PUBLIC COMMENTS Mrs. Elizabeth Plummer, 605 Garden Lane,
presented Council with a petition from her
neighborhood asking Council to refuse to allow
a 68' antenna radio tower on the Pentel
property, 556 Fremont Avenue. She urged
Council to maintain the language in the Zoning
Ordinance and not grant a variance to Ms.
Pentel.
Mayor Mertensotto informed the audience that
since the last Council meeting, Council has
heard from the 8th Circuit Court of Appeals on
the Pentel litigation. He stated that Council
had denied Ms. Pentel's variance request but
had granted a special use permit to allow her
to maintain an existing 55 foot whip antenna
on her house. He stated that the Federal
District Court upheld Council's action but the
Court of Appeals felt that it was not within
the federal mandate and reversed the District
Court. The Appeals Court referred the matter
to the city to work out an agreement with the
property owner. He informed the audience that
Council will meet with its legal counsel in
closed session immediately following
adjournment of this evening's regular meeting
to discuss legal options and strategies.
Mr. Ken Kasheimer, 568 Fremont, stated that
the neighborhood residents were very
disappointed with the ruling and felt that
matter had been solved. He stated that the
whole neighborhood is against allowing the
antenna, commenting that Ms. Pentel does not
use the ham radio for a job but rather for a
hobby. He felt that the Pentel lot is too
small to accommodate the antenna without
infringing on another property.
Mayor Mertensotto responded that the lot sizes
in the neighborhood were a part of Council's
consideration in den�ing the Pentel
application. He informed the audience that
the city spent $25,000 to $30,000 on the
defense of the case and will consider options
at the closed session. He stated that the

court is trying to balance policing owers and
the federal concern to permit amateu radios.
He expressed appreciation for the ne'ghborhood
concerns.

Mayor Mertensotto stated that according to the
planning report and Commission minutes, the
home sits on the rear of the lot and on the
high point of the lot. He further stated that
it appears that the house is set back about
150 feet. He asked Mr. Wandschneider if he
has any plans to enlarge the structure.
Mr. Wandschneider responded that he plans to
put an addition on the house and possibly add
a garage in the future, but that he has no
plans to enlarge the proposed accessory
structure.
Mayor Mertensotto stated that a variance would
run with the property, and suggested that
Council instead consider granting a
conditional use permit which would permit a
144 square foot accessory structure to be
located in front of the principle structure.
He felt that this would give Council more
control, because if Mr. Wandschneider were to
sell the property in the future, the
subsequent owner would that since a variance
had been granted he could enlarge the
structure. He suggested that an additional
condition of approval be stipulated - that in
the event the structure were to be damaged to
more than 50� of its value, or if there were
an attempt to enlarge its size, the
conditional use permit would terminate.
Mr. Wandschneider responded that he has no
objection to the proposed condition.
Councilmember Smith stated that she would
prefer that the structure blend in with the
house rather than with the landscaping and
also suggested that landscaping be added on
the side that faces the adjacent home.
Mr. Wandschneider explained that there is a
line of very big trees between his property
and the neighbor's.
Councilmember Krebsbach moved to direct to
prepare the appropriate resolution to approve
a conditional use permit to allow a 144 square

Public Works Director Danielson stated that
there are two lots involved and the applicant
will request a vacation of the utility
easement that runs on the lot line between the
lots. The applicant proposes to relocate the
water line and the hydrant to a location which
will be�determined by the city's fire marshal.
Mr. Hudson informed Council that he will pay
for the cost of relocating the hydrant and the
water line needed to serve it.
Mr. Kilstofte informed Council that parking
will be provided at the front of the warehouse
and that truck loading docks will also be at
the front of the addition, similar to the
existing warehouse. He stated in order to
handle drainage at the rear of the site catch
basins and a manhole will be installed in the
easement area, and that a ponding area will be
created. He informed Council that the
existing line of pine trees will be retained
and that a landscaping plan has been submitted
to show the additional landscaping which will
be provided.
Mayor Mertensotto asked if Mn/DOT has reviewed
the drainage plan.
Public Works Director Danielson responded that
city staff has reviewed the plan and that it
will be submitted to Mn/DOT for approval.
Mayor Mertensotto asked if the rear of the
building will be visible from new Highway 13
and what it will look like.
Mr. Hudson responded that it will likely be
visible after the woodpiles are removed from
the McNeill property. Mr. Kilstofte showed
Council a drawing of the front of the
building, which faces existing T.H. 13, and
stated that the rear of the structure will
match the white face and decoration used on
the front and will have the company logo but
no signage. He explained that the rear of the
structure will be finished essentially the
same as the front of the facility.
Councilmember Krebsbach stated that she would
like to see more landscaping to screen to the
east (rear) of the building.

