1994 Amendment to Joint Powers Agreement for

At the September 21, 1993 City Council meeting,
approved Resolution No. 93-57, seeking funds from Dakota �
Landfill Abatement Program in the amount of $7,006 for sol
abatement in 1994. (Please see attached resolution.) The

SECOND AMENDMENT TO 1992 JOINT POWERS AGREEMENT
BETWEEN DAROTA COIINTY AND
THE CITY OF MENDOTA HEIGHTS FOR
1994 LANDFILL ABATEMENT FIINDS
This Agreement is between Dakota County (hereinafter "C unty") and
the City of Mendota Heights (hereinafter "Municipality"), th ough their
Board and Council, respectively.
AHEREAS, effective January 1, 1992, the County and the
municipality entered into a Joint Powers Agreement ( ereinafter
"Agreement") in order to provide for cooperatiori between the County and
the Municipality to implement and operate a local comprehens ve
landfill abatement program; and
WHEREAS, the Agreement was in effect from January 1, 19 2; and
WHEREAS, the First Amendment to this Agreement was exec ted in
December, 1992 to provide.Landfill Abatement Funds for 1993; and
WHEREAS, on June 29, 1993, by Resolution No. 93-558 , the Dakota
County Board of Commissioners adopted its Community Abatem nt Funding
Program Guidelines; and
WHEREAS, on November 2, 1993, by Resolution No. 93-872, the Dakota
County Board of Commissioners approved the 1994 Communi y Funding
requests for abatement activities in 1994; and
WHEREAS, the parties wish to amend the Agreement o provide
funding for 1994 to enable both parties to continue to enjoy the mutual
benefits it provides; and
WHEREAS, Paragraph 18 of the Agreement provides that any
amendments, alterations, variations, modifications, or waive s shall be
valid only when reduced to writing duly signed by the partie .
NOW, THEREFORE, in consideration of the mutual covenan
herein, the parties agree that the Agreement is hereby

SUBJECT: Designation of Official Newspaper
INFORMATION
As part of the annual meeting, Council is required
designate an official city newspaper for the year. Only
Lillie Suburban Newspapers (South-West Review) submitted
request for official designation.
DISCUSSION
The South-West Review is the official newspaper for
the northern Dakota County communities and is widely dis
in Mendota Heights. Although the Sun Current has been t:
official newspaper for many years, they apparently have
not to request official designation for 1994.
The Review staff have been very cooperative in publi
press releases. Coverage given to Mendota Heights City Co
meetings has been as extensive as that given by the Sun -
Review's local reporter is actually present at more Counc
meetings than the Sun's reporter. The rates quoted in th
attached letter from Lillie Suburban Newspapers for legal
publication is less than half of the rate charged by the
Current for 1993. Based on these facts, I feel that the

newspaper. When the memo was written, we had anly recei
request for designation from the Review. Late Thursday
afternoon, we received the attached letter fram the Minn
Publications.
RECQMMENDATIQN
Although the Sun has been the city's official paper �
yearsr S continue to recommend designation af �he South-We
Review. This recommendation is based on the facts discuss
my December 29 memo. Those facts are: the Review's rate i
approximately half of that charged by the Sun; a Review re
is fairly regularly in attendance at Council meetings, whe
the Sun reporter generally con�acts city staff for informa
phone after the meetings; the Review's coverage of Mendota
Heights is as extensive as the Sun's and it has been very

platted with a large radius curve at the intersectian with a street island splitting the two tra el lanes an

leaving a lazge distance of up to 34 feet between the street and the Starry property line.

4.18(4) requires that a two-car garage with a minimum of 440 square feet be built concu�

Cross as a developer for their proposal to build a 24,600
foot office/blood testing laboratory on Lots 2 and 3 of B
Northland Plaza Addition. This proposal is a permitted us
B-3 District, however, due to the setback requirement alon
thoroughfares within the B-3 Zone and the narrow lot, a vari�

The amount of landscaping was the condition that c used a
split vote on the Planning Commission. A landscape p an was
submitted for Commission review and some Commissioners elt it

Building Permit
In addition to the review of the requested variances by the
Planning Commission, the City Council needs to consider aut orizing
the issuance of a building permit. City Council revi ws all
exterior building permit requests in the "B" and "I" Zone
For this review, there are the site plans submitted for the
variance requests and additional grading, signage, landsca ing and
lighting plans that are provided for your review.
RECObIlKENDATION
The Planning Commission voted 4-2 (Nayss Tilsen and Duggan)
to close the public hearing. One motion to deny the r quested
variances failed and two motions to approve the varia ces as
requested failed. The Planning Commission voted unanimous y(6-0)
to forward this request to City Council without a recomme dation.
ACTION REQIIIRED

Mr. Gene Happy has been chosen by the American Red Cross to develop a regional blood ting
laboratory on two of the MIST lots along Highway 55 in Mendota Heights. Mr. Happe de eloped the
Batesville Casket building which is close by at Highway 55 and Mendota Heights Road. e proposed
building is approximately 25,000 squaze feet and will employ up to 80 employees in a labo atory/office
setting.
The American Red Cross has chosen Mendota Heights due to its close proximity to the a' rt. The
American Red� Cross cunenfly has SO labs in the U.S. that they desire to consolidate into t regional
labs with the Mendota Heights lab serving the upper midwest area.
Currently, the American Red Cross is located in St. Paul. The City of St. Paul did not des e to lose
this employer and has been attempting to convince the Red Cross to remain in St. Paul. Th available
sites in St. Paul are contaminated and the Red Cross is not interested in these properties. is has led
to a last minute application in the City of Mendota Heights for a building-setback variance �nd proof of
parking. �
The building will house specialized computer blood testing stations in approximately one-h f of the
building. The rest of the building will be used for support facilities, loading, trash handlin and offices.
The blood samples aze brought to the facility in vans and are packed in small vials shipped y air and
received at the airport. After these blaod samples aze tested, the remains are packaged as b o-hazardo�
waste and picked up by a medical waste disposal firm.

