Page No. 23 May 4, 1988 CITY OF MENDOTA HEIGHTS DAKOTA COUNTY STATE OF MINNESOTA Minutes of the Election Canvassing Board Held Wednesday, May 4, 1988 Pursuant to due call and notice thereof, the Mendota Heights City Council met as an Election�Canvassing Board on Wednesday, May 4, at 12:30 P.M. in the City Council Chambers, 750 South Plaza Drive. Mayor Mertensotto called the meeting to order at 12:34 P.M., The following members were present: Mayor Mertensotto, Councilmembers Blesener, and Hartmann. Councilmembers Cummins and Witt had advised the Council that they would not be present. CANVASS OF PARK Results of the City's Park Bond BOND REFERENDUM Referendum were presented by the City Clerk, as attached hereto. Councilmember Hartmann moved acceptance of the canvass results as submitted by City Clerk Swanson, declaring the park bond issue to be defeated. Councilmember Blesener seconded the motion. April 26, 1988 Page 1 CITY OF MENDOTA HEIGHTS PLANNING COMMISSIQN MINUTES, APRIL 26, 1988 The regular meeting of the Mendota Heights Planning Commission was held on Tuesday, April 26, 1988, in the City Hall Council Chambers, 750 South Plaza Drive. Chairman Morson called the meeting to order at 7:30 P.M. The following membets were present: Morson, Anderson, Burke, Duggan, and McMonigal. Henning and Krebsbach had notified the Commission•that they would be unable to be present. Also present were Planning Consultant Howard Dahlgren and Public Works Director.•Jim Danielson. APPROVAL OF Commissioner Burke moved approval of the MINUTES March 22 minutes as submitted. Commissioner Duggan seconded the motion. Ayes: 5 Nays: 0 CASE # 88-09, Chairman Morson called the meeting to COPPERFIELD EAST, order for the purpose of a public hearing REZONING, PUD, & to consider a request from Copperfield PRELIMINARY PLAT, East Associates for a rezoning, PUD and HEARING preliminary plat for Copperfield 4th. Mr. Dick Putnam was present to explain the proposal. He noted that the property involved is the former George Weed property and consists of 9.3 acres. The proposed rezoning is from the current R - 1A, 40,000 square foot lot to R-1, 15,000 square foot lot sizes. Seventeen single family lots are proposed for this area. Mr. Putnam stated that the existing Copperfield covenants would apply to these 17 lots and the plan is roughly the same as for the Copperfield 3rd plan, with the average lot size being 20,100 square feet. Mr. Putnam stated that sewer and.water for the site comes from Stone Road to serve all the lots, with the land being located just south of the Montgomery Addition. The development has a looped street system, rather than an additional access point on Delaware Avenue. He noted that there are some large, mature trees along the property line which they would like to save, as well as remodeling the existing Weed home, if at all feasible. He pointed out that no grading will be done in the April 26, 1988 Page 2 area of the trees. Per staff request, Mr. Putnam agreed that the watermain size can be increased to 8 inches and the slope on Stone Road could be 5-6%, rather than 7%. Commissioner Dugan expressed concern with the fact that six of the 17 lots would need a variance to the 100 foot frontage requirement. He also was concerned with preservation of the mature trees. Planner Dahlgren favored the relationship of the proposed rear yards to the abutting Montgomery Addition's larger lots and felt it was very appropriate to try to preserve the Weed home. Chairman Morson asked for questions and comments from the audience. Mr. Mike Dwyer, 558 Stone Road, asked what the developer plans to do with the 25'-35' cliff off Stone Road and Field Stone. Mr. Putnam responded that it will be removed and will be a gradual drop. Mr. Dwyer also asked if there would be an increase in water runoff when the new lots are developed. He stated he has water in his rear yard now from the natural drainage. Mr. Putnam noted that the drainage amount will definitely be reduced after the lots are developed. Mr. Stewart Siebell, 2232 High Point Court, expressed concern with the increased density, increased traffic, a deteriorating road surface due to extra traffic and construction equipment, and root damage to trees from heavy equipment. Commissioner Duggan suggested video taping the trees before development and again after, to see that none were unnecessarily removed or damaged. He asked if this would be feasible and/or legal. Mr. Putnam stated that a lot with a mature tree on it is worth much more money than an empty lot. Mr. Siebell stated he would be very happy if the development were scaled back by April 26, 1988 Page 3 three lots, since he was very concerned with the extra traffic and the safety of his children. He also wanted to encourage stop signs on Huber Drive to slow down the traffic speeds. Mr. Chuck Gilbertson, 542 Huber Drive, also expressed concern with retaining the existing trees and with the proposed density. Mr. Putnam stated it would be possible to use snow fence around the trees to be saved from grading during construction. Ms. Kay Houghland, 2244 High Point Ct., noted that two of the smaller lots border on the west side of the development, those being Lots 1 and 2, Block 1. She asked that those lots be reconsidered. There being no further questions or comments, Commissioner McMonigal moved to close the public hearing at 8:40 P.M. Commissioner Anderson seconded the motion. Ayes: 5 Nays: 0 Commissioner Duggan reminded the audience to vote next Tuesday on the Parks Bond Referendum. He also asked Mr. Putnam if he would be willing to reduce the plan by 2 or 3 lots. Mr. Putnam stated he is not prepared to reduce the plan, and that originally he had looked at 19 lots for this site. He felt that if someone could give him a good reason for reducing the lots from 17 to 14, he may consider it, but he was not prepared to reduce the plan otherwise. Commissioner Burke moved to recommend approval of the zoning change from R -1A to R-1 PUD for the plat as submitted. Commissioner McMonigal seconded the motion. Ayes: 4 Nays: 1, Duggan Commissioner Anderson moved to recommend approval of the preliminaryplat called