' j NORTHERN DAKOTA COUNTY CABLE COMMUNICATIONS COMMISSION , FULL COMMISSION MEETING • � a/ August 10, 1994 , � The August Commission meeting was called to order by Chair George Tourville at 7:00 p.m. on Wednesday, August 10, 1994. The Pledge of Allegiance was recited.� NDCTV President, Liz Witt, updated the group on NDCTV activities. A Volunteer Appreciation picnic will take place on Thursday, August 18 at Kaposia Park in South St. Paul. Commissioners are invited and will be recognized for their support. A list of names will be submitted at this evening's meeting from which Commissioners will appoint one person to complete the term of Jim McCabe (an NDC4 appointee) who recently resigned from the NDCTV Board of Directors. J. Miller reported that NDCTV� will begin its membership campaign "Drive 95 -- Joi� NDCTV!" in September. Premiumsi will be offered to those who renew or take out a membership by the end of October. J, Miller announced that Continental Cablevision System Manage.r,. Fran,Ze�:li, �ill not attend the meeting this evening. F. Zeuli will continue to �attend NDC4 meetings in place of R. Coleman who has been assigned to work on setting up a i able system for Continental in Singapore. NDCTV President Witt reported that she recently attended the first meeting of a state telecamrnunications task force established to outline cities needs as the developing technologies emerge. Mike Sokol will consider participating on this task force. A quorum was present at 7:15 p.m. with the arrival of R. Vitelli. ,1. NDCTV UPDATE - A) Board Member/NDC4 Appointment: Dave Coen, who had been appoirited to the NOCTV Board of Directors in January, has resigned. NDC4 must appoint another person to fill the position vacated by Mr. Coen. Commissione�s agree� to use the list as a ballot from which to choose another appo�in�rtr'ent. Legal Counsel, B. Grogan collected and tallied the votes. Lorraine Palkert was chosen to fill the remainder of Dave Coen's term on the NDCTV Board of Directors. B) Activities Report: (A report on NDCTV activities was presented by NDCTV President Liz Witt earlier in the evening.) 5. REPORT FROM CONTINENTAL - No report was given. 6. NEGOTIATION COMMITTEE REPORT - Committee Chair Mike Sokol reported that in recent conversation with F. Zeuli he was told that because of administrative changes occurring at Continental's St. Paul office, no decision has been reached regarding � the��-i�tems•�NDC4 •wishes to negotiate. Continental has requested an 18-month extension on the three variances that 'have expired. Because of the delay experienced by Continental, the Committee has not been able to meet to discuss any substantial offer, so a recommendation has not been formed for NDC4 consideration. Therefo�e, the Committee recommends tabling discussion of the issues until next month's meeting. Continental is aware of the need to finalize some of these concerns, particularly the Local Origination (LO) channel, which has been on-going for 1-1/2 years, and has agreed to provide specific information to the Cammittee in time for them to meet before the next Commission meeting. The Committee should have a recanmendation ready concerning the LO channel for Commissioners to consider at the next meeting. The Negotiation Cornmittee tentatively scheduled a meeting for August 30. M. Sokol stated that he has tried to impress upon F. Zeuli the importance of coming to some agreement regarding the LO channel and that pending legislation and Continental's dilemma over interpreting FCC rulings has no bearing on the LO issue. J. Miller was directed to contact F. Zeuli and reinforce the desire of NDC4 to conclude the issue concerning the LO channel. 7. CITIZEN COMMENTS - No citizen comments we.re received. 8. BUDGET FEEDBACK FROM CITIES - J. Miller updated the group on the current status of 1995 budget approvals. The City of Inver Grove Heights approved the draft 1995 budget on Monday, August 1. (That budget showed a zero Operating Budget bottom line with the deficit amount being reduced from payments to the cities.) The City of West St. Paul briefly discussed the budget and directed their attorney to review the Joint Powers Agreement for compliance if monies were not returned to the cities. A response fram the attorney will be reported at their August 22nd meeting, at which time the budget will be placed on the meeting Agenda. The City Administrator for the City of South St. Paul suggested that not including the full 15� may be viewed as non-compliance. J. Miller discussed the budget with the Mayor of West St. Paul and explained that the draft budget was sent out with the understanding that if any of the seven cities had cortanents or feedback, it would be brought back to the Commission for discussion. Since West St. Paul has NDC4 Commission Meeting Minutes August 10, 1994 Page 3 raised concerns about this budget, a meeting will take place with officials of West St. Paul and the Cammission. � B. Grogan pointed out that the Joint Powers Agreement (JPA) state`s that the annual operating expenses (including city payments) should not exceed the franchise fees collected. If every city approved something different f ram what�is stated in the JPA this would constitute a waiver of the JPA. Chair Tourvillekasserted that it was never the intent of the Commission to do anything illegal. It was agreed the Commission would present a revised budget that shows a cash balanced budget of zero using means other than reducing the city payments