will be the same as the Bat sville structure and that there will be no oading dock. The garage door that was origi ally proposed for the south side has been moved to the east end. Mayor Mertensotto stated that the P1 pointed out in his report that 100 f reasonable setback for service-type stated that the applicant has select service site that was set up as part industrial park. He pointed out tha Properties held its property in the park for many years before developin never missed property tax or assessm payments. He stated that he would h effectively change the site from B-3 industrial use, further stating that proposed building does not have the of an office building. He explained r had is a . He a a of the United ndustrial it, and nt te to to the ppearance that he Page No. 3886 January 4, 1994 believes Council fully understands what the applicants are trying to do but must make a judgement based on future development of the highway corridor. He stated that in his judgment Council should not give up the flexibility that the 100 foot setback provides, but if the applicants could meet the setback he would have no objection. Attorney Hart stated that as the City Planner mentioned in his memo, as a condition to granting a variance, the city must determine that this particular site presents a reasonable hardship for any development. He further stated that Council must.find that the hardship is related to the site, and not the specific development proposed for the site. Mayor Mertensotto also referenced the planning report with respect to consistency of maintaining a 100 foot setback. Councilmember Smith stated that when she looks at a change in use, she always tries to look at the long term. She further stated that while there have been instances cited where buildings are currently closer than 100 feet, perhaps some of those uses are temporary and in the long-term future will have a different type of use. She informed the applicants that Council has designated in its goals for the year looking at the entire T.H. 55 corridor to ensure that development takes place with the needs of the community in mind. She felt that the timing of the application is very unfortunate because Council has not yet had a chance to review the entire corridor. She asked about the site adjacent to the Turner's facility and whether the proposed building is a prototype. Mr. Happe responded that the lot south of Turner's is two acres and while he tried everything he could to get the site to work, he could not fit the building on it given setbacks and a gas line easement. He informed Council that there are currently 52 Red Cross testing labs across the country which must be replaced by 11 facilities. He explained that an injunction issued in July gives the Red Cross until September to get four labs operating and the remaining seven must be built by some time in 1995. Ayes: 3 Nays: 0 Page No. 38 7 January 4, 994 Mayor Mertensotto stated that while like to be cooperative with the Red approval of the application would r major change. There being no further discussion, Councilmember Smith moved to deny t application as relates to the fifty setback with regret. Job No. 9222A Improvement No. 92, Project No. 6A Dear Mr. Cemey: At the November 16th Council meeting, the City Council decided to hold off on the entire'Friendly Gills street project and instead focus on just the Frienclly Hills 1st Additi.on. A feasibility study on the Friendly Hills lst Additi.on has been completed and reviewed by the Council. The next step is to hold a public he,aring. On 3anuary 1$, 1994, at 1.45 P.M., a hearing is scheduled to discuss this project. You aze encouraged ta attend. There are 59 homes in the 1 st Addition and the streetS involved are Creek, Fox, Hokah and Aztec. The eurrent proposal would involve reconstructing all the streets with storm . sewer, curb and gutter, and new blacktop. Storm Sewer wi11 be installed throughout most af the area.. A1so aun underground drai.n system will be inst.alled in some areas so homes with excessive sump pump discharge will have the option af hooking up. Froblems caused by runoff from Dodd Road, the fire hall and ihe bank will be addressed by the new storm sewer system as well. Given the many ground water problems in the azea, a new storm sewer might help lower the ground water levels and therefore help in same sizzations. This $347,3{?0 pmject would be funded in three ways. The City bnfrasiructure Reserve Fund would cover many of the costs of canverting to npgraded streets. $135,000 of Lafrasixucture Funds would be allocaied taward this groject. A1so the cost of the storm sewer improvements associated with runoff from the bank and fire hall area. would be covered by the Starm Water Utility Fund. . The remaining $20b,Q00 in project costs would be split evenly among the 59 properties. Every