Copperfield 4th Addition, with the provision that every reasonable effort be made to retain the trees that are existing and compatible with this development. Commissioner McMonigal seconded the April 26, 1988 Page 4 motion. Ayes: 4 Nays: 1, Duggan CASE #88-08, JESCO, Chairman Morson called the meeting to INC., REPLAT, EAGLE order for the purpose of a public hearing RIDGE SUMMIT 2ND, to consider a request from Jesco, Inc. HEARING for the replatting of existing lot lines in Eagle Ridge Summit 2nd Addition. Mr. Bill Tuminelly was present to explain the request. He apologized to the members for not being present at the last meeting, when the matter was originally scheduled. The intent is to rearrange the lot lines on Lots 8, 9, 10, and 11, Block 1, Eagle Ridge Summit 2nd Addition because Lots 10 and 11 --are so small that it is difficult to design a house that would be compatible with the existing houses. The most feasible plan is to reduce the size of Lots 8 and 9, and increase the size of Lots 10 and 11, to allow construction'of•townhouses similar to the others in the area. He noted that Jesco will comply with Mr. Kieffer's request for additional screening along Lots 8 and 11. Chairman Morson asked for questions and comments from the audience. There being none, Commissioner Burke moved to close the public hearing at 9:04 P.M. Commissioner Duggan seconded the motion. Ayes: 5 Nays: 0 Commissioner Duggan moved to recommend granting of the replatting of the existing lots lines in accordance with the plans submitted. Commissioner Burke seconded the motion. Ayes: 5 Nays: 0 CASE #88-13, PASTER Chairman Morson called the meeting to ENTERPRISES, CUP order for the purpose of a public hearing FOR LIQUOR STORE, to consider a request from Paster HEARING Enterprises for a conditional use permit to allow a liquor store in the Mendota Plaza Shopping Center. Mr. Ron Krank, architect from Korsunsky and Krank, was present representing Paster Enterprises. Mr. Ed Paster, his mother Celia Paster, the President of Paster Enterprises, and April 26, 1988 Page 5 several others from the company were resent. Mr. Paster noted that he lives in Mendota Heights, on Douglas and Lexinton. He gave an update on the shopping center and showed several options for development in the rear of the center and along the westerly portion and around the rear portion. One of the options called for a raised roof structure and a raised pylon identification sign. •He noted that the covered walkway may also be removed to allow for direct access to the stores. He noted that the exterior remodeling is continent on approval of the liquor store in the center. An MGM representative felt that there is a market for liquor here in the City of Mendota Heights. Chairman Morson asked for questions or comments from the audience. Mr. Brian Birch, 755 Willow Lane, expressed concern with a liquor store coming into the community and was concerned that the major advertising thrust was aimed at the 15-16 year old market. He noted several liquor companies that do not put any money into rehabilitation of persons suffering from excess alcohol useage. He felt that MGM should be required to give a surtax to the City and that the police department should have input on the matter of a liquor store in the City. A representative from Paster Enterprises noted that the J. Phillips Company contributes to all programs. There being no further questions or comments, Commissioner Duggan moved to close the public hearing at 9:52 P.M. Commissioner Burke seconded the motion. Ayes: 5 Nays: 0 The MGM representative noted that this MGM store would have no territorial infringement on the West St. Paul MGM liquor store. Commissioner Anderson moved to not April 26, 1988 Page 6 recommend approval of the conditional use permit for an off -sale retail liquor store. Commissioner McMonigal seconded the motion. Ayes: 3 j Nays: 2, Duggan, Burke The majority of the Commission felt that the remodeling and updating should be done prior to asking for approvals for a liquor store. CASE NO. 88-11, Chairman Morson called the meeting to NORTHLAND LAND CO., order for the purpose of a public hearing PRELIMINARY PLAT to consider a request from Northland Land FOR MAC PROPERTY, Company for a preliminary plat of the MAC HEARING property, which is east and west of Pilot Knob Road, between TH 13 and TH 55. Mr. George Burkards and Mr. Dale Glowa were present from Northland Land Company and United Properties. Mr. Burkards noted that the property consists of 50 acres, 35 of which are west of Pilot Knob Road and the remaining 15 acres are on the east side of Pilot Knob Road. He noted that the right-of-way on Lemay Court will be 80 feet, rather than the indicated 66 feet, and also noted that this is the last of the Metropolitan Airports Commission land. There is presently no access on TH 13 to the site, but that development will take place before TH 13 is upgraded. There will be stop lights at Pilot Knob Road and also at TH 55 in the future. The property is to be divided into 12 commercial lots, all conforming to the lot size and frontage requirements for an Industrial area. Chairman Morson asked for questions or comments from the audience. There being none, Commissioner Duggan moved to close the public hearing at 10:13 P.M. Commissioner McMonigal seconded the motion. Ayes: 5 Nays: 0 Commissioner Duggan moved to recommend approval of the subdivision as requested, including the 80 foot right-of-way for Lemay Court, and the necessary easements being granted as noted in Public Works Director Danielson's memo of April 20, 1988. April 26, 1988 Page 7 Commissioner Duggan moved to recommend approval of a five foot side yard variance as requested to allow construction of a 20' x 28' garage at 1421 Clement Street. Commissioner McMonigal seconded the motion. Ayes: 5 Nays: 0 CASE #88-14, Mr. and Mrs. Joseph Schaefer were present SCHAEFER, WETLANDS to request approval of a wetlands permit PERMIT to allow construction of a single family home on Lot 3, Block 1, Spring Creek Acres, at 726 Marie Avenue. It was noted that there is ample room on the lot to construct a home without a wetlands permit, but that