to balan�e it. B. Grogan explained that if the draft budget is modified, the new version will need to be resubmitted to the cities for their approval. Lengthy discussion followed on how to modify the budget to show a total 15 percent of f ranchise fees being returned to the cities and also achieving a zero operating balance. . Suggestions on how to make up the approximate �27,OOO,deficit included takin_g the amount out of depreciation, �and reducing the NDCTV grant. Same Commissioners argued against mortgaging the future of the organizations by taking the deficit amount out of depreciation for the second year in a row. R. Vitelli urged the group to take the deficit amount fram the NDCTV grant. J. Miller �pointed out that NDCTV has already reduced their dependence upon grant monies by�10 percent f �am the previous year and are undertaking an ambitious project of raising nearly $30,000 in revenues through production services efforts. Add�itional cuts in funding would seriously jeopardize NDCTV operations at a time when efforts are in full swing to became less dependent upon franchise fee monies. M. Sokol pointed out the seriousness of the situation when an organization has to make budget cuts out of the depreciation fund. He stated he did not want to support a deficit budget and mortgage the future of the organization. � Chair Tourville advised that there is at least one member city that will demand full payment be made to the cities and NDC4 must comply with the�JPA requirement of having a balanced budget; therefore, the Commission must make a decision on where to find enough money to make up the deficit amount. Debate ensued and a question was raised on how franchise fees in excess of the amount needed to fund the budget would be distributed. It was agreed that the intention of the statement in the JPA was to return only a percent of those franchise fees to member cities. i Motion 8.10.94.4 to resubmit a balanced budget to the member c'ities for their approval showing full payment being made to cities and reducing�the NDCTV grant by $27,321 in order to balance the operating budget and to appeal to the cities three months p�ior to year-end if the financial situation is show�ng an operating deficit was made by R. Vitelli and seconded by J. Lagoo. Discussion continued. Chair Tourville suggested it is vital to fulfill the obligation of the JPA and still try to attain a balanced budget. J. Huber suggested a compramise solution to the problem by making up the deficit partially out of the depreciation fund and partially out of the NDCTV Grant. The question was called, the�vote taken, and the motion failed with J. Ista, L. Collins, J. Huber, and M. Sokol voting No. . Discussion continued in which it was suggested the cut be shared between the NDCTV grant and the depreciation fund. Motion 8.10.94.5 to pass a balanced operating budget by reducing the NDCTV grant by $11,809 with the remaining amount being taken out of the depreciation fund with the understanding that any favorable excess revenue generation would go first to replenish the NDCTV Grant to the . ' NDC4 Commission Meeting Ninutes August 10, 1994 Page 4 amount originally budgeted and second to replenish the depreciation fund was made by J. Huber and seconded by J. Lagoo. During the discussion that followed same Commissioners argued that now more than ever NDCTV needs funds to help the organization become self-sufficient in the future; others argued that making such adjustments to the budget only cover up the reality of the situation, and that cities should be made aware of the magnitude of the budgetary problems and the need NDCTV has for funding in order to continue providing community services. M. Sokol repeated his preference for presenting a budget which shows the actual deficit, and ask the cities for their help in solving the problem by returning same or all of the money they receive as a payment from the Commission. The vote was taken and the motion failed with L. Collins, J. Lagoo, M. Sokol, R. Vitelli, and G. Tourville voting No. Motion 8.10.94.6 to submit a revised budget showing full payment to the cities and an operating deficit of �27,321 with a cash balance of zero was made by M. Sokol and seconded by J. Lagoo. NDC4 will have a prescribed time period in which to s and make a determination on whether or not to approve those A) Government Access Update: NDC4 Government Coordinator Judy Skeie-Voss highlighted activities from her monthly report. An analysis of city hall cablecasting systems by technician Mel Anderson indicates the need to do some rewiring in some of the city halls; VCR's also need to be replaced with higher grade S-VHS decks. Bids for the cost of purchasing the decks and installing them were pr-esented. A request was made to spend narrowcasting funds to take care of these expenses. With the addition of the decks, the technical quality of programs produced in city halls will increase. Mation 8.10.94.7 to authorize spending narrowcasting funds to purchase the VCR's at the lowest bid and spending up to $350 to install the decks was made by J. Lagoo and seconded by R. Vitelli. Brief discussion took place in which it was pointed out that during the time of installing the decks, the technician could do same of the needed rewiring. A question was raised on what kind of tape should be used in the better quality decks. J. Skeie-Voss responded that the decks will require the S- VHS tapes, which cost approximately $5 more per tape