Mr. Hudson informed Council that he
anticipates putting the addition into
operation by July 1.
Councilmember Huber asked how many trips will
be made in and out of the site when the new
facility is completed.
Mr. Hudson responded that the add�ition will
primarily be used for long-term storage of
frozen products, and that while he does not
know exactly how many new trips there will be
he did not anticipate there will be much
impact on traffic.
Councilmember Huber stated that he is
concerned about whether additional signage
will be needed on T.H. 13 to alert traffic on
the highway that trucks will be entering and
leaving the site.
Public Works Director Danielson responded that
since T.H. 13 is a state highway, signage is
out of the city's jurisdiction but that he
will bring the matter to Mn/DOT's attention.
Councilmember Krebsbach stated that she would
appreciate it if Mr. Hudson will encourage the
truck traffic not to use T.H. 110 if possible.
Mr. Hudson responded that he would do so, and
that he currently tells the drivers to come to
the site from I-494.
Councilmember Smith stated that there will be
much additional impervious surface with the
addition and asked if the ponding area is
sufficient to handle drainage so that it does
not become a problem.
Public Works Director Danielson responded that
staff is currently studying the drainage and
that the applicant will need a permit for
Mn/DOT before doing any grading on T.H. 13
right-of-way.
Mayor Mertensotto expressed concern over
lighting and advised Mr. Hudson to provide
lighting which will not extend a distance from
the site or create a."sky glow."
Councilmember Krebsbach moved approval of a 10

Mayor Mertensotto stated that it is bvious
from the report that the recommended painting
and repairs must be done, at an esti ated cost
of $600,000. He stated that it has nly been
14 years since the tower was constru ted and
that he hopes it will be at least 20 years
before repairs are again needed. He informed

Mr. Kolmer that the panels on the outside of
the tank are not for decorative purposes but
are there to prevent buckling of the tank
panels.
Mr. Kolmer responded that he is aware of the
history of the tank and the decorative panels
and that the cost of tank painting will be
substantially increased because of the panels.
Councilmember Krebsbach questioned the
original quality of the tank. She stated that
the report indicated that if there had
originally been a proper internal coating the
tank might have held up better, but noted that
while it was stated that a cathotic protection
system would provide better protection it has
not been included in the bid.
Mr. Kolmer responded that the coating proposed
will do what is needed but that a cathotic
system would be better. He explained that the
initial coating failed before its time and if
it had been properly installed should have

that a cathotic system would add about $15,000
to the estimated cost of the repairs and would
add to the cost of maintenance.
Councilmember Krebsbach stated that since the
tank is troublesome, she feels that the
cathotic system should be installed.
Mr. Kolmer responded that the cathotic system
would need to be inspected and system
components would need replacement every five
years at an approximate cost of $3,000 to
$4,000, and it is possible that coating
maintenance would also be needed at the same
time.
Mayor Mertensotto stated that he questions
what benefit a cathotic protection system
would provide since the water provided by the
St. Paul Water Department is treated. He
further stated that he suspects that the tank
corrosion occurred before the tank was put
into operation. He noted that cathotic
protection can be included as a bid option.
Public Works Director Daneilson stated that he
will contact St. Paul Water to see whether it
uses cathotic protection in its tanks.

Burnsville that has buckles in its top three
tiers, and stated that the Mendota Heights

view the tank, and stated that he would be
happy to give an estimate, at no additional
cost to the city, for removal of the panels.
Mayor Mertensotto asked if there is any cost
added to the project because of the U.S. West
antennas located on the tower. Mr. Kolmer
responded that there is little added cost.
Administrator Lawell informed Council that the
contract with U.S. West stipulates that it
must bear the cost.
Mayor Mertensotto asked Mr. Kolmer to provide

protection. He asked about the projected
timetable for the project.
Mr. Kolmer responded that he recommends that
the work be done in the spring of 1995, which
would take the tank out of service in April or
May. He explained that hiring an engineering
firm and letting the bids would need to be
done in late summer, 1994.
Mayor Mertensotto expressed concern that the
tank not be out of service during the summer
months when there is the greatest potential
need for water for fire fighting purposes. He
asked Mr. Kolmer to keep Council informed and
stated that the Council will view the
Burnsville tank and ask staff to gather
information on St. Paul's use of cathotic
protection.