would involve removing a stand of mature evergreen trees fronting on Marie. The Schaefer's wished to preserve the trees. Commissioner Duggan commended the Commissioner McMonigal seconded the motion. Ayes: 5 Nays: 0 CASE #88-10, HOWE, Mr. Gordon Howe, 539 Hiawatha, was VARIANCE present to request a 6.47 foot side yard variance to allow construction of an addition to their existing home. He had. received written approval from his neighbor to the west, who would be most affected by his proposed addition. Commissioner Duggan moved to recommend approval of a 6.47 foot side yard variance as requested. Commissioner McMonigal seconded the motion. Ayes: 5 Nays: 0 CASE #88-12, Mr. Kelly Strebig, 1421 Clement, was STREBIG, VARIANCE present to request a 5 foot side yard variance to allow construction of a 20' x 28' garage on his property. He noted that his neighbor, Laura Scheibel has no objections, but her husband had some questions, but Mr. Scheibel never called him with his questions, nor was he present for the meeting. Commissioner Duggan moved to recommend approval of a five foot side yard variance as requested to allow construction of a 20' x 28' garage at 1421 Clement Street. Commissioner McMonigal seconded the motion. Ayes: 5 Nays: 0 CASE #88-14, Mr. and Mrs. Joseph Schaefer were present SCHAEFER, WETLANDS to request approval of a wetlands permit PERMIT to allow construction of a single family home on Lot 3, Block 1, Spring Creek Acres, at 726 Marie Avenue. It was noted that there is ample room on the lot to construct a home without a wetlands permit, but that would involve removing a stand of mature evergreen trees fronting on Marie. Commissioner Duggan commended the April 26, 1988 Page 8 Schaefer's for their high caliber presentation, noting that the color photos of the lot were very helpful, and he hoed that others. would be as conscientious in their presentations as Mr. and Mrs. Schaefer had been. Commissioner Duggan moved approval of a wetlands permit for Lot 3, Block 1, Spring Creek Acres, allowing construction of a single family home within 75 feet of a wetlands area. Commissioner Burke seconded the motion. Ayes: 5 Nays: 0 CASE #88-16, KILEY, Mr. Scott Kiley, 716 Spring Creek Circle, VARIANCE was present to request a variance to allow construction of a 22' x 22' detached garage 15 feet from Dodd Road. This property is Lot 8, Block 1, Spring Creek Acres. After discussion, Commissioner Anderson moved to recommend to the City Council that the application for a 15 foot front yard setback variance to allow construction of a garage 15 feet from Dodd Road be disapproved. Commissioner Burke seconded the motion. Ayes: 4 Nays: 1, Duggan PRE -APPLICATION Mr. Brian Birch and Mr. Steve Wentworth MEETING TO were present to discuss proposed plans to CONSIDER CAR WASH locate a car wash on Mr. Birch's property north of the Mendota Heights Animal Hospital off Freeway Road. They showed a model of their proposed car wash and noted that it would be a two story structure, with 4 bays self-service and 1-2 bays automatic washes on the lower level with offices on the second floor. There would be 1000 psi in each bay. The building would be concrete block exterior with 10 foot Anderson windows in the second story. Mr. Birch noted that Dr. Koepke had no problem with the car wash and the Miller's across the street from the site are opposed to anything on that corner. After considerable discussion, Commissioner Anderson moved that no such April 26, 1988 Page 9 amendment be made to the zoning ordinance to include a car wash in Mendota Heights and that the ordinance should be left as is. Commissioner McMonigal seconded the motion. Chairman Morson felt that this B-2 site is inappropriate for a car wash. Ayes: 4 Nays: 0 Abstain: 1, Duggan VERBAL REVIEW Since the applicant did not appear at the last meeting, there was no verbal review. MISCELLANEOUS Commissioner Anderson noted that he felt the Commission should only address items on the agenda and should avoid political issues. APPROVAL OF Minutes of the March 8 meeting were approved MINUTES as amended to read under "Tot Lot: Curley Valley View Neighborhood" Which residents would like to see developed as a play area. PARK MAINTENANCE General maintenance at all parks has been undertaken. They will upgrade all parking lots by addition of more gravel, filling sand around play equipment and wood play structures. Tilling and dragging ballfields - normal trash and debris clean up - tree trimming - tennis courts are adequate but might need to resurface Friendly Hills tennis courts next year ... this summer will repaint hockey boards at Ivy Falls and Friendly Hills. REQUEST FOR PARK Dr. Pilney and several residents from that IMPROVEMENTS IN neighborhood presented the history and CURLEY'S VALLEY nature of their request - presented VIEW preliminary proposal suggesting that the neighborhood residents could create a good playground on the lot in question (City owned) for approximately $10,000, rather than the $24,000 estimate for a City constructed park. One of the neighbors in that area is in the business of designing and construction public playground facilities and would donate his services. Dr. Pilney and Chris Schneeman stated that the neighborhood is enthusiastic about the idea and they propose to provide a plan of the playground and will include materials and detailing for City approval. Will provide an itemized statement within two weeks detailing how the money would be spent, and provide to Parks Commission for study prior to next meeting. The Commission April 12, 1988 Page 2 voiced general approval pending more detailed plans. There was some concern regarding the setting of a precedent but since the City owns the lot already, and the area had previously been promised as a play area, and then ignored, it was felt that these special circumstances justify such an endeavor. GRADING PLAN Administrator Frazell described the plan VICTORIA which basically ties into the park dedicated HIGHLANDS on Diane Road (adjacent). Drainage will dictate the use of the area which is approximately 10 acres. NAMES FOR NEW The Commission informally discussed possible PARKS