than VHS tapes currently used. It was the consensus of the group that cost for S-VHS tapes used for city meetings should be taken out of the narrowcasting�funds. The motion was amended to include deducting the cost for the S-VHS tapes for city meetings from the narrowcasting funds. The vote was taken and unanimously carried. NDC4 Commission Meeting Minutes August 10, 1994 Page 5 J. Skeie-Voss thanked the group for the additional help she has received from the hiring of a part-time Production Assistant and by increasing�a cablecaster's duties. She highlighted several programs that are going to happen in the next few months including live coverage of candidate forums, the West St. Paul Primary election, and the November 8th election. Many volunteers are needed for all of these events. The news magazine show is in its formative stages of development. A sample tape of what the show may look like will be put together soon and plans for sponsorship of the show are being discussed. A proposal inc,luding estimated costs to produce the show will be presented to member cities for their endorsement and support. Continental will also be asked to provide promotional pieces and in- kind services. The proposed name of the show is "Insight 7." Most productions of this nature require on an average 80 hours of staff time that€would include a journalist/writeyreporter, a graphics person and a videographer: A volunteer appreciation picnic will take place on Thursday,� August 18 for cablecasters and other volunteers. The Dakota Youth & Families Conference program is a finalist in the category "Impact on the Cammunity" for the NATOA national competition. � The Commissioners expressed enthusiasm for selling sponsorships for the election coverage to local businesses, and directed staff to implement such a project for the September 13 Primary election and the November 8 General Election. 6) Executive Director's Update: J. Miller reported that the NATOA'Conference will be held f rom September 19 - 22 in Reno, Nevada. The least' costly way to participate in the Conference would be to send the Government Coordinator, who has an airline ticket voucher, and the Executive Director who can fly,for very little cost, plus the two can share a room, or to send one Commissionerfor more if they are willing to pay for some of the costs. Motion 8.10.94.8 to authorize sending the Executive Director, Jodie Miller and the Government Coordinator, Judy Skeie- Voss to the NATOA Conference in Reno was made by R. Vitelli, secon`ded by J. Lagoo, and unanimously carried. In reviewing insurance coverage over the past few months it was discovered that NDC4 and NDCTV may be carrying double coverage on some insurances,. Conway Olson, who is an agent for T.C. Field & Company, was referred to J. Miller and has since prepared a proposal to streamline all six policies into two, one�main policy and a separate Dishonesty Bond (LMCIT does not write these bonds)! The two bond policies could be merged and purchased as a joint policy that would save money and add Board members and Commissioners to the coverage. In order for Mr. Olson to pursue investigating whether the building insurance and broadcaster's insurance can be covered under the LMCIT, NDC4 must authorize him as the acting agent. Discussion followed and it was agreed that at this time NDC4 does not wish to name Mr. Olson as their Agent of Record. Staff was directed to ask theiLMCIT what they need in order to allow Mr. Olson to investigate the insurance �records for the organizations. It is also desirable to obtain competitive quotes from Mr. Olson as well as from the current agent. The Employee Bond is due for 4enewal shortly. Stafffwas directed to a obtain quote for bond coverage f rom the current agent, as well, and to pursue obtaining competitive insurance bids wheneve"r possible with the goal of providing appropriate coverage at the least cost. � NDC4 Commission Meeting Minutes August 10, 1994 Page 6 J. Miller announced that Melissa Schmidt, an Inver Hills Community Co11egF student, has been working in the offices as a secretarial intern. Ms. Schmidt':. assistance has been invaluable and it is hoped the secretarial intern program will continue. G. Tourville suggested contacting local high schools which often look for intern programs for their students. 11. UNFINISHED BUSINESS — L. Collins thanked the Executive Director for sending a letter of appreciatian to the City of Lilydale for their contribution of city payment monies to NDC4. 12. NEW BUSINESS — J. Ista brought to the attention of the graup a lette� prepared by Roger Miller, South St. Paul City Attorney regarding the law concerning city officials accepting gifts. J. Ista suggested that it wouid°be appropriate �o acknowledge employess r:ho have been with the organizations for at least five years. J. Miller was directed to consult with staff to learn what they would like to receive. Also a policy needs to be put into place for future guidance regarding employee recognition. J. Ista remarked that during morning on August 3 when she visited the office for a meeting she noted that all the editing suites and both studios were filled to capacity with people using the services offered by NDCTV. 