Grove does not charge any fees, and that while
he could have asked Maple Grove to do the
issuing, he cannot do so now because he does
not have enough time.
Mayor Mertensotto stated that the city
resolution referred to by Mr. Riley states
that a schedule-based fee will be charged in
consideration of the city acting as a
financing conduit for the issuance of bonds.
He pointed out that this will be a new bond
issue and stated that in the absence of any
record (in 1990) that there would be no
further financing fee, the provisions of the
resolution are applicable. He stated that,
according to the schedule, the fee would be
$35,000. He informed Mr. Riley that the
resolution states that fees generated under
the terms of the resolution should be used for
the furtherance of general community housing
goals. He suggested to Council that the fee
for the proposed refinancing be set aside for
senior citizen housing. He explained that the
city's community development block grant
allocations which have been set aside for this
purpose will not be sufficient if housing is
constructed in the next two years. He stated
that the original fee paid by Mr. Riley in
1990 was $15,000 and the full fee on the $11
million issue would be $35,000 under the fee
schedule. He felt very strongly that the city
should require payment of the fee.
Councilmember Huber stated that he realizes
this was intended to have an easy conversion
but some things have changed and those changes
are outside of Council's control. He further
stated that a joint powers agreement for
financing is apparently in Mr. Riley's best
interest, and that the changes which have
occurred are to Mr. Riley's benefit. He
stated that while he is not opposed to
requiring a fee, he felt that the fee should
based on the $11 million Mendota Heights
portion of the issue and that Mr. Riley should
be given credit for the $15,000 fee paid in
1990. He stated that he did not feel that a
$20,000 fee is unreasonable.

SYNOPSIS
The de�artment responded to 25 calls during the month of January
1994. Calls included alarms, car fires, medicals and a mutual aid call to
West St. Paul. On the morning of Januazy 23rd at 5:56 A.1VI., mutual aid
was re uired by West St. Paul to fight a�ire at Charlie's Bar on South
Robert�treet. Charlie s Bar is joined to the old West Twins theater which
was a landmark on Robert Street in West St. Paul. We sent one engine
and crew to the scene for assistance in fire attack, overhaul, and standby
�ire coverage fox their community.

Monthly Drill
Drill for January was on the use of large diameter hose and the
movement of water at the fire scene.
Monthly Sc�uad Drill
Squad drill involved a continuing series on scene assessment and
incident command. Incident Command is a structured use of all resources
that is being adopted world wide in the fire service.

In addition to routine maintenance performed in the Public Works

On behalf of the Parks and Recreation Commission and the City
Council of Mendota Heights, I cordially invite you to attend a
neighborhood meeting to discuss conceptual design plans for the
development of the north area o� Kensington Park. Z'rie Parks and
Recreation Commission and city staff are hosting this meeting which

The intent of this neighborhood meeting ig to solicit input
and suggestions about the design of this park. Improvementa to the
north area of Rensington Park are anticipated to be scheduled for
1994 construction. Th� Parks and Recreation Commission �nd City
Council desire neighborhood participation and input before the
concept plans for the park's design are forntulated.
The soutfi area of Kensington Park was developed in 1.992 and
includes two full size soccer fields, a comfort station, play
equipment, picnic shelters, trail connections, parking and
landscaping. The no`rth area of -Rensington Park was graded and
seeded and left undeveloped in order to allow the neighborhood an
opportunity to help determine its use. (Please aee reverse aide
for map of park.)
City staff will provide brief presentations throughout the
"open house" style neighborhood meeting and there will be exhibits
and maps on display to provide further information. The Commission
and City Council are encouraging any interested resident to attend
this meeting and are looking forward to your input, ideas and
auggestions.

T'he Colony Townhouse Association located in Lilydale has, for a long tim
attempting to improve a stormwater situation on their site by redirecting a culvert
under Trunk Highway 13 and connects into the storm water system for their parki
Meadota Heights and Lilydale jointly completed a project last fall that div
substantial amount of storm water that used to go through this pipe (Mayfield He
Diversion). The Colony development sits literally "on the brink" of the bluff. I
of the bluff have been breaking away by their foundation and at other places in tl
vicinity. The Colony Townhouse members feel that surface and subsurface dra'v
area may play a part in these bluff break offs and bave been attending the Lower
River Watershed District meetings to try and get them to do something about red
surface water. The Lower Minnesota River Engineer Larry Samsted recently lea
Mn/DOT Special Projects program and that storm water improvements at tlus loc
be a candidate for this type funding.
In order to be considered a candidate for the Mn/DOT Special Projects F
1995 program, this project would have to have a resolution of support from the
affected jurisdictions sometime in February of this year. The Lower Minnesota ;
Watershed District has already approved their resolution (attached) and Lilydale
one at their next aneeting.
The project as approximately a$100,000 project and if approved by Mn/]
would be shared by NIn/DOT , Lower Minnesota. Rive� Watershed District, Lily
Mendota Heights. It is proposed that Mendota Heights' share would come from
Water Utility Fund. If based on an area contribution, Mendota Heights° share G