The two pazcels that are being developed by the proposed American Red Cross facility c
excellent potential for support businesses once the Mendota Bridge is completed and the
again flows on Highway 55.
The Business Zone B-3 requires a 100-faot setback from a major thoroughfare, such as Tru
55, which reduces the buildable portion of the site to a building width of only 70 feet. The
requesting a variance from this 100-foot setback so that a 120-foot building can be built. T
zone along Highway 55 to the north also requires a 100-foot front yard. It should be noted
zoned industrial, B-2 or B-4 would not require the 100-foot setback. Although there is no �
of why exact dimensions were decided upon in the Ciry Ordinance, other communities requ
additional setback along major thoroughfares. The idea is to maintain a spacious appearanc
attractive front door along major thoroughfares, which are really the gateway systems to thE
communiry. If it decided that the 100 feet should be varied from, than the ordinance ought 1
reviewed by the City for compatibility with future development in the City. There should t
consistency in the zoning ordinance with respect to setbacks along thoroughfares which, toc
exist.
The applicant is proposing a 50-foot setback versus a 100-foot setback. The applicant is
praof of pazking and is only building that which is required for the 80 employees. A bu
size would normally require 124 pazking stalls when calculated as an office use.
The variance requires a public hearing and notices have been sent by Ciry Staff to the
property owners.
Variance Request
The vaziance needs to show an undue hazdship and that the property cannot be put to reaso
because of that hardship. These should be circumstances unique to the property and, if gra
not alter the essential character of the neighborhood. The character of the neighborhood is
at this point with other properties that are undeveloped. It is important to decide what that
neighborhood is going to be and what an appropriate setback should be along Highway 55.
The traveled portion of Highway 55 is approximately 100 feet from the property line of the
Red Cross proposed faciliry. This extra width of right-of-way is unusual for this stretch, bu
maintained by the Highway Department and can be used in the future for highway improvei

The building is proposed to be 50 feet from the right-of-way due to the width of the bu

In reviewing the vaziance, the request cannot merely serve as a convenience to the applic,

uses. Should the City decide to grant a variance, they may propose conditions and safegu
variance to make sure that'the public health, safety and welfare is being protected. These
may include architectural performance for aesthetic compatibility and significant landscap

Proof of Parking
At the time of this writing, I have not seen the final set of drawings that were discussed at
meeting with the applicant. A proof-of-parking plan will be presented for the Planning Cc
review. Pazking will be provided for the employees, with open space left for future expan:
compact parking should the faciliry change use. All the landscaping, screening and bermin
put in place in anticipation of full expansion of pazking. The parking lot must also have tt
percent landscaped area inside the parking area with full screening from all of the perimetE
date, a finalized landscape plan has not been submitted for review. What has been submittE
more screening along the perimeter edges, especially with the use of evergreen material to
address the building facade and loading areas.
The proof of parking is a reasonable request for this specialized use. I am anticipating
plans will perform as promised, with appropriate setbacks and screening.
Building Architecture
The building generally matches the material used with the Batesville faciliry to the north.

Re: American Red Cross Proposal
Ladies & Gentlemen:
We have today submitted plans for a proposed Amer
Red Cross National Testing Laboratory to be located on
Northland Drive and Mendota Heights Road.
It has come to our attention during the planning pr cess
that the subject property has three frontages with varyi g
degrees of setbacks. As a result, a lot having a depth f
201 ft. has a total building area of only 70 ft. We are in
need of a building having a miminal dimension of 120' an
205' in length. Using the normal setbacks, this buildin
could normally be built on a 2.1 acre site. Because of
100' setback for properties adjacent to a major thorough
the desired building can not be built without a variance
the setback ordinances. With this 100'setback, very few
buildings could be built on any of the three lots adjoin
Highway 55. Because of this apparent conflict in the
ordinances, we are requesting a variance to allow for a
normal 30' rear yard setback rather than the 100' adjace
a major roadway. It should be noted that a large right
way does exist between the actual roadway of Highway 55

The Red Cross presently has 50 small labs across the cou try
and is replacing these labs with 10 larger facilities. he
lab will employ 80 technical employees at the new facili y
which must be tested and fully operational by September ,
1994. The shell building must be ready for interior
improvements by approximately March 1, 1994.
The proposed building requires an 18' clear height
ceiling to allow for extensive air handling equipment n
for the cooling of several pieces of computer testing
equipment. As a result, the proposed building will be
constructed of a panel identical to the Batesville Cask

interfering with the operation. Because of the Federal
mandate to have the building and staff in place by Sept
1, 1994, we are requesting a shell only building permit