13. August 16th a call in for severed phone line at thfe Mendota Heights Road lift station and on August 24th two call ins for power failures due to Northern States Power working on feeder lines. Five sanitary sewer lift station wet wells were cleaned and accumulated sludge pumped out. Air and mandril testing of the new sanitary sewer lines was done for the new construction on Highway 13. We contiaued street patch work with the paver borrowed from Eagan. The�slurry seal contractor completed the slurry seal in the Crown Point area and the neighborhaod � south of the Par 3 golf course. Purple Loosestrife was sprayed behind City Hall. Preparation work was done at Mendakota fields for tournaments on August 6-7, 12-13. There was graffiti painted in the tunnel under Marie Avenue again and also at Mendakota Park on the bleachers, pedway and Kiosk. The warming house at Friendly Hills Park was relocated toward Pueblo Laue. It was found that some of the gear had extensive damage due to wear and tear from firefighting activities. Also, we just taok on three new firefighters; and we need to provide them with turnout gear so they can start "Firefighter I" as well as other in-house training. After composing specifications, I pursued competitive bids from area companies that sell the types and biands of turnout gear which we use. Metro Fire and Smeal (DANKO) both returned quotations. Prices submitted by Smeal (DANKO) were found to be less costly. Ia this time Chris has shown that he can perform his duties satisfactorily without the need'�of extra assistance or supervision. Even though the summer construction is slowing down, work, both in the office and out in the field, remains at a steady pace. Since Chris has been involved in the majority of the projects, and has an understaading of the work that needs to be completed for the City, it would be in the Engineering Ilepartment's best interest to keep Chris on staff on a part-time basis. As a temporuy part time engineering aid, Chris would be around to follow �through on the completion of our construction projects and help out with the day to day engineering work. His hours would be limited to no more than 20 hours per week and would work on; an "as needed basis". The Metropolitan Council's 1993 household estima.te for Mendota Heights is 3,755 households. There ,will be no carryover of 1994 funds. The Goodwill Drop Off Center discontinued collection of recyclables on August 1, 1993. A new focus for 1995 will be waste reduction and procurement practices at City Hall, as well as an increased level of activity in promoting recycling with the commercial/industrial sector. It is anticipated that the County will add residential office paper as a required, additional material for curbside collection in December of 1995. The majority of the budget is administrative costs for salaries and mileage to pay for the Administrative Assistant's time in recycling activities. The funding application I am proposing will cover the maintenance and monitoring of our on-going recycling program. CTTY OF MENDOTA HIIGHTS September 14, 1994 TO: Fire Chief John Maczko FROM: Assistant Fire Chief 7ohn Neska RE: Sealing of Apparatus Floor at the Fire Department I have spent a lot of time recently finding information on properly sealing of the apparatus floors at our fire station. I have talked with four different companies that specialize in concrete floors; and have determined that the proper coating would include a 100 � epoxy base with two coats of 100 � chemical resistant urethane. A light seeding of aggregate would be incorporated in the first coat of urethane to insure a non-slip surface. The original flaor would be shotblasted in order to assure a raw concrete surface which would add to the adhesion of the epoxy. All four companies have similar products and all have been established for quite some time. I reviewed similar floors at Minnetonka Fire Station #5, Lake Johanna Fire Station #3, and some heavy industrial floors in Blaomington. The building is on the intersection of Heights Road and Northland Drive, across from Cra.y and Minnesota Knitting (see map). Ia 1981, we included the property in our Tax Increment District, and currently receive about $26,000 per year in increment off the building. The property was owned by a four member partnership, which due to financial troubles of two of the partners, got into problems over clear title. The problems have now been resolved and two of the partners have acquired clear title to the buildi.ng. About two years ago, the Fire Marshal instructed the owners to retrofit the building with a sprinkler�system. Daaielson, Public Works Direc� SUBJECT: General Pump - Building Permit Review and Request for Tax Financing INTRODUCTION: General Pump, Inc., appeared before the City Council at their August 16, meeting for a preliminary review of a request for Tax Increment Financing to dev� building at 1174 Northland Drive. City Council discussed the proposed request a� General Pump that a revised site plan and building reorientation would be necessa: City to consider TII� participation (see attached minutes of August 16, 1994 meeti City Council expressed concerns about the visibility of this building at the � Mendota Heights. Council did not feel the aesthetic appearance of the building w� satisfactory. The City Council desired to see a reorientation of the building, the lc docks, and the parking. The Council felt additional landscaping was necessary to screen the site. 1994, op a new t informed � for the to and Since August 16th, General Pump has indicated a strong desire to make this site work and has met with the planning staff and consultant to address Council's concerns. � DISCUSSION: Revised site plans have