WHEREAS, storm drainage from and along the west ide of
Lexington Avenue has caused a 12" corrugated metal pipe to become
overloaded during rainstorms of average intensity and durat'on; and
p1SEREAS, this culvert leads and is connected to a�rivate
drainage system owned by the Colony Apartments in Lilydale; and
�PHEREAS, the Cities of Mendota Heights and Lilyda�e have
already completed a project that diverts a good share of t storm
water that once flowed down Lexington Avenue, by creating hat is
known as the Mayfield Heights Diversion; and
WHEREAS, the Colony Apartment Association has off red to
provide the right-of-way for a relocated culvert and exten ion to
the Minnesota River Bluffs on the west side of the Colony Ap rtment
property for a nominal sum; and
WHi3REAS, the Lower Minnesota River Watershed Distri t, the
City of Mendota Heights, the City of Lilydale and the Co nty of
Dakota may wish to cooperate financially with the Mi esota
Department of Highways in this project.
NOW TSEREFORE B$ =T RESOLVED that the City of Mendota eights
hereby formally requests MnDOT Special Agreements Funds or the
redesign of the drainage system with an appropriately siz d pipe
west of Lexington Avenue on Trunk Highway 13 for the fisc 1 year

notification from Police Officer David Olson that he has
a position with the Police Department of Elk River and t

Kullander stated the rinks were closed this evening

Improvements Plan. Batchelder stated that since the July 1993
meeting the Commission has been reviewing the park system on
a monthly basis to generate a list of maintenance, capital
improvement and replacement items that will be necessary in
the parks system in the near future. He stated that.beginning
at the March meeting, the Parks and Recreation Commission will
begin more difficult discussions regarding priorities and
funding sources. Batchelder stated the intent, at the March
meeting, is to provide a summary list of all of the
discussions to this date based on the monthly reviews that
have been occurring since July. He stated that from this list
priorities will have to be determined, funding sources
identified and a five or ten year schedule will have to be
established.
Parks Project Manager Kullander reviewed the open space system
in the City of Mendota Heights. Kullander stated this open
space is land that the City owns that is not in the park
system.
Kullander reviewed the Ivy Falls area and stated that this
land is mostly steep and difficult to install improvements.
Kullander stated that at one point in the past the Lilydale/
Harriet Island Regional Parks had conaidered connecting to the
Ivy Falls open space area but that the City of Mendota Heights
response had been negative. Kullander stated we have not
heard back on this issue since.
Kullander described the Caren Road open space area that had
originally been a storm water ponding area that is not now
used for that purpose. He stated that Parks Leadperson Blum
has planted some evergreen trees in this area over the last
year and that some neighbors have been maintaining wild
flowers in this open space. Kullander stated the City can
continue to place plantings in this area and that no one in
the neighborhood has requested that the City clear cut it and
mow.
Kullander described the Marie Avenue and Lexington Avenue open
space area by stating that this had been given to the City as
a park dedication. Kullander stated this open space was
mostly storm ponding area with swales and open space along the
rear yards of some of the homes. Kullander stated the
neighbors had requested that the City dredge this pond and
that $10,000 had been allocated from the storm water
maintenance fund to do thise Kullander stated that borrings
and soundings have recently been taken which shows the pond is
of adequate depth and is actually designed correctly to meet
NURP Pond Standards. He explained that based on these tests,
it may be best to not dredge this pond this winter as planned.

Kullander described the Civic Center site as being

stated the only improvement need is the gravel trail nd that
this aite has been left mostly in its natural charac er. He
stated that at an earlier Parks Commission meeting it ad been
discussed that wildflower plantings might be approp iate in
this area.
Kullander described the Delaware pond area between Cop erfield
Drive and Mendota Heights Road by stating this is steep,
wooded lot connecting to a pond along Delaware Avenu .

policies for the upkeep of these trails. Kullande stated
that in the future there may be opportunities for ad itional
trail segments in conjunction with developments and he

of trail from the developer. Kullander stated this section of
trail would be constructed in 1994 as this project begins.
Kullander stated the Mendota Interchange trails are in
progress and that the County is currently constructing the
underpass at Highway 55 and Highway 13. ICullander stated the
County has a seven phase program involving the implementation
of this regional trail and that the Pilot Rnob Road
connection, south to Eagan and north to the new Highway 13/
Soo Line trail is the last step of that program.
Batchelder stated that the City Council had considered
endorsing the North Urban Trail concept which the County is
beginning to work on. Batchelder stated the City Council
desired to know where the trail connections would be and where
the trail corridors would be before they gave concept approval
to this trail.
Kullander stated that in Valley Park the City was working with
Dakota County staff to look at possibilities of clearing and
grubbing a natural trail that would allow grooming in the
winter for cross country skiinge
Commissioner Spicer inquired about signage and markings along
the trails. Rullander responded the City has the stencils to
begin the mileage markers and would be doing that this summer.
Rullander stated the City currently has twenty miles of paved
trails. Spicer stated that perhaps the work service crews
might help the City in this regard.
Kullander stated occasionally the City receives requests for
new trail connections from certain neighborhoods. He stated
there are currently several grant opportunities available for
trail purposes. Kullander stated that staff would need
authorization to pursue these types of grants because
typically they involve a fifty percent matching fund
contribution from the City.
Kullander stated the Soo Line trail at Mendota Heights Road
would be a possible grant request to connect this trail south
along Highway 55 to Lexington Avenue in Eagan because this
might be a joint City project that grant givers would look
favorably upon. Commissioner Spicer stated the City should
contact the City of Eagan to find out what their plans are for
bringing trails north along Lexington Avenue so that we could
connect at the Soo Line deadend. Kullander stated as part of
the Capital Improvement plan he would like to have the Parks
Commission make recommendations on policies for periodical
seal coating of the trails, for clearing and grubbing the
brush around the trails and for snow removal in the winter

time. He stated that last year the City budgeted $:

Administrative Assistant Batchelder stated the City Council
had not accepted the Parks Commission recommendation for
concept plans at North Kensington Park. Batchelder stated the
City Council felt a neighborhood meeting should be conducted
before a concept plan is developed and directed staff to
conduct this meeting. He atated the neighborhood meeting has
been scheduled for Thursday, February 24th in the evening at
City Hall. He atated mailed notice would be sent to all
property owners in Hampshire, Brentwood, Kensington, Mendota
Woods and Bridgeview Shores neighborhoods as well as press
releases to local newspapers and association newsletters in
this area.
Commissioner Spicer stated he felt the Commission could show
what previous options had been discusaed for this park at the
neighborhood meeting, however, he is concerned that we would
open the doors to unlimited spending at this park. Spicer
stated we would have to inform the audience that there is a
certain amount of dollars left in the referendum and describe
what possible options could occur at this park. Spicer atated
he feels the Commission's recommendation that this be green
space with landscaping was still appropriate and that possible
options which have been discussed in the past were tennis,
horseshoe pits, picnic shelters, basketball and open space.

The Parks and Recreation Commission recommended that

Parks Project Manager Kullander examined the alternatives for
addressing this issue. Kullander atated that the options aree

Kullander stated for option no. 1, extension of the backstops,
sleeves could be fit inside the existing pipes in order to
extend the backstops to twenty-four feet in height. Kullander
atated this would etop the direct line drives but that foul
balls would still clear the extended backetops. He stated
this option would cost approximately $I0,000.
Kullander described option 2 with the overhead netting. He
explained that overhead, nylon mesh netting could be erected
to extend from the comfort station to the existing backstops
with wire cables. Rullander stated this would provide
complete overhead protection in the center area of Mendakota
Park's ball field complex. He atated there might be some line
of site vision obstructions for those people in the
observation decks. Rullander stated the wire mesh netting has
a five to eight year life expectancy and that it would be
somewhat susceptible to vandalism.
Mr. Blake stated he is aware of three complexes that use this
type of netting quite effectively. Blake stated that
Bloomington has two softball complexes, one at Dred Scott
Fields and one at Portland and 90th and that the City of
Minnetonka also has a netted pinwheel softball complex.
Kullander stated it would be necessary to put these nets up in
the spring and take them down in the fall and that more
frequent removal and placement of the netting would only be
possible with a cherry picker. Chair ICatz inquired if the
netting could not be constructed at a higher location where it
would be more difficult to reach it to prevent vandalism.
Kullander stated he is trying to maintain a balance between
the maintenance and easy installation of the netting versus
the liability due to vandalism.
Commissioner Spicer inquired about the use of a metal fiber
netting. Kullander stated that the.City would pay a premium
for metal fiber netting and that the nylon netting is
estimated by the vendors to have an eight to ten year life

netting would be done by an outside firm and that l�ghtning

intended Mendakota Park be used more than fifty percent for
youth baseball. Chair Katz stated it was never the intention
of the referendum that Mendakota Park was always intended for
adult softball, however, we can accommodate some youth
baseball on these fields. Katz stated the purpose of any
overhead netting would be to protect spectators and to address
liability issues.
Mr. Blake stated Mend-Eagan is under the assumption that this
park was intended to be used at least fifty percent by youth
baseball and that this is what he had heard from some baseball
commissioners. Commissioner Spicer corrected him by stating
he had been involved in the referendum from the very start and
that this park was always intended for adult use, however it
can accommodate some youth play and that is what the City is
attempting to do. Spicer stated that the City's Parks and
Recreation Commiasion have denied numerous requests from
outside adult softball users such as a church league, West
Publishing and Northwest Airlines.
The Commiasion inquired about timing to implement any of the
options discussed tonight. Kullander stated that if the
Commission decides to move forward with the netting he would
like to install the wires and connections in late April or
early May so that the panels can be ordered to an exact fit.
Kullander stated thie would allow the panels to be in place in
June when baseball reservations have been reguested.
Commissioner Spicer stated he would like staff to get concrete
bids for recommendations on option 2, to place overhead
netting at Mendakota Park. Commissioner Spicer moved to
recommend that Council direct staff to prepare specifications
and advertise for bids to install overhead netting at
Mendakota Park for the cost estimated to be $10,400. Spicer
stated City Council could consider using referendum funding or
special park funding to pay for this iteme

scheduling priorities on the City's Park Reservation Policy in
regards to softball fields. Commissioner Spicer stated Mend-
Eagan provides baseball programs that have over 1,400 children
involved in baseball, softball and t-ball. Spicer stated
there are 1,230 family memberships in Mend-Eagane Spicer
stated he is aware that the City has received a request from

field. Spicer stated this independent youth team is not
affiliated with Mend-Eagan and Mend-Eagan is e tremely