lot would pay the sam.e assessment, which would amannt ta approximately $3,500 per household. T`hijs assessment could be paid up front or spread out vn the tac rolls for a 19 year period. The average monthly payment over the 19 year period would be approci7mately $25.0{}. City Engi.neer Feasibility Report for Friendly Hills lst Addition Job No. 9221A Improvement No. 92, Project No. 6A DISCUSSION• At it's November 16th meeting the Council directed staff to prepare a feasibility report for reconstruction of the streets in just the Friendly Hills lst Addition. This report will look at the design and cost for reconstiucting the lst Addition streets, installing storm sewer, financing the project, and then will provide recommendations. Streets The streets in the lst Addition include Aztec, Creek, Fox and Hokah. There are 59 properties abutting these streets in the pmject area. The streets are 24 years old. Reconstructing the lst addition streets to the standard 33 foot wide urban stseet should be easier than maay of those in the 2nd and 3rd additions because most of the homes sit well above the streets. The estimated cost to reconstruct the streets is $241,300. Storm Sewer Storm sewer will be installed to serve the entire neighborhood. It will include some perforated pipe to help lower the groundwater in the area. The extta cost of the perforated pipe is estimated to be $5,800. It is assumed that plastic pipe will be used throughout the pmject. Also some 6" drain pipe will be included to allow for hookups to sump pumps. Some improvements are also proposed to alleviate the drainage pmblems between the fire hall and the bank parking lot. The cost of the storm impmvements, includi.ng $6,300 for the 'ire hall/bank drainage repairs is estimated at $106,000. The total pmject costs are summarized below: Item Street Reconstruction Basic 5torm Sewer Extra for Perforated Pipe Bank/Fire Hall Drai.nage Cost $241,300.00 93,900.00 5,8Q0.00 6, 300.00 TOTAL $347,300.00 .: nancin . SOUTHEAST AREA PARKS Friendly Hills, Hagstram-King, Kensingtan (north & south) • i To: From: Subj ect : CITY OF MENDOTA HIGHTS i • November 5, 1993 Parks and Recreation Commission Kevin Batchelder, Administrative Assis Discussion of North Kensington Park INTRODIICTION At the October 12, 1993 meeting, the Park and Rec Commission began discussions about possible development o Kensington Park. During the 1991/1992 winter the decision h made to grade the area, seed for grass and wait for resi development to dictate the future use of the park. The Co asked staff to review the old concept plans and provide bac information on the area at Tuesday night's meeting. ation North been ntial ssion The Commission felt that the discussion on desi n and construction of this park should continue and that concepts should be discussed and determined prior to presentation to the pu lic for their input. . In July 1991, City Council accepted a settlement des'gn for the Kensington PUD and the Parks and Recreation Commissio began the process for design and construction of Kensington Park. This included a 12.9 acre park dedication. This settlement pan was based on criteria developed by City Council for an acceptab e plan. The criteria list presented to the developer a criteria for parks that stated that the northern park are include the existing comfort station and was to be of su: size to include a tot lot, a dimensioned area for a practice soccer field, and amenities. At the time, the no: area was intended to accommodate typical neighborhood park E although specific design elements were to be determined Parks and Recreation Commission. itained was to `icient ssible :h park .ements by the In August of 1991, the City Council approved a recomm dation that this park be designed in house by city staff without the use of aprofessional park consultant, based on our experience ' n other park construction. Throughout the Fall of 1991, the Parks and Re reation Commission considered the design and use of both the no th and south portions of Kensington Park. A consensus on the app opriate use of the north park area was never achieved and cons ruction proceeded on the south park soccer complex while it was de ermined that the north area would be graded and seeded to await I consideration on deaign and construction. During the discussion on the appropriate use for t park area, staff presented two concept designs. (P1 attached drawings of Concept A and Concept B.) Concept A included a multi-use field, trails and connections, play structure, backstop, hardcourt, parki. picnic. Concept B was a more active proposal with tennis c basketball court, landscaping and berming, horseshoe pits, lot and picnic shelter. Concept B was not a proposal to : all these amenities, but merely an illustration of optior could be included in this park. As stated earlier, there