been submitted that comply with the City's Zoning with the exception of the siga setback. At this stage no sign details have been sub. General Pump intends to pursue their sign permit at a later date. Currently, the dri shown to be on Lot 3 only, however a future shared driveway is sketched on the p General Pump may decide to pursue a variance for a shared driveway. The sign p driveway variance will have to be processed through the Planning Commission, if Pump so desires. and is and A prime concern of City Council on August 16th was the lacation of the loading docks. General Pump's revised plan has relocated the loading dacks to face south, away from TH55. They have shown berming and heavy evergreen landscaping to screen the loading dacks. General Pump has shown visual sight line plans that demonstrate the visibility of the building from Highway 55, I-35E and I-494 and Council should review these on T�esday evening. The landscaping shows a variety of type and height of tree species to provide a variation in the size of trees, as proposed by 7ohn Uban. Elevations of the building have been submitted for Council review and show an office/warehouse with a decorative Spancrete for the exterior materials. City Council should review these elevations with the architect. TIF As we have pointed out earlier, the parcel of General Pump is not an identified parcel in the Tax Increment District. No revenues will come to the District by virtue of this projeet. We have generally felt that it would be necessary to devote some increment funds to correct the soil problems on this site. Generdl Pump has identified several costs that might be similar to those allowed on identified parcels in the District. Aay contribution on this project would be up front funds, and not pay as you go. Council should review potential contribution to the project as part of the project approval. It would appear that soil corrections are estimated at $220,000. � : � � i � :� � i In addition to the Tax Increment request, all building permits issued in the Business or Industrial districts require a site plan review by City Council . This review should include site and building plans, grading and drainage, landscaping, lighting and parking. If City Council so desires, they should pass a motion approving the Site Plan and authorizing staff to issue a buildi.ng permit. PROJECT DESCRIPTION United Properties has proposed to develop and lease the corporate headquarters building for PrimeNet DataSystems, on a 15-year lease term, on an 8.87 acre site on Pilot Knob Road, immediately north of the Big Wheel/Rossi headquarters building. The proposed building contains approxima#ely 80,000 square feet, including approximately 25,000 square feet of office and 55,000 square feet of warehouse. The office portion will be two stories attached to a 24' clear height warehouse. The building will be fully-sprinklered, including extensive irrigated landscaping, and has signage and parking lot lighting to match our other developments in the business park. The exterior materials that are currently proposed include a combination of Dryvit and pre-cast concrete panels. The architect is Korunsky, Krank, Erickson Architects, Inc., one of the premier architectural firms in Minneapolis. They will ensure that all sides of the building are appropriately coordinated and detailed. Ernst Associates is the landscape architect, which has designed landscaping for all of the projects in the Mendota Heights Business Park, and will design the landscaping to be consistent with the other developments in the Mendota Heights Business Park. No variances are required at this time. We may however, request a sign setback variance of 20' at a later date if deemed necessary to fit this site plan. After working with sta� Mr. Ub submitted the attached proposal for Contract for Professional Planning Services. (Pl� attached.) . When City Council ordered the proposal to be submitted, they requested that following items be included in the study: 1. 2. 3. In addition, city staff should research the strip of land in the City of Mendota that is south of I�'ighway 110. The proposed contract addresses these requests by Council. Phase I is a fact finding and research process that concludes with a City CounciVPlanning Commission workshop., The workshop would provide direction for the Planner to begin Phase II, which is a study of options that would be reviewed by the Planning Commission. Another joint workshop will develop the preferred alternatives for land use, zoning and potential developments. Phase III concludes with a public hearing/presentation at City Council of the study's findings. Phase IV is the implementation of the any riew City development controls. � The proposed contract is designed in phases, which each phase to be released in writing by the City before it commences. LAND USE STUDY UPDATE 1. Area Reconnaissance Obtain updated state traffic projections for area. road system from MnDot. Review City ownership list of study area, land owners and businesses. Assemble updated County aerial photos of the area. for use in City meetings and updating land use maps. Augment map information with color slides taken during a study area visit with City Staff. � Optional services: Aerial photographs of key intersections and visual entries to the City to better study motorist views of adjacent property. Obtain from City of Mendota Heights noise contours for the study area. Obtain City information on land use