Chair Ratz stated she feel� this reservation request is the
Recreation Programmer's decision to make. Commissioner Spicer
stated the Civic Center Field has always had two nights
available for the Mend-Eagan 12-13 year old traveling team.
Spicer stated he feels there is only space for one traveling
team in Mendota Heights.
The Commission directed staff to come back at next month's
meeting to discuss the clarity of priorities. Mr. Blake
stated at this point the rules are too vague and that there
are many groups that may fit the category of "organized youth
programs". Commissioner Spicer stated that the terminology
about what is considered an organized youth program has to be
clarified and that Mend-Eagan should be specifically granted
higher priority.

not granted the Friendly Hills tennis courts for reservations e

Friendly Hills Park last year on a first come, first served

St. Thomas Academy could use.

indicated the ANOMS monitor located in the Curley's Addition

Commissioner Leuman noted that Boeing 727's, according to the
ANOMS reports, are the consistent noise makers. .
The Commission acknowledged receipt of the Richfield Part 150
Buyout Updates for December 1993 and January 1994.
Administrator Lawell explained these newsletters are published
by the MAC and W.D. Schock Company, Inc. He explained that
this publication contains information on the MSP land
acquisition and relocation projects in the City of Richfield.
The Commission acknowledged receipt of the NOISE Newsletter
from January, 1994. Administrator Lawell informed the
Commission that the NOISE is primarily a lobbying organization
and that it does not devote much effort towards research.
The Commission acknowledged receipt of the December 14, 1993
MSP Technical Committeeaneeting minutes. Administrator Lawell
explained that the MAC has formed a Technical Committee made
up of representatives from interested communities and agencies
to assist in the review of the Long Range Comprehensive Plan
for the Minneapolis-St. Paul International Airport.

Administrator Lawell explained that at the December meeting,
the Commisaion had discussed the need to investigate FAA
flight procedures utilized at other airports across the
country. He explained the Commission expresaed interest in
aircraft departure procedures utilized at other airports of
similar size to MSP.
Lawell explained he had contacted FAA control tower personnel
at five airports which were found to have air traffic levels
similar to MSP's 1992 level of 413,502 operations. He
explained that the selected airports include Boston, Memphis,
Nashville, Detroit and Denver.
Detroit - Metropolitan Airport
Administrator Lawell explained this airport is located 15
miles southwest of downtown Detroit. He explained there are
four runways and that the land abutting the airport is fully
developed. He explained the predominant air carrier being
Northwest Airlines.

Lawell explained that three of the four runways are
with the centerline aeparations being 2,000 feet for
3R/21L and 3C/21C, 3,800 feet between for runway 3C,
3L/21R, and 5, 800 for 3R/21L and 3L/21R. Various comb

18L/36R. He stated the centerline separation is 3,�

Lawell explained that this airport is located five miles
southeast of downtown Nashville. He stated there are four
runways total and the land abutting the airport is mostly
developed, less so on south and aoutheast. He explained the
total annual operations to be approximately 340,000 with the
major air carrier being American Airlines. He stated
approximately nine arrivaZ and departures pushes each day
between 7:00 A.M. and 3:00 P.M.
Lawell explained that the principal parallel runways are
2L/20R and 2R/20L. He explained the centerline separation is
5, S00 feet and when traffic dictates, the parallel runways are
run independently by two local controllers.
He further explained that under a waiver granted by the FAA,
simultaneous jet departures on runways 20R and 20L may climb
out with no divergence for one mile under VFR conditions. He
explained that jet departures on runways 2L and 2R must
diverge immediately.

Bostan - Logan International Airport
Lawell explained that this airport is located two miles east
of downtown Boston. He stated there are five runways total
and the land abutting the airport is fully developed except on
the east which is adjacent to Massachusetts Bay. He explained
the total annual operationa are approximately 487,000. He
stated that many air carriers operate out of this airport with
USAir being, probably, the largest. �
Lawell explained the principal parallel runways are 4L/22R and
4R/22L. He explained the centerline separation is 1,500 feet.
He stated the parallel runways are frequently run
independently by two local controllers, however, two jet
aircraft are never released simultaneously because runway
4L/22R is resenred for prop aircraft.