was no consensus on the apprc use of this park space and many ideas were generated duri discussion. This included the inclusion of Hagstrom-King P consideration as a site for some of the;ideas that were gene particularly tennis and volleyball for which Hagstrom-King P been graded. During the discussion, it was also fel Hagstrom-King Park was more appropriate for "green" uses as more natural amenities. (Please see attached map of Hagstrc Park.) RENSINGTON PARR Service Area The available 12.9 acres of park land is split into acre south park and a 4.4 acre north park area. The multifamily units are all est of the power line corridor and the single family homes are east of the powerline corridor. It is anticipated that residents living east of Dodd R west of Delaware Avenue will be the primary users of th facility. This area includes the Bridgeview Shorea, Mendota Putnam/Rottlund Homes, Brentwood Estates and Ken; developments. The Copperfield and Hampshire neighborhoods included as primary users because of existing facilities an that• serve those areas, although they will be using facilities as well. Going south, the topography rises to a high point mid ay and then descends into the south area of the park. The ma.jorit of the park area was graded and seeded. It is currently being mo ed and maintained in this condition. Visual Impacts The dominate negative feature in the park is the N rthern States Power high lines along the western boundary extendi g from Mendota Heights Road into the corridor and south park area. Mendota Heights Road is at a higher elevation than the p rk and will look down into the park area. This park will be bord red by residential development which will contain a mixture of ew and mature vegetation. ACTION RE4IIIRED •Staff will be prepared to provide a presentation wit large scale maps of the existing park area, Hagstrom-Ring Park nd the old concept plans on Tuesday evening. 2 recommend that th Parks and Recreation Commission: 1. Given the n maj or engineering proj ecta either underway or on the horizc essential that we replace Klayton as soon as possible. Attached please find a memo from Public Works Dire Danielson outlining the current staffingsituation wit Engineering Department, and preaenting his recommendation r Rlayton's replacement. Jim recommenda that our currei Engineer I, Shawn Sanders, be promoted to handle some of K duties, and that our current part time F3ngineering Tec Chris Arlandson, be promoted to full time Civil Engineer I graduation from the University of Minnesota this spr: recommend that formal action related to Chris' emplo deferred until this spring. The balance of this memo will Shawn's recommended promotion. As stated in Jim's memo, Shawn has been with t approximately 3 1/2 years and has been closely involved w: of the major engineering projects currently under consider construction. Shawn holds a Bachelor of Science Degree : Engineering from South Dakota School of Mines and Techno: plans to sit for the Professional Engineer's Certification October of 1994. As described in Jims memo, Rlayton was s: qualified when he started with the City and was classifiec Grade XXIV of the City's employee position and placem classification system upon hiring. It is recommended similarly hired at Pay Grade XXN, Step A with the tit] Engineer II and a atarting salary of $33,617. The City Engineering eepartment cunenfly has seven members as follows very brief job description): 1. T options: 1. Iiire a replacement from the outside. 2. Promote from within. My recommendation is that we promote Shawn Sanders into Klayton's po Klayton's salary is similar to other assistant city engineers in the area and I think extremely unlikely that any of them would be willing to leave their existing positi Mendota Heights. This means that younger engineers from consulting firms or r school would probably be the most likely candidates. Shawn has been with the C three years now and has done an excellent job. I feel that it is time that his resp increased and that he could most effectively handle the duties of Assistant City E Shawn has been working very closely with Klayton on all the on going City would need little or no training in his new position. I would also recommend promoting Chris Arlandson from part-time E Techiucian to Shawn°s position once he has graduated from the LTniversity of springe I recognize that this plan will mean that, during the transition for the next will have to devote more time and become more involved in the Engineering Dep operation. PAY CONSIDERATIONS Shawn Sanders When Klayton was first brought into the City's pay matrix he was not a reg engineer and was somewhae untrained. It was agreed at the time, that although his classification for Assistant City Engineer was at a Grade XX, he would begia his the Senior Technician pay level of XXIV.