names for as yet unnamed parks. MH DAY AT ZOO Decision was not to participate in this event which was offered in a letter from the Minnesota Zoo. COMMUNITY Decided to set this aside temporarily until RECREATION Administrator Frazell can contact the person SURVEY conducting the survey. PARKS BOND P.R. parties are progressing well and REFERENDUM promotional parties are planned. Voting will be May 3. It looks as though the issue may be brought before Council. Katz also mentioned phone call from John Wallace who lives in Sibley area and would like to see a play area in that neighborhood. Ken has recently passed his probationary period as Firefighter with the West St. Paul Fire Department and was accepted as a full ti me firefighter wi th them. Ken had always been a committed firefighter wi th our department starting his employment with the Fire Department in February of 1978. In June of 1984 Ken was appointed Caption to fill the position left vacant by the appointment of Bill Lerbs to Assistant Fire Chief. Ken was then elected to three consecutive one year terms as Captain by the membership of the Department. Also, during Ken's tenure he served as the Fire Department Saftey Representative since July of 1984 and also as chairman of the Fire Department Fire Prevention Committee. Through Ken's efforts and direction we now have a very active Fire Prevention Program in all of the schools that are located in Mendota Heights. On Behalf of the Fire Department I would like to say that Ken's dedication to the fire service in Mendota Heights will be missed. Ken will be recognized at our annual Fire Department Relief Association dinner in February of 1989. Valuation increases were put on some types of property in some jurisdictions for the 1987 assessment by the State Board of Equalization. These increases were necessary because the minimum acceptable level of assessment of 90 percent of market value was not attained. Enclosed is a copy of the order which put these valuation increases on certain property for the 1987 asessment. If a taxpayer feels that his or her property has been overvalued for the 1987 assessment as a result of a state ordered increase the county assessor can explain to the taxpayer the appeal and abatement procedures. The local board of review should not address complaints regarding the 1987 assessment. The local board of review has jurisdication only over the 1988 assessment. The local board can not change any 1987 assessment. The State Board of Equalization has not yet reviewed the 1988 assessment and no increases have been ordered by the Board up to this point. Therefore, questions regarding the valuation or classification of properties for the 1988 assessment will have to be addressed by the local board of review and the county assessor's office. The State Revenue Department does not have assessment information on specific parcels of property and so we are unable to help taxpayers when they call us with questions. We would appreciate it if you would mention these facts at your local board of review since there does appear to be confusion on the part of many taxpayers as to where to go for answers about the assessment on their specific parcel of property. Swanson City Clerk SUBJECT: Marriott Courtyard Liquor License Renewal INTRODUCTION The licensing year for liquor licenses of all types runs from July 1st through June 30th. The applicable Ordinance (No. 1403) stipulates that Council shall conduct a public hearing on all applications for renewal of liquor licenses. DISCUSSION The Marriott Courtyard Hotel has applied for renewal of its Limited Service Hotel and Motel on -sale and Special Sunday on -sale liquor licenses. The applicant has submitted all application materials, including insurance and bond forms, and a statement of liquor to food sales ratios for 1987. Police Chief Delmont and I have reviewed the application contents and find everything to be in order. Our experience with the Marriott Courtyard during its first full year of liquor licensing has been excellent. We have found the staff, both local and corporate management, to be very cooperative, and have had no problems relating either to the hotel or liquor operation. RECOMMENDATIONIACTION REQUIRED Staff recommends approval of the renewal of the Marriott liquor licenses, subject of course to any public comments Council may receive at the public hearing. If Council concurs in the recommendation, it should pass a motion approving the renewal of on -sale limited service hotel and Special Sunday on -sale liquor licenses for the Courtyard by Marriott Hotel. Attached is a small booklet prepared by the applicant indicating the nature of their proposal and their request for a Conditional Use Permit for a new MGM Liquor Warehouse International store. The store would be 7,500 square feet in area and would be located contiguous to the existing Snyders Drug Store. 2. The applicants purchased the shopping center last year. They are experienced shopping center developers and managers, and many of us hoped that significant improvements would occur. The Country Club Supermarket has moved out, therefore, there is considerable challenge to modify and improve the center. i 3. In discussions with the applicants (Ed Paster and his associates) Kevin Frazell and other City Staff persons, we have emphasized the community's strong interest in the need and desire to improve the center and "turn it around". Therefore, it is suggested that in conjunction with this application for a Conditional Use Permit, preliminary plans be presented to the Planning Commission and Council indicating the applicants' intent and level of commitment to do so. 4. Attached is a sketch indicating a revised facade for the front of the structure. The applicants inform us, however, that they intend merely to paint the other exterior walls. We suggest that in order to upgrade and substantially* improve the center, that more significant architectural changes may be necessary. 