issues such as engineering, local road capacity, open space, or existing land use conflicts. _ 2. Update Area Base Ma� Obtain County digitized ARC/INFO map through the City &om the County Surveyors Office. It is understood that this map will be cleaned and all pazcels closed or, the City may furnish the CONSULTANT with both a parcel map and topo map at 1" = 400', 200' and 100' for the study area. Optional Service: DSU may have to "clean" the data for completeness in order to make the mapping system compatible with other County and City data. Since the County is just producing this information, we are not sure how error free the data will be. The map information will give us property lines, building pads, parcel I.D.'s, treed areas, and topography. Planning Goals Review general planning directions with the Planning Commission and City Council at the workshop. Summarize these directions as specific goals for the study area. Identify specific areas for further study as additional services as needed. 2. Development O tn ion Based on the areas chosen by the Planning Commission and City Council at the workshop, two land use scenarios will be illustrated. These scenarios may include the concepts of: 1. City gateway 2. Needed support facilities for business park 3. County park land acquisition adjacent to Lake Augusta 4. Single family and multiple housing potential 5. Business and office potential These options will be reviewed with the Planning Commission at a regularly scheduled meeting. Each option will be expressed on the base map with a discussion of the implications. Optional Services: Other areas of study may be requested such as the intersection of FTighway 110 and Lexington to.Interstate 35E and other areas as may be designated by the Planning Commission or City Council. PHASE III. PROJECT PRESENTATION AND PUBLICATION It is anticipated that there will be a second workshop with the Planning Commission and City Council to review land use scenarios. This common Planning Commission/City Council Workshop will solidify the development options and Comprehensive Plan changes. This � workshop would be held before the public hearing is conducted. The findings of the Planning Commission, City Council, and consultant along with information prepared by City Staff and summary of owner interviews will be assembled in a final report. If Council is satisfied with the response the public has shown in naming these streets, I recommend that the Council vote on, and pass a resolution to adopt street names for the identified streets from those received. If additional street names are desirdble for Council consideration after this meeting, staff suggests that the consideration of street names by Council be delayed and that a press release be included in the Heights Highlites andlor a message be broadcast on the local cable access electronic bulletin board to solicit additional names . ACTION REQUIRED: Evaluate all the potential sh�eet names submitted to date, and if Council so desires, extend the date for submission of additional street names and publish the notification in other sources, or accept all the potential street names submitted to date, and adopt unique street names from those presented by council resolution. I spoke with Tony Winieke, Mn/DOT's Signal Design Engineer, today ta datermine the process the City needs to follaw to obtain Mn/DOT's approval. Tony infoxmed me that the key ingredient in Mn/D4T approval is a signed Traific Control Agreement. La.st meeting Council approved that agreement subject to the following twa changes: l. Agreement Condition Numbex 16 being changed to parovide fox Mn/DQT's consuitation with Mendoia Heights on tinning adjustments for the traffic signai. 2. Mendota Heights' sharing in the proceeds of any sal�age value, should the signal be removed. Tony reports that he unders#ands the City's concerns on these two issues however he reports that the agreement is one that is standard with a11 communities and he %s rer�iving resistance from other l�inIDOT st��ff inembers an making changes. Should Mendota �Ieights continue ta insist on these changes, there is a formal pracess at Mn/DOT whe,reby the pmposed changes are cQnsidered. First the changes are nin t�rough several departments for comment and then once the final language is detenmined, the agreement is sent to the Attarney General's office for amendment. The process is a slow one that would take several months, with no guarantee for success. Tony suggests that the City incorporate its concerns in a separate letter and approve the standard agreement as prepared. RECUI�/IlWIENDATION: I recommend that we heed Mn/DOT's advice and approve the Traffic Signal Agreement as prepareci and e�cpress our concerns about timing and salvage cost sharing in a separate letter (see attached). Upon approval of Agreement No. 72616, Council expressed a concern that the signal be timed properly so as not to create an increased traffic problem along Mendota Heights Road. During our conversations, you informed me that the signal was being installed to solve a traffic problem and that the State would certai.nly be willing to work with the City to solve any problems should they arise. The City Council was also concerned, that since the City is funding one half the costs of the signal, should it have to be removed for any reason, the City would share equally in any salvage value. Yqu reported to me that once traffic signals are installed, they are never removed.