DISCUSS MSP CAPACITY ENB�I�TC�T PLAN
Administrator Lawell explained that as part of the Dual Track
Airport Planning Process, the Long Term Comprehensive Plan
LTCP) for MSP is currently being updated. He expZained that
the intent of this update is to define the best approach which
will allow this airport to handle the air traffic volumes
projected in the future. He stated that the current MSP LTCP
calls for the future construction of a new north/south runway
on the weat side of the airport property, roughly parallel to
Cedar Avenue.
Lawell stated the FAA team identified and assessed various
actions which, if implemented, would increase MSP's capacity,
improve operational efficiency and reduce aircraft delays. He
explained that the purpose of the process was to determine the
technical merits of each alternative action and its impacts on
capacity. He further stated the Team did not study the
environmental, socioeconomic or political issues asaociated
with the various expansion alternatives.

Administrator Lawell explained that the Commission has
discussed in the past the important role aircraft departure
profiles play in the mitigation of noise impacts. He stated
the profile or vertical track an aircraft follows as it
departs is of particular concern to the City.
Lawell explained that the FAA has issued an Advisory Circular
on the subj ect of Noise Abatement Profiles . He explained that
this information has yet to be implemented at MSP but probably
will be in the near future. The MASAC Operations Committee
will be discussing this matter at an upcoming meeting.

Lawell explained that the new procedures will severel limit
the authority of individual airports to negotiate t e most
unique and effective noise abatement profiles for their local
conditions.
In response to a question from Commissioner Beaty,
Administrator Lawell stated the full impact of he new
procedures are not yet known. It is doubtful he new
procedures would help limit the air noise problem b t they
could potentially make it worae. The Commission will e kept
up to date on this matter as it evolves.

DISCUSSION
At the February 1, 1994 City Council meeting, the
approved a Conditional Use Permit to allow Mr.
Wandschneider, of 1289 Lakeview Avenue, to construct a 14
foot shed in the front area of his property. Thia CUP was
instead of the requested Variance to Section 4.5(4) in or�

WHEREAS, Mr. Michael Wandschneider, of 1289 Lakeview Avenue,
has made application for a Variance to Section 4.5 (4) of the Zoning
Ordinance to construct a 144 square foot shed on his property at
1289 Lakeview Avenue, as proposed on site plans in Case File No.
94-01; and
WSEREAS, the Mendota Heights Planning Commission conducted a
public hearing on January 25, 1994 to review said application; and
�HEREAS, on January 25, 1994 the Planning Commission closed
the public hearing and voted unanimously (5-0) to recommend that
City Council approve a Variance to Section 4.5(4) of the Zoning
Ordinance to allow construction of a shed, as proposed, with the
following conditions:
1. That shrubs be provided as a screen on the side facing the
street.
2. That the shed not encroach closer towards Lakeview Avenue than
the neighboring house located at 1281 Lakeview Avenue.
3. That the color of the shed either match the home or be tan in
color.
�BEREAS, the City Council reviewed said application for
Variance to Section 4.5(4) at their February 1, 1994 meeting; and
wHEREAS, upon review of the application the City Council
desired to allow this shed under the provisions of a Conditional
Use Permit with revised conditions in order to properly retain
control over the size and use of the structure.
NOw THEREFORE iT IS HEREB3C RESOLVED by the City Council of the
City of Mendota Heights that a Conditional Use Permit for
construction of the proposed structure is consistent with the
general welfare of the citizens of the community and the
surrounding land; and

This spring St. Thomas Academy's Environmental Studies class requested a variance
from the City's Or�inance to allow them to use a motorized pontaon to collect w ter samples
from Rogers Lake. The City Council granted the variance subject to them shari� the results
of their studies with the City. The studies aze now completed and members of t class will
attend the February 15th meeting to present the results (see attached letter).
ACTION REQUIRED:
Allow members of St. Thomas Academy's Pnvironmental Studies class to �res

SUBJECT: Hudson Pasement Vacation
DISCUSSION:
February 4,
At their last meeting Council approved a variance and authorized staff to i
building permit to Mr. Jim Hudson for a 32,000 warehouse building expansion. `
expansion will cross the lot lines of two lots that are being combined. That lot li
utility easement on it and water main with a hydrant to protect his e�dsting buildi�
attached site plan). Because the building expansion is to cross that easement, this
will have to be vacated and the hydrant relocated.
The hydrant was installed for the sole purpose of providing fire protection
existing Hudson building, it benefits no other property.
RECONIMENDATION:
I recommend that the existing easement that contains a fire hydrant local
�Iudson property be vacated and that the hydrant be relocated to a new location
directed by the City's Fire Marshal.