5. The applicants inform us that the nature of the MGM Liquor Warehouse concept will be different at this site. We suggested that additional detail regarding the nature of these differences could be important to the consideration of the Conditional Use Permit. Listed below are the salient points that staff recorded from the April meeting: 1. On simultaneous take -offs, all flights departing runway 11L must maintain a runway heading until the end of the runway; runway 11R must maintain a runway heading until reaching the middle marker. /0° ,/2. All plans will maintain assigned heading until they are 4 miles from the end of the runway or achieve C , 3000 feet above ground. 3. On simultaneous departures, planes departing runway 11L should be given a heading no more than 10 V degrees north of extended runway centerline, and �r those departing on runway 11R no further south than five degrees south of extended runway centerline. 4. Once depart�'n.q- E s achieve 15 degree separation, they -must maintain the me heading for four miles or 3000 feet above ground`` 5. On non -simultaneous departures, there will be no turns from the runway centerline on runway 11L. 6. The property in question was purchased by the Metropolitan Airports Commission about twenty years ago at which time there was a series of - single -family houses located westerly of Pilot Knob Road on two cul-de-sacs known as Acacia Lane and Matilda Street. At that time the City also owned a neighborhood park in the area which was also purchased by the Metropolitan Airports Commission. Their principal reason for the acquisition was the deleterious impact of aircraft noise levels. 2. Subsequent to that time the land was rezoned from R-1 single-family residences to the Industrial Zone. A joint committee was established between MAC and the City of Mendota Heights with the objective of putting the land back on the Tax Rolls for industrial development. That objective has been achieved through the ultimate sale of the land to United Properties, who now proposes to plat the land for new industrial development. 3. A portion of the land was developed through the sale of a parcel to MnDOT for the construction of a district maintenance facility. That development was accompanied by the dedication and the partial completion of Lemay Avenue, which forms the northerly • boundary of the larger area of land involved in this plat (on the west side of Pilot Knob Road). 4. Some years ago our office, working for the Metropolitan ;Airports Commission, did a layout of the land illustrating how it can be developed for industrial purposes. The current proposal is very similar to that development plan which consists of a loop street providing two points. of access to the 34.42 acres divided into seven .lots on the west side of Pilot Knob Road. 5. The property on the easterly side of Pilot Knob Road is proposed to be developed with five lots, four of which will have access off a proposed cul-de-sac which will be the extension of Lemay Avenue. This area consists of 15.11 acres (including right-of-way). Thus, the total acreage involved is 49.53 acres. The difference is in the land that has been dedicated for State Trunk Highway and County Road purposes, prior to the sale to United Properties. 6. Contiguous to the old Sioux Line Railroad right-of-way and Trunk Highway 13, the land will be graded to a 3 to 1 slope so as to create a fairly level pad at the far west end of. the property. Therefore, much of the land will not be highly visible from Trunk Highway 13. However, Trunk Highway 13 will be rerouted to the new alignment southeasterly of the property where the land will be highly visible because the Highway will be graded to pass over the railroad tracks. 7. A series of drawings have been prepared by Howard, Needles, Tammen._ & Bergendorf, a national architectural, engineering, and planning firm with local offices. The grading of the land, streets, and installation of utilities has been carefully worked out in cooperation with the City Engineering Staff. You will note the rights-of-way for the streets are 80 feet wide with 44 feet of paved surface. The right-of-way for the cul-de-sac east of Pilot Knob Road is shown to be only 66 feet. This should be changed to 80 feet. Therefore, the development will be commensurate with the high standards established and maintained in the other parts of the Industrial Park of which United Properties has developed a considerable portion. 8. It would appear that a positive action on the development proposal will enhance the City's nonresidential tax base in conformance with the original tax strategy of the City developed over a period of many years. The fact that this land has been held off the market for such a long period of time, may prove to be an advantage. Now that the locational quality of the site is obvious due to the completion of the Freeway System and the demand for well placed industrial land, this property will be in a position to achieve its best potential. The Strebig residence is located just west of the end of Clement Street where it stops at the base of the hill a short distance south of First Avenue. The property is occupied by an existing house and attached garage which, is 241 x 241. The applicants propose to add an extension to the rear of the garage 281 x 241 for the purpose of providing additional inside storage. Attached is a copy of a letter from the applicants, Kelly and Susan Strebig, noting their reasons for their desire to add to the garage as proposed. 2. Staff has reviewed this development proposal with the applicants, and it appears that if they intend to add to the capacity of their garage, this rather unusual method may be the most appropriate for this site. There is inadequate space on the lot to provide a driveway around the house or garage so as to provide a separate garage facility in the rear of the lot. There is, of course, adequate space in the front of the lot, because the corner of the garage is already 30 feet setback from the front lot line (as required by ordinance). Though the expansion of the garage to the rear is not considered as convenient and efficient, it is a method of providing for additional storage, particularly if that storage is not necessarily for cars used everyday. The obvious disadvantage is that if four cars are parked in such a double depth garage, two of the cars are parked behind the other two. 3. We had suggested in reviewing this with the Strebig's that they contact their affected neighbors, particularly the neighbor to the north. We are not aware as of this date whether or not that has been , accomplished. Obviouslyt the neighbor to the north is most impacted because their house is near the proposed garage extension to the northwest. It does appear, however, that if a substantial addition to the garage is to be made, that the technique proposed in the site plan presented is perhaps the most valid approach. April 5, 1988 Planning commission; We are making this request for a side lot variance of five feet for two major reasons. As our family and possessions have grown over the 18 years in this house we no longer have adequate storage space. We do not want to construct a yard storage shed to store our lawn mowers, tools and other equipment in because we feel that a yard shed would detract from the appearance of our house. We also have more cars that our present garage will hold and another teenage driver coming up. We do not like the appearance of cars parked in the driveway, the inconvenience and safety problems of scraping windows in the winter, and the security problems of leaving cars outside. The property has a unique feature in the existence of a strong, mature stand of evergreen trees in approximately the location where a house would be constructed if it were to be setback the normal 30 feet from the right-of-way line of Marie Avenue. As you will note from the attached drawing submitted by the applicants, they propose to locate the house south of this stand of trees, thereby making the distance 75 feet from the deck of the proposed structure to the center line of the creek. As you know, a distance of 100 feet is the normal standard. 3. Obviously, in this case, the Schaefer's could build their house further north on the property, cut down the trees, and not be involved with a variance to the wetlands setback. The purpose for the setback requirement is to protect the function and aesthetics of the drainage system. In this case, the system is not threatened since there is considerable high ground where the home is to be located (as proposed). You will note that a substantial portion of the house appears to be approximately 80 to 85 feet from the creek line, and portions of the house are more than 100 feet. 4. Therefore, it would appear that perhaps preservation of the trees is a matter of reasonable concern. Certainly, the view from the street will offer a rural vista to a greaten extent than if the house were fronting 30 feet from the roadway as would typically be the case. They built an attached double garage and now propose to add a detached double garage to accommodate a boat and other storage. Attached is a statement from the Kiley's indicating the nature of this concern. 2. It would appear that if one is :to add a second detached garage to the site, the location proposed is perhaps the most appropriate. The site plan indicates it is 10 feet from the south property line of the lot and 15 feet from the Dodd Road right-of-way. The drawing indicates the existing home to be setback 50 feet from the Dodd Road, right-of-way and over 40 feet from Spring Creek Circle. Based on our observation of the site, we are concerned whether or not this is accurate. i 3. It is true that the placing of the garage as proposed tends to screen portions of the back yard from Dodd Road. This is perhaps one; of the good things about the proposal. Certainly another positive aspect is that the variance does not involve the reduction of vehicular parking space. There is also some tree growth along the west side of Dodd Road. 4. The applicants inform us that they oriented the garage doors of the built-in garage away from Spring Creek Circle. It is true that the house is very attractive from this view (from the north). The new garage will, of course, face Spring Creek Circle, but will be a considerable distance back on the lot. E 5. It would be helpful if members of the Planning Commission and Council could view this site in consideration of this proposal. RE: Amendment to the Zoning Ordinance Regarding a Car Wash On Monday, April 4th, during our regular office hours in the City of Mendota Heights, Brian Birch dropped by with Steve Wentworth of K Building Maintenance Company with a proposal to construct a car wash on Mr. Birch's property north of the Veterinary Clinic off Freeway Road in Mendota Heights. They submitted •a preliminary site plan, a copy of which is attached, indicating the proposed structure to be built on the northerly portion of a irregular shaped lot with additional parking on the southerly portion of the property. We suggested to .these gentlemen that: A. The zoning ordinance does not list a car wash as a permitted or conditional use, therefore, it would be our suggestion that such a use should be considered to be added to the ordinance as a conditional or permitted use in one or more of the zoning districts. B. Adding the use to the district would have to occur before any action could be considered with respect to any specific proposal or location in the City. C. They could initiate the request. by addressing a letter to the City Administrator to that affect, but that the *City may or may not consider it appropriate to add the use to the B-2 District. D. Car wash facilities can be attractive and functional, but frequently are not, and the existence of such facilities in a neighborhood setting could be in question. E. We would regret to see Mr. Birch attempt to utilize this irregular I shaped piece of parcel when, in fact, additional right-of-way may be released in the near future making this a more developable parcel than it is today. Car Wash in B-2 District Page 2 F. We suggested, therefore, that Mr. BIrch not proceed with any development on this parcel as of this time and, particularly, that it not be a car wash facility. G. The concrete block building material proposed by Mr. Birch would be totally inappropriate since the existing structures in the area are built of