Conduct the required public hearing and then if Council desires to
recommendation, pass a motion adopting Resolution No. 94- , APPR

"CELEBRATE" A SUCC�ESS!
On Satucday, July 24th the second annu�l Celebrate Mendota Heights Parks! was held at Mendakota Park. For the second straight year
everyone had a fun filled day participating in or watching the various acGviGes and events that were held. It was estimated that over 1,000
people attended the celebration despite lhe tlu�eat of rain throughout the day. 1fie rain held off until after the events were over and everyone
had a fun time.
1fie day actually began at Kensington Park, the City's newest park located on Concord Way off of Mendota Heights Road, when Mend-Eagan
and Sibley Sting soccer programs hosted a Kickoff and soccer exhibiGon at the new soccer complex This event was climaxed by a Ribbon
Cutting ceremony as the City Council and lhe Parks and Recreation Commission officially dedicated Kensington Paric.
Meamvhile, back at Mendakota Park the fun and festivities began in the moming with the City's Men's Over 30 Softball League's annual
tournament. Many people of all ages participated in activities throughout the day including the Kiddie Parade and Camival Games hosted by
the Mendota Area JAYCEES, Sub�vay Sand�vich Shop's Home Run Hitting Contest, Dunk Tank sponsored by the Ladies Auxiliary Club,
in-line skaGng, horseshoes, Moomvalk, Fire Truck Rides and face painting by Kelly the Clown
Spectasors I�ad thc; opportunity to enjoy the Teddy BeazBand and the Lazy River Jazz Band for musical entertainment The Teddy Bear Band
thrilled youngsters ��nd adults alike �vith a performance that included participation by many of the children in the audience and the Lary River
]aa Band provided two sets of their unique style of Di�eland Ja�. Tumer's Gymnastics pcovided an exciting routine of tumbling spiced with
some humorous tran:poline hijinks and antics. For the second year in a row, children from D.D.'s Dance Studio delighted the crowd with their
well rehearsed dance recitals. Contests held throughout the day included the free ttunw shooting contest sponsored by the Optimist Club of
Soutt�/West SG Paul, the sack races, the wheel barro�v races, and the water balloon toss with many a lucky competitor taking home a nice prize
donated by local area businesses.
This successful event is fast becoming an annual tradition and many thanks go to the volunteer planning committee comprised of lor '
residents, local civic organizations and city o�cials. The celebration would not have been possible without the efforts of many volunteers a
the generosity of many local businesses and individuals who staffed the events and provided the funding to pay forcosts and supplies. Specia�
ihanks go out to all the organizations and individuals who contributed to this effort. Special mention goes to the Fire Department and spouses,
Ladies Auxiliary Club, JAYCEES, Optimist Club, Mend-Eagan Athletic Association and the parks maintenance staff.

Parks memo-and the February Park minutes for more details ) The
Commission preferred the overhead netting option beca se it
provides complete protection of the center area and becaus it is
less expensive than some of the other options.
Guy Kullander will be present Tuesday evening to pr vide a
brief overview of overhead netting which he has estimated wi 1 cost
$10,400. (Please see attached drawings.) The Parks and Rec eation
Commission felt that either the Referendum Fund or the pecial
Parks Fund would be appropriate if this item is approved.

the batter� s box could. be raised from fourteen feet ( 4�) in
height to twenty four feet (24' ) in height. This optio would

to have a 30 year life span. Rough estimate is $10, 00 to
$12,000.
2. OverY�ead Netting - Overhead netting, nylon mesh, co�
erected to extend from the comfort station to the e�
backstops with cables. This mesh netting would prote
seating areas from above, however, will impede sight
from the observation deck and there are concerns
aesthetics. Netting will require maintenance and r
handling by the park crews. Complete replacement of thE
mesh, connecting cables and fasteners is estima.ted
necessary every 5 to 8 years. Rough eatimate is $8,

3. Parabolic Shaped Backstaps - These backstops would repl ce the
existing backstops and are shaped to overhang home late.
(Imagine slicing an orange into quarters.) Al1 foul balls
would be knocked down. Replacing the backstops would i clude
costs for removal and disposal (or reuse), and addi ional
concrete surfacing around the backstop. Rough estimate of
costs is $30,000.
4. Do nothing and allow baseball use - Baseball use would be
allowed to continue with no additional improvements to
Mendakota Park. Staff has initiated discussion with our risk
managers and should have more information availa.ble on Tuesday
evening about this option. Currently, baseball user groups
have to provide a Certificate of Insurance to the City to
reserve these fields, however, the City would likely still be
named in any suit involving injury from foul balls.
5. Do nothing and not allow baseball use - Mendakota Park was
originally designed to meet the needs of adult softball in
Mendota Heights. Sibley Park was intended for youth play and
the pinwheel design was not used there primarily to prevent
the clustering of fans and players in foul ball territory.
Demand for the fields at Mendakota Park is increasing and
parents of youth baseball players like the convenience and
quality these fields provide. Alternatively, adult softball
programs are growing and expanding in Mendota Heights as well,
and it is envisioned that in the near future adult softball
will take up an increasingly greater amount of time at these
field�.
6. Limit baseball use - Baseball could be limited to an age
bracket where foul balls are not a safety concern.
In addition to the above listed options, there are some other
partial measurers the City could take such as screening only the
window areas of the observation deck. It may be prudent to have
professional architects provide professional expertiae on any
preferred design solutions. Staff will be prepared to discuss
these issues and present more detailed information for your
consideration.