brick. We suggest that a car wash can certainly be added to the ordinance, but we do not recommend it being added to a neighborhood B-2 District. In the location in question, there are single-family uses to the west, north, and east. A car wash : facility in a community like Mendota Heights would be more appropriately .located in the Shopping Center District or the B-3 District. The category of Service Station exists as a conditional use in the Shopping Center District only. In view of this fact, we suggest that a car wash be added to the Shopping Center District. It may be appropriate as a part of the expanded center that a well designed "auto mall" could be developed. This is a collection of auto oriented facilities built like a shopping center to better serve the public. There is relatively little business land available in the City. It would appear that in this .community the potential for locating a car wash in conjunction with other automobile services can be best accommodated in the shopping center. Therefore, we suggest that the car wash not be listed as a permitted use or a conditional use in either the B-2 or B-3 Districts. It would, in our opinion, be appropriate for the Planning Commission to consider adding a self service or- automated car wash as a conditional use to the SC Shopping Center District. The Planning Commission and Council may wish to consider making It a Conditional Use "in conjunction with other automobile service facilities". This would make it more likely that such a service would be combined with other automobile services providing a more attractive and efficient service facility. Swanson City Clerk SUBJECT: Liability Insurance Limits for Contractor Licenses INTRODUCTION Council may recall that an amendment was made to the contractor licensing ordinance last year at the urging of the City's loss control adjustor. The adjustor felt, and recommended, that the limits of liability required by contractors should be the same limits held by the City in its liability policy. We did not believe that Increasing the limits would pose significant difficulty for contractors and therefore recommended adoption of the amendment: experience has proven that the new limits are unrealistic and in some cases impossible to achieve without significant hardship. DISCUSSION The limits of liability in effect prior to the June, 1987 ordinance amendment were as follow: "public liability insurance shall not be less than $100,000 for injuries, including accidental death to any one person, and, subject to the same limit for each person, in aniamount of not less than $200,000 on account of any one accident and property damage insurance in the amount of not less that $50,000 for each accident or mishap." The ordinance amendment raised those limits to the current level of $200,000, $600,000 and 150,000 respectively. It has been brought to my attention recently, both by an insurance carrier and by a contractor, that policies cannot be written for $600,000 but rather can be written for limits of $500,000 or $1,000,000 (or greater). Nancy has also informed me that she has had very many complaints from contractors about the new limits. It appears that most of the smaller carriers cannot provide the $1,000,000 coverage and the cost to the contractor to write policies with new carriers who can provide the coverage is far greater than is practical. In many instances the $600,000 limit has had1the effect of restricting many good contractors from doing business here. This was certainly not the intent of our recommendation to amend the licensing limits. Indeed, many of the contractors f F currently licensed are working under insurance certificates which were in effect prior to the ordinance amendment and which do not meet the ordinance requirement. When the policies come up for renewal, many of the insurers will likely not be able to provide the required coverages. RECOMMENDATION The effect that the Ordinance amendment has had was certainly unintended and unanticipated at the time of its recommendation. So that the City might have realistic limits and still recognize the concern of its loss control adjustor, and in response to an additional concern of Peter Tritz, LMC insurance expert, who recommended that the property damage limits be substantially increased, I recommend that Council repeal Ordinance No. 233 (attached) and adopt the attached proposed ordinance amendment which establishes the liability limits at $200,000/$500,000/$500,000. ACTION REQUIRED: If Council concurs in the recommendation, it should pass a motion adopting Ordinance No. 254, "AN ORDINANCE REPEALING ORDINANCE NO. 233." Director SUBJECT: Ivy Creek Informal Hearing DISCUSSION• Last summer after the "Super Storm", the City received a number of complaints from concerned residents living next to Ivy Creek about what was going to be done by the City to repair, maintain, or upgrade the creek. One resident, Mr. Jack Brassard,, who lives by the creek, experienced some damage and applied for a wetlands permit to do some bank protection improvements on his own and at his own expense. Mr. Brassard was going to be out of town for the winter, so Council asked that he delay starting the work until spring, at which time the City would have an informal meeting with all the residents living near the creek to see what the, general concensus was on what actions the City should take to improve the creek (should there be an assessment project to improve it as' we did upstream through the golf course, or should it just be cleaned up and who would pay for that?). Eckles Civil E�gineer SUBJECT: Watermain Extension 11761Sibley Memorial Highway and Adjacent Areas (Cornick) Job No. 8712 Improvement No. 87, Project No. 6 INTRODUCTION As a result of the July 1987 super storm the Cornick residence at 1176 Trunk Highway 13 was flooded, resulting in a contaminated well. The Cornick residence and Savage residence (Cornick's neighbor in Mendota) are currently without water; St. Paul Water Utility will not allow them to make a temporary hook up to the system in the Lexington Court Townhomes. Cornick and Savage have requested -that the City investigate methods of providing them with water. There are no viable alternatives for providing water to Cornick and Savage, other than the extension of city water. The Rehfeld residence of Lilydale is interested in hooking up to city water if it becomes available. With all these issues emerging, it has become necessary to complete a .feasibility report for installing a watermain system along the highway. :The costs and funding mechanisms for such a project are presented below: DISCUSSION In order to serve the Cornick residence with water, a 1600 foot watermain downlTrunk Highway 13 must be constructed. As a result 5 residences andlone vacant lot will be served on the Mendota Heights side of the highway. Also the Rehfeld lot on the Lilydaie side will gain the potential to hook up in the future. The Savage residence will have the potential for service, but not without coordination with the City. of Mendota. The construction of the watermain will enable the city to provide water to other portions of Mendota.in the future. The cost to install a watermain system to serve the 6 Mendota Heights property owners along Trunk Highway 13 will be $93,300, including the cost for construction, easements, service leads, engineering, overhead, and contingencies. There are.three possible sources of funding for such a project. Assessments are the conventional method of covering the costs of such a project, but the few number of new homes that will be served mean that it isn't feasible to assess all costs. Another source of funding is water revenue fund. However, this fund is not normally used for watermains that aren't part of the trunk watermain system. The third and most promising source of funding for this project is Community Block Grant Development money from HRA. CBGD money is available for low and moderate income residents or for occasions when there is an "imminent threat" to a residence. Due to the fact that Cornick has virtually no other source of water, the residence may be classified as an imminent threat by HRA. If this is the case, HRA funds might be available to fund a portion of the project. According to County officials there will be a decision made by mid-May as to the acceptability of using HRA funds for such a project. Assuming that HRA would aid in reducing the cost of the project to a level that yields assessment rates that are acceptable, the table below is a breakdown of the allocation of costs. If HRA does not participate in the funding, the project will not be feasible. Note that the lot owner assessment is based on what a normal large lot in Mendota Heights would be assessed for water ($3,000 for watermain and $700 for water service). Rehfeld) ever wishes to hook up to the system, a hook up charge would be necessary. The Savage residence would not gain immediate service from the Mendota Heights system. The main could be extended far enough to provide him service, but funding mechanisms would have to be arranged between Savage, HRA and the City of Mendota. Unless these arrangements are made, this project will only include service up to the city limits. RECOMMENDATION Staff recommends council approve the use of HRA CBGD funds for this project, approve the feasibility report, and.order a public hearing. Fr eJ,/ �y Administrator ;SUBJECT: Park Bond Park and Centex Developer's Agreement Regarding Purchase of Southeast Area Park Property i In late December, 1987, Council gave approval to Developer's Agreements with Centex Corporation for construction of the Kensington Planned Unit Development. The joverall agreerient for the entire PUD provided for construction of 500 multi -family units on 102 acres. Included in the project was the option for the City to purchase approximately 35 acres for the southeast area recreation site submitted to the voters in the referendum of May 3, 1988. A second Developer's Agreement set forth the details for construction of Phase I, 136 units, of the overall PUD. The referendum which would have provided the $750,000 for the City to purchase the park property was defeated by the voters on May 3. Under the agreement, however, the option to purchase this property does not expire until July 30, 1988. Therefore, Council needs to indicate whether it has any intention of considering an alternative source of funds for purcI ase of the property. Due to extensive legal review, the agreements were not signed by the {developer until approximately two or three weeks ago. Had the referendum passed, it was staff's intent to bring the final documents (there were a few slight revisions) to the Council this evening for its authorization Ifor signature.I Both agreements, however, are mainly premised jupon the City purchasing the park property, so if we are not going to exercise the option, there is a question whether ithere is any point in executing them at this time. The obvious question now is where do we go from this ,point with a parks referendum. Council, the Planning Commission, and Parks Commission, are scheduled for an all day team building and priority setting session on Saturday, June 4. We will be working with facilitator Don Salverda. It is my suggestion that we schedule this as a topic for discussion at that meeting. Centex President Tom Boyce has indicated to me that they would like to proceed with Phase I of their approved plan, the 136 townhomes, subject to obtaining the Indirect Source Permit from the PCA. If the Council does not intend to exercise the option to purchase the park property, Centex is also interested in reverting to Plan A, Planned Unit Development for the remainder of their property. Staff and the developers will be meeting Tuesday afternoon to discuss the status of the projects and the Developer's Agreement. I can be prepared to update Council at the meeting, but will not be requesting any action on these items, except as outlined below, and the action would be scheduled for the meeting of May 17. ACTION REQUIRED: Council should indicate to staff whether it has any intention of exercising the option to purchase the 35 acre community park site, using some source of funds other than the proceeds from a bond referendum.
